t looks the Supreme Court verdict that criminalises homosexual relationships has given the LGBT (Lesbian, Gay, Bisexual and Transgender) community more courage and the will to make their presence felt in society. Slogans like ‘He ho ho ho Homophobia has to go’ were shouted at the Maheshwari Udyan, Matunga on Sunday where hundreds of people, not only from the LGBT community, but also from several sections of society, voiced their opinions about the criminalisation of homosexual relationships. Though the meeting was called a protest, it was no less than a celebration of one’s sexuality. The need for belongingness to society and the right to live without having to hide one’s sexual preference was the common thread of talk at the protest. Irrespective of sexual preference, gender, and age, people came together to fight for the rights of the LGBT community. For instance, K.P Jayashankar who is a professor and the chairperson of the School of Media and Cultural Studies, Tata Institute of Social Sciences, and Anjali Monteiro, who is also a professor and the Dean of School of Media and Cultural Studies, Tata Institute of Social Sciences, were seen holding placards saying ‘Straight but not narrow’ and ‘NO 377’. They said, “This is not about this community. It is about rights. This verdict is a violation of human rights and we have to form a coalition of all like minded people to make sure that the LGBT community gets its rights.” LGBT rights activist Ashok Row Kavi from the Humsafar Trust said, “This is to protest against the violation of human rights of the LGBT community. We will go for a re-petitioning and do what it takes.”

Govt hostel for tribal students in Mira Road MBMC agrees to set up state-of-the-art residential facility to house 1,000 students By Suresh Golani

n a bid to give a boost to the education of tribal students, and to address their residential problems, the Tribal Welfare Department, has decided to set up a hostel complex in the Mira-Bhayandar region. Following directions from the Upper Commissioner – Tribal Development Department (Thane District) – the civic administration moved a resolution in this context
which was unanimously passed by the General Body house of the Mira-Bhayandar Municipal Corporation (MBMC). The state-of-the-art hostel complex with a capacity to house 1,000 students, will be constructed on reserved land (Survey Number: 70, Hissa No: 1) in an area spread across 4.5 acres, located in the Kaju-Pada area of Kashimira. Although some part of the land (reservation number, 381, as per the development plan) reserved for
public utility is privately owned, the state government authorities have agreed to acquire the property for setting up the much needed utility. Apart from residential quarters for the warden, security personnel and other supporting hostel staff, the proposal mooted by the government authorities for the complex envisages in-house residential facilities for 1,000 students, a computer lab, library, recreation hall, auditorium, play-ground, gymna-
sium and mess (Dining-Kitchen) facilities. “The education of tribal students is one of our primary objectives, and this hostel complex will be of great help to those who want to pursue their higher education in urban areas,” said Municipal Commissioner, Bharat Shitole, adding that although the MBMC will act as an executing agency, the Tribal Welfare Department will fully support the project and provide the required funds.

e all know we should protect the environment, but somewhere, Mumbaikars seem to lack the initiative and will when it comes to them doing their bit. Take for example a simple practice of segregating garbage. It doesn’t really take much time or effort, but despite BMC directives, it has faced resistance and taken long to come into play completely. But here’s a model set of residents from Bhoomi Arkade Complex in Kandivali (East) – 182 flats in all, under the keen leadership of Harish Kate, Building Secretary, who have completely embraced the eco-friendly route and are separating their garbage diligently, and to top it all, are converting the wet waste generated by them to compost in their own building premises! Kate, who works in the Aviation industry, has always had a keen interest in protecting the environment, and when the BMC directive came along, he decided to follow it completely and go a step ahead and conserve the environment. After doing some research on the internet, Kate got in touch with the Garbage Concern Welfare Society, who guided him on how he and other residents could go about the process. It can be done in other buildings as well if you have the support of all members and the corporation.” Kate has also distributed garbage bins for the wet garbage with directives on what can be put in the bin, eco friendly bags, and also packets of compost. On their part, they have invited other buildings from the area to observe and hopefully implement the process. Next on Kate’s agenda is tackling e-waste and plans of selling the excess compost created in the complex to generate revenue. For buildings opting to follow suit: The first thing needed is the will and initiative to segregate garbage into bio-degradable and non biodegradable garbage. Secondly, every building will need an area where the wet garbage can be converted into compost. The bins for these are available in different sizes, materials and prices. AAP vs Anna Hazare The parting of ways between noted social activist Anna Hazare and his protégé, Arvind Kejriwal and his Aam Aadmi Party (AAP), seems to be a bitter one. That it turned ugly on Hazare’s own turf at Ralegan Siddhi only goes to show how deep the divide in perceptions has been. Ever since Kejriwal, after the India

The success of AAP in New Delhi assembly polls has only further widened the rift. The Jan Lokpal bill appears to have once

While Hazare abhors the idea of taking a plunge into politics to achieve his ends, Kejriwal has embraced it, trying to create a political world of his own in an already established system. What happened at Ralegan Siddhi was not entirely unexpected. Since 1995, Hazare has been waging singlehanded fight against corruption, successfully sending off former Shiv Sena-BJP government ministers Babanrao Gholap, Shobhatai Fadnavis, Mahadev Shivankar and Sureshdada Jain. The latter (Jain), with whom he had a bitter war of words. He did not spare the Congress-NCP ministers either, forcing the likes of Nawab Malik to step down. In all this it was Hazare who almost single-handedly took on the political class of the day. Through repeated exchanges with him over Adarsh Gaon Yojana, the ruling alliance of the day had a

The real test for the AAP will come when it spreads its political wings in Hazare’s homeland, Maharashtra, which is very unlike Delhi, where the bipolar political contest was given the third dimension with the arrival of AAP. However, in Maharashtra, the electoral and political spectrum is already fragmented. The anti-incumbency factor does weigh against the Congress-NCP alliance, ruling now for close to

Not to forget the fact that both, the Congress and the NCP, are deeply entrenched in the heavily politicized cooperative movement from where they derive their political power. Mayank Gandhi does admit that the AAP has its task cut out. But that very presence has sent parties like MNS scurrying to Ralegan Siddhi to extend their support to Hazare’s fast. It is not much a question of support in the urban areas. What would be interesting to watch will be how much the AAP manages to gain support base in rural Maharashtra. The contest here could well be multi-cornered, leading to further fragmentation of the anti-incumbency vote, as well as the vote in favor of the already splintered opposition. Will that help the AAP. The Lok Sabha elections due in April-May and Assembly elections due in SeptemberOctober in 2014 will be extremely interesting to watch.

Traffic still stops in London today to let a Victoria Cross veteran cross the road. Unfortunately, we seem to somehow fail to recognize and respect our own war heroes and their medals of honor. With elections drawing closer, it will not be surprising to find the issue of preserving IMS Vikrant turning into a political issue.

he state government will today explain to the Bombay High Court what action has been taken against those who have received two flats under the discretionary quota of the Chief Minister. This comes after the division bench of Justice A.S. Oka and Justice S.C. Gupte had last week directed the state government to file an affidavit on the action taken on the list provided by petitioner Ketan Tirodkar, who has alleged that in many cases, the same person or his/her family member was given another flat under the CM’s quota in a different city, while several other deserving applicants had to wait. It should be noted that the flats are given at rates much below the market rates under this quota. In his petition, Tirodkar has also sought a probe into the allotments
wherein the kin of several politicians like Ashok Chavan, Chhagan Bhujbal and Narayan Rane, among others, and journalists, have been allotted more than one flat under the CM’s quota. According to the PIL, Chavan’s mother-in-law Bhagwati Sharma, who has been allotted a flat in Adarsh Co-operative Housing Society, has also been assigned an 800 sq.ft flat in Kingston building, Powai, under the CM’s quota. Tirodkar has sought that an investigation be conducted under the Prevention of Corruption Act and under Section 420 of the Indian Penal Code against the ministers and their kin. During the hearing last week, the HC bench wanted to know whether the state government has verified the double allotment of flats to people of the same family in different cities. “If it has verified the double

allotment, then we need to know what action has been initiated against the offenders in this case, even if they are officials who allotted the flats or people who benefited from it,” the bench stated. Reacting to this, the additional public prosecutor Aruna Pai Kamath had said that the government has cancelled double allotments in some cases. “However, we could not verify whether the same persons were given flats in different cities.” However, the court sought to know whether an inquiry was conducted in all the cases cited in the list. n a bid to widen the long held notion of organ donations being restricted to only blood donation and eye donations, Paalvi Pratishthan – a Mumbai based NGO run by Pallavi Tawde – has launched a massive public awareness campaign about human organ donation. On the other hand, after having set a personal example by pledging the donation of an organ, there has been a lukewarm response to the

Taking the cue, Paalvi Prathisthan has through street shows and skits informed people about the benefits of organ donation. “Most people were aware of blood donation, but very little was known about liver, kidney and skin donation. People were enthusiastic to know further about such donations and some were even willing to register for the
same”, remarked Tawde. The NGO so far has organised similar shows near railway stations such as VT, Churchgate, Bandra, Khar, Santacruz, Vile Parle, Jogeshwari, Dadar, Bhandup, Mulund and Thane, as well as the Gateway Of India, Kirti College and Capital Cinema. he entire East Indian villages in Vile Parle West gaotan areas remained tense throughout Sunday after residents, mostly Christians, noticed that a Holy Cross situated on S.V. Road in the Life Insurance Corporation (LIC) compound, a short distance away from Santacruz Bus Depot, had been vandalised by unknown miscreants. According to residents, the statue of Jesus Christ on the cross had been completely broken, with the limbs hacked off. Hundreds of devotees, preparing to attend morning Mass, gathered at the site to protest, and later lodged an FIR at the with Santacuz police station. The broken statue was taken to St. Francis Xavier’s Church in Vile Parle West for veneration. Residents in this locality claimed that the incident came to light at around 07.30 am, and the news spread throughout the peaceful Christian community. The cross is believed to be over a hundred-years-old and was the center of faith and prayer for many Christians and also non-Christians in the locality. According to Anthony Fernandez, a resident of Vile Parle Gaotan, “We were shocked to learn about the incident. Hundreds of people assembled at the site after they heard that someone had broken the statue of Jesus Christ. We informed the Juhu police station about the incident.” “The cross is just situated just a
stone’s throwaway from the LIC watchman’s cabin, so residents are demanding to know what he was doing when the vandalism was done. If you look at the condition of the statue, you can clearly see marks which give weight to the doubt that it was a deliberate act by miscreants,” added Fernandez. Rebecca Misquitta, another resident expressed fears about the other crosses in the localities, saying, “In our gaotan, there are crosses at many corners and junctions. We are now worried about their safety. We are an extremely peaceful community and authorities should ensure that this kind of incident should not happen again.” Another resident said that it could be the work of some mentally challenged person. ‘’We have no clue about the miscreants, but on the basis of primary information we had lodged an FIR under section 295 against the unknown person. We will do our best to nab the culprit and are interrogating the LIC watchman who was supposed to be on duty when this incident took place,’’ said Senior Police Inspector Arun Chavan from Santacruz police station. Sources from Santacruz police station revealed that it was decided to call finger print experts, and later, send the statue to the Forensic Science Lab for further testing to help in the investigation. Why were we given admission if we were not eligible? We have studied for two and a half years and now are being told that we are not eligible for the degree. If the MU had informed us earlier, we would have not wasted our time and money.” In January, the UGC had released list of 21 self-styled unrecognised institutions across nine states of India, which have been functioning against the provisions of the UGC Act, 1956. All these institutions have been declared fake and do not have the right to confer or grant degrees. When the ADC spoke to Pradeep Sawant, senate and member of Students Grievance Cell MU, he said, “Students opt for deemed varsities to complete their graduation quickly. These varsities give out a three year degree in a year or two
and are not accepted according to UGC norms. As per the rules, the MU cannot accept students with degrees from deemed universities and cannot allow them to pursue further education from the MU.” When asked about students being allowed for exams and their marksheets being printed, Sawant added, “The college authorities and the examination department members who have accepted the admissions and then allowed these students to sit for the exams will be punished and strict action will be taken against them.”

he fact that they chose to wake up so early yesterday and take part in the Run for Unity, underlined the resolve of senior BJP leaders to leave no stone unturned to make Sardar Vallabhbhai Patel’s Statue of Unity a mammoth reality. Although it was labelled a non-political event, the sole presence of senior BJP leaders Venkaiah Naidu, Gopinath Munde, Vinod Tawde, Kirit Somaiya, Mangal Prabhat Lodha and Ashish Shelar clearly indicated that it was far from being non-political. The Run for Unity was flagged off by Naidu, Munde and others at the August Kranti Maidan and culminated at the Sardar Vallabhbhai Patels memorial at Worli. Similar runs were organised at 106 locations across the state, in which the party
claimed that more than 5 lakh people took part. The state party president led the run in Nagpur. According to party spokesperson Keshav Upadhaye, senior citizens and ordinary citizens, including Mumbai’s famous dabbawallahs joined the run. Upadhaye added that more than one lakh people had registered online and by filling up forms. The state BJP unit planned the Run for Unity to coincide with its Maha Garjana rally of prime ministerial candidate Narendra Modi due to be held on December 22. The party has pooled all its resources into making the rally a huge success. 24 long distance trains from various parts of the state have already been booked to ferry the crowd for the rally. 57-year-old pathologist died after being stabbed by an angry motorcyclist in an incident of road rage in Kalyan (West) on Saturday evening. Shockingly, a mere stab in the thigh caused heavy blood loss ultimately leading to the victim’s death. The Mahatma Phule police have launched a manhunt to nab the accused. The incident took place at around 5:30 pm on the Santoshi Mata Road at Kalyan (West). The victim, Kishore Mehta, a pathologist, had an argument with the accused when their bikes collided on a narrow road. “The road was dug up causing a bottleneck. Both tried overtaking each other, leading to their bikes touching. They had a brief argument during which
Mehta rode away. The accused however, chased him for around 50 meters till he intercepted him. He then stabbed him with a knife on the thigh and sped away. Mehta was taken to a private hospital where he died due to blood loss,” said PI Vijay Bhise. Based on a witness’ statement, the police have prepared a sketch of the accused and are trying to identify him. A case under Sections 302 (murder) and 341 (wrongful restraint) of the IPC has been registered. The police are also exploring the possibility of invoking the Arms Act depending on the size of the knife used in the attack. However, this will be determined only after the accused is arrested. Unfortunately, there were no CCTV cameras on the road or in shops facing the scene of the crime.

fter skyrocketing prices of onions and tomatoes brought tears to everyone’s eyes, it is now garlic that is bringing grief, with prices having hit the roof at Rs.180 per kg in the retail market. The rate has now come down to Rs.160 per kg, and prices vary from Rs.20 to Rs.100 per kg in the APMC market depending on the quality. Everyday, 10 to 12 trucks of garlic arrive at the market from Gujarat, Madhya Pradesh, Rajasthan and Uttar Pradesh. 50-year-old man was killed after an unidentified motorist run him over at Borivli (West) on Saturday night. The police said that the accused fled the spot immediately after the incident and is yet to be identified. According to the Borivali police, the deceased, Rocky Francis Franco was a resident of Wadarpada in Kandivali (West) where he lived with his wife, Sushila (44). He used to wash auto rickshaws for a living. The police said that the mishap took place around 8.30 pm on Saturday when Rocky was walking near Abhay building on the southbound
stretch of Link Road in Borivli. “An unidentified motorist run Rocky over and fled from the spot immediately after. Sushila, who was nearby, found him lying in a pool of blood minutes later and rushed him to Bhagwati Hospital where he was declared dead on arrival,” said Borivli police. The police said that Rocky sustained multiple injuries, particularly on the left side of his body as the vehicle hit him from the left. “We are questioning locals to find witnesses to the incident and information of vehicle’s registration number. The accused has not been identified yet. Further probe is underway,” said the official.

AST year on this day, at around the time copies of this newspaper are being delivered to you, a girl called Jyoti Singh Pandey must have been waking in wintertime Delhi to a good day she thought was the first of the rest of her rather decent life. Coming from a lower middle class family, her aspirations and her achievements were definitely upper class. She was completing her education doing something she loved, she had a warmly supportive family in a country where her gender renders her an undesirable, she had good friends, a very nice boyfriend, strong opinions on most things. What was not to be happy about? The night brought out a horrific darkness that ended with her being pitched out of a moving bus like a rag rather than a human being. Thirteen days later she was dead, unaware of the deep anger and vast scale of protests that raged through India and much of the rest of the world. A year later, what is it that we have accomplished as a result of the outpouring of grief and anger? For one, we realize what a vast chasm there exists between the finest of our laws and their actual implementation. For another, that public anger will not stop rape. For a third, there is no comprehensive guide to avoid the horror of sexual violation. Look at the way rape and sexual abuse has occupied the front pages of our newspapers for much of the year as more and more cases are reported. And that is the biggest takeaway. The anger will die, the protests will be muted, as India seems to resign itself to the evil of gender abuse in which women continue to be the victims. Calling them survivors does not change this ground reality. So all the more, in print, on television and online, through Twitter and Facebook and blogs, using poems and plays and street performances, we must iterate our stand again and again. As parents we must teach our sons that this is completely unacceptable. As teachers and peers, we have to be forceful influencers at all times. And we must keep the spotlight on all forms of sexual abuse till we can honestly say there has been a slight change in the way we perceive women. Start with your own family.

HE logjam in the nation’s capital will take some doing before it can be broken, The sterling performance of the AAP may have only further enforced the BJP’s resolve not to scramble for power when it is four seats short of a majority in the Delhi Assembly. Fidelity to principled politics is the latest mantra to succeed in politics. For proof, ask Arvind Kejriwal. But the question that cannot remain unanswered any longer is: How long can the quintessential ‘aam aadmi’, blessed with a brilliant Bania’s brains, keep the AAP unsullied now that it is competing in the political bazaar with veteran players known to employ every trick in the trade to stay relevant? In our view, not for very long. Let us explain why. Had the voter given the AAP a clear majority and thus denied Kerjriwal the excuse to remain out of power, his bluff would have been called — sooner than you realize. Translating extravagant promises to the ‘aam aadmi’ into reality would have resulted in two very different outcomes. One, it would have soon dawned on Kejriwal and Co. that politics without compromise is impossible — and that sort of politics would have soon claimed him as its own. Two, it may well have made him shun politics altogether, leaving the party he floated in complete disarray even as he repaired to the Anna ashram or busied himself in espousing esoteric causes through his NGO. Now, we take a dim view of the prospects of the AAP not because we lack in idealism. No. We can probably compete with Kejriwal on that score. Having seen politicians and politics at close quarters for over four decades, we know that even the best of the lot get tainted with unscrupulous and unacceptable behaviour. Politics per se is dirty everywhere. More so in a young and developing nation like India. The greatest of idealists that this country has ever known was Mahatma Gandhi. And he made umpteen number of compromises, not all of them savoury. Therefore, Kejriwal should abandon the pretence that he and his colleagues in the AAP will remain lily-white while they seek to rise further up the greasy poll of politics. Politics will consume them sooner than they realize. How does he know that some of the AAP MLAs are not already thinking of graduating from the modest jhuugis to pukka houses, now that some of them are displaying on their shirts, Mein Vidhayak Hoon. In a society where spiritual leaders behave despicably, where the priests and maulvis have their eyes only on their own material advancement, hoping that the practitioners of everyday politics will stay pristine pure is to display a lack of commonsense. It is good to dream, but better still to be a realist. There is a far more compelling reason why Kejriwal should come down from his high horse to either accept the outside support to form the AAP government or to extend outside support to the largest party to make one possible. A failure to do so would deplete the large reservoir of goodwill that the AAP had built by making outlandish promises about clean politics, a corruption-free system, free water, electricity at half the current rates, etc. The countless voters in the jhuggi-jhopris and slum clusters, in the illegal and upscale colonies alike would not forgive Kejriwal for shunning opportunity to prove himself in government when that opportunity is knocking at his door. Why should he reject unconditional support whichever party might be willing to offer it? After all, the poor are waiting for their new messiah to deliver, to free them from the stranglehold of the slumlord, the thuggish beat constable, the money-lender, the greedy babu in the MCD office, etc., etc. The task of cleansing the system is so ardu-

ous that without enlisting the cooperation of all the stakeholders the system cannot be reformed. Playing the outsider while seeking to work the same system can only wreck it further. Kejriwal cannot practice the politics of untouchability without insulting the voters who plumped for the AAP in preference to the Congress and the BJP. His challenge is to work within the system, reform it as far as possible by bringing to bear on it his own sense of honesty and purpose, but he cannot shy away from his responsibility by blaming the voters that they did not give him majority. If he has the belief in his own capabilities he would accept outside support and prove to the people in Delhi what difference the AAP can make to their lives. Otherwise, the AAP is bound to fade away as a one-election wonder. Meanwhile, notwithstanding the AAP talk of conquering the rest of the country in the coming general election, what should be borne in mind is the demographic profile of the nation’s capital. The melting pot nature of Delhi’s population with no particular caste, ethnic, religious or regional group dominating the electorate, and the concentration of

ND you thought after they dismantle the license-quota raj the media can be free from the baneful influence of politicians? If you did, you were wrong. For, a government, any government, has so much control over the system that it can always bend the media owners to its will. How about setting the IT department or even the CBI after the main investor in a media house? Now, the power to order IT raids will always stay with the government weather the economy is free or controlled. And once you order the IT department and the CBI to harass the Sethji who has invested big in a media empire, the government can virtually dictate the editorial policy of the concerned media house and/or nominate its favourite journalist to be its editor. That is why so many journalists have been demanding a ban on cross-media holdings by industrial barons, but to little avail. Then there is a senior minister in the UPA Government who is known to be so sensitive to what the media says and writes about him that he invariably gets on the phone to the media owner to complain against even a passing mention which may not be too complimentary to him. Like the other day, he sent SMSed to a popular television anchor, asking him to immediately replace a panelist debating the Assembly election results because what the said panelist said about the fall-out of the outcome on the minister’s own re-elec-
tion chances was highly pessimistic. Of course, the anchor retained the said panelist for the entire duration of the programme, but he is lucky because the group he works for has no other interests and, therefore, cannot be cowed down by IT raids or a CBI inquiry. While still on the media, wonder why the I and B Minister Manish Tiwari is so solicitous of the welfare of the alleged rapist Tarun Tejpal. Under Tiwari, Doordarshan had signed up the Tehelka owner-editor to do a programme for it and had paid him at least Rs. one crore in advance. Will Doordarshan get that money back? Or will it still want the rape accused to produce programmes for it? In fact, thanks to Tiwari, Tejpal was to be nominated to the board of Prasar Bharati when just in the nick of time the rape scandal saved the I and B Ministry of embarrassment and his appointment letter was withheld.
Rahul alone is PM candidate

DISTRAUGHT Sonia Gandhi told the media after the decimation of the Congress in the Assembly elections that she would name the party’s prime ministerial candidate at the ‘opportune time.’ Rahul Gandhi went further, promising transformation of the party, ‘changes you cannot even imagine.’ Admittedly, it takes time to formulate positions on men and matters, especially when one has to deal with a lot of organizational deadwood and enforce changes which could be upsetting for a lot of people. Yet, most speculation has centered on the tantalizing promise of a prime ministerial candidate. Whether the Congress should declare one at all before the polls is no longer the question. It is now a question of who and how soon ahead of the polls. Most observers read in Sonia Gandhi’s assertion that Manmohan Singh would not lead the party in the coming general election. That much was a given. But who will be the Congress’s prime ministerial candidate was still not clear. The names of Sushil Kumar Shinde, P. Chidambaram, Meira Kumar and a few others were bandied about as the likely PM candidates. In a bizarre twist of crystal-gazing even the name of the IT billionaire Nandan Nilekani cropped up. Of course, it was farthest from the realm of possibility. The circumstances under which Sonia Gandhi had named Manmohan Singh as PM are vastly different from the current political scenario. She could not have become PM without inciting a veritable country-wide protest due to her Italian birth. There could be even constitutional and legal questions about her ascendancy to that high office. Besides, the dysfunctional way the diarchical system has worked is a strong reason in itself for not to repeat the experiment of foisting a dummy as PM while the real power vests with the party boss. Separating real power from a high constitutional office is a sure recipe for disaster. Admittedly, Sonia Gandhi could not have risked nominating a strong party satrap as PM for fear of him doing to her what mother-in-law Indira Gandhi had done to those who had first nominated her as PM So, we can forget about a Chidambaram or even a Nilekani being offered that high post. In other words, it cannot be anyone other than Rahul Gandhi. Just as well. Mani Shankar Aiyar, who abuses everyone in the party but always bestows high praise on the Family, has already asked for Rahul Gandhi to be named as the Congress’s prime ministerial candidate. Other Congressmen will take the cue and chant Rahul’s name till his mother is able to cite pressure from the party to formally anoint her chosen heir as the prime ministerial candidate.

BEFORE thinking of expanding its activities at an all India level, the AAP should do well to consolidate the gains made by it in the Delhi polls. As of today, the fledgling outfit does not possess the necessary manpower to operate at an all India platform. They may lose steam and track in going for such a task. Unscrupulous elements may try to enter the party, thereby sabotaging the clean image acquired by it till date. THIS has reference to your article ‘After Delhi, AAP eyes Mumbai’ (ADC, Dec 11). The Aam Aadmi Party (AAP) is understandably euphoric after its spectacular debut in Delhi. However, Mumbai is likely to be a much tougher nut to crack. Mumbai may be nominally cosmopolitan, but the majority population belongs to the group popularly referred to as the ‘marathi manoos’. This group has traditionally been fiercely loyal to the Shiv Sena; and lately also to the MNS – particularly that segment that stands in line at polling booths. They are prepared to gloss over and forgive the many negative traits of these parties; hooliganism and lack of internal democracy, for example. How else can one explain the Shiv Sena regaining power in the BMC, even after a previous 12 years of potholed roads and pathetic public services – not to mention corruption and wasteful expenditure on inferior infrastructure projects? The AAP may appeal to the relatively well educated and prosperous, but this lot does not usually bother to vote. Whichever way you

Explain the physiography of the Deccan Plateau
Ans The inverted triangular plateau region to the south of the Narmada river is called Deccan Plateau. Its base in the north is formed by the Satpuda Range, Mahadeo and Maikal hills. II The Maghalaya plateu and associated hill complex from the North East India are also parts of the Deccan Plateau. III The Western and the Eastern ghats from the margins of the Deccan Plateau. IV The Deccan Plateu is divided into the following sub-regions. 1) Satpuda-Mahadeo-Maaikal Range 2) Maharashtra Plateau 3) Karnataka-Telangana Plateau 4) Eastern plateau compromising of a part of Chota Nagpur plateau, Mahanandi Basin, Dandakaranya and Garhjat Hills. 2) Explain subregions of Deccan Plateau in detail Ans Satpuda-Mahadeo-Maikal Range 1 These form the northern edge of the Deccan Plateau. The Satpuda range occupying the area between the Narmada and Tapi river. Starts from eastern Gujarat and extends for a distance of 800 km. II The Burhanpur gap in its central part provides an access to North India. Its hill tops are mostly flat and their height varies from 700 to 900 m. III The eastern extension of the Satpudas can be seen in the form of Mahadeo Range in Madhya Pradesh and Maikal Range in Chhattisgarh. The Maikal Range forms a divide between the Narmada Basin and the Mahanandi Basin. IV The three major river system-Narmada, Mahanandi and Wainganga collect their head waters from this hill complex. 2) Maharashtra Plateau I The north western part of the Deccan Plateau is known as the Maharashtra plateau. II The Basalt rocks of this region are formed by fisser volcanic eruption eg lava, it spreads over the region horizontally. The maximum thickness of this basalt is around 2 km. III Due to the horizontal nature of the basalt rocks, the region has an appearance of a series of flat lands placed at different heights. The hill tops are generally flat. IV The altitude of the plateau ranges from 400 m to 600 m. The Tapi basin in the north slopes westward, while the plateau portion to the south of this basin gently slopes eastward and forms upper part of Godavari and Krishna basins. V A number of offshoot from the Western Ghats run in a West to East direction and form the divisions between different river basins. VI The eastern part of this plateau is occupied by the Wardha-Wainganga basin and they flow in the North South direction. 3) Karnataka-Telangana Plateau: I It is the South most part of the Deccan plateau and it covers a large portion of the Plateau. II It is a region of crystalline rocks, mainly granite and granitic gneiss as well as metamorphic forms of some sedimentary formation. Kalam tells youth to fight corruption from home N
EW DELHI: Calling on the youth to commence the journey of curbing corruption from their homes, former President APJ Abdul Kalam on Sunday said 21st century needs leaders, who can work with integrity. Delivering the first Defence Estates Day Lecture here he said an analysis has found that 30 per cent houses in India were corrupt, reports PTI. "Of the 200 millions houses in the country 60 million houses are corrupt. Each house comprise parent and their children," he said. "The question is will the daughter or son would be bold enough to say to their corrupt father please do not do that (corruption)? Let’s start from the home," he added. Kalam observed that though the government could frame laws, it would only end up in filling jails. "Young people have got a responsibility to make a home clean and transparent home," the former President stated. Kalam was responding to questions posed by the audience after his lecture on the topic 'Creative Leadership
for Transforming Societies'. Earlier, addressing the gathering he highlighted the qualities required for leadership. A leader, he said, must have a vision and courage to take decisions. The real estate sector through 2013 was plagued with numerous troubles. The overall economic climate, coupled with inflation and high interest rates, kept buyers at bay. But, if one is to believe the current trend in the economy, there is hope that year 2014 would bring in some good news for the sector. Overall, there were some policy decisions in favour and some not in favour of the sector in 2013. Mayura Shanbaug takes stock of the situation and events that have impacted the sector and how they would continue to do so in 2014 as well.
W
hile the real estate market witnessed a drastic fall in sales across regions, property prices in some established markets dropped on account of an oversupply situation. However, in most regions, especially in emerging areas having ongoing projects, developers continued to hold on to their prices making some locations unaffordable. While the office space segment witnessed improved transactions through the first half of the year, the retail segment continued to face challenges such as supply of quality spaces affecting overall absorption. The residential demand improved during 2013; however, developers continued to struggle with unsold inventories and reduced cash flows for construction. Major events in the last one year which impacted the sector were: a) RBI scrapping 80:20 housing loan schemes b) 1 % TDS on immovable property over Rs 50 lakh in the Budget c) Rs 1 lakh tax incentive for first time home buyer this too in the Budget and d) Introduction of real
estate investment trusts (Reits) in the country. “The Reserve Bank of India (RBI) asked banks to call off the dubious 80:20 and 75:25 schemes, as the banking regulator felt that such products increase the risk for both banks and borrowers especially if there is a dispute between the buyer and the builder or the project is not delivered on time,” says Sachin Sandhir, MD, RICS (Royal Institute of Chartered Surveyors) South Asia. The RBI advised banks to closely link home loan disbursal with the stages of construction of a housing project. “The move puts a check on price escalation, as it will dissuade investors or short-term buyers from investing in the otherwise popular under-construction projects,” he says. “Several viewpoints have been floated since the RBI announced this ban, largely speculating on a fall in real estate prices as a consequence,” says Ashutosh Limaye, Head – Research & REIS, Jones Lang LaSalle India. “It has been opined that devel-
opers’ holding power will be significantly reduce, forcing them to reduce prices. This analysis of the situation is based on the currently high levels of inventory that developers are saddled with, especially in larger cities like Mumbai, Bangalore and Delhi,” he says. “Despite the RBI’s edict, it is important to note that there are other dynamics at play in some of these larger cities which could result in developers resisting price cuts. In the first place, the cost of land in these cities is already at astronomic levels. Secondly, the recent amendment to the Land Acquisition and R&R Bill will raise land owners’ expectations, which means that developers will have to negotiate harder for available land. As a result, developers in these cities will now operate from the standpoint that overall real estate prices will, in fact, rise going forward,” explains Limaye. Trend Forecast For 2014 In Retail

he slowdown in the economy over the past few months has affected almost all sectors. Retail is no exception. One of the most important reasons for this is very high inflation. Fortunately, the affect of slowdown in retail is not as bad as it is in other sectors like automobile, real estate etc. Year 2014 being an election year is expected to be slow in the first few months however, it would certainly pick up from 2nd quarter onwards. Like any other industry, retail industry is also hoping for a stable government after election which would boost the confidence of the investors and general sentiments in the market. Many new companies who have been studying the market over the past year and half are almost certain to set up shops by the third and fourth quarter of the financial year. Growth for most of the retail companies this year has come through the increase in prices of the product. There has been very minor increase in the volume which has affected the bottom line. The phenomenon of discount sale was at its peak this year which I am sure is something that retailers would like to correct next year. The pattern of “Sale” needs to go through a dramatic correction if retailers would like to see a healthy growth in the bottom line and profitability. As far as consumers are concerned, they are going to see many new brands. Many popular international brands have been making right noises over the past few years but have not been able to set up shops in the country so far. Big retailers like H&M, Carrefour, Tesco, IKEA seems to be almost certain to open store in the year 201415. This will not only give many choices to the consumers but will also help the existing retailers in bring more consumers to the shop. The rise of income of the middle class and lower middle class is certainly helping the market dynamics. The branded products are increasingly becoming a choice for most of the consumers for urban and semi-urban areas. Shopping Malls in many cities are helping the retailers increase their volume. The Malls are able to induce the shoppers to spend more time on the shop floor by offering almost everything under one roof. Various options of entertainment, multiplex, food & beverage and services like ATM, florist, Drop boxes, large parking, Baby care room etc are helping the shoppers spend more time in the Mall. Consumers shopping habits have changed and reliance on mobile devices increased, retailers are looking at ways to embrace mobile/digital technology to better serve customers. There are more on focus on store experiences for lifestyle merchandising that brings the products/services to life to interactive displays that encourage exploration and the “hands-on” experiences. E-commerce is also gaining ground in the market. Companies like Amazon.com, Flipkart, Jabong, eBay have understood the psychology of Indian consumers and they have been aggressively marketing their offerings. This has made the retail very exciting. With most of the urban and semi-urban population have internet access; this will also be an exciting format for the retailers as well as consumers.

This will also boost the subdued investor sentiment in the country,” says Sachin Sandhir. “Reits will provide an investment avenue which is less risky than under-construction properties, as well as offer easier exit routes along with regular income,” he says. “Allowing Reits is a sign of the maturity of the Indian real estate market. Reits reduce individual speculation in real estate assets and allow for more professional investment and management in the sector,” says Sanjay Dutt, executive managing director, South Asia, Cushman & Wakefield, a real estate consultancy. According to Cushman & Wakefield, around 57 million square feet of office space is vacant in India and over 200 million square feet of investable ‘Grade A’ leased offices are unsold. These properties can be used by Reits to generate rental incomes. The residential segment, where annual rental yield is low (2-5%), will be better suited for capital appreciation. Another affecting factor is that, amidst the global economic uncertainty, fiscal consolidation; the prevailing local market conditions have affected investor sentiments. According to the Department of Industrial Policy & Promotion (DIPP), the Construction Development sector received a total Foreign Direct Investment (FDI) equity inflow of INR 1,052 bn (USD 22.8 bn) during April 2000 to September 2013. These amounts to an 11.1% share of the total FDI equity inflow and are the second highest amongst all sectors, outlining the importance of the sector in attracting valuable foreign capital to the country. Pankaj Kapoor, managing director, Liaises Foras, a real estate rating and research company explains that the announcement of Rs 1 lakh tax incentive for first time home buyer in the Budget will continue to be a big boost to the affordable segment. “For the first time in 12 years the Finance Minister had increased the interest benefit for the first time home buyers from Rs 1.5 lakhs a year to Rs 2.5 lakhs. So his interest rate benefit which was earlier 57 % of his total exemption has now gone up to 96 %, which is very good,” he adds. Though the housing sector has witnessed a total investment of INR 22.4 bn in the first three quarters of 2013 as compared to INR 25.1 bn investment during the same period last year, the total PE investments have increased from INR 37.5 bn last year to INR 47.2 bn in 2013 for the same period indicating greater interest. Despite the continued large scale migration of the rural poor to urban areas, the Twelfth Five Year Plan (2012-17), has estimated the total housing shortage in rural areas at 43.67 million units. The slum population in India was projected to be 94.98 mn in 2012 and is expected to touch 104.67 mn by 2017. This increase in population, if not matched with the required increase in housing units could contribute to the development of further slums in urban areas, creating a social problem and becoming detrimental to the overall health of the Indian economy. Hence, the total housing demand in the country by 2017 could be as high as 88.78 mn units. As per the latest Economic Survey of India, institutional credit for housing investment is expected to grow at a CAGR of about 18-20 % per annum in next three-five years and the housing sector’s contribution to GDP is likely to increase substantially. “In the coming year, for the first six to eight months, growth momentum may not be the same as it used to be during boom period between 2006 and 2008. However, economic indicators suggest that market is poised for growth in the second half of the year after the general elections in May 2014,” concludes Sachin Sandhir. through automatic route in townships, housing and built-up infrastructure and construction developments, which drove up the FDI inflows in FY2008 and FY2009. Apart from cost overruns due to inflationary pressure on materials etc, the investors are worried about their timelines for exit which has been elongated and had adversely affected their returns on investments. Hence, the lack of certainty with regards to the time lines in the country risk compounded by the bureaucratic hurdles and corruption is further shaking
the confidence of the investors,” said Lalit Kumar Jain, Chairman of Confederation of Real Estate Developers’ Associations of India (CREDAI) in a recently published white paper on the housing sector. According to the CREDAI white paper, India is rated as one of the lowest destinations for attracting cross border investments in real estate globally. In fact it is the lowest even amongst the BRIC countries. Other Asian countries markets such as China, Singapore, Hong Kong, Malaysia, are ahead of India. Given that the first six months of the current financial year have recorded FDI equity inflows into the sector at INR 41.6 bn (USD 685 mn), there are indications that the rest of the year could record FDI equity inflows at par with the figures observed last year. “Hence, the Government needs to take some concrete steps to create international investor interest in order to attract more foreign equity capital into the country and cross the previous thresholds,” says Jain.

he Indian mutual fund industry’s month-end assets under management (AUM) rose 7% (or Rs 560 bn) to a record high of Rs 8.90 trillion in November, as per the monthly numbers released by the Association of Mutual Funds in India (AMFI). The rise in AUM was primarily due to inflows into liquid / money market funds, says a Crisil Research report. The report added, money market / liquid funds saw net inflows worth Rs 514 bn and rise of 30% (or Rs 573 bn) in AUM due to improved liquidity in the system and cyclical inflows. Liquidity in the banking system improved in November due to gilt purchases via open market operations (OMOs) and an additional 11-day repo auction by the Reserve Bank of India (RBI). Government spending also helped ease liquidity in the system. Improvement in liquidity is confirmed by the fact that the banks’ average borrowing via the central bank’s marginal standing facility (MSF) decreased to around Rs 120 bn in November compared to an average borrowing of Rs 371 bn in October. Further, average net borrowing via the RBI’s liquidity adjustment facility (LAF) - the repo and reverse repo - declined to Rs 380 bn in November compared to Rs 400 bn in October. In October-November, the category saw record inflows of Rs 1.19 trillion on a consolidated basis. Equity funds’ AUM (including ELSS funds) rose by 1% (Rs 17 bn) to Rs 1.75 trillion marking its third monthly rise in a row. The rise in equity funds’ assets was an outcome of inflows
on the face value of Rs 10 per unit.

The category saw inflows of Rs 7 bn in the month (highest in the past five months) compared to outflows of Rs 35 bn in the previous month. Gilt funds’ AUM rose 7% (or Rs 5 bn) to Rs 80 bn primarily due to inflows of Rs 5.30 bn. . Gilt prices were down in the month on worries of rise in inflation, depreciation of the rupee and heavy supply of bonds. The 10-year benchmark 7.16% 2023 paper’s yield rose to 9.04% on November 29, 2013 from 8.62% on October 31, 2013. Investors continued to exit from gold exchange traded funds (ETFs) for the sixth consecutive month amid weakness in the underlying asset class prices. The category’s AUM fell by 6% to Rs 93 bn led by outflows of Rs 1.3 bn
and mark-to-market losses. Fixed maturity plans (FMPs) continued to attract investor attention due to prevalent high yields of debt instruments in the financial market. Yield on the one-year commercial paper (CP) and certificate of deposit (CD) rose to 9.98% and 9.29% on November 29, 2013 compared to 9.78% and 9.02%, respectively, at the end of October 2013, said the report.

When Brand Offerings Are Rejected...
n my experience over two decades of brand sales and marketing, I have found that brand marketers and sales and marketing professionals get dejected whenever their brand is objected to and their offering is rejected. Thus a very critical element of success in brand marketing is to be able to face and handle objection so that consumer rejections do not lead to team dejections. Let us go to the root cause and find out the various reasons for his state of affairs and also the various solutions that can be handled and given to increase brand sales, brand growth and brand profits. Firstly, let us look at the objection front. Consumers raise objections to a product brand or service brand because they may find certain gaps either in their understanding or in the sufficiency of information or just the fact that they don’t like the marketers. Objections are natural behaviourial elements from consumers. Consumers may object to buying a product brand or a service brand if they do not comprehend what the brands stand for. It is very important that objections from consumers be clearly understood and addressed and responded to immediately. This would improve the understanding of the consumers about the brand and objections would go down. Brand marketers must consider objections positively and use them as opportunities to build their brands and increase sales and market shares. One must be very careful in ensuring that a credible and appropriate brand ambassador is chosen who is acceptable to consumers so that there is a greater acceptance of the brand. This will help reduce or overcome objections opening the path to grand brand sales. A brand could face Rejection because of poor product or inferior service or merely because the consumer is not aware about the brand. Brand faces rejection from consumers for various reasons. If these reasons are removed there is a very good probability that consumers would choose the brand and not reject it. Inferior product or poor service could be a reason for the consumer rejecting the brand. In all the cases it is important that world class quality be offered to the consumer with proper awareness and need assessment so that the consumer is able to benefit and improve his standard of living and quality of life. This would help reduce or eliminate rejection and increase consumer acceptance. A brand marketing team could get dejected because it is human nature to feel low and depressed whenever there are barriers and objections raised and whenever a brand offering is not accepted or rejected. Brand marketers get de-motivated and dejected when consumers do not accept the brand or switch to other brands leading to the moral going down as also the sales. The right solution is to regularly train the brand marketing team and make them internally tough and at the same time externally sensitive to changing consumer needs. The Brand Marketing team must be alive to adapting their brand so that the consumer gets the best benefit avoid dejection. Thus we see that if the root cause of consumers facing objections is tackled and the main reasons of brand rejections are solved then there will be little scope for dejections especially if the marketing team is regularly trained and motivated to face a number of these issues. A little background about yourself? I have been a practicing Technical Analyst for over 15 years, but would still like to consider myself as a student of this vast, complicated and fascinating subject.
At what point had you given a thought to making a career in the stock markets? During my college years being a commerce graduate, with a peer group where everyone was interested in stock markets especially with the tech boom on the brink of happening on bourses due to the Y2K problem, I had decided to make a career in the stock markets and just knew I would succeed. There was no question that it was what I was supposed to do in life. Somehow I followed the principle of “Do what you love, the money and success shall follow”. The same principle incidentally was quoted in the movie 3 Idiots “Baccha kabil bano, kabil ... kamyabi to sali jhak maar ke peeche bhagegi”.
How do you pick your trades? Do you use technical analysis, or do you employ fundamental data? In today’s time when you are bombarded with information through various channels and which get discounted so fast you, cannot rely on any single theory. I therefore use the Fundo-Techno approach. However, the weightage to technical analysis would be far greater than the fundamental approach as entry and exit points are key to making fortunes on the Street. Moreover, the Fundamentals that you read about are typically useless as the markets have already discounted the same.
What appeals to you about investing? The short side or its the long side? Trending markets appeal to me. However, according to me, trading on either side needs conviction, discipline, patience and a firm belief in your system.
What differentiates you from other investors? I may not be different from other experienced people in my approach in picking stocks based on Technicals, but I would say that Patience and tight Stop Losses would be my positive points. What gives you that edge? Remaining unbiased and believing in my conviction and ability to pick the right stocks and not getting swayed by the news flow and grapevine helps me to succeed.

How much of what you do is gut felt? If you are investing / trading in a disciplined manner, there is no place for gut feel. Though believing in yourself against all odds does take into account some degree of your instincts.
Do you try to anticipate or follow market trends?
What is the basis of your theory? It is necessary to think ahead of the markets if you want to earn handsome profits. Therefore some degree of anticipation is required. The proportion of anticipation and following market trends have to be equal. None should over whelm you.
When you put money and it goes against you, how do you decide when you’re wrong? What do you do next? Stop Losses are the key. However, the most important way to understand whether I am right or wrong in case of a doubt is to get back to the basics of your system and re-analyze your decision. In case you think you are wrong get out of the trade and book losses immediately. Never average a losing trade. As Sir Ed Seykota would put it “If you can’t take a small loss, sooner or later you will take the mother of all losses” Any positions you ever lost sleep over? Though I have never lost sleep being a strict disciplinarian when trading, you do think over your position day in day out. Since most of the trades are positional based, you need to ponder over the next emerging scenario. What would make you wary of a trade? Entering a trade either a Buy/Sell ahead of time or before my Technical System gives it; makes me wary of a trade.
Of the tens of thousands of trades that you have done, which was your best trade? Amongst the many good trades that have earned me handsome profits over the past 15 years predicting the reversal of markets in early 2008, against the general euphoric conditions and projecting the quantum of fall is amongst the few that make me delighted.
What makes a trader successful? What is your success mantra? Amidst all the qualities that are required to make you successful in trading, I think it finally boils down to Discipline that can make or break you. Any final words? Believe in yourself, build a trading System that suits you and follow it like a True Disciplinarian.

Argentina, the other major soybean exporter sowing at 19.7 mn ha will be 3 percent larger than a year earlier. Argentina farmers are expected to plant a record 20.65 mn ha soybean in the 2013-14 season, up from 20 mn in the previous crop year. We expect soybean prices to remain in the negative territory in the short-term on the back of weak demand as millers are not buying aggressively due to lack of fresh soy meal export demand. However, the downside is not expected to sustain and prices are expected to bounce back from lower levels given the tight supply situation in the domestic markets. Prices are also likely to take cues from movement in the international markets as well as the domestic currency, i.e the Rupee. Technically, Soybean January contract may find strong support at Rs 3650/ 3500 per qtl levels, while resistance may be seen at Rs 3850/4000 per qtl levels in the near term.

Bad Economics Is Bad Politics
he single biggest reason for the crumbling of the UPA 2 was its inability to tackle inflation, as has been admitted by Chidambaram, who attributed the price rise as the single biggest reason for the recent poll debacle. Also P. Chidambaram who has been the FM of India on five different occasions, has a track record of stifling the economy, and as history has shown that at the end of each of his terms, as FM, growth and therefore tax revenues slowdown considerably. Therefore he resorts to tax raids on large corporates, which leads to further resistance from India Inc. and they freeze investments. He is also famously known for announcing Amnesty or the VCES as it is known, which has proven to be a big disaster. Out of the 10 lakh defaulters that this scheme has targeted, only 7000 have come forward, even though the original deadline was Dec 31 2013, which I believe is now extended to 31st March 2014. But does extending this deadline have any meaning with general election round the corner and does Chidambaram seriously expect that after such a poor response now there will be a meaningful pick-up in disclosures? Chidambaram has always been known for making tax laws more and more complicated, whether it is individual taxes or corporate taxes or indirect taxes, when world over tax rules are being increasingly simplified. And whenever he is forced to give tax-sops for political reasons, he does it half heartedly and gives marginal relief. For example, after the recent drubbing at the polls there were indications that he would raise the minimum income tax exemption limit from Rs. 2.5 lakhs to Rs. 3 lakh, an increase of nearly Rs. 50,000 in today’s context, when there is a case to raise this limit to Rs.5 lakhs so that this limit remains for at least the next 10 years, without the need of tampering or tinkering. Single and decisive changes in tax laws can kickstart the economy and growth. For example, when the NDA came to power in 1998 the income tax exemption on the principal and interest amount for a home loan was Rs. 10,000. The then government in a single move increased this limit to Rs. 1.5 lakhs. This resulted in a huge housing sector boom, created thousands of jobs, created huge demand for cement and steel and kick started a sluggish economy even at that time. It wouldn’t be surprising if they do that even this time, provided they form the next government. They could now raise the exemption limit from Rs. 1.5 lakhs to Rs. 5 lakhs, because with property prices having risen drastically since 1998, Rs. 5 lakhs is a more realistic limit. A single stroke of the pen has the potential to energize the stuttering economy. Already, Yashwant Sinha is talking of boosting investment in infrastructure and in particular rural infrastructure if NDA wrest power. Facilitating and incentivizing such investment by rejigging tax laws so that corporates get tax benefits if they invest in infrastructure, not only will restart bogged down infra projects but, also create demand for labour, steel, cement, power, equipment, etc. This will give a huge boost to growth. Of course there will be a time lag before any such measures have a visible impact on the growth rate, but it will be a big sentiment booster. There are poll pundits who warn that there is a big danger of a fractured mandate especially with regional parties having become stronger and AAP having emerged as yet another spoiler and there could be a hung parliament. But past history shows that the Indian Voter, whenever he has been subjected to gross misrule, has given a clear mandate

REVIEW OF THE PREVIOUS DAY:
The Nifty fell substantially on Friday (December 13, 2013) a net 68.65 points (1.10%) and closed at the 6168 point level. The market opened down with a gap at the 6201 points level. It then rose by a few points and registered the day’s high at the 6208 points level at 9.38 a.m. The index then declined and turned into a range bound movement until 2.49 p.m. It then declined further and registered the day’s low at the 6161 points level at 3.15 p.m. and then turned into a range bound movement until closing at the day. The Nifty remained below its previous close throughout the session, moved in a range of 47 points and closed below the psychologically important 6200 points level. The index is now below the 5 and 15 days moving averages. Moreover, the velocity parameters which were neutrally trended are now turning negative. The index has also dropped below a major support level at the 6198 points level. All these indicate a negative bias and the possibility of a further decline unfolding. Investors are advised to avoid buying at current levels.

We see the effort to start bearing fruits and solve its two-pronged problem: 1) Lower dependence on low-margin onsite business 2) Visa-issue (Immigration Bill). Continued and increased focus on Business IT - Tactical v/s Strategic: The management continues with their long-term strategic goal of increasing nonlinear revenue composition. However, in the near term, they have pegged their focus on traditional Business IT. Key positives from the discussion were: 1) there is consensus on reduction of license fee for the sector to 8% of AGR from the current 10%, and 2) license extension/migration for DTH operators will be automatic and for a finite though long period of time. The negatives from the discussion were: 1) the regulator is highly concerned about control or cross-media ownership in the space, and 2) lack of interoperability – technical or commercial. We maintain our positive view on Dish TV and believe that reduction in license fee to 8% can lead to further Rs5 upside to our target price from Rs 70. Impact on Dish TV: In the event that license fee reduction is implemented prospectively, the impact on Dish TV is a positive Rs9/share. And if the reduction is implemented retrospectively the net impact on Dish TV is a positive Rs5/share. owever, control issues with respect to ownership remains a concern and needs to be watched out for. There is no change in the basis of calculation of House Rent Allowance. However, the change is with regard to furnishing of PAN No. of the landlord. Earlier the employees were required to furnish the PAN No. of the landlord only if the rent payment exceeded Rs.1,80,000 p.a. According to the change the PAN No. of the landlord is required to be furnished now if the rent payment exceeds Rs.1,00,000/- p.a. Besides this there is no other change.

EW DELHI: A spell of President's Rule loomed large in Delhi as the political deadlock continued over formation of a government in the national capital even eight days after announcement of outcome of the election that returned a hung verdict. Lt Governor Najeeb Jung on Saturday sent a detailed report to President Pranab Mukherjee about the current political situation and mentioned that government-formation in Delhi was not possible now. The tenure of the current assembly will end on December 18 and President's Rule has to be imposed after that if a government is not put in place by then, an official told PTI. They said Jung was now waiting for a directive from the Centre. Aam Aadmi Party (AAP) had yesterday put the onus on Congress and BJP for taking its support to form a government by putting forth 18 conditions and wanting to know their views on them, a move seen as an attempt to rebut criticism that it was shying away from taking re-

EW DELHI: Under severe attack after the December 16 gangrape, Delhi police took a slew of steps like setting up helplines and women help desks at police stations to ensure women's safety but there is no let up in the crimes against them which have actually increased during the period. The number of rape cases this year is highest in the last 13 years, but Delhi police has attributed it to greater awareness and registering of cases which otherwise would have gone unreported. According to Delhi police data, a total of 1,493 cases of rape were registered in the national capital till November 30 which is more than double the number of cases registered in the same period in 2012. What is more alarming is
that the number of cases of molestation has registered a five-fold increase as till November 2013, a total of 3,237 such cases were registered as against 625 last year. Cases related to outraging the modesty of women, that includes eve-teasing and stalking, also show a similar trend with the figure skyrocketing to 852 from last year's 165. As per data of National Crime Record Bureau (NCRB), in 2012, a total of 706 rape cases were registered while in 2011, the numbers of registered rape cases were 572, as against 507 rape cases reported in 2010. The figure stood at 469 in 2009. In 2008, the figure was 466, while in 2007, 2006, 2005, 2004, 2003, 2002, 2001 the figures were 598, 623, 658, 551, 490, 403 and 381 respectively.

What made you ac cept the sho w? I did it firstly because it’s a Rajeev Mehra production which I had worked under in ‘Shararat’ earlier. I basically like to do comedy and also feel comfortable with SAB TV. For the first time, I am playing the character of a fairy which drew me to this show. Also Ali Asgar, my co-star, is a good friend and I enjoy a comfort level with him.
What is your c harac ter like in ‘Jeannie Aur Juju’? I will be playing the character of ‘Mooni’, the leader of Moonistan (Chaand). My character represents the imaginary residents of Moonistan who are believed to be very artistic, romantic and beautiful people that fall in love very easily. Mooni possesses certain magical powers like Jeannie. How m uch do you relate to yo ur r ole? I am very happy with the way my character Mooni will be portrayed on screen. This is my dream, as I have been craving to play a fantasy character on screen. I can relate to Mooni and the concept of Moonistan completely, as I am a die-hard romantic just like my avatar.
How will your cha racter pr ogress in the sh ow? It so happens that love finds its way towards Vicky (Ali Asgar) everywhere he goes. Mooni will fall in love with Vicky, after hearing him singing a song for Jeannie. Let’s see if Mooni proves to be tough competition for Jeannie!

TV and film actor Manish Paul was injured while playing cricket with the ‘Tere Bin Laden 2’ cast and crew on Saturday night. Manish was fielding and jumped to catch the ball but twisted his ankle. His foot is bruised and he has been unable to walk. He was taken to Kokilaben Ambani Hospital immediately where the doctors advised him complete bed rest for a week. However Manish has a show on Monday at Ahmedabad which he will do to keep his word.

ollowing mount pressure from the Opposition and the media, the Union Minister of State for Parliamentary Affairs Rajeev Shukla has offered to return to the State, the controversial plot in a prime location in Mumbai he received as a 'gift' . Reportedly, Shukla was allotted a plot, worth Rs 100 crore, in Andheri at a lesser rate. Shukla claims to have incurred a loss of around Rs five to six crore with regard to the plot and is yet ready to return it to the state. Now, he has written a letter to Maharashtra Chief Minister Prithviraj Chavan in which he maintains, “I wish to return the land allotted to me by the state government as we have not been able to carry out the project as it is not encroachment free. I have not been able to take the possession of the land or proceed with the school project.” In 2007, Shukla also the secretary of BAG Films Educational Society requested the state to allot the Society a 2821 sq mt plot, in the western suburb Andheri reserved for a municipal primary school. Apparently, the state government’s plot, worth Rs. 100 crore was awarded to Shukla’s educational society at a very minimal rate. Five state departments and the Brihanmumbai Municipal Corporation (BMC), unanimously, cleared the proposal for the allotment of the land to Shukla. BJP leader Kirit Somaiya asked for the records of the deal in which the land was allotted to Shukla, through an RTI application, after reports of the land being given away at low rate came to light. Somaiya had asked for the records from the state revenue department but didn’t get any reply for four days. After four days, he was called to the office but told the files he had requested in the RTI application were untraceable. A day later, he was told that the files got burnt in the Mantralaya fire. This wasn’t the first time that the authorities used the 'missing' ploy as a pretext to avoid making public, controversial files sought under the

With government officials declaring files ‘missing’ each time they encounter a sensitive RTI application, it’s time the state puts a punitive process in place, writes Gajanan Khergamker
After the Mantralaya fire last year, a lot of files were ‘burned’ in the mishap. After the incident, the officials had said that many crucial files had been lost in the fire. RTI Act. The richest corporation of the country, BMC had created a stir when reports of it having misplaced 6,000 important files were made public. In July, earlier this year, as anRTI application was filed asking for details of building proposal plans in the city. The reply that followed wasn't something the applicant had could have expected for an answer. The applicant was told that around 6,000 files from the western suburbs, eastern suburbs and the Island city were misplaced. So much was said about the carelessness of the civic body and the government authority in general, that the Maharashtra CM had to set up a committee to probe the issue. In August, the BMC managed to ‘trace’ a majority of the missing files after the committee was set up. Reportedly, about 1,300 files were missing, of which it managed to restore 1,100 files. The remaining files will be traced soon, the BMC claims. Reports published around the time also suggest the missing files included many key installations in the city. Apparently, design plans, files and even blueprints of several important buildings in the city, in-
cluding the Taj Mahal hotel, have gone missing from the BMC. The RTI report also suggested that most of these files involving key installations in the city had gone missing before the 26/11 terror attack; which means that Taj Mahal Hotel development plan files had gone missing before the terror attack. Considering that the hotel was one of the prime targets of the terror attack, the missing files could ‘give a complete new dimension to the issue’ the activist, who had sought these files, said. The files had gone missing in 2006. And, this is just Mumbai we are talking about. After the Mantralaya fire last year, a lot of files were ‘burned’ in the mishap. After the incident, the officials had said that many crucial files had been lost in the fire. Shukla’s land deal, that has fetched so much trouble in the past few weeks, figured in one such crucial file 'burnt' in the Mantralaya fire. The state had decided to recreate the files that were lost in the fire and the process is still underway. But, the kind of files that are usually ‘lost’, ‘misplaced’ or in the Mantralaya case ‘burnt’ are the kind
mired in some or the other controversy. It has become a rather predictable trend that every time a new ‘corruption’ or ‘scam’ comes up, the crucial files that would probably act as evidence or throw some light on the issue, usually go missing. The coal scam files that were ‘misplaced’ are still to be recovered as yet fully. It was in August that files containing ‘crucial’ information about the coal blocks allocation deal went missing. It was reported that records of applications for 45 coal blocks allocated between 1993 and 2005 were nowhere to be found. And, it wasn’t just that, apart from the fact that applications and records for coal blocks issued from 1993 to 2005 having turned untraceable, recommendations made by Congress MP Vijay Darda and subsequently forwarded to the PMO for the bander block were reported untraceable as well. It must be noted that, in connection with Coalgate, the Central Bureau of Investigation (CBI) had raided Mr. Darda and registered a case against him last year. Also, records of at least 157 pri-
vate companies, which applied for the coal blocks but were not allocated to them, had gone missing. A couple of month back, it was reported that the CBI had managed to recover the ‘crucial’ missing files pertaining to coal block allocations done between 2006 and 2009. The CBI, reportedly, has also found Congress MP Vijay Darda’s letter to Prime Minister Manmohan Singh advocating allocation of a coal block to one of his companies. Losing and tracing files has become a norm with officials of different government departments all over the country. Files get misplaced, lost or ‘mixed up’ every time a new scam or a controversy involving a political leader comes up. The government needs to bring in place a proper management system to keep records in check. Instead of setting up panels to probe missing files or getting existing government workers to look for missing files, the government should look into setting up proper departments to keep track of files even put some punitive action in place for officials ‘misplacing’ such files. N a programme on Aaj Tak, Punya Prasun Bajpai said something that caused deep shock in everyone’s heart. On the Anna-Arvind letter controversy he said that a dream was dying because of it. But in the video that came before the world exactly 72 hours after that, it was proved that it was not the death of a dream but a dream had been killed, been murdered. The main accused in this murder is Arvind Kejriwal, whose ambition is to achieve power. Arvind Kejriwal, who used to gloat that only he and his party were honest and the rest of the people in the world are dishonest and corrupt, in just one jerk this entire bogus bundle of claims burst open. It was proved that the Aam Aadmi Party was corrupt like other political parties. That stage of corruption which it took other parties years to occupy, the Aam Aadmi Party managed to do in just four months. A dirty joke was played on the people of the country. Pash’s
poem comes to mind: “The death of dreams is the most dangerous.’ The accusation of killing a dream is levelled against Arvind Kejriwal. At Delhi’s Constitution Club on 21 November, a sting operation conducted under “Operation Lokpal’ was shown at a press conference. This was a film which had been prepared by the web portal ‘Media Sarkar’. Why was the film made? Why was it shown just before the elections? Is there any in-
den behind the mask of honesty, perhaps nobody had thought even in a dream. If the video had not been shown, who would have believed that AAP leader Shazia Ilmi is ready to hold a ‘dharna’ (sit-in) or a demonstration after taking money? She goes to any dharna or demonstration for anybody who gives funds to the party, and she also issues a statement. It was shown in this video how Shazia Ilmi was ready to take cash

It was also revealed in this sting operation that the most cherished leader of the AAP Kumar Vishwas, does not hesitate at all to take black money either. The ‘Media Sarkar’ web portal’s reporter went to Kumar Vishwas’s home to conduct the sting operation. Poet KumarVishwas too has a secretary. The woman reporter had arrived to invite Kumar Vishwas for a programme. Discussions were held. How much money does Kumar Vishwas take to come a programme, a deal was made on this, and when it came to giving the money, Kumar Vishwas’s secretary disclosed that money is taken in cash also, but in return no receipt is given for it. The manner in which Kumar Vishwas’s secretary is keeping the money given by the reporter in his pocket can be clearly seen in the video. After the sting operation, what Kumar Vishwas said in his own defense is even more ridiculous and laughable. He said he was a poet who got the most money in the country; he takes remuneration for his talent.
Will the 2014 elections be a wake up call? P
ERHAPS it is this that is the magic of elections: The people of our country, in any election, whether they are corporation elections, Assembly elections or general elections of the country, become engrossed in seeing them as a ‘tamasha’ (farcical show, entertainment). They listen to the speeches of leaders as if they are some wondrous thing and after listening to the speeches do not raise any questions. They don’t pay attention to why those questions that should be raised in corporation elections, how are they arising in the assembly elections? How are promises related to those corporation election questions made during assembly elections? And those questions which should arise in the Lok Sabha elections, how can they be solved through the legislative assemblies? But our country has become accustomed to watching a ‘tamasha’ for the last 65 years, is watching a ‘tamasha’ and will keep watching a ‘tamasha’. Perhaps people consider elections to be a form of entertainment. Let’s talk of the Lok Sabha elections. Questions related to inflain the country, tion unemployment, corruption, poor education facilities, poor health facilities, poor and faulty infrastructure, development which is of no use for people, have been arising since Independence and in answer to these questions there was jugglery performed in every election and people saw lots of this
jugglery and ‘tamasha’. People just did not focus on these questions, did not bother about what was at their root. The 2014 election too is about to become an epic, a magnificent ‘tamasha’, a farce, on a very grand scale. Economic policy decides what kind of production there will be. Which people would
Santosh Bhartiya participate in production? Who will be in the stream of development? Where will roads be made? Where will schools be opened, where will hospitals be opened? Or will not be opened? It is economic policy that decides what percentage of people have to be brought out from the circle of poverty and what percentage of people have to be increased in the circle of poverty and brought into it. But even on economic policy, no party which wants to form a Government at the Centre opens its cards. This time round, the conditions are even funnier. The Congress has been implementing the policy of liberalisation, a free, open econ-
omy, open market for the last 22 years. Other Governments came in between, there was the Deve Gowda’s Government, Gujral Sahib’s Government came, Atalji’s Government came, none of them raised any questions about economic policy. Everybody took forward the same economic policy. Now the BJP is saying that the policy of liberalisation is not being implemented properly by the Congress. We will implement this policy properly. That is, if the liberalisation policy was implemented by the Congress in the wrong manner, the figures with it for unemployment, for agriculture becoming uneconomical, water, forests and land going to foreign companies – all these things and the figures will register a further rise if the BJP implements the policy properly. It means that development in the country will not be for everyone, but will be there for the special few. The number of poor people in the country will increase. Crimes will increase. People are unable to understand this situation because people love not the country but themselves. It is often said that the public never gives a wrong verdict, but the public has just no option. When all the parties, the big parties who want to lay claim to forming the Government or small parties who desire to be their tails, all advocate the same kind of economic policy what verdict can the public give?
In between, some small parties sprang up like mushrooms and fought the assembly election on questions of municipality elections. People clapped in applause and said we have seen everybody, now we will see them too. This is an amazing thing in our country: that we have looked at ‘them’, we have looked at ‘them’ as well, and now we will look at ‘them’ once too. Let’s see, perhaps something good will happen. And after five years have passed, we beat ourselves on our heads and say ‘we were made fools of’. The 2014 elections are coming. And a few new political parties start behaving like political mafias even before they go the assembly or the Lok Sabha. Their biggest leader speaks the same language. Their servile agent standing on their right, and the intellectual standing on their left also speaks the same language and even before being selected as candidates, can be seen talking about staking occupation of land, taking money, cooperating in promoting the interests of one company against the interests of another company. In our country, where democracy was the strongest, where there is freedom of speech, freedom of thought, it is because of our weaknesses, the weaknesses of the people of the country that those people are flourishing in the name of parties who are playing a big role in destroying democracy in this country.

RECENTLY, the past came on a rather rare visit to Udyog Bhavan. Retired IAS officer Mani Narayanswamy, or Mani, as this columnist once knew him, returned to his old office and room at the Directorate General of Foreign Trade (DGFT) for an interactive session with Indian Trade Service (ITS) officers. In the early 1980s, Mani was Chief Controller of Imports and Exports (before the post lost its immense power and corporate clout and became a more benign storehouse of wisdom and was renamed DGFT). He had occupied the room which, he was proud to inform his audience, was once used by Prime Minister Jawaharlal Nehru whenever he visited Udyog Bhavan to attend meetings of the Planning Commission. Clearly, this was not just historical trivia, but an attempt by an old hand to encourage and motivate those who work in the directorate with a sense of its noble history. Among his audience was the erudite current DGFT, Anup K. Pujari, who joined the IAS in the year Mani occupied the ‘special’ room! Pujari should now be the envy of his IAS biradari, since few will actually get to squat, in a Prime Minister’s former chambers.

BABUS joining politics is not something new; in fact, the Election Commission has recommended a ‘cooling off’ period for babus, which is still being debated. However, in Mamata Banerjee’s West Bengal, several retired bureaucrats entered politics in parliamentary and assembly elections. Recently Ms Banerjee has given her assent to an IAS officer to join politics. Eyebrows were raised only because she had last year denied a similar request from an IPS officer P. Ravi, claiming that there was a shortage of IAS and IPS officers in the state. J Sundara Sekhar, however, seems to be in Didi’s good books, and after her go-ahead on his request for voluntary retirement, is all set to contest assembly elections in his home state, Andhra Pradesh next year. At present he is Secretary and CEO of the West Bengal Human Rights Commission and many officers are reportedly already vying for his position.

IN the age of email and instant communications, how long do you suppose it should take for the Department of Personnel & Training (DoPT) to issue a notification? Seven years! That’s how long it took DoPT to issue a notification regarding a 1994-batch IAS officer who overstayed in Uttarakhand in 2006. The babu in question is R.C. Joshi of the AssamMeghalaya cadre but was posted to Uttarakhand and overstayed his deputation by seven years because DoPT did not act on time. Sources say that, last week, a letter signed by personnel undersecretary S.S. Shukla was sent to the Chief Secretaries of Assam, Uttarakhand and the Accountant Generals of both the States respectively, noting that Joshi’s overstay has been regularised. Why it took the DoPT seven years to do so, however, remains a mystery. — Dilip Cherian

ERTH: England were battered and all but beaten with Australia on the verge of regaining the Ashes at stumps on the third day of the third Test here. Australia led by 134 runs on the first innings after the England tail folded meekly again before lunch and the home side were dismissed for 251. The Australians were 235 for three in their second innings at the end of play for an overall lead of 369, with Shane Watson on 29, and Steve Smith on five and two days left to play. Opener David Warner (112) capitalised on the shoddy wicketkeeping of Matt Prior, who missed two stumping opportunities from the left-hander, to post his second century of the series and take his tally for the series to 457 runs at 91.40. By contrast, England's highest scorer in the series is Michael Carberry, whose 157 runs at 31.40 is only 10 ahead of Australian tailender Mitchell Johnson's aggregate. Australia lead the five-Test series 2-0 after comprehensive victories in Brisbane and Adelaide and can regain the Ashes, which they last won in 2007, with victory in Perth. As if England's predicament wasn't already dire enough, the tourists returned to the field for the Australian second innings without their best fast bowler Stuart Broad. NEW DELHI: In a heartwarming gesture, former Test cricketer Surinder Amarnath coached inmates of the Sabarmati Central Jail in Gujarat for a Twenty20 match against lawyers and judges as part of a welfare initiative taken by the authorities. Surinder, eldest son of the Legendary Lala Amarnath, prepared the convicts for a Twenty20 match against a team of judges and lawyers. In fact it was Surinder, along with Director General Of Police (Gujarat) P C Thakur, who came up with this innovative idea of making life a little better for the inmates of the jail. The match which took place on Saturday saw a close fight between the legal fraternity and the convicts. The Legal eagles scores 165 in 20 overs for the loss of seven wickets. Kapur totalled five-under 205 at the event, reduced to 54 holes. The trophy was won by Dawie van der Walt who held his nerve down the closing stretch to win a second European Tour title. Kapur, who shot 71 on the first day, scored 65 on the second. Kapur regained his European Tour card for 2014 after finishing in the top-15 of the European Challenge Tour, where he won the first and last events in 2013.

MUMBAI: Carl Serrao of Dadar Club registered crucial back-to-back wins to progress to the next phase in the SPG-Park Club Open Billiards Handicap Tournament on Sunday. Serrao kicked off an exciting day of billiards action when he fashioned a thrilling 156-152 win over Dependra Pinkyar of Shivaji Park Club in Group N and later overcame Vinay Kalro of Park Club to make it to the knock out round of 32 along with Pinkyar. Former champion Rishabh Kumar of Bombay Gymkhana also snatched a crucial win over Dharmesh Mistry (MCF), Borivali in his last Group D tie to scrape through along with compatriot Rovin D’Souza. Kumar, winner here in 2011, had to win by a substantial margin and his 267-168 win over Mistry shunted out Deepak Khubchandani of Khar Gymkhana. Sunil Jain of Elphinstone Cricket Club and Chandu Kansodaria of MCF also registered crucial wins in their concluding ties to enter the next round.
