Lalbaugcha Raja Karyakarta assaults Byculla cop

O
ne year after a lady constable deployed in front of the famous Lalbaugcha Raja idol to control the crowd, was slapped by a volunteer when she tried to intervene in an altercation, another case of cop-bashing has been reported this year from the Lalbaugcha Raja Ustav Mandal on Friday evening. According to sources from Byculla Police station, the incident occurred when Assistant Police Inspector (API) Somling Kumthale attached to the Byculla Police Station was on-duty as a part of the extra force deployed at the Lalbaugcha Raja to man the crowd. When a 17-year-old unidentified volunteer from the Mandal allegedly tried to forcefully bring in a few devotees from the VIP gate, meant only for the ministers, actors and other bigwigs, API Kumthale objected and asked the volunteer to follow the queue meant for devotees.
Police tightened security in the premises of Lalbaugcha Raja after the cop bashing on Friday evening. “The volunteer, whose identity is being investigated, immediately started hitting and punching the cop and abused him. Looking at the commotion, other policemen deployed at the spot rushed to rescue the API and called in the mandal officials,” sources said. Confirming the incident,

Bun maska and Irani chai
IN 1890 (or thereabouts) when a famine broke out in the provinces of Yezd and Kerman in Iran, bordering then undivided India, at last Haji Mohammed Showghi Yezdi and thousands of his fellow Iranis, turned their faces towards Hindustan. They crossed the border at Mirjaveh, and without a pie in their pockets, trudged for nearly five months over land both hospitable and hostile, over lush vegetation and cruel desert, travelling in caravans that were sometimes looted by the peoples they came across, sometimes not. The Haji came through Quetta and groups began to break off as some stayed back in Karachi, some went off to Lahore. But he travelled on doggedly, coming through Attari-Wagah, going to Amritsar, passing Delhi, heading towards Bombay where family waited. Walking, walking, more walking… towards the realisation of the dream of a better life. That dream did not fail him. For Haji Mohammed became part of the social and cultural landscape in a way that he could never have imagined. He and thousands of his fellow men from Iran gave this city (and Pune and Hyderabad as well), its Irani cafes, bun maska and its utterly addictive Irani chai, made through a careful process that never fails to satisfy. This evening at the Islam Gymkhana, there is to be the showing of a documentary, Café Irani Chai, the eponymous title clear indication of the subject. It has been made by Dr. Mansoor Showghi Yezdi, the Haji’s grandson, and he describes it as a complete labour of love, a thank you to his countrymen for the welcome that his forefathers received. “I love my country”, he says, in a voice that quivers with emotion. “We Iranis cannot do enough for Bharata Mata”. The documentary is also a fine example of the complete integration that Iranis feel among their own community, whether they are Zoroastrians or Muslims. This is something that the average customer to these wonderfully recognisable places always misses because there is little to distinguish between them. “People have been coming from Iran for more than a millennium, first the Parsis, then the later waves. “Our forefathers knew there would be a welcome because they were Persian after all”, says Mansoor. The wonderful thing is that there was no disappointment. The welcome was there, not just from fellow Iranis but from India as well. And so the Irani cafes were set up, selling what they knew to make best – tea! Mansoor himself says that his father, Haji Mirza Habibul-

lah sold tea in an Irani ketli around Apollo Bunder before he and his brothers got into the canteen business at several cinemas (Plaza, Dharti, Citylight, and Paradise) and street locations like Café Ideal near Radio Club run by his maternal uncle. Mansoor himself got training not just in the running of an Irani café but also in film, for it was while his father, in partnership with the late Dr. V. Shatanram, ran the canteen at Plaza in Dadar, that he developed his fascination for the medium. And both, an awareness of the café culture and the making of a film, have come together in this documentary which could not have come at a better time, when the very existence of these marvelous socio-economic entities are threatened by the pull of real estate prices and the diverging aspirations of young Iranis who don’t see themselves sitting behind counters for the rest of their lives, dispensing chai, biscuits and short eats! As a result, where there were perhaps 1,300 Irani cafes in Bombay in its heyday, around 300 exist now. The picture is slightly better in Hyderabad, where there are perhaps 400 of these establishments, still flourishing. Mansoor says this 28-minute film has taken almost 10 years to bring to fruition. He shot 500 hours of film across Mumbai, Pune and Hyderabad, and also travelled

Merwan & Co. opposite Grant Road Station famous for their mawa cakes, Lucky Hotel and Restaurant in Bandra and their biryani, Sarvi at Nagpada and its seekh kabab. In Pune it is Kyani on East Street and its wonderful Shrewsbury biscuits, Blue Nile for biryani and Chelo kabab and Iranian food, George for rotisserie chicken, Café Vohuman for their cheese omelette and brun maska, Cafe Yezdan at Camp, famous for their bun maska, brun maska and omelettes. The roll call goes on - Dorabjee and Sons famous for their dhansak and salli boti and biryani, Husseini Bakery for their bakery items, especially their brun. In Hyderabad, there is Paradise at Secunderabad, famous worldwide for their biryani, able to seat 5,000 people at a go in their restaurant, New Grand Hyderabad for their food items and Bawarchi, famous for their Chicken Rotisserie and biryani. And every one of them most famous of all for their Irani chai! This evening, the film will be shown and present in the audience will be both Zoroastrians and Muslims, for it is the Iranian Zoroastrian Anjuman of Mumbai which has sponsored it. MSRTC reinstates sacked driver as a peon By Philip Varghese

week after the Bombay High Court directed the Maharashtra State Road Transport Corporation (MSRTC) to reinstate one of their drivers who was sacked after he contracted HIV, the court on Friday, was informed that the driver has been taken into service as a peon. The driver was sacked by the MSRTC in May 2012 on the grounds that he was ‘unfit to work’. He had been working as a driver since 1999 and had told the MSRTC that he was physically weak because of the treatment he was receiving. He requested them to provide him with light work, rather than being asked to drive heavy vehicles. Stating that there was no legal provision for changing the job profile of HIV-positive employees, the transport authority had him removed from service. However, he decided to fight the stigma, and accused the MSRTC of discriminating against him be-

During the hearing on the matter on Friday, Advocate G.S. Hegde, representing the MSRTC in the matter, told the division bench headed by Justice Abhay Oka that obeying the High Court’s remarks in the last hearing, the driver who had challenged his dismissal, had been taken back into service. “The reinstatement is subject to a medical examination and he being found fit for the new job. The necessary medical test has been conducted and report of the tests will be available only on September 26,” Advocate Hegde told the court. ombay High Court yesterday rejected a bail plea by Pune-based businessman Hasan Ali Khan, who is facing charges of money-laundering and stashing huge amounts of black money in foreign banks. Justice RC Chavan rejected Khan’s plea after the prosecution argued that the accused might abscond, tamper with evidence or impede the trial if granted liberty. He is likely to give a detailed order on Sept. 16, reports PTI. Khan has been in jail
since his arrest in 2011. His bail applications have been rejected earlier by the trial court, high court and Supreme Court. Khan, accused of holding US $8 billion in the Union Bank of Switzerland, was arrested in 2011 and his bail plea was rejected in September of that year by Supreme Court. Another bail plea was rejected in October 2012 by a Special Court under the Prevention of Money Laundering Act (PMLA). Khan’s lawyer Amit Desai argued today that the material before the court against
his client did not disclose any connection between the allegations and the proceeds from the crime, as required under PMLA. Desai also argued that there had been a change in the circumstances after the apex court had turned down his bail plea. Khan is also facing allegations of obtaining five passports under different names. He is also under the scanner for alleged terror links, as he is suspected to have laundered money for international arms trader, Adnan Khashoggi.

iding on a wave, the Shiv Sena which had earlier supported Sushma Swaraj as the prime ministerial nominee. However, yesterday the party wholeheartedly decided to stand by Narendra Modi for the coveted post. After the late night conversation, Modi had with Shiv Sena president Uddhav Thackeray, the oldest alliance partner of the Bharatiya Janata Pary (BJP) had already made a U-turn. Sena, the constituent of the NDA, has welcomed BJP’s announcement of Narendra Modi as its prime ministerial candidate, saying that the decision reflected the mood of the people. hief Minister Prithviraj Chavan, while welcoming the Delhi court judgment, has said that after this verdict, nobody will dare to repeat such a horrific and grave crime. Reacting to the court judgment giving the four accused in the gang rape of the Delhi based medical student in December last year, Chavan expressed satisfaction at the order. He said, “The judgment will offer some solace to the victim’s family. The case was disposed of within eight to nine months after the crime was committed. Investors forum to seek legal action against NSEL promoters N
SEL Investors Forum yesterday said it will pursue ‘legal action’ against the promoters of the troubled National Spot Exchange Ltd (NSEL) if they tried to dispose of the assets of the promoter company, which was vehemently denied by Financial Technologies India Ltd. “We will be compelled to take appropriate legal action, including criminal action against the promoters, if they proceed to dispose of any assets owned by the promoter company Financial Technologies (India) Ltd (FTIL) or its promoter Jignesh Shah, pending the settlement of the outstanding defaults,” Forum Secretary Arun Dalmia said in a statement.
Dalmia alleged that the promoters of NSEL are presently in advanced discussion with a prospective investor for the sale of a substantial part of shareholding in FTIL. Any disposition of assets by FTIL in the present circumstances will seriously put at peril recovery of investors’ dues of Rs 5,500 crore. It is absolutely necessary to safeguard and preserve these assets till such time as the outstanding amounts are not paid to the investors, he said. “We deny that there is any such move,” a Financial Technologies spokesperson told PTI. In its fourth default, the crisis-
ridden NSEL on Tuesday announced the disbursal of only Rs 13.45 crore to investors, against the total commitment of Rs 174.72 crore. In the first three pay-out schedules, the exchange had received Rs 120.10 crore from its 24 registered members and recorded a total deficit of Rs 409.56 crore. FTIL holds a controlling stake of 99.9 per cent in NSEL. Given that NSEL contributes to approximately 50-60 per cent of the overall profits of FTIL, it is only natural that its affairs were closely monitored by FTIL. Therefore, FTIL must have been aware of NSEL’s way of functioning, Dalmia said.

His anticipatory bail application was rejected by the sessions court last month. Bafna claims that he was falsely implicated by police and com-
plainant Rizwan Merchant in the case, reports PTI. It is alleged that Bafna had stripped off the beams inside his showroom, which weakened the entire structure, a charge denied by him. The High Court has kept his petition for hearing on September 17. Ten persons were killed in the collapse of the building on June 10 this year.
HC asks Maha to buy food test kits to stop milk adulteration T
aking a serious view of the sale of synthetic milk in Maharashtra, the Bombay High Court yesterday asked the state authorities to immediately appoint a food analyst and procure equipment to ensure that food-testing labs were made fully functional. A bench headed by Justice D Y Chandrachud directed Principal Secretary of Public Health Department and the Commissioner of Food and Drugs Administration (FDA) to convene a meeting on or before October 4 to fix time schedule for appointing food analyst and buying equipment for food testing. The court was hearing a PIL, filed by Pune-based S M Joshi Memorial Association, which said that the FDA had found presence of sodium lauryl ether sulphate (SLES), a carcinogenic substance, in milk samples. The bench further ordered that the entire process of appointing food analyst and procuring food testing equipment should be completed not later than November 30. Disposing of the PIL, the court ordered that the state should file a compliance report with the Registrar in respect of these directions.
The bench further observed that there was no reason to justify the delay in setting up mobile labs in the State. In this regard, the High Court directed the FDA Commissioner to set up mobile labs immediately and also to ensure that they were made fully functional not later than November 30. Jane Cox, petitioner’s lawyer, had earlier contended that of the 15 FDA laboratories in the state, five were non-functional. The bench directed the government to recruit staff for these labs and provide them with adequate equipment. Additional government pleader Samir Patil said the state had already sanctioned six mobile labs. The judges said they should be made functional at the earliest. Cox said that during the raids in 2009, FDA found sorbitol and SLES adulteration for the first time. “The test methods available with the dairies are not equipped to detect these chemicals,” she said, arguing that all the dairies in the state should be equipped with the necessary kits. According to the petitioner, refined Palmolive oil is also used to manufacture synthetic (artificial) milk.

USTICE has been a bit delayed, but it has been done: The judge of the fast-track court trying the ‘Nirbhaya’ gang-rape case has awarded death sentence to the four accused. This was a verdict greeted with satisfaction not only by the family of ‘Nirbhaya’ but also by lakhs of people in Delhi and also across the country. The judge said that the crime committed by the four accused was nothing but a rarest of rare case which deserved a death sentence. The four men had not only committed a crime, but also behaved like monsters with the hapless victim. Perhaps there has never been such a savage rape committed anywhere in the country. The criminals had tortured the girl and mercilessly threw her nude out of the moving bus. The worst brute among the rapists has, however, escaped proper punishment just because he is a juvenile – 17and-a-half-year-old. He is enjoying himself at a reform centre: In three more years he will be out and roaming free. It is only when this monster is also hanged, that justice will be done in the ‘Nirbhaya’ case. There are as many as 30,000 rape cases pending across the country. This shows that the existing rape laws are not being implemented and that many a rapist gets a chance to escape punishment. Establishing hundreds of fast-tracks and taking the legal means may never be undertaken by the government, with the result the rape scenario will become worse with the passing of each day.

UNDERSTAND that the United States is officially celebrating the 50th anniversary of Rev Martin Luther King Jr’s famous speech, ‘I have a dream’. I am specially interested in it because I am the first, also the only foreign correspondent then serving the Press Trust of India at the United Nations (1955-56) to have interviewed Rev King, at some length. I think it was some time in 1956. He had not yet become a celebrity and was more known as a parish priest serving a small black diocese in Montgomery, capital of the southern state of Alabama. He had participated in a civil rights movement and was to undergo a trial. I decided to cover it out of sheer curiosity. My American colleagues at the UN tried to dissuade me saying that as a non-white I might get assaulted and suggested that if I really wanted to go to the southern state I should at least wear a turban!

Very strange...newly laid roads develop potholes! DESPITE relaying roads in posh Bandra, Khar and Santacruz areas, the newly laid roads develop potholes and that shows the poor quality of work done by the BMC. In spite of having given mobile phones to corporators, no useful purpose is served in reducing the pothole-filled roads having a clean look for smooth flow of traffic. Mumbai city is facing the menace of pothole riddled roads leading to deaths and immense inconvenience to commuters during the monsoon. There is the usual hue and cry of anguished citizens and concerned authorities do some cosmetic repairs which is of no use. Every monsoon the same problem crops up with metronomic precision. Is it not strange that many ancient monuments and aqua ducts constructed thousands of years ago still stand but for the wear and tear of weather and depredations

EW DELHI: Across the nation, people on Friday hailed the death sentence given to the four men who gang-raped a young woman in the national capital, demonstrating the strong feelings the horrible crime had evoked. Political leaders including Union Home Minister Sushilkumar Shinde and Chief Ministers yesterday welcomed the death sentence awarded to four convicts in the Delhi gangrape case, saying justice has been done and that it will act as a ‘deterrent’ against such heinous crimes. “This was the rarest of rare crime...Damini and her family have got justice. I welcome the court ruling,” Shinde told PTI in Mumbai. “The ‘nyay devta’ has set a new example for such cul-
prits that if you commit such a heinous crime, then you will get a stringent punishment,” he said. Shinde was speaking shortly after the four convicts — Akshay Thakur, Vinay Sharma, Mukesh Singh and Pawan Gupta — in the December 16, 2012 gangrape and murder of a 23-year-old physiotherapy student inside a private bus in Delhi were sentenced to death by the Saket fast-track trial court. “There was an atmosphere in the country after this incident....We expected such a punishment,” he said. Apparently referring to Defence Counsel A.P. Singh’s claim that the verdict was delivered under political pressure, Shinde said, “The judiciary follows the law and not political pressure.” Shinde also referred to the

The panel headed by former Chief Justice of India J.S.Verma was formed in the wake of the shocking Delhi gangrape incident. “The new law has provision for hanging in rarest of rare cases,” he said. Madhya Pradesh Chief Minister Shivraj Singh Chouhan said the capital punishment served the requirement of justice. “It shall act as a deterrent against heinous crimes,” he said in Bhopal.

Following are the revised prices of petrol in four metros after oil firms hiked rates with effect from midnight tonight.
Petrol price hiked by `1.63 a litre EW DELHI: Petrol prices were yesterday hiked by Rs 1.63 per litre, the seventh increase since June, on rising oil rates and falling rupee. The increase excludes local sales tax or VAT and will be effective midnight, oil firms said. The petrol price in Delhi will go up by Rs 1.96 to Rs 76.06 per litre, while it will cost Rs 83.63 per litre in Mumbai as against Rs 81.57 currently. With this increase, petrol prices have gone up by a massive Rs 10.80 per litre since June, excluding VAT. The price in Delhi has surged by Rs 13.06 per litre, inclusive of state tax, since June 1. Diesel prices may soon see a one-time hike of Rs 3-5 per

EW DELHI: All central government departments should identify sensitive posts and ensure rotation of officials within every two-three years so that they do not indulge in corruption or develop vested interest, the Central Vigilance Commission (CVC) has said. Citing its earlier instructions on the issue, the CVC said it was prescribed that ministries or organisations identify sensitive posts and staff working in these posts and also ensure that they are strictly rotated after every two/three years to avoid developing vested interests, reports PTI.“The Commission
in the superintendence of vigilance administration over the years has observed that such rotational transfers are not effected in many organisations due to which officials continue to remain in the same posts for long periods. “Such overstay and continuous postings afford scope for indulging in corrupt activities, developing vested interests etc, which may not be in the interest of the organisation,” the CVC said in a recent missive to all ministries and public sector undertakings, including banks. The Commission, would, therefore, emphasise that pe-
riodical rotation of officials holding sensitive posts or jobs needs to be ensured. As such, officials should not be retained in the same place or position for long by ministries, departments or public sector undertakings, it said. The CVC has also asked the Chief Vigilance Officers (CVOs), who act as distant arm of the Commission, to send a monthly report indicating number of officials rotated or transferred to it in this regard. All heads of departments and CVOs have been advised to ensure strict compliance of the Commission’s directive.

HE film is a copy of Spanish film Box 507, so no rating points for originality for director Ahishor Solomon. Then there are the glaring incongruities — the eponymous John Day is presumably of Goan origin, and speaks Hindi? He is a bank manager in a Mumbai bank and lives in a bungalow? A cop, corrupt though he may be, lives in a bungalow with a swimming pool and has an Alibaug hideout? If this is random, what is to be made of a scene in which the abovementioned cop, Gautam (Randeep Hooda), tortures a man, in a restaurant, by forcing him to eat biryani
FILM REVIEW Deepa Gahlot and currency notes. To what purpose? Who knows! This same, obviously loony cop, bites out the tongue of a man he is questioning and then beats an informer to death. His excuse is that he was abused as a child in the orphanage. He has an even more loony girlfriend (Elena Kazan), who is an alcoholic and stuffs cushions up her
t-shirt because she wants to have a baby! Earlier in the film, John Day’s (Naseeruddin Shah) wife (Shernaz Patel) has her head bashed in with a hammer, and later Mr John (as he is called) bites a goon’s neck in vampire mode. A gangster type (Sharat Saxena) whips himself every Friday to the accompaniment of devotional music. If there was any point to all this cringe-making violence, it would still be acceptable, but the whole film replete with vague characters with a real estate deal as the McGuffin. John Day’s daughter sneaks off for a weekend with her boyfriend and ends up dead. After two years, there is a robbery in his bank, a nasty episode that leaves him wounded and his wife in a coma. On scratching the surface, Mr John finds out that his daughter’s

death was not accidental, there is a real estate scam in which Gautam and a couple of warring gangsters are involved. All of them are after a file containing papers to do with the land deal, and a lot of violence is unleashed, mostly by Gautam. Mr John wisely walks into the government department concerned, bribes the clerk and gets the papers. Sigh, all that heavy duty rough stuff and no pay-off in the end. Not even some kind of revenge accomplished or redemption gained or scamsters exposed. Naseeruddin Shah lends his usual acting muscle to a part that doesn’t deserve it, but Randeep Hooda with his grimaces, twitches and slow drawl is a major irritant. John Day tries to be gritty and noir-ish, but just ends up tedious. The only plus point being, no songs and no item number.

SCAPING Grand Masti which, by all accounts is disgusting, doesn’t mean one can get away from smut this week, with Dennis Dugan’s Grown Ups 2 dishing it out. A film that opens with a deer peeing on Adam Sandler, is not likely to get very far in the comedy stakes, but Sandler who was once a good comedian has some residual goodwill left over, and there’s Salma Hayek and Taylor Lautner for eye candy so one sits through nearly two hours of yawns and a couple of reluctant sniggers. Adam Sandler, Chris Rock, David Spade, Kevin James return from the first outing in 2010, not in the least grown up or sensible. The writing just never goes beyond the peepoop-fart-burp-barf kind of juvenile gags. A viewer has to desperately bored to even want to watch this one. Not only is it mostly

HOSE who have watched a few of Mel Gibson’s older movies would agree after watching this film, that it comes close to his 1999 Payback and Edge of Darkness in terms of tone and plot. Like always the legendary Gibson is great, and gives off a great performance sinking his hands into a dirty role. The film starts with a masked thief, Driver (Mel Gibson) making his getaway across the desert with a trail of police cars near the US/ Mexico border. A badly injured clown is in the backseat. In Hollywood style, Gibson launches the vehicle across the border, only to be held by corrupt Mexican authorities who take him into custody after finding the stolen cash. Things aren’t looking good for Driver, and he soon finds himself in El Pueblito, Mexico’s toughest prison, where life is especially harsh for ‘gringos’ (slang in Spanish and Portuguese to denote foreigners). The prison is more like a city than a detention centre. Prisoners and their families live without shackles and go about their lives much as they would outside the prison walls. But trouble begins when gangster Frank (Peter Stormare) comes to know about
Driver’s presence in the prison. He wants his stolen money back, and Gibson realises he has to get it from the corrupt cops who took it. He ties up with prison godfather Javi (Daniel Gimenez Cacho) who runs the prison from a luxury penthouse. He befriends a 10-year-old kid (Kevin Hernandez) the streetwise son of two drug dealers and his mother (Dolores Heredia). With their help, Gibson vows to take down Javi and get back his cash and also outwit a corrupt US official (Peter Gerety). Thus begins Driver’s fight for survival. Gunfire, car chases, explosions, a prison riot, bloody violence, pervasive language, some drug use and sexual material, not forgetting Gibson’s wisecracking, make up this 90-minute action flick. While the movie is half Spanish, sadly there are no subtitles included. — By Verus Ferreira

unfunny, it’s boring. There isn’t much of a plot — Lenny Feder (Sandler) moves back to his hometown, and hangs out with his buddies (the other three — Rob Schneider is missing), whining about their wives, ogling women and reminiscing about the good old days, all of which leads to a brawl at an 80s theme party. Adam Sandler probably missing his salad days. Despite the crude content, the film actually makes case for family values. Hypocrisy or smart business trick — it’s tough to

say, since the first film was a hit. And the sequel faithfully follows the formula. The important thing is, that audiences knows just what to expect, and so don’t feel all that disappointed. An Adam Sandler starrer is about puerile humour-- it’s not a Woody Allen movie, so forget about wit and sophistication; it’s not even the rude satire of Sacha Baron Cohen. At some point Sandler says, "We're irrelevant, we're losers, we're old..." If only he acted that way.

How can a grant of probate of letters of administration be revoked? What are the grounds on which they are likely to be revoked? — Sahil Joshi
Duty to disclose material defect in the property or title

IT is generally the prerogative of the buyer to find out the defects in a property before buying it and also to make the seller rectify such defects. However, the rights of the buyer to seek reasonable clarification and raise reasonable doubts have been statutorily recognised by section 55 (1)(a) to (c) of the Transfer of Property Act (TOPA). It is statutory duty of the seller to disclose to the buyer about the material defect in the property of title. The defects are of two types, patent defect and latent defect. Patent defect is one which is apparent and can be discovered by the purchaser with ordinary care. For example, dilapidating condition
of the property, use of right of way by the third party etc. Generally, the patent defects, which are within the knowledge or without the knowledge of seller, are covered by the maxim caveat emptor, and it is for the buyer to know such defects. Latent defects are those which the purchaser cannot discover with ordinary care. The seller is duty bound to disclose such defects to the buyer. For ex: underground drainage, pipelines laid for public drainage/water supply etc. Material defect in one which is known by the purchaser he general would not prefer to buy the property or something which is never intended to be brought from the seller in terms of nature of the contract. What defect constitute a material defect is a question of fact and depends on the facts and circumstances of each case. (Sec 55 (1) (a) of the TOPA). Queries may be mailed to gajanan@draftcraft.in
Chapter III of part IX of the Indian Succession Act deals with revocation of grants. Under Section 263, the grant of probate or letters of administration may be revoked if the proceedings to obtain the grant were defective in substance; or the grant being obtained fraudulently by making a false suggestion or by suppressing from the court something material to the case or if the grant was obtained by means of untrue allegation or if the grantee has wilfully with or without reasonable cause omitted to exhibit an inventory or account in accordance with the provision of Chapter VII of Part XI. Under section 263, as stated above, grant of probate or letters of administration is liable to be revoked on any of the five grounds mentioned therein. Section 297 inter alia states that when grant of probation is revoked, all payments bonafide made to an executor under such grant before revocation shall be a legal discharge to the person making payment. A probate can also be revoked in the following circumstances • The court by which the grant was made had no jurisdiction • In the grant proceedings the parties who ought to have been cited as parties, have not made the parties. • The will of which the probate was obtained was forged or revoked • Discovery of subsequent will • Discover of a codicil, made subsequently revoking or adding to the appointment of executor under the will • The person who probate has been granted, has subsequently become of unsound mind That where the grant of probate is revoked, the grant does not become void ab initio the revocation will not invalidate any previous dealings of the executor as long as they are done in due course of faith. That an administrator derives his authority from his appointment by the court whereas an executor derives his authority from the will. That the letters of administration confer rights on the administration but the probate is an evidence of the pre-existing rights of the executor appointed by the will and the probate does not confer any new right on such executor. That the vesting of the property of the deceased in the executor under Section 211 is independent of the grant probate. That Section 211 does not say, with reference to an executor that he becomes the legal representative only on obtaining probate. On the other hand, Section 307 indicates that an executor can exercise the power of disposition without obtaining the probate. However the executor must administer the estate in accordance with the will. His acts must not be incompatible with the administration of the estate. That Under Section 211, the estate of the testator vests in the executor even before the grant probate, but by virtue of

That the letters of administration confer rights on the administration but the probate is an evidence of the pre-existing rights of the executor appointed by the will and the probate does not confer any new right on such executor Section 213, the executor can establish his rights in a court on production of the probate. When a competent court grants probate or letters of administration it can never be absolutely sure that the deceased left no subsequent will being discovered later on. There is always a possibility of subsequent will being discovered later on. There is always a risk of fraud on the court. However, such possibility of risk cannot indefinitely hold up the administration of the estate. Therefore Section 273 makes the grant conclusive. As soon as the grant is made Section 273 comes into play. However the law takes note of the possibility of error, irregularity or fraud and accordingly makes provisions for revocation of grant for just cause (Section 263). If a grant is made in any of the circumstances falling in the Explanation to Section 263, the court can revoke the grant. In this connection, Section 297 of the Act is important. That Section provides that when grant of probate is revoked, all
payments made bona fide to any executor under such grant before revocation shall constitute a legal discharge to the person making such payment, the object of the aforestated scheme of the Act is to make it safe for the public to freely deal with the grantee, the theory if vesting if the estate in the executor at the moment of death of the testator, even before the will is probated, is true enough for the administration of estate but it is subjected to the qualification that the grant even if erroneously made is revocable if the circumstances in the explanation to Section 263 exist, however till the grant is revoked, the grantee is the only legal representative of the deceased and people may safely deal with such representative in good faith in due course of administration and such dealings will be protected even if the grant is subsequently revoked. In the case of Valerine Basil Pais V. Gilbert William Pais, it has been observed that even in cases where grant has been obtained by fraud, so long as the grant remains unrevoked, the grantee represents the estate of the deceased.

KARACHI: Desperate for regular cricket clashes with India, the PCB is hoping to convince the BCCI to host a tri-series later this year when the officials from the two Boards come face to face during an Asian Cricket Council meeting in Chennai today. Reliable sources in the Pakistan Cricket Board told PTI that Chief Operating Officer Subhan Ahmad will not only attend a meeting of the ACC but also hold discussions with BCCI officials. "There is a strong chance that the BCCI might propose to have a triseries sometime in December in India with Pakistan and Sri Lanka and the PCB is ready to accept this invitation," one source said.

The FIFA World Cup Trophy Tour by Coca-Cola will take an unprecedented journey around the world in anticipation of the 2014 FIFA World Cup in Brazil. This will allow thousands of football fans in Kolkata to see the real solid-gold trophy in person. The trophy will travel to 88 countries around the globe over a nine month period. The arrival of the trophy in India also coincides with the celebration of 20 years of Coca-Cola's presence in the country.
India issues visa to Faisalabad Wolves for Champions League T20
ISLAMABAD: Pakistan's domestic T20 champions, Faisalabad Wolves have been issued visas to tour India to participate in the qualifying round of the Champions League Twenty20 cricket tournament to begin later this month."The visa has already been issued. The passports would be handed over as and when they come to collect it at the Indian Embassy in Diplomatic Enclave," an official source told PTI here.The Diplomatic Enclave here is a heavily guarded premises and one can enter only after numerous permissions and security checks. The team was earlier denied visas on the ground that they faced a security risk in India.
Sportstar Trophy MCA U-19 trials from Tuesday
MUMBAI: The Sportstar Trophy under-19 tournament, considered as selection trials to pick the Mumbai colts side for the upcoming Cricket Board-conducted age-limit tournaments, is to commence on September 17 here. The tournament, to be played on a round robin basis among four teams, is in its 28th year and going strong, said N Parthasarathy, assistant vice president (west) of "The Hindu" group of publications, which organises the annual tournament under the aegis of Mumbai Cricket Association, at a media conference last night. The members of the four squads - Vijay Merchant XI, Vijay Manjrekar XI, Dattu Phadkar XI and Khandu Rangnekar XI - will be picked by MCA's junior selection panel headed by former India stumper Chandrakant Pandit. With the grand Ganpati immersion scheduled in the city on September 18, the first game in the tournament - between Merchant XI and Manjrekar XI and between Rangnekar XI and Phadkar XI - would have a break on that day.
EW DELHI: Cracking the whip on corrupt players, the BCCI slapped life bans on Indian Test pacer S Sreesanth and spinner Ankeet Chavan for being involved in the IPL spotfixing scam while handing out lesser punishments to some others in the scandal which rocked the Twenty20 league this year. Amit Singh, a former Rajasthan Royals player, was handed a fiveyear ban while another RR cricketer Siddharth Trivedi got away with a lighter one-year suspension after the BCCI disciplinary committee met here to discuss anti-corruption chief Ravi Sawani's report on the scam. "After considering the evidence on record and hearing each of the Players in person, the Disciplinary Committee has passed the following order...Mr Amit Singh is banned for a period of five years from playing any representative Cricket, or in any way being associated with the activities of the BCCI or its affiliates," BCCI Secretary Sanjay Patel said in a statement. "Mr. Siddarth Trivedi is banned for a period of one year from playing any representative Cricket or in any way being associated with the activities of the BCCI or its affiliates. Mr. Ankeet Chavan is banned for life from playing any representative Cricket, or in any way being associated with the activities of the BCCI or its affiliates. Mr. S. Sreesanth is banned for life from playing any representative Cricket, or in any way being associated with the activities of the BCCI or its affiliates," the statement added. Young spinner Harmeet Singh was, however, let off for lack of strong evidence against him.

UMBAI: The oldest player to clinch a Grand Slam in Open era, Indian tennis ace Leander Paes credited his former mixed doubles partner Martina Navratilova for helping him elongate his international career by adopting a "clean lifestyle". "Playing with Martina for many many years, I have learnt a lot. She is obviously a big inspiration for me to continue to remodel my game and stay healthy. I have also learnt how to live a clean lifestyle and be productive towards my tennis," Paes told reporters on his return after winning the men's doubles trophy at the US Open. Paes and Navratilova together won two Grand Slam titles, besides finishing
runners-up on two other occasions. He became the oldest man to win a Grand Slam title on Sunday when he along with his Czech partner Radek Stepanek won the men's doubles title at the US Open. Enduring a tough season this year, Paes was determined to excel at the last Grand Slam of the year. "I had no idea that I was the first person in the Open era to win a Grand Slam at 40. What I did know was that this whole year had been such a rough one - both on and off the court. It has been a very hard year. Coming into American summer, I knew I had to do really well. My first week in the Canadian Open in Montreal did not go well,� Paes added.

AHMEDABAD: 2013 World Indoor Games Snooker Gold Medallist, Aditya Mehta and Junior National Champion, Dhvaj Haria propelled Indian Oil into the final of the Billiards Team Championship by defeating the fancied BPCL team at the IndianOil hosted - X PSPB Billiards and Snooker tournament at the Sports Club of Gujarat, Ahmedabad. With every match of the three match tie consisting of a maximum of 200 points, Mehta gave the hosts a flying start beating Manan Chandra by a whopping 194 points. However, seasoned campaigner Devendra Joshi of BPCL brought it back on level terms by trouncing Brijesh Damani by 186 points. With just 8 points separating the two teams, the tie was evenly poised going into the decider between local favourite Dhvaj Haria (Indian Oil) and BPCL’s Shahbaz Khan. The cool and composed Haria held his nerve to garner the 194 points required to give Indian Oil victory. In the other semi-final defending champions ONGC comprising of stalwarts like Pankaj Advani and Dhruv Sitwala made short work of GAIL to book their berth in the final.

UMBAI: Former chief selector of the Indian cricket team, Dilip Vengsarkar voiced his concern over the growing influence of the Twenty20 form of cricket all over the world and urged that ‘eight weeks’ of the shortest format will ensure the balance and the survival of other formats of the game. Vengsarkar who was recently felicitated in Surrey, Canada said that it was ‘Test cricket’ which tested the real skill of the player and not T20. “CC has introduced T-20 which is a good thing but at the same time in my opinion it should be played only for about eight weeks in a year. If we concentrate only on T-20, it will ultimately kill the game,” said Vengsarkar. Commenting on the match fixing
and spot fixing scandals, Vengsarkar said that the root cause is the huge amount of money involved in the game. “On the one hand, this is a good thing because unlike our times, young players now can actually make a career playing cricket and it motivates them to play more, but on the other hand, players don’t know how to handle the wealth and the glamour which is associated with being a top cricket player,” said the former Indian batsman. Vengsarkar said it is important to educate players and their families on how to handle their newly found wealth. “Awareness and education are key, because a number of our players come from humble backgrounds and simply cannot cope with all the money and glamour associated with the game,” he signed off.
