ore than two-andhalf months after the murder of Dr Narendra Dabholkar (68), the state Anti Terrorism Squad (ATS) has made a breakthrough into the case by arresting the arms supplier. The accused, identified as Mangesh Pagare, was arrested last week by department sleuths, said sources in the ATS. Interrogation of the accused led to the arrest of four people, to whom the accused had supplied arms in the past one year, added the sources. With this, approximately 22 Indian-made 7.65 caliber pistols were seized from the arrested man. EVERY year in November, flamingos arrive in the city, escaping the Siberian winter to spend the season in our comparatively more comfortable climes, their pale pink legs and delicately shaded wings making the mudflats in Sewree blush with pleasure. This year, the Fotothon, as part of a year-long campaign initiated by the Friends of Flamingos (FoF) has directed its annual 24-hour live photography challenge towards the support and protection of these beautiful creatures. The Fotothon kicks off at the Mahim Nature Park on November 16 and will continue till the next day, the aim being, as Ganesh Pimpale, director of the event puts it, “encouraging photographers to use their cameras for conservation and providing a platform to spread awareness about these birds that arrive here in such large numbers. Awareness about the need to protect them has become imperative since they are falling prey to both extensive pollution and poaching”. In fact, it is possible that soon flamingos will have their own season, complete with lectures, photo walks, and exhibitions. Fotothon is supported by the Maharashtra Pollution Board, while the Mahim Natrure Park is the event’s chief patron in the form of deputy director Avinash Kubal, who says, “Photographers love flamingos as they get beautiful images and hence we want them to also stand for conserving these birds. ome 20,000 workers of the National Railway Mazdoor Sangh (NRMS) protested on platform 8 and 9 of Chhatrapati Shivaji Terminus (CST) with regard to the safety and shortage of gang-men in the suburban division in the aftermath of the November 3 accident which crushed four gang-men to death. They marched to the General Manager’s office and issued a memorandum of demands to him. Four railway gang-men, carrying out maintenance work on the tracks, were killed after a speeding Kolhapur-bound long distance train hit them between Thakurli and Kalyan railway stations in the neighbouring Thane district. The victims were busy conducting maintenance work on the tracks and thus did not realize that a fast train was approaching. The four died on the spot after being hit by Koyna Express. According to Venu Nair, Divisional Secretary, NRMU, “The sanctioned strength of gang-men in Mumbai division is 3,712. At present, the operational strength is 3,107.” A.K. Mahendru, Assistant General Secretary of National Railway Mazdoor Union said, “Since the last five years, 150 gang-men have died on the tracks. They are not given proper facilities. There is no dignity to their death too. Their dead bodies lie on the tracks for hours together”. The memorandum (copy with the ADC) states that all vacancies of trackmen and other railway staff be filled in immediately, either from existing panels or by recruitment of substitutes. Additional men for manning the additional assets be provided immediately through existing panels or substitutes. The staff working in bungalows and quarters of officers or supervisors be sent back to the gangs or work places. An enquiry should be conducted by a high power, independent committee into the deaths on November 3 and earlier deaths as promised in the discussion on October 28. All safety measures should be ensured i.e. flagman, waterman etc. should be available in each gang while trackmen are doing their work. The workers should be allowed to avail important holidays unless there is a serious emergency. “According to the rules, within 30 metres of
the train, there needs to be a gangman with one cross red banner. Within 600 metres another gangman needs to be present to give a signal to the gang-man along with the red cross banner. Within 1200 metres, another gang-man needs to be present to give a signal to the other two gang-men. But safety rules are not implemented”, said Nair. “On paper, there should be 25 gang-men in one section. But only five to ten of the, are actually present”, he added. The NRMS also reportedly pressurised the railways that within 15 days, a compensation of Rs.25 lakh be given to the families of those who died in the recent accident and job

Udaysinh had sought bail on the ground that several coaccused in the case have been released on bail. However, the High Court refused to accept this and said,
"The applicant is the main accused. Prima facie, if he had not wanted that Sanjay Patil should be killed, then there would not have been the incident of shooting Sanjay to death. Being an influential politician, from an influential family, there is force in the apprehension of the prosecution that if the applicant is released on bail, he would tamper with the evidence and the witnesses would not come forward to depose against him." Sanjay Patil, winner of Maharashtra Kesari title, was shot dead at a market in Karad (Satara district) by two assailants on January 15, 2009.

seven-year-old boy was killed in an accident after a speeding Skoda car allegedly rammed into him on the Juhu-Versova-link-road in Andheri (west) on Thursday at around 8.30 pm while he was returning home after offering prayer at a Masjid. The Skoda driver immediately rushed the boy to the hospi-
tal but the boy did not survive. The deceased has been identified as Mohammad Irfan Sayyad, who was a Grade I student of the municipal school in Andheri (west) and stayed in Kapaswadi area with his parents and seven siblings. “Locals gathered at the spot and the Skoda driver, Tejas Shah immediately got down from the car and put the child in his car with the help of the people there and rushed him
to the CritiCare Hospital. Sayyad had sustained severe injuries and was shifted to Cooper Hospital where he was declared dead”, said a police officer. By the time his family was informed about the incident and they rushed to Cooper Hospital, Sayyad was dead. Senior police inspector Rajendra Chavan of D.N. dicates that it was a revenge killing. Police found the victim’s bloodstains in the bushes just 100 metres away from where the body was found. ustoms sleuths have detained four passengers including two women at the Mumbai international airport for allegedly smuggling gold worth around Rs.1 crore on Thursday night. Interestingly, the accused, arriving from Mauritius, had moulded the gold into belt buckles and kadas (a traditional bangle) to avoid detection. While the names of the accused are being withheld, investigators are now on the lookout for the person who was supposed to collect the contraband. The passengers, who were holding Mauritius passports, were heading towards the green channel, arousing suspicion of Air Intelligence Unit (AIU) officers since the section is meant for fliers who do
not have dutiable items to declare. They were taken aside for questioning when officials spotted the belt buckles worn by one of the male members. The women were also found to be wearing kadas. The items were seized and were immediately valued, which put their worth around Rs.1 crore. “One of the women’s passport showed that she had visited the country at least thrice on earlier occasions. We are assuming that gold was smuggled in on those trips too,” said an officer. They were immediately placed under arrest under relevant sections of the Customs Act and were remanded in custody of the customs department. The airport has seen an all time high in gold smuggling after the union finance ministry hiked the duty to 11 per cent.

he Brihanmumbai Municipal Corporation (BMC) issued eviction notices on Friday to occupants of the illegal floors of the beleaguered Campa Cola housing society at Worli. This is being viewed as the first decisive step by the civic body to demolish the 35 illegal floors in seven buildings of the housing society, reports PTI. Earlier, the BMC had
served two notices to residents living in the illegal floors, but the notices were declared null and void after the Supreme Court stayed the demolition of the illegal flats in May and October respectively. On October 1, the Supreme Court ordered the residents to vacate the illegal flats, above the fifth floors of all the seven buildings on the premises, by November 11. The BMC handed issued eviction notices to residents
of the illegal floors yesterday under Section 488 of the Mumbai Municipal Corporation Act. "As the said time period expires on 11.11.2013, the Municipal Corporation of Greater Mumbai (MCGM) has organised demolition of the premises on 12.11.2013," the notice served to occupants of the illegal floors stated. As many as 100 families are occupying the illegal floors.

he state government yesterday approved the proposal for creation of 44 posts to the State Cooperative Election Authority (SCEA). In August this year the state government had issued orders announcing the setting up of the authority which has been designated as the Competent Authority to hold elections to all the cooperative societies in the state having more than 100 members. The creation of the SCEA has been necessitated due to the 97th constitutional amendment enacted by the
Centre that has brought cooperative societies under its ambit from February 15, 2012. Correspondingly, the state made amendments to its Maharashtra Cooperative Societies Act, 1960 and has issued a notification on February 14, 2013. The state has passed the amendment to this effect in the monsoon session of the state legislature in July last. At present there are 2,18,320 lakh cooperative societies in the state having 5.42 crore members. As per the law, the SCEA is expected to conduct elections to these societies by December 31, 2013.
The SCEA shall comprise commissioner SCEA, secretary SCEA, SCEA election officers, assistant officers, legal officers, administrative officers, accountants and cashiers, statisticians, stenographers, steno-typist, peons among others. The appointment of SCEA staff will be from government departments, retired officers and employees. Some of the posts of the SCEA will be filled by out-sourcing, on deputation and reappointments. The service and recruitment rules will be drafted in the near future, states a press release.
Powerloom shutdown results in `90-crore loss per day

A large number of powerloom units downed shutters since November 6, in protest against the Maharastra government's failure to solve their problems. The ruling Congress MP Suresh Tawre who represents the Bhiwandi Lok Sabha constituency told PTI yesterday that the shut down by as many as 7 lakh looms in the town, employing more than 12 lakh workers has meant a loss of around Rs 90 crore per day and if it continues the industry itself will be dead.
He said that Bhivandi powerloom owners faced a number of problems but an indifferent government had not taken any steps to help them. Exhorbitant power billing by the Torrent Power Company which has been given the right to collect power bills was one of the main woes cited, while other issues were related to constantly fluctuating yarn prices, he said. In addition to this, there is a large gap in wages being paid to weavers, he said. The state government had promised of a high level
committee to look into the powerloom sector's problems but no problem has been solved so far, he said. Due to these unresolved problems, powerloom owners have shut down their looms until November 15 and formed the Bhiwandi Powerloom Sangarsh Samiti which includes MLAS and representatives of all political parties, he said. The situation will be reviewed after November 15 and if the government fails to solve the issues, loom owners plan to decide on their future course of action, he said.

HE BJP would have had a walk-over in Delhi assembly poll but for the late arrival on the scene of Arvind Kejriwal’s Aam Admi Party (AAP). The Congress governance in Delhi has been so bad that the party would have been routed in the elections. The Delhi voters are angry with the Congress for many reasons: Total lack of any effort to check prices of essential articles, the brutal crackdown of innocent protesters against the gangrape of Nirbhaya; corrupt administration by the Congress UPA government. The corrupt cases in the Commonwealth Games, 2G scam, Coalgate etc. is likely to make a big and adverse impact on the chances of the Congress party. The BJP will gain by the lapses of the Delhi and the UPA governments and is likely to get good support. The poll campaign by prime ministerial candidate Narendra Modi appears to have won for the BJP many votes. Corruption, steep rise in prices of essential consumer articles are likely to be the main issues in the BJP manifesto. Both the BJP and the Congress, however, have to face a new, vigorous challenge from Arvind Kejriwal’s Aam Admi Party. Kejriwal’s campaign has been aggressive and vigorous: he has introduced several new methods in his poll campaign in a bid to personally reach the people. According to reports his party has created a good impression on Delhi voters who somehow seem to have decided to give his party a chance to deliver. As the leader of the party, Kejriwal has made a good impression on Delhi voters. A new party is not likely to get majority support, but it can prevent both the BJP and the Congress getting majority support. It is most likely there will be a hung House. It all depends on what the Aam Admi Party will do in such a situation. Between the two ‘evils’, Kejriwal is likely to choose the BJP and jointly form the government. It is clear Arvind Kejriwal will be the king maker in Delhi.

HE English media after going ga-ga over Sachin Tendulkar for a few days has sobered down and is now settling down. Of course, one expects one last hurrah from the media after the final Test in which Tendulkar plays his farewell game is over. Whether he will retire in style hitting his last ton or go out for a duck as Don Bradman did in the last match he played, remains to be seen. Meanwhile the comments on Tendulkar have dropped from high praise to a more sober assessment. Writing in Economic Times (October 18) Boria Majumdar noted that “Tendulkar isn’t simply an icon but he is an idea that we have all come to embrace and admire”. To that he added: “Needless to say, there never was a Sachin Tendulkar and there never will be. And in the process of bidding his last hurrah, he is doing one final service to the game he has contributed so much to in a career that is unrivalled.”

It gave prominence to his final statement on his departure in a coloured three-column ‘box’ that attracted attention that surely the ‘God’ has appreciated. Does anyone believe it? Can one? The rabid criticism against Narendra
Exaggeration or not Writing in Asian Age (October 14) Siddharth Bhatia sounded a little sceptical. Naming the high praise Tendulkar has so far received, such as saying that he represents in his departure an “end of an era”, Bhatia said that was a “hyperbole”. As he saw it, that was too much, considering that Tendulkar should have quit earlier. For all that, Bhatia said that “Sachin’s career trajectory moved in tandem with the emergence of a new India, an India which was loud, aggressive, confident, demanding… and most of all, young.” The young had no time “for heroes and legends of old”. Bhatia’s essay was more a sociological study of how Tendulkar’s rise coincided with that of India’s and the rise of the young. As he put it: “A rising star today is already old hat by tomorrow – the world has moved on”. Also, Bhatia wondered whether another Tendulkar will emerge. Will that be permitted? Replied Bhatia to his own question: “We will know the answer after another 25 years, but with Sachin’s departure from the cricket field, the fans who grew up along with him much understand that a whole way of life has ended.” L. Suresh, who calls himself “a disappointed cricket fan” writing in The Hindu (October 20) criticised those who saw Tendulkar as “God”, saying that by making

I am reminded of an article written by Rajdeep Sardesai in Hindustan Times some weeks ago (June 14) and it deserves reproduction. Wrote Sardesai: “Journalism cannot be pubic relations nor can it be character assassination. Now, as Modi is poised for his next big leap, it is time for the media to may be reset its moral compass. Is it possible to analyse the Modi phenomenon by moving beyond the extremes of glorification or vilification? Can the media find a middle ground where Modi can be assessed in a neutral dispassionate manner without facing the charge of bias or being a cheer leader? Or is Modi
such a polarising figure that even the media has been divided into camps? Journalism in its purest form must remain the pursuit of truth shorn off ideological agenda”. Rajdeep Sardesai then said what needed to be said a longer while ago. But the media has probably come to realise that it would now be unsafe to damn Modi considering that he – and the NDA – might come to power in 2014 and then where will it stand? The greatest damage that our secular press did was to damn Modi over the Godhra and postGodhra happenings. It was vicious. It was strongly condemnatory of the man which under any circumstances he did not deserve. But such has been our post-independence mindset among our so-called intellectuals that they took pride in damning fellow Hindus at the slightest provocation.
A truly secular India Not only did it hurt India, but it also hurt India’s standing in the world beyond. It may have been fashionable to be ‘secular’ whatever that means – but it is not secular for Hindus to be self-condemnatory when it comes to taking sides in any Hindu-Muslim differences. If the Muslims had any sense of grace, they would have graciously conceded the Hindu claim on the Babri Masjid. All that the Hindus had claimed was just one freedom to build a temple to Sri Ram on the site where he was reportedly born. It was as much a matter of faith as it was justifiable on historic facts. Just imagine what a different world India would have been if the Muslims had graciously conceded the Hindu claim? They would have clasped the Muslims to their heart and proceeded to grant them any wish. This, our secularists prevented. That is why I argue that the worst enemies of Muslims are the secularists and their own leaders. May I hope and pray that they will change their minds to win the undying gratitude of Hindus. That would be the best way to rebuild an India of our dreams, in a mighty show of Hindu-Muslim unity. We are one people and should always remain one. For Muslims to grant the Hindu demand would not be a self-inflicted defeat: it would be the greatest moral victory for Muslims ever in their history of Islam. To Muslims all over India I beseech them, pray love us and we will love you.

When most of the Test playing Nations have adopted UDRS, the BCCI has all along been refusing to have that system, the reason for which is mainly attributed to Tendulkar’s hesitation for reasons technically best known to him. If UDRS had been in place in the current Test match in Kolkata there would never have been any controversy about Tendulkar’s dismissal. Coming as it does in the 199th Test match of Tendulkar it is not in good taste. Was Shillingford ‘out’ LBW to Tendulkar really without any margin of error in the umpire’s judgment on the first day of the current Test match in Kolkata? ‘Religious’ hypocricy THE visit to a temple by a Hindu scientist to seek the deity’s blessings for the success of his dream project does not seem to have gone down well with a section of the secular lobby. Pak mole in Indian agencies helped 26/11 attackers

EW DELHI: A Pakistani mole in the Indian security agencies code named ‘Honey Bee’ had helped his ISI handlers in identifying the landing site for 26/11 terrorists in Mumbai, claims a book by two British journalists. The information on Badhwar Park, the landing site, was shared by ISI operatives with Pakistani-American Lashkar operative David Headley who had checked it out while conducting recce of the area, reports PTI. The book ‘The Siege’ by Adrian Levy and Cathy ScottClark claims that when Headley was subjected to undergo a two-year course on surveillance and counter-intelligence by Pakistan’s espi-

onage agency Inter-Services Intelligence (ISI). His handler, Major Iqbal of ISI, gave him what he described as classified Indian files that he said had been obtained from within Indian police and army which revealed their training and limitations. “The Major boasted that they had a super agent at work in New Delhi who was known as Honey Bee. The Major revealed while he would guide Headley, the Mumbai operation would be run by Lashkar,” the book claimed. According to the book, before leaving Pakistan Headley met up with Major Iqbal who gave him a bundle of counterfeit Indian currency and a suggestion. “Honey Bee, the ISI double
agent, who had provided the classified Indian training manuals had come up with a potential landing area, in Badhwar Park, a fishing colony in South Mumbai, reporting that it was only patchily patrolled and was shielded from the road,” the book claimed. “He should check it out,” was the suggestion made out by Major Iqbal to Headley as per the book. Union Home Minister Sushilkumar Shinde and the then Intelligence Bureau Chief P C Haldar refused to comment on the claims saying they were yet to read the book. A group of 10 terrorists of LeT including Ajmal Kasab, who was captured by Mumbai Police and hanged, had landed at Badhwar Park on
November 26, 2008 launching a mayhem in the cosmopolitan in which 166 people including Mumbai police Anti-terror Squad chief Hemant Karkare. The book while concluding says till date the handler of Headley, Major Iqbal, Honey Bee and Abu Qahafa have not been identified. Listing their sources, the authors, who write for British newspaper ‘The Guardian’, said they had gone through classified documents of Indian, the USA and the British security sources, thousands of unpublished court documents and confidential annexure submitted to the Pradhan Commission which went into the lapses of part of Mumbai police.

Govt to challenge HC verdict on CBI N

EW DELHI: Stung by Gauhati High Court verdict that CBI is unconstitutional, Government on Friday said it will challenge the judgement in the Supreme Court on Monday and seek an urgent stay since it will affect the functioning of the premier central probe agency. The curious and unprecedented judgement in which the 1963 resolution — by which the Central Bureau of Investigation was set up—was struck down was described by Additional Solicitor General P P Malhotra as patently wrong. The court yesterday had held that all the actions of CBI were ‘unconstitutional’. “...The DoPT intends to file an appeal. So an appeal will be filed against the order (in the Supreme Court),” Law Minister Kapil Sibal told PTI.
DoPT is the administrative ministry for CBI, Sibal said, adding it has discussed the issue with him and that it was decided to file an appeal. CBI on its part said it is seeking an “urgent action” on the situation. Minister of State for Personnel V Narayanasamy met Prime Minister Manmohan Singh apparently to discuss the fallout of the verdict. He said the Government will challenge the verdict in the Supreme Court and seek a stay. “Definitely, we will have to (file appeal against HC order). We will move the Supreme Court on Monday challenging the Gauhati High Court order,” he told PTI. “We will tell the Supreme Court that the CBI was set up under a resolution in 1963 and
it has been there for last 50 years. So, it should be allowed to continue. “We will seek a stay of the operation of the order. CBI is handling a lot of sensitive cases. It(order) will affect the functioning of CBI,” Narayanasamy said. CBI Director Ranjit Sinha said the agency was looking into the verdict. “We are studying the order of the Gauhati High Court and will submit our opinion to Department of Personnel and Training. We are definitely seeking an urgent action on the situation,” he said. Officials of the agency said they were awaiting a certified copy of the court’s order. “Once it is received, it will be examined and appropriate steps will be taken,” the agency said in a statement.
Infighting in drug gangs behind Nigerian’s killing N
EW DELHI: Ministry of External Affairs on Friday said it has received a report from the Goa government in which preliminary leads indicate infighting between possible drug- related gangs behind the killing of the Nigerian in that state last week. “We have received the report which is a ‘factual description’ of the incident, action taken by the police and the status of the investigation,” the spokesperson in the MEA told PTI.
He also said as per the report, “preliminary leads indicate infighting between the possible drug-related groups leading to the killing.” The report also gives details of the aftermath of the incident, including detention of the 52 Nigerians involved in blocking the highway when the body was being taken for the postmortem, the spokesperson added. The state police had also arrested a Goan youth in connection with the killing of the Nigerian national on October
31 which sparked protests by his fellowmen. The special investigation squad had earlier this week arrested a Goan youth in connection with the killing of Obodo Uzoma Simeon on October 31. Goa Chief Minister Manohar Parrikar has already termed the murder as a drug related crime. The MEA, which is in touch with the Nigerian High Commission here, will now share the elements of the state government report with the mission.

She is the assistant to Jane Foster — Natalie Portman returning as the ‘mortal’ American scientist working in London, who ends up teaming with Thor to save the world, since she becomes an unwitting finder and keeper of the Aether that Malekith is desperately looking for. There is some humour derived action sequences are awesome, but from Thor’s visit to the modern still... it can get boring watching so world (he takes the tube!) but many of these films coming out at otherwise it is formulaic. Now Ram Gopal Varma’s Satya 2 tells is, the underworld is a ‘soch’ and we might be Company people without even realising it. Because according to RGV, the underworld is a better alternative to the System, and looks after people better than the System, and till there are inequities in the System, the underworld will exist in one form or the other. But RGV’s new Company is a shady and complicated organisation that can’t be traced, because it’s a ‘soch’ – it kills as it pleases, money is extorted, laundered and sent to offshore accounts, but it is used to help people. You can’t call it crime unless you know the ‘majboori’ or the ‘maqsad’ behind it, says the new Satya (Puneet Singh Ratn — too raw), the Robin Hood of Oshiwara. So all criminals can line up outside RGV’s office to get clean chits.

HE very name Dracula conjures notions of broken down castles, dark alleys and bats swarming everywhere. The spine chilling story sends a shiver down a movie going audience. The title is a 1931 vampire horror film based on the 1924 stage play written by Bram Stoker, adapted by John L. Balderston and Hamilton Deane. An English solicitor, Renfield (Dwight Frye) is on his way to Transylvania by boat to finalise a deal on a massive sale of English property, Carfax Abbey. As he arrives at a small Transylvanian village by coach, Renfield talks with the innkeeper, telling him that he is on his way to Castle Dracula as he is interested in the property. The innkeeper warns Renfield to stay away from the castle because after sunset Dracula and his wives rise from their coffins and feed on the blood of the living. Renfield dismisses this as superstition and prepares to leave. The innkeeper’s wife gives Renfield a crucifix, saying it will protect him. Upon his arrival, Renfield enters the castle only to find it in terrible shape. But for Dracula this place is home. When Renfield enters, Dracula says “I am Dracula, I bid you welcome”! Unaware of the terrible danger he is in; Enfield accepts
the Count’s hospitality and retires to his room. Renfield never figures the truth until it is too late. Renfield becomes a slave to Dracula and is sent to Dr. Seward’s sanatorium adjoining Carfax Abbey. But the horror doesn’t end there. At a London theatre, Dracula meets Dr. Seward (Herbert Bunston) and his daughter Mina (Helen Chandler), her fiancé John Harker (David Manners) and Mina’s friend Lucy. The nightmare now engulfs Seward’s family after Lucy is found dead and Mina gets kidnapped. Lucy’s father, Professor Van Helsing (Edward Van Sloan) arrives from France to investigate the strange goings on and finds out Dracula is behind it all. He also has a best buddy (Amritiyaan) who gives him Mumbai gyaan, and the buddy’s gal (Aradhna Gupta) called Special, whose name has a story behind it, which, presumably, we will hear in Satya 3, which, from all indications, is definitely coming. Be afraid, be very afraid! If Satya 2 has a redeeming feature, it is that the cops are not shown to be complete dolts! They figure things out rather quickly.

Though how a list of people with sudden income spurts can acquired almost overnight in a city of millions is bewildering. The original Satya was a copsand-gangsters film with no pretensions, and it lent the genre such an authenticity that other filmmakers followed the template, and RGV himself kept making versions of the story. Here, he tries to take it to another level and falls flat into a vat of absurdity. And finally, as a nod to Big Daddy, The Godfather, a scene in which a father whose daughter has been raped approaches the underworld for help, since the System fails him. Enough said!

LIST OF DOCUMENTS PERTAINING TO LAND AND NECESSARY BY LAW AMONG documents pertaining to land, there’s the Conveyance Deed or Sales Deed which is most important. This is a deed document through which the title of the property is conveyed by the seller to the purchaser. Conveyance is the act of transferring ownership of the property from a seller to the buyer. This will help a buyer ascertain whether the property which being bought is on land belonging to the society / builder / development authority. You will come across mention of saat barah which is the 7/12 extract - a document issued by Tehsildar or the concerned land authority providing details such as the survey numbers, area, date from which current owner is registered as owner. And then, there’s the Index II which is a document issued by the office of the Sub-Registrar of Assurances. It mainly mentions the name of the seller and purchaser of a property for which the document is registered. A Search Report is a search of the title of the property taken for a period of the last 30 years. This search report and title certificate can be obtained from one’s own advocate or if the search has already been conducted by the current owner then one can have his/her advocate inspect these reports to ascertain the title of the property. A buyer may also need Non Agriculture Permission. If the land under consideration is agricultural and one intends to develop the said land for residential/commercial/industrial use, then such agricultural land has to be converted to non-agricultural land and a Non Agricultural Order has to be obtained from the Collector of the District where the property is located. Along with this, one needs to take the latest receipts evidencing the payment of Non Agricultural Tax. In cases done within the stipulated period then, there should be an order from the concerned authority extending the period. Where documents pertaining to project/building are concerned, there’s the Development Agreement which is an agreement entered into by the builder with the landowner. It contains details regarding the terms and conditions on which the landowner has permitted development of his property. This is where the landowner engages a third party (i.e. the developer/builder) to develop and build on their plot of land. The Approved Building Plan made by the Developer/builder needs to be approved by the Municipal Corporation or the concerned authority. The approved building plans need to be checked necessarily. And then, there’s the Intimation of Disapproval (IOD) issued by the local municipal corporation or any other local authority pertaining to any city or district to the developer/builder intimating that the proposed plan submitted by the developer/builder is disapproved to the extent of details mentioned in the said IOD. The concerned municipal corporation provides what is known as a Commencement Certificate to permit the developer / builder to begin construction. This is done once the plans have been approved. There’s finally the Completion/Occupation Certificate, certificate is given by the concerned authorities to the developer/builder once the said building is complete in all respects and fit for occupation. My cooperative housing society’s managing committee has been acting in a rather arbitrary fashion by levying fines without any procedures put in place. Can a CHS make its own set of rules and change them at whim? Please advice. — Malati Rao
In the absence of clarity of the law and a misplaced sense of authority, there’s a lot of misuse and misinterpretation of the law in cooperative housing societies all over. Across India, different states have their own Cooperative Societies Acts and Rules and, sometimes, their own Model Byelaws. The one thing that stands common among them all is the fact that they are all driven by one basic goal… cooperation. It must be understood that bye-laws may be binding between the persons affected by them but do not have the force of statute. And, in order to customize niche needs, each and every cooperative housing society should amend their own bye-laws in strict accordance with provisions laid down by the law. For instance, if a cooperative housing society wants to pass a bye-law that demands every member embarking on structural repairs to his/her flat to obtain prior permission of the society or deposit a said amount of money to be refunded at the completion of the work or fine someone an X amount for construction material placed in common passage, it will have to create bye-law for the same. Anything arbitrary could be extra-legal There is a resolution that must be passed by 2/3rd of the members present at the meeting before being submitted to the office of the registrar within two months from the date of the meeting at which it was passed. The resolution must be submitted with a copy of the relevant bye laws in force along with the amendment/s proposed to be made in pursuance of the resolution together with reasons justifying the amendment; four copies of the text of the bye laws as it will stand after amendment/s that should be signed by the office bearers duly authorised by the managing committee of the society and a copy of the notice given to the members of the society for the proposal to amend the bye laws. There is a good enough reason for the procedure to be in place. The Managing Committee even a General Body is not authorized to pass laws. The onus of passing laws rests upon elected representatives. Any change in the existing Model Byelaws to further the purpose of the society can be suggested through an amendment which will have to be cleared by the Registrar who normally acquiesces to the application within two months from the date of receipt of the application or, if of the opinion that the proposed amendment may be accepted subject to any modification, suggest a modification to the society. The approval of the amendment of a bye law depends on the Registrar’s dis-

Cooperative housing society’s managing committee members are often charged with playing law-enforcers with selective members while themselves committing every civic offence in the book cretion. It’s important for all cooperative housing societies to stop a civic mess by correcting smaller offences at the very onset to prevent them from snowballing into situation that go completely out of control. A lot of cooperative housing societies create rules that include fines of Rs.1,000 upwards for each day of construction waste matter accumulated ‘outside’ or in common space and a copy forwarded ‘for reference’ to the local civic authority; any civil changes ‘even those made within’ a member’s premises to be preceded by a structural audit from a BMC-approved civil engineer only; all non-members ‘residents’ to provide a police clearance certificate; fines of Rs.1,000 upwards for each day of garbage or litter thrown in common passage with a copy for reference to the local civic authority and so on and forth. The ‘rules’ or ‘bye-laws’ created need to be cleared by law and added as amendments to the Model Bye laws, failing which they possess little or no validi-
ty. After all, a procedure to amend the Model Bye laws has been put into place to ensure that nobody commits an excess in the process of running a cooperative housing society; the work of a society isn’t converted into a business for profit and the law isn’t subverted for personal gains or prejudices. Cooperative housing society’s managing committee members are often charged with playing law-enforcers with selective members while concurrently, themselves committing every civic offence in the book and beyond without a heed in the world. Concurrently, rogue members tend to make life miserable for right-thinking managing committee members thereby defeating the purpose of cooperation. However, either which way, any move to amend the model bye-law to enhance accountability and stop the rot as well as effect fining processes should be endorsed by the Registrar to further the due process. Anything beyond this is an excess of the law itself.

OLKATA: Debutant Mohammed Shami produced a devastating spell of reverse swing to return with a dream match haul of nine wickets as India spanked West Indies by an innings and 51 runs in the first cricket Test and take a 1-0 lead in the twomatch series here. Ravichandran Ashwin also made it a memorable day by cracking his second Test century and then chipped in with three wickets as the hosts bundled out the visitors for a paltry 168 in the second innings to clinch the match with two days to spare. Rohit Sharma, too, made his Test debut special, cracking a magnificent 177 in the first of the twomatch series which is also retiring legend Sachin Tendulkar's last outing in international cricket. Apart from Sharma, the star of the match was undoubtedly Shami who claimed 5/47 in the second innings and returned impressive match figures of 9 for 118 at the Eden Gardens. Shami's effort is the second best by an Indian on debut after Narendra Hirwani's 16/136 against the same opponents in Chennai way back in 1988. Earlier, Sharma missed out on a double century on debut by 23 runs while Ashwin slammed his second Test ton in a record 280-run stand for the seventh wicket as India extended their lead to a mammoth 219 runs before being bowled out for 453. Starting their second innings with a huge deficit, West Indies were bundled out for just 168, with off-spinner Ashwin (3/46) providing Shami the support at the other end. Sharma slammed an exquisite 177 off 301 balls with the help of 23 fours and a six, while Ashwin made his runs off 210 balls, hitting 11 fours. Making his debut at his home ground, Bengal pacer Shami, who took 4/71 in the first innings, utilised the conditions to maximum effect as he rocked the West Indies batting line-up with his lethal reverse swinging deliveries that skidded in sharply. a potent attack with the senior bowlers. We are definitely forming a potent attack with the SA series coming up,” he said. Such was Shami’s penetration with the reverse swing that he bowled out six Windies batsmen from the nine dismissals as India registered a innings and 51 runs victory to go 1-0 up in the twomatch farewell series of Sachin Tendulkar. Showering praise on Shami, Ashwin said the young pacer eased pressure off him at the other end. “He bowled really well. He got the ball to reverse pretty late. EW DELHI: India will host four major international hockey events in the next four years, including the 2016 men's junior World Cup and the 2018 men's senior World Cup. According to the 2015-2018 tournament cycle unveiled by the International Hockey Federation (FIH) today, India will also play host to the 2015 and 2017 editions of men's Hockey World League Finals to be held in the months of December.

Vishwanathan Anand seeks sixth title as high-profile World Chess Championship begins

HENNAI: Billed as the most high-profile clash in chess history in more than 40 years between defending champion Viswanathan Anand and challenger Magnus Carlsen of Norway, the World Chess Championship match begins here today with the experts divided over who will walk away with the coveted title. The hype surrounding the match between the ageing fivetime champion Anand and 22year-old world number one Carlsen, comparable to the historic clash between Bobby Fischer and Boris Spassky in 1972, will come to an end when the two rivals take on each other in the opening game at the Hyatt Regency Hotel today. Carlsen has the advantage of playing white in the opener but that may not count much as both players get six white and black games in this 12-games November 9-28 contest. Anand has seen similar situations before while Carlsen is playing his first match in a World Championship. So, while the Norwegian enjoys the tag of a favourite, his mannerisms thus far have suggested that he is gullible like any other youngster in a certain sense. Twirling in his chair, scratching his head while answering questions during the first press conference here on Thursday, Carlsen gave the impression of someone tense but exuded confidence once the tete-a-tete was over. Anand, who has won World Championship matches in 2000, 2007, 2008, 2010 and 2012, is used to open with black pieces in World Championship matches. Against Vladimir Kramnik of Russia in Bonn in 2008 and against Veselin Topalov of Bulgaria in 2010, Anand had started with black, which is known as a slightly unfavourable colour in the game, and yet won in style. NEW DELHI: Rahil Gangjee was the best-placed Indian at the weather-hit Hero Indian Open as he was four strokes adrift of Mohammad Siddikur, who fired a sensational six-under 66 to grab a two-stroke clubhouse lead. Gangjee, who shared the lead with five others including Siddikur after the opening round, was two-under at the 16th hole to be tied third at the moment in the unfinished second round at the prestigious Delhi Golf Club. IN BRIEF India set to submit U-17 FIFA World Cup bid documents
NEW DELHI: The uncertainty over India presenting its bid documents to host the 2017 U-17 FIFA World Cup before the stipulated deadline ended today with the government furnishing the required guarantees so that AIFF can submit the documents to the sport's world governing body. With just a few days left before FIFA closes the bidding process, there was speculation that India may not be able to submit the final bid documents before the November 15 deadline due to delay by various ministries in giving the necessary guarantees. Bidding countries have to submit written guarantees on tax exemptions for broadcasters and sponsors, foreign exchange remittances, security, transport,players accommodation and visa, among others.

think I am ready to attack. We will see how it goes but I think I am ready to play. I am really excited to play in my home city. I am looking forward to the match starting." Having won five world titles, Anand said his experience could come in handy in the match. "Obviously, it is one factor among many. I will bring to bear those factors into my game. Definitely it is one of my resources I would like to draw from. We will have to see." Carlsen sought to downplay the view of some experts that he will start as favourite in the match. "I do not know if everyone considers me a favourite but in general I expect to do well in tournaments. If I manage to do well to my abilities and levels, I can win and that will be my mind set here as well," he said. For Anand, there is an extra
motivation to win the match, according to legendary chess player Garry Kasparov. "While the world champion has never given any importance to matters of chess history or his legacy, he must know that his entire career will get an extraordinary new dimension should he beat the Norwegian wunderkind against the odds," he said. While Anand has this chance of reinventing himself once more, a motivated Carlsen though should know that he will be world champion one day or the other. "The difference (between us) is that I have been winning tournaments and he (Anand) has been holding on to his title. It will be an interesting clash between two different ideas of what constitutes the best player in the world," Carlsen had said.

The much-anticipated event starts here from today. Previewing the World Championship, Kasparov was full of praise for the Indian. "Anand is a fantastic chess player who brings honour to the sport and to his nation with his skill and his boundless good nature. If he wins this match his high place on chess Olympus is assured," Kasparov said. Citing his familiarity with both players the Russian, who ruled the chess world for over 20 years, though predicted a Carlsen victory. "I am predicting a Carlsen
victory because of his talent, his results, and the tides of chess history. I am rooting for a Carlsen victory because a new generation deserves a new champion. Most of all, I am hoping for big games, a hard fight, and a great boost for chess around the world as a legend and a legend-in-the-making do battle in Chennai," Kasparov wrote in 'Business Insider'.
Kasparov, however, noted that it will not be easy for Carlsen. "This is one of the most anticipated matches in recent history and it is no insult to Anand, that most of the anticipation circles around the 22-year-old challenger. "Carlsen is the favourite because results and objective quality must matter, but it will not be easy and it is not difficult to imagine a scenario in which he loses the match. Anand has deep experience at every level and that carries with it practical preparation advantages as well as psychological preparedness." Kasparov's arrival in Chennai and his likely attendance in the third game of the match is going to cause a furore. While the Indian chess fans will get to see the great master of the past for the first time in a chess event in India, the FIDE leadership and Anand's camp may not like his presence.
KARACHI: Pakistan's former fast bowler, Shoaib Akhtar has criticised Misbah-ul-Haq saying the present captain lacked innovation and failed to inspire the national team players. "I am disappointed with Misbah's captaincy, he is not aggressive, innovative, slow to read the situation and not able to inspire the other players," Akhtar said. The pacer, who retired during the 2011 ODI World Cup and is known for his forthright views, said Pakistan needed a captain like Imran Khan to get out of its current state of affairs. "Imran was not a better batsman then Misbah but yet on so many occasions he came up the order, scored runs under pressure and won matches for his country," Akhtar told 'Geo News' ahead of the fourth ODI against South Africa. "I don't see that happening with Misbah. He is scoring runs but what use are they if the team is not winning," he added.

KARACHI: After Abdul Qadir and Zaheer Abbas, another former great Javed Miandad has also announced his intention to contest for the post of chairman of the Pakistan Cricket Board (PCB) in the forthcoming elections. Miandad, one of Pakistan's most well known cricketers, is presently employed in the board as director cricket. "I am seriously thinking about contesting the elections because I think I know the running and affairs of the board well enough now and given my cricketing background, I can do a lot of good for Pakistan cricket," Miandad said. Though Miandad is employed on a handsome salary, the board and its chairmen appeared reluctant to make full use of his experience.
Holding slams Ricky Ponting over book controversy
WELLINGTON: West Indies great Michael Holding criticised former Australian captain Ricky Ponting day over revelations in his autobiography that prompted a public spat with current skipper Michael Clarke. Holding, now a prominent cricket commentator, said it was "unfortunate" that Ponting had broken the traditional dressing room code of silence in the book, which was released last month. The former paceman said it was acceptable for ex-players to reveal "a few little titbits" in their memoirs but they should not air dirty laundry in public. "You don't want to be starting all this animosity after you've finished playing," he told New Zealand radio station Livesport. "You've played cricket with some great guys, some not that great, but that doesn't mean that you come out into the open and wash your laundry, keep it behind doors. What is gone is gone."
