cores of activists of the Aam Aadmi Party (AAP), led by Anjali Damania, were reportedly attacked by BJP party workers led by Borivli MLA Gopal Shetty while the activists were conducting a signature campaign over the MLA’s alleged takeover of the Veer Savarkar Garden, on Sunday evening. The AAP members were attacked by around 30-35 BJP worker, including a few women, who started pushing the activists and ordered them to go out of the garden. Members of AAP party are alleging that Shetty has usurped 40,000 square feet of land in the Veer Savarkar Garden located at Borivli West, and was being used by his henchmen for private functions, who barred common citizens from entering it. They also did not allow the garden’s caretakers to develop the part of the garden that they were using for such purposes.. CIDCO infuses `739.46 lakh in Nerul-Uran rail project By Amit Srivastav

elapur/ Nerul-Seawood-Uran Railway Corridor is likely to be a reality soon, as the planning agency CIDCO which is bearing the major part of the project cost has sanctioned Rs.739.46 lakh for the project after a meeting of board of directors held last week. The work on the project restarted in July 2011 after it was stalled in 2010 after differences between the state government and the railways. The much-awaited rail project got its life again when the City and Industrial Development Corporation Ltd (CIDCO) decided to infuse major amount in the project in July 2010. A tripartite agreement was signed among the state government, CIDCO and the railways. Currently, the work on the project is going on full swing. “If the present situation continues for the next three years, commuters would be able to take a direct train from Chhatrapati Shiv-

With this case, focus has been shifted to get law for acid attacks in place. I think this will be the basis for Preeti’s family to get justice and other acid attack victims as well.

Such cases do create a lot of hype but I have never heard about justice being meted out. They die away slowly. I hope that this case becomes an exception and sets a precedent.

This case has brought out several issues like safety for women, regulation of acid sales, compensation for acid attack victims, etc. This gives me hope that Preeti’s family will be given justice.

MUMBAI | MONDAY, JUNE 3, 2013 ASTECTOMY is the medical term for the surgical removal of the breasts and is resorted to only when considered to be medically necessary. Then a month ago came the announcement by Hollywood actor Angelina Jolie that she had had a preventive double mastectomy, and suddenly, this last resort has begun to seem like a plausible if drastic means of preventing a disease that strikes terror in all women, not least because of its potential for ‘de-feminising’ the sufferers. The debate began immediately, kicked off by Jolie herself writing in the ‘New York Times’ about how she approached her decision and why – because she hoped that more women, likely to have inherited the mutative gene that made them vulnerable to breast cancer, would know that a preventive double mastectomy was not the end of their lives as women but possibly the beginning. So, has Jolie’s announcement done more harm than good for the public? And what does the medical fraternity in Mumbai think about the issue? The ADC spoke to Dr. Vijay V. Haribhakti, consultant surgical oncologist and reconstructive and microvascular surgeon at Jaslok, Breach Candy and Saifee hospitals, and who and specialises in areas of head and neck cancer and breast cancer. What came out of this discussion with Dr. Haribhakti was that knowledge about a certain technique, preventive mastectomy in this case, is good but opting for it just because someone famous had decided this was best for her, is definitely not the right approach. Even before we could start shooting our questions at Dr. Haribhakti declared, “First of all, you must know that more than 80 per cent of cases of breast cancer have no significant family history or are related to heredity. They are sporadic cases. Less than five to ten per cent of cases are because of the expression of the BRCA1 and BRCA2 genes.” “BRCA1 and BRCA2 (the BR and CA are short forms for ‘BReast Cancer susceptibility gene’) are genes that help repair DNA, but when they are defective, they increase the risk of breast and ovarian cancer,” he added. This statement was an answer to our next question about who needs it, as preventive mastectomy helps only people who have chances of developing breast cancer because of family history and heredity. But as our readers expect more direct answers, we proceeded to ask, “Who needs it?” “Women who have a very strong family history of breast cancer in the maternal lineage and hence might have a strong clustering of the BCRA genes could opt for preventive mastectomy. People diagnosed with cancer might feel that if Jolie can get her breast removed for prevention, then why shouldn’t I go for it after being diagnosed with cancer? This is wrong. There are breast conservation surgeries that can be as effective. People need to know this,” said Dr. Haribhakti. “Also,” he continued, “There can be complications like implant failure, implant fibrosis, improper reconstruction to state a few. The lady might have to undergo repeated surgeries. This is traumatising.” Dr. Haribhakti also highlighted the fact that in preventive mastectomy, for optimising the risk reduction factor, not only the breasts but also the ovaries have to be removed. According to him this is like totally ‘de-feminising’ a woman. “Opting for a preventive mastectomy has to be a decision initiated by the treating doctor and accepted by the patient,” said Dr. Haribhakti. “The Angelina Effect is here to stay. It will not be forgotten soon. I hope that this doesn’t lead to an increase in the demand for mastectomy without good reason which would be terrible. There is half knowledge about preventive mastectomy which is dangerous and that is how it is going to be. In times to come, we will see more of preventive mastectomy. In the west, it is already quite prevalent and the wind is going blow this side too. Demand will rise and nothing can be done about it. Doctors have to educate people and help make appropriate decisions.” To the question whether Jolie did the right thing by coming out about her double mastectomy, Dr. Haribhakti said with a smile, “It is debatable. It is about knowing risk at which a lady for developing breast cancer. When it comes to early diagnosis of cancer, there are other tests like MRI, mammography and sonography. They too help pick up cancers at early stages. Self examination also helps,” was Dr. Haribhakti’s reply. “I would grudgingly permit someone who has a strong family

history to take this test,” added Dr. Haribhakti. Dr. Haribhakti was keen on making the point that cases like Jolie’s are very few and the use of preventive mastectomy cannot be applied generally for the public. “In a career that spans 25 years, I have operated upon thousands of women and have saved their lives and their breasts. While we need to perform mastectomies many a times, I can count the number of mastectomies I have done. Might be around eight to ten cases of double simultaneous mastectomy, that too, for good reasons.” Across the world, doctors are in favour of breast conservation and so am I. In proven cancer cases, we have removed the cancer and also saved the natural breast of a lady, then why remove the breasts for prevention purposes,” he questions, reiterating his strong belief in medication and close surveillance as good preventive measures. When asked about the effect of Jolie’s announcement on people, Dr. Haribhakti said, “It is too early to talk about the effect right now.” But its immediate effect is, “There is an increase in awareness about preventive mastectomy and more people are asking about it.” Even this, however, is a cause of

he state government will launch the life saving ‘Blood On Call’ service in Mumbai sometime in August this year. The scheme will be launched in the rest of the state later in October, stated Minister for Public Health, Suresh Shetty. Relatives of patients in urgent need of a specific blood group can now dial 102 and avail of the service. The feature of this service is that blood stored in mobile cold storage boxes will be supplied to the relatives of the patient on motorcycles. Speaking to newspersons recently, he disclosed that meeting with the Metropolitan Blood Bank has already been held. Built at an estimated cost of about Rs 100 crore, the opulent new Maharashtra Sadan is located in Lutyens Delhi. But more than its opulence, the BJP and the Aam Aadmi Party (AAP) have lodged strong protests against the controversial manner in which the contract was awarded to a contractor close to the Minister for Public Works, Chhagan Bhujbal, and the alleged awarding of contract for interior decoration to a company owned by Bhujbal’s daughter-inlaw. ome weeks ago, it was discovered that the standard X text books carried many grammatical mistakes apart from factual errors. It was soon noticed that even standard IX text-books of the SSC Board had had similar errors. Now, the state board has said that the corrections can only be done next year as the whole lot of the text books for this year have already been published, distributed and sold. However, the Board had sent corrections of these errors to all the schools across the state. When the issue of erupted, the board dismissed the committees handling the subjects where errors in text-books were discovered. Though the state board had already formed the committees for sitting down to formulate this year’s syllabus, teachers from various schools claimed that they had not been informed about the formation of the committees. The girl who suffered 70 percent burns was rushed to a hospital in Palghar from where she was shifted to Sion Hospital in a critical consition. While 56 buildings housing 1,891 families are already on the list of rickety structures for the past several years, the MBMC has recently ordered structural audit of all pre1995 buildings in the twin-city. Notices have been issued to 1,165 buildings to get their structural audit done within a month. After a series of evacuation notices failed to evoke response from people living in the dangerous structures, the MBMC has now initiated stringent measures, including disconnection of water supply and forceful eviction amidst tight police cover. While water supply lines to 14 buildings have been disconnected, the MBMC has asked the service provider to cut-off electric supply to ensure that residents evacuate immediately. Meanwhile, a special civic squad went ahead and evacu-

Harvest this monsoon THE monsoon silly season is upon us, and even though we know that the rains will hit the city ten days after they come to Kerala, nothing stops us from peering upwards hopefully all the time. As I write this, they are advancing to Goa, then the Konkan and Ratnagiri and finally, they should be here by June 10. Once again, if we are lucky and the IMD has been accurate, we can look forward to cloudy days and pouring rain as Mumbai receives its annual 2146 mm of rain for the city (2457 for the suburbs). And we shall try not to let the sight of billions of litres of water gushing uselessly into the sea because, one, we have tarred, concreted, bricked and cemented every available centimeter of open space available to us in the name of development, and because, two, we just will not invest in rainwater harvesting systems that will solve all our problems. Consider this – the number of buildings, societies and co-operatives that have included rainwater harvesting in their development plans are probably less than 1 per cent of the total. Currently there is a shortfall of 550 MLD (million litres per day) in Mumbai. Yet, merely using rooftop rainwater harvesting to capture 20 per cent of Mumbai’s run-off would result in a saving of 600 MLD per day! Just 20 per cent. In addition to rooftop rainwater harvesting, there is harvesting using percolation pits for groundwater recharging. But there is really no alternative to this. If we are to prevent water wars from taking over our lives, we have to treat this issue far more seriously than we have done. We have to make rainwater harvesting a part of our lives, individual as well as collective. We have to talk, cajole, influence, persuade and threaten everyone, from groups to neighbourhoods to the authorities. We have to make non-compliance with rules that new buildings must come with mandatory rainwater harvesting systems punishable not just with fines but with jail terms. And for the sake of decency, let’s get these idiots posing as luxury apartment purveyors to stop promising that each flat is to come with its own plunge pool. In a state where there is mass migration of villages into cities because of the water shortage, this is the ultimate obscenity.

UBLIC memory is proverbially short. And it is an abiding failing of our policymakers not to get wiser even with the benefit of hindsight. Recall how the Congress Party, now crying from housetops that Naxals are terrorists, had done a deal with the insurgents on the eve of the 2004 Assembly and Lok Sabha polls in Andhra Pradesh. The author of that not-so-secret understanding with the leading lights of the ultra-left guerrillas was the late Y.S.R. Reddy. As part of the deal, soon after the twin polls, which the Congress won handsomely in Andhra Pradesh, the top command of the Naxals was engaged in negotiations. Representatives of the newly-installed UPA Government in New Delhi and the YSR Government in Hyderabad met the top leadership of the Naxals in several sessions spread over a couple of weeks. However, when it became clear that there was no meeting ground between the elected members of the lawfully constituted central and State governments and a handful of scruffy men and an odd woman or two, all claiming to speak for the people without in anyway providing an iota of evidence of their representative character, the talks broke down as they were bound to. For there could be no common ground between those who were self-avowedly committed to wage a war against the Indian State and those who were its elected representatives and duty-bound to uphold the Constitution, Within hours of the abrupt breakdown, the anti-Naxal Greyhound squad of elite policemen had the top Naxal leadership in their sights in a jungle not far from Hyderabad. They wanted to siege them. A message was flashed to YSR. He, in turn, sought permission from New Delhi. The then National Security Adviser, the all powerful M.K. Narayanan, however, ordered that the cornered high command of the Maoist guerrillas be allowed a safe exit. That was sometime in later half of 2004. Admittedly, whether it was part of a tacit understanding, or the Naxals were being genuinely grateful for having been spared their lives, their operations in Andhra Pradesh were overnight scaled down. Instead, Chhattisgarh and, to a lesser extent, Orissa saw further intensification of Naxal insurgency. Now cut to the last week. The ambush and killing of 24 people, including a few leading lights of the Chhattisgarh Congress, traveling in a convoy through the densely-forested Bastar, was a barbaric act. No sane person can condone it. Naturally, the Congress high command is hopping mad. The leaders of the Chhattisgarh Congress had begun electioneering early in Bastar. In the last Assembly poll, the party had managed a lone seat while the ruling BJP won the other eleven. In view of the State elections later this year, it was natural for them to try and renew contact with the voters in the vast region dominated by the tribals and, their self-proclaimed benefactors, the Maoists. Without in anyway detracting from the

enormity of the tragedy that befell the families of the twenty-four people, including a few who had no connection with politics and were merely serving as drivers and security guards to various VIPs, it must be noted that people like Jairam Ramesh and other bleeding-heart liberals in the ruling party probably for the first time have begun to equate Naxals with terrorists. Not even when the they killed a busload of security personnel, including 76 in one incident and over 30 in another, did they deem it fit to call a spade a spade. Those were security personnel, you

But as is now amply clear, the route on the way back was inexplicably changed at the behest of the lone Congress MLA from Bastar, who, incidentally, survived the attack. Maybe only in retaliation, the BJP has publicly accused the former Congress chief minister Ajit Jogi of being involved in the conspiracy. Jogi’s ambitions to bounce back as the chief ministerial candidate are not hidden. Following the horrible killings of the State Congress chief and others, he remains the only leader of significance to lead the Congress campaign in the coming Assembly poll. Also, it is worth recalling that his delinquent son, Amit, was the main accused in the murder of the State NCP treasurer Ramavatar Jaggi on the eve of the 2003 Assembly elec-

Acquitted by a lower court, last heard the CBI was planning to file an appeal against his acquittal. Ironically, Jaggi had then joined the NCP at the instance of its Chhattisgarh leader, V C Shukla, who was an implacable foe of Ajit Jogi. Since then back in the Congress, Shukla was seriously injured in the Naxal attack last week and was now fighting for his life in a Gurgaon hospital. Meanwhile, Ajit Jogi, who was seriously injured in a road accident in 2004 and had been wheelchair- bound since then, has now acquired electronic legs which would enable him to walk at least seven hours a day. And last month he had declared his intent to plunge actively into the Congress campaign for the next Assembly poll later this year. As we said, it takes two to construct conspiracy theories. Even though we will give the crafty Jogi the benefit of the doubt, there are others who know him well and wouldn’t put anything beyond his and his son’s evil capabilities. How immensely better would it be for the larger good of the polity if politicians followed a bare minimum code of conduct which eschewed playing with the national interest for the sake of votes. Naxal insurgents becoming terrorists for the bleeding heart liberals overnight due to the exigencies of the electoral battle ahead is as good an example as any of our political class playing with fire for short-term gains while losing sight of the larger public good.

Pitting growth against the poor

O

NE of the strangest reasons cited by Aruna Roy for quitting the National Advisory Council, the super cabinet headed by Sonia Gandhi, is that the UPA Government prioritizes growth over welfare of the poor. Roy, however, failed to enlighten us as to how the Government can generate funds for more and more freebies for the poor if there is no growth. Growth, we thought, was not the enemy of the poor. In fact, even the existing entitlement schemes could run out of funds if growth suffered any further, having already slipped below five percent in the last fiscal. Besides, Roy, whose heart, it should be noted, bleeds the most for the poor, might be wrong on facts. The truth is that the UPA Government gave up bothering about growth a long time ago. For evidence, consider the policy paralysis, the abandonment of vital reforms, neglect of infrastructure, various corruption scams et al. Civil society activists like Roy seem to suffer from the illusion that they alone know what is good for the poor and the wretched of this earth. For them, it is either `my way, or highway.’ Time they disbanded the NAC, a motley group of leftist do-gooders who only believe in widening the entitlement net without any concern for the state of the public finances. There is no better way to remove poverty than for India to grow consistently at ten percent for a decade or so. Entitlement schemes which civil society activists like Roy canvass can only distribute poverty but not help remove want and hunger from the land.

The incident occurred on Tuesday night at 2.50 am when the Dalit victim’s husband who was drunk, slept outside his house because of

The fear that the super-loose US monetary policy of the past four years, that fuelled cheap Fed funds leading to across the board rallies amongst most asset classes and markets, could soon come to an end and could create major corrections across global asset classes, is not unfounded. So how badly will it impact India? Manik Kumar Malakar reports…

T

here is an overhang lurking around the corner for India’s battered economy and that is the possible winding down of the US’ Quantitative Easing (QE) programme; meaning the U.S. stimulus program is set to taper off. This programme had boosted economies across the globe and its easing will not be easy for economies, including that of India. However, analysts believe that India is a mega-power in its own right; possible the third largest economy in the world, and has the potential to grow on her own steam although some discomfort will have to be borne through. “India has exhibited resilience on

its own in the last few years and has grown consistently on various sectors independently,” says K. Jayraman-Research AssociateBonanza Portfolio about a possible exit of the US QE (Quantitative Easing) policy. Following the US Fed Chairman Bernanke’s testimony, our US economics team changed its monetary policy call, says Nomura a financial company. ‘It brought forward the date it expects the Fed to start tapering QE asset purchases to the end of September from the end of 2013,’ the Nomura analysis continues. While the exact QE date is still sometime off, its effect is already

being felt. “Though economic data releases are not in any way suggesting that the Fed’s QE programme is now in its conclusive stages, recent Fed speak has sparked off significant nervousness in markets,” say Sanjay Mathur and Vaninder Singh of RBS in an Emerging Markets note. “This (Fed statement) gave rise to increased volatility in global capital markets in the recent days,” concurs Debopam Chaudhuri, VP-Research, BluFin, a financial services company. And there is economic worry on this front. Outside of the Philippines, the ASEAN region has suffered the largest deterioration in macro fundamentals. “India will also not be immune but much would depend on the external position when QE is tapered off,” say Mathur and Singh. “Certainly the global demand and growth largely depends on the policies of the US,” says Jayraman. So why would the US winding down of QE affect us in India? “The majority of FIIs (Foreign Institutional Investors) are from the US and if they withdraw money from India, we have no mechanism to counter that,” explains Kishor P Ostwal, CMD, CNI Research. Already, a domestic counter balance for foreign funds is missing. The government especially in the recent past has started to diversify India’s trade basket away from the US. Will that work as a counter balance to the run-down in QE? “India continues to be strongly linked to the US,” says Chaudhuri. Statistics reveal that the US is one of the top three sources of foreign remittances to India. “Also US accounts for as high as 12% of total Indian Exports and approximately 5% of total Indian imports,” he continues. (See Box1) “QE winding-down can affect investments in India, but bilateral

trades will not be affected much,” says Ostwal. “India’s bilateral trade will improve in lieu of additional demand for various Indian products,”

more expensive which is a cause of concern. “Export oriented companies will improve while imports will be restricted owing to higher cost and to that extent the bilateral trade as well,” he continues. And a QE easing may actually be good for India! “In India, we believe a reduction of QE purchases would be very negative in the shortterm, but should bode well over the mediumterm,” say the Nomura team in their analysis. “However, once the dust settles, we expect India would emerge stronger,” the Nomura team continues. While India has benefited from flows, excess liquidity globally has hurt the economy through elevated commodity prices, including gold, which led to high inflation, a large current account deficit, a falling savings rate and shrinking profit margins. “As normalcy returns globally, India’s macroeconomic imbalances should gradually start to correct,” the say. “Any positive development in the US in terms of its economy is bound to have a positive trickle down impact on the Indian economy as well, is our belief,” says Chaudhuri. If QE is withdrawn, it would mean the US economic improvement is being eyed as self- sustained which should be good news for India. “In the event of an extension, it would imply that the Fed continues its support to the US economic growth, which again would not have any negative impact on India,” Chaudhuri concludes.

QE WIND DOWN AND INDIA’S EQUITIES

Will the QE wind down affect Indian equities? “India will be affected, and there is no question of this getting factored in,” says Kishor P Ostwal of CNI Research. Thus, the recent rally is due to the fact that India had been underperforming even though global markets were at all time high. And remember that domestic factors too move the market a lot. “India is on a threshold of growth which is hindered more by an internal policy crisis and political instability,” says K. Jayraman of Bonanza Portfolio. So what are the companies that would be the most vulnerable to the wind down? “IT and export driven companies,” says Ostwal from both the equity as well as the numbers perspective. “Also all companies where the FII holding is very high,” Ostwal continues.

QE EASING AND THE RUPEE

“If US growth is tangible and broad based due to QE easing, the Indian rupee could become weaker by another 5 to 8%. However, if the Indian government, post elections maintains sound economic policy reforms, coupled with a good monsoon, the rupee could recover and stabilize at 55 levels,” says K. Jayraman of Bonanza Portfolio. “The rupee will fall further due to increase in dollar demand,” says Kishor P Ostwal of CNI Research. However, India has sufficient dollar reserves, he notes.

THE CAD EFFECT

“A rapid fall in gold, oil and other commodity prices is setting the stage for a reduction in India’s Current Account Deficit to 4.0% of GDP, though a possible fall in the Rupee and high elasticity of gold demand in India appears to be potential minor risk,” says Debopam Chaudhuri of BluFin. “We are not very certain in the direction of foreign exchange rate, but we foresee a decline in overall volatility of the rate. Regarding Gold, we are forecasting an average decline of 2.8 - 3% its prices in India by Q3 of 2013, which should further help in reducing the Current Account Deficit,” Chaudhuri ends.

he earnings season continues and many past fancied stocks continue to underperform though there may be some marginal signs of a modest turnaround. Stocks which were fancied in the past like Crompton Greaves and Hindalco reported earnings which did not meet market expectations. In the case of Crompton Greaves the earnings reported by the company fell fall below street expectations. For the quarter ended March, the company reported a 74.7 per cent decline in net profit at Rs 25.3 crore, on a turnover of Rs 3,387 crore, a rise of 10 per cent year-on-year. The dismal performance was primarily due to significant erosion in margins and continued losses in the international business. During the quarter, the company’s power systems segment, which accounts for about 60 per cent of its revenue, reported a fall of 2.8 per cent in margins, led by higher proportion of low-margin systems business in the overall revenues. This is a reason why despite the revenue growth, consolidated margins fell

to 2.3 per cent, against 6.9 per cent in the quarter ended March 2012. The consumer business (22 per cent of revenues) recorded 23.3 per cent growth in revenue. The biggest worry stems from the company’s foreign business, which accounts for about half its revenue. The standalone power system business reported a 7.1 per cent Ebit (earnings before interest and tax) margin on a turnover of Rs 836 crore, while the corresponding business for subsidiary companies, including foreign ones, reported a 9.6 per cent fall in the Ebit margin, on a turnover of Rs 1,224 crore. The foreign business which has been a drag on the company’s performance is undergoing restructuring and has begun to yield results, though any significant gains may not materialize in the immediate short run. However, next year could see greater benefits of restructuring of the company’s global business. Benefits of the recent correction in commodity prices should also be seen, and a strong order book should drive growth. In FY13, the company’s order backlog increased to Rs 9,126 crore, against Rs 8,366 crore in FY12, indicating room for growth. The stock which was at a 52 high of Rs 143 and a low of Rs 87 is currently quoting at Rs 93 and it appears that for the time being most of the positives have already priced in the valuations. However, there could be gains for those investors who are willing to take a long term bet on the company. The fourth quarter numbers of Hindalco are a mixed bag. On a comparative basis the fourth quarter numbers continue to indicate the stress in metals and mining. However, if a comparison of the perform-

ance sequentially is identified it shows signs of improvement. While the sequential improvement is positive, the sharp uptick in debt has come as a negative surprise. Compared to last year, Hindalco’s net sales fell nine per cent during the fourth quarter but rose two per cent to Rs 7,000 crore sequentially. Volumes are down compared to last year but sequentially these have picked up. Copper cathode and alumina volumes have remained flat sequentially, though these are substantially down year-onyear (y-o-y). Operating profit rose 11 per cent sequentially to Rs 640 crore, but was down 26 per cent y-o-y. What remains unchanged is the pressure on costs. High input costs (especially higher fuel and power) have kept operating margins under stress, which declined 211 basis points y-o-y to 9.2 per cent in Q4 but expanded 73 basis points sequentially. The sequential improvement suggests things are not worsening. The stock which was at a Rs 52 high of Rs 137 and a low of Rs 87 is currently quoting around Rs 102. Here too it appears that some of the positives appear to be factored in the valuations. However, investors who have a long term horizon could benefit at current prices and further declines. During the earnings season there are several blue chip companies that have reported earnings below street expectations. The below than street expectations earnings results in price declines, sometimes sharp. These sharp declines should be used as an opportunity to acquire these shares at attractive valuations and build up a portfolio with a potential to generate excellent returns over a time frame of a year.

ith the spending on investor awareness now becoming a regulatory requirement, AMCs now have a sizeable corpus to reach out to investors. Based on the current size of the industry, AMCs have roughly Rs. 165 crore at their disposal to spend on investor awareness giving such campaigns a scale and depth that is far greater than what they were doing earlier on their own. This is evident from the activities and campaigns of fund houses and the intensity will pick up further when the rest of the fund houses too roll out their campaigns. While many AMCs are looking at fresh campaigns, others are continuing with their timetested activities, UTI being an example of the latter. Under UTI Mutual Fund’s awareness drive ‘Swantantra’, ‘UTI Knowledge Caravan’ criss- crossed the country covering 48,000 km and 500 towns. It has also come out with multi-language literature that explains investments in a simple jargon-free manner. The fund house now plans to hold investor camps across the country in partnership with TOI. Reliance Mutual Fund claims to have reached out to two lakh investors in its investor awareness program with plans to reach out to five lakh investors in the next three years. RCAM has been conducting its investor awareness programme (IAP) through its learning academy EDGE since 2010. ast month the rupee was hit by many negative points like a record Current Account Deficit, high inflation, the dollar buying by defence, purchases by oil firms and foreign banks squaring off their offshore positions; further the recent global dollar rally; after it was known that the U.S. Fed may gradually wind down its asset purchases, weakened the rupee which depreciated by 4.8%, posting its worst monthly fall since May 2012. It became the worst performer in Asia during the month. The RBI cut interest rates by 25 basis points (one basis point is one hundredth of a percentage point) last month and India saw its inflation figure ease below 5%. However, GDP data on May 31 came in line with expectations, lowering hopes of further rate action. It is recommended to sell the USD/INR on rise as overall the rupee is expected to bounce back. The pivot point for the pair is 56.48. The markets have been very choppy last week. The Nikkei was down by more than 10% in recent days and Treasury yields rose

Simply Simple (PSS), Tata has got something right and plans to build on its success. It is looking forward to taking this initiative further by creating engaging videos that would spread virally and reach out and influence more people along with a separate micro-site to host the lessons and videos. Kotak Mahindra Mutual Fund is using a combination of mass media campaigns with ground events. It has held these events in Maharashtra, Rajasthan and Gujarat and plans to cover more states this year. The print campaign answers questions like ‘what happens if investment is done only during market peaks’ or ‘should an investor get in or get out of equity markets at a 20000 SENSEX level’ and highlights why mutual funds are the most convenient way to access equity markets. Besides print, the fund house will start its awareness campaign in online and outdoor media shortly. Birla Sun Life Mutual Fund has started a campaign called ‘Jaanoge tabhi toh Maanoge’

which aims to spread awareness about mutual funds. The 360 degree campaign has started with radio and a micro-site. Interestingly, DSP BlackRock is targeting women with its ‘Winvestor’ initiative which aims to inspire women of all income levels and ages to empower themselves with financial knowledge. Women advisors called ‘Winvisor’ have volunteered for this initiative. ICICI Prudential has launched ‘Invest Correctly’ to educate mutual fund investors through print, digital and outdoor media. The first campaign focused on using SIPs correctly. The second campaign was to create awareness on debt mutual funds. ICICI Pru has also started a new section on its website which is dedicated to investor education. Quantum Mutual Fund started an initiative called ‘Path to Profit’ where the senior management of Quantum Mutual Fund travelled by road to nine locations in south India. Ethnic Versus Western Segment

ndia is a very different country in terms of opportunities for marketing especially in the context of languages and the ethnic versus foreign factor. To understand India and its consumer behaviour and thereafter to build brands successfully is akin to tight rope walking balancing between the worlds foreign factors and India’s deep rooted ethnic feelings. Let us take the “Dip” category. Early in the morning many Indians like to dip a snack into their morning cup of tea and enjoy and relish the early experience. However, there is one segment which uses “Desi Khari”, to dip in your tea and equally enjoys like the other segment which like to dip in “English Marie” in their tea. A third segment which does both in different points in time. Clearly, there is the ethnic segment which enjoys the khari dips and there is the westernized foreign influence segment which enjoys the Marie Dips. Both these segments co-exist, but smart marketers must sensitively address these segments otherwise there could be confusion or wrong targeting. Britannia Marie Biscuits do extremely well and so do Monginis Khari Dips both addressing different segments – one ethnic and one Western In my opinion, there are three important steps which should be taken to ensure a brand succeeds in the context of there being western and ethnic segment. Firstly, it must be understood that brands are built in the minds and hearts of the consumers and therefore it is not only a word or a brand name that is consumed but also the entire meaning and essence of the brand name that is consumed. The second thing to be understood is that a particular product or service category and its roots are thought about and consumed. The significance of the product category also decides whether it is appropriate for the western or the ethnic segment. Infact many a time the source of the category and the way it is used is crucial in deciding a brand strategy. Thirdly, it is a combination of a suitable brand name and relevant product category coupled with a well thought out segmentation and positioning exercise which determines whether a brand would succeed or fail. It is my strong belief that the ethnic categories if addressed with ethnic sounding brand names and communication and brand personality would have a better probability of success. So also, it is my belief that westernized brand names would have a better probability of success if addressed to western segments. For example, Britannia cheese has a greater probability of success than Britannia Butter (Makhan) in the butter (Makhan category) it is Amul which would do better. Similarly in the chocolate category which is western Cadbury would do better than Amul chocolates. In the hair oil category Nihar, Parachute and Vatika would do better, but in the shampoo category which is western, Pantene, Head and Shoulders and Sunsilk would do better. Clinic which tried to appeal to both Shampoo (Western) and Hair Oil (Ethnic) segments lost out in the confusion even though both products are, used on the head but in the mind they are perceived differently. Clinic Shampoo does well. Not clinic oil. Thus in my opinion, one should be sensitive to ethnic versus western segments, in choice of branding and appropriate segmentation. On meeting Vijay Kedia Director Kedia Securities, one gets the impression of a man who has a most philosophical approach to the equity class. Kedia is a long term investor and prefers to buy majority holding in most of his stocks which may range from 1% to 5%. But what is even more astounding is his view towards the equities’ class. Kedia says, the “Market rewards you as per your perception about the market. If you treat it as gambling den, it will prove a gamble for you. If you treat it as a source of another investment avenue, it will treat you so. Remember, this is the hardest way of making easiest money.” Speaking about his approach, he reveals to Manik Kumar Malakar both his philosophical as well as hard-nosed side about investing in equities.

Your background? My company is 20 years old, but I had started taking interests in my family business of stocks right from my teens in Kolkata. I then moved to Mumbai from Kolkata in 1990 as a sub broker and started from scratch.

At what point had you given a thought to making a career in the stock markets? It was my family business for over a century. I had no choice but to join in. But, I had a strong passion for trading from since I was in school. I always wanted to make a career in the financial market. Tell us a little about your first trade? My first share itself earned me a huge profit. I made my first fortune in 1991/1992 when I identified ACC as a multi bagger.

How do you pick your trades? Do you use technical analysis, or do you employ fundamental data? I do not follow technicals in my investments and I do not follow fundamentals in trading. Both of these are different businesses and thus require different strategies.

How would you describe your methodology? I watch market movement very closely when I want to indulge into trading and then go by my gut feeling. Whereas in investment I follow general principals like judging management credibility, growth in the sector

ndia’s socio-economic structure requires human capital centric approach for sustainable economic development. The diversely qualified work force must be optimally utilized to realize its potential which in turn is crucial for the overall growth and development of the economy. Priority sector lending is a commendable initiative of the government of India to strengthen the social banking & financial inclusion. It includes lending by the organised sector to those sectors that impact large sections of the population, the weaker sections and the sectors which are employment-intensive such as agriculture, and tiny and small enterprises. It envisages the involvement of scheduled commercial banks in the financing of priority sectors like agriculture, Small scale industries, weaker sector development, Education, Housing etc. The origin of priority sector prescriptions for banks in India can be traced to the Credit Policy for the year 196768, wherein it was emphasized that commercial banks should increase their involvement in the financing of priority sectors, viz., agriculture, exports and small-scale industries, as a matter of urgency. However, the description of the priority sector was formalized in 1972 on the basis of the report submitted by the Informal Study Group on Statistics relating to advances to the Priority Sectors constituted by Reserve Bank in May 1971.

What would make you wary about a trade? The moment it behaves in contrast to my expectations.

Do you have a scenario about how the current bull/ bear market will end? Where do you see the Indian markets five years down the road? I think we are in a very early phase of a bull market. The last bull market had a life of 5 years. I expect that a new bull market should also last not less than five years.

What differentiates you from other traders? I am also like the majority of them as my number of losing trades are more than profitable trades.

Of the tens of thousands of trades that you have done, which was your best trade? A Short position in the Nifty in 2008 was the recent best.

What was the story there? In last quarter of Calendar 2008 the whole of the world’s markets had started collapsing, but the Indian market was rising. I found it abnormal and looked for an opportunity to sell.

VIJAY KEDIA What gives you that edge? My losses in losing trades are lesser than the gains that I make in winning trades.

Is there any applicable lesson to trading? Not cutting losses in trading and investing on tips will lead to an end of one’s career on the stock market.

How much of what you do is gut felt? A lot, but only after thorough research and knowledge. When you put money on a trade and it goes against you, how do you decide when you’re wrong?

If one’s trade is going into a loss it has by default been decided that one is wrong. I take my loss and make merry.

Any positions you ever lost sleep over? I always lose my sleep whenever I bring home my trading position in a loss.

Low profitability: Banking all over the world has not been among the most profitable sectors and in India its even lesser. This creates a win-win situation as the Banks get the benefit of penetrating into newer markets which they otherwise might not focus on and the small and medium enterprises get adequate finance at affordable prices from mainstream banking institutions. We have the potential and systems in place to become world super power by channelizing our resources in productive avenues and bringing everyone in the mainstream economic activity for fast track economic growth of the country. There is plenty of opportunity to grow for the economy as a whole by increasing the Banking reach for the common man.

Lessons From Dubai

D

uring my recent visit to Dubai about 2 weeks ago it was quite evident that just like many countries, including India, signs of recession are clearly there but not as severe as during my previous visit to Dubai 3 years ago, when it was in the grip of severe recession. At that time construction of most planned skyscrapers had come to a standstill and you could see half constructed tall buildings with overhead cranes not working.In fact, major construction giants including Emaar, the government owned company, and many others had sacked workers including top level executives. Although the Dubai Metro was started on schedule on 09/09/09, when I went in early 2010, only a few metro stations were operational, and many were still under construction. Even operational stations wore a deserted look and there were few passengers on the trains when I took a ride. This time however there was cautious optimism as most tall buildings have been completed, but metro rates have doubled and they have reduced the frequency of trains. As a result the metro is jampacked like Mumbai local trains, with hardly any breathing space. Food inflation is also dramatic but the only comforting factor is that petrol is available at 1.5 dirhams a litre or Rs. 22/litre (1 dirham = Rs. 15 approx). Despite this there was a flood of tourists, mainly from developed countries. There was so much of demand for tourist attractions like Burj Khalifa, the tallest building in the world that it was difficult to get tickets to go to the observation deck on the 124th storey of this 165 floor building. That too even though it was open from 9 am to 9 pm with half hour slots, and tickets as expensive as 130 AED (Dirhams), which roughly amounts to Rs. 2000 per head. It was difficult to get tickets even 15 days in advance and if you wanted a last minute ticket it officially costs 400 AED, but even then availability was not certain. I have been to Dubai 4 times in the last 10 years and each time I find there is a new tourist attraction. This time around there was a new cable car ride which was 2.5 km long, but unfortunately it was closed due to maintenance. Apart from that they were in process of constructing a 15 km long tramway, all along which there were street cafes like in Paris or Melbourne. Also the Atlantis Mall built around a huge aquarium inside has been one of the top tourist destinations for the last few years. Last time I went there, a good part of this aquarium, which has huge fishes, big and small, for which the entry was free and even the free portion of the aquarium was breathtaking. The entrance to the paid portion called the Lost City was around 60 AED. But now the ticket for the Lost City has increased to 100 AED and the portion for which entry was free, now has a ticket of 30 AED per head. Yet I saw large groups of Chinese tourists buying tickets and trooping in. In a span of just 20 minutes hundreds of people paid to see this marvel. Another tourist attraction they have added is a zoo, which is spread over 40 to 50 acres with Giraffes, Lions and wild animals from across the world. That’s not all - besides tourism, Dubai is building the Medicity and Knowledge City, where it has already invited universities like Cambridge to attract students from Asia, mainly India and China. Medicity plans to have the best healthcare facilities. The recovery though slow by Dubai standards, it has been much faster than in India.

NSE India : CNX Nifty — Daily Market Report for: Monday (June 03, 2013) By Dominic Rebello

REVIEW OF THE PREVIOUS DAY:

The Nifty fell substantially on Friday (May 31, 2013) a net 138.10 points (2.26%) and closed at the 5985 point level. The market opened down with a gap at the 6098 points level. It then rose by a few points and registered the day’s high at the 6106 points level at 9.16 a.m. The index then declined sharply into the red and turned into a range bound movement until 2.44 p.m. It then declined further and registered the day’s low at the 5975 points level at 3.17 p.m. and then turned into a range bound movement until closing at the day. The Nifty remained below its previous close throughout the session, moved in a range of 131 points and closed below the psychologically important 6000 points level. Sentiment was extremely bearish and amongst the 50 Nifty stocks 45 were losers, while just 5 stocks managed to close in the green. All the sectoral indices barring IT closed in the red. Heavy selling was seen in realty, oil & gas, banking and FMCG stocks.

TECHNICAL ANALYSIS: Volume: Volume (Qty shares) increased 3.41%. This change is small and indicates a moderate participation by investors. Market Breadth: Overall Market Breadth on the NSE was negative. Amongst all the traded stocks, 368 were gainers, 1051 were losers and 49 remained unchanged. Slow Stochastic Indicator: The Slow Stochastic Oscillator has declined in the neutral zone. The Slow K line in the Stochastic Oscillator has dropped below the slow D line (negative and a sell signal). RSI Indicator: The RSI is above the 40 level but is now declining (negative if it continues). MACD Indicator: The MACD is above zero but is now declining (negative if it continues). It is below its 9-day Average (negative). ADX Indicator & DI Lines: The +DI line is below the –DI line and both lines are diverging (negative if it continues). The ADX is falling while the Market Index is falling, which indicates that the present down trend is decreasing in strength. MOVING AVERAGES (TREND INDICATORS) The index: Has crossed below its 5-day average (at 6081) Negative. Has crossed below its 15-day average (at 6080) Negative. Has crossed below its 25-day average (at 6052) Negative. Is above its 200-day average (at 5776) Positive.

Overall Market Strength/Weakness: The indicators and oscillators discussed here are indicating a neutral market but with a negative bias. Support Levels: For short-term traders the immediate main support is at the 5942 points level. The next support is at the 5867 points level. Resistance Levels The immediate main resistance is at the 6223 points level. The next resistance is at the 6357 points level. Pivot Point Analysis: For intraday traders the support and resistance levels are calculated according to the pivot point theory and are: Pivot point = 6023 (This is the level where the trend is likely to change during intra-day). Support (1) = 5939. Support (2) = 5892. Resistance (1) = 6070. Resistance (2) = 6153. OUTLOOK FOR TODAY:

On Japanese candlestick patterns the index has formed a long black body candle on higher volumes. In fact yesterday’s candle is almost like a Black Marubozu candle. (A Black Marubozu forms when the open equals the high and the close equals the low). This is negative. Further, the index had crossed below the 5, 15 and 25 day’s moving averages in a single session. Moreover, the velocity parameters which were neutrally trended have now turned negative. All these indicate a negative bias and the possibility of a further decline unfolding. Investors are advised to avoid buying at present levels.

CMP: Rs. 296 Target Rs. 378 Results in‐line: Aban’s Q4FY13 results were in line with expectations, with revenues at Rs 9.6bn, 19.5% YoY and 5.6% sequential growth. Margins stood at 52.4% as against 53.63% in Q3FY13 and 52.4% in Q4FY12. On account of lower ETR, PAT grew by 91.6% QoQ and declined 24.3% YoY. During the quarter, all vessels, with the exception of Tahara, were working. Fleet Status: In March 2013, Aban Ice and DDI went off-contract. Of these, DDI has already been re-contracted and will commence operations from July 2013 onwards. Aban Ice is currently being marketed. Further, Aban 7 completed its contract in the month of May 2013 and is also being marketed. New Contracts: DDII, IV & V, which were contracted in the Middle East and whose contracts were to expire in September 2012, have all been recontracted with the same parties. DDVII, whose contract ended in December 2012, got into another contract immediately in Mexico for a period of 1005 days at a healthy operating day rate of US$151K. DDI was also contracted at a healthy rate of US$158K for a period of 1115 days. Valuations: Aban currently trades at a PER of 6.9x FY14 and 5.2x FY14. Given the strong fleet status, whereby, the risk over the next couple of years is mitigated, we maintain our positive stance on the company and value it at 6x FY15 which translates to Rs 378.

SBICAP SECURITIES CALLS A ‘BUY’ ON ZYDUS WELLNESS

CMP: Rs. 596 Target Rs. 726 Zydus Wellness Ltd. (ZYWL), a subsidiary of Cadila Healthcare Ltd. is into manufacturing and marketing of niche wellness products, having plants at Ahmadabad and Sikkim. It offers wellness products, combines best of healthcare, nutrition and cosmeceuticals. All its products, viz., Sugar free, Nutralite, EverYuth and Actilife; cater to the evolving needs brought about by change in lifestyle and surge in chronic diseases. Being an early entrant, with launch of Sugar Free in 1988, it has successfully gained over 90% of the market share of an artificial sweetener. Over half of its revenues have been contributed by Sugar Free and EverYuth, we expect these two products continue to drive the revenues and Nutralite to provide some support to the overall margins as vegetable oil prices are cooling off. We initiate coverage with a target price of Rs. 726 and BUY rating. Investment Rationale: Leader in an artificial sweetener - Sugar Free to sweeten overall business: Over the years, Sugar Free brand has successfully captured 92% of the total market share of an artificial sweetener market. If we lightup the history, it was firstly launched in 1988 as an ethical drug and promoted through doctors for diabetic patients. Sugar Free product has very strong brand equity and it is always on the top of the buyers' mind when it comes to the sugar substitute. With launch of Sugar Free in 1988, it had made people aware about an artificial sweetener and created the demand for the product, in a way industry has been created and developed by the Zydus Wellness, in India. As on 31st December 2012, ZYWL is a market leader with more than 90% of the total market share. Of late, many MNCs and domestic companies have jumped in, to eat the fruits sown by the ZYWL, this has led to single digit growth in the last 3 quarters. To remain competitive, it has rolled out an aggressive ad campaign, roped in many big celebrities and extended its Sugar Free brand, viz., Sugar Free Gold, Sugar Free Natrura, Sugar Free Herbvia and Sugar Free D'lite. Sugar Free Gold is the highest selling product followed by Sugar Free Nutra and margins are also superior as compared to other extensions, due to lower input cost i.e. Aspartame. An artificial sweetener industry has a real growth - as sugar consumption is on rise, led to an increase in diabetes population in India: India is the world's biggest sugar consumer, with a population of 1.2 bn, consuming one-third more sugar than the EU and over 60% more than China, but still India’s per capita consumption of sugar is around 20.2 kg, below the global average of 24.8kg. NG Golden Years Retirement Plan is a Regular Payment Deferred Variable Annuity Plan. It is a Traditional Plan without Bonus facility. In this plan, payment can be made in a lumpsum under Single Premium Paying Option or for a limited tenure under Limited Premium Paying Option or throughout the Policy Tenure under Regular Premium Paying Option. The Vesting Date, from when the Annuity or the Pension would begin needs to be specified at the start of the plan. This date shall be the vesting date of the retirement plan and the period till the vesting date shall be the vesting term chosen. All premiums paid by policyholder, subject to the deduction of all applicable charges, will be transferred to an Individual Pension Account which earns an interest of: • Minimum Floor Rate Interest of 1% p.a. compounded for the entire vesting term. • Additional Interest Rate of 4% p.a. compounded for the first 5 years and 0.5% p.a. compounded for the remaining years. • Residual Addition of Interest from the end of the 5th policy year. There is Loyalty Benefit also available in this plan for total premiums paid for Rs. 4,80,000 or more, including Top Up Premiums such that the Allocation Charges collected throughout the Policy Tenure is credited to the Individual Pension Account, provided all due premiums are paid. On vesting, i.e. on completion of the Policy Tenure, there is an option to the policyholder to opt for Annuity from the entire corpus or withdraw 1/3rd of the same tax free and then opt for Annuity from the remaining 2/3rd. The annuity needs to be purchased at the prevailing Annuity Rates from ING Life. However, if the policyholder dies before the Vesting Date, the nominee will get the higher of 105% of gross premiums paid including top-up premiums till the date of death, Total premiums including top-up premiums compounded at 1% p.a. till the date of intimation of death or Balance in the Individual Pension Account + prorated interest from last policy anniversary till the date of intimation of death as Guaranteed Death Benefit and the policy terminates. EW DELHI: Four youths were arrested here for allegedly duping a Kerala-headquartered private financial firm by claiming that its gold were robbed by unidentified men two days ago, police said on Sunday. The arrested included two employees of Muthoot Finance, reports PTI. The firm was duped of around 3.4 kg of gold worth around Rs 80 lakh. Police have recovered 2.6 kg of gold and Rs.10 lakh in cash. Sreejith (30), Assistant Manager with Muthoot, Girish Chand (38), an office boy, and their associates Amit Advani (30) and Sandeep Khatri were apprehended on Saturday a day after the alleged robbery incident was reported to police, DCP (Central district) Alok Kumar said. Girish had told police that two men had snatched the bag containing gold at gunpoint. "As per the version of Girish, Sreejith had gone to the branch with his bag and he was alone when the incident took place. "During probe, the version of complainant Girish was not found to be satisfactory. Primarily, on the point that soon after the incident of his bag being robbed which contained gold jewellery items worth about Rs 80 lakhs, instead of raising a hue and cry, he made a phone call to Sreejith and informed about the incident," Kumar said. Girish and Sreejith were followed closely and during sustained interrogation, Girish broke down and confessed about the conspiracy, he said.

EW DELHI: India has asked the US to ‘temporarily’ hand over LeT terrorist David Headley for a year and extradite his accomplice Tahawwur Hussain Rana to get more information about the conspiracy hatched to carry out Mumbai terror attacks. In its fresh efforts to get access to the Pakistani American terrorist, India has conveyed to the American interlocutors to ‘temporarily’ hand over Headley for a year after the US ex-

pressed its inability to extradite him. The request was made during the Indo-US Homeland Security Dialogue held in Washington between May 20-22. "The US interlocutors assured us to actively consider the request," a top Indian official, who participated in the meeting, told PTI. Washington also assured New Delhi to positively consider the request to extradite Headley's friend Rana, who helped Headley to recce the 26/11 targets.

What is the scenario of your show? The show explores the tranquil tale of blossoming love between two pious souls, Raghu and Antara, in ‘Do Dil Ek Jaan’. The show will capture the travails of two lovers who are brought together by destiny but their journey is marred by testing ordeals. I play Raghu and Nikita Sharma will essay the role of Antara in ‘Do Dil Ek Jaan’ that premiers on June 3 at 9 pm on Life OK. This is the story of lovers from conflicting backgrounds who strike a chord at first sight. Antara suffers from a personal loss and finds solace in Raghu, the ideal son to his godmother Daya maayi played by

Ayaz Ahmed, who has been a part of ‘MTV Roadies’ and shows like ‘Crime Patrol’ will be seen in a lead role in Life Ok’s new show ‘Do Dil Ek Jaan’. He is happy about being cast in a prime time show and he shared his thoughts with us in a brief telephonic chat. Here is what he has to say

Are you open to reality shows or anchoring shows? Reality shows only as I am comfortable with the concept. But anchoring shows is just something up my street and something which I enjoy as I was also a RJ with a popular FM channel. What is the work that you are proud of? I am especially proud of ‘I Luv My India’ on SAB TV and ‘Gumrah’ on Channel V.

What has your journey been like till now? I am from Kolkata and have been in Mumbai for the last four years and have done a few major shows but this is my biggest break. How is it, working with your costars?

Don’t pay for plastic bags without price tags J

ust about every shopkeeper even mall in Mumbai even across the nation has begun to ‘charge’ for plastic bags they provide to carry goods purchased. They even offer you a ‘choice’ to buy one and don’t quite force you into purchasing it, should you carry your own bag. What makes things worse is that, despite violating The Standards of Weights and Measures ACt, 1976 that clearly lays down the rule on goods having to sport a maximum retail price tag, they display notifications by the local civic authority - the BMC - justifying the act. While nations all over the world have been steadily winning the war against plastic, through niche legislation and advocacy, India seems to lack the seriousness! While permitting a surge of loopholes in the law, the campaign against plastic falls flat. In a seemingly-orchestrated attempt to vindicate the act, there are reports about how ‘charges’ levied on plastic bags have acted as a deterrent and reduced the consumption of plastic bags in India. The problem, however, is the openended implementation of rules that leaves consumers twiddling their thumbs and the retailers left to do as they please.

MIAL refused to answer stating that it was not a public authority and therefore doesn’t come under the ambit of the RTI Act. However, a Central Information Commission ruling on the case declared that MIAL, owing to its benefiting from public concessions such as the waiver of a substantial stamp duty and functions on land leased cheaply from the Airports Authority, should be held accountable under the RTI Act. Earlier this year, Indian Railway Catering and Tourism Corporation (IRCTC) was slapped with a fine of Rs 10 lakh by a consumer forum for selling soft drinks above the maximum retail price (MRP) to two customers. As in the two cases, most retailers are known to charge over and above the MRP printed on the products. Not having a price tag at all gives retailers a completely free hand in charging customers at will, irrespective of what the BMC notification reads.

IN 2011 the Environment ministry issued The Plastic Waste (Management and Handling) Rules, 2011 to check the use of plastic. These Rules included a section called ‘Explicit pricing of carry bags’. Accordingly, under this section, it was held that ‘no carry bags will be made available free of cost to the consumers by the retailers. The concerned municipal authority may determine the minimum price of the carry bags.’ Now, the Brihanmumbai Municipal Corporation (BMC), on its part, issued a notification to all shopkeepers – small and big, that read - As per Rule 10, of the Govt. of India, Ministry of Environment and Forest's Plastic Waste (Management and Handling) Rules, 2011, no carry bags shall be made available free of cost by Retailers to the Consumers. The notification also clearly stated that the retailer will display the size of the bag and their respective price at a prominent place for consumers to see. Also, according to this Rule, BMC gave guidelines and asked retailers to charge shoppers a minimum of Rs two for 8 inches x 12 inches bag, Rs four for 16 inches x 20 inches bag and Rs five for 20 inches x 25 inches bag and Rs six for more than 20 inches x 25 inches bag.

offence, with imprisonment for a term which may extend to two years and also with fine. Accordingly, selling a plastic bag without an MRP displayed on it or without printed ‘the sale price’ is illegal and invites imprisonment for a term which may extend to six months or fine to the tune of Rs 1,000, or both. So, for a shopkeeper, mall or a retail store to sell a plastic bag without a printed price, even while providing a bill for the same, is violative of the law. While the BMC did their bit and issued a notification concerning the pricing of the plastic bags, the onus of ensuring retailers abide by the law and the government earns its rightful dues by way of tax from the from the sales of plastic bags lies on the Legal Metrology department. So, the next time, someone forces you to pay up for a plastic bag...do so, take a receipt and file a complaint with the Legal Metrology department and ensure that the retailer is fined by law. HE last ten years have been the most tragic time for Indian democracy. During this period scam after scam came to light scam whose names, the money involved and their dimensions could never have been imagined. The amazing thing was that poor farmer’s money, their water, their land and animals none escaped being looted. Sixtyfour years of Indian democracy and Parliamentary traditions were seen being torn to shreds in the last ten years. In fact, in these ten years, the essence of the system that is called governance was totally wiped out of existence. Let us take up the Coal Scam first. When Chauthi Duniya first disclosed that a massive coal scam of Rs. 26 lakh crores had taken place in the country, then maybe nobody believed it. This report published in Chauthi Duniya was not based on any estimate, but was based on a report of a Standing Committee of Parliament. Later on the CAG gave its report and disclosed how in the coal block allocations, a loss of Rs. 1.86 lakh crores had been incurred. The CAG raised direct questions against the UPA Government and stated that in the coal block allocations the Government did as it pleased and chose to do arbitrary allocations . The 2G spectrum scam is in itself a unique scam. What was sold and what was purchased, the common man is unable to under-

Not only were rules ignored for this by ISRO, but the Prime Minister Office became suspect and came under the scanner. When the Bofors scandal had hit Indian politics, chaos had been created. In the continual scams that are taking place under the UPA Gov-

ernment, another scam is that of the Commonwealth Games (CWG). According to an estimate, this scam is of close to Rs. 80 thousand crores. In this scam, the CWG President and senior Congress leader Suresh Kalmadi and his colleagues came forward. Alongside, the connivance of the Congress Government of Delhi also came to light. Lalit Modi, who played a major role in establishing IPL not only lost his preeminent position but also now has to live outside the country. Investigations are still continuing even as the new IPL 6 scam has shocked the nation. The subject of black money being involved in the game has been a matter of much talk. The Kochi team ownership controversy deepened so that Union Minister Shashi Tharoor had to resign over this matter and his friend (now wife), Sunanda Pushkar also come under the scanner and was faced with lots of questions. Before IPL 6 broke, the scam amount in IPL was estimated at more than Rs.1,500 crore. The insensitivity of the Government is such that it did not hesitate to lay its hands on the money that should rightfully have been that of poor farmers. The result was the farmer’s loan waiver scam. The amount set aside for farmers loan waivers through an initiative by the present Congress Vice President and ‘successor’ Rahul Gandhi has also been gob-

bled up scamsters. According to the CAG report, tremendous irregularities have been found in the loan waiver scheme sum of Rs. 52 thousand crores. In Vidarbha in Maharashtra, where there is unprecedented drought, an irrigation project scam of crores of rupees has come to light. Known as the Maharashtra Irrigation Scam, it forced Deputy Chief Minister Ajit Pawar to tender his resignation. Obviously, this water was given to industries.Instead, the shameful thing is that Sharad Pawar’s nephew and the State Deputy Chief Minister Ajit Pawar made an offensive and objectionable comment on this issue by saying that if there is no water in the canal, should I urinate and take that water there? The UPA Government has also made a new record in scams in defence and security related matters. For instance, there is the NTRO (National Technical Research Organisation ) scam. The NTRO is a secret Government institution. Here too, in the purchases made of close to Rs. 1,000 crores, many irregularities came to light. In other words, this country’s security is dependent on brokers and middlemen. Nobody knows when this series of swindles, scams and scandals will end or whether it will ever end. There are many other shocking scams too like the thorium scam, the Reliance-KG basin scam, MGREGS and so on.

Last week this column reported that Sujatha Singh, ambassador to Germany, is strongly tipped by babuwatchers to be named the next Foreign Secretary, being next in seniority to the present incumbent Ranjan Mathai. If that indeed happens, Ms Singh will not be alone at the top. It is also rumoured that Sindhushree Khullar, who was given a two-year extension as Secretary of the Planning Commission barely two months ago, and is also overseeing the Direct Benefits Transfer scheme of the UPA government, may well be appointed India’s next Comptroller and Auditor General (CAG) after Vinod Rai retires at the end of the month. Meanwhile, a little bird tells us that Delhi is likely to get a woman police chief after Neeraj Kumar retires next month. The name of 1977 batch IPS officer Kanwaljit Deol is being mentioned as Kumar’s replacement.

Fresh trouble?

THE ongoing tussle between SEBI and the Sahara Group has shadowed a curious sideshow at the Supreme Court, involving SEBI’s chairman U.K. Sinha and a letter purportedly written by M Abraham, a Kerala-cadre IAS officer and member of SEBI to Prime Minister Manmohan Singh with reference to the appointment of Sinha as SEBI chief in 2011. According to sources, a PIL has been filed before the Supreme Court seeking removal of Sinha as SEBI chief due to alleged irregularities in his appointment. Among the names dragged in is that of Omita Paul, now Secretary to President Pranab Mukherjee, but who was advisor to the then Finance Minister. The Government has apparently opposed the PIL as “motivated”. What next? Going by the UPA Government’s recent troubles, we can expect anything!

Corruption stain

INCREASED corruption in the state administration is something that should worry Jammu and Kashmir Chief Minister Omar Abdullah. The State Vigilance Organisation (VO) is currently investigating around 170 cases of graft and possession of disproportionate assets by the State’s babus, including several senior bureaucrats. Sources say that though the Government has sanctioned prosecution in 210 cases since 2009, curiously, the conviction rate is almost nil! Only one bureaucrat, Adil Rashid Naqash, was dismissed last year for misappropriation of the public exchequer to the tune of Rs. 22 crores. Among those currently facing prosecution, according to a senior vigilance officer Javaid Koul, are a former Secretary, a former Special Secretary, a former Divisional Commissioner and one incumbent Deputy Commissioner all very senior officials. EW DELHI: Back in the side after London Olympics last year, star drag flicker Sandeep Singh has credited his friend and Indian cricketer Harbhajan Singh for helping him come out of the bad phase that sidelined him from the national squad for nine months. Sandeep returned to the national-fold for the upcoming FIH World League Round 3 (semifinals) to be played in the Netherlands after being dropped from the Asian Champions trophy, Champions trophy, Azlan Shah cup and World League Rd 2 played earlier this year. “Last few months were tough for me and I was stressed. HENNAI: Bowing to all-round pressure, N Srinivasan today agreed to “step aside” as BCCI President under a compromise formula that brought back former Chief Jagmohan Dalmiya as head of a four-member “interim arrangement” to run the Board, more than a fortnight after the spot-fixing scandal rocked cricketing world. In a decision in which the proSharad Pawar group appeared to have suffered a dent, the Working Committee of the Board decided that Dalmiya will conduct its dayto-day affairs after Srinivasan announced that he will not discharge his duties as the President till such time the probe is completed. Sources said that key members including Arun Jaitley, Rajeev Shukla and Anurag Thakur appeared to have tilted the scales in favour of Dalmiya and softened the

He then narrated two incidents involving three players allegedly involved in spot-fixing and the Gurunath Meiyappan betting issue. He then told the committee about the resignation of Jagdale and Shirke and that it was unacceptable. Jaitley, a Vice President, participating in the meeting through video conferencing in Delhi, expressed concern about the credibility of the Board taking a beating because of the actions of the three players and Gurunath. “Step aside till the pendency of inquiry and not discharge any presidential functions for a free and fair probe,” Jaitley told Srinivasan which he immediately agreed.

HENNAI: Former BCCI President I S Bindra today slammed the Board’s Working Committee for allowing N Srinavasan to just “step aside” instead of resigning as the body’s chief, calling the proceedings a “sham” and “worse than match-fixing”. “I have the minutes and notes of the meeting. I categorically asked for his (Srinivasan’s) resignation. I said this sham will not satisfy the public. I said he should resign and come back if exonerated. He (Srinivasan) said he will step aside but not resign at any cost,” Bindra, whos is currently the Punjab Cricket Association President, said after the meeting here. “He (Srinivasan) is not resigning. He is just stepping aside for one month. This is taking the public for a ride. We needed something more than this. The decision is worse than match-fixing. I suggested, let him step aside until September, but he said he is not going to resign,” he said. Bindra claimed that he was the only person in the meeting to have asked Srinivasan to resign. EW DELHI: Jagmohan Dalmiya, who was shunted out unceremoniously eight years ago by the BCCI, today rose from the ashes like a phoenix to repair the damage caused by one of the worst scandals to hit Indian cricket. The 73-year-old administrator, who has also served as an ICC President, was once credited with making cricket a money-spinner in India but had to make an inglorious exit seven years ago when charges of financial misappropriation were slapped on him. The Kolkatan came into the BCCI way back in 1979 and immediately made an impression along with his friend-turned-foe Inderjit Singh Bindra. The dynamic duo was at the fore-

front in bringing the World Cup to India and commercialise the game to rake in the moolah which made BCCI the richest cricket Board in the world by the time 90’s arrived. He was elected Chairman of the ICC in 1997 and managed to make the cash-strapped body a profitmaking one with tactful commercial moves which involved selling TV rights and making cricket attractive to the advertisers. With this, he also ended the west’s domination in the game and initiated the era of sub-continental prominence which is still continuing. But he had to quit ICC under acrimonious circumstances when a controversy erupted over the sale of TV rights.

His ICC reign ended in 2000 and the very next year, he was elected President of the BCCI beating A C Mutthiah in a well-fought board elections in 2001. That ended in 2004 but he managed to pull the strings in the election to get his favoured candidate Haryana’s Ranbir Singh Mahendra beat union minister and Maharashtra strongman Sharad Pawar 16-15. With scores tied at 15-15, Dalmiya gave a casting vote sitting in president’s chair to pull it in Mahendra’s favour. But the next year, tables were turned on the man, who had not lost an election till then, Pawar coming to power with a resounding win by 21-10 margin. The defeat also led to the present

BCCI regime slapping charges and cases of fund misappropriation against him. The new BCCI regime asked him to present details of a transfer of Rs 400 million (USD 85.5 million) from an Indian Overseas Bank account in Bhawanipur to the Cricket Association of Bengal (CAB), of which he was the president from 1996 to 2005. The BCCI accused Dalmiya of misappropriation of the 1996 World Cup funds and filed a complaint against him at a Mumbai police station in 2006 within months of him getting re-elected as CAB President in pitched election where he defeated erstwhile CM Buddhadeb Bhattacharya backed commissioner of police Prasun Mukherjee 61-56.
