he mood was buoyant and the undertone bullish, as the the BSE Sensex closed at a new high at 21,239 after it touched a record high of 21,321 intra-session in the special Diwali Muhurat session, yesterday. While 1561 shares advanced, 468 shares declined, and 97 shares were unchanged. Among the Top Gainers were Tata Motors, Jindal Steel, Sun Pharma, Maruti Suzuki and Tata Power. The losers included ICICI Bank, M&M, HDFC Bank, L&T and HDFC. Among midcap stocks, the top performers were Indian Bank, Amtek Auto and Sadhav Engineering. The Nifty also ended at its highest closing level at 6317.

alpractices by various top colleges across the city have surfaced during scrutiny by Local Inspection Committee (LIC). Though these colleges have provided a detailed list of students to the MU for a book bank scheme, the ADC has managed to get records of few colleges which indicate that there is possible manipulation of the number of students shown and the actual number of students eligible for the scheme. According to the Maharashtra Universities Act, 1994, the University has to provide a certain amount of money to affiliated colleges in order to maintain a book-bank scheme. This amount has to be utilised by colleges solely to issue books to students belonging to

Scheduled Castes, Nomadic Tribes and Scheduled Tribes. Colleges have to submit the total number of students under each reserved category so as to claim the amount for each student under the scheme. Last week, the LIC visited around 15 colleges and was shocked to learn that although colleges have taken funds for the book-bank scheme, most did not have books from the syllabus. When the committee checked the records, it was found out that colleges had manipulated the students’ lists and added extra students to claim more funds under the scheme. According to reports submitted by Joshi Bedekar College (Dombivli), the institution has reported 538 students from various reserved categories to claim the book-bank scheme funds, but the inspection reports reveals that there are only 229 such students. Sanjay Viral, Senate Member, MU said, “We were shocked after we tallied students’ records submitted to the varsity and the facts that emerged after visiting the college. We realized that colleges had manipulated the records. Colleges like D.G Ruparel have been charging money for the application forms which is not correct procedure, as these forms are to be given free of cost. Some colleges like Podar College have started their own BookBank scheme. Chetana, Gokhale and B.R Patil college (Dombivali) have been produced wrong figures to the varsity and the authorities should punish them severely.” As per records, the book banking scheme has been implemented for 26,000 students. Each college has been given between Rs.10,000 to Rs.2 lakh, depending upon the number of students from the SC, NT and ST categories and applicants for the scheme. Dr. Naresh Chandra, Pro Vice Chancellor, MU said, “After the varsity verifies the reports, we can step ahead and take necessary action. If the figures were manipulated, colleges will surely be punished for their fraudulent act.”

Jalpa Bhuta, Consultant Psychiatrist at Global Hospital, Parel recently handled a case of a 21-year-old girl from Mumbai who would periodically go into a state of trance and then exhibit a change in demeanour and style of talking. She would start abusing her mother in the way their abusive neighbour, whom the family isn’t on good terms with, does. For a layman, this might seem like a case of black magic but psychiatrists call this Possession Syndrome. “In Possession Syndrome, there is a temporary loss of integrity of memory, identity and awareness of surroundings. During such episodes, the person goes into a trance like state and starts adopting the mannerisms and demeanour of another person. Suddenly, there is more energy and strength in the person. Such episodes may last for an hour or so after which the person feels drained. Also, he or she doesn’t re-

member anything that has happened. In the above case, the family’s first thought was that their daughter was a victim of black magic and took her to local faith healers. But when that did not help, they came to me. It was after several sessions that the actual reason behind the girl’s behaviour was revealed. The girl had recently got engaged and the gold that was given by her mother to her daughter-in-law was much more than what she had received and the girl’s to-be in-laws had apparently mocked her about it. This had affected the girl, but she couldn’t talk to her mother about it as she feared offending her. The feeling kept growing and she finally started venting by behaving like her neighbour and abusing her mother,” said Dr. Bhuta. The relatives of the deceased protested before the Additional Divisional Manager who visited the spot, and demanded immediate action against those responsible for the accident. According to railway officials, on Sunday morning around 9:55 am, the Koyna Express which was going towards Kolhapur from Mumbai hit the four gangmen who were working on the down fast track near Kalyan railway station, killing them on the spot. The names of the deceased are Jaychand Gangaram (53), Dattram Devji (56), Hari Nana (58) and Pandurang Ghare (53). Because of Diwali, the Central Railway had not undertaken its megablock on Sunday for the convenience of commuters, but the gangmen were working on the track, doing the maintenance part of their job. Ravindra Ghare, a relative of victim Pandurang Ghare, said, “We have decided not to perform the last rites of the deceased until strict action is taken against the culprits.” The ADRM of CR, Hari Shankar Varma, who visited the spot, assured them that action would be taken against those responsible within 72 hours.

hat an issue as important as Infrastructure should become politicized in an election year is to be expected. The woes of the government in ensuring that big ticket infrastructure projects like Metro and Mono Rail are completed on time were best articulated by MMRDA metropolitan commissioner UPS Madan last week, who talked about how improper ducting of underground public utilities and congested localities were delaying construction of pillars as the design had to be changed in some cases, leading to delays. Madan expressed optimism about starting the first leg of Metro and Mono Rail by this Decembe. His boss, the chairman and Chief Minister Prithviraj Chavan, has already admitted that he was not pushing for completion of the infrastructure projects on time. MCHI-Credai chairman Vimal Shah hit the nail on its head when he pointed out that delayed government clearances were the prime reason for cost escalation of real estate projects, not just infrastructure projects. Take the case of the crucial eastwest connectivity infrastructure project of Santacruz-Chembur Link Road (SCLR) which is further delayed as the Central Railway is yet to decide on granting mega blocks on its

Be it the CongressNCP alliance or the Mahayuti alliance of the BJP-Shiv SenaRPI-A or the ramshackle socalled Third Front alliance, the picture is the same wherever you look. The NCP, making its presence felt at the first grand meeting of the Third Front alliance, has predictably failed to raise any curiosity. In a quick flip-flop the NCP has clarified that it will not leave the Congress led-UPA fold. The unmistakable message to the Congress was that if it did not agree to allocate more Lok Sabha seats, then its options post elections were open. However, the wily, smart Congress has refused to bite the bullet and even sarcastically reminded NCP chief Sharad Pawar that, just as he swallowed his self-pride and later accepted the leadership of the Congress president Sonia Gandhi, he would eventually accept the leadership of its vice president Rahul Gandhi. The BJP-Sena alliance too faces a difficult proposition in accommodating the demands of its new found ally the RPI-A. Until now the saffron allies did not have a third partner to share, but now faces a new difficult challenge of sharing their sufficiently large pie with the third partner. And there the problems start often leading to sour relations and eventual break-ups.

Con woman would offer spiked tea to victims and relieve them off their ornaments

54-year-old woman, who claimed to be a Brihanmumbai Municipal Corporation employee, was arrested by the Tilak Nagar police on Sunday for allegedly drugging helpless relatives of patients and robbing them of their gold ornaments. According to police officials, they had received three complaints in the past 15 days from people queuing for treatment outside the civic hospital. The complainants, who were mostly women, told the police that they were waiting outside the hospital when a woman, wearing a BMC employee badge, approached them and claimed

that she was a sweeper with the BMC and could help get a doctor's appointment or even a bed in the hospital. Not suspecting her, the people decided to take her help. The woman, while talking to the victims, Kusum Diwangi would take them for a cup of tea to the nearest stall, and while they were busy telling her of their problems, she would spike their tea. When they became drowsy, she would swiftly take off their gold ornaments and flee. "After receiving complaints, we began

making rounds of the civic hospitals in the vicinity and kept a watch on the women sweepers," said API Vaijnath Upase, from the Tilak Nagar police station. The police observed many women sweepers around the hospitals, and then noticed one approaching relatives of patients and talking to them. The police promptly detained her and then called in the complainants of the earlier cases, who identified her as the woman who had drugged and robbed them. The accused, identified as Kusum Diwangi, was arrested for cheating and theft by the Tilak Nagar police, who revealed that there are similar cases registered against her in Sion and Chembur also.

n a shocking incident, a 65-year-old woman set herself on fire at her Bhandup residence on Saturday morning. The police said that the woman was facing severe depression as she had suffered a string of tragedies, beginning with her elder son’s demise and the recent death of her younger son and his wife. The cops said that the grand-daughter of the victim was in a local hospital where she had been admitted for treatment of dengue. Nirmala Mudaliyar, a resident of New Sai Ganesh Building of the MHADA colony in Subhash Nagar at Bhandup (West), lived on the 6th floor with her 17-year-old grand daughter, Neha, police said. On Saturday, at around 10 am, Nirmala doused herself with kerosene and set herself on fire. When neighbours saw smoke coming from the house, they broke open the door and found her burning. She was rushed to hospital where she was declared dead on arrival, said an officer from the Bhandup police station. Her elder son had died a few years ago, after which her younger son and his wife too died of a severe illness. “Around 15 days ago, the victim’s grand-daughter Neha was hospitalised when she contracted dengue. We have communicated to Neha and will wait to record her statement,” said senior police inspector, Shrirang Nadgauda of Bhandup police station. According to neighbours, Nirmala was always in a depressed state after her two sons died. No suicide note was found from the spot. The police have therefore registered a case of accidental death.

uoyed by the marketing initiatives of retailers, shopping through card payments has risen 20 per cent a week before Diwali, according to an industry report. "The weekend before Diwali saw a growth of about 20 per cent (over an average weekend) in credit card spends across the country. This growth is likely to be even higher for the Diwali weekend," says a report by payments processor Worldline India. While credit spends have been on a downslide for quite some time now, debit cards payments were on an uptick

of late. The report, however, did not specify whether rise in purchases were due to debit or credit cards, reports PTI. Segments like cosmetic stores and salons, opticians and book stores witnessed

growth in excess of 20 per cent. Home appliances and furnishings segment saw a 30 per cent growth in spends, while apparel and fashion retail witnessed 22 per cent

growth in spends. During October 25-27, all regions exhibited a growth in the range of 15-25 per cent, with the Delhi region showing the highest increase at more than 24 per cent, closely followed by Mumbai and Bangalore at 21 per cent each, it said. "The transaction volumes also grew in line with the spends, Worldline processed close to 2.5 million transactions during this weekend. The categories that grew are the typical growth drivers during the festive period and we anticipate a higher growth on Dhanteras and the Diwali weekend," Worldline India head Jean Pascal Duvet said.

he BSE would be missing the yearend deadline it had set for itself for going public, as the oldest bourse of Asia is yet to hear from market regulator Sebi on its IPO application. "The exchange is yet hear from the Sebi, despite it submitting all the clarifications that the regulator sought after filing the IPO documents a few months back," a source told PTI. Managing director and chief executive of BSE Ashishkumar Chauhan refused to comment. Sebi officials too could not be contacted.

Last December, BSE appointed 14 merchant bankers for the IPO and had said it was planning to hit the markets by the end of the year. BSE's benchmark Sensex ended Samvat 2069 scaling a lifetime high at 21,196.81, after touching an intra-day record of 21,293.88, surpassing the previous record of 21,206.77 reached on January 10, 2008. As per the source, BSE is set to miss the IPO deadline of Q4 of 2013, as it is yet to get some exemptions from the regulator from the new rules. As per the new rules, IPO-bound market infrastructure institutions like

bourses have to ensure that every shareholder is `fit and proper', which the BSE finds it as an uphill task. "The exchange has sought certain clarifications and some exemptions from the Sebi from these rules, without which the initial public offering cannot go ahead," the source said. The new rules came into effect last year, following the Bimal Jalan committee recommendations. The Sebi allowed stock exchanges over three years old to list their own shares through an IPO in June 2012 after accepting the recommendations of the Jalan committee.

n NCP corporator lived up to the meaning of the term, ‘nagarsevak,’ when he, with the help of local residents, caught a notorious chain-snatcher after a hot chase. The incident was reported at around 12.30 pm on Sunday afternoon from the Balaji Nagar area in Bhayandar (West), when the victim, identified as Vimal Devidas Salve (45), was nearing the Railway Over Bridge. The accused, Alameen Abu Shaikh (20), snatched her chain, and

tried to flee from the spot. Local NCP corporator Dhruvkishore Patil, who had come to exchange festive greetings in the ward, heard the cries of the woman and ran after Shaikh, and managed to nab him. After a sound thrashing by members of the public, he was handed over to the Bhayandar police, who also retrieved the gold chain worth Rs.33,000. Investigations revealed that Shaikh, a resident of Bhola Nagar in Bhayandar (West), is said to be a notorious chain snatcher involved in similar crimes in the region. “We have arrested the accused and have booked him under section 384 of the IPC,” said Senior Police Inspector Shantaram Valvi.

anted for a brutal murder committed by him and his accomplices in May, 2005, he had managed to evade the dragnet for more than eight years, but finally landed in the custody of the Mira Road police. Local slumlord, Sakharam Kaamble (50), had been on the run after killing his rival, Inaaz Atya Pawar during a dispute over the illegal possession of land behind Shivar Municipal Manoj Singh

aking serious note of lack of shelter homes for children with special needs in Pune district, Bombay High Court has directed the Maharashtra government and Commissioner For Persons With Disabilities to explain what steps are being taken to address the situation. A division bench of Chief Justice Mohit Shah and Justice M.S. Sanklecha passed the order earlier this week on a public interest litigation filed by the NGO Disability Rights Initiative about the condition of six destitute boys who were physically abused at a Yerwada mental facility. According to the PIL, the boys were kept at the Yerwada facility near Pune which houses adult persons suffering from mental disorders. The children bore visible signs of fresh wounds and complained of alleged physical abused by a person identified as Mane. "Apart from the issue raised in the petition...It also appears that there is no arrangement in place for children with special needs in Pune district," the bench said. Last year, all four existing homes for special children -Shriram Development and Rehabilitation Centre in Daund, Anand Mahila Balkalyan Sanstha in Shirur, Jijamata Shikshan Prasarak Mandal and Sankalp Trust in Donje -- were closed down by the government for serious violations of rules. "We direct the respondents (state government, Commissioner for Persons with Disabilities and others) to submit a report by November 27 indicating the steps being taken and (that had) been taken for ensuring availability of homes for special children in Pune district," the court said. The court also directed the authorities to ensure that the six boys are shifted to Sasoon hospital in Pune.

n what may come as a surprise to many, civic officials have revealed that Brihanmumbai Municipal Commissioner Sitaram Kunte's drivers have been earning more than him. "Yes, it is true that his drivers has been drawing a bigger salary then the commissioner himself, but this is due to the overtime that they do," Additional Municipal Commissioner Mohan Adtani told PTI. He said there are two drivers working in shifts to drive the cars of the BMC commissioner as well as vehicles of the additional commissioners. "The pay for over time fixed by the government per hour, is one-and-a half times more than their regular salary. Therefore, they draw more salary," he said. According to a civic department transport official, the BMC chief's driver took home Rs 11.9 lakh (Rs 99,550 per month) during the last financial year, which is more than the commissioner himself, whose monthly salary is Rs 90,000. The average salary of a

BMC driver is in the range of Rs 25,000 and Rs 30,000 per month. As per rules, the commissioner's driver is expected to work 12 hours a day and the others are supposed to work eight hours a day. Additional hours are compensated with twice the sum of dearness allowance, house rent allowance, transport allowance and basic pay. So, if a driver works on a public holiday or weekly off, the entire day is counted as overtime. One of the reasons for high overtime payments is because officials relieve their drivers only late at night.

HE CHOGM is not being held by Sri Lanka. Sri Lanka has nothing to do with this meeting: Countries of the Commonwealth are chosen by rotation. The happenings in a country – good or bad – have nothing to do with the choice. The two Tamil parties in India, the DMK and the AIADMK – want the Prime Minister not to go to Sri Lanka. They say that Sri Lanka’s army has commited atrocities and killed many Tamil citizens mercilessly. Two videos which show the savage treatment given to Tamil rebels after the war was over have been released. One of them shows how Prabhakaran’s son – just a kid – has been shot dead. Another shows a woman being stripped, raped and killed. Both the DMK and AIADMK have drawn the attention of the Indian government to the video and have been asking that India should cut off relations with Sri Lanka. There is however doubt whether the video is genuine or fake. It is not known who has produced the video. The happening in the video can be easily constructed for filming. It is a fact that what is seen in the video is beastly. It is a fact that after the war with LTTE, the Sri Lankan army has mercilessly and savagely persecuted the Tamil folk. The whole world is aware of the war crimes committed by the Sri Lankan army. Actually a UN body has taken note of the war crimes and passed sanctions. Tamil Nadu keeps asking the Indian government to cut off relations with Lanka. Political rivalry between the DMK and the AIADMK has made the situation worse. They want to be seen by the Tamil people as friends of Tamil citizens in Sri Lanka. In Tamil Nadu, there has always been sympathy for the LTTE rebels and when the Indian Army was sent, there was a hue and cry in Tamil Nadu. The demand of the DMK and the AIADMK that Prime Minister Manmohan Singh should not attend the CHOGM is most unreasonable. To bring in the army’s war crimes and to ask the PM to boycott CHOGM is most unfair because the CHOGM cannot be expected to be involved in any manner with war crimes by Sri Lanka’s army. India should ignore the unreasonable demand of Tamil Nadu, adopt a realistic approach and attend CHOGM.

T is good the slugfest between an ascendant BJP and a fast sinking Congress has helped focus on the enormous legacy of Sardar Patel. The man who had single-handedly unified India was sought to be pushed to the margins of history by a Gandhi-Nehru family- obsessed party. Till the other day, the Congress had no heroes outside the Family. Birth and death anniversaries of leaders from the pantheon of freedom fighters were mostly restricted to members of the Family. Even the Mahatma’s were a perfunctory affair. How much money and effort went to build a cult around the controlling family of the ruling Congress was in sharp contrast to the shabby state of the memorials of the Father of the Nation. No doubt, history is written by the victorious. Legacy of leaders who have direct descendants in power is glorified to the virtual exclusion of that of all their peers. If you are approaching sixty or so, you will recall how the school textbooks had deified the Nehrus, impressing young minds about their huge sacrifice for the sake of freedom. Otherwise, telling ten-year-olds that the clothes of the family were sent to Paris for dry-cleaning would not have made any sense. The myth-making around Nehru, surprisingly, began even when he was still alive. With the early demise of Patel in 1950, Nehru marginalised everyone who could have stood up to him, while other veterans of the national movement were content in their respective fiefdoms in the States. Till the 80s, there was no State-sponsored function to mark the birth anniversary of the Sardar. As an old Delhiite, one recalls how the late Jana Sangh leader Kanwar Lal Gupta’s Citizens’ Council would hold a small function at the traffic roundabout in Parliament Street early in the morning to garland the Sardar’s statue. Historians, of course, would better analyse the contributions of the Sardar and Nehru to the nation-building, but it must be noted that the former was the preferred choice of the Congress Party for leading the first government in free India. Nehru refused to work as Patel’s number two. However, Patel, mindful of the grave pitfalls of an open schism at the very birth of a new nation, readily agreed to be Nehru’s deputy. So much, then, for the democratic faith of Nehru. When threatened with the loss of power, years later even his daughter would betray an authoritarian mindset. (Recall the Emergency) Nobody in his right mind would deny that Patel was a pragmatist rooted in the local soil who called a spade a spade and did what was best for the country. In contrast, Nehru was so seeped in westernised culture and thinking that he hardly had an inkling about the reality of India. For proof, go no further than the

The recent controversy over Patel’s legacy has got enmeshed in the definitional fight over secularism and communalism. Patel’s concept of secularism did not permit him to treat the minority as a special group. His idea of secularism was indeed rooted in the belief pithily encapsulated in the BJP slogan: ‘Equality for all, appeasement of none.’ The vote-bank politics being far away from his mind in those early days when the successful national movement had given the Congress a walkover into all elective bodies at even level, Patel was unequivocal in asserting that “our secular ideals impose a responsibility on our Muslim citizens in India — a responsibility to remove the doubts and misgivings entertained by a large section of the people about their loyalty founded largely on their past association with the demand for Pakistan and the unfortunate activities of some of them.” Patel’s idea of secularism meant that “ ... Every Indian citizen, whether Hindu or Muslim, will have to behave as an Indian, and sooner they realise this, the better.” Presumably, that tenet also applied to those in power while seeking votes. However, the ruling party in its desperation to stop the Modi juggernaut has taken to RSS-bashing. The RSS was patriotic enough for Patel to try and get it to merge itself with the Congress Party. That was soon after independence. Today’s Congress bigwigs may not know that the RSS founder, Dr. Keshav Balliram Hedgewar was a leading member of the Congress. As for those selective quotes from M.S. Golwalkar’s ‘Bunch of Thoughts’, which are being spouted by Congress-friendly anchors and guests on the nightly ‘tu, tu, mein, mein’ sessions on television channels, it must be borne in mind that like all leaders/ thinkers, what he did and said was time- and contextspecific. Even Gandhi could be quoted to suggest that he had endorsed the caste system, even untouchability, for that matter. But that would be unfair to Gandhi. Because his purported remarks too were context- and time-

specific. Why, some of the early US presidents, great in their own right, were not only defenders of the system of slavery, but had themselves kept blacks as slaves in their homes and farms. The point is that relying on the past to fight current electoral battles is bound to yield diminishing returns. The party in power should seek re-election on its record in power in the last nine-plus years. Leave the debate over the contributions of Gandhi, Nehru and Patel to the historians. Instead, provide answers to the concerns of a population reeling under the growing weight of inflation, lawlessness, joblessness, hopelessness, et al.

Could-not-care-less Shinde So, Home Minister Sushil Kumar Shinde has a life beyond Patna. We have that from the authority of none other than the Foreign Affairs Minister Salman Khurshid. The Oxbridge-educated Khurshid has a penchant for putting his big foot in his big mouth on all such occasions. Remember how he had dismissed the Chinese incursion 19 kilometres into India as a mere acne, not to be taken seriously. Now, when the bombs were blasting in Patna on the day Narendra Modi addressed a mammoth rally, our foot-in-the-mouth champion justified Shinde’s presence at a Bollywood music release function in Mumbai, saying the Home Minister had life beyond Patna. We were wrong in believing that the foremost concern of the Home Minister would be, well, Home Ministry. Apparently, it is not. He would rather consort with Bollywood nymphets than concern himself with the life and death of citizens confronting terrorist bombs in the Bihar capital. As for Khurshid, we know that his concerns are multifarious. Like running the familycontrolled NGO which was at the heart of a controversy over the use of funds meant for the differently advantaged in UP. Though he had threatened to sue the media outlet that had done a well-documented expose about the misuse of funds meant for the handicapped, nothing was heard of it after the initial noises. Again, he had threatened physical harm against Arvind Kejriwal if he went to his Lok Sabha constituency Farrkhuabad in UP and talked about the misuse of funds meant for the disabled. Khurshid failed to pursue the defamation case against the AAP leader. Clearly, ‘dal mein kuch kala hain’. Hence the silence. But, we have to admit, Khurshid too has a life beyond MEA.

Which, incidentally, show that the BJP is on a winning streak in Chhattisgarh, Madhya Pradesh and Rajasthan while in Delhi it is ahead of both the Congress and the AAP. However, if you were to go by the internal survey of the Congress Party, it is winning in Chhattisgarh, is in with a chance in Madhya Pradesh, has an edge in Delhi due to the split in the anti-Congress vote, while it is doing not so well only in Rajasthan. On the other hand, the BJP survey shows that it is winning comfortably in Chhattisgarh, Madhya Pradesh and Rajasthan while it is certain to emerge as the largest party in Delhi with a couple of seats short of the majority. Sibal should debate with himself to clarify his notorious claim of ‘zero-loss’ in respect of 2G Scam which was contradicted by the JPC Report. He should have discussed with the Chairman of the JPC who is said to have put the entire blame for the huge loss on the then Telecom Minister. The topic could be ‘Zero-loss versus huge loss’. The next one is that of the Ordinance against the SC Order disqualifying accused MPs and MLAs. Sibal is said to have evinced keen interest and mooted the very idea of an Ordinance and pursued vigorously with the President of India who is said to have exhorted him that this was not viable as it counters the very Constitutional ‘provisions’ to have one law for citizens and another law for Parliamentarians. There is nobody in the Congress who can qualify to discuss with Modi. The minister said that the situations like Nigerians taking on the road will have bad repercussion on the tourism industry of the state on which people from the coastal belt earn their living. Mandrekar said that timely police action could have saved the highway from being blocked by the Nigerians. "People have seen on the television how Nigerians

forcibly dragged out the corpse from the police van while the policemen remained silent spectators," he said. The minister also claimed that the drug menace in the state has crossed the limits of coastal belt and has now percolated to the villages. "You all blame coastal belt for being the hot bed of drugs, but now the scene is different. The narcotics has entered the villages of Goa and sold there," he said refusing to comment whether "the narcotic trade has lessened in the BJP government tenure."

Parakh, the former Coal Secretary. He said that if an FIR has been filed against him, an FIR should be filed against the Prime Minister as well. “I did not make any final decision. The final call was the Prime Minister’s”. On behalf of the Government of India, it was untruthfully stated in the Supreme Court that this policy was decided in the Cabinet, at which the Supreme Court said that proceedings of the meeting of the Cabinet with records should be presented before the Supreme Court. Why

doesn’t the Government of India understand that if something wrong was done, then the responsibility for it should be accepted and it should make efforts to correct the lapse? Instead of which there is a statement on everything – which is proved wrong in the next few days and there is abhorrence for the government. The irritation and the language with which the Supreme Court judges are addressing Attorney General G. E. Vahanvati tells us that the Supreme Court does not have much faith on the statements of Vahanvati. It is not a coincidence that when today’s Prime Minister was the Finance Minister in Narsimha Rao’s Government from 1992 to 1996, the first big scam involving foreign banks took place, in which foreign banks gobbled up to Rs.5000 crore. The then Finance Minister had confirmed the scam, but no step

was taken to bring back the rupees which had been gobbled up. The direction towards which Parakh was hinting when he said that if ‘I am responsible the Prime Minister is equally responsible” is a scam of Rs.26 lakh crore. It is the biggest scam so far after independence and the man directly involved in it is very clearly Manmohan Singh. Those who want to defend and shield Singh say that he merely signed, the money went elsewhere. Will it ever be known what happened to this money? It is a matter of great regret that the government never takes any steps regarding an issue on and the Supreme Court has to intervene. Now the Supreme Court is monitoring the coal block allocations investigations in detail and it has said that the investigations must be completed by December. These are the Supreme Court’s directions to the CBI.

The Durga Shakti episode in Uttar Pradesh seems to have woken up the bureaucracy to challenge what was once the staple weapon of politicians to chastise or punish irksome babus’ transfers. A beginning of sorts was made when the state IAS Officers Association spoke up publicly in support of the IAS officer who was controversially transferred by Chief Minister Akhilesh Yadav and reinstated only after a nationwide outcry. But now, others too seem to have been inspired to stand up for themselves against wilful state netas, even though the Centre has been unwilling to come out in their support. The Indian Police Service (Central) Association, sources say, has made a formal representation to the Department of Personnel and Training (DoPT), headed by Prime Minister Manmohan Singh over state politicians abusing their power to suspend or transfer officials. The association general secretary Pankaj Singh has cited the example of a 2003-batch IPS officer Ajay Misra in Uttar Pradesh who was suspended for 15 months and Mayank Srivastava who was suspended in Chattisgarh earlier this year. Will the Centre try to restrain states from abusing their powers? Don’t count on it yet.

Reclaiming Turf

The Indian Foreign Service (IFS) has managed to recover a prestigious diplomatic post from the clutches of the Indian Administrative Service. India’s new Permanent Representative to UNESCO is a 1987-batch IFS officer Ruchira Kamboj, who at present is Chief of Protocol with the Ministry of External Affairs (MEA). This ambassador-rank position based in Paris, sources say, used to be reserved for career diplomats, until the Government appointed Vinay Sheel Oberoi, a 1979-batch IAS officer in 2010. This move, naturally, had led to much grumbling in the diplomatic ranks. With Kamboj’s appointment, the IFS lobby seems to have reclaimed some of its turf from the powerful IAS lobby, which has spread its influence by poaching on what other services consider as their own domains. But how long can the IFS hold on to its turf is what many are wondering about.

Clean-up Time

In a move that has got incompetent babus worried, the government has decided to shed dead wood in the bureaucracy by weeding out officers whose performance has been below expectations. Prime Minister Manmohan Singh had first proposed this rule in 2004, soon after the UPA came to power, but it was shelved soon thereafter. Now the government has once again decided to implement it. According to the Department of Personnel and Training three cadres, namely Himachal Pradesh, Tamil Nadu and AGMUT have already begun reviewing the performance of IAS officers while Punjab and some other states are likely to start the process soon. Sources say that at least three IAS officers belonging to the AGMUT cadre have been recommended for premature retirement for inefficiency and ineffective performance. Their names have not been disclosed, but those in the know say that the babus are contesting the recommendation, though it is unlikely the DoPT will change its mind. — Dilip Cherian

hopping malls which are already suffering from large vacant spaces have seen a sharp decline of 35-40 % in footfalls in the ongoing festive season as the economic slowdown; high interest and job uncertainties have dampened the shopping spirit this year. According to an ASSOCHAM survey; economic slowdown, galloping inflation and high interest rates have upset the festival shopping plans of most consumers. The shopping spirit was found to be at the lowest ebb among Delhiites (33%), followed by Ahemdabad (31%), Chennai (30%), Mumbai (28%) and Hyderabad (27%). D S Rawat, Secretary General ASSOCHAM said that the trend is on expected lines as the economic recovery is rather slow and consumer confidence is at a low. As per esti-

mates, roughly 250-300 malls came up in the country over the last two years, but 70-80 % of the spaces in these malls lie vacant. The economic slowdown has landed especially heavily on the shopping malls. The survey further reveals that the slowdown, job cuts and devaluation of the rupee against the dollar is also making imported raw material and finished goods costlier. This also impacts consumer spending in a significant way. A large number of malls across the country, unable to justify the rents they charge tenants, are shutting down. The currency fluctuation is a major challenge for the consumer electronics industry because the imported consignment is coming in at a higher cost. Dinnerware and cookware companies have already started offering attractive offers and discounts to boost sales, adds the survey.

More than 47 % of the total mall space in nine cities is vacant, the survey found. Delhi-NCR tops the list with 55 % of malls being vacant, followed by Mumbai at 52 %, Ahemdabad at 51 % and Chennai 50 %. In order to lure retailers, many developers have started giving a rent-free period for up to six months for big brands. While some malls are operating at 60 % occupancy, others are struggling with less than 20 %. “Vacancy levels are due to poor location, poor design and poor parking facilities, while some are operating at 60 % occupancy,� it said. It said the industry is also facing problems like multiple taxes, lack of clarity in policies and shortage of experts in areas such as supply chain and store management. The sharpest decline in mall rental values was recorded in DelhiNCR followed by Mumbai, Ahmed-

ndia has suspended a two decade -old pact with Cyprus that provided benefits to taxpayers conducting business between the two countries, saying the European nation has “not been providing� information to authorities here that are trying to track down black money. “Cyprus has not been providing the information requested by the Indian tax authorities under the exchange of information provisions of the agreement, (hence) it has been decided to notify Cyprus as a notified jurisdictional area under section 94A of the Income-tax Act, 1961,� the Finance Ministry said in a statement on Saturday. The immediate fallout of this decision will be that an individual or a businessman who transacts between the two countries will not get beneficial tax deductions and will have to undergo stricter tax scrutiny. “If an assessee enters into a transaction with a person in Cyprus, then all the parties to the transaction shall be treated as associated enterprises and the transaction shall be treated as an international transaction resulting in application of transfer-pricing regulations including maintenance of documentations,� said the statement. It added that “any payment made to a person located in Cyprus shall be liable for withholding tax at 30 per cent or a rate prescribed in Act, whichever is higher�. The notifi-

cation also means that “no deduction in respect of any other expenditure or allowance arising from the transaction with a person located in Cyprus shall be allowed unless the assessee maintains and furnishes the prescribed information�. It also added that if “any sum is received from a person located in Cyprus, then the onus is on the assessee to satisfactorily explain the source of such money in the hands of such person or in the hands of the beneficial owner, and in case of his failure to do so, the amount shall be deemed to be the income of the assessee�. India and Cyprus had entered into an agreement for avoidance of double taxation of income and prevention of fiscal evasion in December 1994. In the Budget of 2011-12, the Finance ministry had inserted a clause - Section 94A - in the Income Tax Act to notify and guard against countries that do not cooperate in the exchange of information protocol. The Central Board of Direct Taxes (CBDT) in June this year had notified rules under which an entity based in a “notified jurisdictional area� will have to give an undertaking to share information in a prescribed format. Sources privy to the development said the decision was taken after enforcement wings of the ministry reported difficulty in eliciting information in a number of cases related to Cyprus during probes into money laundering and tax evasion cases.

ANGALORE: Impressed with his breathtaking display of batting, Australia skipper George Bailey says Rohit Sharma is certainly the one who is in the mix for the spot that will open up after Sachin Tendulkar's retirement from international cricket later this month. Rohit crack a match-winning double century as India posted a 57-run victory in the series-deciding final ODI against Australia to clinch the rubber 3-2 here Saturday night. "It was an extraordinary innings. He has had a wonderful series. He is obviously flourishing at the top of the order. He would certainly be one who is in the mix for that spot that will open up after the great man (Sachin Tendulkar) departs in a couple of Tests," he told reporters at post-match press conference here. Bailey also lauded Rohit for pacing up his innings wonderfully after starting on a slow note. "It was extraordinary. I think the record was smashed for most sixes in a game. I thought Rohit batted beautifully. He summed it up. He wasn't actually that quick early on. I looked at it when he brought his 100 up and he was probably only run a ball. He just got a bit busier after that," he said. Rohit had blasted his way into the record books with a breathtaking 209 that included a record 16 sixes. He also became only third batsman in the history of ODI cricket after Virender Sehwag (219) and Sachin Tendulkar (200 no) to reach the coveted double ton. This was also the highest individual ODI score by any batsman against Australia in ODIs. Asked whether 400-run chase with the new rules of five fielders inside the circle and two new balls good for the game, Bailey said it would be a different ball game in livelier conditions in Australia and South Africa. "You won't get wickets like this in Australia and South Africa. Bailey admitted that the Aussies certainly missed the services of pacer Mitchell Johnson. And if you can get partnerships...What we have seen on these grounds, if you have got wickets in hand you can score anything," he said. Praising James Faulkner, Bailey said the Tasmanian has got a wonderful future ahead and 'teams will fear him because of the energy and competitiveness he brings into the game'. "Teams will certainly fear him. It is just that energy he brings is wonderful. The competitiveness he brings is something you love playing with. He has got a pretty bright future," he said. UBAI: Virat Kohli became the number one batsman in Oneday cricket after a superb batting show against Australia in the justconcluded series, in which he scored 344 runs. Kohli had scores of 61 (in Pune), 100 not out (in Jaipur), 68 (in Mohali), 115 not out (in Nagpur) and 0 (in Bengaluru). This gave the 24-year-old a series aggregate of 344 runs at an average of 114.66, and a reward of 38 ratings points which helped him to jump three places to top of the ICC ranking table for ODI batsmen. He has achieved the number-one spot for the first time in his career, just a few days before his 25th birthday. Kohli

has now become the third India batsman to hold the number-one batting rank in ODI cricket, after Sachin Tendulkar and MS Dhoni.

Tendulkar first claimed the number one position when he took over from Brian Lara in February 1996. He was last number one in March 2008. Dhoni first reached number one when he took over from Ricky Ponting in April 2006. He was last ranked number one in July 2010. Kohli now leads South Africa’s Hashim Amla by 13 ratings points. Amla had been holding the coveted number-one position since November 2010. Kohli is not the only batsman who has gained in the latest rankings, which were released. Chappell says that the Australians should not feel relieved at the impending retirement of Tendulkar as they could be meted out the same treatment in future from Kohli, who hit two stupendous centuries against the Aussies in the justconcluded ODI series. DUBAI: Shiv Kapur played an extremely steady and solid final round of two-under 70 without any bogeys to claim the seasonending Dubai Festival City Challenge Tour Grand Final at the Al Badia Golf Club. Kapur celebrated his Diwali in Dubai in a winning way with a total of 16-under 272 and a whopping four-shot margin over the second place duo Jose-Felipe Lima of Portugal (69) and Andrew McLeary of Scotland, both of whom carded 69 each to total 12-under 276. It was not only Kapur's second Challenge Tour title of the year – he won the season-opener in February at Kensville Challenge, Ahmedabad – but it also helped him find his way back to the European Tour for 2014.

BU DHABI: Quadruple Formula One world champion Sebastian Vettel eased to victory in the Abu Dhabi Grand Prix on Sunday for his seventh successive victory and 11th of the season. The 26-year-old German led home a Red Bull 1-2 -- the 15th time in Formula One and giving them their 100th podium finish - with Australian Mark Webber second, taking him to over 1000 points in his Formula One career which comes to an end at the end of the season. German Nico Rosberg was third in a Mercedes. Vettel's win drew him level with compatriot Michael Schumacher's mark of seven successive wins (2004) and should he win the last two races of the season he will equal the overall record of nine held by Alberto Ascari (1952/53).
