ith cases of sexual assault reported on a daily basis from across the country showing a definite spike in numbers, it would seem at first to indicate that there is an increase in such crimes. However, the flipside is that this spike could be the result of increased reporting of rape against the backdrop of the out-

Meanwhile, psychologists, sociologists and other like minded people feel that high numbers also imply that the prevalence of sexual assault is now being taken seriously and that is not a bad thing. Know the prevailing laws: Section 375 of the Indian Penal Code (IPC)

According to the anti-rape laws under Section 375 of the IPC, “A man is said to commit ‘rape’ who, except in case hereinafter excepted, has sexual intercourse with a woman under circumstances falling under any of the six following descriptions First- against her will. Secondly - without her consent. Thirdly - with her consent when her consent has been obtained by putting her or any person in whom she is interested in fear of death or of hurt. Fourthly - with her consent when the man knows that he is not her husband, and that her consent is given because she believes that he is another man to whom she is or believes herself to be lawfully married. Fifthly - with her consent when at the time of giving such consent, by reason of unsoundness of mind or intoxication or administration by him, personally or through another way of stupefying or unwholesome substance, she is unable to understand the nature and consequences of that to which she gives consent. Sixthly - with or without her consent, when she is under sixteen years of age. EXPLANATION: penetration is sufficient to constitute the sexual intercourse necessary to the offence of rape. EXCEPTION: Sexual intercourse by a man with his own wife, the wife not being under fifteen years of age, is not rape.

stringent anti-rape laws which in turn resulted in the Amendment Act coming into existence. The genesis of the Criminal Law (Amendment) Act, 2013, is the recommendations made by a judicial committee headed by J. S. Verma. A former Chief Justice of India, he was appointed by the Central government on December 22, 2012, to submit a report within 30 days, suggesting amendments to crimi-

nal law to sternly deal with sexual assault cases. This was a fall-out of the gruesome Nirbhaya case in Delhi that happened on December 16, 2012. On February 1, 2013, the cabinet ministers approved an Ordinance giving effect to the changes in law as suggested by the Verma Committee Report of which 90% of the suggestions were incorporated. The Bill that was finally passed by the Lok Sabha on March 19 and by the Rajya Sabha on March 21, contained several changes from the provisions in the Ordinance. It received Presidential assent on April 2 and came into force from April 3. While these laws are meant to deal with the widely acknowledged forms of sexual violence, what about the other forms of rape considered non-traditional by society because they involve assault upon women within marriage, men and transgenders? Why do such cases tend to remain unreported despite their occurrence being known? Lack of appropriate laws to deal with such cases might be a reason.

The definition of ‘rape’ by Section 375 of the IPC seems to sideline cases of sexual assault and abuse of other kinds that are prevalent in society but are yet to be talked about. The use of the pronouns ‘her’ and ‘she’ and emphasis on ‘penetration between man and woman’ leaves transgenders and men out of the ambit of ‘rape,’ making them feel helpless against these crimes that are commonly committed against them. And the exception in the law excludes ‘marital rape’ too.

The Amendment Act:

This Act brought in a change in definition of rape under the IPC. The word rape has been replaced with sexual assault in Section 375 and penetrations other than penile penetration have been added as an offence. Here acts like penetration of penis or any object or any part of body to any extent, into the vagina, mouth, urethra or anus of another person or making another person do so, apply of mouth or touching private parts constitutes the offence of sexual assault. The section has also clarified that penetration means ‘penetration to any extent,’ and lack of physical resistance is immaterial for constituting an offence. In either of the above mentioned laws, neither are transgenders included nor has marital rape found a mention as an issue requiring a separate law despite it being a part of the recommendations given by the Verma Committee Report. These vulnerable sections of society are often subjected to inhumane acts of forced and unnatural sex but their plight remains hidden owing to lack of support from the judicial system and the fear of their issues being belittled, laughed at and being stigmatised. Through a three part series of first person accounts, the ADC focuses on sexual violation of women by their husbands, same sex rape and finally, transgender rape. Such cases exist, often in the public domain. Yet there is a silence on the subject that results in considerable numbers of individuals becoming increasingly vulnerable to and helpless against such offences. simple cost effective chemical trick has been put to use by Tata Power Company’s Club Enerji to solve energy woes of slumdwellers in Mumbai. The project aptly called ‘Project Jal Jyoti’ involves putting a capful of bleach and water in a 1.25 litre plastic bottle inserted through the ceiling,

half of which is above and half of it inside the room. The outside light passing through the water in the bottle causes refraction converting the bottom half of the bottle into a 60 Watt light bulb. The simple technology provides effective lighting during the day without the use of electricity thus reducing the dependency as well as costs. A youth-run initiative, the project aims at providing renewable and alternative source to traditional lighting. Class X students from Mini Club of Queen Mary School, Grant Road in collaboration with project Jal Jyoti collected 1.25 litres of waste plastic

bottles. The bottles filled with water and a capful of bleach were sealed with industrial sealants to secure the bottle with the rooftop as well seal it completely to avoid any degradation of the bottles content. The bleach in the water prevents any and all bacterial growth. The bottle can thus be used for a period of five years. Club Enerji and project Jal Jyoti hope to engage women in the slums to make these bottle-lights themselves in their own homes in phase II of the initiative. So far the students have installed 15 such renewable and alternative sources of lights in slum areas.

The picture today of the RPI is a sad tale of ego clashes amongst the remnants of leadership that is splintered into several factions. Each of the leaders be it Ambedkar’s own grandson’s Prakash and Anandraj, Ramdas Athawale, R S

Gavai, Namdeo Dhasal and others do not see eyeball to eyeball with each other each claiming to be the rightful claimant to late Dr Ambedkars legacy. It is not for the first time that attempts at unification of the disparate RPI factions was never attempted before. Each time it has been attempted the various faction leaders have temporarily

come together only to part ways bitterly fighting with each other over who becomes the party president, the treasurer and who decides party tickets for elections. The tragedy of the movement has been that all the Schedule Caste community desires unity, the leadership is hopelessly divided into Congress, NCP, BJP, Shiv Sena and MNS camps. Moreover, the SC community is not as monolith as it is in state’s like Uttar Pradesh or Bihar and neither does it have any charismatic leader who can be a rallying point for all the factions. That is why you find a Vijay Kamble of the NCP jostling with Athawale to take credit for paving the way for a grand memorial of late Dr B R Ambedkar at Indu Mill. The disarray in the rank and file has only helped the major political parties in carving the SC vote bank amongst themselves. Although Athawale has rekindled the unity issue once again, his aligning with the right wing BJP-Shiv Sena alliance only for a Rajya Sabha ticket is hard to digest even for the Republican followers. If really the unity amongst the various RPI factions is achieved, the sizeable 10.20 percent SC

So Kunbi Sena leader Vishwanath Patil who has almost exhausted all his options has once again joined the Congress fold. RPI faction leader Ramdas Athawale who has wooed the Congress, NCP in equal measure has done the unthinkable for some of the

Republican followers to join hands with the right-wing BJP-Sena alliance. It may be recalled that it was the same Athawale who had protested against the then BJP-Sena government during the Ramabai Ambedkar Nagar firing incident in 1997. The latest to join the bandwagon is former Sena MP Mohan Rawale who while being sacked from the party heaped scorn on everybodys popular target of hate Milind Narvekar. The immediate reason for Rawale’s expulsion has been his recent meeting with MNS chief Raj Thackeray. According to sources another party leader NCP MLC Vinayak Mete is keen to switch political ideologies. Sureshdada Jain is a veteran at party hopping having quit Congress to join the Sena and become a Sena minister in the 1995-99 Sena-BJP government, only to quit and join the NCP and now has gone back to the Sena.

Bitter Sugar It has not surprised anyone in the political circles to find the central government doling out a Rs 7,200 crore interest free loan to bail out the ‘crisis ridden’ sugar industry in Maharashtra, Uttar Pradesh, Karnataka and elsewhere. Because when it comes to crisis of such nature, politicians are quick to join ranks for the sake of saving the cooperative sugar industry. The industry now is slowly witnessing privatization in Maharashtra, unlike in UP where it is mostly privatized. hree days after Bollywood actor Shahrukh Khan and his wife Gauri accepted notices issued by the Bombay High Court, the court has issued notices to Brihanmumbai Municipal Corporation (BMC), Jaslok hospital and the state government following a petition filed by social activist Varsha Deshpande, challenging an order by the Magistrate Court refusing her application for documents pertaining to the couple’s child born through surrogacy. The petition was filed by Deshpande seeking action against Jaslok hospital, state government and the civic body under the Preconception and Pre-Natal Diagnostic Techniques (Prohibition of Sex Selection) Act (PCPNDT) after Deshpande had sought documents pertaining to the surrogacy process and documents collected by the BMC in its inquiry into the matter. Speaking to ADC, advocate Uday Warunjikar, representing

Deshpande in this petition said, “I had argued in the High Court that the refusal of the magistrate seeking documents pertaining to the surrogacy process was not justified. Accepting my contentions, the court issued notices to all the parties, including Shahrukh Khan and his wife Gauri. However, SRK’s lawyer accepted the notices in the court itself and then notices were issued to the other parties like civic body, Jaslok hospital and the state government.” She has alleged that the Khans had conducted a sex determination test before their third child,

The practice of unsecured or interest free loans has had its dangers. The most recent example being the Beed district cooperative bank and the District Apex cooperative bank which was in the news for being almost on the verge of bankruptcy. It was little wonder then that a honest district collector like Sunil Kendrekar who went hammer and tongs after politicians of all hues in order to recover all the bad debts was unceremoniously transferred despite popular public backing, all too without any murmur of protest from any politician worth his salt.

t has been more than two years since the landmark move by the International Labour Organisation (ILO) in Geneva to adopt a convention that recognises the contribution of domestic workers, including those in the age bracket of 15 to 18 years. However, there has been little improvement in this labour sector, as the country is yet to ratify the convention and implement laws that would not only guarantee minimum wages and grant social security, but also education or vocational training for this large workforce. Calling the government’s attention to this, domestic helps from across Thane, Mumbai and Nashik took part in a mini convention held at the community hall in Bhayandar under the aegis of Anti-Child Labour Wing of the National Domestic Worker’s Welfare Trust (NDWWT) on Sunday. Activists of the NDWWT discussed at length the problems faced by domestic workers who are from the most marginalized communities,

besides being the most exploited. To protect the interests of the domestic workers, the ILO on June 16, 2011, adopted Convention 189 that offers protection to domestic workers. While India is among 183 supporting members who supported the convention, it is yet to ratify it. The NDWWT urged the government authorities to endorse the convention and introduce proper legislations regulating employment, conditions of work, and providing social security. “While the Child Labour Prohibition Act, 1986, is in force in the state, it treats work by children below 14 years in certain occupations as valid and does not facilitate rehabilitation of rescued children, on the other hand the Juvenile Justice Act, defines a child's age as 18 years, as the basis for taking action against child labour,” said Gyanesh Patil. Tehelka case: Goa police slaps additional charges on Tejpal I

n what can spell further trouble for Tehelka founder editor Tarun Tejpal, accused of sexually assaulting a woman colleague, the Goa Crime branch has pressed additional charges against him. A senior crime branch official said that the first information report filed against Tejpal now has additional two sections of Indian Penal Code - 341 (wrongful restraint) and 342 (wrongful confinement). The officials interrogating Tejpal said that additional sections were invoked after statements of the victim, witnesses and going through the CCTV footage of the hotel where the alleged incident took place. Marve Road tragedy sees auto driver killed on the spot, two passengers suffer major injuries By Zuber Ansari

A

48 year-old auto driver died on the spot and two passengers seated in his vehicle received major injuries when a speeding dumper driver lost his control over the wheel and dashed into them on Marve Road in Kharoli locality, Malad (W), late on Saturday night. According to Malwani police station sources, the incident occurred on the busy Marve Road, and the dumper collided head-on with the auto rickshaw, which was coming from the opposite direction. The dumper driver managed to flee from the spot even as eyewitnesses made efforts to catch him. The injured were rushed to a nearby hospital for treatment. The auto driver has been identified as Sandeep Raghunath Ragaye, a resident of Malad. The dumper has been taken by the police while a manhunt has been launched to nab its driver, who was booked under various sections of IPC, including rash and negligent driving, said the police.

Head-on collisions, like the one in which the dumper smashed into this oncoming autorickshaw are almost always a possibility along the Marve Road stretch.

NSEL scam: Mumbai police attach assets of defaulters M

umbai Police, probing the Rs 5,600 crore NSEL scam, have completed attachment of assets of all 26 defaulters in the case even as frozen assets of defaulters, directors and others have been estimated to be worth over Rs 3,000 crore. "We have attached a total of 212 properties worth Rs 2679.4 crore of defaulters, directors and senior officials of the NSEL. We have completed the attachment of all the defaulters. So far 325 bank accounts have been frozen, which have a total bank balance of Rs 172.15 crore. ive years after it had announced a sabbatical scheme for its staff to reduce the bulging salary bill, national air carrier Air India has asked the employees who had availed the scheme to either return to work or quit, say sources. The scheme allowed them to take a minimum of two years and a maximum of five years off the job with the airline. "The airline has recently issued a circular to its employees on sabbatical, asking them to join back on duty or put in their papers as they have completed the sabbatical period," Air India sources told PTI. The salary bill of the airline is around Rs 3,000 crore per annum, accounting for around 20 per cent of the operational expenses of the debt-laden airline. Employees have been given time till December end to inform the carrier of their choice. Around 213 employees mainly from

the non-operational staff are currently availing the scheme, they said. The un-paid scheme was aimed at allowing staff to enhance skills. The period for which the staff remained on sabbatical is considered as a lien which ensures that their jobs were protected if they wish to come back. "While some of these secured jobs in others sectors, some moved to rival carriers. Some employees availed of the leave and settled down abroad," sources said. A number of employees have retired over a period of time and with that the strength is reducing, they said, adding "so employees who join back will fill in those positions." Of the total 27,000 employees of the airline, around 7,000 are expected to retire in the next three years and the carrier has not made any fresh recruitment other than those in the pilots and cabin crew.

The police had bravely, and with much difficulty seized oil inside the port. The samples were sent for analysis, but the FSL told the police that at least for three months were required, and it may possibly even take six months to submit its report. Therefore the police released the oil and handed it over to person who was caught with it. The oil may be dangerous and adulterated and now will be easily distributed in the market. Also most importantly, the dealer even tamper with evidence. On November 26, the Mumbai police had got tip off about oil adulteration and decided to raid the Bombay Port Trust. However the police officials were not allowed inside the port as the highly secure area is protected by the CISF and other security agencies that protect BPT. A police officer said, “We were highly suspicious as it was the eve of Mumbai’s 26\11 terror attack. Later additional commissioner of police (South region) Krishna Prakash reached the spot and after almost two hours we entered, but precious time was wasted, allowing a cover-up by then. We managed to seize 13 oil tankers and two buses in which oil was kept. The police took Amit Sharma, the son of Purshottam Sharma, a big oil dealer in Mumbai, and sent the oil samples to the Kalina FSL for testing whether it was flammable, hazardous or adulterated.” However FSL directors Dr.M.K.Malve said, “In such case it takes minimum of three months to complete the test and make a report.” When Yellow Gate police came to know about this they sent another reminder to FSL to send the report at the earliest. However the

FSL remain firm on its earlier stand.” The police was paying per sq ft of space per day for the 13 oil tankers and the two buses. A police officer said, “If we continue to pay in this manner, we would have to sell this police station to cover the rent charged by the Mumbai docks. Therefore, we decided to release the whole consignment to the person who was detained, on bond, on Friday.” Police Inspector Ramesh Khade said, “We have released the oil to the dealer on bond. We have even taken all necessary documents and statements of concerned people.” DCP (port zone) Tanaji Gadge said, “We completed all procedure in front of rationing officials, before who the consignment was also released. The report may even take six months. If it comes positive, then we will book him under relevant sections.” When asked if the oil could get distributed in the market illegally before the report comes, he said, “We may add necessary sections and take action against him.” Police sources said that there is a well connected mafia operating inside the port and it is very difficult for police alone to stop it.

n a shocking incident, a 20year-old youth has been arrested on charges of sodomising a five-year-old child in Vasai on Saturday. According to the police, the crime was reported from the Waza Mohalla in Papdi village near Vasai. The accused, identified as Imran Syed (20), a resident of Vasaigaon, was caught redhanded while he was sexually abusing the child. After a sound thrashing, Imran was handed over to the local police station. “Imran has been arrested and booked under sections 377 (Unnatural Sex) and 511 (Attempting to Commit Offence) of the Indian Penal Code and under the relevant sections of the Prevention of Children from Sexual Offences Act, 2012,” confirmed an investigating officer. Imran has been remanded to police custody.

T would be a diabolical joke if retired judge Ashok Kumar Ganguly were to continue as the chairman of the Women's Rights Commission. He is under pressure from many quarters, but he has made it clearly known that he has no intention of stepping down. He is barking at the media which has given extensive coverage to the allegation by an intern lawyer that he has sexually molested her. The judge is said to have run behind her, loudly apologising to her as she desperately rushed out of the hospital. The Supreme Court appointed a 3-judge panel to investigate. It came to the conclusion the judge's conduct was unwelcome. In so many words, the panel has charged him with wrong-doing. Women chief ministers like Mamata Banerjee and chairpersons of women's organisations have asked for his resignation. Mamata has written to the President twice asking him to sack Ganguly. The police apparently cannot do anything because the victim has not approached them with any complaint. It is also evident that the police are quite hesitant about taking any action against a judge – a Supreme Court judge. The retired judge seems to have caused a lot of embarrassment to the police. The pertinent question arises why the Union Home Minister Sushilkumar Shinde is silent on the subject. He could have initiated some action against a judge who harassed a girl. There is little doubt that the judge has committed a crime. The whole country knows about it. It is, however, most unlikely any action will be taken against him. Political parties like the BJP have condemned the retired judge's shameful act. Except expressing disapproval, they have not opted for any legal action against him. It is clear now Ganguly is not going to resign. The judge seems to have given his ruling. “Sexual harassment of a girl is not illegal or a crime in India.”

Y the time you read this column, chances are that you may have already digested the news about the rather poor showing of the ruling Congress Party in the Assembly polls. This was only to be expected. Nobody, just nobody, in the Congress was confident of doing well, given the runaway inflation, a grossly incompetent government and a slew of corruption scams whose echo could still be heard in the bazaars and market squares across the country. Since at the time of writing all that we have to go by is the result of the exit polls conducted by various respectable and not-sorespectable psephologists, we will nonetheless stick our neck out and rely on them. If you leave aside Mizoram, which, unfortunately does not register on the antennae of the aam aadmi or the aam neta, the Congress appears to be in a bad way elsewhere. Yes, they seemed to be hopeful of wresting power in Chhattisgarh. But this was probably more to do with their faith in the secret deal allegedly stitched up with the Naxals of Bastar than any concrete development on the ground. We take it that Rajasthan and Delhi are lost to the Congress. Which means that the reliance on freebies in Rajasthan and the socalled appeal of Shiela Dikishit in Delhi was misplaced. Back-breaking inflation which overnight shrunk the incomes of millions of families across the land could not be neutralized with the offer of palliatives about secularism, more freebies, inclusive growth et al. Bread and butter issues would always take precedence over what self-serving politicians might call significant national concerns which ordinary voters find entirely peripheral to their dreary lives. But a bigger takeaway for the Congress Party from the elections is that it suffers from a woeful lack of charismatic leaders. The heir apparent again proved a non-starter in these polls. Just as earlier he had proved a nonstarter in the Assembly polls in UP and Bihar. Whether the party, tied to the little finger of the dynasty, likes it or not, the plain truth is that the Nehru-Gandhis no longer have the same pulling power, the same charisma which its founders, Nehru and Indira Gandhi had. Education, awareness about the world around them thanks to the media, rising aspirations of the younger generations, etc., may have all combined to soften the grip of the Family on the Indian psyche. In any case, there was always something undemocratic, something feudal about a single family controlling the country’s oldest and still the biggest political organization. Unless the huge army of four-anna mem-

bers of the party comes to grips with this stark reality and pressures its netas to build an organization brick-by-brick from the ground up based on internal democracy, we are afraid, the Congress will lose further ground to its old and new rivals. That lesson is inescapable from these polls. In sharp contrast, it will be hard to deny that these polls mark a smooth transition in the BJP, from the era of Vajpayee-Advani to that of Modi-Jaitley-Sushma. Because the BJP was never the property of a single individual or a family, because even at the height of his popularity Vajpayee was not its sole arbiter, the rank and file of the party has had no difficulty in embracing the new leader. Without doubt, Modi proved himself in the Assembly polls, his first major test after being named the party’s prime ministerial candidate. The fact that he was by far the most popu-

If someone puts the value of her farm house in South Delhi at a few lakhs of rupees in her election affidavit, another candidate shows the value of the farm house in the same area at tens of crores, the latter figure being closer to the prevailing market prices. Such discrepancies in valuation of similar lands reveal the futility of these affidavits. Unless false declarations by candidates are made a penal offence, the political class would continue to dodge the system and make it impossible to cleanse the electoral process. However, a cursory reading of the movable and immovable assets of our politicians do make an interesting reading. Politicians you might think are enormously wealthy have in fact very little to declare. Whereas those coming from rather humble backgrounds boast of handsome riches. For instance, what struck our eye was the contrast between the declarations of wealth filed by Sushma Swaraj, Leader of the Opposition in the Lok Sabha, and Jyotiraditya Scindia, a scion of the former House of Gwalior and the Minister for Power in the UPA Government. Swaraj declared that she owned two flats in Dhawan Deep, the swanky building on Jantar Mantar Road, New Delhi. Also, she has a well-appointed flat in Mumbai as well. Scindia, probably, did not feel the need to invest on such flats, having inherited several royal mansions from his ancestors. But, nonetheless, in the moveable assets category, Scindia is beaten hollow by Swaraj. Against his mere 633 (six hundred and thirtythree) grams of gold worth Rs.7.48 lakh, Swaraj in her 2009 affidavit declared 2005 grams — yes, two kilos and five grams — of gold and six kilograms of silver. Small wonder, then, some people believe that politicians are the new rajas in the democratic age, aren’t they? Scindia, mind you, is the scion of what was called the 21-gun salute princely House of Gwalior. The Swarajs, both husband and wife, come from lower middle class backgrounds, and have had only modest success as lawyers.

It’s been 11 years and our judiciary is still barking up the wrong tree. Whether this is inefficiency or coerced inefficiency or self motivated inefficiency is yet to be understood. This seems to be a legal strategy to ensure that Salman gets major relief in terms of time until the trial comes to an end. For all you know, the case may now outlive Salman. This is complete sabotage and a mockery of the Indian law. There was no need for the police to add an additional charge of culpable homicide not amounting to murder. Festive season 2013 has witnessed the worst on the retail sales front in almost the last decade. And now, with just Christmas, New Year and harvest festivals remaining to go, much of the festive season is over. Though the country’s retail sector is set to grow at an annual rate of 16 to 19%, reaching Rs. 56.8 trillion ($901 billion) in 2016, as per a research report, most of the mid segment retailers barring some top ones seem to be struggling with dipping sales, lower margins and high cost of funds. The question is will the remaining festive season, given with the upbeat mood pre-election and marriage season ahead salvage the situation of gloom and doom to positivity?

That has left consumers with less to spend on socalled discretionary products,” says Jay Mehta, Managing Director, The LOOT. According to Mehta, these are tough times with almost every sector like diamond, jewellery, apparels, furnishing and construction bleeding. “The middle class has no surplus money to buy. INDIA’S FOREX RESERVES SOAR TO $291.3 BILLION

India’s forex reserves surged by a whopping $5.04 billion to $291.3 billion in the week ended November 29 on account of a robust jump in foreign currency assets (FCAs), the Reserve Bank said. This is the fourth consecutive week when the country’s reserves have jumped and logged one of the sharpest spikes in recent times. In the week ago period, the reserves had risen by $2.691 billion to $286.26 billion.

GOVT ORDERS PROBE AGAINST 76 COS FOR FRAUDS The government has ordered probes against as many as 76 companies — the highest number of firms against which investigations were ordered for frauds in a single year till now — in the current fiscal so far. This has taken the number of total cases currently under investigation to 134 which include 58 cases related to chit fund activities in West Bengal and other states, Minister of Corporate Affairs Sachin Pilot informed the Lok Sabha in a written reply.

Most economists expect India to grow by below 5% this financial year. For makers of jewellery, the season which accounts for three fourth of their annual sales, starting with Onam and ending with Diwali has not been good with government increasing the import duty on gold and slowing demand due to high prices. “Gold jewellery sales were lower by 30% during the festive season, according to Mehul Choksi, Chairman, Gitanjali Gems Ltd. utual funds have lost over 20 lakh investors, measured in terms of individual accounts or folios, in the first seven months of the current fiscal, mainly due to profit booking and various merger schemes. According to SEBI’s data on total investor accounts with 44 fund houses, the number of folios fell to around 4.07 crore at the end of October 2013, from 4.28 crore in the last fiscal (2012-13) — indicating a decline of 20.72 lakh. During April-October period, the number of investor folios for equity schemes fell by over 25 lakh. The total number of folios in equity funds were 3.06 crore by the end of October as against 3.32 crore by March-end. The decline in equity folios during the first seven months of the current fiscal is coincided with BSE’s barometer index Sensex surging 1,785 points, or 9.2 per cent, in October. According to Sebi data, the total number of folios in debt funds rose by about 4.22 lakh to 66 lakh at the end of October 2013. Besides, exchange traded funds lost 48,755 folios to nearly seven lakh investor accounts at the end of October this year. Balanced schemes, which invest in the equity and debt category, gained 1.06 lakh folios to end at 27 lakh at the end of October. As on October 31, the sector offered a total of 1,335 schemes to investors, of which 344 were equity schemes and 891 were debt-linked schemes. The mutual fund industry lost more than 36 lakh investor accounts in 2012-13. The last financial year also

The majority of data releases out last week were ahead of consensus expectations, affirming that the U.S. economy held its own during the government shutdown and beyond. Aside from the somewhat less buoyant description of the economic conditions in Wednesday’s Beige Book report which kept its growth characterization unchanged at “modest to moderate,” and a slight fall in the ISM non-manufacturing index, the tone of recent economic data has been notably firmer. The ISM manufacturing index kick-started the week, by posting another increase in November and extending its sixthmonth winning streak. The strength in manufacturing is attributable in part to continued gains in the auto sector. Auto sales returned in full force last month, breaking the 16-million mark for only the second time this year. Stronger than- expected growth in personal consumption expenditure in October also echoed the theme of sturdier consumer activity in the fourth quarter. There were also encouraging developments in the housing sector sales of new homes and new building permits both surged in October.

he International refining industry is likely to witness significant refining capacity addition during CY13-15. However, due to weak petroleum product demand and surplus refining capacity, utilisation rates of the refining industry is expected to remain subdued; thereby impacting refining margins, says Care Research in a just released report. According to the report “In the medium term, economic growth will remain the key factor to drive oil demand globally while in the long term; the impact of government policies, technologies and demographics will become influential to drive the oil demand. “ World oil demand grew at a CAGR of 1.4 per cent in the last decade (CY02-12) with an average increase of 1.1 mnbpd every year. The growth was driven by the BRIC (Brazil Russia China India) nations mainly China and India. On the other hand, developed nations like the US, Europe and others have seen a structural de-growth in oil demand since CY05 and are expected to witness a decline in oil consumption. CARE Research expects an incremental oil demand of 2.9 mnbpd globally till CY15 in addition to oil consumption of around 89.8 mmbpd in CY12. The growth would be mainly driven by BRIC nations on account of favourable demographics, urbanisation and industrialization in these nations. However, CARE Research expects a downside risk to the oil demand given the widening uncertainties over global macroeconomic scenario.

Gross refining margins to remain under pressure Historically, it is evident from the following chart that gross refining margins (GRM) have closely followed global refinery utilisation. The global refining utilisation level is expected to remain below 83 per cent, implying pressure on refining margins in next 2-3 years. CARE Research expects Singapore GRM, which is a benchmark GRM for all Asian refiners, to remain weak owing to wide gap between demand and supply of petroleum products. Margins are not expected to improve until there are some signs of improvement in economic conditions or delays in refinery capacity expansion projects. Indian Scenario - POL demand likely to increase marginally Domestically, with almost 21 mmtpa of additional refining capacity coming on-stream, the total refining capacity is expected to reach 236 mmtpa by FY16. CARE Research expects domestic petroleum production to grow at a CAGR of 2.4 per cent during the period FY14-16 while the annu-

Under-recoveries on petroleum products to continue The government in an unprecedented move announced to partially deregulate the diesel prices in January 2013 thereby allowing the Oil Marketing Companies (OMCs) to raise diesel prices by Rs 0.5/l every month. The government also approved bulk diesel pricing to be market driven. This was aimed to reduce the overall subsidy burden. However, due to sharp devaluation of the rupee against US dollar, under-recoveries on diesel increased to Rs 10.2/l as on 15th October 2013. While the under recoveries on SKO and LPG stood at Rs 38.3/l and Rs 532.9/cylinder as against Rs 30.6/l and Rs 490.5/cylinder, respectively in January 2013. However, CARE Research believes that this policy action by the government towards solving the problem of burgeoning under-recoveries plaguing the OMCs and resulting rise in fiscal deficit is expected to prove beneficial in the long run.

ME Aluminum prices declined around 6.4% during the month of November’13. Prices plunged mainly on account of rise in total primary aluminum production which reached to an all-time high of 4.24 million tonnes in Oct’13, as per the International Aluminum Institute (IAI). Aluminum production rose around 4% in October’13 as compared to September’13. China remained the major contributor for the shoot up in global aluminum production. The country contributed around 46% or 1.95 million

tonnes to world primary aluminum production. Additionally, rise in LME aluminum inventories by around 2% from 53,75,725 in Oct’13 tonnes to 54,70,425 tonnes in Nov’13 also exerted downside pressure on the prices. However, sharp downside in prices was restricted due to decline in daily average primary aluminum output in October’13. As per IAI, daily average primary aluminum output excluding China fell to 65,300 tonnes in Oct’13 from 66,600 tonnes in Sep’13, while the drop in output is for the fourth consecutive month. The fall was mainly due to production cuts in east and central Europe, North and South America along with temporary shutdown in one of two pot lines at Mazaden smelter in Saudi Arabia, according to IAI data. The agency also published that between July and November this year; companies announced production curtailment of 1.4 million tonnes this year which had already shown effects of these cuts on daily average primary aluminum output. The latest report by IAI shows that a fall of 3% production was seen in October year-onyear output to 65,000 tonnes per day which is at the lowest daily production rate since Feb’10. On a regional basis, October output levels dropped by 14% year-on-year in Russia, 9% in Latin America and 4% in North America.

Another major factor which prevented downside movement in prices was major shift in the supply side excluding China. LME warehouses rules which were proposed in July’13 and got confirmed in Nov’13 catalyzed around 15% drop in US and European physical premiums. Along with fall in LME prices since the beginning of the year, an additional 1.7 million tonnes of smelting capacity ex-China fell into loss making territory on top of 1 million tonnes per year capacity which was already seen in beginning of the year. al domestic demand is expected to reach about 160 mmt in FY16. Thus, India is expected to remain a net exporter of petroleum products. However, CARE Research believes that India would remain deficit in LPG and remain a net exporter of naphtha, MS and HSD.

Refining industry - to be hit by surplus capacity and weak demand During the period CY06-10, about 5.9 mnbpd additional refining capacity was commissioned worldwide whereas increase in oil demand was only 3.6 mnbpd. This resulted into drop in refinery utilization rate. Due to Euro zone crisis and weak economic scenario worldwide, many companies have delayed the refining projects plans. Many of the new refineries scheduled for CY11 and CY12 have been delayed to CY13 and beyond. In CY12, the utilization rate stood at 82.4 per cent against the last 5-year average of 82.8 per cent. Going forward, CARE Research believes that in next three years, the refining capacity addition is likely to be about 3 mnbpd, which would outpace oil demand growth due to overall weak global economy. CARE Research expects the refining capacity utilisation to remain under pressure in

around 5.7% in November 2013 but sharp downside was prevented due to depreciation in the Indian Rupee. Further, from the demand perspective concerns have eased as a result of positive GDP data from the country has increased expectations of rise in demand for the metal. As per the Economic Intelligence Unit (EIU) report, aluminum growth is expected to increase by 6% to 1.8 million tonnes in the current year. Outlook: During the coming month, we expect aluminum prices to trade higher on the back of expectations of deficit in the global aluminum market in 2014. Further, cut in production from major producers will support an upside in the prices. Additionally, favorable economic data from the major global economies will lead to estimates of rise in demand for the metal which will support an upside in the prices. However, sharp upside in prices will be restricted as a result of concerns regarding the QE tapering by the Federal Reserve. In the Indian markets, Rupee appreciation will prevent sharp positive movement in the prices. For the month of November we recommend, BUY MCX ALUMINIUM DEC BETWEEN 104 – 103, SL – 96, TARGET – 115/120 (CMP – 107.10).

Macros Getting Better

W

ith state election results positively impacting the markets, investors now need to watch out for the macroeconomic indicators, which will be crucial in kick starting investment-led growth. CAD seems to have been contained, but the Fiscal deficit is still a worry. Experts feel that with just four months left for FY13-14 to end, it would be difficult, if not impossible, for the FM to contain Fiscal deficit to 4.7% of GDP. The FM is banking heavily on the spectrum auction that is to take place in January 2014, if all goes well. The telecom companies are playing their cards close to their chest and they know that the government is desperate. We will therefore have to wait and see because the FM doesn’t seem to have too many options left. Revenue collection has been below projections and will remain so because the 5.5% GDP growth the FM is projecting now looks like a pipe dream. The fact that the Q2 GDP growth has come in at 4.8%, which is better than most analysts expected, is little comfort. Because, now for the remaining 2 quarters, even if the economy grows at 5.4% in each quarter, we will just about manage a growth rate of 5% of GDP. Spectrum auction therefore is what the FM will bank on and may be a bit on PSU Divestment, which in the current year is way below target. His last resort will be to reduce plan expenditure, in order to meet his ‘redline’ of 4.8% fiscal deficit. This means kicking the can down the road and leaving the problem of the budget deficit for the next government. It also would be interesting to watch out for the Vote on Account to be presented by P. Chidambaram in February. Knowing FM’s ingenuity, he might just sneak in a few populist measures. Let’s now look at the global macros. The most exciting number would be the annualized US GDP growth number, which now looks better that the expected 3.1%. This is great improvement over the last year number, which was 1.1%. It also now points to a growth which can be sustained above the 3% mark, which bodes extremely well not only for the US, but also the world economy. As far as India is concerned, IT companies should benefit and grow from strength to strength, besides select pharma names. China’s GDP slowdown has also bottomed out and there are definite greenshoots of recovery in the Eurozone. Therefore, Tata Steel and Tata Motors are the scrips to watch out for. While Tata Steel is not doing so well in India, Tata Corus in UK will continue to churn out good numbers. Consider the fact that there are only 2 major steel producers in Europe, which supply quality steel – namely, Tata Corus and Arcellor Mittal. Despite adverse conditions still prevailing in the Eurozone, these two would continue to do well and will grow as the Eurozone economy picks. Tata Corus in UK supplies to JLR, which is again a Tata company. Besides, it supplies to all major automakers in UK and Europe, be it Ford, Nissan, VW, BMW, Mercedes, etc. What is little known is that Tata Steel has set up another 100% owned subsidiary in UK, which has bagged a big order of 95% of UK Rail’s steel requirement over the next 5 years. This includes steel for carriages as well as railroad expansion in UK and Europe. This is a recent order and should play out in the coming quarters. Tata JLR has started making inroads into the US besides its traditional markets of China and Europe. Though currently it sells about 2,000 to 3,000 units in the US, there is a huge potential as US is a very big market. Both Tata Steel and Tata Motors will currently grow from their dollar income, until the domestic market turns around. But this growth is sufficient to take these scrips from Rs. 400 currently to Rs. 500 conservatively, by the year end.

REVIEW OF THE PREVIOUS DAY:

The Nifty rose marginally on Friday (December 06, 2013) a net 18.80 points (0.30%) and closed at the 6259 point level. The market opened down at the 6234 points level. It then declined further and registered the day’s low at the 6230 points level at 9.20 a.m. The index then rose into the green and turned into a range bound movement until 3.00 p.m. It then rose sharply and registered the day’s high at the 6275 points level at 3.29 p.m. and then turned into a range bound movement until closing at the day. The Nifty witnessed a volatile session and moved in a range of 45 points. Sentiment was bullish and amongst the 50 Nifty stocks 38 were gainers, while 12 were losers. All the sectoral indices barring IT closed in the green. Substantial buying was seen in power, PSU and consumer durables stocks. TECHNICAL ANALYSIS: Volume: Volume (Qty shares) decreased 13.45%. This change is moderate and indicates a moderate participation by investors. Market Breadth: Overall Market Breadth on the NSE was positive. Amongst all the traded stocks, 737 were gainers, 627 were losers and 92 remained unchanged. Slow Stochastic Indicator: The Slow Stochastic Oscillator is in the over-bought zone. The Slow K line in the Stochastic Oscillator is below the slow D line (negative if it continues).

RSI Indicator: The RSI is above the 40 level and is now rising (positive if it continues). MACD Indicator: The MACD is above zero and is rising (positive if it continues). It is above its 9-day Average (positive).

Resistance Levels: The immediate main resistance is at the 6357 points level.

Pivot Point Analysis: For intra-day traders the support and resistance levels are calculated according to the pivot point theory and are: Pivot point = 6255 (This is the level where the trend is likely to change during intra-day). Support (1) = 6235. Support (2) = 6211. Resistance (1) = 6280. Resistance (2) = 6300. OUTLOOK FOR TODAY:

On Japanese candlestick patterns the index after having formed a small black body candle with a long upper tail (indicating indecisiveness amongst investors) has formed a white body candle. This is positive and indicates that the bias has shifted towards the buy side of the market. Further, the index is above its 5, 15, 25 and 200 days moving averages. Moreover, the velocity parameters continue to remain positively trended. All these indicate a positive bias and the possibility of a further up move unfolding. Investors are advised to hold long positions.

Management meeting takeaways—confident of revenue growth. TCS is confident of strong revenue growth even though seasonality may impact 2HFY14 numbers. Early indications for next year are positive as clients head into their budgeting cycles with greater confidence. Growth will be driven by improved discretionary spending, adoption of digital technologies and IMS. TCS will reinvest Rupee depreciation-led margin benefits into the business and has retained its 26-28% EBIT margin range target. We expect growth and profitability leadership, driven by strong execution and best market coverage to continue and believe premium multiples are deserved. We retain ADD. Strong medium-term revenue growth though 2HFY14 might see seasonal weakness: We were in conversation with the CFO of TCS, Mr Rajesh Gopinathan. TCS is confident of growth, driven by large market opportunity, overall recovery in developed markets and reduced volatility in demand for IT services. 2HFY14 will be seasonally weak and impacted by lower number of billing days due to furloughs and holidays. The management indicated that clients were heading into their budgeting cycles for CY2014, far more confident than in the past two years. Improving discretionary spending, adoption of digital technologies and infra management will help to drive growth in the medium term. The management indicated that unbundling of the hardware component from IMS deals helped to improve its success in winning deals in the segment against incumbents like IBM, HP and CSC. Calibrated approach to reinvestment of Rupee depreciation benefits to continue: TCS is committed to its medium-term EBIT margin target of 26-28%. However, the reinvestment strategy will be calibrated based on volatility in the currency and other margin headwinds. Benefits from the Rupee depreciation will be reinvested in the business by stepping up sales effort to break into new accounts with high growth potential, especially in new geographies. Key areas of investment will be (1) geographical expansion into new markets in continental Europe, Latin America and the Asia Pacific, (2) expansion of the service portfolio with investment in non-linear initiatives like products and platforms. TCS’ leadership to sustain premium multiples; we retain ADD: We believe TCS’ strong execution capabilities and extensive market coverage across geographies, verticals and services will help it continue to outperform the industry on revenue growth and profitability. We believe TCS’ leadership justifies the premium multiple it gets. We maintain our ADD rating and target price of `2,250, valuing the company at 20X FY2015E earnings.

Key takeaways from our meeting with the VOLT management are: (1) Enquiry levels in Qatar, Muscat and Saudi Arabia are encouraging, but domestic demand remains sedate; (2) Margins in the Electro Mechanical Projects segment are likely to trend higher from FY15. Given the improved margin and order inflow outlook, we raise our FY15/FY16 earnings estimates by 3%/6%, increase our target multiple from 12x to 15x one-year fwd EPS (ex-other income) and upgrade our Dec’14 TP to Rs 135 (from Rs 110). Healthy outlook for the international business: Management indicated that enquiry levels are encouraging in Qatar, Muscat and Saudi Arabia. Major events such as the Dubai Expo 2020 and Qatar 2022 FIFA World Cup are expected to boost the region’s business environment. As per management, the phase of capability building is now complete, placing VOLT in a strong position to execute larger projects in the region. Owning to its comfortable order backlog position, VOLT is now bidding selectively and booking projects with site margins of +5%. However, a new order from the Supreme Court has mentioned that Insurance Companies Are Liable to Pay Even If There Is a Change in Vehicle Ownership. The law states that you can do a Third Party Claim as long as the vehicle in insured but whether or not you can do a claim for your own car damage is an area of consideration. It states that "The liability to pay compensation is based on a statutory provision. Compulsory insurance of the vehicle is meant for the benefit of the third parties. The liability of the owner to have compulsory insurance is only in regard to third party and not to the property. Once the vehicle is insured, the owner as well as any other person can use the vehicle with the consent of the owner. Section 146 of the Act does not provide that if any person uses the vehicle independently, a separate insurance policy should be taken. The purpose of compulsory insurance in the Act has been enacted with an object to advance social justice"

« PRODUCT REVIEW: BAJAJ ALLIANZ TWO WHEELER INSURANCE PLAN

By Manoj Aswani ajaj Allianz Two Wheeler Insurance Plan is the only Two Wheeler Insurance Policy from this insurer. It includes Two Wheeler Insurance along with Third Party Legal Liability Damage as specified by the RTO. In this plan, premium needs to be paid every year to renew the plan and the policy can be issued online without any paperwork. If there has been no claim in the previous year from this insurer or any, a No Claim Bonus is also payable. Each vehicle has a Sum Assured which is called the Insured's Declared Value (IDV) of the vehicle. This is the total value of the two-wheeler as declared at the beginning of the policy. It is calculated on the basis of the manufacturer's listed selling price of the brand and model as the vehicle insured at the commencement of the policy after deducting depreciation. Electronic items, theft kit, LPG/CNG kit, etc. can be added to the sum insured over and above the IDV. In case of a claim, a cashless facility is provided in 1500 network garages or a reimbursement can be done within 5 days.

However, logically speaking you should get the insurance claim since your car is insured; you should get the claim irrespective of the fact whether the car is in the process of ownership transfer.

Amitabh Bachchan lashes out at talks about working with Rekha Afternoon Despatch & Courier

egastar Amitabh Bachchan has rubbished reports suggesting that he is in talks to star opposite veteran actress Rekha in a YRF film. According to reports, Aditya Chopra was said to bring Rekha and Bachchan on-screen together again. The two last worked in 1981 hit 'Silsila'. "I am not doing it. I read it (media report) but there is no truth to it. But if you known anybody there (at YRF) then suggest my name. As today it is difficult to get work," the legendary actor said at a function here. Earlier, producer Firoz Nadiadwala and director Anees Bazmee were keen to get Bachchan and Rekha together in their upcoming movie 'Welcome Back'. But things did not work out. Meanwhile, Big B would be seen in a special appearance for Sanjay Dutt Productions' 'Hasmukh Pighal Gaya'. He has performed to the iconic Raj Kapoor song 'Kisiki Muskuraahton Pe Ho Nisaar, Kisi Ka Dard Mil Sake...' from the film 'Anari'.

"It is a film for Sanjay Dutt Productions. There is a situation in the film, where the hero of the film sings a song and I get into in that song," he said. Bachchan recalled his earlier memories of the Rajkamal Studio, where he delivered some of the famous shots of 1975 hit 'Deewar' including the death and 'khush toh bahut hoge tum' scenes. He is shooting for an ad film there after a gap of more than three decades in the studio built by legendary filmmaker V Shantaram, says another PTI report. "Rajkamal Studio shoot after ages... Established and built by the great V Shantaram. Now most of the floor space and the area given up to high rise buildings... The main floor is where the shooting is for an ad, film on real estate... Ironical... It is the same floor where I did most of my important scenes for 'Deewar' - the death scene, the 'khush toh bahut hoge tum'...," Bachchan posted on his blog along with few pictures of the studio.

ctress Deepika Padukone does not regret being unable to make her Hollywood debut with 'Fast and Furious 7' and says she is open to doing films in the West even if the role is small. Deepika was offered to be a part of 'Fast and Furious 7' movie, but she could not do it because of her commitments to the makers of 'Ram Leela'. "I don't regret it. I had to work out things for 'Ram Leela' here, I couldn't have left the process mid way, I had given my commitment here first. Looking at the way the film ('Ram Leela') has got response, I feel good as my hard work has paid off," Deepika told PTI in an interview here. Though the actress could not make her entry into Hollywood, she is still open to doing films whenever the right offer comes up. "I would love to do a Hollywood film. The reason for me to do a Hollywood film is same as what I do here in Bollywood," she said. When asked if she would be ok doing a small role in a Hollywood film, Deepika said, "There is nothing like a small role. The role has to be of impact, this is what matters, the length of it (role) doesn't. A good actor can make a presence felt even in a short time." Deepika is basking in the success of her fourth consecutive hit this year - 'Ram Leela' - after 'Race 2', 'Yeh Jawaani Hai Deewani' and 'Chennai Express'. "It feels nice that all my films that released this year did really well. I have worked hard on all my films and it feels great when the films become successful and you get appreciation for your work," Deepika Padukone she said.

The actress, who is the wife of T-Series head Bhushan Kumar, said she was moved by the efforts taken by the 'Dabangg' star's to promote her film. "It is really nice of him that he is promoting the film, he tweeted about me. We would also go to 'Bigg Boss' house to promote the film as it is a big platform for all of us," Divya said.

Ahmed also intends to adapt an international film and is actively working on a couple of projects. "On the directorial front I am working on two films - one of is a family entertainer and the other is more about the guys. They are original films. Also, I plan to adapt an international film but it is too early to talk about it,"

Ahmed told PTI. "We are looking to cast Alist actors. There are quite a few on my wish list but it is incorrect to reveal the names. It will happen next year," he added. Ahmed's both the films failed to create magic at the box office. He also turned producer with good friend Shahid Kapoor starrer 'Paathshaala' and is looking forward to produce more films. "There are a couple of scripts that have come our way. The films that we are likely to produce include a comedy, youth related film. Hopefully, by the end of this month things will get finalised," he said. Apart from this, Ahmed recently choreographed a song on megastar Amitabh Bachchan for Sanjay Dutt Productions - 'Hasmukh Pighal Gaya'.

aif Ali Khan's production partner Illuminati Films, Dinesh Vijan will don the hat of a director soon for the actor. Dinesh has been behind films like 'Agent Vinod, 'Cocktail', 'Love Aaj Kal', 'Go Goa Gone' and others. The production company Illuminati Films was founded by Saif and Dinesh in 2009. "There is a love story which my partner Dinesh is going to direct. He is turning director. He has got a nice love story script," Saif told PTI. Apparently, Saif is likely to

act in the movie. "There are plans to direct a film. Things are still in process so I can't talk much," Dinesh said, without divulging any further details. The upcoming projects of Dinesh as a producer include director duo Krishna DK and Raj Nidimoru's 'Happy Ending'. In this film Kareena will be seen in a special appearance. Also, directors Kunal Deshmukh of 'Jannat' fame and 'Pyaar Ke Side Effects' helmer Saket Chaudhary will be making films for Illuminati.

Shilpa Shetty on ‘Nach Baliye’

Multitalented actor Raqesh Vashisth who is currently seen on ‘Nach Baliye’ has made a beautiful painting of judge and Bollywood actress Shilpa Shetty. We hear that the actor has given Shilpa a surprise by gifting her a hand-painted portrait of hers. Raqesh has been painting and sculpting for the last few years and in fact has a studio built at home where he spends time exploring his creative side. Talking about his painting of Shilpa Raqesh says, “Everyone on the show has been praising how beautiful and poised Shilpa is, I have been a very silent observer so far and have really appreciated how she always motivates Ridhi and I and her warmth as a person. Everyone has been expressing their appreciation through words but I can best express my gratitude through my art. A couple of days ago, I stayed up an entire night in my studio working on the painting. A painting can reflect an individual’s inner beauty and I am just happy that she has liked my portrait of her”.

Sapna Pabbi plays the role of Anil Kapoor’s daughter in the TV show ‘24’. Born and brought up in London, Sapna has already done some modeling assignments. In this chit chat, the young actress opens up about everything, from her love for movies to her story so far. By Sandeep Hattangadi How did you end up with a career in acting? I always wanted to do it. I was involved in dramatics right from school. I come from a very desi family, so my father was always very strict about studies and so initially I did not pay much interest to it. I got a corporate job, which I was very happy with actually and it brought me here. And then I ended up doing ‘24’!

How did you end up bagging the role in ‘24’? I had an audition. Actually, I had gone to do an audition for the role of Shyna, which is a negative character in the show. But they thought that I was perfect for the role of Kiran – the role of Anil Kapoor sir’s daughter.

The 24-year-old Jaipur boy, Himanshu Soni, who currently shoulders the monumental responsibility of essaying Buddha on Zee TV and Spice Studio’s biopic is indeed a braveheart! Recently, he was required to shoot a sequence where he, as Prince Siddharth, attends the swayamwar of the beautiful princess Yashodhara in the hope of winning her hand in marriage. For this scene, he would engage in a physical brawl with a very burly giant of a man to prove his might and thereby his worthiness as a suitor to Yashodhara. Unfortunately, barely two days before the shoot of this elaborate sequence, Himanshu fell off a horse in the middle of a shot, badly bruising his hands. There was no way Himanshu would be able to pull it off with his severely bruised palms. But Himanshu put his foot down and insisted on shooting the sequence himself.

Does your character have any similarities with the real Sapna Pabbi? Kiran is 19 years old, but she is very mature for her age. She is very simple, subtle and well mannered. She is quite cool too (laughs)! But like every other teenager she gets angry, fights with her parents and makes wrong decisions. My dad actually said that the way I fight with Jay Rathore is exactly similar to how our fights end up being like. How was working with experienced actors like Anil Kapoor, Tisca Chopra and Mandira Bedi? It was obviously great working with each one of them. I am the youngest and the least experienced of the lot so it is also a challenge for me to match their standard as an actor. But because Anil sir is such a lovely person, it made everything so much easier than I thought it would be. He can make any newcomer comfortable within 10 seconds.

How much do you think ‘24’ will change the scenario of Indian television which rests on Saas Bahu dramas? I think one cannot compare both of them. They are more like independent in terms of content and portrayal. But yes ‘24’ definitely is something that might bring a lot of changes. Because it is extremely specific to detail and it is like watching a 22-hour movie. A lot of people ask me why it is taking so long. We have already shot for 150 days and all the hard work we have out in, I hope it pays off! So any future plans? Right now, ‘24’ is at the top of my priority list. There are a lot of key projects and I am very excited. But I think I have to be patient. But for now I would solely concentrate on ‘24’ and then keep everything else for later.

Another Law Won’t Change Much T

he Sexual Harassment of Women in Workplace (Prevention, Prohibition and Redressal) Act is the latest in the list of legislations introduced, almost in a knee-jerk fashion, to solve issues. Following every high-profile instance, the masses are ‘outraged’ and then go on to demand the “strictest punishment for the guilty,” and ensure that a new law comes into place to protect women. Introducing a new ‘Bill,’ issuing orders and guidelines or creating drafts for ‘better’ laws that need to be introduced ‘urgently’ have become knee-jerk reactions whenever an issue relates to women and crime. But, with sex crimes being repeated day after day, the laws don’t seem to serving their purpose. After the Delhi gang-rape fury, fast-track courts were set up in states all over the nation to deal with sensitive issues like sexual exploitation at a faster pace. A new bill was introduced to address violence issues. Then came the gang rape of a female journalist in Mumbai which once again “rocked the country,” and the police were quick to issue guidelines to media organisations sending female journalists to

Earlier, reports of minors being abducted and raped had instigated the government to bring about a law for protection of minors being subjected to sexual assault. But, so far the new laws, guidelines, orders and drafts doesn’t seem to be having a deterrent effect on sexual crime perpetrators. Which brings about the question, will introducing laws one after the other serve the purpose and lower the crime rate in the country? An RTI application filed earlier this month has revealed that Mumbai witnessed 237 rapes, including eight gang rapes till August 2013. As per the information secured under RTI Act by activist Anil Galgali, as many as 229 rape cases and eight gang rape cases, including two Shakti Mills gang rapes that jolted the nation, were reported till August this year. Reports suggest that the number has risen in the past few months since gang-rape of two minors were reported only last month in the city. Last year’s figures suggest the numbers have only increased this year. There were 223 rape cases and eight gang rape cases reported in 2012, while in 2011, 211 rapes and nine gang rapes were registered. A couple of months earlier, a report issued by National Crime Record Bureau (NCRB) suggested that the national capital had 1,121 rape cases registered in the first eight months of this year, the highest in the last 13 years. The number is actually more than the double of what of last year’s 468 cases in the same period. And these were reports from two metropolitan cities of the country. With sex crimes being repeated day after day, the laws don’t seem to serving their purpose world in 2013. Since so much is being said about the country’s ‘rape trend’ and the new emerging law, shouldn’t every outcry ensure the crime rate against women dips, even if by a small margin? Merely introducing one law after another doesn’t seem like the solution. The action should be initiated at a grass-root level and there should be ways to ensure that the laws that are being introduced actually do help the victim. There is a section of masses that fear that these laws being introduced are gender-biased and while it may

come prove useful for some it can also be misused to a great extent. All this needs to be considered and looked into before rushing to clear the draft bill. Just doling out laws is not going to do much if they have major loopholes like it is being said about the new Anti-Rape Law or the Sexual Harassment of Women at Workplace 2013. The government, judiciary and the legislature need to look into the matter more seriously and address the real problem and not just on the face of it. Ensuring that women feel

safe enough to come report the crime, ensuring that the police registers the case, ensuring that the victim has actually being heard, ensuring that the trail is done in a court of law even in camera and not in open public domain or in media. Because, if there is a chance that a woman/girl has been victimised, there should be provision that she gets the justice she deserves but the law and its processes should never be subverted. Change At The Top

W

hen, on the orders of the Supreme Court, voters in the country got the Right to Reject candidates, then for once it seemed that this order of the Supreme Court will show political parties the path to Constitutional and Parliamentary ideals. Alongside, the people of the country also go the right that under a democratic process they could not only choose a candidate they preferred, but also reveal or make it known that they did not want any of the candidates in the fray. This matter had been stuck with the Law Ministry from 2001. When social worker Anna Hazare included the Right to Reject and the Right to Recall in his 25 point programme, an environment for their implementation began to be created in the country. When the Supreme Court gave orders on this, the apprehension was expressed there and then that since the Supreme Court was doing what the Government and the Election Commission should have done, the Government would adopt a repressive attitude -- this was certain. And this apprehension in the country was proved correct first by the Election Commission and the Government of Madhya Pradesh. In Madhya Pradesh the Election Commission disallowed people to be made aware of and sensitised about the None of the Above (NOTA) option and a start on this was made in the Multai Vidhan Sabha constituency. There, Dr. Sunilam, the Coordinator of the Jan Sansad Abhiyan Samiti had submitted an application to the Returning Officer for permission for vehicles and meetings to carry out a public dissemination campaign for NOTA, but the Returning Officer refused to give permission. The Returning Officer gave the argument that Dr. Sunilam wan not a candidate from the assembly constituency and nor was he a member of any party, therefore, under the 2013 assembly elections Model Code of Conduct, he could not be give permission to publicise NOTA in this way. In fact, this step by the Returning Officer is not only a breach of the right of every citizen in the country to freedom of expression, but is also a grave blow to the democratic system of the country. At the same time, this refusal of permission also raises a question whether the responsibility of

making people in the country aware and conscious of their rights is only that of members of parties and candidates who are fighting elections? Over the years, social worker Anna Hazare, while leading people towards the path of change, has also talked of electoral reforms. Anna Hazare believes that in politics there is now the supremacy of money power and muscle power. According to him, elections now are no longer general elections, because candidates belong to ‘sides’ and parties. There are no candidates of the common people. Therefore, an option should be kept before the people that if they do desire any particular candidate, they can make it known. This effort of Anna Hazare got support in the entire country. So when the people got the Right to Reject, the Jan Sansad Abhiyan Committee, formed under Anna Hazare's leadership, began to make people all over the country aware of this right. However, this should have been done by the Election Commission, because the Election Commission keeps boasting that through the Voters Awareness Campaign they make voters throughout the country aware of voting. But why has the Election Commission not yet launched in any part of the country an awareness campaign about the option of the new Right to Reject and the NOTA button on electronic voting machines, even though Lok Sabha elections are due shortly and the assembly elections in five States will be over soon ? During his country wide Jantantra Yatra, Anna Hazare has felt that people still lack awareness about elections and the selection of candidates. To meet this gap, the Jan Sansad Abhiyan Committee, formed under his leadership, held public meetings during the run up to the ongoing assembly elections in five States. Through these meetings, people were made aware of the value of their votes and the meaning of the option of NOTA. Building this awareness was necessary also because in this regard the Government and the Election Commission are merely doing the paperwork. The Central Government, in its own electoral interests, prepared an election publicity and campaign budget of Rs. 180 crores. The advertisements prepared and released from this budget for TV-print, radio and the Internet mention which schemes were started in

the public interest by the Government, but there is not even a one line mention that voters have now got the Right to Reject, use it to free the politics of the country from undesirable elements. The Government of Madhya Pradesh was the first in the country to refuse permission to carry out a Right to Reject option awareness campaign. But now, opposition leader Ajay Singh has alleged that in the last three months Shivraj Singh Chauhan, the Chief Minister of Madhya Pradesh, has incurred expenses of Rs. 300 crore on his branding. Anna Hazare and his associates are playing an important role in every part of the country to sensitise and make voters aware of their rights, especially the Right to Reject. Anna Hazare had also suggested to the Election Commission that since it would be the first time that voters would be using this Right to Reject option, the Election Commission should tell voters what symbol they were going to give this new button on the EVMs. In this context a logo on behalf of Anna Hazare was also suggested. But neither has the Election Commission yet launched any awareness campaign about this Right to Reject, nor have they given any information to voters that in the country's electoral system, a provision of this kind has been made for the first time. Dr. Sunilam, the Coordinator of the Jan Sansad Campaign Samiti, even wrote a letter in this context to the Madhya Pradesh State Chief Election Commissioner Jaideep Govind. In the letter, Dr. Sunilam requested the State Election Commission that at every polling booth, on the flex boards that have been put up under the Voters Awareness Campaign, the NOTA option should also be mentioned because the reality was that most voters did not even know about this Right to Reject. According to an estimate, in the Madhya Pradesh elections, the total expenses will be approximately Rs. 2000 crore, but out of this entire amount not even one rupee has been spent so far on NOTA. Recently, the Election Commission, patting itself on its back, shared some data with the media, in which it was stated that 64 per cent voters select candidates at their own discretion. Religious, racial and family pressures are just 25 per cent. And approximately half the voters go to the voting centres, because they get an opportunity to exercise their right. According to the Commission,

in the voters awareness programme being carried out so far, the Commission has found that 10.5 per cent people cast their vote based on caste, and 7.6 per cent voters were influenced by the religion of candidates. If the Election Commission figures are correct, during this survey of theirs why do they also not reveal that such and such per cent of voters in the country do not prefer any of the candidates at all and welcome the Right to Reject? If we take the Commission's data itself, nearly half the voters go to vote because they get an opportunity to exercise their right, then in fact these are those voters who are angry or unhappy or dissatisfied with the existing candidates and want the NOTA option. If the remaining 64 per cent voters who select candidates at their own discretion are given the information that in the elections this time they also have an option to press the NOTA button, then undoubtedly they will be able to use their discretion in a much better manner. But the biggest question is that when the Election Commission is accepting that it is running a Voters Awareness Campaign, then how can a Returning Officer representing the Election Commission itself refuse to give permission for a Voters Awareness Campaign on NOTA? Another big question is that why is there so much fear about NOTA within political parties in Madhya Pradesh alone? In fact, the Madhya Pradesh unit of the Jan Sansad Abhiyan Samiti and the Coordinator Dr. Sunilam have been making the people of this State aware about the Right to Reject for a long time. During the campaign of this committee, voices began rising from amongst the people that they are going to reject these candidates because they are worthless and inefficient and have been imposed on them. Seeing this response from the people, political party are becoming nervous and are putting many restraints in those who are in favour of NOTA or have been publicising it. There was also an attack in Chhindwara on Dr. Sunilam by criminal elements some time ago. In Bhopal, on 17 October this year a clerk, Uma Shankar Tiwari, employed in the Weights and Measurement Department was suspended by the District Magistrate only because he was making people aware about the Right to Reject and NOTA.

Over the next few months the Finance Ministry is expected to see several top-level changes but a beginning has been made with Ratan Watal, a 1978 batch IAS officer of the Andhra Pradesh cadre set to become the new Expenditure Secretary once the current Finance Secretary R.S. Gujral retires at the end of the month. Until then Watal will be Officer on Special Duty in the Department of Expenditure. Sources say he has the arduous task of cutting expenditure without compromising on growth. Meanwhile Revenue Secretary Sumit Bose is set to become the next Finance Secretary. The 1976-batch Madhya Pradesh cadre officer is the senior-most of the five secretaries in the Ministry and unless Finance Minister P Chidambaram springs a surprise, Bose will be the first among equals. Budget 2014 after all is not an issue at all!

Miffed Cop Protests

Uttar Pradesh has always been a difficult karmabhoomi for upright bureaucrats, as the episode involving IAS officer Durga Shakti Nagpal showed recently. Nothing has changed on the ground even though widespread public protests forced the political establishment to revoke Ms Nagpal’s suspension. Now another woman officer Manzil Saini, who was controversially moved out as Senior Superintendent of Police from Muzzafarnagar even as the town was engulfed in communal violence, has created ripples. The Akhilesh Yadav sarkar has denied Ms Saini’s request to be sent to the Centre on deputation. She had been interested in working for the Central Bureau of Investigation (CBI). But sources say that Principal Secretary for Home, Anil Kumar Gupta, has not considered Ms Saini’s request. The miffed IPS officer has now sought five months’ leave in protest. Incidentally, she was earlier in the news for busting a high-profile kidney sale racket. Clearly, we will hear more from her in the days ahead.

Apocalypse Now?

Perhaps the babus in the Chandigarh Administration are more paranoid than their counterparts elsewhere in the country. They want to be safe in the event of a nuclear or chemical attack on the city and are concerned enough to have proposed building an underground “safehouse” to house top administration officials in the event of an emergency. Apparently UT Home Secretary Anil Kumar has held several rounds of discussions based on memos sent by former Inspector General of Police P. K. Srivastava and estimated that the project would cost around Rs. 40 crores! The proposed nshelter will, sources say, house 10-12 VVIPs, have conference facility and all the necessities for running an administration during a nuclear attack. No doubt, babus in other metros must be burning with jealousy for not having thought of this one first. But no doubt, it’s the kind of idea that will catch on soon!

EW DELHI: Left with no other option after being served an ultimatum by the International Olympic Committee, the IOA today amended its constitution to bar charge-framed persons from contesting elections, in a development which is expected to pave the way for India’s return to the Olympic fold. The decision to amend the IOA constitution in line with IOC diktat was taken at its Special General Body Meeting here after the the world body served the ultimatum last month that it would de-recognise India if the charge-framed persons are not barred from contesting polls. The IOC has made it clear that the amendment will have to be made before December 10 or else it will recommend India’s de-recognition to the IOC Executive Board which will meet on December 10 and 11. S Reghunathan, who chaired the GBM attended by 134 members, said both Abhay Singh Chautala and Lalit Bhanot, the president and secretary general of the suspended IOA and who were charge-framed by the court, would be ineligible to contest IOA elections to be held on February 9 once the IOC approves

the amendment. “The House unanimously decided to amend the relevant clause in IOA constitution which would bar charge-framed persons from contesting elections. Both Chautala and Bhanot told the House that they will not contest the upcoming elections. In fact, Chautala proposed the amendment while Bhanot seconded it,” he told a press conference. “We also decided to hold elections on February 9.”

In its October 27 Special GBM, the IOA had sought to dilute IOC’s directive on the charge-framed clause by proposing to refer such cases to its internal Ethics Commission, which was later rejected by the world body. “Where charges have been framed by any court in India, in respect of an offence which is of serious nature under Indian Penal Code/Prevention of Corruption Act in which punishment of imprisonment of more than 2 years is prescribed then the member/office bearer/member of executive council of IOA will resign immediately and if not they will be provisionally suspended and will not be eligible to contest in elections and the case will be referred to IOA Ethics Commission for further guidance,” the amended clause said. The amendment if accepted by the IOC could lead toIndia’s return to the Olympic fold after being suspended by the world body on December 4 last. It will also bring an end to the one-year-old impasse between the IOC and IOA. “We are hoping that the IOC will revert back to us in seven to 10 days. The ball is now in the IOC’s court. UMBAI: Minnows Jharkhand grabbed a handy first innings lead of 86 runs over defending champions Mumbai and then increased it substantially by reaching 176 for 5 in their second innings on day three of their Ranji Trophy Group A match here today. Jharkhand, who rode on a blistering knock of 238 by Saurabh Tiwary, dismissed the home team for 265 by wrapping up the remaining five Mumbai first innings wickets this morning, 28 minutes before lunch on the penultimate day of the game at the Wankhede Stadium.

The visitors, who are at the bottom of the league table, ensured they did not collapse in their second essay as openers Bhavin Thakkar (39) and Rameez Nemat (32) gave them a sound start of 65 which was capitalised upon by Tiwary (38) and Ishank Jaggi, who was unbeaten on 51. Left-handed Tiwary and Jaggi put on 75 runs in only 71 minutes for the fourth wicket before the former was caught behind off Javed Khan. Khan also dismissed wicketkeeper Pappu Singh who shouldered arms and was bowled off the last ball of the day. At stumps, the

UMBAI: The first week of the IMG Reliance School League saw some lop sided games as well as close games but the boys from St. Joseph – Wadala, Fr. Agnel’s – Navi Mumbai and the girls from Vidyaniketan – Dombivili showed that they are a class apart. St. Joseph’s boys team displayed great skills to beat Shishuvan school in both their home and away fixture by huge margins. They beat Shishuvan School 41-18 in their away game and at home they beat Shishuvan School, 42-26. St. Joseph also had an easy outing against Smt. Suluchanadevi Singhania School – Thane. They beat Singhania to top the group with three straight wins. In all their games Smit Shinde and Mayank were the heroes for St. Joseph’s. In their last game against Shishuvan at home, Smit scored 18 of their 19 first quarter points. He scored a game high 27 points. In the other pool, Fr. Agnel’s – Vashi boys team looks like the team to beat. With the addition of players from their Jr. College, the team looks like a very formidable side. They beat Dominic Savio 56-12. In their second encounter playing at home, the lads from Navi Mumbai beat Don Bosco – Matunga 46-20.

URBAN: South Africa clinched the three-match ODI series against India by taking an unassailable 2-0 lead after registering a 134-run win in the second one-dayer here today. Sent into bat, South Africa scored 280/6 in the allotted 49 overs before bundling India out for 146 in 35.1 overs. India were bowled out for just 146 off 35.1 overs as South Africa won the series with one match to spare. The visitors were blown away by South Africa’s new-ball bowlers with Dale Steyn capturing 3-17 and Lonwabo Tsotsobe nabbing 4-25. The tourists slumped to 34-4 in the ninth over and never really recovered with Suresh Raina top scoring with 36. The final match in the series is in Centurion on Wednesday, December 11. South Africa’s in-form opening pair of Quinton de Kock and Hashim Amla each knocked up hundreds.

EW DELHI: Australia and France made the quarterfinals of the Hero FIH Junior Men’s World Cup after registering contrasting victories in their respective Pool B matches today at the Major Dhyan Chand National Stadium here. While Australia blanked Spain 2-0, France rallied to eke out a laborious 3-2 win over Argentina. Captain Daniel Beale and Dylan Wotherspoon scored the two goals for Australia. Australia started on an attacking note from the initial whistle and were all over the Spanish circle but they somehow failed to produced desired results, even as they got a series of penalty-corners. Spain managed to contain the Aussies and the break was reached on a goalless score. Australia finally managed to scored in the 38th minute when Beale found the ball in a messy scramble in the circle after Spanish goalkeeper Mario Fernandez Garin stopped three shots in quick succession from close range. Spain also had a chance on the next action on a penalty-corner but goalkeeper Andrew Butturini did a good job. The Aussies had most of ball possession and Wotherspoon scored in the 63rd minute to give a comfortable two-goal cushion to the Kookaburras. Spain had a desperate final surge but they failed to net the ball. With two losses in as many matches, they are already out of contention for a berth in the quarters. In the other Pool B match, Pieter Van Straaten, Theophile Ponthieu and JeanLaurent Kieffer scored for France, while Estanislao Perez Pesado and Gonzalo Peillat hit the board for Argentina.

England heading for defeat in second Test A

DELAIDE: Beleaguered England survived their first full day of resistance Sunday but the prospect of another heavy defeat loomed large heading into the final day of the second Ashes Test in Adelaide. The Ashes holders were set an improbable target of 531 runs over the final two days to prevent the rampant Australians from charging to a two-nil lead in the five-Test series. The tourists have four wickets left and will go into Monday’s fifth day without their front-line batsmen after a confrontational and tense day’s cricket. Rain is forecast on the final day.
