DIDN’T WANT THIS EQUALITY Now, equal before the law, and with many culpable in the ranks, SC verdict is cautiously welcomed by political parties By Prashant Hamine
A
lmost all major political parties have given a cautious welcome to the Supreme Court verdict that struck down Section 8 (4) of the Representation of the People Act, 1951, that gave protection to convicted lawmakers. However, there have been some who were quick to point towards the supremacy of the Parliament to make laws. Most political parties have welcomed the verdict as a step to-
wards stopping the criminalization of politics. Some political parties are now talking of an all party consensus on the stand to be taken on the verdict. Efforts to contact the otherwise vocal, top state BJP leadership proved futile. The SC verdict is especially for politicians like Shiv Sena MLA Sureshdada Jain, Congress MP Suresh Kalmadi, DMK MPs Kanimozhi and A. Raja who have already served Continued on pg 8 «

hile the BMC has managed to bring down the cases of swine flu to zero this July from 151 cases in July last year, cholera and gastroenteritis seem to have gripped the city. Going by the statistics given by the BMC, there were 1652 cases of gastroenteritis in the month of July last year while this year, in the first ten days of July, the city has recorded 685 cases of gastroenteritis already. Cholera, which hadn’t presented itself at all last year, has already affected 20 people over two months this year. “There have been no cases of swine flu this month. But there is a slight increase in the cases of gastroenteritis, while cases of cholera are also surfacing. However these are sporadic and there is no fear of an outbreak or no reason to panic,” said Additional Municipal Commissioner Manisha Mhaiskar. MUMBAI | FRIDAY, JULY 12, 2013
The Sanjay Gandhi National Park is around 103 sq km in size and is home to leopards and other wild animals and human beings (both living legally and illegally) for a long time. Sunil Limaye, Chief Conservator of Forests and Director, SGNP said, “There is no shortage of food within the park. There are plenty of Cheetal and Sambar deer, but they are attracted to dogs as they are easy food for them.” These strays are commonly found near human settlements and of course garbage because of which they are moving alarmingly closer toward human settlements and buildings. According to Vidya Athreya, Ecologist with WCS-India and Co-ordinator, Mumbaikars for Sanjay Gandhi National Park (MfSGNP), “Every leopard eats about 1 dog per week. There are about 700 dogs in Aarey Milk colony alone which is a small area about 13 sq km to the south west of the park. There are unverified reports by residents that the BMC releases stray dogs here.” The garbage and meat disposal here too is a big issue which is attracting dogs even more. Another cause of conflict, Athreya adds, was the release of leopards (caught anywhere) into SGNP till 2005. Moving them away from their homes caused problems of adjustment as they are territorial by nature. It was also found that most attacks happened near release sites. Currently there are around 21 leopards in the park and incidents of attack have reduced considerably.

Do not move around in the dark alone. Make sure you are accompanied by someone. Make sure to create some noise which keeps the leopard aware that you are around. Leopards are attracted to dogs, so make sure your dog is safe at home at all times and not running around freely in the colony. Garbage needs to be disposed off efficiently as this is probably the most major problem and cause of conflict.
FORWARD ACTION According to Athreya, “There is no easy solution and there will always be instances of incidents. Residents need to ensure that their own surroundings are clean, that garbage is dealt with efficiently and children are not outside after dark and that play area has adults supervising the children as well as is well lit. The garbage issue can be
DECODING THE LEOPARD
ON TRAPPING
ATTACKS (INCLUDING INJURIES AND DEATHS):
Mumbai has been facing a conflict with leopards especially in the areas surrounding the Sanjay Gandhi National Park. With forest and open spaces slowly disappearing at the edges PRACTICAL STEPS TO of the park, the easily adaptable, shy, wild cat has been increasingly in the news for the SAFEGUARD YOURSELF wrong reasons, especially for its so called ‘encroachment’ on human land. With the spate of Stay alert at night. leopard sightings raising a storm, environmentalists are struggling to find a solution that Do not leave children unsupervised. Make sure they don’t wanwill not only conserve the species but also help both human and animal co-exist better, der and it is best to keep them indoors at night and under conreports Gayatri Sahasrabuddhe stant supervision
“Contrary to what most people feel,” Athreya adds, “Leopards are very shy animals and are scared of human beings. They will run away and hide on seeing humans.” There may be a few stray cases of leopards injuring humans, but in general, it is important to remember that leopards will not instinctively attack humans or come after them unless provoked.
Trapping an animal and releasing it elsewhere was considered a solution for a long time, but it only made matters worse. Says Athreya, “When you remove a leopard from an area, others come in and fill the vacant territory. If a mother is separated from her cubs, the cub is likely to create problems.” So it is best not to trap an animal that has caused no harm. A trapped animal which has not hurt humans should be released closer to its home whereas animals captured after purposeful attacks on humans should never be released. Moving it to another area
have not received any call about any kind of conflict. Most of the conflicts happen in Aarey Milk Colony.”

causes problems of adjustment for them and may lead to attacks. Athreya also adds that when the animal is caged it very often injures itself on colliding against the metal
bars and maggots infest the wounds. Also, leopards are very territorial and are not prone to multiplying in areas or numbers easily since internally they control their populations, with older animals killing the sub-adults who are in search of new territories.
POLICE AND TACKLING THE LEOPARD SITUATION: Members of MfSGNP visited and spoke to police personnel in surrounding stations to sensitize them on how to deal with the humanleopard conflict. Dipti Humraskar, Ecologist and member of MfSGNP said, “36 police personnel in 13 police stations around the National Park have been alerted about the problem. Legislator Ravindra Waikar, who is representing Goregaon East, that encompasses some part of the National Park, alleged that the state and the BMC are not taking action against mushrooming illegal construction at the Aarey Colony. Waikar said, "Some persons have encroached into the forest areas and consequently the animals are entering into human habitat, thanks to which school-going students and senior citizens out on morning walks are becoming victims of attacks. I have raised this issue in the assembly and have requested to set up a 'Rescue Center' inside Aarey Colony. In case any wild animal enters residential areas, the rescue center will trap the animal." "The state has advised against taming like poultry, goats and dogs, as they tempt wild cats into coming

here. In recent times, leopards have come right upto the ONGC colony. Its high time we resolved the issue," he added. Civic health officials have denied dropping off stray dogs inside the park area.
“If you spot a leopard, the first thing you should do is go inside your home to safety,” says Athreya. A mere sighting does not necessarily translate into a dangerous situation. Recognise that leopards are resident of the area and remember that leopards are scared of humans and will not attack unless provoked. In case of an emergency declare Section 144 of the Criminal Procedure Code (CrPC) when there is any problem caused by leopardhuman interaction, to control the crowds." Deputy Commissioner of Police, Zone 11, Pravin Patil, said, “People are unable to differentiate between police officers and forest officers. In many situations we even rescue the leopard if it is stuck somewhere. The illegal shanties inside the SGNP are the biggest problem. We give training to our police officers to attend and visit the site when they receive a call from the control room. Our main intention is to divert the conflict between leopards and human beings. In the last 2-3 months we
situation (not just a sighting), call up the police or Forest Department to handle the situation. Do not create a commotion or stir up a crowd. Cornering the animal will only provoke it and scare it, making the situation more dangerous. Your best bet is to stay indoors for the safety of yourself and your family. sorted out through composting or creating a pit for the garbage or even by using good garbage bins, that dogs can’t get to. In terms of the problem of encroachments pertaining to SGNP, the government is dealing with them very seriously. ” It is essential to remember that the leopards have always lived here long before the city of Mumbai arrived at their doorstep. Humans and wild animals have been co-existing peacefully for eons in rural areas. As we slowly encroach on the land that they have been living on for years, we are forcing them to stray and stray they do, right back, closer to our homes.

fter the ADC reported about students being crammed into classrooms, the issue was taken up at the Academic Council of Mumbai University, which authorized the extension of divisions for various degree
courses in several colleges in the city. The ADC had reported (‘Packed like sardines’ June 22) that city colleges had been crossing the student limit per class for degree college courses, where two divisions were merged into one forcing almost 140 students
have therefore been allowed to have an extra division for the concerned courses. When the ADC spoke to Dr. T. Shivare, Chairman, NonGrants College Association, he said, “The declaration of seats was actually needed. Colleges can now systematically divide students into more divisions, rather than making classrooms crowded and uncomfortable for students. The varsity should also keep in mind that colleges do not take advantage of the given divisions and enroll more students than the limit of admissions and class-
rooms according to the MU rules." The recent admissions and fewer divisions had made it a hard task for teachers to teach in overcrowded classrooms. Dr. Nareshchandra, Pro Vice Chancellor, MU, said, “City colleges will now not have a problem of divisions, and the varsity will see to it that none of the colleges take advantage. The Local Investigation Committee (LIC) of MU will be keeping a track of the records of the added divisions and admissions". yatin.ingle@afternoondc.in

In lieu of this, the developer had the liberty of using the ground for a total of 30 days each year. “The developer, who is a close aide of an influential leader of this area, has not only carried out permanent constructions in the form of food stalls and concrete structures, but has also violated the agreement by using the ground for a days far more than the permissible period,” alleged Mhatre.
The PMC chief not only inspected the playground and checked the documents pertaining to the land, he also gave a patient hearing to the complainant who had earlier moved the judiciary against the illegal acitivities. Residents of the area have alleged that the developer has turned the access road into a private property which falls in between the play ground and a theatre-cum-mall.

The poll related allegations against Ashok Chavan and Gopinath Munde fall under the purview of Section 10 (A) of the Representation of the People Act, 1951. Speaking to the ADC, NCP spokesperson Nawab Mallik stated that the SC struck down the provision terming it ultra vires on grounds of equality before law to the common man and elected representative as well. He added that the NCP will adhere to whatever stand the government takes at the all party meeting, and that of the Parliament. Mallik however was quick to point out that several

Maharashtra Pradesh Congress Committee (MPCC) spokesperson Anant Gadgil stated that the Congress welcomed the judgment in principle. He argued that the judgment is silent on what happens if a candidate is declared disqualified and is subsequently found not guilty by the higher courts. Gadgil added that the voter needs to be more cautious and not vote for a tainted candidate. Shiv Sena spokeswoman, Dr. Neelam Gorhe, while advocating the supremacy of the parliament to make laws, termed the judgment as a milestone. She added that it is the party’s decision to field a particular candidate in the elections. She said that the parliament was the supreme legislative body to make laws and until it makes such a law, one will have to abide by the verdict. The BMC’s new ‘RG PG’ policy prohibits political parties from using the Shivaji Park for their public rallies.

S
hiv Sena won’t get Shivaji Park for its annual Dussera rally this year as the civic body has strictly prohibited the use of public ground except as recreational space for children under the new ‘RG PG’ (recreation ground and play ground) policy on Thursday. Shiv Sena has been organising Dussehra rallies at Shivaji Park from over four decades. However, henceforth, the Sena shall have to find other spots, maybe the Mumbai
Metropolitan Regional Development Authority’s ground in Bandra Kurla complex, for the rally. The Brihanmumbai Municipal Corporation (BMC) underlined that the open ground will be used only for recreational purposes. Even summer vacations, April 15 to June 15, shall witness no activity taking place on the ground except Maharashtra Day Celebrations on May 1. These grounds would be used only for the celebration of anniversaries of national leaders as well as Maharashtra Day, Independence

last month and had to vacate the C8 bungalow opposite Mantralaya, which he was occupying since 2009. “While surrendering the bungalow he had taken with him all its furniture, appliances, cabinets and even the curtains,” the Public Works Department (PWD) has said in a written complaint to the government. The PWD officials who inspected the bungalow before its next occupant, Tribal Development Minister, Madhukar Pichad moved in, were shocked to see the state of affairs inside the house. All the PWD property, including the sofas, beds, chairs, tables, electrical fittings, geysers, curtains, pelmets, cabinets, air conditioners, gas stove, cylinder, and even the kitchen ventilator, were missing. The PWD officials took cognizance of this and brought this to the notice of the Chief Minister, Prithviraj Chavan. Immediately after this Dhoble rushed to Mumbai and met the PWD officials to tender his apology. The officials are now waiting for Dhoble to return the items.

But even those will require valid permission from the Deputy Municipal Commissioner, Education. Other grounds will be given for other purpose on condition that the event is non-commercial, lasts only for 30 days. Also, the 30 day period will be counted from the moment tents are placed on the ground to the moment the organiser takes them away. vishnudas.sheshrao@afternoondc.in
Sena to take out morcha to protest misuse of land allotted to MCA By Prashant Hamine
A
ccusing the Mumbai Cricket Association (MCA) of blatantly violating the court order and setting aside BMC rules and constructing liquor bars and restaurant on the leased land reserved for playground which was given to it at Mahavir Nagar, Kandivli (West), the Shiv Sena leaders will be taken out a morcha at the MCA premises today. In a statement issued here yesterday, Sena MLA Vinod Ghosalkar stated that the state government had temporarily vacated the stay imposed on the MCA to allow the construction and re-imposed it after the construction was over. He said that many other organisations too had sought permission from the BMC to make construction on the reserved playground but was denied. Ghosalkar stated
Sena MLA Vinod Ghosalkar that all rules were flouted and three liquor bars and two restaurants meant for the rich were constructed. Moreover, the locals have been denied membership and instead the same has been awarded
to some clubs. Ghosalkar further disclosed that as per MCA rules the membership fee per member is Rs.11,000. However, some affluent individuals have been given membership at Rs.7 to Rs.10 lakhs. Ghosalkar stated that although the land belongs to the BMC, the MCA has taken pains to ensure that there is no visible presence of the civic body in the form of any plaque or signboard. Furthermore, security guards have been deployed to keep the locals off the playground. He added that Mumbai Mayor Sunil Prabhu has been urged not to grant Occupancy Certificate to MCA. The BMC Mayor too on his part has directed the civic administration to submit its report within a week on the issue. Meanwhile, the Aam Aadmi Party (AAP) too has announced its decision to agitate at the MCA Club House in Kandivli.

Ponder awhile… “An election is a moral horror, as bad as a battle except for the blood; a mud bath for every soul concerned in it.” — George Bernard Shaw
No place for lawbreakers in T House of lawmakers I T is indeed a shame that a large number of lawmakers — in Parliament and state assemblies — are lawbreakers: they have criminal charges against them and are facing cases in court. All political parties give poll tickets to criminals who possess the necessary means — money and muscle power — to win elections. How can any civilised society have a Parliament with criminals? It is indeed a diabolical joke that criminals can sit in Parliament and make laws. The verdict of the Supreme Court passed a couple of days ago is likely to help in the most undesirable situation. The Supreme Court has ordered that the moment any member is convicted, he should be suspended from Parliament. An appeal to a higher court will not allow a member to continue to sit in parliament. All political parties have welcomed the decision. The practice of giving poll tickets to those against whom there are criminal cases may stop thanks to the directive of the Supreme Court. It is to be seen what political parties will do when 2014 Lok Sabha polls will be held. It looks like politicians cannot do without the support of criminals: They may decide to associate them in some way with the elections.

he most sensational news concerning the media – which many newspapers sadly did not cover – is the decision of the Telecom Regulatory Authority of India (TRAI) to recommend curbing corporate control of the media, while pointing to the complexities in operationalising it. It would seem that there is talk of creating “an institutional buffer” between corporate owners and editorial management of the media. All this has stirred up a measly controversy. One charge is that corporate control over media content has distorted democratic practices through ‘paid news’ and that “with the line between news, views and propaganda blurred, readers are misled”. And Big Business has one more tool to influence the political system. Many issues arise in this context of TRAI’s recommendation. One, setting up a newspaper costs crores of rupees. Where is it to come from? Anybody who wants to pitch in with financial assistance would be a rich idealist or a pucca businessman who wants returns for the money he has invested; even the Congress-supported National Herald had at one time to close down. So, when someone – may be a Corporate Group – cough up the cash, one presumes that it wants something in return in whichever way.

Confucianism, a system of social, ethical philosophy
C
ONFUCIANISM is often characterized as a system of social and ethical philosophy rather than a religion. In fact, Confucianism built on an ancient religious foundation to establish the social values, institutions, and transcendent ideals of traditional Chinese society. It was what sociologist Robert Bellah called a ‘civil religion’, the sense of religious identity and common moral understanding at the foundation of a society’s central institutions. It is also what a Chinese sociologist called a ‘diffused religion’; its institutions were not a separate church, but those of society, family, school, and state; its priests were not separate liturgical specialists, but parents, teachers, and officials. Confucianism was part of the Chinese social fabric and way of life; to Confucians, everyday life was
the arena of religion. The founder of Confucianism, Master Kong (K’ung, Confucius, 551-479 B.C.E.) did not intend to found a new religion, but to interpret and revive the unnamed religion of the Zhou (Chou) dynasty, under which many people thought the ancient system of reli-

The burning issue of the day was: If it is not the ancestral and nature spirits, what then is the basis of a stable, unified, and enduring social order? inition unbiased is pure nonsense. Among reporters one may be inclined towards the Congress, another towards the BJP, a third is in tune with Maoist sentiments and so on, only to end up in messing up news coverage; probably that does not occur to our idealists. In the end there should be only one to lay down the law, whichever way, so that there is consistency in the pages and the smart reader knows what to expect. To quote The Economic Times (June 20), “why presume an editor is more ethical than the publisher?” The ideal situation is one in which the publisher, the editor, the editorial staff right down to the juniormost reporter are all ideologically one. It should also be pointed out that it is sheer arrogance to presume that corporate bodies are evil by nature and should be prevented from owning publications. The Economic Times insists “that the basis of free speech is the right to start a publication to express one’s views” and the TRAI proposal “to barricade the editorial section from the publisher would destroy this foundation.”
Error of omisssion, commission There are many ways in which reporters are made to stay on course with the publisher’s views. One way is to hire them on “contract”. It is a standing threat to the reporter that if he is out of tune with the management’s needs he can be easily shown the door. The best way to make the media transparent is four-fold: one, on the editorial page as well as on front page, it must be clearly stated that the newspaper is the property of the concerned corporate body which alone has the right to choose news. Two, all staff members must be employed on a permanent basis and not on contract and any dismissal should be adequately recompensed. Three, that it is the proprietor and not the editor who is legally responsible for any error of omission and commission. And four, what goes for Paid News must be clearly admitted by the end use of the initials CBC (Certified by Corporation). The Hindu (June 16) carried a report that said Vice President Hamid Ansari has condemned “propagation of biased analysis and forecast, both in the political arena as well as the corporate sector and irresponsible reporting to create sensationalism.” This is a matter for the Press Council of India to evaluate. But it is clear that Mr. Ansari should work in a newspaper office, even for fun, to know what it takes to bring out a daily paper. His recommendations may then be taken more seriously. sound policy. Confucius, however, believed that the basis lay in Zhou religion, in its rituals (li). He interpreted these not as sacrifices asking for the blessings of the gods, but as ceremonies performed by human agents and embodying the civilized and cultured patterns of behavior developed through generations of human wisdom. They embodied, for him, the ethical core of Chinese society. Moreover, Confucius applied the term “ritual” to actions beyond the formal sacrifices and religious ceremonies to include social rituals: courtesies and accepted standards of behavior — what we today call social mores. He saw these time-honored and traditional rituals as the basis of human civilization, and he felt that only a civilized society could have a stable, unified, and enduring social order. — Judith A. SC VERDICT ON TAINTED LAWMAKERS DRAWS LOUD APPLAUSE
THE Supreme Court’s landmark order states that MPs and MLAs with criminal convictions will be disqualified. Better late then never, but it is the best declaration ever done by Supreme Court. We must learn from China, where in a recent case, an ex-minister who was convicted for corruption just two years back has been sentenced to death. In India, we, let go such court cases against MPs and MLAs go on for years together, allowing the offending peoples’ representatives to enjoy more and more during their tenure while increasing their bank balance too. In India, we give votes, we give them security, we admire them, we give them full facilities, in spite of knowing that the concerned persons are criminals. The BJP (42 Ministers) and Congress (41 Ministers), both are pampering such tainted MPs and MLAs, specially BJP is also trying to make one of this ilk the next PM, ignoring his serious crime. I am very happy to hear about the Supreme Court's declaration about such (majority) MPs and MLAs to be disqualified if they are found guilty. But the question is to get the whole issue implemented in real and true sense. At least Parliament will be clean now. Let us hope for the best. — Perin Akolawala, Mumbai

Its inevitable, that the further appeal against the verdict, would not be helpful to the convicted minister, to keep his post or political status with him Its really needful decision in our county, where many of the MPs and MLAs are with criminal background. AS reported, it is indeed refreshing, encouraging and inspring to know that Supreme Court has passed the verdict by which MPs and MLAs will be disqualified immediately when found guilty by any court for crimes committed and punished for two years and more without further appeal, by a higher court. Every year, at the beginning of the academic year, all schools in conjunction with some NGO – this time it is Helpage India – recruit all children to go about to collect money for the NGO. The scheme also has competitions, of course with the usual caveat – Conditions Apply – at least Rs.1,000 must be collected. Since each society has many children from the same school, there is intense competition and it is really pitiable to see children come at night to ask for money. Their faces reveal the tension they are under. Will the courts or some legal eagle file a PIL and put an end to this despicable means of recruiting child labour? Dress code for bar girls? THE Congress govt. of Karnataka is reportedly implementing a scheme which would ensure a certain dress code for bar girls in the State. Just before the Assembly elections, one of the main planks during the polls campaign was the strict opposition to the moral policing undertaken by some of the Hindutva outfits. It was thought to be one of the reasons for the humiliating defeat of the BJP in the elections. By this yardstick, are the bar dancers not at liberty to choose whatever dress they prefer to wear? Check the killer landslides
Every year, landslides have been taking their toll without fail. To state that only 200 people have died due to them in the last 10 years is a gross understatement.
I WELCOME the landmark ruling of the Supreme Court that when an MP or MLA is convicted by any court in a criminal case, he or she must be disqualified from the House with immediate effect and should not be allowed to contest the future election. I am of the opinion that Supreme Court, at last has realised that there are many political leaders with criminal background and are ruling in their own states as well as in the Parliament, dictating their own terms and conditions to remain in power by hook or crook without bothering about the law, thus vilifying the entire political atmosphere and now the people and the voters of the country will have more confidence in their representatives, thanks to the SC’s determination to have politics with a clean image and more transparency. It is high time all the political parties follow the Supreme Court order and see to it that the convicted member of their party must be disqualified and should not be given be allowed to contest polls till their names are legally cleared of their offence, if at all. — Bhagwan Thadani, Mumbai
THIS is with reference to the report ‘Landslide kills two, injures one’ (ADC, July 1). This writer, being a geologist, has in fact pointed out in this column earlier that landslides are waiting on the hills for the rains to come down. This Antop Hill incident therefore does not come as any surprise and there are a large number of localilties in Mumbai and its suburbs where hutment colonies are in real danger of coming under the rock-slides because the hillslopes have been destabilised by indiscriminate cutting, removal of basal support, overloading, oversaturation with water, etc., which are all known causes for the rock and debris slides. The BMC has an exhaustive inventory of all these vulnerable spots but, strangely, does not go beyond sticking notices for evacuation. This does not help at all because the poor people living there do not have any alternative accommodation to go. It is necessary therefore that the corporation with its astronomical annual budget of 10,000 crore, draws up a plan for stabilising the hill-slopes in these localities using some of the available methods like spraying a cement mixture on the slopes, building a retaining wall below, inserting steel bolts, placing a net of steel wires, etc. No other agency is financially equipped to carry out all these. That “200 people have lost their lives in landslides in the last 10 years” is a gross understatement — about 150 people died in just two landslides in Chiragnagar, Ghatkopar and Saki Naka, Andheri and every year the slides have been taking their toll without fail. — Dr. V. Subramanyan, Thane

HC upholds RTE provision which bans holding child back upon flunking exam By A Staff Reporter
O
bserving that a child suffers an intense psychological trauma if he or she is expelled or continued in the same class upon failing in the final examination, the Bombay High Court on Friday dismissed a public interest litigation challenging a provision in the Right to Education Act. Under section 16 of the Act, no child shall be held back or
expelled till completion of elementary school (Std VIII), reports PTI. "A child who is not allowed to progress to the next standard suffers from an intense psychological trauma resulting in loss of self-worth. Holding back for want of adequate performance assessed with conventional methods like examinations places the child in a position of disadvantage in relation to his or her peers," the court said. The division bench of Justices
D.Y. Chandrachud and S.C. Gupte was hearing a public interest litigation filed by Arun Joshi, director of a Solapurbased educational institute, stating that this provision had resulted in deterioration of educational standards. The High Court, however, disagreed. "The kind of pressure we put on our children these days... At such a young age learning process need not be based only on exams. I was also a student
and now a parent...I know how exams can be," Justice Chandrachud said. The court observed that while enacting the RTE Act the Parliament was aware of social realities. "Assessing knowledge merely in terms of performance in examination takes a very narrow view of the purpose of education. Education must emphasise the need to initiate the child into a holistic pattern of development," the bench said, dismissing the PIL.

TREK IT OUT Shutterstock
The monsoon is the most beautiful season for trekking. So, if you love the outdoors, Priyanka Singh & Dev Goswami tell you about destinations that you should not miss out on this season
I
f you are a trekking enthusiast and want to witness the best waterfalls and dense greenery, then trekking during the monsoon will be like a dream for you! During the monsoon, the natural habitats surrounding us are in their utmost glory and you’ll get to view them up, close and personal while hiking. We give you a list of some of the best monsoon trekking destinations closer to the city.
tUngareshwar Tungareshwar is an excellent choice if you’re looking for heights that are closest to the city. Located between Virar and Vasai, it’s a hill with a plateau on top and it is surrounded by dense forests and ample greenery. There is also a Shiv temple and ashram on the hill, the latter of which has turned into more of a picnic spot lately. If you are not taking your own vehicle, you can take a Virar local and then take an auto from there to get to Ussgaon where you’ll find the welcome gate for Tungareshwar. This is the perfect time to visit the place as the waterfalls will be at their prime right now. There are also some small
restaurants on the way, so you have an option of not carrying eatables with you. The trek is not very steep and so is suitable for beginners.
gorakhgad Named after Saint Gorakhgad, Gorakhgad is situated at a height of 2,150 ft, which is not a very long trek and ideal for a one day trip. After the base of the summit, the trek gets a little challenging, so if you are not used to >> Jaamal Maal is the highest point in Mumbai and is located in the Sanjay Gandhi National Park
trekking, we’d suggest that you refrain from visiting this location. This mountain is located at Dehri which is near Murbad and some distance away from Kalyan. If you are taking a train, then getting off at Kalyan will be your best option. After some amount of trekking, you’ll reach a cave with beautiful rock cut steps and further up you’ll find a small Shiva temple. Make sure you should carry your own food and water here.
ratangarh If you are also a history enthusiast, then Ratangarh will delight you as on its extreme top, you’ll find Ratanwadi Fort which is 400 years old. It is located 180km away from Pune and you’ll have to take a ferry over the Arthur Lake to get to the base camp. A series of waterfalls and a thick jungle follows next. Finally, the entrance to the fort is so well hidden that you need to enter through a chimney. It will take three hours to reach to this fort from the base and you will come across paddy fields, Pravara river and dense forests. Towards the end of the forests are

However, one needs to exercise utmost caution on the ladders during the rains as they can get slippery, but if it’s adventure that you are after, then you’ll find that aplenty here.

harishchandragad Harishchandragad is a hill fort situated in Ahmednagar district of Maharashtra and it is 120km northeast of Pune. This is a treasure trove for people who have a keen interest in history. However, during the monsoon, it is advised that only experienced trekkers should take up this trek, as reaching the fort can get quite dangerous and slippery. The highlights of this trek are the Kadareshwar cave and Konkan Kada. The former is a huge cave which has a big shiva linga that is completely surrounded by water. In the monsoon it is mostly not possible to reach this spot as huge streams of water flow across the way. The cave is quite a sight. The Konkan Kada gives a breathtaking view of the surrounding region. In the monsoon, availability of food and water becomes a problem, so carry your own.
>> Tikona fort (in the picture) near Lonavala, though not on our list, is another great option to go for a monsoon trek

JaaMbul Maal If you don’t think you can go out of Mumbai or just want a one-day break from the city, head over to the Sanjay Gandhi National Park (SNGP) where you can trek to Jaambul Maal, which is the highest Kanheri Caves region and we point in the city. safety precautions While trekking While the monsoon is the perfect time to go trekking, due to the lush greenery and the variety of flora and fauna; it can also be dangerous, especially if you’ve never trekked before. If you’re new to trekking, always get someone who has trekked before to accompany you. Also, Akul Tripathi, one of the founders of Jumpstart Outdoors, gives us a few safety tips: • Always inform your family/neighbours about your plans. Keep them updated. • All treks/climbs have a variety of routes. Select one on the basis of the least capable person in your group. • Do background checks on the location before you leave the city. Talk to someone who has been to the place before. • Learn wilderness first aid skills and always carry a basic first aid kit. • Carry enough drinking water and emergency food with you. • Avoid carrying valuables when outdoors (jewellery /gadgets). • Check your shoes for grip and durability before you leave and carry extra socks. • Consuming alcohol dehydrates your body, makes it tougher to trek, reduces your alertness, lowers your guard and makes you prone and vulnerable to accidents and/or crimes against you. Make an informed decision. • Keep change ready in your pocket and do not access your wallet all the time. Keep some money stashed away safely in your bag for an emergency. • Be consciously careful during the end of the trek as most accidents tend happen during the wrap-up time.

Located in the Raigad district and a few hours away from the city, Thanale Caves is a very popular trekking location. The rockcut caves are actually Buddhist temples that date back to 1st and 3rd century AD. There are 28 caves in all, however, natural circumstances have blocked nearly 10 of them. All the treks for Thanale caves start from the Thanale village, from where it will take you around two hours to reach the caves. The only drawback is that the place is popular and so, you might find it a little crowded. However, the scenic beauty and ancient architecture will surely make up for it.
experience that this is one trek that every Mumbaikar must take up at least once in their lifetime. The view from the highest point is truly breathtaking and you will want to come back for more. Quite obviously, SNGP is usually crowded during the weekend. However, very few people venture towards Jaambul Maal, so you don’t need to worry about that.
kalsubai Another popular destination, Kalsubai is the highest peak in Maharashtra and is located in the Sahyadri range. This trek is only for those who are experienced in trekking as the rugged hilly terrain can prove to be quite a challenge; and the final climb to the Kalsubai pinnacle is a steep climb. Once at the top, you will be treated to a panoramic view of the surroundings and the vast backwaters of Bhandardara are sure to catch your attention.

The price of luxury Luxury Italian label Armani has launched an Armani Jeans store in Malad. Rhea Dhanbhoora sees if it lives up to its designer name
A
1,957 square foot store with designer clothes and accessories for men and women — Armani does a good job with first impressions. As it should, being one of the many spinoffs of the successful Giorgio Armani brand. We’ve always loved the luxurious Emporio Armani collections and the high-end Armani Collezioni, but unless you’re flushed with cash, they’re not the most affordable options. So, they decided to bring the bridge-line, denim heavy Armani Jeans into the mix to test the waters. It’s still heavy on the pocket for most, but it’s targeted (correctly) at the young and flashy crowd for whom paying `9,000 for a belt is no big deal. Armani Jeans is like the rainbow sister compared to the rest of the Armani labels. I’m used to going gaga over their dapper suits, crisp whites and subtle beiges, but I’m not used to seeing reds and blues pop out at me
>> The men’s collection has a nice range of loafers
>> We loved this floral bag
under the designer tags. It was a pleasant change and made the store seem a little less intimidating. On display as I entered the store, was a pretty peach floral bag staggeringly priced at `15,500, along with its somber black twin for `15,000. Remembering that it’s a luxury brand will help ease you into the prices, especially since it’s cheaper than a usual Armani store. Still, `9,000 for a pair of pink rain shoes seems a bit overpriced to me. While the purses and shoes were too run-off-the-mill to have such tags, the clothes were a little less offensive. Especially since the designs were designer-worthy and the material was luxurious to touch. I was reminded that the collection changed often, so if you like something and think you’ll buy it in a few days, you may not get the chance to. They seem to encourage impulsive spending, not a bad ploy for a designer store. A blue, striped blouse stood out the most (`13,000), if only for

the material. The jeans also looked like they were made of great material (`11,500) and seemed like a good buy. However, on closer inspection I was a little perturbed by the loose stitching near the waist band. If I’m paying over ten grand for jeans, I expect nothing less than perfection. The men’s collection impressed me with its splashes of colour. A red checked shirt for `11,500, shoes for `19,500 and slim jeans for `11,000 — I loved each piece but the material wasn’t as impressive as that of the

They didn’t treat affluent looking customers better than the jeans and t-shirt wearing crowd. Relax, de-stress and let creativity flow at the relocated Art Loft in Bandra, says Rhea Dhanbhoora
The Art Loft has been around for two years and most people in Bandra already know and love French brother-sister duo Leila and Kevin Tayebaly. Started as a space for art therapy and a range of other activities, it enables participants to take a break from life to explore their artistic side. They’ve recently managed to procure a decent amount of space on Bandra’s Waroda Road, cut off from the noise outside by a large wooden door and a tiled, closed space. On the day we visited, work was still going on, but we could see the long French windows and muted walls of the ‘therapy room.’ It’s a big space, complete with a gallery and exhibition area where they plan to hold a lot more exhibitions and workshops than before. We walked in (and class to distressing pottery workshops and a possibly disturbed!) an art therapy class held by Sounds of Sufi workshop for music lovers, this Leila, who very generously allowed us to take a artsy space has something for everyone. We can’t say much about its décor because it few pictures and explained that although they have opened doors for their art therapy classes, where The Art Loft, 37 Waroda Road, off they are still working on putting finishing Hill Road, Bandra (W) touches to the entire space. coNtact 9819132958/ email: The art therapy includes painting with water contact@theartloft.co.in/ website: colours, which brings harmony between your www.theartloft.co.in thoughts and actions. Tea Trunk It’s the perfect weather for a good cup of tea. That’s why Glynda Alves recommends you order a tin or two from Tea Trunk
There’s pretty much nothing that can make me smile when I just wake up. But, seeing that elephant along with the sentence ‘Made with tender loving care, our teas taste best when shared’ made my day. Perhaps even week. But, that wasn’t the best part — I opened the tins and was engulfed by an invigorating lemon scent, gentle vanilla aroma and a potent whiff of ginger. And that’s what Tea Sommelier Snigdha Manchanda, the founder of Tea Trunk, wants — a happy tea totaller. Snigdha has always been

consumed by her love for tea. Having grown up collecting tea from all over the world, including Russia, Taiwan and Kenya; Snigdha stored more than 100 exotic and rare teas in her father’s old trunk for over a decade which later became the inspiration for the name of her tea company in 2011. She is a trained Tea Taster and a certified Tea Sommelier in 2011 from the Tea Sommelier Academy in Sri Lanka. So, it’s safe to say that this girl knows what she’s talking about when it comes to tea. Having realised the potential of the tea market, she created six handblended signature teas (Rose Oolong, Vanilla, Ginger, Lemon, Moon White and East Himalayan Black Tea), available on her new online tea store. The website is fun (that elephant is so goddamn cute!), easy to navigate and ordering is simple. We tried the vanilla (read the brewing instructions on the tin), lemon and ginger tea. The vanilla (`800 for 15 teabags), which we had
WhAT’s Cooking? with a dash of sugar, is a unique blend of two tea varieties from the north and south of India: the robust Assam and the fragrant Nilgiri. Combined with real vanilla beans, the vanilla tastes so good that you almost feel guilty drinking this dessert tea. The lemon tea (`650 for a tin of 15) is a great pick-me-up and ideal to beat a mid-day slump. The ginger root (`650 for a tin of 15), which shows the adorable elephant all wrapped in a scarf on the tin, claims to sort out everything from a blocked nose to a broken heart. A warming cup of this is like a hug from the inside. Another thing we like about the tea is that they recommend what you can eat with it. Tea Trunk knows us well. Frankly, these teas are a little expensive to make it a daily affair but the cute tin makes it an ideal gift or a treat for yourself. The flavours are subtle and worth trying out. And yes, I know Tea Trunk recommends sharing. But, I’m not going to. Get your own tin!

Five things you love about Mumbai? Four people who come for my show. And, one glass of Nasik wine. Five things you’d change about the city? Nothing. All the negatives of our great city are positive. Flooding turns us into Europe — S.V. Road becomes South Venice road. Potholes finance the axle repairman’s livelihood — he can send his kids to Harvard with the money he makes. Traffic gives us moments of stillness — to direct our inner Buddha. Illegal immigrants remind us that you can buy Chetan Bhagat’s new novel for cheaper at traffic signals. Pollution makes our lungs stronger, so strong that we could survive underwater when the tsunami comes. One person you’d like to import into the city and why? Any Bangladeshi. I’m a North Indian so I need the ire against my people directed toward someone else. One person you’d like to export. Why and where? The man/woman who started Micromax phones. To China. It'll be ironic for him/her to meet the place his/her phones originate from. Funniest Mumbai moment. I once stopped a man from committing suicide at Worli Sea Face. When things got out of control, I called the cops. Most of them were super but, one kept insisting that the man trying to commit suicide was my gay partner. I was like, even if I were gay I don't think I'd be so bad at being gay that I'd drive my partner to kill himself! Hottest person in Mumbai Shahrukh Khan in those ganjee ads. Nifty Crosses 5900
NSE India: CNX Nifty — Daily Market Report for: Thursday (July 12, 2013) (Based on the activity of the previous trading day) by Dominic Rebello
REVIEW OF THE PREVIOUS DAY: The Nifty rose substantially on Thursday (July 11, 2013) a net 118.40 points (2.04%) and closed at the 5935 point level. The market opened up with a gap at the 5894 points level on positive global cues. It then declined by a few points and registered the day’s low at the 5887 points level at 9.16 a.m. The index then rose sharply and turned into a range bound movement until 12.00 p.m. It then rose further and registered the day’s high at the 5948 points level at 12.14 p.m. The market then turned into a range bound movement until closing at the day. The Nifty remained above its previous close throughout the session, moved in a range of 61 points and closed above the psychologically important 5900 points level. Sentiment was extremely bullish and amongst the 50 Nifty stocks 46 were gainers, while just 4 stocks closed in the red. All the sectoral indices barring consumer durables closed in the green. Heavy buying was witnessed in banking, realty, capital goods and oil & gas stocks. TECHNICAL ANALYSIS: Volume: Volume (Qty shares) decreased 6.04%. This change is small and indicates a moderate participation by investors. Market Breadth: Overall Market Breadth on the NSE was positive. Amongst all the traded stocks, 864 were gainers, 487 were losers and 58 remained unchanged. Slow Stochastic Indicator: The Slow Stochastic Oscillator has risen and has entered the over-bought zone. The Slow K line in the Stochastic Oscillator has risen above the slow D line (positive and a buy signal).
RSI Indicator: The RSI is above the 40 level and is now rising (positive if it continues).
MACD Indicator: The MACD is below zero but is now rising (positive if it continues). It is above its 9-day Average (positive).
ADX Indicator & DI Lines: The +DI line is above the –DI line and both lines are diverging (positive if it continues). The ADX is flat while the Market Index is rising. No signal here.
Support Levels: For short-term traders the immediate main support is at the 5581 points level. The next support is at the 5478 points level. Resistance Levels The immediate main resistance is at the 5965 points level. The next resistance is at the 6108 points level.
Pivot Point Analysis: For intra-day traders the support and resistance levels are calculated according to the pivot point theory and are: Pivot point = 5924 (This is the level where the trend is likely to change during intra-day). Support (1) = 5899; Support (2) = 5863; Resistance (1) = 5960; Resistance (2) = 5985.
OUTLOOK FOR TODAY:
On Japanese candlestick patterns the index has formed a long white candle. The body of this candle is above and outside the body of the previous candle indicating range expansion and acceleration. This is positive. Further, the index has crossed above the 5 and 200 day’s moving averages. The index is now above the 5, 15, 25 and 200 days moving averages and all the four averages are rising. Moreover, the velocity parameters which were neutrally trended have now again turned positive. All these indicate a positive bias and the possibility of a further up move unfolding. Incidentally, the index is approaching a major resistance level at the 5965 points level. There is a possibility that the index could find some resistance there. However, if it crosses above it then a further rise can be expected. Investors are advised to hold long positions.
Work with strict stop losses on all positions
MOVING AVERAGES (TREND INDICATORS) The index: Has crossed above its 5-day average (at 5858) Positive. Is above its 15-day average (at 5775) Positive. Is above its 25-day average (at 5783) Positive. Has crossed above its 200-day average (at 5836) Positive.
Overall Market Strength/Weakness: The indicators and oscillators discussed here are indicating a strong market with a positive bias. IIB’s Q1FY13 results were in line with our/street estimates at the NII level (up 40% YoY to Rs 6.8bn), while PAT came in higher (up 38% YoY to Rs 3.3bn) driven by trading profits. NIMs remained stable as lower cost of funds (despite high deposit costs) offset the pressure on lending yields. Asset quality was stable (even as GNPLs in the CV portfolio rose marginally) and the provision coverage increased QoQ due to floating provisions of Rs 500mn. SA traction continued in Q1 with 12% growth QoQ. We maintain BUY and roll over to Sep’14 PT of Rs 575/sh (from Rs 525/sh earlier). Other income growth strong; asset quality healthy: Total non-interest income grew by 48% YoY to Rs 4.7bn driven by trading profits of Rs 1.05bn; however, core fee income growth moderated to 31% YoY. GNPLs increased by 3bps QoQ to 1.06% due to higher GNPLs in the CV segment (up 16bps QoQ to 1.17%; Fig 8); however, NNPLs declined QoQ as floating provisions of ~Rs 500mn were adjusted against NPLs. IIB intends to utilise trading profits to increase its provision coverage further. Strong earnings growth to support premium valuations: We expect a 27% EPS CAGR over FY13-FY15 driven by strong advances growth and stable asset quality. In our view, the bank’s premium valuations (3x/18.7x FY14 BV/EPS) would sustain given strong earnings visibility and robust asset quality.
ICICI Direct calls a ‘Buy’ on Jubilant Life Sciences CMP: Rs. 122 Target Rs. 162
Jubilant is one of the few stocks in the pharma space, which is negatively impacted by rupee depreciation due to huge foreign currency denominated loans. As on March 31, 2013, it has debt of around Rs 3788 crore, which includes foreign debt of US$426 million and rupee debt swapped into US$ to the tune of US$202 million. According to the management, every one rupee depreciation vis-à-vis the US$ will benefit the company to the tune of ~Rs 12-15 crore at the EBITDA level. However, it needs to book MTM loss of Rs 40-45 crore on forex debt. We are cutting our target price to Rs 162 from Rs 234 on the back of two reasons 1) unfavourable rupee and 2) China imposing anti dumping duty on Pyridine. From our last recommendation, the INR has depreciated around 10% vis-à-vis the US$ and the stock has declined 26%. We now value the stock at 3.8x FY15E EV/EBITDA, i.e. ~70% discount to Divi’s. What if rupee stays at current level? If the rupee stays at the current level of Rs 61 per dollar, the debt will get inflated by around Rs 300 crore from the levels of March 2013.

fter falling for three consecutive months WPI inflation is now facing upside risks. “Our analysis shows that if the rupee averages Rs 58 per US$ in 2013-14, average WPI inflation in 2013-14 could rise to 6.0 % compared to our baseline call of 5.3 %. This leaves little room for monetary easing despite the sharp slowdown in GDP growth” says Crisil Research. The fall of the rupee by nearly 12 % since the beginning of May, 2013 has raised the rupee price of crude oil and will get reflected in higher inflation of internationally-linked fuels such as petrol. The rupee’s weakness has also increased under-recoveries in diesel to Rs 10 per litre (as of July
8th) from only Rs 2.50 per litre in April. If the rupee remains at current levels, the monthly diesel price hike will have to continue throughout 2013-14. In addition, keeping in mind the fiscal consolidation agenda, the pressure to hike prices of other administered fuels such as LPG will also rise. Input costs, particularly those of imported raw materials, have risen significantly. As firms pass-through at least some of these cost increases to consumers, core inflation - measured by CRISIL Core Inflation Indicator – will begin to rise again. Therefore, unless the rupee appreciates swiftly from its current levels, the lowest point in WPI inflation may now be behind us. This article analyses the evolving
Infosys Results Today By A Business Reporter
T
oday will be Infosy’s first result announcement after N R Narayana Murthy returned to the helm of affairs as its executive chairman. Already the company’s shares have risen over 4 % since his return in June. However, what is announced today will majorly influence the company’s stock price and the sector pricing as a whole going forward. But analysts do not expect any fireworks. The company had already forecast its revenues to grow in the range of 6-10% for 2013-14
much below the industry estimate of 12-14%. So the first quarter results would be similarly in line. Says Rumit Dugar, Indian IT and Telecoms Analyst, Religare Institutional Research “We expect Infosys to deliver a muted sequential US$ revenue growth and expect margins to remain flat. The focus will firmly remain on their FY14 outlook which currently stands at 6%-10% US$ revenue growth. While demand environment remains mixed and could prompt some tightening of the band, we don’t expect cut to the lower end of the guidance range.”
inflation dynamics in India by separating the noise, signal, and administrative price components of inflation. Wholesale price-based inflation (WPI) fell sharply within a short span of three months – to 4.7 % in May from 7.3 % in February. The recent sharp depreciation of the rupee has, however, once again raised concerns over the future trajectory of inflation. Will inflation go up again sharply? Is the lowest point of inflation behind us now? Will demand-side pressures on inflation rise again? In insight, Crisil assess the inflation trajectory in coming months by separating inflation into two components: noise and signal. ‘Noise’ in inflation comprises those prices that tend to be highly volatile and whose impact on inflation is usually transitory. ‘Signal’ reflects the demandside pressure on prices and provides an indication of the likely inflation path ahead. Noise could arise due to two factors – first, the impact of temporary factors that are hard to predict such as supply disruptions on prices of food articles, volatility in currency and movements in international crude and commodity prices. Second, changes in administered prices that are set by the government such as prices of certain food grains and fuels; such as diesel, coal, kerosene etc. As price increases in these articles are regulated by the government, they do not reflect demand and supply forces in the economy. Like other noise elements, administered price increases are not indicative of the underlying pressures on prices.
Airtel, DoT To Slug It Out In Court By A Business Reporter
E
xpressing shock and disappointment, telecom major Bharti Airtel has said it will approach court against a Rs 650 crore penalty notice imposed by the Department of Telecom for alleged violation of roaming norms. “Bharti Airtel is shocked and disappointed to receive a demand notice of Rs. 650 crore from the DoT pertaining to the service of Subscriber Local Dialling to its subscribers between 2002 and 2005,” the company said in a statement. DoT had found that Airtel had
routed national and international calls to its roaming subscribers as local calls, even after being told to stop the service in 2003, causing losses to the government exchequer and state-run Bharat Sanchar Nigam Ltd in 13 service areas. Telecom Minister Kapil Sibal approved the penalty amount proposed by DoT on the company at the rate of Rs 50 crore per service area. Airtel said the Rs 650 crore penalty is devoid of any merit and has no justification both on facts and in law. “We are disappointed that DoT, which has the bounden duty to act rationally, has thought it fit to issue
such a baseless penalty order, leaving us with no choice but to litigate,” the company said. The total revenue generated by the SLD service was a few lakh rupees and the DoT was aware of this fact, Airtel said. The regulator had found this service to be customer friendly and in compliance of the licence conditions, the company said. “Yet strangely, without as much as giving us a proper hearing, the DoT has after eight years issued a demand notice of Rs 650 crore in complete disregard of the natural process of justice,” the company said.
Rising Raw Material Cost Threatens Corporates In Asia Pacific Region By A Business Reporter

BUSINESS
ising price of raw materials and high taxation have emerged as biggest threats to corporates in the Asia Pacific region, says a survey. According to Lloyd’s Risk Index 2013, Asia Pacific executives termed currency fluctuation, inflation, loss of customers/cancelled orders as the next three top risks facing their organisations. When the study was last conducted in 2011, price of material inputs ranked 12th on executives’ list of risk concerns, the index noted. Talent and skills shortage was the prime
concern for corporate houses in 2011. “The price of raw materials is seen as the top risk, reflecting the importance of manufacturing to the region, and the rising cost of materials across a range of sectors. It has soared up the risk index ranking from 12th to 1st place in the last two years,” the survey noted. The risk index surveyed 558 executives across the world during April and May. Respondents were questioned about 50 risks across five categories— business, strategic and economic; regulatory and market; political, crime and security; environmental and health and natural
hazards. “With costs of many raw materials rising, businesses in the Asia Pacific region are understandably concerned about managing this expenditure. Yet the danger is that an emphasis on near-term, operational issues comes at the expense of significant, strategic decisions that have previously exercised business leaders,” Lloyd’s CEO Richard Ward said. “With the timetable for global economic recovery likely to be much longer than we hoped, a focus on long-term sustainability and effective risk management should be a priority for boards across the world,” he added.
BUSINESS BRIEFS Power, Pharma, Banks & Textiles To Lead Q1 Earnings Momentum
During the June quarter, “we expect Power, Pharma Banks and Textiles sectors to show profit growths of 29%, 11%, 7% and 96% YoY respectively” forecast Karvy Stock Broking. According to it ; Capacity additions, increased tariffs, lower base of last year should drive the Power sector’s growth. New product launches, market share ramp-up and Rupee depreciation should drive the Pharma sector’s PAT growth. Banks’ profit growth is driven by private sector banks’ profitability growth. Earnings growth in Textiles sector is skewed. Cyclicals including Infrastructure, Cement, Capital Goods and Automobiles would report a YoY earnings decline owing to slower economic growth, policy paralysis, high interest rate and higher input cost. Key sectors showing QoQ uptrend are Oil & Gas (+6%) and Real Estate (+5%). Key sectors with QoQ earnings downtrend are Auto (-34%), Capital Goods (-74%), Infrastructure (-20%), Pharmaceuticals (-7%), Power (-32%) and Textiles (-9%).

Under these rules every listed public sector company has to maintain a public shareholding of atleast 10 % of the total paid up equity capital.

rom his first movie Kalicharan in 1976, Subhash Ghai has believed in his instincts to make the decisions that saw his debut film become a blockbuster. Over time, the instincts were gradually replaced by a strong confidence in mastered skills that continued to drive him towards acclaim. Karma, Kalicharan, Ram Lakhan, Saudagar, Pardes, Vidhata, Karz and Taal are some of his subsequent films which have made it through the annals of Bollywood. The master filmmaker is now coming out with his new directorial film – Kaanchi which is releasing in August this year. Ghai, who is known for launching new faces and big dramas,
is back in his element. Kaanchi, a musical thriller with a love backdrop has a new star cast with veteran actor Rishi Kapoor playing the villain in the film and Mithun also playing an important role. We dug up information on Ghai’s new film Kaanchi and found out that it is the story of a 17-year old girl’s journey from the mountains to the city. Ghai admits, “Yes, it is the story of a young, innocent girl’s journey from the mountains to the city. She’s a girl on a mission.” Ghai is thrilled about returning to direction after 4 years. “I di-

Now, I am directing again.” As a filmmaker, Ghai introduced tons of fresh talent and groomed each of them, making their journey to stardom easier. No wonder he is also known as a godfather and great teacher to many in Bollywood. This is probably why Ghai set up Whistling Woods in 2006, an international quality film and television training institute. Sharing his thoughts Ghai insists that, “We must
share our knowledge and experience with the younger generation of film makers and keep learning from contemporary cinema to keep pace with time and values “. The grandeur of Ghai’s endeavor and the delight he took in extravagant storytelling, earned him the sobriquet ‘Showman.’ His last few films like Yuvraaj, Trimurti, Yaadein, and Black and White may have not done well, but it would be foolish to write him off, because there are a lot of would-be performers out there who need their sparkle

Let’s start with your journey.. I started singing at the age of 2 and a half and although I belong to a Marwari family, my mum did everything she could to train me. I have studied classical music under Pandit Satyanarayan Mishra and have also learnt playback singing and voice culture. My journey has been very exciting so far with me having sung over 78 songs. You have done a lot of Social Work with ‘Dil se Dil tak’ from a very young age? Yes, my brother and I do shows for heart patients and till now we have donated Rs. 2.88 crores for 587 operations. There are 623 more kids in my waiting list and I am trying my best to help them out. I started this mission 13 years ago but never thought that it would go so far.
How was your start in Kalyanji - Anandji’s group? I was already a part of Anandji uncle’s Little Stars group from the age of four. I travelled across the world with him and got to learn a lot.
How did Bollywood respond to your first major assignments in Damadamm and Ek Tha Tiger? Himesh sir made me sing title track of Damadamm. I got ‘Lapataa’ from Ek Tha Tiger only because of Salman sir. One day he told me that I would soon be singing for Yashraj films. A month later, I got a call from Sohail Sen. I was so excited when I came to know the song was for Ek Tha Tiger.
Your song from Aashiqui 2 became a rage. How did you feel? I was excited when I was called to sing for Aashiqui 2. There
was a big responsibility on the music team, because the music of Aashiqui 1 was a super hit and we had to match those standards. I was aware that this project would be something big, but never knew that it would create history. I am thankful to everyone involved. How many languages do you sing in? I sing in 17 languages. Actually wherever I perform I sing in the local language. Like when I went to Malaysia I sang in Malay, Arabic in Dubai, Kiswahili in Kenya, English in London, Tamil in Chennai and so on. What do you have lined up for the future? I have recorded 78 songs which are lined up for release this year and early next year.

All of which raises the question of a film star’s right to privacy. There is a point of view that says a public figure is answerable to society, which is the price to pay for fame, and another that believes there is limit to how much prying that can be done into the lives of stars. Then again, the stars who want to be left alone, find ways of guarding their privacy and there are those who just pretend to be bothered by the constant scrutiny, but surreptitiously feed it. As for consumers of this peephole journalism, it is of course a safe form of voyeurism. They get their gossip fix, without experiencing any of the discomfort or embarrassment the celebrity target would go through, especially if he/she has not asked for it. As for the rest, if you don’t care to know, turn the page or change the channel. Frankly, if Shah Rukh Khan had ignored all the speculation and glared down any impertinent questions, that would have been fine too. The world would have moved on in any case.

Number 11 batsman and debutant Ashton Agar stands as a wall against the English attack, scores a bristling 98; shares record 163 run stand for last wicket with Phil Hughes
THE ‘NEW’ WIZARD FOR OZ SPORTS
29
Australia's Ashton Agar smiles as he reaches a historic 50 on the second day of the opening Ashes series cricket match against England at the Trent Bridge cricket ground, Nottingham.
T
RENTBRIDGE: Number 11 Ashton Agar made an astonishing record 98 on debut as Australia seized control of the first Ashes Test against England on a wildly fluctuating second day at Trent Bridge on Thursday. Ashton Agar shared a record last-wicket partnership of 163 with Phil Hughes to give Australia a lead of 65 and England did well through skipper Alastair Cook and Kevin Pietersen to score 80 for two in their second essay in the first Ashes Test. England had dominated the first part of morning session when Australia collapsed to 117 for nine before 19-year-old Agar and Hughes changed the course of the match. Agar’s innings was the highest score by a number 11 in Tests and Hughes made an unbeaten 81. England fast bowler James Anderson earlier produced an inspired display of swing bowling as Australia, after resuming on 75 for four, lost five wickets for nine runs and the hosts looked poised to lead by around a hundred on first innings. Steve Smith became the
first player to pass fifty in the match and had moved on to 53 when he tried to drive Anderson through extra cover and nicked a catch to wicketkeeper Matt Prior, sparking a flurry of wickets. Graeme Swann produced a ripping offbreak to bowl Brad Haddin for one, Peter Siddle edged Anderson through to Prior and Mitchell Starc went the same way for a duck. James Pattinson was trapped lbw by Swann for two and Australia were reeling. But Agar showed great composure in only his 11th first-class match, driving Swann over long-off for six and pulling Steven Finn for two fours as the last-wicket pair brought up their fifty partnership off only 60 balls. Agar reached his half century with a two off Anderson, getting to the landmark off exactly 50 balls including one six and seven fours. He dispatched Swann for another six over long-on and Hughes joined the party after passing his fifty, smashing Stuart Broad for three fours in an over. England took the extra half hour before lunch but they could not capture the final
wicket, Agar and Hughes bringing up their century partnership shortly before the interval. The pair continued to flay the England attack in the afternoon and Agar, having passed the previous highest score by a number 11 in a Test of 95, looked poised to reach his century. But he heaved Broad into the leg-side and was caught by Swann on the mid-wicket boundary before leaving the field to a standing ovation. England openers Alastair Cook and Joe Root played cautiously in the face of tight Australian bowling and Root, on five, was unlucky to flick Starc through to wicketkeeper Brad Haddin down the leg-side. Jonathan Trott was then trapped lbw by Starc’s next delivery, sent back to the pavilion following an umpire referral after being initially given not out. Brief scores: England 215 and 80/2 (43 overs) KP Pietersen 35* (98) AN Cook 37* (130) vs Australia 280 ( A Agar 98, S Smith 53, P Hughes n.o.81; J Anderson 5/85)
Warne to be inducted into ICC Cricket Hall of Fame D
UBAI: Former Australia spinner Shane Warne will be inducted into the ICC Cricket Hall of Fame on July 19 during the tea interval of the second Ashes Test between England and Australia at Lord’s, ICC announced. Warne becomes the 69th male member of the Hall of Fame, and joins fellow 2012-13 inductees Brian Lara of the West Indies, England’s Enid Bakewell and former Australia team-mate Glenn McGrath in being recognised by the ICC and the living members of the Hall of Fame. Lara and Bakewell were inducted last year at the ICC Awards in Colombo in September, and McGrath during the Sydney Test between Australia and Sri Lanka in January this year. Warne represented Australia in 145 Tests between 1992 and 2007, claiming 708 Test wick-
ets at an average of 25.41. He was the first cricketer to reach 700 Test scalps. He also played in 194 ODIs, claiming 293 wickets at an average of 25.73 and was part of the Australia side that won the World Cup in 1999 at Lord’s against Pakistan alongside fellow Hall of Famers Glenn McGrath and Steve Waugh. His performance at the match saw him named Player of the Final after he concluded the game with match figures of 9-1-33-4. "I'm very honoured and proud to be announced as an inductee into the ICC Hall of Fame later this month and I’d like to thank the voting academy very much for even considering me. I'm looking forward to celebrating my induction with my friends and family in front of the crowd at Lord’s during the second Ashes Test," Warne said.
Agar tipped for Ashes success
NOTTINGHAM: Australia coach Darren Lehmann forecast "outstanding" teenage sensation Ashton Agar would come into the game "more and more" after the leftarm spinner was handed a shock Test debut in the Ashes opener at Trent Bridge. Agar, a 19-year-old Western Australia left-arm spinner, was only brought to England originally as a "development player" for the first two Ashes Tests. But in a dramatic move involving Australia chairman of selectors John Inverarity, on tour selector and wicketkeeping great Rodney Marsh and Lehmann himself, Agar was preferred Wednesday instead of offspinner Nathan Lyon, a veteran of 22 Tests. The stunning selection did not leak from the tourists' camp until fast bowling great Glenn McGrath was seen handing Agar his 'Baggy Green' cap, in a traditional presentation ceremony for Australia players making a Test debut, shortly before Wednesday's toss. "The boys were good, they knew two days ago so we just had to see if they could keep it quiet and they did," Lehmann, appointed only just over a fortnight before this match after South African Mickey Arthur was sacked as Australia coach, said. "For a 19-year-old kid, it's great," added Lehmann, a former Australia batsman. "He's excited and you saw him when Glenn McGrath presented him with his cap, he had a tear in his eye and it's a big moment for him." Just as England believe off-spinner Graeme Swann can play a key role against Australia because his stock ball turns away from left-handed batsmen, of whom there are several in the tourists' line-up, so the fact England's top-order is mainly made up of right-handers helped boost Agar's case.

ONT-SAINT-MICHEL, FRANCE: Tour de France leader Chris Froome came to the defence of former team-mate Mark Cavendish on Wednesday and hit out at the spectator who threw urine at the British sprint star. The incident happened during the 11th stage of the Tour de France, a 33-kilometre individual time-trial between Avranches and Mont-Saint-Michel in Normandy. It came a day after he was blamed for a collision that sent Argos rider Tom Veelers crashing to the ground in Saint-Malo. Cavendish did not talk to the media after the race, but Froome, speaking after holding on to the yellow jersey, said what happened "ruined" what has otherwise been a wonderful atmosphere throughout the 100th staging of the sport's greatest race. "It is disappointing to hear about one individual like that," he said. "That's one of the beauties of our sport. Anyone can come and watch at the side of the road and enjoy the excitement and really get close to the top riders in the world. Mark is one of the big characters in the sport, and some people love him, some people hate him. But to do something disrespectful like that, that's really sad. It ruins the whole atmosphere." Earlier in the day, Omega Pharma team CEO Patrick Lefevere confirmed to AFP that Cavendish had been insulted by spectators and attacked by one individual on the race route. "Probably some spectators were

"Mark is not upset, but he is really disappointed because he thinks he didn't deserve this. The cycling public is known for being very fair, we have no hooligans, but there are thousands and thousands of people on the roads and not everybody is a gentleman," the Belgian added.
Cavendish escaped without punishment following Tuesday's clash with Veelers, which happened during a sprint for the line won by German rider Marcel Kittel. Veelers pinned the blame on the British champion, and an anxious Cavendish became embroiled in a spat with one journalist after the finish to Tuesday's stage, snatching away his dictaphone after being asked if he felt the crash was his fault. However, Cavendish later called
Soundarajan gets Sports Ministry assistance for NIS course
N
EW DELHI: Taking note of the "indigent circumstances" in which former athlete Santhi Soundarajan has been living, the Sports Ministry sanctioned an assistance of Rs 60,500 to fund her NIS Diploma Course at the SAI Centre in Bengalore. "Minister of State (Independent Charge) for Youth Affairs & Sports Shri Jitendra Singh has approved financial assistance of Rs. 60,500 from National Welfare Fund for Sportspersons to Ms. Santhi Soundarajan, former athlete, who had won a silver medal in Asian Games 2006 at Doha, which was later withdrawn, as she was not found eligible to compete in female category because of female hyperandrogenism," the Sports Ministry said in a statement. Soundarajan's plight came to fore after media reports appeared of her working as a daily wager at a brick kiln in Tamil Nadu. Soundarajan later applied for a coaching course at the SAI Centre in Bangalore. "Ms. Santhi Soundarajan has applied for pursuing a regular National Institute of Sports (NIS) Diploma in coaching at Bengaluru Centre of Sports Authority of India (SAI). For Soundarajan, it has been a tumultuous journey so far. The middle-distance runner became the cynosure of all eyes when she won a silver medal in the 2006 Doha Asian Games. But a failed gender test a few months later, and the athlete was immediately stripped of her achievement. Last year, the country woke up to the news of the 26-year-old slogging eight hours under scorching heat to earn a measly sum of Rs 200 per day as a labourer. The Union government took cognisance of the matter and promised Soundarajan a seat at the NIS, Patiala even though she was banned by the Athletics Federation of India from competing in national and international competitions.

Veelers to apologise and Lefevere hopes that can be the end of the matter. "He apologised already yesterday (Tuesday) on Twitter and on the phone," he said. "If you don't agree you don't take the telephone, but he (Veelers) took the telephone. Today is a time-trial so you don't have the time but maybe tomorrow (Thursday) he can have a little handshake with Tom Veelers if he agrees to do it and then this case has to be closed."
Badami, D’Souza rally to enter last 8 of snooker tourney
MUMBAI: Local cueists Kabil Badami of Bombay Gymkhana and Rovin D'Souza of P J Hindu Gymkhana recorded hard-fought 32 victories to enter the quarterfinals of the NSCI-BSAM All India Under-25 Snooker Challenge 1. Badami, who came through the round robin untroubled, endured a late challenge before stopping city rival Pawan Kohli of Khar Gymkhana with a 60-28, 73-13, 53-63, 29-54, 59-35 win at the National Sports Club of India here. Badami got off to a good start with a 2-0 lead that included a break of 42 in the opening frame. But Kohli fought back brilliantly to force the decider before bowing out. D'Souza, a former Maharashtra state junior champion, halted the winning streak of Nimish Kulkarni of Pune's PYC Hindu Gymkhana with a 30-62, 61-23, 62-38, 27-55, 68-0 win. D'Souza rallied after losing the opening frame to a 2-1 lead but Kulkarni kept his hopes alive by snatching the crucial fourth frame. A break of 44 by D'Souza proved decisive in the fifth and final frame, leaving his rival with no chance to recover. Laxman Rawat and former Maharashtra state junior champion Jaiveer Dingra of P J Hindu Gymkhana were the other notable players to make the last eight.

BANGALORE: National team striker Robin Singh, who made his India debut at the Nehru Cup last year, signed a two-year contract with JSW Sports, a Bangalore-based I-League Club. "There was more than one reason to sign for this club. It's going to be a young squad and the way they are going about setting up the club is very professional. That apart, I have been to Bangalore to attend camps and I enjoy the vibe of the city. I am really excited to be part of this team," Singh said. The young striker, who was named among the 30 probables by national coach Wim Kovermans for the upcoming friendly against Tajikistan, has had a promising run since graduating from the TFA and is touted as a player who will make it big.

ORT OF SPAIN: India benefited immensely after Sri Lanka’s middle and lower-order batsmen committed harakiri, which saw the team lose eight wickets for just 30 runs before being bundled out for 201 in the final of the Tri-nation ODI series here today. Sent into bat, Sri Lanka were sitting pretty at 171 for two in the 38th over, but lack of application on part of their batsmen saw them being packed off with seven balls left in their innings. Ravindra Jadeja was the most successful Indian bowlers returning figures of 4/24 while there were two wickets apiece for Bhuvneshwar Kumar, Ishant Sharma and Ravichandran Ashwin. Earlier, the in-from Bhuvneshwar made use of seaming conditions to send back Upul Tharanga and Mahela Jayawardene. Incidentally, the duo had punished India with a double-century partnership in the match that Bhuvneshwar was dropped. Sri Lanka then rode on Kumar Sangakkara (71) and Lahiru Thirimanne’s 122-run part-
nership for the third wicket to stage a fightback before their innings disintegrated largely due to some mindless batting. Thirimanne scored 46 off 72 balls while Sangakkara got his runs in 100 deliveries. From a comfortable position with about 12 overs to go, Sri Lanka were left licking their wounds at 193 for seven in the 46th over when skipper Angelo Mathews got out. None of the last six batsmen could reach double figures. Sri Lanka made a cautious start on a pitch that was not conducive for stroke-play. But after reaching 27 in the seventh over, the islanders suffered their first blow when Bhuvneshwar changed his angle to induce an inside edge from Upul Tharanga. Dhoni did the rest behind the stumps. The ever-consistent Bhuvneshwar was at it again, in the 14th over, as he removed Jayawardene with an innocuous delivery that moved a bit on landing at the Queen’s Park Oval. Losing the experienced Jayawardene so early into the innings was a big blow for the Kumar Sangakkara attempts an unorthodox shot.
Virat is an aggressive captain in Ganguly mould: Coach Sharma N
EW DELHI: Noted coach Rajkumar Sharma, who played a pivotal role in shaping up Virat Kohli's career, feels that his ward's aggressive captaincy resembles a lot with Sourav Ganguly's methods but insisted that he should also learn the ropes from current skipper Mahendra Singh Dhoni. "Virat is an aggressive player by nature. He is someone who always likes to attack and take the opposition head on which is also reflected in his captaincy. For me, Virat belongs to the Sourav Ganguly 'School of captaincy' which is to attack the opposition from the word 'go'," Sharma told PTI during an interaction. Just like any concerned coach, Sharma is also aware that aggression should be blended with caution which is the hallmark of a good captain. "I am all for aggressive captaincy but I believe that he should also know the line that one shouldn't overstep. If he does that, then I come into picture to make him aware," Sharma analysed. Kohli, in his maiden stint as India captain has led the team to the final of the Tri-Series
in West Indies but his coach doesn't want his ward to be pushed into the hot seat. "Mahendra Singh Dhoni is an exceptional captain and I believe that Virat still has a lot to learn from Dhoni although no two persons are the same and their thought process is bound to be different. I feel that till Dhoni is playing, he is the best man to lead India and Virat will certainly get it when his turn comes around," Sharma opined. However the former first-class cricketer doesn't believe that age should be a criteria while selecting a captain. "Age has got nothing do with captaincy. It's more about how good one is when it comes to analysing match situation, reacting to it and also about leading from the front with good performances." The coach also believes Virat has come of age in the past couple of years and is more confident about his game. "He had some problems but that was way back in 2008 during IPL-I. After that, he understood his mistakes and also worked hard on his game. He has matured a lot and that's for everyone to see," Sharma concluded.
BEIJING: China has cut down the budget for its 12th National Games by a hefty 78 per cent as the once booming economy has slowed down with no respite insight. The total funding for the 12th National Games will be reduced to no more than 800 million yuan (USD 130 million) which is a huge drop of 78 per cent than the previous budget which was 3.6 billion Yuan (USD 590 million), said the Games' organising committee. China in the past hosted national and international sports events including the Beijing Olympics with lavish settings and spending. But now the era of high spending on lavish events appears to be a thing of past.

Lorgat in CSA could affect India-S Africa cricket ties
JOHANNESBURG: A top contender for the CEO's post in Cricket South Africa, Haroon Lorgat's appointment could end up creating a rift between the CSA and the BCCI, which is opposed to the former ICC official joining here. Lorgat is among the three contenders short-listed by CSA for the post and technically the favourite given his administrative experience in international cricket but the BCCI's opposition could go against him. There have been reports that the Indian Cricket Board has threatened to pull out of the upcoming tour to South Africa if the former ICC CEO is appointed as CSA's CEO.
