Viennese Johann Strauss Gala-Concert

Wiener Johann StrauS Konzert-Gala

September 6th, 19:00 at S. Ludkevich Philharmonic Concert Hall (7, Chaykoyskogo St.)

Be sure not to miss the special performance by the Ukrainian-Austrian K&K Philharmoniker symphony orchestra on September 6th at 19:00 at the S. Ludkevich Philharmonic Concert Hall. Under the bouncing baton of conductor Taras Lenko, the orchestra is set to treat Leopolitan musical lovers with a rousing performance of popular pieces by Johann Strauss. Easy on the ears, this relaxing and charming music will truly create an atmosphere of unforgettable recreation. The highlight of the concert will undoubtedly be the musical compositions, which are rarely performed in Ukraine. It was conductor Matthias Georg Kendlinger who, in the summer of 2002, created his own symphony – the K&K Philharmoniker. This group of 70 musicians has already performed at over 100 of Europe’s finest concert halls, such as the Herkulessaal Münchner Residenz, the Tonhalle Zürich and the Konzerthаus Berlin. Taras Lenko is a graduate of the Lviv National Music Academy and a long-time musician in the K&K Philharmoniker. He acts as the assistant to Maestro Kendlinger and is honoured to present Leopolitans with this delightful musical evening. Tickets are selling for 60–250 UAH. For more information, or to book your tickets, please call (032) 255-1055 or visit: www.philharmonia.lviv.ua.

KOKTEBEL JAZZ FESTIVAL 2014

September 11–14, Bilhorod-Dnistrovskyi (Odessa Region)

The ancient Akkerman Fortress and the Zatoka village beach in Bilhorod-Dnistorvskyi (Odessa Region) will host the Koktebel Jazz Festival 2014 from September 11–14. The festival, traditionally held in the Crimean Region, has been moved to the Odessa Region for 2014. The Koktebel Jazz Festival was founded in 2003 and over its decade plus-long run has gained the status as one of the largest and most soulful festivals in all of Ukraine. The Koktebel Jazz Festival features 3-stages in a multi-format that hosts more than 30,000 people at over 70 concerts over the 4 days every year. The Nu Jazz Stage will be located in the Akkerman Fortress courtyard, which at 9 acres is the largest in Ukraine. The Open Stage will be located at Zatoka Beach, a popular holiday destination on the Black Sea coast. The Voloshyn Jazz Stage, which 12 years ago became the first in Koktebel Jazz Festival history, will be organized as a separate weekend – the Voloshyn Jazz Weekend will be held in Kyiv from September 19–21. Alexey Kogan is project leader and curator. A 4-day weekend pass to the Nu Jazz Stage runs for 499 UAH. For more information, or to book your tickets for the Open Stage and Voloshyn Jazz Weekend, please visit: www.koktebel.info.

Lviv’s FOOTBALLING LEGACY

W

hile football fans around the world are glued to their TV sets to watch the world’s biggest football spectacle in Brazil, Lviv Today takes the opportunity to look at our own footballing heritage. While Ukraine has existed as an independent state since only 1992, our football history goes much further back. The history of football in Lviv dates back to the late 19th century with the rising popularity of the sport and the first decades of football in Lviv are associated with the history of football in Austria and Poland.

Football in Austrian Lviv Organized sport benefited from the environment of cultural freedom in late 19th Century Lviv and it was then that Polish and Ukrainian football took its first true steps. July 1894 saw Lviv host a series of sporting tournaments, including a football match between the Sokol clubs of Lviv and Krakow. The match saw Lviv take an early lead on a goal by Włodzimierz Chomicki, however the match was called off early due to a conflict with a gymnastics competition that was set to be held in the same stadium soon afterward. Chomicki’s goal is considered to be the birth of football in both Poland and Ukraine. As in many other spheres, the game is claimed by both Poles and Ukrainians as the start of their football legacies; the Poles because the two sides were from Polish secondary language schools, and the Ukrainians as the game took place in what is now Ukraine.

24

The sport soon blossomed in the city, even though it took another nine years before the first Lviv-based club was created. Lviv’s first football teams were formed in 1903–04 when four local gymnasiums formed their own clubs: the Gymnasium for Boys formed a club that became Pogoń Lwów, the State Schools I and II created the Sława Lwów club (which became Czarni Lwów), and Lechia Lwów rounded out the new squads. There is debate as to which side was organized first as the teams were poorly organized. However, Czarni Lwów is generally credited with being the first Polish professional football team. Ethnicity, it seems, played an important role in the establishment of football clubs at the time. As each side was set-up by Polish Leopolitans, the teams can be considered Polish clubs. But Lviv’s Jewish citizens also had their own side: Hasmonea Lwów. Football acted LVIV TODAY | Summer 2014

LVIV history as an opportunity for different ethnic groups to express themselves in a safe environment. It wasn’t long before Ukrainian Leopolitans organized their own side. The Ukrainian pioneer of the beautiful game in Galicia was John Boberskyi, a teacher at a secondary school in Lviv. Boberskyi was a mover-and-shaker in Lviv’s sports community where he had his students participate in several sports, including: athletics, boxing, hockey, skiing, guiding, and sliding sports. In addition, he invited a Czech football coach to train his students. By 1906 he had set up a ‘Sports Circle’ at his school and later travelled Galicia to spread the popularity of football to his fellow Galicians. For example, it was Boberskyi that convinced Ukrainians in Stanislawów (now Ivano-Frankivsk) to take up the game. Indeed, it was he that organized the first Ukraine-wide ‘Sports Circle’ in 1908. By 1911 his students formed the patrioticallynamed ‘Ukraine Lwow’ squad, which was to become the strongest Ukrainian football club in Galicia. Football in Lviv 1921–39 Ukrainian football fundamentally changed following the PolishUkrainian war. Many athletes had fought on opposite sides of the barricades and Ukrainians were reluctant to participate in the Polish football system. For patriotic Ukrainians, playing against Polish teams was surmount to accepting Polish state control and tantamount to collaboration. Despite this, Ukrainian clubs re-establish themselves across Eastern Galicia, including Lviv. Ukrainian teams refused to play Polish squads until the middle of the 1920s. The breakthrough came in autumn 1925 when they played their first friendly against a Polish Hasmonea Lwów. This marked an important first step in normalizing relations on the football pitch between Poles and Ukrainians. By 1928, Ukrainian teams took a further step by deciding to join the newly formed second-division Lviv A-Klasa. Their entrance initiated a chain reaction amongst Lviv-based Ukrainian clubs – by the mid1930s, a good number had begun to participate in the Polish football system. The presence of these clubs marked an important symbolic step for the Ukrainian community in Poland. For example, when in 1929 the Lviv-based Ukrainian newspaper ‘Dilo’ was flabbergasted that Ukraine Lwow couldn’t find a Ukrainian side to play against in the city of Stanisławów, a new team – Prolom (Breakthrough) – was organized in the city to take part in the Polish system. Apart from these two sides, other Ukrainian teams like Skala Stryj and Sian Przymyśl also decided to join the Polish system. The interwar period can be considered the golden era for football in Lviv; indeed, the city was famed for its footballing strength. Pogoń Lwów, the Polish community’s club in the city, led the way with four Polish titles between 1922–26. The squad featured superstar Wacław Kuchar, known not only for scoring an incredible 1065 goals for the club, but for also being a Polish champion in speed-skaing, ice hockey, and several athletics events. While the club saw a drop in form in the 1930s, the side would remain a staple of the Polish premiere division. Several other Lviv-based squads saw success during the interwar period, with Czarni Lwów, Hasmonea Lwów, and Lechia Lwów all reaching the premiere division during the period. The high level of competition led to heated rivalries and an amazing football climate in the city. Ukraine Lwów, Aleksandr Skocen & the President’s Cup “Ukraine Lwow” was the flagship Ukrainian side during the interwar years in Poland. While they never qualified for the premiere division, they played at the highest level of regional football in Lviv from 1928–1940. The late 1920s saw the club reach its greatest successes as they finished as runners-up each year between 1937–39. Let’s take a look at the glory years of Lviv’s first Ukrainian football heroes. In 1937, a time when storm clouds hung over Europe with Hitler in power in Nazi Germany and the Great Terror and its gory manifestations in full swing in the Soviet Union, Lviv’s A-Klasa division was just getting started. The league was comprised of 14 teams, including one Jewish club (Hasmonea) and one Ukrainian squad (Ukraine Lwow). As part of Lwow’s preparations for the beginning of the season, the team played the touring Bocskai team from Hungary. The team unfortunately went down to defeat 4:3, but took spirit in making a strong showing after trailing 3:1 at half. LVIV TODAY | Summer 2014

Surely the indisputable star of the Ukraine side in the late 1930s was the unmatched Aleksandr Skocen. Skocen, born to a sporting family in the late throes of the Great War, was a true sporting prodigy. He loved hockey in winter, football in summer, and stood out among his peers in terms of athletic ability. Hailing from a family of patriotic Ukrainians, Skocen spent a good deal of time at the local branch of the Prosvita Ukrainian cultural organization. At just 15, he learned that Prosvita was forming the ‘Tryzub’ (Trident) football team and jumped at the chance to sign up. A few years of playing striker for Tryzub and Ukrainian scouts took notice after he netted a hat trick against Skala Stryj in the final of a youth tournament. He soon became a star for the Ukrainian national team and was relied on as the team’s main goal-scoring threat. A mark of how good he had become came in summer 1938 during the President’s Cup, an annual tournament organized by the Polish President. This knockout format tournament featured teams representing different Polish provinces. Lviv’s team was made up nearly exclusively of Pogoń players with the exception of two Ukrainians: Skocen and his teammate Vladimir Bohurat. While the two only appeared in one match, what a match it was! The team from Lviv hammered Śląsk 7–1 with Skocen and Bohurat setting up a number of the goals. Following this tremendous showing, Pogoń made several attempts to sign the talented Skocen; however he stayed with Ukraine until the outbreak of war in 1939. Following the Soviet invasion of Eastern Poland in 1939, football teams in Lviv ceased to exist. NKVD officers brought Skocen to Kyiv to play for Dynamo before he made his wake back to Lviv following the Nazi invasion of the Soviet Union in 1941. He played only one more time for a reformed Ukraine side in 1944 before he was forced to flee to the West in fear of returning Soviet troops. He eventually made it to DP camps in Austria and Germany before having two successful seasons with the French First Division side OGC Nice from 1948–50. Skocen left Europe behind for good in 1950 when he immigrated to Canada. FC Karpaty Win USSR Cup Lviv’s colourful cultural mosaic was shattered by the Second World War as the holocaust brought an end to Jewish life in the city and the new borders and population displacement emptied the city of its Polish population. For example, according to the last census, the Lviv Oblast is now 95% ethnically Ukrainian. The history of football in Lviv tells of a time when things were more diverse and a heck of a lot more complicated, but more interesting as well. In the decades following the Second World War, Ukraine asserted itself as a football powerhouse on the world stage. It is generally considered that Russia is the official successor to the national team of the USSR, however this appropriation of history overlooks just how influential Ukrainian players and clubs were in the Soviet era. Named after the nearby Carpathian Mountains, the local FC Karpaty evolved from the factory squad Silmash and inherited their forerunners’ colours when the replaced the squad in the Soviet Second League. The club made history in 1969 as the only team outside the top flight to lift the USSR Cup. Ukraine’s Post-Soviet Football Legacy If one looks at the official FIFA records, they will find that the Ukrainian national team as a separate and recognized entity has existed for only 20 years. The record over these two decades is full of closebut-no-cigars as the team has fallen in World Cup qualification in the final round on 3 of 4 occasions. The team made one World Cup appearance in 2006, where our heroes fell to eventual champion Italy in the quarterfinals. The team nearly qualified for the quarterfinals as co-hosts of EURO 2012, but dropped a controversial 1–0 decision to England to prevent further progression. Ukraine nearly qualified for this summer’s World Cup in Brazil taking a 2–0 lead into the final qualification game in Paris, before dropping a heartbreaking 3–0 loss to France. The loss left Ukraine as the highest ranking team in the world to not qualify for the main draw. Ukraine currently sits as the 17thranked team in the world, higher than the successors of the USSR (Russia), and a proud reminder of the glorious footballing legacy that Ukraine left behind as part of the Soviet Union.

LVIV OLYMPIC AMBITIONS ON HOLD

2022 2026 W

hile the political and security situation in Ukraine seems to be improving, it comes too late for two major sports organizations, who have decided to cut ties with the 2015 EuroBasket Championship (of which Lviv was set to host games) and Lviv’s 2022 Winter Olympic bid. Both decisions were widely expected and officials from both groups vowed to continue their goal of hosting the events at a later date. The FIBA Europe Board, for example, has already authorized its executive to begin negotiations with Ukraine with respect to hosting the 2017 tournament, while the Lviv 2022 bid committee announced as they withdrew their bid for the 2022 Olympic Games that they felt that “a bid for 2026 would make more sense.” So while the current events in Ukraine threatened to derail the plans of the organizing committees, it seems as if they have only delayed them.

Later Bids Expected Losing the EuroBasket tournament, where Lviv was set to host games next summer, and the Olympic bid, where the Lviv bid could have been gaining momentum as the number of competing cities dwindle, are being taken by officials not with the regret of lost opportunity, but with a sense of renewed optimism. Yet with the cancellation

42

of next year’s event and the withdrawal of the 2022 bid, the future of infrastructure projects tied to the events, such as the new, multipurpose indoor arena near Arena Lviv, has been thrown into doubt. That hasn’t, however, worried Sergei Gontcharov, the chief executive of Lviv’s 2022 bid, who insists that the city will continue to take a future Olympic bid into account in its future city planning, “most of the necessary infrastructure projects for the Games are part of the city’s long-term development plan irrespective of the Games and will continue to be implemented.” The idea of using the events as part of a reconstruction plan for Ukraine was echoed by Ukrainian PM Arseniy Yatsenyuk, “a bid for 2026 would have excellent potential for the economic recovery of the country, and could have huge benefits for Ukrainian society.” In fact, there is already some reason for optimism as it seems that a 2017 EuroBasket in Ukraine is a foregone conclusion. The IOC too, looks positively on a future Leopolitan Olympic bid as it noted “a huge potential for future development” in its preliminary assessment of the Lviv bid. So while it has certainly been a disappointing month for Leopolitan sports fans, it seems as though the message is not so much ‘goodbye’ as it is ‘see you later’. LM Reaney LVIV TODAY | Summer 2014

Facebook Shell Shock: Ordinary Ukrainians exposed to multimedia trauma Social media helping to fuel anxieties as Ukrainians cope with revolution and war

A

s the conflict in East Ukraine continues to unfold, it is becoming increasingly apparent that we are living in traumatic times and witnessing events that impact upon our emotional health. This impact has been magnified by the non-stop flow of information via social media platforms such as Facebook, which provide Ukrainians with emotionally draining minute-by-minute accounts of the traumatic events which are shaping the future of their nation. Ukrainians living with everyday trauma The psychological effects of witnessing events such as Ukraine’s Euromaidan protests and the insurgency in East Ukraine are now well recognized by mental health experts as post traumatic stress syndrome. In its widest sense, this can be applied to anybody who has had a traumatic experience and feels emotionally affected by it. It is important to realize that the stress and anxiety felt after such incidents is absolutely normal and that the majority of people have the ability and learnt collateral experience to deal with such problems. We live in an age where there is a tendency to medicalise all of life’s problems, and amongst medical professionals there is an ongoing debate as to whether counseling for such events should be mandatory. As professionals, we now understand some of the stages of this syndrome, and its treatment in skilled hands has good results. Patients often worry about constantly revisiting experiences in the days after they take place, but this is a normal process towards developing the correct storage of unpleasant experiences in the right side of our brain – if we are right handed. It seems that this storage mechanism is particularly active during a stage of sleep called rapid eye movement sleep, which is why medical professionals always try and encourage sleep after a patient has experienced such trauma. Patients often deal with unpleasant experiences by trying to completely suppress them, and indeed some individuals can successfully do this. However, for many people this suppression can lead to subsequent high levels of anxiety and depression, possibly because the memories have not been processed properly. Anxiety is common after such stress and can be either focused upon certain scenarios that replicate the original trauma, or what doctors call “free floating anxiety”, which is a state of generalized and heightened anxiety. After traumatic incidents, people often feel strangely guilty and come to believe that they may have caused the events, even when this defies all rational explanation. Children are particularly prone to feeling guilty about traumatic events; this is commonly found in cases of marital breakdown, but can also be applied to the violence we have seen on the streets of Ukraine in recent months. Emotional health and political instability Whilst post-traumatic stress syndrome is generally well understood, we are perhaps less aware of the effects that civil and political unrest can have upon civilian populations. Emotional health is dependent upon complex systems of social stability that include stable employment, close partner relationships, wider family ties and an outer circle of friends and acquaintances. Added to this is the need for a sense of civil and political stability, which underpins the society that we live in. In today’s Ukraine many of these concepts are under threat. Economic instability has placed a direct threat on incomes; jobs have been lost and the financial future for millions of Ukrainian families is currently insecure. Many marriages and partnerships have also endured considerable additional stress in these times of heightened political tensions, with differences of opinion acquiring added significance and placing strains on even long-standing relationships. There has also been a shift in everyday activity away from relaxing family times towards frantic searching for

LVIV TODAY | Summer 2014

the latest news and developments, often late at night and aided by the very interactive technology that prevents good sleep. Social media has provided us with access to almost limitless amounts of information, but this has in many ways only added to the emotional stress which many millions of Ukrainians are currently experiencing. Revolution and war strain Ukrainian relationships Whilst we tend to live with people of similar political views, this is not necessarily true of extended family networks and wider circles of friends, who may often hold strongly opposing political views. As a result of the amplified emotions produced by Ukraine’s current upheavals, in recent months many Ukrainians have experienced the collapse of formerly fruitful personal relationships. This is a particular risk in Ukraine, where many people have friends and relatives not only in Crimea and East Ukraine, but also in the Russian Federation. As Ukraine has lurched from revolution to war, this loss of traditional extended support networks - coupled with poor sleep and the stress of financial difficulties - has produced a sense of emotional exhaustion in which people find that their emotional energy is depleted and their levels of stress and anxiety are rising ever higher. The majority of Ukrainians seem able to cope well with these crisis conditions, but many will inevitably find themselves feeling abnormally flat in the weeks or months after a resolution of the crisis – whenever that may be. How to avoid social media shell shock In terms of treatment, it is important to recognize that stress is now part of our everyday lives and to understand how it affects us. There are a number of measures which we can all take to combat the causes of this heightened anxiety, including setting aside time for traditional family activities. You should also try not to spend hours monitoring the latest developments on Facebook and other online resources, especially in the evening prior to sleep. Getting a good night’s sleep is crucial to emotional well-being – especially when daily events in Ukraine remain so stressful. Talking calmly about the emotional challenges of the crisis with family and friends can also help, allowing you to reassure those close to you that their ongoing friendship is important to you, despite any political differences which you might have. It is also crucial to recognise that your children may also be stressed by the uncertainties and your altered family life. Fortunately, good family physicians are trained to recognize and support patients experiencing the kinds of emotional health problems caused by these situations, and modern therapies are able to speed up the process of healing, which also requires time and eventual stability. It only remains for me to wish you some peace in these troubled times and an early resolution to this crisis, so Ukraine can begin the healing process and we can all invest in emotional recovery. EBA Events I

n this issue of Lviv Today Markian Malskyy, Partner of Arzinger law firm, Head of West Ukrainian Branch Office, attorney-at-law, PhD, is answering the following question: Novelties in anticorruption and criminal legislation regarding establishment of criminal liability of legal entities.

The national anticorruption and criminal legislation were amended several times recently. This was mainly caused by urgent necessarily to bring it in compliance with EU legislation in this sphere before signing the EU-Ukraine Association Agreement and liberalization of visa regime with EU. According to the changes, which were adopted on 23.05.2013 “On amending of certain legislative acts regarding liability of legal entities in Ukraine with respect to implementation of Action Plan on liberalization of visa regime with EU” No. 314VII, amending Criminal Code of Ukraine, it became possible to apply criminal liability on legal entities for established types of crimes. Such list includes, inter alia: money laundering, usage of money obtained from drug trafficking, bribery, abuse of influence and other criminal corrupts committed on behalf of legal entity. Sanctions applicable to legal entity for such violation might be such as fines, confiscation (supplementary type of sanction) and even liquidation of the company. Following significant amendments to anticorruption and criminal legislation were adopted in May, 2014 by the Law of Ukraine “On amending of certain legislative acts of Ukraine in the sphere of state anticorruption policy with respect to implementation of Action Plan on liberalization of visa regime with EU” as of 13.05.14 No.1261-VII. Named law established new regulation regarding control of government employees’ incomes/expenses, new rules of liability for criminal corrupt, stricter sanctions for such crimes, special confiscation and fines as criminal sanctions established for legal entities. Main novelty regarding liability of legal entities is a special supplementary type of sanction – special confiscation - uncompensated court seizure of the property owned by the legal entity committed a criminal corrupt. Another new provision is determining the fines for legal entities for criminal corrupt in amount of double sum of unlawfully received profit (200% of the bribe) or in case it is impossible to establish such – amount of sum established by respective article depending on the crime seriousness. Another interesting novelty is that the law provides general requirement for Ukrainian legal entities to develop and implement anticorruption compliance programs as it is a general practice in EU. We estimate that by itself only legislative changes will not likely to considerably affect the number of corrupt crimes. The reason for such non optimistic forecasts is low effectiveness of such crimes investigation, impossibility to confiscate property owned by other linked entities, low salaries and, of course, national acceptance of corruption as a norm. Regarding legal entities the new amendments will be a reasonable ground to refrain from the bribery only in case it is big or reputable company, otherwise there will be no real consequences of the sanctions to the company owning nothing and being no one.

EBA Round Table on Dealing With Investors On June 5, 2014 Western Ukrainian European Business Association office held the round table on dealing with investors in Ukraine which was carried out in the framework of International Conference on Industrial Parks: Opportunities and Perspectives of Industry Development. The issues of investment climate, obstacles and possible solutions to difficult situations which investors could approach were discussed during the round table. The round table speakers were Anton Podilchak, (WUEBA Regional Coordination Council Member and Advice Group LLC representative), Markiyan Malskyy (WUEBA Regional Coordination Council Vice-chairman and Arzinger representative), Taras Yurynts (WUEBA Regional Coordination Council Vice-chairman and Guldmann-Ukraine Ltd. representative), Oleh Vasylenko (Discovery Drilling Equipment Ltd. representative) and Oleh Maliutiak (Mykolaivcement PJSC representative).

The participants of the meeting have agreed that the investor is no Santa Claus with a sack full of money and that active and reasonable public scrutiny and assistance from local authorities are needed to attract foreign investors as well as to stimulate the domestic ones in Lviv oblast. Such cooperation is the key to success and economic growth.
