hree minor boys were caught on camera recently at Churchgate station while they stole a mobile phone of one Ashok Patel, when he was purchasing a ticket. The three boys aged between 9 to 14 years surrounded Patel. One of them stood behind him pretending to buy a ticket, another, with a newspaper in his hand stood to Patel's right and the third boy kept pushing Patel from the left side. While the boy behind him and to his left pushed him, the youngest boy, hiding his hand behind the newspaper removed Patel's Samsung note 3 phone, while Patel bent at the window to purchase his ticket.The two boys kept pushing and irritating Patel and at that moment the third boy, the youngest, flicked Patel's cell phone and left the place, while the others left in different directions. Walking a few metres away from the ticket counter, Patel realised that his phone was stolen and then was shocked when he saw the whole incident on the CCTV footage with the police. Patel said: “I was shocked to realise after a while that my phone was missing. Soon I went to the railway police station and complained. n Friday, the 16th edition of the Terry Fox Run was announced in the presence of Richard Bale, Consul General, Canada, Director Abhishek Kapoor, Judith Fox-Alder, sister of Terry Fox, Gul Kripalani Convenor Terry Fox (India) Committee and Dr. Rajen Badwe, Director of Tata Memorial hospital, Parel. The run will be held on February 16, 2014 starting from opposite AirIndia building, Nariman Point to Brabourne Stadium (CCI). Abhishek Kapoor, who is also the brand ambassador of this event said. “It's my pleasure to be associated with Terry Fox Run. The work that the team here is doing is phenomenal, I wish all the success to

the team here.” This non-competitive run is an event where people get together as individuals, families and groups to raise money in Terry Fox’s name. Youth stabbed to death by brother BY TARIQ KHAN

A

youth was stabbed to death in Dadar by his elder brother, following a heated argument between the two, over a married woman with whom the victim had an affair. The 21-year-old accused, Navin Goswami, stabbed his brother Jituraj, 20, thrice on his back with a knife, after a fight ensued between the two late last night. According to the police, the brothers Navin – who works as a manager in an ice cream parlour in Dadar – and Jituraj who hailed from Uttar Pradesh, were living in Bandra. When Navin discovered that Jituraj was having an affair with a married woman in UP, he called up the woman's husband and informed him about the affair. When Jituraj came to know about Navin had done, he rushed to the latter's workplace last night and began arguing with him. The argument turned violent when Navin, in a fit of rage, picked up a knife and stabbed Jituraj on his back thrice, causing him grievous injuries, said the police. Jituraj was rushed to the nearby Shushrusha Hospital where he succumbed to his injuries. Navin has been arrested by the Shivaji Park police on the charges of murder and a further probe is on.

Good people and bad things LIKE the rest of the world, we wonder why bad things happen to good people seemingly more frequently than they happen to bad people. Take Sarmistha Ray for instance, aka Rumi. Unfailingly cheerful whenever we have met her over the past 15 years, coming and going from Mumbai, marching to the beat of her opwn mysterious drum, painting, drawing, selling art, suffering. Currently based in Panjim in Goa, a recent exhibition of hers at the Kala Academy elicited the declaration that she was “one of India’s top artists” and a “well known painter”. She has been a professional from 1997, after leaving a well-paying corporate job to do what she loved, and M.F.Husain, Manjit Bawa and Anjoli Ela Menon have applauded her work and encouraged her to paint more. Manjit Bawa in fact called her “an extremely painterly painter”. Without any formal training in art, Rumi held her first exhibition in

Well-suited bedfellows

WE are all well-versed with the saying that politics makes strange bedfellows to the extent that if

politicians of various hues don’t become strange bedfellows, we wonder what’s wrong with them. Maybe that is why even AAP member Anjali Damania’s revelation last year that the BJP’s Nitin Gadkari had told her that he had business dealings with the NCP strong man Sharad Pawar raised very few eyebrows. In this case, however, it is surprising, for the toll issue seems to tap into huge reservoirs of bitterness and anger, and the MNS is making hay while the sun shines on the issue. The truth is, people in Maharashtra are tired of paying up at toll after toll naka to use the state’s roads, especially when they feel their taxes should have paid for them anyway. When we pay road taxes and wheel taxes, and the money is (or should be) used to build roads, why should be keep paying for half a century or more to use them? That is why the MNS has public support, that is also why, we think, the MNS has toned down its agitation and kept the violence to a minimum. But the public thought Thackeray was ready to read Chavan the riot act (figuratively on Thursday morning at his residence. No such thing, says a journalist who was there. They came out and

everyone was positively beaming and happy. And what was decided? The state would buy back 22 toll nakas that cost less than Rs 10 crore each from the contractors. A new toll policy will shortly be announced. There is, as yet, no timeline to stop toll collection.

IS THAT A “TOLL STORY” OR A PJ? Either way, we would really like to know what the exact deal is that makes everyone laugh so much. That’s the MNS’ Bala Nandgaonkar wielding his smart phone, as Nitin Sardesai, Raj Thackeray’s right hand man, chief minister Prithviraj Chavan and Ajit Pawar look on.

And Thackeray says don’t pay and if the contractors insist, tell us, we will go to their houses and create havoc. Now, Chavan might have had reason to smile, and as an ally, Pawar as well. The others – not so much.

Sena takes potshots at MNS’ anti-toll stir

The Traffic Police were on Friday forced to close down Ambedkar Road at Sion for traffic after a container was stuck under a railway bridge opposite the Sion-Gandhi Market. The road was closed towards South Mumbai causing traffic jams during peak hours. Traffic cops later brought the situation under control.

Referring to the release of Sena workers who were detained for stalling the performance of a Pakistani band last week, the Sena mouthpiece 'Saamana' remarked that the party was proud of its party workers. The editorial states that any agitation should not be reduced to a drama and fizzle out because people will boycott such dramas and move on. In a sarcastic tone it said,

AAP collapse: the expected has happened T

he AAP government in Delhi has collapsed: chief minister Arvind Kejriwal has resigned. He has sent his resignation to the Delhi Lt. Governor. He had no go but to step down. Earlier, yesterday his attempt to pass the Jan Lokpal failed. That was a big setback to him. The Congress MLAs – eight of them – refused to support the move which was regarded as unconstitutional. When he took over, a couple of peoplefriendly welfare measures were supported by the Congress MLAs – water, power. Afterwards, he began attacking establishing institutions and began to find fault with them. It is quite surprising that the Congress thought it could do what it wanted. The collapse of the government had to happen. It was not a surprise. The Congress had given him a long rope and was silently watching what he was doing. And when he went haywire, they said enough was enough and did not support his Lokpal bill. That made Arvind Kejriwal to resign. The BJP managed 42 votes against the Lokpal move. It is evident that some of the Congress MLAs voted with the BJP. There appears to have been a new understanding between the BJP and the Congress. If they came together, the BJP can form the government in Delhi. Both the BJP and the Congress now regard the AAP as their common enemy. If however they do not continue to support each other they have strong reservations in this regard – the only way out is for the president to take over. That is what is going to happen in Delhi. The Congress and the BJP are traditional enemies. They may join when a common enemy challenges them, but they are indifferent in their political perceptions. Delhi folks could have done without the 48 days of drama. What have they got from the AAP? Nothing – not even a kg of onion at a fair price.

Maharashtra's political heavy-weight, Sharad Pawar often acts like the juggler. At a time, he handles many political parties, their leaders and keeps the people of Maharashtra wonderstruck all the time. Like the trained juggler in the ring, you cannot predict, his next trick. The difference between the two, however, is that the objects that the juggler handles are not likely to react adversely. In the game of politics, Pawar needs to be prepared for any unexpected reaction. Despite that risk, Pawar continues to play, day after day; year after year.

This is because Chavan, having a clean face, the BJP could not make any personal attack against him, while the NCP leaders are more vulnerable having many scandals in their cupboards.

What strategy will he adopt now? Not that Pawar is not aware of this eventuality. However, he is sending confusing signals to the alliance on one hand and the Congress on the other. The strategy of the seasoned politicians seems to be of applying pressure tactic. If Pawar shows his preparedness to break away from the alliance with Congress in Delhi and in Maharashtra, the already weakened Congress camp will be in a distress. By bringing the Congress to its knees, Pawar would demand his pound of flesh, not in the Lok Sabha elections but in the State Assembly elections scheduled to be held in October. Now that the Congress and NCP have forged a seat sharing deal of 26-22 for Lok Sabha, Pawar's sight is set on Assembly elections. He would demand and get bigger share in the Assembly elections to ensure that the NCP emerges no. 1 party and thus claim for the chief ministership. On the other hand, he would also weaken the Sena-BJP alliance campaign as many second rank leaders and workers at the rural level would remain confused on who is their enemy no 1, Congress or NCP? This confusion would help Pawar's men to fire their salvo when the actual campaign takes off. To remain in the forefront in national politics and to be a force to reckon with after the Lok Sabha verdict, Pawar wants to ensure at least a dozen MPs on his side in Lok Sabha. In 2009, he could win only 9 seats, 8 of them from Maharashtra. Now that P.A. Sangma of Meghalaya is not with him, Pawar would have to win all his seats from Maharashtra only. This is an uphill task as many opinion polls have given him not more than 4 seats. In such a situation, Pawar needs to follow the guerilla warfare formula and take on the enemy on his own battlefield. Pawar mastered this strategy and successfully implemented it in the past. That is called 'Pawar (Power) politics' in Maharashtra corridors. Will he be able to do it again? The future course of Maharashtra politics and Pawar's own political future lies there.

Under the circumstances, it will be best to drop the bill and request the President to dissolve the parliament which has got only a couple of months to go. In Jonze’s imagined dystopia, this may be all there is to aspire to in the name of love. On Valentine’s Day, it a depressing thought.

Ranveer Singh and Arjun Kapoor have to try hard at machismo which came effortlessly to the real stars of the period—Amitabh Bachchan, Dharmendra, Vinod Khanna, Shatrughan Sinha. The plot is rather close to the old Raj Khosla Dostana. Priyanka Chopra’s costumes may be self-consciously sexy, but she manages the husky slinkiness of Zeenat Aman. However, Irrfan just steals every scene he is in—it really is a ‘special’ appearance.

LTHOUGH it wasn’t a box-office success when originally released in 1958, ‘Vertigo’ is considered by many to be Hitchcock’s greatest, most spellbinding, most deeply personal achievement. Based upon the novel ‘D’Entre Les Morts’ by Pierre Boileau and Thomas Narcejac, this classic is now brought to you fully restored and remastered, packaged with a restoration trailer and revealing documentary footage. This romance – thriller has excellent cinematography, beautiful locales, the highlights being the majestic San Francisco Golden Gate Bridge and the Palace of the Legion of Honor. Set in San Francisco, we have Scottie aka Det. John Ferguson (James Stewart), a celebrated member of the San Francisco Police Department who opts for retirement prematurely when a sudden bout of acrophobia (fear of heights) leaves him unable to save a fellow officer in chasing a criminal. But his plan to retire and live a relaxed life goes awry when Gavin Elster (Tom Helmore), a college chum, now a big businessman offers him a job as a private detective. The director, National Award winner Nagraj Manjule has won acclaim at many festivals and does a good job though he goes overboard in the hog catching sequences. The actors playing Jabya and Shalu are first timers but have done a good job, especially Jabya. Kishore Kadam excels as always. The director himself has an important part. Jyoti Subhash supports well. All in all a film worth a 'dekho' just for its different subject and presentation.

SECTION 21-A of the Maharashtra Co-op Societies Act, 1960 deals with de-registration of societies. If the Registrar is satisfied that any society is registered on misrepresentation made by applicants, or where the work of the society is completed or exhausted or the purposes for which the society has been registered are not served, he may, after giving an opportunity of being heard to the Chief Promoter, the committee and the members of the society, de-register the society: Provided that, where the number of members of the society is so large and it is not possible to ascertain the correct addresses of all such members from the records in the office of the

Registrar and, in the opinion of the Registrar it is not practicable to serve a notice of hearing on each such individual member, a public notice of the proceedings of the de-registration shall be given in the prescribed manner and such notice shall be deemed to be notice to all the members of the Committee of the Society, and no proceeding in respect of the de-registration of the society shall be called in question in any Court merely on the ground that individual notice is not served on any such members. When a society is de-registered under the provisions of sub-section (1), the Registrar may, notwithstanding anything contained in this Act or any other law for the time being in force, make such incidental and consequential orders, including appointment of Official Assignee as the circumstances may require. Subject to the rules made under the Maharashtra Co-operative Societies Act, the Officials Assignee shall realise the assets and liquidate the liabilities within a period of one year from the data he takes over the charge of property, assets, books, records, and other documents, which period may, at the discretion of the Registrar, be extended from time to time, so however, that the total period does not exceed three years in the aggregate. The Official Assignee shall be paid such remuneration and allowances as may be prescribed; and he shall not be entitled to any remuneration whatever beyond the prescribed remuneration or allowances. Rights and liabilities of a member include: 1. Voting at General Body Meeting. 2. Rights to contest the election for the post of any committee or Board of Directors. 3. Right to know the affairs of the society. 4. Inspection of Books and Records 5. Transferring shares or interest in the society, subject to provisions of section 29. 6. Entitled to refer the dispute between him and the society touching the business or constitution of the society to the Co-op. Court for decision. 7. May tender voluntary resignation of his membership. 8. Right to refer disputes between him and the society to the appropriate authority for the decision. 9. To obtain a loan. 10. Refund of share money on amalgamation, division, conversion, etc. 11. Withdraw in case of charge of liability. 12. Freedom from attachment of shares. 13. To nominate successor. 14. To receive profits and dividends. 15. To apply for enquiry. 16. To appeal against winding up etc. Mere application to be admitted to membership together with payment of necessary fees cannot invest a person with position of a member. While admitting an applicant to membership, the managing committee has to consider not merely compliance of technicalities but also the position status desirability of a person to be a member etc (Panditrao Madhavrao v. Jayant Rangrao and others) If the bye-laws of a society lay down certain limitation on the full-fledged membership, then, such a person has no right to vote during the period of probation (Gajanan v. Guru Seva Society). Also, when the value of share is increased and unless the existing members are served with notice to pay the balance of the price, they cannot be treated as defaulters and their voting rights are not affected (Suganchand v. Pannalal) Only the members of the Provisional Committee are exempted under the said bye-law, in order to contest the election to the Managing Committee. A person must first be a member of the society and must have acquired a requisite number of shares in order to get elected as the member of the Managing Committee (Capt. V.G. Nagarajan v. Bhanu Vinayak Premises Co-op Society Ltd). If a person is held liable towards obligation to make full payment of the cost of the particular tenement which is to be allotted to him, he has every right to question the correctness or otherwise of the demand thereof (A.I. Umarani v. Saraswat Suburban Co-op. Housing Society Ltd). The right to vote being a member of society and being a member having a right to vote in the affairs of a society are two distinct things. Every associate member does not have right to vote but,

If the bye-laws of a society lay down certain limitation on the full-fledged membership, then, such a person has no right to vote during the period of probation only that associate member whose name stands first in the share certificate has the right to vote. To challenge the election process, the person must have acquired a voting right. In case the petitioner does not have shares of requisite value, he has no locus standi to challenge any part of election process. (Bhaskar Eknathrao Shinde v. State of Maha. & Ors).

NOW INVESTING BECOMES EASIER FOR NRIS How does an NRI invest in property in India? Earlier, it was governed by a person’s citizenship. Is an NRI treated on par with non-resident foreign citizens of Indian origin? - Vendy Thomas Until some ago, investing in immovable properties for NRI’s was quite an uphill task. In the days of the Foreign Exchange Regulation Act, the buying or selling of immovable property was governed by the citizenship of a person. At present, the term Non-Resident Indian means a person residing outside India who is either a citizen of India or is a person of Indian Origin who is no longer a citizen of India. An Indian citizen who stays abroad for the purpose of employment, business or to pursue any kind of vocation outside India or under circumstances indicating an intention for an uncertain duration of stay abroad is a non-resident Indian. In addition, non-resident foreign citizens of Indian origin are treated on par with Indian NRI citizens for the purpose of many investment related facilities. To avail of a number of facilities in India such as opening and maintenance of bank accounts or investment in shares and securities in India, the term ‘Person of Indian Origin’ means a citizen of any

WELLINGTON: After taking his career-best haul in Tests, Indian medium-pacer Ishant Sharma said that he has been bowling well consistently for some time but his performance was being noticed only now because he is among wickets these days. Ishant took 6-51 on the first day of the second Test against New Zealand, his second consecutive six-wicket haul in this series, after taking 6-134 in the first innings at Auckland. EW DELHI: AIFF technical director Robert Bann has stressed on the need to organise a pre World Cup tournament in 2016 involving countries from Asia, Africa, Europe and South America as part of preparation for hosting the U-17 FIFA World Cup in 2017. This is part of Baan's presentation on how India should best prepare for its maiden stint in the U-17 FIFA World Cup. Similarly, the World Cup team should also travel to different parts of the World for exposure trips. "Players need to adapt to different cultures, different playing styles. Also you need International Tournaments every year leading
