HOPEFUL RESIDENTS SUBMIT ORDER OF DEEMED CONVEYANCE ISSUED BY THE DISTRICT DEPUTY REGISTRAR

n an interesting development in the Supreme Court, residents of the Campa Cola Compound apartments on Monday conveyed to the BMC that they had the title of the property. Last month, the Supreme Court had directed Attorney General G.E. Vahanvati to find a humanitarian solution to the problem in consultation with the affected residents. It had also temporarily stayd the demolition of the building in 2013 and taken suo-moto cognisance of the Campa
Cola matter, directing the BMC not to carry out demolitions till May 31, 2014.Accordingly, the residents had submitted various options to the Attorney General and to the Municipal Commissioner and Deputy Engineer of the Building Proposal department of the corporation which they think could be possible solutions. However, the BMC had expressed its inability to consider any of them since the societies did not have title to the property. However, during the hearing on Monday in the Supreme Court, the members
conveyed to the BMC that they did have the title of the property and also submitted an order of deemed conveyance issued by the District Deputy Registrar of Co operative Housing Societies, who is designated under MOFA - Maharashtra Ownership Flats Act. Based on this, the Attorney General has asked for 4 weeks to review the title document and appropriately act thereafter. ven as the country is in the grip of the Lok Sabha election fever, the 12 vacancies of nominated members in the Legislative Council have almost been forgotten. Twelve members of the Legislative Council which includes NCP minister Fouzia Khan are set to retire as members of the upper house on March 12. The members to these vacancies are nominated by the Governor based on recommendations of the state government. However, what is surprising is that all those who get nominated as Members
of the Legislative Council (MLC) do not have to submit any election affidavits disclosing their movable and immovable properties or even about criminal cases pending against them. As per the Constitution, prominent people from different walks of public life should be nominated to the upper house of the state legislature or the Rajya Sabha in the case of Parliament.
