n a unique case of a litigation between an advocate and his client, a Pune-based warring couple has approached the Bombay High Court with a criminal writ petition after the First Class Judicial Magistrate in Pune issued a process for offence under Section 420 (cheating) and 120B (criminal conspiracy) of IPC against the couple for not

paying legal fees to their lawyer. According to the case, the couple – Harish Kale and Smita Harish Kale (name of the couple withheld) had differences in their matrimonial life and had approached advocate Mayuresh Kulkarni for his legal advice. Smita was known to the advocate Mayuresh through her parents. The lawyer advised that a petition for Divorce by mutual consent could be filed and the parties had 45 sittings. Kulkarni also e-mailed the draft of such consent petition to the wife, while it could not reach the husband. ngioplasty is quite a common procedure today. But a coronary angioplasty way back in 1988 was quite a deal when technology and infrastructure were not as developed as they are today. On this very day 25 years ago, Dr. Anil Kumar, now a Professor of Cardiology at Grant Medical College and JJ Group of Hospitals and Consultant Cardiologist at Bombay Hospital and Medical Research Centre, became the first interventional cardiologist to perform an angioplasty in a public hospital in Mumbai. The procedure was performed at the state-run JJ Hospital on a 50year-old. There cuould not have been a better day to talk about Dr. Kumar’s experience as JJ Hospital celebrates 20 years of performing angioplasty in the city. Here is what Dr. Kumar shared with us in a quick tête-à-tête. “The patient was a 50-year old man called Lakshman Hathankar. He was suffering from a right coronary artery disease and was eligible for an angioplasty”, Dr. Kumar said about his first angioplasty patient. “It was my first experience performing an angioplasty by myself. When I was in England learning about this procedure, I used to assist the doctors. But at JJ, I was the one doing everything. Conducting a surgery is completely different from assisting someone. At first, we noticed him because he was so different from the average student who lands up at St Pauls Institute for Communication Education (SPICE) in Bandra to do one of the many short courses that it offers. For one, he is older than the general run. For another, he is extremely well-groomed, in keeping with his comparatively mature ways. “Who is he?” we asked the executive manager of the institution. A student, she said smiling, and laughed when we got exasperated at the brevity of her explanation. But we insisted on knowing and finally it emerged that the gentleman in question was from the South African consulate, that he had done a photography course there and was just wrapping up his classes with a bit of editing and photo-shopping. This is where India’s true revolution is taking place, at the lower levels of a society that is still not jaded beyond belief and constantly cribbing about a system that does not work.

Not exactly popat, but close! Hopes and curiosity always soar when an august institution like the Bhabha Atomic Research Centre (BARC) calls for a press conference. Expectations of announcements of exciting studies, astounding results, pathbreaking research and mind boggling figures and statistics were what drew the media to the Press Club on Tuesday. After all, it was also Hiroshima Day and the links between good energy and bad energy were being speedily drawn. The panel of speakers was most impressive too.

What was actually provided was basic gyaan on radiation processes for agricultural products, other food products, nuclear medicine, so on and so forth. Disappointing! But to be fair to them, this is the first time that the BARC had called a press conference and they probably are still in their ‘ivy towers’ about what makes the media tick and sends it into a tizzy. One thing has, however, been established. The media will come whenever the BARC calls. Let’s hope the calling is a bit more frequent!

n a heinous act, a 29-yearold pervert raped his own mother in their home in Mankhurd. The accused is a drug addict autorickshaw driver whose wife left him and their children two years ago, unable to bear his sexual torture. According to the police, the accused, a resident of Lallubai Compound in Mankhurd, lives with his parents, his three children and a younger brother, and has multiple cases of attempted murder, robbery and assault against him at various police stations in Mumbai. In her statement to the police, the 49-year-old victim said, “On the previous night we all had dinner together. My elder son (the accused), his three children and I slept in the hall, while my husband and younger son slept in the kitchen. At around 4 am I felt something awkward and woke up with a start. Before I could react, my son gagged me and held a knife to my neck. He then raped me and threatened to kill me if I made a noise.” After committing the crime, the accused went to the bathroom to clean up, which is when his traumatized mother ran to wake up her husband.

n a daring attempt, four robbers on Saturday stole Rs. 1 lakh from a depositor in a bank in Kamothe in broad daylight. While three of the thieves have been arrested, one managed to get away. The robbers entered the SBI branch in Kamothe and stood in the deposit queue behind a boy who had come to deposit Rs. 1 lakh in cash. One of the robbers then pretended to accidentally push the boy so that the money would slip out of his hands. He then picked up the money and handed it to the boy out of goodwill. As the boy was counting the money to ensure none of it was missing, the thief then

snatched the bundle from him and fled with his accomplices, one of whom was an auto rickshaw driver. Mantralaya staff get salary via Aadhaar

he Government of Maharashtra yesterday claimed that it had become the first state in the country to disburse salary of its staff through their Aadhaarlinked bank accounts. All employees of the Information Technology (IT) department got their salary for the month of July through

their Aadhaar-linked bank accounts, an official release said. Rajesh Aggarwal, IT secretary, said the government has now decided to use the Aadhaar Payment Bridge (APB) system for all Mantralaya employees. Most of the Mantralaya employees have enrolled for the Aadhaar system.

ormer BJP MP Dr. Kirit Somaiya yesterday accused the ruling Congress leadership of a Rs. 100 crore scam in the allotment of Shiv Shahi Punarvasan Prakalp Limited (SSPPL) flats to Bangladeshi nationals without a list. Speaking to newspersons here, he stated that the flats which were meant to house the slumdwellers of Mahatma Jyotiba Phule Co-operative Society were instead sold by another organization to illegal Bangladeshi nationals. The BJP leader stated that SSPPL was supposed to have housed 357 families of the Mahatma Jyotiba Phule Cooperative Society, but the number of allotments was later increased to 1,182. Somaiya stated that instead of SSPPL, a company sold the Rs. 2 lakh flats at a price of Rs. 12 lakhs. While the Bangladeshis occupied the flats without any documents, the residents of Mahatma Jyotiba Phule Co-operative Society were shown to be rehabilitated on paper. Somaiya stated that the SSPPL sent reports of its investigation to Chief Minister Prithviraj Chavan twice, but no action has been taken so far. He added that the SSPPL, which probed the allotment, has no list of beneficiaries. Now, the residents of Mahatma Jyotiba Phule Co-operative Society are facing a threat of eviction as they are

n Wednesday at around 7.45 a.m., housewife Rajshri Narendra Shah (32) was robbed of her gold chain in broad daylight while on her morning walk near the H20 Club, close to Mafatlal Park at Marine Drive. Committed jihadi What mystified me completely was the certainty with which he knew that those in the group who wore Pakistani army uniforms were in fact just militants in disguise. How did he find all this out so soon? Does he have a hotline to Pakistani army headquarters and was he merely parroting what he was told? From what I know of such things, I know that army commanders on both sides are usually able to talk to each other so how is it that the army does not share the Defence Minister’s certainties? The Defence Minister’s mystifying defence of the Pakistan government could not have come at a worse moment from an international perspective. We are alas not a country that follows closely what is going on in the wider world so the Indian media has mostly ignored the decision of the United States government to close some of its embassies and consulates last week. The decision was prompted by fears that Al Qaeda groups in Yemen were plotting a series of attacks at the behest of Osama bin Laden’s lieutenant, Ayman al Zawahiri. This committed jihadi who is believed to have been the master planner of the 9/11 attacks recently made this statement. “Crusaders and secularists and the Americanized army have converged: with Gulf money and American plotting to topple Mohammed Morsi’s government.” He then apparently spent long hours chitchatting with jihadi

commanders and ordered them to attack American properties in the Middle East. This chitchat was intercepted by American spooks preventive measures were taken. What does this have to do with the attack on the LoC? Everything. Pakistan has been jihad central, as we in India well know, from long before the 9/11 attacks and if proof were needed of this it came when Osama bin Laden was found living happily in a Pakistani military town. Anyone who believes that he lived there safely

It could be the only kind of war we are ever likely to fight against Pakistan and it will almost certainly intensify once American troops start withdrawing from Afghanistan next year. Pakistan is paranoid about India’s intentions on Afghanistan and it is hard to meet even sensible Pakistanis who do not talk of

It was this kind of deluded thinking that caused the Pakistani army to create the jihadi groups that now proliferate across that country and sometimes threaten its existence. But, to believe that they are now out of control of Pakistan’s military men is to believe a lie. So if someone as important as our Defence Minister believes that it is possible for militants to reach the LoC, cross it and kill our soldiers, without the tacit support of the Pakistani army then we have cause to be very, very worried.

This made me extremely angry, even in my restful, distant spa, because we do not need ‘anguish’ from her, but an explanation for why national security has been so neglected by her government. A. K. So would Soniaji get down to finding out from him what strategy he has evolved to defend India against this insidious, ugly, undeclared war. She could begin by asking him how he found out so quickly that the men who killed our soldiers were militants and not Pakistani troops. Her next step could be to ask the Army Chief why the army’s view is different to that of the Defence Minister. After this, how about sitting these two gentlemen down in the privacy of 10 Janpath and asking them what India’s strategy is to take on the jihad and how it has improved and been strengthened since the attack on Mumbai five years ago. There have been as many as 57 violations of ceasefire by Pakistan. Whether regular army men crossed the LoC by 500 metres and killed five of our soldiers in Poonch or extremists in army uniform does not make any difference, since the fact remains that we lost five of our brave men. This raises the important question of how they were able to come so far into our territory if our army has been keeping a strict vigil over the LoC. Pakistan and China do appear to have a joint plan of military action against India as is clear from the Chinese stopping our army patrol midway in its tracks and ordering it back to Ladakh. Under the circumstances, one wonders whether talks at any level will be useful at all. there is a lot of pain. We shot the bold scenes in a very real and non-fussy manner. We were being honest to ourselves and the camera; originality is beautiful. The movie happened to me when I was in Delhi. I had almost left Mumbai and Bollywood when I came across the script. I read it on the phone and asked my mother if she would disown me if I did this movie, because it is a bold film. She laughed and said that I could do whatever I wanted and that I knew better. Even my father was fine with it. The story of B.A. Pass is intriguing and mind-blowing. I read the original short story (The Railway Aunty) too and the three levels of story to script to movie are quite evolved. Even the writer (of the short story) Mohan Sikka liked the movie. I feel complete after doing this movie as it has taken nearly two years of my life but it has been worth it.

Everyday I get messages in my inbox and on my phone that make me very happy. And it is just admiration and respect and best wishes... like my friend who had gone to Muscat told me about the people there who told her that they saw the trailer of the movie and loved it. Mahesh Bhatt hugged me and Vishal Bhardwaj called my performance brave, genuine and honest. The other day I was with one of my Chak De! India friends, having pani puri. Suddenly, a random person on the road said one line from the promo of B.A. Pass and I turned around with a big smile on my face. He told me that how much he loved the promo of the movie and how he had shown it to all his friends and that they all wanted to see the movie. It is amazing to get such a response from a non-festival audience.

I feel like I have come back with a bang. I had no work for a while and was quite low. This movie has given me my voice back and I feel I can go on for ten years! I feel fearless. I feel transformed. This is a big departure from Chak De! India and I have broken out of my comfort zone. I have taken a free fall and a leap of faith and it has worked in my favour. Doing the lovemaking scenes was like dancing or painting.

Actually, the role of Nagma (in Gangs of Wasseypur) was initially offered to me by Anurag Kashyap (the director) but at that time I had just finished Rajuben and my emotions were exhausted. So, I suggested Richa's (Chadda) name. She and I are very good friends. I am really proud of the work she has done in the movie — I could not have done that. I know the women in Bihar. They are thin but they have the strength of ten men! I even stayed with the GoW team for two days when they were shooting in Bihar. And B.A. Pass was initially offered to her but it came to me. This has been a case of beautiful poetic justice and everybody is happy. Every film and character has its own destiny.

I feel television is an effective medium of reaching out to people and making them socially aware as to what is happening in big cities like Mumbai, the crimes, how to take precautions against them and fight them. Mumbai was once considered to be a very safe city. Yes. The scenario has changed slightly in recent years and we will be portraying the crimes taking place in Mumbai.

Tell us something about your anchoring? I will first be depicting the crime and then analysing it. Later, I will also make people aware as to how such crimes can be avoided. Recently, crime-based shows are becoming popular. What could be the reason for this? I feel that the crime scenario in cities has raised an interest in the public and hence such shows are becoming increasingly popular.

What is happening on the film front? REVIEW OF THE PREVIOUS DAY: The Nifty fell marginally on Wednesday (August 07, 2013) a net 23.15 points (0.42%) and closed at the 5519 point level. The market opened up at the 5549 points level. It then declined sharply into the red and registered the day’s low at the 5486 points level at 10.44 a.m. The index then rose and turned into a range bound movement until 2.28 p.m. It then rose sharply into the green and registered the day’s high at the 5561 points level at 2.44 p.m. The index then dropped back into the red and turned into a range bound movement until closing at the day. The Nifty witnessed a volatile session and moved in a range of 75 points. Sentiment was mixed and amongst the 50 Nifty stocks 25 were losers, while the other 25 were gainers. Substantial buying was witnessed in metal, power and oil & gas stocks, while heavy selling was witnessed in IT, auto and FMCG stocks. TECHNICAL ANALYSIS: Volume: Volume (Qty shares) increased 7.08%. This change is small and indicates a moderate participation by investors.

he Indian banking sector is unlikely to recover in the next 18-24 months. That’s according to a report titled “Slack Economic Growth Dents Recovery Prospects For Indian Banks,” that Standard & Poor’s Ratings Services published yesterday. It based its views on slow economic growth that is constraining the corporate sector, the chief recipient of banking credit. “Deteriorating asset quality and earnings are likely to constrain the credit profiles of Indian banks over the next two years,” said Standard & Poor’s credit

analyst Geeta Chugh. “We no longer expect the corporate sector to mildly recover in fiscal 2014, given slower-than-expected GDP growth, heightened currency volatility, and high interest rates.” The report expects the banking sector’s nonperforming loan (NPL) ratio to surge to 3.9% of total loans in fiscal 2014 (ending March 31, 2014) and to 4.4% in fiscal 2015, compared with 3.4% in fiscal 2013. The return on assets should also remain depressed, at about 0.9%. Indian banks have restructured 5.7% of their aggregate loan balances as of March 31, 2013. The Reserve Bank of India allows banks to exclude

these loans from their reported NPLs until fiscal 2015. We expect restructuring to remain high in the next two years because of the weak economy and the regulatory allowance. Standard & Poor’s has revised its forecast for India’s GDP growth to 5.5% for fiscal 2014 from 6.0%. “The corporate sector’s weak performance, combined with high interest rates and a weak rupee, is likely to weaken debt servicing for these companies,” said Standard & Poor’s credit analyst Mehul Sukkawala. “We believe that the infrastructure (power and road), metals and mining, construction, and capital goods sectors are particularly at risk.”

Incidentally, the estimated demand of coal in the country will reach to 769.69 million tonnes by 2013 -14 against the domestic availability of 614.55 million tonnes. This was stated by the Minister of State for Coal, Pratik Prakash Bapu Patil in a written reply in the Lok Sabha on Tuesday. He said that the main factors that constrain production of Coal relate to difficulties in acquisition of land, obtaining environment and forest related clearances, difficult geo mining conditions in some areas. He was the mainstay of the Indian batting line-up and has displayed his prowess as the chief selector as well. Former Indian cricket captain DILIP VENGSARKAR who contested the Mumbai Cricket Association elections, speaks to NEIL JOSHI about the urgent need for sportspersons to head sporting institutions, the lack of trust in the DRS and the need to cleanse modern day cricket from the vexing ‘fixing’ issues.

Indian cricket is suffering a lot of turmoil with its credibility at stake. With the spectre of spot fixing badly hurting the Indian image, especially of the BCCI, what measures need to be initiated to restore credibility to Indian cricket? Everybody has to be very strict including team owners and the franchises. In Twenty20 even a couple of bad overs could make you lose the game and this could happen anytime. Those who are fringe players and also unknown players, they can be easily tapped. It is easier to do these things [spot fix] in the shorter format of the game as a couple of bad overs change the complexion of the game. There should be stringent laws which act as a deterrent and would prevent players from doing such things.

Is the education given by the BCCI to the young cricketers sufficient, and has it served its purpose? It is not fair to comment, since I am not a part of the BCCI and I don’t know whether the board is talking to players in this regard. It is also the responsibility of each franchise and it is they who also should speak to the players.

With the Sports Bill stating adequate representation for sportspersons, is it time that the BCCI adopts the guidelines of the Sports Bill? I always believe if you have a sporting background, you take the right decisions [for the game]. If you have played the game, you know what is best for the game and you know how to improve the game. You also know how to implement things from the grassroot levels, so these are things a person who has played the game would understand. I feel very strongly that sportspersons should govern sports administrations. With elections around the corner, what plans do you have for Mumbai cricket and what do you feel are the major issues? There are so many issues. We have a great system in Mumbai with the school and college cricket. The club cricket culture has produced very good cricketers who have gone on and played the game at the highest level. But of late, some of the matches have been tampered with. I don’t know how it will work because they have scrapped Kanga League although it has been played for the last 65 years. These kind of things will not go down well with the people who have played cricket. We need to have a good system and produce good cricketers who will play for Mumbai and India as well. As a cricketer I can talk about cricket, but there major issues administratively as well. I am shocked that Kanga League is scrapped. It is not that the matches are getting washed out. It helps a 15-year-old who plays alongside a 40-year-old where the seniors pass on his experience to him.

INTERVIEW

Banning cricketers should be the last option resorted to in such circumstances. How will banning help reduce instances of fixing? There is huge money in cricket including in the Indian Premier League and in other formats of the game. The players who play cricket come from a very humble background and it is easy for them [bookies] to tempt them [players] and do all such kind of things, so it very important for the franchise and the BCCI to guide them. It should extend to their parents also.

The use of the DRS has caused a lot of talk and debate during the ongoing Ashes series, with many decisions made by the umpires not really up to the mark. Do you feel that a healthy debate should be put in place or should India accept the DRS in its present form? DRS should not be used until it is foolproof and as such, it is not foolproof at all. So many times it has failed to give the right verdict. The umpires also are under tremendous pressure and they are bound to make mistakes. I feel if there is any doubt, the benefit should go to the batsman and that has not been happening. If they find a slight doubt they give it out. And there are certain things in the system which I don’t agree with at all. If you have DRS system and you are struck in front of the stumps even though are 10-12 feet away from the stumps, because according to the hawk eye it would hit the stumps. There could be a deviation after hitting the front pad. The umpire is the best judge of the game. I always feel the game should be kept simple. If you use technology, you not only lose momentum but time as well.

Players such as Ajinkya Rahane and Rohit Sharma haven’t been able to cement their places in the side, is the quality of the players produced by Mumbai on the downward spiral? You may have oodles of talent but at the end of the day you need to perform. If you get an opportunity, you need to grab it. It up to the individual [what he expects from himself], if you play high class of cricket, you need to deliver.

How important is the India ‘A’ tour of South Africa? This tour will be very important as well as the under-19 tours. When the Indian senior team is selected, these fringe players will definitely get a look in. You need to see how to perform there and South Africa is an important tour and those who perform should get a look in. On the laggard pace attack of the Indian team… It is very important because we lack in that department. That is our weak link; we need to improve our bench strength, as they will win more matches for you.
