n internal dispute has ensured that a majority of the flat-owners of the Shree Ganesh Co-op Housing Society, located on CIDCO plots in Nerul (Navi Mumbai), are yet to be made members of the society. To gauge how big the problem is, one must realize that the plot in question stands on land admeasuring nearly 5 acres in sector 28(1) and sector 22(8). The plots were leased out by CIDCO way back in 1993 to decongest south Mumbai, by shifting commodity markets and traders’ residences to the new city. But since most of the traders

Will the state government’s decision to cap off 35 colleges in FYJC online admissions facilitate students?

Hardik Tanna Student

The cap of 35 colleges is a nice move. It will help students.

Maharudra Kapse Lecturer

Online systems will facilitate travel time and efforts of students and parents. Besides, students will get a college of their choice list of 35 colleges, provided students should score enough.

Siddharth Kumar Professional

I don’t think that it will help. What will happen if the score’s are low and students do not get admission in the listed colleges?

Munna Hakke Student

It will really facilitate students as they don’t need to go all the way to colleges to fill the forms.

Abha Dhole Student

The cap will not help.

ernment formation, and possibly fulfill his life time ambition to be crowned the Prime Minister even if it is short-lived. But barring his own trusted loyalists in the state cabinet, none seem to be in favour of his ploy to field them for the Lok Sabha polls and bringing new faces in the state cabinet, albeit to duck the anti-incumbency factor on both the fronts. What many are perplexed about, though is that in a span of just two months his nephew Ajit Pawar had to resign as Deputy Chief Minister over alleged involvement in the Irrigation scam. The question is that if he wanted to put pressure on the Congress or give it a sudden jolt as they say, why did he not do so then? Oath taking ceremonies at Raj Bhavan do cost a fortune. For a man who despised talking of state politics after becoming a national leader, to once again pay attention to matters of state and engage with Uddhav Thackeray over the Racecourse issue goes to show that ultimately it is hard to resist your own local constituents.

ill the Congress high command succumb to the pressure tactics of Union Agriculture Minister and NCP boss Sharad Pawar and remove Chief Minister Prithviraj Chavan? Though the Congress high command has not given any indication, till last night, that Chavan would be moved out, predictions in most surveys about trouble in the state have alarmed Congress bigwigs. By securing the resignations of all 20 ministers of his party, Pawar has virtually mounted pressure on the Congress to undertake a ministry reshuffle. The armtwisting tactics have come in the middle of a campaign by Congress legislators to remove Chief Minister Prithviraj Chavan. The NCP chief strongly feels that the state government requires an urgent surgical makeover, and believes that winning elections under Chavan’s leadership would be difficult. Prior to that, many Congress MLAs told the high command that continuing with Chavan as Chief Minis-

ter would bring electoral ruin for the party in the Lok Sabha and Assembly elections, scheduled next year. The MLAs have pointed out that Chavan is an administrator, not a leader, and does not pay any heed to their demands or requests. This attitude might invite trouble for the party. But Central leaders of the Congress are of the opinion that Chavan has a clean image and the MLAs are angry because he is playing by the rulebook. The good image and excellent rapport with the high command has so far saved Chavan, but the various recent surveys and the resignations by NCP ministers may force the party leadership to do a rethink. According to sources, Union Home Minister Sushil Kumar Shinde is being seen as the frontrunner, though he is reluctant to come to Mumbai before the elections. Although Narayan Rane is trying hard to become CM, his Sena background creates suspicion amongst traditionalists. In light of these developments, all eyes are on the Congress high command.

Having been labeled "rancid pickle", it is hard for the feeble, infirm old guard to contain Modi. The scare both within and outside the party is visible from the kind of statements that are being made. From the infamous Gujarat riots to questions over his development model, everything has been thrown at him. The national executive conference in Goa resembles more a sick bay with almost all the senior leaders down with mysterious illness. With the principal opposition party in disarray and the ruling Congress grappling with its own set of problems, the situation does not bode well for the nation. selves down the years. Here we bring some of his interesting anecdotes for you. It so happened that once former Peasants and Workers Party leader turned Congressman Yashwantrao Mohite happened to visit New Delhi to meet Congress president Indira Gandhi. Those were the days when Rahul Gandhi was still in the cradle. After his Delhi visit, Shinde caught up with Mohite at the Karad guest house and inquired how his Delhi visit was. Pat came a wily response from Mohite “Well, I went to Delhi, met Madam and afterwards leaned towards the cradle and offered a rattle to Rahul and whispered in his ears – son do not forget me when you grow up!” Do you know why the uncle-nephew duo of Sharad Pawar and Ajit Pawar hold such a sway over politics in Western Maharashtra? Because every other young IAS or MPSC cadre officer who cuts his teeth, as it were, in the state administrative set up in his formative years, usually has to do the hard grind in what is infamously called the Baramati Administrative Service (BAS) or the Pune Civil Service, a plagiarized version of the provincial civil service of the old. Once passed out of this unwritten rigmarole, you are guaranteed the blessings of the first family of Maharashtra till you retire for good.

hen it comes to monsoon prediction, often the weatherman and even the Agriculture minister and department officials are way of the mark. Little wonder then that for the last three years the state has been reeling under acute water scarcity. The scarcity itself spawned corruption in the Irrigation and Relief and Rehabilitation departments. But these days everybody loves a good drought for the windfall that it ensures. This time yet again union Agriculture minister Sharad Pawar has predicted a good monsoon. Take that anyway you wish. We had already stated that the political moves of NCP chief Sharad Pawar have become far too predictable. After having sought the resignations of all the 20 NCP ministers, the NCP strongman, while speaking at Chakan near Pune, went on to remark that it would rain bountifully this year. But to encash a good monsoon, you have to till the land well and sow good seeds to reap a bumper harvest. In other words the NCP chief wants a bumper harvest of maximum number of MPs in the 2014 Lok Sabha rainfall so that he can extract a maximum support price when it comes to haggling over gov-

First rains lead to slab collapse in MHADA society at Currey Road

The first heavy showers of the season witnessed a slab collapse at Om Pimpleshwar Society at Currey Road.

F

irst heavy rains of the season yesterday led to a slab collapse at Om Pimpleshwar Society along Mahadev Palav Marg, near Currey Road station. The slab on the front gate of the MHADA building suddenly came crashing down. However, no casualty was reported according to local resident Bala Desai. Speaking to ADC, Desai disclosed that the incident occurred at around 3.30 pm. The building was built 15 years ago under the Prime Ministers Grant Project in 1998. Desai alleged that since the building which has six wings was constructed under the PMGP the MHADA Repair Board authorities have been rather reluctant to carry out repairs. The society has been managing repairs out of its own funds. He added that a lone MHADA officer had inspected the building about a fortnight ago. But since most of the officers in the Repair Board have now been transferred due to promotions there is no headway in undertaking repairs. Desai stated that even noise from small firecrackers is enough for portions of ceiling to collapse.

onsoon is here and to counter the emergent traffic problems the Mumbai Police Traffic Department have come forth with a unique initiative. To aid commuters the Traffic Department has divided parking lots into two slots: major and minor. Major parking lots being those that allow over 1,000 vehicles to be parked at once while minor parking lots only have space for 50-100 cars. The traffic department has placed all pertinent information regarding the locations and other ancillary information about these lots on their website to aid citizens during monsoon generated emergencies. According to Deputy Commissioner of Police (DCP-Traffic)

Pratap Digawkar, “We made available 94 lots to Mumbaikars who are facing parking related problems during the monsoons.” Some of the lots you can park in during emergencies are at P D’Mello Road in south Mumbai, or the Northbound side of Siddhivinayak Hotel, or at Mahalaxmi Racecourse at Keshawrao Khadye Road, Cotton Green BPT Ground, MMRDA Ground BKC, KJ Somaiya Hospital Chunabhatti, Rani Baug (Jijamata Uddyan-Byculla). Minor parking lots are at Azad Maidan, all Gymkhanas including Police Gymkhana, Parsi Gymkhana, Islam Gymkhana, BEST Ground in Malad, Xavier School at Kurla in Kajupada. “The details regarding the lots can easily be procured at the Traffic dept. website,” said Digawkar.

Cops reunite ‘missing’ girl with dad

n Saturday night, Mumbai police arrested a woman, for abandoning her three-andhalf year old daughter, and her paramour for helping her. In the process the cops united the girl with her original father nearly a year after she was abandoned. Shivaji Park police arrested Ahmed Sheikh (35), who along with Sheetal Lohade (27), had abandoned the latter’s daughter at Dadar’s flower market area. The incident happened in September 2012, in which the two accused, in a bid to get rid of the girl, who Sheetal had sired with her first husband Sachin Lohade, abandoned

her and started living together at Sheikh’s house in Pune. In March this year Sheikh filed a missing person’s complaint at Shivaji Park police station. This step by the accused was a misdirection intended to prevent his arrest in future, if the police ever came across the girl. However, in June the police grilled Sheikh and he broke down and confessed to the crime, said sub-inspector (Detection) Deep Bane. Police then started searching for the girl and soon the investigators received a tip-off from their informer that lady named Usha, a flower vendor in Dadar’s flower market area, was seen with a small girl last year. “Police reached Usha’s house in Ul-

hasnagar and found the girl, who was looked after by the old lady,” said sub-inspector Prashant Bade. Finally, cops arrested Sheikh as a co-accused for misdirecting the police. “Ahmed has been sent to judicial custody while Sheetal has been sent to rehabilitation centre,” said Suresh Unawane, senior inspector of Shivaji Park police station. According to the police, a few years ago, Sheetal was married to Sachin and the couple was staying in Aurangabad. During this time, the lady was in a relationship with Ahmed, who was staying in Pune, added police. In April 2012, Sheetal and her daughter, then two-and-half year,

suddenly disappeared from her home in Aurangabad, after which Sachin lodged a missing complaint of the duo in Aurangabad. Aurangabad police started hunting for the mother-daughter duo and this year they came to know of a missing person’s complaint lodged at Shivaji Park police station. The Mumbai police became suspicious and started questioning Sheikh, who had filed the complaint. In the meantime, Aurangabad police reached Pune and found Sheetal and started questioning about her sudden disappearance from Aurangabad along with her daughter. neel.shah@afternoondc.in

Dated this of June, 2013 Sd/(Rajesh M. Yadav) Advocate

Accordingly the work was entrusted to Mayuresh Builders, who constructed 21 buildings: Three towers (ground-plus-13-floors), 12 medium-sized buildings (ground-plus-seven), and six shorter buildings (groundplus-three). The complex was divided into two compounds. Meanwhile some flat owners applied to CIDCO for registering a separate society titled ‘Balaji Towers’ on December 16, 2005. But since the plots were originally allotted to the ‘Dadar Bhajipala Vyapari Mitra Mandal’, CIDCO refused to recognize ‘Balaji Towers’, saying that their permission was not sought before applying for separate registration and the flat owners were not connected to the commodity market and the Agriculture Produce Marketing Committee (APMC). The dispute continued with a number of litigations and appeals to the court and other quasi judicial au-

thorities. The Bombay High Court, while dealing with writ petitions No. 474/1996 and 5771/1997, noticed that out of the total members residing in the complex, less than 10 per cent were genuine commodity traders. As such the court ruled in favor of the existing (non-APMC) flatowners. But the dispute continued and on November 11, 1998, CIDCO appointed an administrator on the society. But CIDCO’s order was quashed by the then Minister of State for Cooperation, late Babasaheb Kupekar. On August 25, 2003 the state government directed the managing committee of Shri Ganesh society to settle all grievances within 3 months. But the committee approached the High Court (WP\8508/2003) saying that the chief secretary had no powers to interfere in the society affairs. As such the High Court stayed the Government order, giving the managing committee the upper hand. Since the dispute continued, in May 2012, the Joint Registrar of Co-operatives Vikas Rasal directed that the society be bifurcated. But in December last this bifurcation order was stayed by the Cooperation Minister Harshvardhan Patil. Speaking to ADC, the new Joint Registrar of Cooperative Societies Sandeep Deshmukh said that he will have to study the matter afresh because the issue involves CIDCO’s estate department as well. Meanwhile, out of total 555 flat owners in disputed ‘Balaji Towers’, 316 flat owners continue to be treated as ‘non-members’ by the managing committee and most of them have not been issued share certificates. Also they are given monthly maintenance bills without their names, Manohar Lal,

one of the flat owners, alleged. As a result, they cannot attend the AGM and even if they want to sell their flats they are required to approach CIDCO since the managing committee refuses to issue NOC, Sharma said. The managing committee is controlled by PromotorChairman Ashok Ankushrao Gawde who is also a Secretary of the Dadar Bhajipala Mitramandal. In addition, he controls the APMCs located at Turbhe, Vashi and NaviMumbai. He is also the Deputy Mayor of Navi Mumbai Municipal Corporation. When contacted, Gawde told ADC, “These flat owners were not members of the Dadar Bhajipala Mitra Mandal and had purchased flats through fraudulent means. We have not encroached upon their properties. But we abide by bye laws and decisions taken in the AGM. If they have any grievances they should come across the table for discussion with relevant papers”. In another development in June 2008, Mayuresh builders allegedly sold the residual FSI belonging to all these buildings to another developer Anant Sanghvi for Rs.50.75 lakh. Sanghvi built a ground-plus-six structure with 16 flats in a separate compound, and sold them in the open market. He allegedly paid Rs.7.5 lakh as corpus fund to the Shree Ganesh CHS. Surprisingly, in this case the issue of ‘trader’ or ‘non-trader’ status did not rise. Similarly five other societies, Bhima Shankar, Vighnahar, Lenyadri, Sagar Darshan and Sea Breeze located on CIDCO plots (which were originally reserved) have gracefully accommodated all the members as legitimate members whether they are connected to the commodity market or not.

Advani’s absence tells it all T

op leader L.K. Advani was conspicuous by his absence at the BJP’s national executive council meeting in Goa. It was Narendra Modi who dominated the show: He got a royal reception thanks to the support he has from Goa’s chief minister Parrikar. It looked as though Modi was at the centre of things. Advani gave the lame excuse that he was not attending the meeting due to health reasons. All along Advani has maintained a strong silence with regard to his ambition of becoming the prime minister but with a large number of leaders pitching for Modi, he must have realized he had to make a claim in the open. It is being said that party president Rajnath Singh has convinced Advani with regard to the desirability of Modi becoming the head of the party’s poll campaign committee. It is likely that Advani himself will be proposing Modi for the post on Sunday – the last day of the party’s executive council meeting. Advani must be getting some consolation from the fact that the final decision with regard to the prime ministerial candidate will be taken by the top parliamentary board of the party. It is sad that Advani does not realise that his age – he is plus 80 – he just cannot conduct a poll campaign across the country. It looks like he refuses to be realistic in this regard. There is overwhelming support now for Narendra Modi – with even the RSS giving its approval: Advani should withdraw from the fray and be a wise guide and adviser in his party.

MAZING that almost all parties should nix the decision of the Central Information Commission to bring them under the ambit of the RTI law. Far more amazing that the cadre-based parties should echo the same objections the family-owned political firms have in opposing the public spotlight being put on their finances. The point is not whether the CIC has stretched the law to declare political parties as public authorities under the RTI Act. It may well have. But the point is that the six parties named by the transparency commission have vociferously protested being dubbed public authorities. Of course, eventually the ruling may be extended to cover all registered political parties. Frankly, it is hard to imagine a more public institution than a political party. The more public it is, the greater its chances of success. Given that even family-controlled corporate entities have to necessarily open their books of accounts to the public, and submit them for closer examination by the IT department, political parties by their very nature are most public of institutions. Or ought to be. Taking shelter behind a narrow reading of the RTI law to evade examination of their fiancés only confirms the general view that a good part of the political donations invariably finds its way into private pockets. For, if the truth be told, most parties still rely on huge black money donations by a handful of moneybags. In turn, big donors extract their pound of flesh through discretionary allotments of natural resources and permits and licenses. The bigger the donor, the more his influence over the political process. From getting Lok Sabha, Rajya Sabha, Assembly nominations for their loyalists and factotums, to making them ministers, contributors of sackfuls of black money distort the entire political process. For, most political parties remain hostage to big money. Political donations below Rs. 20,000 in cash are permissible. Therefore, most parties use the convenient stratagem of listing hundreds of crores of rupees received in cash from big business as small contributions by party cadres and supporters. And deposit the same in their bank accounts. The IT department takes a benign view of this palpable falsehood knowing as it does that every party, more so the ruling party, resorts to such creative accounting to turn black into white. Remarkably, even after corporate donations were made legit a few years ago, industrialists, real estate tycoons and other businessmen still prefer to fund political parties in cash. According to reliable estimates, more than four-fifths of political donations to major parties is still in hard cash. When delivered to politicians, a good chunk is kept aside by them for private use, while the remainder is deposited in the party’s bank accounts and accounted for as collections from small donations. A few years ago, BSP boss Mayawati had got around a case of disproportionate assets by arguing that she had received tens of

the issue. For, nobody is asking them how they nominated a particular person for contesting this or that election. Or how they decided to support or oppose a particular policy. No. The limited objective of the CIC is to make political funding and its use transparent. If parties do not divert funds for private ends, if politicians do not steal them to amass personal fortunes, they should welcome the CIC ruling, and not oppose it. Admittedly, various authorities expand their reach only when things go out of hand. The CIC might have allowed a broader definition of public authority under the RTI Act only because there was a general consensus that politicians pocketed party funds for private use. Just as a few decades ago the apex court virtually omitted the role of the executive in the appointment of judges to the High Courts and the Supreme Court once the executive went overboard in making poor appointments. A former law minister virtually forced the creation of the collegium system for judicial appointments when partisan considerations of caste and political bias determined higher judicial appointments. Of course, the rare unanimity among political parties against the CIC order opening their accounts to public scrutiny would ensure that someone will challenge it in the High Court. It is hoped that the courts too would not be unmindful of the rot that has struck deep into the polity where the difference between political and private funds has virtually become non-existent, especially in the family-owned parties. Wily Srini will just not give up easily! WHILE giving an interview to a Tamil TV channel, the former Board of Control for Cricket in India (BCCI) president N. Srinivasan said that charges made against him and his family is the conspiracy by the north Indians lobby in the cricket body to malign Madrasi south Indians particularly Tamils is utter nonsense and rubbish. This is the most irresponsible comment made by any board president in the history of Indian cricket; proves that he is depressed, lost his balance of mind and needs immediate psychiatric treatment and is playing dirty communal politics by dividing the people on the basis of cast and religion to save his skin. The evidence in the spot and match fixing probe by the police proves that he and his son-in-law Gurunath Maiyappan were directly involved in the betting crime. — Bhagwan Thadani, Mumbai

IF the Delhi Police Commissioner is to be believed, then Rajasthan Royals team owners, Raj Kundra and his actress wife Shilpa Shetty indulged in betting in the IPL cricket tourney just for “fun”. Enough of these “fun” and games, I say, and now there is sufficient fodder available to disband the ipl cricket tourney, which looks to be nothing more than a ‘casino royale’. Meanwhile, the Mumbai Police during their investigations had revealed that some big Bolly-

Expose the ipl/ Bollywood nexus with immediate effect please. — Altaf H. Ladiwala, Bandra

SLEAZE lies and fixing…thy name is IPL. Royal’s owner Raj Kundra’s admission of betting in IPL and wife Shilpa Shetty’s involvement doing the rounds, proves that the entire tournament was everything other than cricket and the public were taken for a ride. The cricketers behind bars were mere pawns and small actors in a film where producers and directors (Team owners) called the shots from behind the cameras. An en-

tire film can now be made, now that they even have a glamorous heroine called Shilpa Shetty, on ‘Fixing & gambling’ and it sure would be a hit even bigger than the IPL. Business and sports should never be mixed & IPL was all about money and cricket was an eye-wash. One of India’s best talent and World Cup winning team member unfortunately has ended his career. Scrap IPL in totality and make the rich BCCI accountable by making its activities transparent. — S.N. Kabra, Goregaon

A LOT of sound bytes and column centimeters are being dedicated to the IPL snafus. But there are questions that the media is un-

willing to explore and educate readers and cricket followers. What is the legal status of the BCCI? Under what Act was it formed? Who gave it the authority and under what law to run cricket in the country? Can anyone else also start a similar body to run cricket or any other sport? This is the fundamental crux of the problem and needs to be set right. Till then all other talk and actions are just beating around the bush. Look at the new president – he takes on cheerleaders. As if this was the most important issue! Is the media worried about not getting passes and access to officials, players and matches? — T.R. Ramaswami, Kandivli

AS a part of the investigations into the spot fixing scandal, the police are reportedly quizzing Raj Kundra, who is mentioned as the co-owner of the Rajasthan Royals team. If that is true, then who is the other co-owner of the side? His wife Shilpa Shetty? If that is so, then why she too is not being questioned by the investigating agencies? — Jorhat Singh, Kandivli

RBI has advised banks not to sell gold coins to retail customers. P. Chidambaram, finance minister always acts slowly and lets the finance portfolio in disarray. More schools and colleges ACCUTE shortage of educational institutions is one of many serious problems of Mumbai. This has resulted in malpractices and corruption at all levels. Mainly there are two reasons for this malady. (1) Regressive policies and interference by government at all levels even in the unaided educational institutions and harassment by educational inspectors and, (2) Shortage and consequent high prices of land. Simple solutions: (1) The government should review its educational policy and make it progressive, transparent and simple and save educational institutions from Inspector Raaj. (2) Most of the govt. schools are in small two-storey buildings with vast unused, open land. The surplus land should be used to create more multi-storey schools/ colleges. Problem of shortage of educational institutions can thus be solved. — Prof. Anant Thakker, Mumbai

APROPOS ‘Dabbawallas to share success mantra in Dubai’ (ADC, June 3), it is indeed heartening to learn that the Mumbai dabbawallas got an invitation to share their success story with Gulf Co-operation Council in Dubai. WITH reference to Mr. T.R. Ramaswami’s letter titled ‘Careless pedestrians’ in the ADC dt. June 6, no proper road safety can be ensured until both pedestrians and motorists observe rules that ensure road safety. The bad trend of driving vehicles on pavements, driving in wrong direction, defeaning the ears of pedestrians by blowing the horn, blinding the pedestrians with bright lights at night, etc are things that need to be curbed. On highways and roads, safety can be ensured by installing sonorous tiles--these are tiles that make a noise when vehicles jump lanes, pillars with cushions can be installed on ghats and hilly roads to prevent unnecessary accidents and on all roads exiting the city, telephone booths must be installed every 100/200 metres for emergency calls. So let us shed our third world image by keeping good road sense (by both motorists and pedestrians)--it is something which is acheivable.

The people of this country, in fact, look forward to Shri N. Modi to take over the reins of the nation to set the tone for prosperity and nullify the ills that have had their own adverse effects depriving this potential nation from reaping the desired fruits in independent India. Shri Advani, at the age of 85, should behave like a statesman as the people would expect him to work towards a united BJP to summarily defeat the Congressled alliance in the next Lok Sabha polls. Having richly benefited being in BJP it is incumbent on his part to maximise the winning prospects of the BJP. — T.M. Uday Shankar, Mumbai

GROW UP: Senior BJP leader L.K. Advani should stop craving for nomination as a candidate for the PM’s post and work towards defeating the Congress-led alliance in the next Lok Sabha polls. Modi, who is known to have played a part in the Gujarat riots as the prime ministerial candidate? Is our great country ready to have a prime ministerial candidate like Modi who has a criminal past in spite of all the so called developmental work done in a state like Gujarat? Can’t the BJP find any other candidate rather than fall prey to the marketing and PR gimmicks of Modi’s spin doctors? The BJP and the nation should introspect whether it wants such a right wing fundamentalist leader at the helm of the country. — Joseph Mendes, United Arab Emirates

While buying resale property, it’s important to examine title

IT is an established rule of equity that the deposit of a document of title without more, without writing or without word of mouth, will create, in equity a charge upon the property referred to. However, this general rule won’t apply when you have a deposit accompanied by an actual written charge. In such a situation, one must have to refer to the terms of the written document and any implication that might be raised, supposing there was no document, is offset by the document by which alone one must be governed. The privy council held that: • Where titles are handed over with noting said except that they are to be security, that law supposes that the scope of the security is the scope of the title

I have purchased a resale flat in a society which is registered but builder has not handed over society records to the society. I have paid my share of Transfer fee to the seller who in turn handed over the same to Builder. While obtaining NOC, the Builder has given the NOC to the seller on Society Letter Head and signed as Chief Promoter and handed over to me. Now, the society committee members are not accepting me as a member as they have not received the transfer fee. I am paying monthly maintenance regularly but society is giving the maintenance receipt in the original flat owner name (the seller from whom I purchased flat). Kindly advise what should I do? Even if I pay transfer fee to the society, they will not be able to give me share certificate they themselves have not received from builder. Whenever I contact the builder to hand over the transfer fee to the society, she said she has to recover some money from society and she would like to adjust the same against the same. — Vikas Kulkarni

• Where, however, titles are handed over accompanied by a bargain, that bargain must rule • When the bargain is the written bargain, it, and it alone, must determine what is the scope and extent of security. The Supreme Court held that where the parties to the contract of mortgage by deposit of the title deeds choose to reduce the contract to writing, the document will be the sole evidence of its terms. The deposit and the document form the integral parts of the transaction and are essential ingredients in the creation of the mortgage. The document which constitute the bargain regarding securing require registration under section 17 of the Indian Registration Act, as a non-testamentary document creating an interest in immovable property, where the value of this character is not registered, it cannot be used in the evidence at all and the transaction itself cannot be proved by oral evidence either. Also, whether a memorandum of title deeds is compulsorily registrable under section 17 of the Indian Registration Act, 1908 depends on whether the parties intended to reduce their bargain regarding the deposit to the form of a document, if so, the document required registration. If, on the other hand, its property construction and the surrounding circumstances lead to the conclusion that the parties did not intend to do so, there being no express bargain, the document being merely evidential did not require registration.

In the first place, you should have checked for the title of the flat which you purchased in resale. The title for any sale/resale flat should be clear and without encumbrance. At the time of purchasing resale property, the previous sales / conveyance deeds and sub-registrar’s receipts should also be checked. If the earlier sale deeds have been lodged for registration, you should ask for the certified true copies of such conveyance and the sale deeds along with the original receipt of the sub-registrar in whose office the document has been sent for registration. Now, when you gave the transfer fee to the seller why did s/he hand over the same to Builder? Wasn’t the flat in the name of the said seller? If it wasn’t, then why is the society issuing receipts for maintenance in favour of the original flat-owner when you make the payments. « REAL ESTATE BILL

There are two sides to it. On one, every right thinking bureaucrat, home buyer and consumer activist has praised this long awaited regulation; On the other is a powerful lobby, mainly that of builders opposing it. While the former believe that the “Enhanced transparency will boost consumer confidence,” the latter believe “it is one-sided, and a punishment for the whole industry”. So what’s the truth? Dominic Rebello looks at two contrasting opinions, one from the prestigious research house, CRISIL and the other of the real estate body, MCHI-CREDAI. His report…

T

he approval of The Real Estate (Regulation & Development) Bill, 2013 by the Union Cabinet on June 4, 2013 seeks to create a regulator for the real estate sector to protect interests of home buyers by providing a uniform regulatory environment. The Bill, which shall oversee only the residential real estate sector, will be presented during the monsoon session of the Parliament, in August 2013. The Bill necessitates establishment of one or more real estate regulatory authorities in every state/UT, to oversee real estate transactions, and seemingly appears to be the need of the hour. Justifying the bill Ajay Maken, Union Minister of Housing & Urban Poverty Alleviation (HUPA) while addressing media persons post the cabinet approval had said, “real estate and housing construction has been largely the concern of state institutions till the 80’s with very few private promoters and a nascent industry. With the liberalization of the economy, conscious encouragement was given to the growth of the private sector in construction, with a great Continued on pg 14 «

ince the last week or two we have witnessed a lot of volatility in the stock markets. This was mainly due to currency volatility, which is linked to an appreciating dollar and a depreciating yen. Also due to a spate of OFS from companies scrambling to meet the June 3rd deadline to reduce promoter holdings to 75%. Whatever may be the case the broad range of the Nifty has remained between 5800 and 6150. There are no fresh triggers in the short term, except that the markets will be watching the monsoons, and, if they progress well, then the markets range may move up by another 100 pts by the end of June. Right now it will be good to be stock specific and buy on dips. There are 80% chances that RBI may not reduce the interest rates even by 25 basis points during the June policy review, due its concern on CAD.

Expect FY14 GDP growth at 5.9%

R

By Manik Kumar Malakar

emember the old saying that you can look at a glass as either half full or half empty, correct? Well India’s latest series of GDP numbers could be looked at with the same perspective. GDP numbers which for the final quarter of the FY13 period reached a spot that analyst’s term as an absolute nadir. While experts opine that things should get better going forward this is conditional to the monsoons showering us with their blessings. “Friday’s 4.8% March quarter growth seals our call that the economy has bottomed,” says Indranil Sen Gupta, India Economist with Bank of America Merrill Lynch. “India’s gross domestic product growth decelerated to 4.8% in 4Q FY13 from 5.1% in 4Q FY12, primarily on account of weakness in agriculture and allied activity, mining, construction and community, social and personal services sectors,” notes Achala Jethmalani of Nirmal Bang. The various components of the GDP basket were negative. Agriculture and allied activity sector’s growth almost halved to 1.9% in FY13 from 3.6% in FY12, attributable in part to the 7% monsoon deficit witnessed in FY13. “Contribution of this sector to GDP fell to 3.9% in 4Q FY13 from 5.6% in 4Q FY12, thereby pulling down GDP growth,” says Jethmalani. Its contribution to GDP was at a nine-year low, at 13.7% year-on-year in FY13. The industrial sector grew by 2.7% in the Q4 period though this was thanks to a lower base of

Fantastic Legislation... Continued from pg 13 «

This seems to be factored into the market - already several steps have been announced by the government, such as further curbs on gold imports, raising the FDI sectoral caps across sectors from 26 to 49% in certain sectors, 74% in other sectors and 100% in a few other sectors. This augurs well for the economy but its implementation will take time, even if it is done through ordinances. It would then encourage more FDI flows as well as FII flows. Of course, the consensus is to buy into select private sector banking stocks out of which my top picks are Yes Bank, followed by Axis Bank with medium term perspective. Another sector to be looked at is the IT sector, again being selective in stocks. HCL tech remains a top buy and TCS would be equally good. The IT sector in general will reap the benefits of rupee depreciation and a gradual recovery in the major US economy which is the major market for most IT companies. Another sector worth looking at is the oil and gas sector. I would favour crude oil producers like ONGC as petrol has been decontrolled and diesel is close to being fully decontrolled. As a result the subsidy burden which ONGC had to share will reduce substantially this fiscal and will further minimize in 2014-15.

deal of success, and the sector today is estimated to contribute substantially to the Country’s GDP. But currently the real estate and housing sector is largely unregulated and opaque, with consumers often unable to procure complete information, or enforce accountability against builders and developers in the absence of effective regulation.” He hoped that the proposed legislation would ensure greater accountability towards consumers, and to significantly reduce frauds and delays. However, real estate bodies have strongly opposed it calling it one sided. Says Vimal Shah, President, MCHI-CREDAI, “In its zeal to curb a small section of erring developers, the government is punishing the whole industry. The bill makes it mandatory for a developer to obtain all clearances before commencing a project, but it does not take into account the inordinate delays in project approvals on the part of government bodies and local authorities.” The association believes that “The Regulator can be effective only if it is in position to regulate all constituents of the Real Estate Industry including Developer, Land Owner, Approving Authorities and Customers. The bill provides for regulating of only one of these. The bill will only increase the cost of Premises which is going to harm the customer the maximum”, it threatens. In contrast CRISIL Research in an Impact Note believes, “For developers, while this bill implies stricter regulatory control, it will also translate into better demand, as buyer confidence improves. In terms of supply, delays in handover of projects are likely to decline as clauses mentioned in the Bill mandate strong commitment from developers to complete projects as per schedule. The Real Estate (Regulation & Development) Bill will improve buyer confidence and boost demand for residential real estate. It will incorporate mandatory disclosure clauses, which would provide greater clarity on the project standards and timelines for completion.”

the previous year and a slight pick-up in manufacturing activity. So at the end of the day where do we go from here, and has the economy touched its nadir, or is there worse to come? Analysts are cautiously positive, but the monsoons are the key. “We see a shallow recovery in 2H14 on normal rains and lending rate cuts,” says Sen Gupta. “For the Reserve Bank of India (RBI), this year’s monsoons again will be a crucial variable in calibrating monetary policy, as they will have implications for both inflation and growth,” say Siddhartha Sanyal and Rahul Bajoria of Barclays. “The Indian Meteorological Department (IMD) has forecast a normal monsoon in FY14, which would give a thrust to this sector and thereby contribute more to GDP growth,” says Jethmalani. There are some more pointers to a better future. At least equity has something to smile about. “4Q FY13 results beat our expectations with adjusted net profits of the BSE – 30 Index increasing by 8.2% year-on-year versus our expectation of a 1.8% decline,” says Sanjeev Prasad of Kotak Institutional Equities in an India Strategy report. Automobiles, metals and mining stocks surprised positively. “We expect FY 2014 net profits of the BSE 30 Index to grow 5.4%,” continues Prasad. Then too the chief bugbear inflation is being (cautiously) tamed. Inflation Motilal Oswal a brokerage, reminds us, has dropped sharply below RBI’s comfort level to 4.9% in April 2013 with core inflation ruling at only 2.8%. Also interna-

tional commodity prices and a relatively stable rupee present a benign inflationary outlook, going forward. ‘This has provided headroom to RBI to further ease policy rates by 50 bps (one basis point is one hundredth of a percentage point) in remaining FY14,’ says Motilal Oswal. To also cite the possible negatives lower deposit growth and concerns over credit growth have also restrained credit growth. Motilal Oswal estimates that DGP growth for the FY13 period would be 5.0% and for FY14 would be 5.8%. And the government has its role to play too. “Following the deceleration in investment, consumption, and net export growth in FY13, only a rise in government spending can hold up economic growth, at least in the short to mediumterm,” says Jethmalani. However, as the government’s fiscal deficit shot up post FY 09; as a result of expansionary policy measures adopted to pull the country out of the post global financial crisis slump; it increased further as slow growth diminished revenue and led to austerity measures in order to avert a sovereign rating downgrade. “However, the latest data released by the government shows that despite some slippage on the direct tax front, the indirect tax mop-up rose by approximately 6.2% over revised estimates (RE),” says Jethmalani. “We expect FY14 GDP growth at 5.9% on the back of a modest pick-up in economic activity across the three sectors agriculture, industry and services,” notes Jethmalani.

The Policy Will Require…

▪ Mandatory registration of projects with plot areas of 4,000 sq m or more. All clearance documents to be submitted to the regulator before the construction activity commences. ▪ Registration of real estate agents with clear responsibilities and functions. ▪ Strict legislation against releasing misleading ads. ▪ Projects to be launched only after securing all statutory clearances. ▪ Sale of flats only on a ‘carpet area’ basis and mandatory disclosures to be made on facilities/amenities provided on the regulatory authority’s website. ▪ Separate escrow accounts for all the projects. ▪ Builders to refund payments with interest to buyers, in case of delays. ▪ Establishment of the Real Estate Appellate Tribunal to ensure faster resolution of disputes.

Elaborating and analysing key pointers on the policy clearly reveals that the opposition is uncalled for. For example the bill requires Mandatory registration of projects with a regulator. It proposes that all residential projects with plot areas of 4,000 sq m or more need to be registered with a regulator, which will be possible after the developer submits all necessary clearances. This clause is expected to impact developers in all major cities, except in case of Mumbai, where the Bill will have limited impact due to smaller plot areas. Developers also need to disclose details on the carpet areas of all flats, layout plans, plans of development works, and the architect and structural engineers. The Bill also mandates registration of real estate agents with the authority, to ensure that agents only facilitate sale of registered properties. It also seeks to safeguard buyers against misleading advertisements, pertaining to the quality of services or amenities provided and approvals/affiliations that the developer has not secured. Buyers, affected by such misleading advertisements, will get a full refund of the money deposited, along with interest in case they intend to withdraw from the project. And this one is most important as it safeguards buyers against pre-launch schemes. Pre-launch schemes are offers where the developers ‘soft’ launch their projects to a select group of buyers, typically priced at a 5-15 %discount to the launch prices. However, these investments carry a substantial risk, as projects at that stage may not have received all required approvals. The Bill seeks to protect interests of

buyers by incorporating a clause that projects can be launched only after the developer secures all statutory clearances from relevant authorities. Authorities, on the other hand, will have to approve or reject projects within 15 days from the date on which the developer submits documents. Then another factor is the concept of ‘super built-up area’. The Bill directs developers to sell their properties only on a ‘carpet area’ basis, thus doing away with the ambiguous concept of ‘super built-up area’. Carpet area is the actual net usable floor area of a residential unit and does not include the area covered by walls, whereas the super built-up area is the built-up area (carpet area + wall breadth) in addition to the proportionate area of common areas, such as the lobby, lift shaft, stairs, etc. Thus, buyers will get clarity on the actual liveable area that they will get, on receiving possession of the flat. Project delays are another issue that the bill tackles effectively by ensuring stricter adherence to completion timelines. The Bill mandates that “70% or such lesser percentage, as notified by the appropriate state government” of the money raised for a project should be deposited in a separate account. By ensuring that developers do not divert funds meant for a particular project to their other projects, the Bill seeks to curb delays in project completion, due to shortage of funds. The Bill also protects buyers against project delays by requiring that developers refund the amount paid along with interest in the event of a delay. Both these factors are expected to ensure timely completion and handover of projects to the buyers.

‘Wealth Creation Is Easy’

‘W

ealth Creation is Easy’, ‘Anybody, even with a single stream of income can create it over a period of time’… Shocked? Well one shouldn’t be. How else would one explain that more wealth has been created and more billionaires have cropped up in the last two decades as compared to, may be, a fifty year period before that? In my opinion it’s all in the mind. It is an urge within, which gets ordinary, out of the blue mortals on to rich lists. But there is a catch: It takes a vast amount of discipline to do so. And there is a ’mool mantra’. It says ‘sacrifice today’s pleasures for tomorrow’s gains’. What it means in simple terms is that: curtail the unnecessary, the ego boosting and social pleasuring expenses that melt your money faster than an ice-cream cone. That said; let’s look at the serious side of the business. Statistics reveal that at any given point, almost 8% of a family’s money spends are wasted due to a lack of finding the right place to buy products; includes bargaining etc, etc. That means an average of almost that amount can be saved across annual expenses. Then there are other ways you can cut expenses. All it takes is a serious analysis of your spends. But the analysis must happen before the money exits your pockets. When the annual amount is considered, it does size up to a tidy sum’. Squirrel it away… Assume it is spent and forget it in a bank’s fixed deposit. The longer the term; the better! Then watch the power of compounding come into play. A single rupee multiplies itself 5.38 times at an interest rate of 8.5% compounded over 20 years and around 2.32 times in ten years. I personally trust only the LIC. And within this I love their “Jeevan Anand Policy’. It offers a life cover, takes care of the unexpected and also pays out an amount on maturity of sum assured, compounded with an average of 5% returns that are tax free. The returns if analyzed statistically are amazing…Perhaps, no other scheme from a credible company could match the returns.

I love this quote of billionaire Warren Buffet. He says “My wealth has come from a combination of living in America, some lucky genes, and compound interest.” Note the emphasis on ‘compound interest’. This one I love better. Attributed to Albert Einstein, it says “Compound interest is the eighth wonder of the world. He, who understands it, earns it ... he who doesn’t; pays it. The most powerful force in the universe is compound interest.” Simply put the power of compounding is pure magic. And there are many other forms to do it. Top on the priority list should be a Public Provident Fund (PPF), here again the power of compounding becomes a great play. Just Rs 10,000 saved per year becomes Rs 30, 9001 in 15 years…and its tax free and safe. Then there are insurance products that are available and help you do that. But, don’t get carried away by the claims of the ‘Johnnies come lately’. Some of these from the private sector insurance companies promise the moon and deliver misery. I personally trust only the LIC. And within this I love their “Jeevan Anand Policy’. It offers a life cover – takes care of the unexpected- and also pays out an amount on maturity of sum assured, compounded with an average of 5% returns that are tax free. The returns if analyzed statistically are amazing…Perhaps, no other scheme from a credible company could match the returns. As regards investments in gold, real estate and equities; these are capital intensive and come with a risk. But again if long term averages are considered, they are safe and still play an important role in the multiplication of wealth. But first, the wealth has to be created… To sum it: Real wealth accumulation is achieved by allowing money to multiply on its own steam. Like success begets success, money begets money! I love the way the Marwaris plan their wealth building. They believe in the generation gap. Meaning; grandfather saves for grand children, And in between the generation, they encash upon the power of compounding. How do you pick your trades? We believe only in fundamentals and have learnt that wealth can grow only with the help of a fundamental approach to investing.

arketers try to understand their own market via varied analysis. They try to find out contribution of sales from various towns, regionality, as well as seasonality for the relevant product category. Just as summer is an extremely potential season for product categories like soft drinks and ice-creams and winter is an excellent season for sweaters and other warm cloth offerings, the rainy season, the monsoon provides an exciting opportunity to some marketing people. Certain product categories look up to the rains for their gains. If we try to understand this slice of the year as a segment to be marketed to, we must also first understand what segmentation means. A market segment consists of buyers who seek (occasionally or often) the same offering. The concept of a market as a set and a segment as a subset is, the basis on which the process of segmentation is carried out. But, relationship of a segment to a market is also one of means to goals and this has two implications. First, since means for accomplishing goals can be varied, different segments of a market may demand radically different offerings, with buyers in one segment not regarding what is being offered in another segment as being an adequate substitute. For example, an umbrella for a raincoat. Secondly, since people choose within the context of what is available, they are not satisfied with what they buy. A possibility always remains of designing an offering better suited to the segment. If we continue the example of umbrellas for raincoats, one sees a drastic change in the form and styling of umbrellas. Earlier, all umbrellas were black, but today you get branded, colourful and easily portable folding ones. Similarly, in the case of raincoats, the shapes and designs and colours now cater to modern, contemporary tastes. Marketers start planning their ‘Rain Campaign’, quite early. Since the clear benefit provided to the consumers is one of protection from rain, shoes also fall in the same category. Other product categories who look forward to rains, are a mixed lot. On the industrial product side, major contractors would be awarded road contracts filling pot holes on the roads, while creating holes in the tax payers pockets. Further, the cement industry also does get a share in the works, especially during and after the rains have done their damage to the roads. On the consumer durable front, cars and two wheelers need to be geared up to meet the onslaught of the monsoons. In cars, wipers start making their re-appearance. Since, the major illness are caused due to problems with the quality of water, water purifiers, water filters and safe water offerings, have a certain appeal to the customer. On the pharmaceutical side, this is an important season for some companies. In fact, though it sounds sadistic problems with health and hygiene occur during the rains and pharmaceutical companies are ready with their brand offerings to provide solutions and relief to the potential and existing patients. A related category, in the field of medicine, is the universe of doctors. Their practice, in some quarters, does show an upward trend. Cough and cold remedies, start advertising rather heavily during this season, though a lot of other categories like air- conditioners and soft drinks find this a relatively lean season. The entire range of cough and cold remedies, whether in the form of balms, rubs, lozenges or syrups, start aggressive marketing and sales exercise, with brands competing fiercely with each other.

Afternoon Despatch & Courier

How would you describe your methodology? I like to focus on value stocks, be a long term investor and constantly filter the universe of stocks in terms of corporate governance, history of business performance and future potential for business models. Time horizon for investments?

QUREISH RAGHIB

Any applicable lesson to investing? Always differentiate “objectives” of investing from “tools” of investing. Valuation tools are always meant for identifying great opportunities. However, many retail investors get engrossed in these tools even if their stocks fetch them 10 times return. The stocks which rise, say ten times, in a year or two also have substantial downside risk; hence, retail investors should realize their dream if they get such an opportunity rather than excessively engaging in their valuation debate.

How much of what you do is gut felt? It is not more than 1%. it is dangerous to go by gut feel in the stock market. Gut feel or intuition based investing can destroy wealth overnight in the stock markets. Thorough study and good common sense approach should drive the investment decisions.

« MARKET WIZARD G. CHOKKALINGAM Do you try to anticipate or follow market trends? Yes, I try and anticipate the market trend for a minimum period of six months or so, but certainly not for a day or month. The basis should be fundamentals of economics, political events and global macro events. One should not worry too much about volatility caused by perceptions.

When you put money on a trade and it goes

against you, how do you decide when you’re wrong? What do you do next? In an investment, an idea may go wrong in terms of price movement. In such a case, try to go further deeper into the company’s fundamentals and also into all relevant parameters of its business. If there is no significant deterioration in their fundamentals and business environment, then go aggressive in accumulating the stock. Many times perceptions drive the stock prices in the short term, rather than fundamentals. For instance, in the past when one of the plants accounting for just about 3% of total capacity of a manufacturing company was shut down temporarily, the stock price fell as much as 15%. We used this opportunity to aggressively accumulate the stock and it became a winner once corresponding quarterly results were announced. However, investors should restrict exposure to a single stock to the maximum extent of 10% or 15%, based on their risk profile. Any positions you ever lost sleep over? Yes, at beginning of my equity investment life,

having personally invested in a good performing stock, its promoter committed suicide which led to complete destruction of the share price and eventual delisting. The learning is that one should not get into equity market with ambition of making fixed and certain returns. Secondly, the risk should be mitigated by proper allocation of wealth across asset classes and within the equity asset class, across various sectors, market cap segments and value picks. Again investment in equity asset class should be from one’s own wealth, not from others’ money, i.e. it should not be from borrowed funds!

Do you have a scenario about how the current bull / bear market will end? Where do you see the Indian markets five years down the road? The current bear market will end with the next General Elections. Our domestic equity is likely to rise to record levels post elections in 2014. The Sensex should cross 28,000 in 2015. A complete reversal of interest rate cycle in next 6 to 12 months and the possibility of one of the two major national parties coming to power

at the Centre with an individual tally closer to simple majority, in our view, will lead to re-rating of the Indian equity market in terms of valuation multiples from 2014 onwards. Any final words? The Indian equity market offers great opportunity to individual investors who have long term investment perspectives and also by playing on individual stock ideas rather than on the whole market. Perceptions in our markets create huge volatility and destroy or help in wealth creation – hence, one should not react in haste or believe story tellers.

Your advice to investors Investors need not become experts on their own; however they should try to develop some amount of skills to filter news flows and stock ideas. There could be more than 5,000 stocks traded actively on the exchanges, however, investors need to understand the fact that there cannot be more than 100 stock ideas which can form part of an investible universe at any point in time.

Bhendi Bazaar’s Economic Evolution

is a Mumbai based socio-economic commentator

F

In the short-to-medium term do not worry about the price performance of the stocks, but be concerned only about fundamental performance. Do not follow a stop loss purely on price points for fundamental investing - in fact use serious erosion in the share price to your advantage and increase accumulation of the stock, provided there is no shake up in the fundamental convictions. Many great wealth creators in the past did have significant divergence between price performance and fundamental values in the short to medium terms.

« GUEST COLUMN

rom being an irrigation tract in its early days as mentioned in the Maharashtra State Gazette as, ‘in the north-west of Dongri there existed a plantation of thespesia populnia or bhendi which has given its name as Bhendi Bazaar’ to being developed by the British to resettle communities affected by the Great Mumbai Fire that broke in 1803 at the British Fort area to eventually mushroom into a bustling business district, Bhendi Bazaar in South Mumbai, India has come a long way in terms of socio-economic evolution. Surprisingly, even with its 200 years history of characteristic entrepreneurial resilience, Bhendi Bazaar has gradually sunk in an abyss of civic neglect and infrastructural despair leading it to be seriously challenged in a liberal Indian economy. Interestingly, even during the global economic slowdown that affected Indian market growth in the last decade, this 16.5 acres area having dis-

tinct business dynamics, saw economic reforms such as diversification and new business ventures while indulging in minimal credit facilities. This largely has been possible as over 50% of the 1250 commercial establishments in the project area are owned by Dawoodi Bohras - one of the oldest mercantile communities that first settled in the city during the 18th century. Known for their business acumen, Dawoodi Bohra businesses in Bhendi Bazaar and elsewhere have grown exponentially by benefitting from the Qardan Hasana Trust, a global financial institute established by the community’s spiritual leader His Holiness Dr. Syedna Mohammed Burhanuddin. The trust facilitates short and long-term interest-free credit disbursement, which in turn, helped in arresting larger effects of recession, and facilitated capital inflow in the area. Apart from the traditional business of hardware tools, artifacts bazaar, the Friday flea market, there has been an increase in pilgrim tourism due to the religious and cultural centers situated in the area like the world renowned Raudat Tahera, the mausoleum of Syedna Taher Saifuddin. Taking into consideration all these socio-economic dynamics, mainstream market players particularly from the service and hospitality sectors along with small manufacturers have put-up outlets in the area providing job opportunities and alternate source of income to many a household in Bhendi Bazaar. However, be it petty shopkeepers or value added service providers depending on elite clientele or businesses requiring spacious floorspace - all macro and micro market players have adversely been affected due to diminishing

urban facilities in the vicinity. With an overall 74% ground coverage, the present 66,264.74 Sq. m. area has one of the highest population density in South Mumbai. Interestingly, the newly proposed Bhendi Bazaar redevelopment project undertaken by the Mumbai based Saifee Burhani Upliftment Trust ( SBUT) will have a 54.55% ground coverage post redevelopment. The project, according to the widely used economic theory, is constrained optimization. It represents arriving at a set of best solutions to a matrix of problems.

From a purely economic perspective, the nonprofit redevelopment initiative in the area would shift the perfectly inelastic supply curve of commercial and residential land to the right. This would lead to an increase in consumer surplus to the residents and additionally provide positive externalities to the surrounding areas such as over 15 m wide internal peripheral roads for vehicular movement, separate loading-unloading facilities for commercial vehicles and 1,16,153.93 Sq m of much needed parking facility in the area.

TO BECOME

NOW

Apparently, unlike the present inequitable market scenario, both complementary and substitute goods’ stakeholders in the neighborhood are to be provided with shops strategically facing the main roads. The economic evolution of Bhendi Bazaar from a typical, unplanned bazaar to having Mumbai’s longest high-street shopping area would serve both purposes of retaining to a

great extent the traditional bazaar essence as well as provide a contemporary business environ. In essence, Bhendi Bazaar’s parameters of economic growth are largely defined on the lines of the area’s cultural and social vibrancy. The fact of the matter is, while all religious and cultural architectural structures situated in the

vicinity are to be retained, all legitimate businesses and cosmopolitan residents would also be relocated back in the same locality. These phenomenal factors would, without doubt, reinstate the unique cultural flavor, and reinforce Bhendi Bazaar’s past business glory. A broad observation is, there is an evident absence of quality shopping area catering to the simultaneous needs of all strata of society in a three kilometer radius around the proposed 3000 crore Bhendi Bazaar redevelopment site. With an average 100,000 footfall registered today, a conservative approximation of a threefold commerce and trade growth tends to be a reasonable prediction consequential to a much broader customer base post-redevelopment. Subsequently, economic stimulus will be in employment gains, leveraged investment, and revitalized neighborhoods while fiscal impacts would include generating new sources of local revenue derived from previously less productive establishments. On a larger canvas, even as a small minority has offered reservations advocating for preserving the ‘natural fabric of the city’, they do not in turn have any credible solutions to offer in correcting the colonial era’s deteriorating long, linear stretches that make up this area. At stake are 80% of buildings that suffer from dangerous dilapidation and constant repairs, compounded with critically congested 150 year old arterial roads. All this cumulatively pose serious risk to human life and property. The question that begs to be answered is whether or not the residents of Bhendi Bazaar have a right to a better quality of life as their forefathers did a century ago?

Markets Directionless NSE India : CNX Nifty — Daily Market Report for: Monday (June 10, 2013) By Dominic Rebello

REVIEW OF THE PREVIOUS DAY:

The Nifty fell moderately on Friday (June 07, 2013) a net 40.40 points (0.68%) and closed at the 5881 point level. The market opened down with a gap at the 5900 points level. It then rose and turned into a range bound movement until 10.46 a.m. The index then rose sharply into the green and registered the day’s high at the 5972 points level at 12.17 p.m. It then declined and turned into a range bound movement until 2.48 p.m. The index then declined sharply into the red and registered the day’s low at the 5871 points level at 3.12 p.m. and then turned into a range bound movement until closing at the day. The Nifty witnessed a volatile session and moved in a range of 101 points. Sentiment was bearish and amongst the 50 Nifty stocks 40 were losers, while 10 were gainers. All the sectoral indices barring IT and technology closed in the red. Heavy selling was seen in auto, realty, banking, power and metal stocks.

TECHNICAL ANALYSIS: Volume: Volume (Qty shares) increased 0.65%. This change is small and indicates a moderate participation by investors. Market Breadth: Overall Market Breadth on the NSE was negative. Amongst all the traded stocks, 591 were gainers, 798 were losers and 69 remained unchanged. Slow Stochastic Indicator: The Slow Stochastic Oscillator is in the over-sold zone. The Slow K line in the Stochastic Oscillator is above the slow D line (positive if it continues). RSI Indicator: The RSI is above the 40 level but is now declining (negative if it continues). MACD Indicator: The MACD fell below zero and is declining (negative if it continues). It is below its 9-day Average (negative). ADX Indicator & DI Lines: The +DI line is below the –DI line and both lines are diverging (negative if it continues). The ADX is falling while the Market Index is falling, which indicates that the present down trend is decreasing in strength. MOVING AVERAGES (TREND INDICATORS) The index: Is below its 5-day average (at 5917) Negative. Is below its 15-day average (at 6020) Negative. Is below its 25-day average (at 6046) Negative. Is above its 200-day average (at 5790) Positive. Overall Market Strength/Weakness: The indicators and oscillators discussed here are indicating a weak market with a negative bias. Support Levels: For short-term traders the immediate main support is at the 5867 points level.

The next support is at the 5673 points level. Resistance Levels: The immediate main resistance is at the 6156 points level. The next resistance is at the 6223 points level. Pivot Point Analysis: For intra-day traders the support and resistance levels are calculated according to the pivot point theory and are: Pivot point = 5908 (This is the level where the trend is likely to change during intra-day). Support (1) = 5844. Support (2) = 5807. Resistance (1) = 5945. Resistance (2) = 6010. OUTLOOK FOR TODAY:

On Japanese candlestick patterns the index has formed a small black body candle with a long upper tail. A long upper tail indicates that the Bulls controlled part of the session but lost control by the end and the Bears made an impressive comeback. As such it indicates that the index was facing selling pressure at higher levels. This candle also indicates that the indecisiveness amongst investors continues. The next candle formation will confirm whether the bias is towards the buy or sell side of the market. However, the index is below the 5, 15 and 25 day’s moving averages, and all the three moving averages are declining and also negatively trended. Further, the velocity parameters too indicate weakness. Both these indicate a negative bias and the possibility of a further decline unfolding. Incidentally, the index is approaching a major support level at the 5867 points level. There is a possibility that the index could find some support around this level and reverse from there. However, if it crosses below it, then a further decline could be expected. Investors are advised to avoid buying at present levels.

CMP: Rs. 134 Target Rs. 193 GMDC’s 4QFY2013 net sales declined 17.6% to Rs 443 cr, mainly due to lower lignite sales volumes (- 20.5% yoy) to 3.1 mn tonne. We maintain our Buy rating on the stock. Lower costs mute EBITDA decline: The company’s staff costs and other expenses declined by 16.0% and 26.8% yoy to Rs 21cr and Rs 200 cr respectively and therefore the EBITDA declined at a lower rate of 9.0% yoy to Rs 224 cr whereas the EBITDA margin improved by 479bp. The power segment posted an EBIT loss of Rs 63 cr in 4QFY2013 as compared to an EBIT loss of Rs 128 cr in 4QFY2012. Higher other income and lower depreciation contained the decline in PAT to only 5.9%.Outlook and valuation: GMDC beats other PSU miners in terms of efficiency, volume growth and ability to take price hikes. Despite these factors, GMDC is currently trading at an inexpensive valuation compared to its peers, which is unwarranted, in our view. GMDC ticks most boxes for a long-term view: A stock which is a virtual monopoly with proven ability to increase sales volume and prices, available at an inexpensive valuation. The key catalysts for the stock are likely to be: 1) lignite price hikes, 2) regulatory approvals for brownfield expansions, and 3) commencement of production from Umarsar mines. We value GMDC at an EV/EBITDA of 4.0x FY2015E with a target price of Rs 193 and maintain our Buy rating.

O

leander Girl by Chitra Banerjee Divakaruni. Long before she reached her current total of 17 books, Chitra Banerjee Divakaruni had hit her stride and her oeuvre — which was the documentation of the female immigrant experience. in the US. That she has done it with considerable success is commendable, because she has a lot of competition, notably from Pulitzer prize winner Jhumpa Lahiri and Bharati Mukherjee, not to forget Anita Desai and Bapsi Sidhwa. Regarded as the most prolific in the category, time and again, her books have received plenty of plaudits from no less personages than Junot Diaz (Pulitzer for The Brief Wondrous Life of Oscar Wao) and Abraham Verghese (prize winning physician-author memorable for My Own Country).. Both have praised her for different works, fulsomely, as have Vogue, Outlook, etc. Therefore, in picking up this current work, her readers know exactly what to expect and are not disappointed, especially since the story, interesting but not shatteringly original in its premise, is accompanied by sharply observed situations, well-delineated characterization and lashings of style when it comes to simile, metaphor and imagery that straddled the seas and creates its own music across two countries — India and the US. Perhaps we should say Kolkata and the US, because of course the heroine is well-rooted Bengali who travels to the US, a place that the author, hav- familiar with. ing lived there for a couple of decades, is very So we have Korobi Roy, only orphaned

grandchild of a well-established, aristocratic bhadralok family who may not have all the money in the world but plenty of name and tradition. She meets Rajat Bose, newly-minted moneybags whose desirability off-sets Korobi’s own blue blood to create a heady coupling that then runs into problems. When Korobi’s grandfather dies suddenly, she learns a shocking secret that sets her off on a trans-ocean quest to discover the truth and find herself. Telling you any more would be a shocking breach of the spoiler rule so we will let readers find out for themselves. The book is a good read, racey enough to keep one turning the pages, but also satisfying in the author’s artful use of language and style. Actually, this is what saves it from becoming one of those dreadful books categorized under “airport novels”, because while you more or less know what to expect from Divakaruni, she continually surprises you with little nuggets that suggest original research, empirical fact into little-explored aspects of character. Everyone is beautiful or handsome, all are tormented, and each harbours a secret. That’s a lot like real life isn’t it, except that here it’s tarted up and made to look very good indeed! All in all, if the travel experience is what you enjoy, this book will absolutely not disappoint. Oleander Girl by Chitra Banerjee Divakaruni Published by Penguin Viking Price Rs.499

The mystery man who would be PM T

he NaMo Story: A Political Life by Kingshuk Nag. At a recent event to lunch this book in Mumbai, a panel discussion populated and moderated completely by journalists and featuring the author as well, threw up a curious viewpoint. Asked what they thought would happen if Narendra Modi actually became the Prime Minister of India, all cited different reasons that came to the same conclusion. NaMo had a little more than a snowball’s chance in hell of making it to 7, Race Course Road. Then why, asked a member of the audience (also full of journalists), was Indian news so keen on projecting his popularity on a national level as the man to watch against the background of the approaching elections? There was really no answer. Even as I write this, said newspapers (Indian) were announcing the Gujarat by-poll results and declaring them a boost for Modi, bringing him even closer to his ultimate dream — replacing Dr Manmohan Singh. Not a bad dream for anyone, but in particular for Modi, who has come a very, very long way since he started out, the middle of six siblings, son of a tea-stall owner at Vadnagar in northern Gujarat. You would be forgiven for saying “Vad-where”, for even now, it is far from being fully developed, and this itself, along with the fact that Modi has not carried along a single member of his family as he journeyed to the top in Gujarat, should tell you what a singular category he employs in the pantheon of son and family-loving, nepotistic and corrupt Indian politicians. Written in simple, direct reportage, Kingshuk Nag has done readers who would like to know more about the man who would be king a real service. All of us know bits and pieces about the man’s political journey, but he burst

upon the national psyche only with the Gujarat riots in 2002. Since then he has been viewed through the prism of presumed guilt or innocence, depending upon whether you support or oppose him. For, like it or not, cliched though it may be, the truth is that you may like Modi or hate him, you cannot ignore him. That’s how Nag introduces him, before taking us into the next chapter which addresses the main question — can he become Prime Minister? The thing is — no-one really knows what can

happen in the volatile world of Indian voting because results have so often gone completely contrary to expectations. The introduction of the AVMs may have brought more voters out to the polling booths, but cards are held very close to the chest indeed. So Nag does the next best thing – he weighs the pros and cons, does some math, says it is possible, and then proceeds to tell the reader what kind of Prime Minister Narendra Modi would make. In one word — different. From every other prime minister we have known except for Indira Gandhi! Much of the book treads familiar ground and we realize how much we have actually absorbed in bits and pieces about the man over the years. But absorbing does not mean putting the picture together. Nag does that for us, dovetailing fact, reportage, anecdote, interview into a seamless whole that makes for very good reading indeed precisely because there is very little drama. And because of the lack of hyperbole and declamation, it rings true, even though there is very little to add to knowledge of the man himself. For that, we will have to hynotise Modi and make him answer questions! That is the worrying part — that Narendra Modi, who has an outside chance of becoming the Prime Minister of India, is such a private person that no-one knows what might spring out once that last ballot has been counted and he is installed. If he is installed. 2014 is going to be a very interesting year indeed! The

Each of these clips is paused right before its big moment and the viewer is asked What Happened Next? They’re then presented with a number of incredible – but scientifically viable – options to choose from on the basis of the montage they’ve just seen. For example: Does the helicopter make the landing? Can the tornado lift the train? Will opening this window cause a backdraft? But they won’t be expected to answer off the cuff. Each clip is supported by a montage cut to give the viewer a clue as to what is about to unfold, from demonstrating the lifting power of tornados, to the impact of building demolitions gone wrong; and from the effects of helicopter engine malfunctions to the damage potential of giant hailstones. MUMTAZ’S BIG FAN

LEGENDARY ACTOR AMITABH BACHCHAN IS POISED TO TURN THE SMALL SCREEN INTO A MEGA-SCREEN WITH HIS MAGNIFICENT TOWERING PRESENCE, IN A ‘KEEP GUESSING’ TV SERIAL AS OF NOW.

BIG B GETS SET TO DEBUT ON SMALL SCREEN! I

By Chaitanya Padukone

n a daring initiative, superstar Amitabh Bachchan is poised to make his telly screen ‘debut’ as the lead actor in an “enthralling finite fiction” TV serial (Sony) being directed by the maverick filmmaker Anurag Kashyap (‘Gangs of Wasseypur’) and re-define telly-screen content. Strangely, the whole AB starrer telly opus which is a co-home production for the Bachchans, is being guarded in an armour of intriguing suspense. Unlike the immensely popular prize-money quiz show ‘KBC’ (Sony) hosted by Amitabh, which offers answer options and even expert advice there was no such facility to ferret out any details regarding the title, the concept or the lead cast. Explains the Big B, “Director Anurag and the creative team are yet in the proactive process of constructing the serial. Actually, without informing even my family members I have had discreet meetings with them. It’s premature at this stage to reveal any details but its definitely different,” he insists. In Indian showbiz it’s considered a major challenge for any top-ranking movie

actor to shed their big-screen aura and don a fictional TV character’s avataar. Did the par excellence “demanding” actor have any apprehensions? “In fact for the past six long months we have been meticulously working on it and taking it further. During this phase, a series of debates and arguments on the pros and cons have taken place before a final consensus was arrived at. Because, when one is venturing into something novel there is bound to be pressure owing to the potential dangers and the anxieties that it brings along,” admits ‘workaholic’ Amitabh who is willing to take on the ‘strenuous’ shooting schedule pressures of a TV soap. “If it is warranted, I am willing to work for even 18 hours a day,” enthuses the indefatigable 70-year-old acclaimed actor. Unlike certain A-list film luminaries, who feel ‘acting’ on the ‘small screen’ would tantamount to some sort of a ‘demotion’ for them, the Big B has no hang-ups. “With the kind of colossal revenue that it grosses ( he quotes the figures off –the-cuff) television today, is a much bigger medium of entertainment than cinema in terms of commercial turnover and has an extensive instant penetrating global reach,” counters the Bachchan in his bass baritone. Meanwhile, director Anurag assures that when it goes on air, the new Sony “family entertainer soap” would definitely not be a ‘one-man-show’ despite Sr. Bachchan’s formidable scene-stealing presence.

Stray killers should be booked, convicted O

n June 8th, a small crowd gathered around the lifeless body of a young dog Frisky - the cynosure of all eyes in the lane. Frisky, like those millions of other strays, was hated by a handful, one of who even allegedly went to the extent of picking him up one night and dropping him a few kilometres away at Cuffe Parade. This time around, it seemed that whoever it was, had got the better of Frisky who appeared to have been poisoned to death. After a brief bout of retching through the previous day, he collapsed and died the next morning, on the very pavement he lived for the last four years. While the local police have initiated an investigation and a postmortem of Frisky’s carcass at the instance of a local, poisoning if proved will lead to an FIR and a concurrent manhunt for Frisky’s killers. Just last month, it was reported that two out of three men were arrested by the city police after a video of the three brutally murdering a stray dog was recorded by a CCTV camera installed in the area. In the footage recorded in the camera, the three accused were seen stabbing and stoning the dog to death early in the morning. The three men approached the dog at around 6 in the morning and then tied it with a chain and started dragging it around while attacking it with knives and stones. It happens all over the country and needs to be stopped. Just recently it was reported that over 150 dogs have been poisoned in Indore over the past four years. Ironically, it was the Indore Municipal Corporation (IMC) that reportedly poisoned these dogs to keep the population of mongrels under check. The municipal corporation’s act of killing dogs by such means is in direct violation of the law of the lane which lays down perfectly humane way like sterilisation to control their population. Killing of stray animals is a cognizable offence under the Prevention of Cruelty against Animals Act (1960). Also, there are many programmes like Animal Birth Control under which the population of the stray dogs can be controlled through method like immunisation and sterilisation. Last year, in Navi Mumbai an eight-month-old dog was killed in a horrific manner. Reportedly, a fire

Societies break law, impose fine for ‘feeding strays’ WHEN Mira Road resident and film-maker Partho Ghosh was fined Rs 1,000 in his maintenance bill for “feeding strays,” who lived outside his society, he refused to pay up unless “the society proves the charge was legal.” Ghosh’s isn’t a case in isolation. A lot of societies’ managing committee members take it upon themselves to play law-enforcers, act like the judiciary and impose fines randomly and arbitrarily. In the absence of any opposition, they also go on to collect the fines and spend it as ‘sundry’ accounts without offering any details too. Concurrently, no Cooperative Housing Society’s managing committee has the right to impose fines and / or levy any penalty in this regard. Affected parties may refer to Indian Penal Code (1860) - Section 428 & 429; Bombay Police Act (1951) - Section 73 to 78 / Sec 99 ; The Maharashtra Animal Preservation Act; The Maharashtra keeping & movement of cattle in Urban Areas (Control) Act (1976) and Prevention of Cruelty to An-imals Act (1960) ; Prevention of Cruelty to Draught & Pack Animals Rules

On June 8th, Frisky who lived at Third Pasta Lane in Colaba died, all of a sudden, after a brief bout of violent retching. It is feared he was poisoned by a local dog-hater who had tried to relocate him from the lane. Police investigations on the alleged killing are afoot and if a postmortem proves death by poisoning, a manhunt for Frisky’s killer will be launched cracker explosion was set up to kill the poor dog. Fire-crackers were tied to the dog’s body and lit up. The explosion caused the death of the dog. Examination by a local vet revealed the dog had died due to severe burn injuries, a broken vertebral column and ribs. The dog’s body was found inside Rajiv Gandhi stadium at CBD-Belapur by some students who come to study at a nearby library. Earlier too, cases of stray dogs being poisoned have been reported in the area but the Navi Mumbai Municipal Corporation has not been able to do anything because of “lack of space” at the dog pound. In 2008, at one time over 20 stray dogs were poisoned in a single day

What’s abominable is that these felons think that they can get away with committing crimes as heinous as killing an innocent animal in the dark of the night and feel they can get away with it. It is your rights as a citizen to protect your stray. Where issues of stray population or dog bites attacks are concerned, the problem needs to be tackled systematically by the Municipal Corporations and NGOs together. By killing stray like they do in ‘Malaysia’ as offered as an argument is certainly not done! With inputs from Prerna Pandey

JK-Tyres backed Karamjit Singh (left) and co-driver Jagdev Singh of team Slideways Industries who won the Indian Rally Championship (IRC) class in the Rally of Maharashtra, Nashik on Sunday.

NASHIK: Experienced Karamjit Singh was a cut above the rest finishing only second-best to overall winner Gaurav Gill (codriver Musa Sherif) on the concluding day of the INRC (Round- 2) Rally of Maharashtra, Nashik on Sunday. Going flat out on an overcast day, the JK Tyre -backed Karamjit did well on the final three stages to win the Indian Rally Championship (IRC) Class and finish second overall. In end analysis, Gill, driving a modified XUV 500, was quickest (1 hour 26 minutes 0s), with Karamjit trailing in at (1:27.40). On the final day, Karamjit, driving a Volkswagen Polo, lived up to his top billing clocking the fastest time among the twowheel-drive (2WD) cars on a terrain that he described as, “challenging and extremely tricky”. Held on the outskirts of Nashik the event is the only tarmac rally in the INRC calendar and this year the rains threw another challenge at the drivers. The 2002 Production Car World Champion, began the day with a bang going the fastest on the first stage of the day to take the Polo to its second victory in only its second rally. Rallying the Volkswagen Polo for the first time Karamjit Singh was on the pace from the word go clocking blistering times.

ANGKOK: K Srikanth became the latest badminton sensation to emerge from India as he lifted his maiden men's singles title with a stunning straight-game triumph over top-seeded local favourite Boonsak Ponsana at the Thailand Open Grand Prix Gold here. The 20-year-old from Guntur, Andhra Pradesh beat world number eight Ponsana 21-16, 21-12 in a 34-minute match to script the biggest win of his still nascent career. "When I went into the court, I was pretty okay. I was not thinking anything. He was the local guy and the court was also with him. I knew I had a 50-50 chance even though he is world number eight," the excited youngster told PTI. "I just wanted to give my 100 per cent. I was focusing on one point at a time and I knew it was all about who plays well on that particular day," he said. Indian The 13th-seeded matched his fancied rival in all departments of the game in what turned out to be a lop-sided contest. "The win has not sunk in. I am still pretty excited. I spoke to my parents and they are also very happy. I will be travelling to Hyderabad tonight and probably fly back to Singapore next Friday or Saturday," he said. The first game went neck and

neck before Srikanth broke free to notch up six consecutive points to win the game and wrest the initiative. "The first game was tough. I was leading by 2-3 points from the start but in the end he was like 1516 but he made some unforced errors as I played some attacking badminton. It worked as I got four points on the trot and that made all the difference," he said. The second game was a completely one-sided affair with Srikanth scoring at ease. The Indian sent down nine smashes against his rival's three to stamp his authority in the match. Ponsana had a two-point lead to start with but Srikanth made amends quite quickly to reel off eight successive points and seal the game and the match in his favour. "In the second game I played pretty well, I was leading 11-5 and continued in the same vein. I didn't relax and stayed focussed. I could see that although the crowd was supporting him, he looked tense and turned on the pressure on him," he said. Srikanth had previously reached the quarter-finals of the Asian Junior Championships and entered the prequarterfinals of the World Junior Championships in 2011. Indian male shuttlers have been making quite a mark internationally of late. P Kashyap had won the Syed Modi Grand Prix Gold last year.

BRIDGE Assume that you can break every contract & defend accordingly. Partner’s 2 of spades promises 4 cards in spades with an honour. So declarer has 2 spades left! You wonder why south has not tried to discard one spade loser on the clubs,

because if he has 2 clubs then partner has 3 & declarer’s 1 spade loser can immediately go away. After pondering this problem you realise that south must have 3 clubs & cannot discard a spade till the trumps are drawn. So what should you do? Play back a spade or shift to hearts. You are not certain. Now go back to the first trick. Instead of making the correct play of” Third Hand High” you play the Jack

of spades to find out who has the Queen. If declarer wins with Ace then you know 2 spades are cashable. On the contrary if declarer wins with Queen you know a spade is not cashable, because partner is unlikely to underlead an Ace in suit contract. So you must shift to a heart hoping partner has Ace & Queen, & that is why he has made this anemic lead of spade from 10 x x x. What if partner has underled the Ace of spades & you have allowed a ridiculous to make? After partner’s tirade is over change the partner.

IN BRIEF Double bonanza for Mahi Racing, both riders finish on podium

NEW DELHI:Mahi Racing Team India riders Fabien Foret and Kenan Sofuoglu stayed on course for a shot at the overall championship as they finished second and third respectively in the sixth leg of World Supersport Championship at Portimao, Portugal today. Foret, who began the race in fourth place, leapfrogged two riders to finish with a timing of 35'33.262. Sofuoglu, who started the race in second place, completed the podium party with a timing of 35'33.384. Both the riders are now tied on second spot in the overall standings with 81 points each and trail leader Sam Lowes of Yakhnich Motorsport by 39 points. Lowes took his fourth successive chequered flag today but Foret isn't really worried."It is still early in the season and we can easily bridge this gap. He (Lowes) has hit a purple patch but we are not far behind," said the confident Foret. Though Sofuoglu finished third, he registered the fastest lap of the race on the 12th lap when he set a timing of 1’45.730 and held the lead for four of the 20 laps of the race.

IPL should not be scrapped: Ashanta de Mel

AHMEDABAD: The spot-fixing and betting scandal in Indian Premier League matches is unfortunate but IPL should not be scrapped, former Sri Lanka fast bowler Ashanta De Mel said. De Mel, who played 17 Tests and 57 ODIs besides serving in the Sri Lankan Cricket Board, said IPL has its positives. "It provided opportunity to the young cricketers to showcase their talent. It also enabled youngsters and promising players to learn and gain experience by playing alongside top players in the game," he said. De Mel, who is an avid bridge player and represented Sri Lanka in the Commonwealth Games in the card game, is here participating at the ongoing Bridge Federation of Asia and Middle East (BFAME) Championship.

Sreesanth's arrest painful for fans in Kerala: Tharoor

KOCHI: Minister of state for HRD Shashi Tharoor said the arrest of Kerala pacer S Sreesanth for alleged spot fixing is "very painful" for cricket fans in the state. Asked if it was fair for Delhi police to have invoked stringent provisions of MCOCA against Sreesanth and 24 others, Tharoor said, "It was for the court to decide on it." "The enthusiasm of young fans should not wane due to the IPL episode," he told reporters on the sidelines of a function here. Tharoor said 18-year-old Sanju Samson from Kerala, who played for Rajasthan Royals this year had become a star and added that Kerala has become a serious cricketing state. The IPL episode should not be a 'setback' for cricket, he said.

Ashwin ends tied 13th to be best Indian performer in Albena

ALBENA, BULGARIA: Ashwin Jayaram emerged as the best Indian with a tied 13th place finish after settling for a draw with GM Boris Chatalbashev of Bulgaria in the ninth and final round of Grand Europe Albena Chess tournament. There was little to cheer for the Indian enthusiasts as highest rated Indian Abhijeet Gupta went down fighting against International Master Vitaliy Bernadskiy of Ukraine in his final round. Earlier in the eighth round Abhijeet had raised visions of an improved finish after outplaying Eylon Nakar of Israel. Tigran Petrosian of Armenia comprehensively won the tournament defeating Levente Vajda of Romania in the last round.

Rafael Nadal sinks to the ground in triumph after he defeats compatriot David Ferrer in the men's final match of the French Open on Sunday.

Rafael Nadal defies protest to clinch record eighth French Open

P

ARIS: Rafael Nadal defied David Ferrer as well as a worrying security breach to become the first man to capture the same Grand Slam title eight times on Sunday with victory in the French Open final. Nadal claimed his 12th major with a 6-3, 6-2, 6-3 win over his Spanish compatriot who was playing in his first Grand Slam final at the age of 31 and at the 42nd time of asking. It also gave Nadal his 59th win out of 60 matches played in Paris. However, the 27-year-old's push to victory suffered a heart-stopping moment when a protestor, naked from the waist up, leapt from the stands on Court Philippe Chatrier, carrying a flare and protesting France's controversial same sex marriage law. The protestor, who was wrestled away by security staff, came within just a few feet of the Spaniard as he prepared to serve at 5-1 in the second set. A burly security official immediately came to Nadal's aid in front of the VIP box where Olympic sprint champion Usain Bolt and Hollywood superstar

Leonardo DiCaprio were watching. The drama, however, didn't alter the outcome as Nadal claimed his seventh title of 2013 after returning to the tour in February following a seven-month injury lay-off. "Thanks to everyone in my family and team. Without their support, especially when I was out of action, this would have been impossible," said Nadal. "Thanks also to everyone who sent me messages on Twitter and Facebook. They all gave me positive energy for today."Ferrer had raced through the first game to love, but it was the champion who broke first for 2-1 when his compatriot unleashed a wild forehand. Ferrer, showing all the attributes which gave the nickname of 'bloodhound', was level in the next game at 2-2 and with both sluggers evenly matched, it was going to take something out of the top drawer to settle the opening set. Nadal produced it right on cue, flashing a superbly controlled, sliding backhand on the move, from 10 metres behind the baseline, past the advancing Ferrer.

Nadal backed it up in the ninth game when a double fault from Ferrer handed him a set point which translated into the first-set advantage when the veteran dumped a weak backhand into the net. Ferrer hadn't dropped a set in the tournament and had spent six hours fewer on court getting to his maiden final. But he was in serious trouble and he knew it, suddenly confronted by Nadal's record of 145 wins against just three losses when he had won the first set of a Grand Slam match. Their personal history was also stacked against him with just four wins against 19 defeats coming into Sunday's final. Sixteen of those losses were on clay and Ferrer's only victory on the surface was way back in 2004 in the pair's first meeting when Nadal was still a raw 16-year-old. In no time at all, and with light drizzle falling, the champion was 3-0 ahead in the second set as a love-service game backed up a break which had been secured with a pair of sharp forehands. Ferrer halted Nadal's six-game streak for 3-1 but was unable to

convert four break points of his own in the fifth game, a marathon duel which included a 29-shot rally. Nadal was 5-1 up and preparing to serve for the second set when a spectator, naked from the waist up, leapt from the stands carrying a flare just feet from where Nadal was standing. The intruder, with the words 'Childrens rights' written across his chest, was wrestled away from the court. The final had already been held up by protestors high up in the stands holding up placards demonstrating against France's same sex marriage law.

RUSSIAN PAIR CLAIM MAIDEN WOMEN’S DOUBLES CROWN Ekaterina Makarova and Elena Vesnina claimed their first trophy at a major, defeating the defending champions, No.1 seeds and world top-ranked pairing Sara Errani and Roberta Vinci 7-5, 6-2. In a match where baseline rallies dominated, the Russians focused on Errani’s back-court play, attempting to bypass the punchier Vinci who can dominate the net like few others in the women’s game.

Pak bowlers should go for wickets against SA, India: Akhtar

KARACHI: Former fast bowler Shoaib Akhtar advised Pakistan bowlers to be aggressive and go for wickets in their group matches against South Africa and India to remain in contention for a knock-out berth in the ongoing Champions Trophy in the UK. "Both teams (South Africa and India) have strong batting lineups, so our bowlers should not be thinking of containing them but about getting wickets," Akhtar said. "South Africa is struggling with injuries to their top pace bowlers. Pakistan must try to take advantage of this," he said. Pakistan have to beat South Africa tomorrow to stay in contention for a semifinal spot after they lost a close encounter to the West Indies. They play India in their final group match on June 15. He felt that Junaid Khan needed to step up his game as he was the key to Pakistan's success. "Junaid would be the most effective bowler on the English tracks and he has to exploit the conditions. Against the West Indies, Muhammad Irfan made an impact. England is a great place to make an impact. I remember I bowled well in 1999 World Cup and then progressed rapidly after that," he said.

ARDIFF: The gallant Sri Lankans fought right down to the wire. Having totaled a paltry 138, the Sri Lankan bowling led by the doughty Lasith Malinga really turned the screws on the New Zealand batsman who themselves did well to register a memorable win in their Champions Trophy match. In the end, New Zealand pulled off a nail-biting one-wicket victory in a low-scoring Group ‘A’ thriller. Chasing a paltry total, New Zealand made heavy weather of their run chase as Sri Lanka put up a tremendous fight on the back of a fiery spell by paceman Lasith Malinga. New Zealand were made to sweat for every run scored as they huffed and puffed their way to victory with 13.3 overs to spare at Sophia Gardens. The track was conducive for seam bowlers as both sides reaped benefits with the likes of Kyle Mills, Shaminda Eranga and Lasith Malinga extracting a lot of movement off the pitch. Malinga put on display an incisive spell of fast bowling to slice through the opposition batting lineup but could not decisively turn the tide in his team’s favour. Malinga bowled his heart out to finish with an impressive figures of four for 34 from his 10 overs. Earlier, New Zealand bowlers stuck to a disciplined line to skittle out Sri Lanka for a paltry 138 inside 38 overs, their fifth-lowest total after choosing to bat first. Barring former skipper Kumar Sangakkara who stood tall amidst ruins, scoring 68 off 87 balls with eight boundaries, others simply didn’t have any clue against controlled seam bowling by seasoned Kyle Mills (2/14) and young left-arm seamer Mitchell McClenaghan (4/43), who kept cutting partnerships short. The start for New Zealand was

Martin Guptill and Kane Williamson led the recovery path for the Black Caps with a 34-run stand for the second wicket but Malinga flummoxed the latter with a slower delivery to get him out leg before for 16. BRIEF SCORES: Sri Lanka: 138 all out in 37.5 overs (Kumar Sangakkara 68, Mitchell McClenaghan 3/43). New Zealand: 140 for 9 in 36.3 overs (Nathan McCullum 32, Martin Guptill 25; Lasith Malinga 4/34).

Pakistan, South Africa in battle of survival in CT B TODAY’S MATCH

Group B

Match 5

South Africa Pakistan To be played at: Edgbaston, Birmingham Time: 15:00 Hours

IRMINGHAM: Handed defeats in their respective tournamentopeners, Pakistan and South Africa would be fighting to stay alive in the ICC Champions Trophy when they take on each other in their second group B match here today. While Pakistan lost their opening match to the West Indies in a lowscoring cliffhanger, South Africa were beaten by India by 26 runs. Today's match will be a shootout of sorts for both the teams and it is the South Africans, who are looking more vulnerable, despite the wellknown unpredictability of the Pakistanis. The Proteas are faced with the challenge of playing Pakistan without two of their main strike bowlers as Morne Morkel has gone back home due to injury, while Dale Steyn remains a "work in progress" on the fitness front.

as recovery is concerned. We can only get him to start bowling once he is symptom-free," Mohammed Moosajee, South Africa team manager and doctor, has explained. Newcomer Chris Morris is almost certain to make his ODI debut against Pakistan. Morris replaced Morkel, who was forced to return home due to a groin injury against India. "I've been with this team for two years. Morne has been injured once and Dale has never been injured. Now it's come together. That's a curveball," admitted South Africa coach Gary Kirsten. Pakistan may not have injury The update on Steyn is still not quite clear after the world's No.1 concerns to deal with, but Misbahfast bowler was injured during a ul-Haq still has plenty of worries on warm-up match against Pakistan at his plate. play with more responsibility and stay on for at least the entire 50 overs. "...Even after losing three wickets (for 15 runs) at one stage, the game was under control, but then we made mistakes. So it's just about taking responsibility and taking the games to the end. The batsmen need to be more responsible and just carry on," said Misbah. What Pakistan took confidence from was their bowling show which stifled the Windies, who made a hash of the chase before winning by two wickets. "I think the biggest positive from this game was our bowling. All the seamers bowled really well and bowled their heart out and took wickets. And at one time we were really in the hunt, so it's really a big positive, and it just creates pressure on the opposition," Misbah said.
