o give organ donation a boost, the Directorate of Health Services (DHS), along with Gift Your Organ Foundation. which is a Bangalore-based NGO, had launched a pilot project for getting people to pledge their organs while they applied for driving licences at the Tardeo RTO since the start of July this year. It has been almost a month now, and though the results say that Mumbaikars need to be more open and inclined to the idea of donating organs, the NGO and the DHS are optimistic and say that the initiative will gain momentum soon. According to the statistics given by Gift Your Organ Foundation, till August 2, 2013, a total of 1,541 people had applied for licences at the Tardeo RTO and out of these, as many as 1,127 (approximately 73%) applicants refused to pledge their organs. Only 414 applicants, which amounts to 27%, have agreed to

pledge their organs. And these 27% comprise the youth from various socio-economic strata of the society. Speaking about this response to the initiative, Sameer Dua, Founder

and Chief Catalyst of Gift Your Organ Foundation, said, “Yes, there is a long way to go for us with regards to organ donation. But then again, this is just the beginning and we hope things will get better soon.

What is the initiative all about? Anybody who comes to the RTO office (Currently only at the Tardeo RTO in Mumbai) for driving licence test is given a booklet explaining the need for donation along with a pledge form. If the person voluntarily agrees to pledge his or her organs, then before the license is dispatched, an ‘I am an organ donor’ sticker will be pasted on the licence.

hile the Mumbai University (MU) has already brought in a new rule to award aggregate marks to the students if manipulation is verified in their internals marks, it has stepped vigilance on the marks awarded by colleges to their students. Keeping in mind the various issues and repots of manipulation by colleges to allot maximum internal marks to their students, the MU will now keep an eye on the marking schemes, projects, assignments and class-tests conducted by the colleges. In short, the MU will be supervising internal assessments and exams conducted by the colleges and will also keep a check upon the marks allotted to students. Last year, the examinations department of the varsity had noted that most of the colleges had given out maximum internal marks to their students, whereas most of the students were able to score only average marks in the external theory examinations conducted by the varsity. It was clearly noticed that colleges had manipulated the internal marks merely to promote their students. As per the credit system marking

MU to keep a strict check upon the internal assessments and class tests of the final year students to reduce manipulation of marks scheme of the MU, a students has to appear for 60 mark external theory examinations conducted by the varsity and 40 marks of internal examinations which are carried out by the colleges themselves. Out of these 40 marks for internals, 20 marks are for a written class-test, 10 marks are for projects, assignments, while 10 marks are awarded for the student’s attendance and class participation. These 40 marks are wholly given out to students by their colleges. The ADC spoke to Avdesh Yadav, Coordinator, Bachelor of Mass Media, St Clara’s College, Versova, who says “As the MU has brought up this new rule to keep a check upon the projects and tests conducted by the colleges, it will bring out an equal marking for the students. It’s a fair and correct step by

the varsity. Most of the time, colleges give out maximum marks to their students even if students don’t deserve them. It used to be an unfair means for those students who worked hard for the marks and had to be satisfied with what was awarded to them. This new action of the varsity will ensure fair markings for the students.” In February 2013, the Academic Council of MU had brought up a new rule which stated that internal assessment scores of undergraduate students having higher marks internal exams than in the university’s exam will be automatically reduced and brought in line with the theory exam scores. The ADC spoke to Dr Madhu Nair, Academic Council member, MU, who said “The varsity will be keeping a check upon the internal

assessments carried out by the colleges. The issue was raised after it was noticed that students having maximum marks in their internal assessments flunked in the external examinations conducted by the varsity. It was soon that the council had brought up a new rule to deduct the manipulation of internal marks carried out by the colleges. To ensure a fair and clean process for marking the students correctly for their internal assessments, MU will be keeping a check upon the students’ internal assessments. Colleges will have to maintain records for the internal assessments. This step has been taken by the varsity to halt the manipulation of marks which misguides the students leading to their failure in the external examinations carried by the MU.”

The application shall contain all the details of techniques and procedures of Assisted Reproductive Technology (ART) practiced at the Bank or Clinic. Registration of ART Banks / ART Clinics by the authority shall be done on the basis of technology practiced at such clinics or bank. These banks or clinics shall not be allowed to practice any other technique without the certificate or accreditation from the district board. No ART Bank shall divulge the name, identity or address of any sperm donor or oocytes donor, or surrogate and keep it confidential. The law provides for storage of donor gamete or embryo for maximum period of five years. The law also provides that the ART Bank / ART Clinic should not carry out sexdetermination tests. Besides this the proposed bill also seeks to imprison up to five years with fine any medical geneticist, gynaecologist, registered medical practioner or any person owning a ART Bank / ART Clinic that violates any provisions of the law.

T was not the question of issues, there were plenty of them that were offered on the platter by the ruling Congress-NCP alliance to the BJPShiv Sena led opposition. But thanks to its lethargic and unimaginative approach, the opposition squandered its chances. Technically speaking, with Lok Sabha elections just nine months away, it was expected that the BJP led opposition would have pinned the government on the mat, as it were, through intense grilling on issues, lapses and scams. Sadly, the performance of the principal opposition party left a lot to be desired. Save for the Adarsh issue, the BJP led opposition was literally taken for a ride by a smart ruling alliance. Not just the Sena and the PWP, even within the BJP ranks there were voices of dismay over squandered chances due to the lack of political acumen and effective floor coordination. The much talked Prithviraj Chavan about debate on the Irrigation scams was one such case where the opposition was not only outmaneuvered, it was simply outsmarted and handed over a shortened debate sans any reference to any scam. After week-long brinkmanship over the issue, what the opposition got in return was a shortened debate and suspension of Diwakar Raote in the legislative council. What has raised the eyebrows and voices within theBJP-Senaistheperceivedabjectsurrenderoftheupperhand. Many, even in the Sena, are miffedoverthemannerinwhich thetopBJPbrassappearedmore conciliatory towards the ruling alliance, agreeing to almost everything that was being thrown at them. It is not surprising when MNS chief Raj Thackeray recently remarked that the BJP-Sena alliance had a tacit “friendly” understanding with the ruling alliance. The opposition did raise the issue of infrastructure in the Mumbai region and in turn got whacked by Chief Minister Prithviraj Chavan, who questioned the Sena ruled civic body's reluctance to accept third party audit of potholed roads. Another issue that the opposition could have exploited to the hilt was the mess in Online admissions, the goofups in school textbooks, the bad management of the government of the drought in the state. In the end it looked like the ruling alliance was laughing at being let off the hook by a lame duck opposition.

tate police is taking all the possible steps to block the renewal of recently announced state BJP General Secretary and MLA Jaykumar Rawal’s passport. In this regard, Deputy Superintendent of Police, Dhule, has asked senior inspectors of all the police stations in Mumbai including crime branch’s criminal intelligence unit to provide the information of criminal cases registered against Rawal, an MLA from Dhule’s Sindkheda. The information, stated DY SP’s letter to city police, should be provided by August 6 and the letter should be given top priority, said police adding that the senior inspectors of the po-

lice station would be held responsible for the delay in providing information, stated the letter. This has, however, baffled the police personnel from the city police department, as the MLA neither possesses any residence in the city nor is he, in any way, related to the city, informed sources in the CIU. or the first time in its history, the Mumbai traffic police carried out nightlong checks and stopped 500 bikers for performing dangerous and unwanted stunts at various locations. Stunt bikers are normally seen speeding between Bandra and Dahisar and between Marine Drive and Haji

It is known that bikers performing stunts often have bets placed on them. Police have now begun to seize motorbikes fitted with equipments to facilitate dangerous stunts. So far, bikers were being prosecuted for rash driving under the Motor Vehicles Act, but the police have now started booking rash drivers

under Sec 279 of the IPC too, a crime which if proved can land one behind bars for six months, said Rameshwar Suple, senior police inspector, Marine Drive. According to Deputy Commissioner of Police Zone VIII N D Chavan, “We conducted a special drive against the bikers and brought them to the Vakola, Kherwadi, Nirmal Nagar police stations to fine them. A few days ago we conducted a drive against bikers and booked more than 11 who were found performing dangerous stunts.” It has to be noted that today (Monday) night is a big night in the month of Ramzan, and most bikers usually land up on the roads to perform stunts. The police are therefore initiating a special drive throughout the night.

(52), was displaying his swimming skills to his 13-year-old son at a lake near their residence in Mohak City on Sunday morning. The father-son duo was on a morning walk, when Dighe stepped into the lake for a swim. He apparently suffered

a heart attack and drowned. His body was fished out by fire brigade personnel late in the afternoon, police said. A case of accidental death has been registered in this connection and the body has been sent to the Public Health Centre, for post-mortem.

he Traffic Police Department of Borivli region nabbed a 35 year-old person for allegedly carrying around 500 litres of spurious liquor, during a surprise check on the Western Express Highway, late on Sunday night. According to Police Inspector from Borivali Traffic, Anil Adandi, “We were carrying out surprise checks on motorists and bikers on the WEH, and spotted a car with the occupant behaving in a suspicious manner. We tried to stop it but the driver sped away. After chasing it almost for almost 30 minutes, we intercepted the vehicle to only see country liquor, more than 500 litres of it, hidden inside. We caught the driver, Sambhaji Kamble, and handed him over to the Dahisar police who are doing further investigation.”

he Navi Mumbai Municipal Corporation (NMMC) will be getting jetting, suction and recycling machines to clean sewer lines. The standing committee members have cleared a proposal of Rs.26-crore to appoint a contractor and maintain these machines for the coming seven years. Aziz Shaikh, deputy municipal commissioner, said, “The municipal corporation has, in all, nine jetting machines of which five are functional. Out of the five machines, three have the capacity of 6,000 litres and

two are of 3,000 litre capacity. The remaining four jetting machines have been scrapped.” He also added, “The new machines will be carrying out work of suction and jetting and will recycle sewer water for its operations. Presently, we are using fresh water for this purpose.” The opposition has dubbed this move as “unnecessary expenditure”. Already we have spent lakhs on purchasing sweeping machines and appointing a contractor to operate and maintain them. And now this new proposal is nothing but a burden on the civic coffers.

A cover-up operation by Akhilesh fails AMAJWADI PARTY leaders are going all out to justify the suspenS sion of IAS officer Durga Shakti Nagpal. One of their leaders said the government took quick action because it did not want another incident like Babri Masjid happening. Chief Minister Akhilesh Singh Yadav is saying that the IAS officer had ordered the demolition of a wall constructed on government land which is near a masjid. According to him, he took the action to prevent communal tension. Another leader boasted that he contacted the chief minister and in just 41 minutes got Durga suspended. The truth is there was no communal tension at all. The wall was pulled down by villagers and the IAS officer had nothing to do with it. There was no communal tension of any kind. It was a cover-up operation by chief minister who must have got an urgent demand from the sand mafia. Durga Shakti had identified the sand mafia and had begun an investigation. She was suspended without any inquiry within 41 minutes and the order for the suspension was issued at midnight — an unusual happening. A SP leader had an explanation for this midnight suspension order as well: It only showed how the government worked hard — day and night. The UPA government should have taken prompt action, but it did not. It had asked the state information about Durga’s suspension – that is all the IAS Officers’ Association is carrying out a strong agitation. There is now tremendous pressure on the chief minister. He has no go but to withdraw the suspension. He must now be trying hard to get a face-saving device — it is not going to be easy.

ventually, they do cave in, don’t they? Whether it was the Partition or the creation of new States following it, the Congress behaviour has remained unchanged. Outright rejection, then an attempt to buy time through intimidation, blackmail and even co-option of protagonists agitating for a new State is invariably followed by a complete surrender. Even the pretence of a dispassionate look at the administrative and financial viability of a new State is dispensed with. When things go completely out of control, indecision and dithering yield to abrupt decisions. Or, as in the case of Telangana, the fear of an electoral rout forces arbitrary actions. Remember the utter disdain with which Nehru had referred to the fast by Potti Sriramulu in 1952 for the creation of Andhra Pradesh by carving out the composite State of Madras. In a letter to Madras Chief Minister C. Rajagopalachiari, Nehru wrote that “— Some kind of fast— is going on for the Andhra Province… I am totally unmoved and I propose to—ignore it completely. —” Fifty-eight days later, upon Sriramulu’s death, widespread violence, arson and rioting had forced the same Nehru to crumble. That was the birth of the first new State on a linguistic basis. Paradoxically, six decades later the creation of Telangana negates language as a basis for a new State. The Congress behaved in similar fashion whether it was the division of the composite State of Punjab, Maharashtra, or the creation of several new States in the North-East. Arrogance and contempt for the popular aspirations for faster development is an integral part of the Congress DNA. Only when the leadership faces rejection, or sees percentage in giving in to persistent demands of the people, it reluctantly bestirs into action. Indeed, it is to the credit of the Vajpayee Government that it carved out three new States without a hint of duress. Uttarakhand, Jharkhand and Chhattisgarh were created because the BJP had for long been a votary of smaller States. However, the Congress’s motivation is almost always self preservation, not the larger public welfare. Take the concession of Telangana. The decision was taken by the 10 Janpath establishment; the Cabinet only followed its diktat. Notably, the Congress spokesman announcing the decision to form Telangana, in the same breath appealed to the TRS to merge itself with the party. Make no mistake about it. The fear of Jagan Mohan Reddy forced its hand a few months ahead of a crucial general election. The TRS was a spent force. Its leadership had lost credibility. Last time its leader Chandrashekhar Rao sat on a hunger fast it was only because he was forced to by angry youths. He had done a quiet deal with the Congress. Hyderabad was agog with the talk

of lucrative contracts and other funds for businesses which had been given to the extended first family of TRS. Even though Andhra Chief Minister Kiran Reddy is a lightweight, and lacks the Machiavellian skills of the late YSR Reddy, the agitation for Telangana was more or less tamed. Yet, the Congress brought the Telangana demand up front. It was nervous about a complete washout in Andhra, which had given it 32 seats in the 2009 poll. For some inexplicable reason, it would not arrange to have Jaganmohan Reddy released from prison. He is held without bail for more than a year in connection with a CBI probe into a disproportionate assets case. At best, Jagan is only guilty of being a recipient of the loot resulting from the sale of favours by his late father YSR Reddy as the allpowerful Chief Minister of Andhra. Nor is Jagan the only leader facing investigations in a DA case. Two notable leaders with similar cases are being openly feted by the Congress leadership. Unlike Jagan, both Mayawati and Mulayam Singh Yadav were themselves chief

However, nobody should cavil at the birth of a new State. India can do with many more since, on balance, smaller States make for better governance. Bigger States are not necessarily better administered. For evidence, look no further than Uttar Pradesh. Therefore, the size does not matter. Leadership does. For instance, since its birth Jharkhand has been in the grip of rampant corruption and mismanagement. Uttarakhand showed promise to become a model State under the shortlived chief ministership of General B.C. Khanduri. But it is Chhattisgarh which has taken full advantage of its separation from Madhya Pradesh to take development to the hitherto neglected parts of the State. Meanwhile, now that the Congress for very selfish reasons has taken the genie of smaller States out of the bottle, before the demand for many more States results in large-scale arson and violence in various parts of the country, it should set up a second States Reorganization

Tyagi had exalted company in helicopter scam Last Tuesday, the multi-edition daily, ‘The Hindu’, led with a news report filed by its Paris correspondent from Busto Arsizio, Milan. The lead headline screamed, “Evidence against persons `much above’ Tyagi.” It said that documents seized by the Italian authorities in the Augusta-Westland investigations revealed that persons “much above” the former Air Marshal S.P. Tyagi and his three cousins were “implicated” in the bribery scam. The former CEO of the Italian armaments giant Finmeccanica, Giuseppe Orsi, and the head of its subsidiary, Augusta-Westland, Bruno Spangnolini, along with a couple of middlemen are on trial for violating the Italian law prohibiting bribes for procuring business. India had purchased 12 helicopters from Augusta-Westland at a cost of Rs. 3,600 crore in 2005. Rupees 360 crore was the amount allegedly paid in bribes. No other paper chose to follow up on the sensational claim emerging from the documents made available by the Italian authorities. More significantly, the unnamed “persons much above” Air Marshal Tyagi had the lead defence lawyer of the main accused, Orsi, dash off a letter within hours of the publication of the ‘The Hindu’ report. In the letter, published on Thursday, Professor Ennio Amodio said the suggestion about the higher-ups’ involvement “is completely unsubstantiated.” However, paper’s correspondent stood by her report, saying in her rejoinder that Italian “sources did speak to this correspondent about ‘top secret documents from the Indian Defence Ministry’ contained in the 1,10,000 pages of evidence collected by the Prosecutor’s office. Some of that evidence implicates persons ‘much above’ Air Marshal Tyagi…” Incidentally, Professor Amodio was also the lawyer of the Bofors bribe-taker, the late Ottavio Quattrochi. That should throw some light on the likely route used by AugustaWestland to bag the Indian order. The Indian authorities had lowered the height specifications from the earlier 6,000 meters to 5,000 meters to enable August-Westland to bag the order. The rest is for you to guess. Of course it is pure balderdash to think that Air Marshal Tyagi could have done that on his own. A lot more could emerge from the court proceedings in Milan in the coming days. But do not expect most media outlets to follow that story. Still, there will be an intrepid paper or two which will remain on its trail. More power to their elbow.

EW DELHI: Educational tours for school students have over the last few years picked up steam, with a variety of holiday packages now offering opportunities to take learning beyond the classroom. Customised tours ranging from walks to neighbourhood forts and monuments to more detailed itineraries in foreign locales or even super-specialised learning trips, say to the facilities of NASA, are being targeted at school children. A trip to South Africa with a chance to meet and learn the intricacies of cricket from icon Jonty Rhodes is the biggest attraction of an upcoming 10-day ‘Cricket Safari’ organised by Delhi-based Acamor Academy for young sport aficionados from Class 8 to Class 12. "We are seeking to combine the educational aspects of learning with out-of-classroom experiences in nature which will help develop problem solving abilities and inculcate teamwork and leadership qualities in children," says Charanya Chidambaram, VP Marketing, Acamor Academy. Participating students also get a chance to explore the attractions of South Africa like the Hluhluwe Game Reserve, the oldest national Park there and the historic

Robben Island where Nelson Mandela, the country's former president, was imprisoned. Tour operators say travel programmes for students remain a niche territory. "This was something novel and when we first started in the year 2010, other company was offering such educational opportunities and global enrichment programmes to students from India," says Vishal Verma, MD Frontiers Edutainment, which has organised over 80 such trips since 2010. The company offers programmes in the US, UK, Ireland and Singapore. "These range from 5 days to 14 days. We work with the education department of NASA's Space Centers to offer programmes to Indian students," says Verma. The cost of such trips, he says, varies from around Rs 60,000 to over Rs 2 lakh. Apart from overseas tours, students also get a chance to take learning out of the confines of textbooks by exploring local monuments and heritage. Academician Navina Jafa designs and executes heritage walks which she says brings in experiential learning for children and school teachers. "Through heritage children can also be introduced to different professions. A trip to the local stepwell can encourage a child to creating a career in environmental development," says Navina. Equipped with a doctorate in Performing Arts, Navina, the lead Heritage Consultant for Shahjahanabad Redevelopment Corporation in the Delhi Government, designs travel packages that take students to cultural sites. "We flag off two walks every month in Delhi on weekends. Anyone can attend these walks. They are usually around a monument and include not only the architecture of the monument but other aspects, like birds too. They also help showcase the changing aspects of Delhi, the areas which have changed over time," she says. "Slum children of migrants too are involved which create a sense of belonging to the city," she adds. Another important name in the field of heritage education is Smita Vats who conducts study tours for school students. "These walks are about understanding heritage and culture by breathing, away from the television and computers. Children inherit heritage from home, city and the country. We try to incorporate heritage into curriculum and encourage resourceful learning," says Smita.

FICCI Quarterly Survey on Manufacturing for the second quarter of FY 2013-14, has indicated a slight upturn in manufacturing activity. Recent initiatives of the government to remove supply bottlenecks by clearing some of the large projects are perhaps reflected in the higher growth expectation for manufacturing sector in quarter two of 2013-14, noted the survey. The proportion of respondents reporting higher levels of production in second quarter of 2013-14 has improved to 47% as compared to over 35% in previous quarter. Similarly, proportion of respondents expecting any fall in their production level in second quarter has also fallen to 16% as compared to 26% in previous quarter. Upturn in industrial sector is particularly evident in sectors like leather, textiles, cement and chemicals. At the same time, sectors like automotive, capital goods, textiles machinery, paper and food are expected to witness sluggish growth in the current quarter. FICCI’s latest quarterly survey gauges the expectations of manufacturers for Q-2 (July-September 2013-

The demand conditions however remain subdued as only 32% respondents reported higher order books for July-September 2013 vis-à-vis previous quarter. In previous three quar-

ters (Q-1 2013-14; Q-4 2012-13 and Q-3 2012-13) only 31 to 39% respondents reported higher order books. Capacity Addition & Utilization In terms of investment, it remains subdued in manufacturing sector as was the case for previous quarter with 74% respondents not having any plans for capacity addition for next six months. Sector wise, on the one hand we have sectors like chemicals, textiles, leather & footwear where capacity utilization has either improved or almost remained same over the last few months, on the other hand we have sectors like metals, food products and automotive where the average capacity utilization has fallen over the previous quarter. Exports Slight improvement in export outlook is possible due to some revival of demand in US and Japan and also due to impact of rupee depreciation, but exporters are not able to leverage this opportunity due to following reasons: High import content compensates for any gain from rupee depreciation Exchange rate is hedged in forward markets

Inadequate orders in major markets like EU In Q-1 2013-14 around 36% respondents were expecting better export outlook and in Q-2 of 201314 also similar proportion of respondents expect better export outlook. However, it seems that growth in exports has bottomed out and exports may not fall further as proportion of respondents expecting reduction in exports has fallen from 32% in Q-1 to 22% in Q-2.

Rupee Depreciation & Imports An overwhelming 85% of respondents reported that rupee depreciation has impacted their raw material input cost. On an average, rupee depreciation has increased input cost by 11% for the manufacturers. Credit Rate Credit rate paid by the manufacturers ranges from 8 to 16% as per the survey with 42% respondents getting credit at over 12%. Hiring Over 75% of the respondents are not likely to hire new workforce in next three months. This proportion has increased as compared to previous survey in which around 70% respondents did not expect to hire new work-

force in coming months. This is also reflected by way of lack of expansion plans of manufacturers as explained above. In addition, availability of skilled labour was a significant challenge for the manufacturers with 65% respondents finding it difficult to get right skilled people. Power Scenario Around 49% respondents view deficiency of power as a major or moderate constraint for the growth of manufacturing. Further, 37% respondents were dependent on captive power for their manufacturing units. The cost of captive power for the manufacturers ranges from Rs 3 per unit to Rs 20 per unit. High cost of captive power is due to high cost of fuel required for running the gensets. Sectoral Growth Based on expectations in different sectors, the Survey pointed out that five out of twelve sectors were likely to witness low growth (less than 5%) as compared to seven sectors in the previous survey. Only three sectors namely, cement, leather and paper are expected to have a strong growth of over 10% in JulySeptember 2013.

According to Dhawan there is concern for past few months that FIIs investments into Indian equities and bonds are at historic highs. “This along with waning interest from the retail investors is resulting in exaggerated market moves either ways, whenever the FIIs are selling or buying in sizeable volumes,” he says. However, he feels that certain quality stocks and sectors are overdone on the downside, “We expect a sharp rebound in the near to medium term. So the market will have winners and losers and the right stock and sector selection is the key to making money in current market conditions,” he says. ”We feel that there is a distinct possibility of the markets making fresh historic highs towards the end of the year. Although, in the nearterm the volatility will remain elevated,” he adds. “If the FIIs pull-out money from the Indian markets en masse then any level is possible on the Nifty on the downside, however if the Nifty goes below 5400 then it will be a good opportunity to buy quality stocks with a medium to long-term horizon,” he advices. Chouhan, Head, Technical Research, Kotak Securities feels that it’s a really a fearful stage for the Indian market. “As the time is passing it is receiving all negative news flows,” he says. According to Chouhan, the equation of the rupee and crude prices is also impacting the core economy. “The pessimism is increasing and in case, if FIIs start following it, then the market may fall to extreme levels in the coming few months,” feels Chouhan. Incidentally, if we consider the overall industries in India, one would witness that the slowdown is persisting for the last one year with GDP growth significantly under pressure and the investment cycle at a near halt. The broader market is moving based on certain sectors such as IT, FMCG, Pharma and Oil &Gas. “The broader market breadth is poor that will keep sentiment weak,” states Chouhan. “In brief, in the long run (6 to 9 months) the market will come down from the current level, but in the short term, due to an over retracement or oversold situation the market may bounce back to retrace some of its losses,” he says. “The level of 5850 is going to act as a major hurdle for the market and above that 5970 is not ruled out. On the down side it has support at 5660 and below 5660 it may even fall to 5400 with a minor support at 5560,” he adds. But has the RBI’s decision to stave off the rupee fall really helped? “Certainly not,” says Siddharth Rajpurohit, Sr. Equity Research Analyst, The Market. “The temporary steps taken by RBI on money market

rates to curb the fall in USD/INR has not really helped to restrict the fall. Hence RBI would be forced to maintain these steps for a longer period,” he says. Rajpurohit feels that due to the stiff liquidity scenario, banks have started to increase the base rates and in a poor economic scenario; rising of interest rates would further dampen the economic outlook. Incidentally, the RBI and finance ministry are considering other steps such as increasing margins and restricting trade of USD/INR futures outside India. The government is also trying to boost exports with higher interest rate, increasing subventions and adding more sectors under it to strengthen the currency. However, Vikram Dhawan feels that the RBI’s decision to defend the rupee is a bold one as history is replete with instances where Central Banks have tried unsuccessfully to manage currency rates over a longer period of time. “So we presume that it is just a short-term measure and interest rates will resume their southward journey in the not too distant future,” he says. “Moreover rupee has depreciated very steeply in a very short period of time and we don’t’ see a significant downside from here in the near-term, unless there are policy mistakes or populist moves by the government,” he adds. Another question doing the rounds is: Will the markets factor in good monsoons? “Good monsoons are a welcome respite in these tough times and it will definitely improve sentiment for both equity and bond markets,” feels Dhawan.

The share of Agriculture and its allied sector is close to 14% in our GDP. Also Agriculture is the largest employer in India. “A better monsoon is definitely good news for India as it would further give a boost to consumption with increased money supply flow in the economy,” says Rajpurohit. He feels that this would lead to revival in many sectors and hence, the markets may witness a positive move with the onset of the harvesting season. According to Vishal Jajoo, Senior Research Analyst (PCG), Nirmal Bang Securities, the good monsoons have already started getting factored in the stock prices of FMCG companies. “We expect this trend to continue going forward as well,” he says. However, Shrikant Chouhan feels that the real fruit of it will be realised only after September 2013. “This time the rainfall is over and above average. How actually, it turns up till the end of August will also matter a lot,” he says. Chouhan feels that in the past, even if India got good monsoon it was very difficult to get the real advantage of it to boost the economy, due to lack of efficient logistic and storage facility. So how should your portfolio look like? According to Dhawan, the banking and commodity sectors are cheap from the medium to long term perspective and once the monetary easing resumes, then we expect all the cyclicals to bounce back sharply. “Accumulate Blue Chips at every steep fall and keep excess cash in Tax-free Bonds,” he says. Siddharth Rajpurohit feels that one must definitely consider FMCG and

Pharma for investment and apart from this the other better opportunities lies in Agro based sectors (except fertilizers), tractors and certain private banks. “Small investors must invest in blue chip companies and avoid companies with huge debt and sectors such as power, infra and capital goods. Investors must also diversify their portfolio across various assets classes,” he advices. “Due to uncertainties and still the picture of a broader economy is not clear, we have to look for defensive sectors like Technology, FMCG and Pharmaceuticals,” says Chouhan. “They are trading at rich valuations and buying on dips is advisable,” he says. Chouhan advices retail Investors and NRIs, that they should look at adding and holding on to Index linked Stocks to their current portfolio with a focus on Sector Leaders or Blue Chip Stocks especially at declines. “Further fluctuations are expected especially in the next 30 days and thus, traders need to optimize profits in an ideal situation or minimize loss in a normal trading landscape,” he adds. Vishal Jajoo warns against speculative investments. “Don’t try and time the markets,” he says. “One should use the weakness in the markets to invest in companies with consistency in earnings, strong cash flows, excellent corporate governance and which have decent visibility in their earnings,” adds Jajoo. However, he feels, in the short to medium term, IT and FMCG should do better.

fter a phase of oblivion, mutual fund distributors and advisors are surfacing again. Don’t be surprised if your lost agent is back punching your doorbells to give you his advice. This is evident from the commission earned by mutual fund distributors that surged by 26% to Rs 2,367 crore in 2012-13, driven by improved market conditions, even as their number fell during the year. According to latest data available with Association of Mutual Funds in India (AMFI), the total commissions earned by 332 distributors stood at Rs 2,367 crore in 2012-13, while banks such as Citibank, HDFC Bank and HSBC Bank topped the chart with highest commissions. This was 26% higher than the total commission of Rs 1,883 crore given by the fund houses to their 373 distributors during the fiscal year 2011-12. Market participants attributed the spike in commission to better capital market conditions last fiscal coupled with measures taken by Sebi for the benefit of the sector. Interestingly, many distributors earned commissions despite net outflows of the investor money through their accounts. There were seven banks among the top-ten mutual fund distributors in terms of com-

As per the latest disclosure of commission and expenses paid by various fund houses to their distributors, Citibank led the list earning a commission of Rs 165 crore followed by HDFC Bank (Rs 160.88 crore), HSBC Bank (Rs 144 crore), NJ IndiaInvest (Rs 124 crore) and Standard Chartered Bank (Rs 88 crore). Besides, there are four other banks among the top-ten commission earners - Standard Chartered Bank, Axis Bank, ICICI Bank and Kotak Mahindra Bank. The commission paid to the top 20 mutual fund distributors went up by 23% to Rs 1,448 crore in the past fiscal ended March 31, 2013 from Rs 1,176 crore in 2011-12. During 2012-13, mutual funds’ assets under management (AUM)

ast week the rupee dropped to a record closing low on the last trading day of the week. It depreciated by almost 3.50% last week, the worst fall in a week after 22 months. Now the investors have lost the confidence in Rupee as Indian shares has also declined nearly 1% on last Friday, marking their eighth consecutive session of fall and posted its biggest weekly fall since mid-March which has further weakened the Rupee. Constant measures taken by the regulators to defend the currency have failed, as visible by the market sentiments. Spot Rupee is expected to breach the all time low to trade near 62.00 levels. Measures taken by the RBI will

hamper the growth in the short-term period as India’s own record high current account deficit is at 4.8% of GDP and existing fundamental weakness has further depreciated the Rupee. The trading range for the Spot USD/INR pair is expected to be within 60.70 to 61.50. It is recommended to be cautious and Buy USD/INR Futures on dips with the appropriate stop loss as the rupee at this stage is expected to depreciate against dollar. Pivot Point for the Pair is at 60.75. Last week the RBI as expected kept policy rates unchanged, the Repo rate at 7.25%, Rev Repo at 6.25%, CRR at 4% and MSF at 10.25%. The steps taken by the RBI are mainly focusing on exchange rate stability which can hamper growth in the short-term period as India’s own record high current account deficit at 4.8% of GDP has made the rupee vulnerable. As per RBI, at present their priorities are to stabilize the rupee, support the growth and to keep down the inflation. Measures taken by the regulators are in line to recover from this situation. The steps taken to revive the rupee condition will not change India’s situation overnight, as to recover from this, India will have to control inflation, increase the foreign fund inflows; and also will have to increase the manufacturing and production base to contin-

ue the India’s growth story. The weaker than expected payrolls number in addition to the caution in the Fed’s statement suggest that the balance of risks to monetary policy have shifted. While one payroll report may not be enough to dissuade the Fed from tapering in September, it certainly decreases its urgency. Between now and the next FOMC meeting, the Fed will be closely monitoring incoming economic data. We have one more payroll report before the next FOMC

RBI Chokes Growth; Government Watches Inactively

D

espite the growth choking measures and collateral damage caused by RBI, volatility in the Indian currency continues even after 2 weeks. Even as the Governor of RBI addressed TV audiences and later through the day he addressed the press, the rupee fluctuated even more violently last Tuesday, depreciating by a record 1.8% on that day alone. A 50p movement in the rupee has become quite a normal thing. The only way it gets controlled is when RBI directly intervenes. This is leading to even more flight of capital from stock markets as well as bond markets, resulting in even more depreciation. With US growth figures coming in better than expected, hot money will move to the US. The CAD problem is not new to India. It has been above the comfort zone of 2.5% of GDP for the last 4 years, and was the Government and RBI sleeping or complacent to allow CAD to be financed by FII flows. The structural reforms of booting growth of exports that the RBI governor is talking about, does not happen overnight. It will take drastic measures to lift exports and even then it will take 8 to 9 months. Was the RBI not aware that the QE3 was not going to go on forever, that growth should have been boosted much earlier by cutting rates. Now it is caught in a bind and the Government is suddenly opening up FDI limits in various sectors. Just raising limits does not bring in FDI rushing into the country. As a short term measure the Government should announce Sovereign Bonds and long term NRI Bonds which will quickly bring in 20 to 30 billion dollars. More importantly, it will improve sentiment. But the FM says we are ‘considering’ it and talking to pension funds. ‘Considering’ and ‘talking’ won’t help. We need action and quick action. Look at the mess the government made of the Jet Etihad deal. It took seven months to fructify when people had thought initially it would happen in a week. It kept going back and forth from DIPP to FIPB to SEBI to CCEA to the Cabinet. All these concerned people could have come together and addressed all concerns, if they sat together, within a month. It’s only a 900 million deal. What signal does it send to Foreign Direct Investors? That this government can’t make up its mind with all the brightest economists like Raghuram Rajan, Montek Singh, P.Chidambaran and the PM himself. I think perhaps it’s the case of too many cooks spoiling the broth. This time around they can’t even blame the opposition for stalling their decisions. Let me again point out that the biggest component of the CAD is the Energy Bill and nothing is being done to encourage onshore and offshore exploration. Who would have thought that there was oil in Rajasthan until a technically competent foreign company was allowed to explore oil. This also brings in quick and large FDI because oil is the scarcest commodity of the world. When Obama was re-elected 2nd time, he vowed to have an aggressive policy to make US energy independent by 2020. He is well on track with large discoveries of Shale gas and also they are looking for conventional oil in Alberta valley, California, where large fossils of dinosaurs have been found, which is an encouraging sign. If India continues mismanagement and bad governance, if we slip to below 4% growth next year and US will be closer to 3%. Then the India growth story repeated ad nauseum will die and it will be manmade.

he securities business in India is constantly changing and becoming more complex than what brokers have been used to managing through the years . A structured approach to management of compliance risk is imperative in assuring investor protection and the financial health of Broking firms. Implementation of all regulatory circulars issued by SEBI and the Exchanges need to be tracked from receipt to implementation with a defined process of proactively identifying and addressing exceptions. The “risk” that a broker needs to manage is vast and significantly expensive than ever before. It is in the interest of the Broker to constantly take stock of the common risks that this business needs to deal with today and find ways and means to mitigate these risks. The key five cardinal principles to achieve a robust compliance framework across the organization are as under: Invest in a Compliance Risk Management System: Brokers with a large footprint and a large client base have to constantly reach out to employees and authorized persons/ sub brokers to ensure complete understanding and robust implementation of the prescribed circulars. There must be a consolidated database of all regulatory guidelines and circulars available to all staff involved in servicing customers and dealing with the regulators. There are multiple compliance solution providers who have systems and solutions which can supplement the efforts of the Brokers’ Compliance and Operations Teams to bookmark diaries, cross reference and provide explanatory notes and alerts for effective implementation of the prescribed guidelines across the organization. Build Prevention of Money Laundering and Customer Due Diligence sensitivity across the organization: Brokers must implement robust process and controls to execute the onerous task of implementing “Know Your Customer” guidelines. This regulation will be the key driver of future strategy of compliance implementation across the broking services industry in India. Brokers must be extremely wary to any possible red flags, which may or may not merit the filing of a Suspicious Activity Report (SAR) with the Financial Intelligence Unit (FIU) of India. Identifying a potentially suspicious transaction is always a sub-

jective determination and it is in the interest of the Broker to adopt a conservative approach to this challenge. In anticipation of the questions that Brokers typically receive from regulators, it is prudent to ask customers the difficult questions revolving around source of funds and validate documents to establish the income levels of the customer. The regulator with the advantage of hindsight looks not only at what the broker did about a suspicious transaction but also whether the broker took adequate corrective and preventive action to ward off any such risks in the future. Ensure screening of employees and sub brokers/ authorized persons, formal induction and training, mystery shopping and surprise audits at branches and sub broker locations: Employees and sub brokers are the face of the Broker and the commitments they make to customers and their actions, determine the fate of the business in the long term. Brokers must deploy independent screening agencies that provide such verification services for potential employees and sub brokers. Current trends on customer complaints and business sense demands that this scrutiny, though expensive, may prevent many problems in the future. Further, employees and sub brokers must be trained and inducted into the organization so that the requirements of operating in a regulated environment are well understood. Mystery shopping posing as potential customers using third party agencies may help Brokers identify and correct malpractices and wrong commitments made to customers. Surprise audits at locations where there are large transaction volumes or significant customer complaints is a necessary operational control that Brokers must implement to mitigate investor complaints and regulatory breaches. Keep electronic and hard copy audit trails of all customer transactions, customer communications and regulatory reporting: Brokers must have strict controls to generate hard copy and electronic footprints of all transactions, customer correspondence and regulatory reporting executed by them and have a robust archival strategy to keep such records for future reference. All returned mail both electronic and hard copy should be subject to detailed follow up and additional due diligence so that all customer records are current and relevant. Inability to provide such records and audit trails can attract severe disciplinary action from the enforcement agencies. It will not matter how good the Brokers’ system or process is unless they can prove it to a regulator – the regulator insists on seeing documentation to validate any transaction. Implement Key Control Standards and an internal self assessment control checklist across the country: Key Controls Standards and Self Assessments (KCSA) are critical for assurance of regulatory compliance across all locations where the Broker is represented. This completed self assessment checklist must be reviewed by the Compliance Team regularly to identify any escalations and take proactive action to close any exceptions highlighted by the operating units.

NSE India : CNX Nifty — Daily Market Report for: Monday (August 5, 2013) By Dominic Rebello

REVIEW OF THE PREVIOUS DAY:

The Nifty fell moderately on Friday (August 02, 2013) a net 49.95 points (0.87%) and closed at the 5677 point level. The market opened up with a gap at the 5750 points level. It then rose further and registered the day’s high at the 5761 points level at 9.16 a.m. The index then declined and turned into a range bound movement until 11.30 a.m. It then declined sharply into the red and registered the day’s low at the 5649 points level at 2.47 p.m. The index then rose and turned into a range bound movement until closing at the day. The Nifty witnessed a choppy session, moved in a range of 113 points and closed below the psychologically important 5700 points level. Sentiment was bearish and amongst the 50 Nifty stocks 35 were losers, while 15 were gainers. Some buying was witnessed in IT, technology and oil & gas stocks, while substantial selling was witnessed in realty, power and metal stocks.

TECHNICAL ANALYSIS: Volume: Volume (Qty shares) decreased 5.40%. This change is small and indicates a moderate participation by investors.

Market Breadth: Overall Market Breadth on the NSE was negative. Amongst all the traded stocks, 392 were gainers, 937 were losers and 62 remained unchanged. Slow Stochastic Indicator: The Slow Stochastic Oscillator has risen in the over-sold zone. The Slow K line in the Stochastic Oscillator has risen above the slow D line (positive and a buy signal).

RSI Indicator: The RSI is above the 30 level but is now declining (negative if it continues).

MACD Indicator: The MACD is below zero and is declining (negative if it continues). It is below its 9-day Average (negative).

Is below its 200-day average (at 5854) Negative.

Overall Market Strength/Weakness: The indicators and oscillators discussed here are indicating a weak market with a negative bias.

Support Levels: For short-term traders the immediate main support is at the 5636 points level. The next support is at the 5578 points level.

Resistance Levels: The immediate main resistance is at the 5951 points level. The next resistance is at the 6108 points level.

Pivot Point Analysis: For intraday traders the support and resistance levels are calculated according to the pivot point theory and are: Pivot point = 5696 (This is the level where the trend is likely to change during intra-day). Support (1) = 5631. Support (2) = 5583. Resistance (1) = 5744. Resistance (2) = 5809. OUTLOOK FOR TODAY:

On Japanese candlestick patterns the index has formed a second consecutive and long black body candle. This is negative. Further, the index is below the 5, 15, 25 and 200 day’s moving averages, while the 5, 15 and 25 day’s moving averages are declining. Moreover, the velocity parameters too indicate weakness. All these indicate a negative bias and the possibility of a further decline unfolding. Investors are advised to avoid buying at present levels.

Work with strict stop losses on all positions

ADX Indicator & DI Lines: The +DI line is below the –DI line and both lines are diverging (negative if it continues). The ADX is rising while the Market Index is falling, which indicates that the present down trend is increasing in strength. MOVING AVERAGES (TREND INDICATORS)

The index: Is below its 5-day average (at 5746) Negative. Is below its 15-day average (at 5910) Negative. Is below its 25-day average (at 5892) Negative.

CMP: Rs. 2237 Target Rs. 2532 Dr Reddy’s Laboratories (DRL) reported lower-than-expected numbers for 1QFY2014 on the top-line and bottom-line fronts. The EBIT margin came in at 13.3% vs our expectation of 16.8%. Consequently, the net profit came in at Rs 361cr, a growth of 7.4%, lower than our expectation of Rs 453cr. The margins fell higher than expected on back of higher R&D expenses during the period, which rose by 55% yoy. We recommend an Accumulate rating on the stock with a price target of Rs 2,532. Outlook and valuation: For DRL, we expect net sales to report a 14.9% CAGR to Rs 15,350cr and adjusted EPS to record a 10.8% CAGR to Rs 126.6 over FY2013-15. We recommend an Accumulate on the stock with a price target of Rs 2,532.

ICICI SECURITIES CALLS A ‘BUY’ ON MOTHERSON SUMI

CMP: Rs. 209 Target Rs. 237 Motherson Sumi (MSL) reported its Q1FY14 results, which were higher than our estimates on the margins front, as key subsidiaries SMR and SMP performed well. The consolidated topline at Rs 7082.6 crore (~11% YoY growth) came below our estimates as standalone sales grew only 1.7% YoY. Operating margins (adjusted for forex impact) came at 8.8%, up 30 bps sequentially as raw material costs declined and utilisation levels improved. Subsequently, PAT, adjusted for forex, came at Rs 242.5 crore, a 16% YoY jump. Adjusted for adverse forex movement, PAT was at ~Rs 161 crore. Significant growth was witnessed in SMR’s performance, as the topline (£283 million) grew 22% YoY and margins expanded to 8.7% (370 bps YoY improvement) as major clients continued to perform well. Notable aspect of the quarterly result was that SMR’s RoCE has increased to 28% from 14% last year. The business profile of MSL continues to grow stronger as it becomes a one-stop supplier for global clients. With utilisation levels improving and new carlines added, we expect revenues and margins to rise for SMR, SMP. We continue to recommend BUY with a target price of Rs 237.

RELIGARE CALLS A ‘BUY’ ON BANK OF BARODA

CMP: Rs. 488 Target Rs. 775 BOB’s Q1FY14 earnings were in line, but asset quality risks remained elevated and future profitability outlook subdued. Business growth was muted and NIMs declined by 9bps QoQ. Impaired asset formation remained high at Rs 40bn (~5% on annualised basis). PAT was higher than estimates at Rs 11.7bn (+15% QoQ), but driven by trading profits. We cut FY14/FY15 EPS estimates by 17%/16% to factor in lower growth and higher provisions, but maintain BUY on attractive valuations (0.6x/4.8x FY14 ABV/EPS). Slippages/restructuring remain high: Slippages/restructuring were high at Rs 19.6bn/Rs 20bn. Slippages from domestic advances stood at Rs 18.4bn (3.7% on annualised basis). Recoveries/upgrades improved from Rs 2.3bn in Q4FY13 to Rs 3.5bn in Q1FY14 but remained lower compared to peers. GNPLs/NNPLs increased by 59bps/41bps QoQ to 3%/1.7% and the PCR declined to 44.3%. Outstanding standard restructured assets stood at Rs 175bn (5.4% of advances). NIMs under pressure; advances growth muted: Advances/deposits declined by 1.4%/1.5% QoQ (up 13%/22% YoY). Domestic advances grew by 10% YoY whereas growth in international advances (+18% YoY) was driven by INR depreciation. Domestic/international NIMs declined by 9bps/17bps QoQ to 2.84%/1.3% as pricing power remains weak. However, the domestic C/D ratio was low at 66.5% which could provide support to NIMs. Other income grew by 60% YoY, but driven by trading profits (Rs 4.1bn as against Rs 815mn in Q1FY13). Opex increased by 27% as the bank provided Rs 1bn/Rs 0.75bn towards pension liabilities/wage revisions. Subdued near-term outlook but valuations attractive: We cut our FY14/FY15 earnings estimates by 17%/16% to factor in lower growth and higher provisions, and trim our TP to Rs 775 (from Rs 875). The demands for separate states have come from across the country -- for Kukiland in Manipur to Kongu Nadu in Tamil Nadu, for Kamatapur

However, except Uttar Pradesh, which during the Mayawati- led BSP government proposed to create four states dividing the country's most populous state, no state government had given any recommendation for carving out a new state. But the demands continue to pour in. "The demands for creation of separate states were received by the Home Ministry through representations from various organisations or individuals over the years," a Home Ministry official told PTI. The demands for separate states are: In Uttar Pradesh, there have been demands for Awadh Pradesh, Poorvan-

eastern UP, Bihar and Chhattisgarh has also been received by the Home Ministry. There has been an old demand for creation of a separate Vidarbha by curving out the Vidarbha region of Maharashtra. The most vocal demands for separate states came from Gorkhaland, by curving out Darjeeling and its adjoining areas in West Bengal. Demands for Bodoland, comprising Bodo dominated areas in Western Assam, and a separate state of Karbi Anglong, comprising the Karbi tribals living areas under Karbi Anglong autonomous district in Assam, have also been pending with the Centre. There is a demand for

Mithilanchal comprising Maithili speaking regions of Bihar and Jharkhand. The Centre has received demand for creation of Saurashtra by curving that region out of Gujarat. The Dimasa people of Northeast have been demanding a separate state called Dimaraji or Dimaland comprising the Dimasa inhabited areas of Assam and Nagaland. There is a demand for creation of Kongu Nadu comprising parts of southwest of Tamil Nadu, southeast of Karnataka and east of Kerala. Demand for creating a Coorg state, comprising the Coorg region of Karnataka has also come to the Centre. Representation has also received for creation of separate Kosal state comprising some districts of Odisha, parts of Jharkhand and Chhattisgarh. There is a demand for Tulu Nadu comprising a region on the border between Karnataka and Kerala. The demand for separate Kukiland, comprising Kuki tribal inhabited areas in Manipur has also been raised. A demand for creation of Konkan, comprising Konkani speaking part of Western India along the Arabian sea coastline has also been raised. There has been a demand for creation of Kamtapur comprising some districts West Bengal, including Cooch Behar and Jalpaiguri. Some people from Garo regions of Meghalaya are demanding for a new state of Garoland. Besides, there is a demand for a separate Eastern Nagaland by curving out some parts of the Northeastern state. The demand for creation of an Union Territory for Ladakh has also been pending with the Home Ministry. So far, India has 28 states and seven Union Territories. Telangana will be the 29th state of the country.

With the help of these forged letters present on file, property dealers managed to press the point that despite the allottees having informed DDA about the change of address, they did not receive allotment letters, hence their allotments should be revived.

Citing the letters, they sought fresh allotment of flats at the old rates and managed to obtain Low and High-Income Group and Self-Financed Scheme flats which had already been cancelled by DDA. CBI has so far managed to track three such cases, sources said, adding that proper scrutiny was being done of allotments of a total of 250 flats advertised in 1979. Six DDA officials, original allottees of the flats, and several property dealers have been accused by CBI of cheating and forgery along with offences under the Prevention of Corruption Act.

‘Human activities increasing risk of calamities in Kedarnath’ EW DELHI: Increasing human activities are augmenting the risk of natural disasters in the ecologically sensitive region of Kedarnath which was washed away by floods triggered by cloudburst in June, a latest study claims. A team of scientists from the prestigious Wadia Institute of Himalayan Geology has warned that rise in human activities around the area like pilgrimage and tourism would increase the risk of such disasters occurring in future. EW DELHI: CBI has busted a racket by property dealers who allegedly revived cancelled flats illegally in collusion with DDA officials and made huge profits selling them at premium rates. The flats involved are those which were advertised in 1979 but got cancelled after the allottees failed to pay up, reports PTI. CBI in its probe has found that in 2007-08, the property dealers approached these allottees who, against payment for the cancelled flats, agreed to sell them their allotment letters. CBI sources said that the

channels of Mandakini and Saraswati rivers which meet near the town. The study led by scientist D.P. Dobhal, well-known for his work on Himalayan glaciers, says overcrowding of people and constructions have obstructed the natural flow of Saraswati river which now flows just behind Kedarnath town, reports PTI. Similarly on down-stream near Rambara and Gaurikund, houses were constructed on loose soil making them prone to natural disasters and landslides, it said. Dobhal, who has been named in the Time magazine list of 'Heroes of Himalayas' in 2007, said heavy rains on June 16 evening flooded the catchment area of Saraswati and Dudh Ganga resulting in overflowing of channels which triggered erosion and subsequent silting up in the rivers. This resulted in huge volumes of water along with loose soil and debris from glacial moraines forming a slush which moved with unprecedented energy towards Kedarnath town and washed off its upper parts where Sankaracharya samadhi, Jal Nigam guest house and Bharat Seva Sangh Ashram are located. "While reconstruction efforts are going on in the region, government must ensure that construction should take place away from the temple at a safe location. Strict environment guidelines should be followed and a database of pilgrims climbing towards temple should be maintained to avoid such mis-happenings," Dobhal told PTI.

By Sandeep Hattangadi How do you feel on completion of your three years in Balika Vadhu? In one word, it’s magical. In this last three years I have realised one thing that I can act (smiles). Working with actors like Sulekha Sikhri, Anoop Soni, Satyajit Sharma, Smita Bansal is not a joke. Their experience is huge and they are a source of constant support for me. I am thankful to them and to my viewers for accepting me. Their feedback inspires me as an actor. How do you feel on completion of five years of this show? Balika Vadhu is a cult serial. Running continuously for five years is an achievement. There are shows which celebrate 400 episodes. I feel this serial is excellent. I love to act and do not bother about the commercial aspect. I don’t understand the TRP business. A good show is all about a good story and script and this serial has all that and more.

Apex Court to interpret ‘juvenile’ I

n what seems like a huge fillip to public sentiments, the Supreme Court has, just recently, agreed to consider the plea to reinterpret the term ‘juvenile.’ Last month, president of Janata Party and parliamentarian Subramanian Swamy filed a Public Interest Litigation in the apex court asking the court to consider the emotional, mental and intellectual maturity of the juvenile accused of December 16th, Delhi gang-rape case. At the time of committing the offence, the minor convict among those involved in the gang-rape was 17 years old. Swamy’s petition challenges the legal protection the nation offers to those less than 18 years of age. Agreeing to consider the PIL, the Apex Court also halted the proceedings of a juvenile court that was set to give its verdict on the accused in the December 16th gang-rape case. This proceeding is stalled until it could be decided that the accused can be tried as an adult in a special court where five other men (other convicts in the gangrape case) are facing charges of rape, assault, robbery and murder. For some time now, it is being debated whether the age of juvenile criminals be lowered. Various arguments and counter arguments have been offered over the subject but the matter is still being looked into. Ever since December 16th Delhi gang-rape, many petitions have been filed for lowering the age of juvenile criminals from 18 years to 16 years. Last month, the Supreme Court dismissed a batch of PILs asking to lower the age of juveniles, stating that ‘interference in the Juvenile Justice Act is not necessary.’ But, there have been reasons that vindicate the need for a change in the juvenile judicial system for - the protection of the juvenile convicts and outrage towards those like the juvenile in December 16th gangrape case.

THE LAW NEEDS REFORM URGENTLY...BOTH WAYS EARLIER, in February 2013, the Asian Centre for Human Rights (ACHR) released a report “Assam: The State of Juvenile Justice” revealing the sad state of affairs of juvenile justice system in Assam. An RTI application filed and data procured revealed that the case pendency before Juvenile Justice Boards (JJBs) in Assam is very high and the pendency ranged from 33.3 per cent in Udalguri district to 100 per cent in Dhemaji and Morigaon districts. The reports revealed there aren’t many homes for juvenile delinquents and for the 27 districts in the state. Reportedly, there are only four Observation Homes and three Children Homes run by the

It has been reported that these juvenile delinquents are often tortured in the police custody and the juvenile delinquency is high in the state. Around seven Open Shelters were supposed to be set up in Assam in 2011 but the state failed to do so despite the availability of funds under the Integrated Child Protection Scheme, usually offered as the reason for such inactions. Due to this lackadaisical attitude of the state, the Project Approval Board of the Ministry of Women and Child Development declined to accept the request for grants for three existing Open Shelters in Assam. In a similar situation in Bihar, around this time last year, it was revealed that over 16,000 juvenile cases were pending with the Juvenile Justice Boards in various districts in Bihar. In one case of pendency in Uttar Pradesh, a 40-year-old man appeared before the Supreme Court 25 years after allegedly killed his wife for dowry. It turned out that the man was a juvenile when he killed his wife by setting her on fire. He was sent to appear before the juvenile justice board by the SC. While case pendency before the

Juvenile justice board is one serious problem, the debate on the reduction of the age of juvenile convicts from 18 years to 16 years holds ground as well. According to data revealed by the National Crime Records Bureau (NCRB), it was revealed that most of the juvenile crimes are committed by those in the age group of 16-18 years of age. Reportedly, 64 per cent of the juvenile crimes are done by those between this age group. NCRB data also revealed rapes committed by juveniles have jumped by 188 per cent. Crimes like robbery and theft committed by minors have also risen around 200 per cent. In 2011, the growth in rape by juveniles, of around 34 per cent, when compared with 2010 was among the highest. The reports showed that in 2011, 33,887 juveniles were arrested for 25,178 instances of crime. Of these, 1,211 juveniles fell in the 7-12 years age group, 11,019 fell in the 12-16 years age group and 16-18 year age group topped the list with 21,657 instances of crime. In Delhi itself, of the 925 boys arrested for juvenile crimes in 2011, 567 were in the 16-18 years age group.

Although Modi too desired fighting elections from Lucknow, Singh induced him to fight the upcoming Lok Sabha elections from Varanasi, citing Hinduism and it being a city of religion as inducements. Those people who know Singh well are aware that he is adept at removing a thorn with a thorn. When Singh was the Surface Transport Minister at the Centre, even then he had sidelined Kesarinath Tripathi, Kalraj Mishra and Lalji Tandon in UP and cornered the chief minister’s post. When Singh was the Uttar Pradesh BJP president, he created an atmosphere in which Kalyan Singh directly revolted against Vajpayee and quit the party.

s the country nears elections, the election activity in political parties is increasing as rapidly. The Bharatiya Janata Party has started preparing publicly for the elections. Narendra Modi is in a position to control the Bharatiya Janata Party and quite deliberately, such pictures are coming out in which Lal Krishna Advani can be seen sitting with Modi. Modi has spread his checkerboard, but on that checkerboard he has also adopted a new strategy. He is not playing himself, but is getting the game played through Amit Shah. It was Modi’s decision to send Shah to Uttar Pradesh and before

that, to keep him in the Parliamentary Board. People in the BJP did not want to see Shah in such a big role. Somebody else should have been there, Arun Jaitley should have been there, but Modi does not have confidence in either Arun Jaitley or Sushma Swaraj. He has confidence in Amit Shah. Through Amit Shah he has also given a direct message to Uttar Pradesh. The message that if Muslims do not come with the BJP, then the guarantee for the life and property of Muslims cannot be given by the Samajwadi Party, cannot be given by the Congress and nor can the Bahujan Samaj Party give it. I am writing this with confidence because if Modi had made somebody other than Amit Shah in charge of Uttar Pradesh, I would never have doubts about the intention. But now there are doubts because Shah’s mind, his method, his thinking and his history is before the country. The Supreme Court has already accorded approval for a hearing against Shah. Perhaps there are many appeals too related to Shah

in the Supreme Court. On Amit Shah’s pretext, Modi is threatening not only the Muslims, but also threatening the Dalits. Shah has been a domineering type of minister and has been one who gives a direct message to some communities through some events. When such a minister goes as a political leader to UP, it is a direct message too for those who are orthodox Hindus that you people should stand up. If you stand up, then neither Muslims nor Dalits will dare to come before you. Modi’s message is spreading in UP through Shah, but the work of a bigger message than this had been done in UP during Kalyan Singh’s time by the Vishwa Hindu Parishad. Narasimha Rao’s Government was in Delhi and the Babri Masjid had been ‘martyred’, which people in the BJP call ‘demolishment of the structure’. Along with UP, this message was for orthodox Hindus in other States too. If they stand up now, after Rao whoever will be Prime Minister will be from the BJP, because the Masjid has been de-

molished and a grand temple of Lord Ram has to be built there. When the Babri Masjid had been demolished, Kalyan Singh was the chief minister. Singh was such a chief minister who had filed an affidavit in the Supreme Court saying that nothing will happen to the Masjid. In the next elections, the Hindus of UP made Mulayam Singh Yadav the chief minister. The Hindus of UP or the country did not make Atal Bihari Vajpayee the prime minister. They gave a majority to the parties ranged against the BJP and Inder Kumar Gujral became the prime minister. After this, Atalji did become prime minister, but the reason behind him becoming prime minister was not the Ram temple, or the demolition of the Babri Masjid. There was only one reason behind Vajpayee’s becoming prime minister – that in the name of the Third Front led by Deve Gowda and Inder Kumar Gujral became prime minister. They shattered the regard of the people of the country and disillusioned them.

Telecom Regulatory Authority of India (TRAI) Chief Rahul Khullar has suggested that his successor should preferably be from outside the IAS fold. The suggestion naturally raised eyebrows, as it was made publicly. More than reviving the old specialist versus generalist debate, observers were trying to read the tea leaves for any deeper significance in Khullar’s remarks. Like Khullar himself, former chairmen of TRAI including Pradeep Baijal, Nripendra Misra and J.S. Sarna have all had an IAS background and previous experience as Telecom Secretary before being appointed to the regulatory body. Besides the IAS, the Indian Revenue Service and Indian Telecom Service too also supplied a steady stream of officers to TRAI. But perhaps Khullar really has a genuine non-IAS candidate in mind when he aired his view.

Madhya Pradesh IAS officer Rajesh Rajora, for one, recently discovered the perils of annoying an income tax officer at some considerable cost. In 2008, Rajora, who was Home Secretary and also in charge of allocating Government houses to Central Government officials, apparently ignored a request from S.S. Rana, Director General of Income Tax for a sarkari bungalow. Rana, sources say, then got a bungalow allotted by approaching the Chief Minister directly. But Rana allegedly also ordered an income tax raid on Rajora, who was suspended for nearly 33 months. However, the State High Court has now come to Rajora’s rescue and vindicated his stance that the IT raid conducted at his premises was for not allotting a bungalow to the IT official. The Bench stated that the raid had no logical reasoning. That must have sounded like music to the aggrieved babu’s ears.

By registering a case against his peers and superior, the suspended officer created a stir in Patna’s bureaucratic circles. Unfortunately, the FIR

filed by Alok Kumar has now been rejected, and he faces a case for “forcibly trying to file a case”. Alok Kumar, however, is determined to carry on his fight. Though Director General of Police Abhayanand has not reacted to the suspended DIG’s accusation, it is clear that the case will not be resolved any time soon, given that it now involves the State judiciary.

ANGALORE: It was always a case of so near yet so far for ace Indian cueist Aditya Mehta in his nearly a decadelong career and the seasoned journeyman said he surprised himself as he graduated from bronze to gold at the World Games in Cali, recently. "I am just over the moon. This trip to Colombia was probably the best moment in my life. The format was tricky being a best of five and knockout. Even the table conditions were very different from what we are used to. I was surprised at how well I adapted to them. I just focused on the basics and tried to keep it simple," Mehta told PTI in an e-mail interview. Mehta, the undisputed king of the Indian snooker, has often found himself finishing secondbest in major tournaments but the 27-year-old Mumbaikar has finally been able to break the shackles and silence his critics with a gold medal-winning performance at the World Games. "It's just been such a long journey. My entire career has been about slow and steady improvement. I have learnt many lessons along the way. And to progress from the bronzes and silvers to gold medal was a matter of selfbelief. I am really happy with this achievement," Mehta said. By Mehta's own admission, he is living the best moment of his life after putting India on the global snooker map with his stupendous show. "The quarterfinal victory gave me a lot of confidence coming from 2-1 down and 50 points behind in the fourth frame. After that I think I played some of my best snooker till the end. It's easily the biggest moment of my career. It's a massive stage and I am proud that I could put India on the global snooker map," he added. Mehta became the first Indian to win the World Games title after comfortably defeating his higherranked Chinese opponent and pre-tournament favourite, Liang Wenbo, in the summit clash of the quadrennial event on Tuesday. NEW DELHI: The International Hockey Federation (FIH) has turned down former Indian captain Dilip Tirkey's proposal for increasing the number of teams in next year's World Cup. Tirkey had written to FIH president Leandro Negre requesting him to increase the number of participating countries in next World Cup to be held in the Netherlands next year. Negre, however, said it is not possible for them. "Your idea is in line with the FIH strategic plan and wishes. The FIH full agree to increase the number of team nations participating in the World Cup final and in this line the FIH Executive Board took, some month ago, the decision to have 16 teams for the World Cup in 2018," Negre said in his letter.

Rayudu, Mohit become eligible to make it to IPL auctions

NEW DELHI: Middle-order batsman Ambati Rayudu and seamer Mohit Sharma are all set to make it to the auction list of the cashrich Indian Premier League by virtue of having made their international debut in the recently concluded ODI series against Zimbabwe. A medal at the World Championships has eluded Saina so far as she could only reach the quarterfinals in the last two editions in 2009 and 2011. The 23-year-old from Hyderabad will look to better her record this time around. The world number three has been going through a lean patch for the last nine months as she has failed to win a single tournament but a six-week break after the Southeast Asian circuit in June has given the Indian ample time to regain fitness. Luck also seems to be at her side as she has got a bye in the first round and will open her campaign against the winner of Russian Olga Golovanova (ranked 66) and Bulgarian Alesia Zaitsava (ranked 104). Saina is likely to meet her first challenger in Thai Porntip Buranaprasertsuk, who is ranked No.18 in the world but she has never beaten Saina in five career meetings. INDIANS WIN 11 GOLD IN WORLD POLICE GAMES

ELFAST: Indians produced an excellent performance at the XVth World Police and Fire Games 2013 here, pocketing 11 gold, six silver and four bronze medals so far. The 39-member Indian team is taking part in a number of disciplines -- athletics, archery, boxing, judo, swimming and wrestling -- in the August 1 to 10 event.
