On October 21st, the ’Mariya Zankovetska’ Ukrainian Drama Theatre is pleased to present a live performance by provacative, hard rocking, Russian girl-power band ”Night Snipers” and legendary Russian female rock singer Diana Arbenina. Founded in 1993 as an acoustic female duo, ”Night Snipers” has participated in a variety of Russian musical festivals as well as touring extensively domestically and abroad. The band’s best-known singles are ”Tridtsatpervaya Vesna” (31st Spring), ”Rubezh” (Frontier), ”Stolitsa” (Capital), ”Asfalt” (Asphalt), and ”Aktrisa” (Actress). November 9th, concert begins at 19:00 Lesya Ukrainka Drama Theatre (36 Horodotska St.) Lviv’s Lesya Ukrainka Drama Theatre is pleased to host the provocative “Dakh Daughters Band” in a show event on November 9th. Try to picture seven young women, dressed like actresses from the old black-and-white silent movie days, with bleached faces, smoky eyes, and bloody-red lips – these are the “Dakh Daughters”. These actresses-turned-freak-cabaret-band are one of the most unusual, extravagant, and electric acts in Ukraine today. The nature of the “Dakh Daughters” phenomenon lies in their name: they are daughters of theatre and born actresses, which means every musical composition is a mini-performance. Seven girls storming the stage playing numerous musical instruments, singing, screaming, dancing, and doing all sorts of crazy stunts on stage will make for a spectacular performance that will leave you taken aback! “Boombox”, one of the most popular Ukrainian groups, comes to Lviv on November 4rd as part of their national tour to promote their new album “Terminal B”. Every year on December 1st, the world observes International “Anti-AIDS Day”. In this tradition, for the last 16 years, Lviv charitable foundation “Salus” organizes different social events under the common title of “Art against AIDS”. This year the “Salus” foundation is hosting the “All in Your Hands” contest – a make-up and manicure competition designed to highlight the problems of AIDS. Participants are welcome to submit their works until November 10th, with the best entries being rewarded with certificates and prizes. An exhibition of the best “Art against AIDS” will be held at Lviv’s Interregional Centre of Art Design (2 Kulchytskoj St.) at the end of November. NEW GERMAN FILM FEST 2013 October 10-19, Lviv Art Palace (17 Kopernyka St.) Leopolitan film fans are highly anticipating the exciting selection of modern German films to be presented as part of the New German Film Fest that gets underway on October 10th. This year’s festival, being held at the Lviv Art Palace, presents a selection of movies that featured in German cinemas over the past year. The films, representing a variety of genres, are coming to Kyiv and other major Ukrainian cities for the first time. Of the many films worth seeing, of note are Detley Buck’s drama “Die Vermessung der Welt”, which follows the story of Alexander von Humboldt and Carl Friedrich Gauss, two brilliant and eccentric scientists, through their early 19th-Century lives; the war-thriller “Lore”, a 2012 Australian-German film written by Robin Mukherjee, co-written and directed by Cate Shortland, and funded by the UK Film Council; and Jan Ole Gerster’s comedy “Oh Boy”, that showcases a self-ironic portrait of a young man that drops out of university and ends up wandering the streets of the city he lives in: Berlin. You won’t want to miss the biographical drama “Hannah Arendt”, a 2012 film directed by Christian Margarethe von Trotta, which looks at the life of philosopher and political theorist Hannah Arendt, who reported on the war crimes trial of Nazi Adolf Eichmann for The New Yorker. CHECKHOV’S WORLD ON STAGE November 4th, start at 19.00 Lviv Opera & Ballet Theatre (28 Svobody Ave.) Anton Checkhov’s play ‘Faces’, starring Olexandr Kalyagin and Volodymyr Simonov, has become Moscow’s Etcetera Theatre’s calling card and one of its most popular plays. Kalyagin may have been especially brought into this world to play Chekhov, as his skills as an actor take the audience deep into the world of little people. The play ‘Faces’ is based on 5 of Chekhov’s comedic plays: “In the Foreign Land”, “Psychopaths”, “Foot-Dragging”, “The Culprit”, and “Diplomat”, and showcases characters that are painfully familiar to connoisseurs of Russian culture. Lviv is set to host the XII Annual Lviv Fashion Week – “Spring/Summer 2014” from October 23-27. For five days, fashion-conscious Leopolitans and guests of the city will have the opportunity to review the newest collections from fashion designers in Poland, Russia, Armenia, Belarus, and Israel. Feature designers include Marta Qachholz, MMC Studio (Poland), OKSANA MUKHA, Oksand Piekna, SHADOYAN FASHION (Armenia), Valentina Nebarsky (Belarus), Ivanna Yukhymchuk, and others. Designers Sergey Proskurnya (Donetsk), Amina Vyshnevska (Kyiv), and Joanna Wietrzycka (Poland) will have their debut collections introduced. Among the week’s ‘not-to-miss’ events will be the show presented by creative design duo MMC Studio (Poland), special guests of the event. As usual, Lviv Fashion Week will stage the finals of the V. Young designer’s contest “SABOTAGE”. This year’s finals feature 18 designers from Kyiv, Kharkiv, Odessa, Donetsk, and Lviv, as well as from Russia and Belarus. A partner of this year’s “SABOTAGE” contest is “Fashion Philosophy Fashion Week Poland”, which give the lucky designer the opportunity to participate in the “OFF Out of Schedule” fashion show at the next Fashion Week Poland. The “OFF Schedule” collection will showcase outfits by seven young designers from Belarus in a joint project with the “Gallery of Style” (Belarus) contest. Lviv’s Armenian Heritage T

he annual holiday dedicated to one of the oldest streets in Lviv – Virmenska – was held over the September 13-15 weekend. The year’s celebration was dedicated to the 650th anniversary of the Armenian Cathedral – the oldest in Lviv and a UNESCO World Heritage Site. Leopolitans, tourists, and distinguished guests had the wonderful opportunity to discover many historical facts about prominent Halychynan Armenians, the Armenian Quarter through different historical periods, and the role of Armenians in the history of the city. The Armenian community has had an undeniable impact on the historical development of Lviv, as well as on its culture and traditions, and the holiday was designed to celebrate this unique aspect of the city’s heritage.

Armenians Arrive in Halychyna

During the Middle Ages, Armenia was the scene of bloody wars and devastating invasions that led to the massive resettlement of Armenians throughout southern Russia, the Crimea, Ukraine, and especially Halychyna. The flow of immigrants increased considerably following the 8th Century Mongol invasion and 9th Century wars among Turkish tribes. During this period, more than 30 Armenian settlements appeared in Western Ukraine. The bulk of immigrants were merchants and craftsmen that settled in Lviv, Kamyanets-Podolski, Vladimir and Galich, Jaroslaw and other trade and craft centres. Each of these cities saw Armenian communities established and they were given the right to self-governance by Polish kings that were interested in developing trade and in-

dustry. The Armenian community in Lviv was large and wealthy as it lay at the crossroads of important trade routes that linked East and West. It is believed that Armenians started to appear in Halychyna in the 10th–11th Centuries, although according to at least one account, they were invited by Halychynan King Danylo Romanovich in the mid-13th Century. It is more likely that Armenian settlements in Halychyna began appearing in the 10th Century and King Danylo invited skilled builders and craftsmen to participate in the foundation of a new city. Leopolitan Armenians lived in a separate quarter in the northeastern part of the city where they built numerous churches, monasteries, hospitals, and schools, as well as a library and printing house. Many Armenian scientists, writers, painters, and musicians were born right here in Lviv’s Armenian quarter. By the 11th–13th Centuries, Halychynan dukes had already provided Armenians with the privileged right to settle in Halychyna, to form autonomous national communities, and to have their own faith. Yet the Polish crown pursued a policy of “Polish-ization” of the Halychynan people. They added the suffices –vich or –ovich to Lviv’s Armenian names to make them sound Polish. For example, Torosyan became Torosovich or Torosevich, Simonyan – Simonovic, Stepanosyan – Stefanovic, Abgarian – Abgarovich, etc. The Halychynan name Avgustinovich was formed in this way too, as it initially belonged to the descendants of the Armenian royal and princely family of Atabekovs (Atabekians).

Written sources have preserved a variety of information regarding the Armenian settlement in Lviv. The oldest settlement was located in Podzamche and can still be seen in such names as Armenian St., Armenian Bridge, etc. The Podzamche community became a suburb after 1360 when a new city was founded to the south. Podzamche Armenians had three churches, a monastery, and a bathhouse. It is estimated that the oldest of these, St. Anna church, was founded in the 13th-14th Centuries. Lviv’s Armenian quarter was inhabited mainly by the more prosperous Armenians and new Armenian settlers from the Orient. By the early 15th Century there were over sixty houses in this quarter alone. The famed Armenian Cathedral was erected here in 1363–1370 and in 1365 a special bishopric was established. King Casimir recognized Armenian religious freedom in 1367 when Gregory (Krikor) became the first Armenian bishop of Lviv. The community continued to grow and by 1407 the city tax roll listed eighty names of the heads of Armenian families. Polish Armenians would retain close ties with their metropolitanate in Eschmiadzin until 1630.

Armenian Contributions to Lviv

Armenians played an important role in the economic life of Lviv as many were talented in such skilled crafts as tanning, leatherdying, saddle-making, shoe-making, metal, goldsmith, and embroidery. From the 14th Century, Armenians also found employment in coin-striking. Generally speaking,

Exploring Lviv the Armenians were the most commercially-oriented nationality of the medieval ages and settled predominantly in the major trading centres. At the time, Lviv was one of the three main Armenian centres of Europe, along with Venice and Amsterdam. Armenians helped make Lviv a desirable centre of international trade as they had no equals among traders with the Orient, particularly throughout Crimea. They primarily used the Tatar route to Kaffa (modern Feodosia) and in the 15th Century they utilized the Moldavian route. Armenians had a monopoly on the organization of trade caravans and their services were much sought-after as they had extensive knowledge of the Orient, its customs, and its languages. Each caravan was headed by an Armenian, known as a ‘karavanbasha’, and exercised absolute power during a trip. Each caravan had the right of extra-territoriality and was protected by the trade treaties between Poland and Turkey. Armenian trade was entirely oriented toward the East. In the 16th-17th Centuries, they dealt with luxury products, known as “Armenian goods”, that included carpets, arms adorned with precious stones, jewelry, raw silk, and various Oriental spices such as pepper, ginger, saffron, and nutmeg. Armenian merchants owned many large stores in central Lviv’s Market Square that were so opulent they were known as “rich shops”. By 1588, Armenians owned 22 of the 38 “rich shops”, while Catholic merchants owned nine and Ruthenian merchants had seven. Poles would often employ Armenians as diplomatic interpreters or customs officials and the following story shows just how influential the Armenian community was in the life and fate of Lviv. In 1672, the Turks conquered the city. As was customary, a delegation was sent to negotiate a truce. This delegation necessarily included Armenians as they were not only foreign language experts, but masters of diplomacy also. The delegation managed to convince the Turks not to seize the city by force in exchange for 80,000 gold ducats and nine hostages from the city’s most affluent citi-

zens. In a display of the highest patriotism, responsibility, and high moral principles, Armenians Rafael Bernatowicz and Gakob (Jacob) Yaskevich voluntarily agreed to become hostages. History tells us that in the end, Mr. Bernatowicz returned from Turkish captivity in poor health and died in Lviv in 1677. There were many other prominent Armenian figures that contributed to the development of Lviv. These include famous politicians such as: Lviv Mayors Bartholomew Zimorovich (1597-1677), Joseph Yaskevich (1719-1794), Jacob Theodore Bernatowicz (1713-1789), Godzimir Malakhovsky-Nalevich (1852-1908); academics, including the discoverer of many Carpathian mineral springs Theodore Torosevich (17891876), the founder of the “Shklo” resort Marian Florian Ogonchik-Zakshevski, M.D. (1803-1831), and many others. There were prominent architects, like Julian Aktavian Zakherevich (1837-1898), who designed the main building of Lviv Polytechnic Institute and many other Lviv buildings that are now considered to be the pride of the city. There were inventors too, like Ignacy Lukasiewicz (1822-1882), who invented the kerosene lamp and who has museums, monuments, and commemorative plaques, medals and books across Poland dedicated to his memory. Armenians made important contributions to the arts as well, including co-founder of the Galich Music Society and the conservatory, Karol Mikul (Michaelian) (1819-1897), and Ludwik Tirovich Jr. (19011958), who founded the “Union of Lviv Graphic Arts” in 1932, and was a pioneer of Lviv’s avant-garde artists “Artes”. Works of many talented Armenian artists can still be found at the Lviv Art Gallery. Other Leopolitan Armenians of note include: famous surgeon Roman Baronch (1856-1930), historian Piotr Baronch (1814-1892), Armenian language professor Karapet Keuprilyan (20th Century), and Marian Tirovich (19011990), a 19th Century Halychynan historian and author of nearly 4,000 celebrity biographies. Armenians have touched every aspect of life in our great city.

The Decline of Leopolitan Armenians

While many Armenians proved to live very successful lives in Lviv, it wasn’t always so easy. Leopolitan Armenians were often treated as second-class citizens; they had no political rights, elders were forced to take an annual oath of loyalty to the city council, and their residency was restricted until 1630. Yet regardless of these issues, the community has contributed a great deal to the development of Lviv. Despite their relatively small numbers, Armenians have constituted the second most important group of people in Lviv after Catholics. Protected by the policy of Polish kings, Armenians were an isolated ethnic group in 16th Century Lviv. By the end of the century, Armenians had lost their dominant position in international trade to Jewish merchants and the latter became more prevalent in Lviv’s Oriental commerce. Following the Armenian Church’s union with Rome in the 17th Century, the Armenian people quickly become “Polan-ized” and assimilated. Lviv’s Armenian Cathedral continued to operate until World War II. Following the Soviet Union’s annexation of Lviv, many Armenians fled to Poland. The cathedral was shuttered and used for storage, and its last administrator was executed in a Soviet gulag. Today Virmenska St. is a reminder of Lviv’s rich cultural heritage in general and the contributions of the Armenian population in particular. The house at #19 is one of Lviv’s most popular coffee houses, while Ararat restaurant, named after a mountain that Armenians regard as a symbol of their nation and their global community, is another Armenian quarter mainstay. The main attraction, of course, is the 650-year old Armenian Cathedral. Today the building is being restored through a joint Polish-Ukrainian restoration project and is used by both the Armenian Apostolic and Catholic churches. So if you happen to be wandering through Old Town along Virmenska St., be sure to stop in at one of the Armenian quarter’s nostalgic attractions and reflect on Lviv’s wonderful multi-ethnic heritage.

The event included a large concert program as well and as special guest came world-renowned Armenian musician, composer, scholar of Armenian national music, professor of Yerevan Komitas State Conservatory, winner of four UNESCO gold medals Djivan Gasparyan, who treated the audience to his playing the duduk, or “apricot trumpet.” On September 14. The traditional Armenian cuisine was well-represented at the festival too alongside with various jolly entertainments for children and grown-ups.

The culinary Tales

of Stefko Rondel Culinary history of Halychyna may not be well known, but if you look deeply you will find some historical ‘pearls’. Let’s take for example sweets; more specifically, chocolate. While you might not think that there are many interesting stories about chocolate, Halychyna – and Lviv in particular – has a ‘rich’ history of this sweet, sultry treat. Leopolitans likely first became acquainted with chocolate in the medieval times, when French desserts and Oriental sweets first made their appearance in the city. In time, local confectionaries started making their own treats and by the beginning of the 20th century, many mansions in Central Lviv hosted coffee-shops. In fact, at that time Lviv was known as the second European chocolate capital after Bern, Switzerland. No doubt the city would develop a taste for chocolate – what else goes better with a cup of fragrant Lviv coffee than a piece of chocolate! At that time, of course, the majority of Lviv’s coffee-shops were owned by Poles, except the first Ukrainian confectionary factory in Halychyna, “Fortuna Nova”. The factory was founded in 1922 in Przemyśl by Klymentyna Avdykovych-Hlynska. Ms. Avdykovych-Hlynska was a hard-worker, philanthropist, and woman of enormous energy who actively supported the “Union of Ukrainian Women” and even sponsored the Women’s Congress in Stanisławόw. In 1924 she partnered with Metropolitan Andriy Sheptytskyi to found the steam-driven candy factor “Fortuna Nova”. It was Sheptytskyi, who descended from a wealthy Halychynan family, that invested 50,000 złoty. Following the factory’s extension and modernization, its maximum capacity was 5 tons of sweets per day. Employees consisted primarily of Ukrainian women, especially those with secondary or higher education. During the factory’s Golden Age in the 1930s, as many as 125 employees were needed and the company had 6 sales agents in the city. Over time, the company opened several shops in Lviv, as well as ones in Stryj and Drohobych. While the factories specialized in chocolate, the assortment of sweets was wide –cookies, ice-cream, fruit jellies, and various other candies were also prepared. One treat the company was known for was a special edition “Sweet History of Ukraine” chocolate, which presented portraits of famous Ukrainian leaders from Prince Volodymyr Velyky to Hetman Pavlo Skoropadskyi on their wrappers. As the quality of the sweets was very high, “Fortuna Nova” chocolate quickly gained popularity among Leopolitans and throughout Halychyna. The company cooperated with other factories, such as “Centrosouz”, “Folk Commerce”, and “Zemelny Bank”, before being nationalized in 1939 by the Soviet government. Following WWII, the company was merged with several other enterprises to form the company that is today known as “Svitoch”. Regrettably, in present-day Lviv, there is no mention of the “Fortuna Nova” factory and its splendid past. However, thanks to some culinary history enthusiasts that managed to find authentic chocolate recipes originally produced by Ms. Avdykovych-Hlynska’s famous factory, one can find tasty sweets named “Fortuna Nova” in many of Lviv’s fine coffee-shops. Стефка Ронделя Кулінарна історія Галичини – настільки забута річ, що беручись практично за будь – яку страву і починаючи вишукувати щось про неї, частіше за все можна наштовхнутись на якусь історичну «перлину». Візьмемо солодощі, а точніше, шоколад. Здається, ну яка тут може ховатися цікава історія? Шоколад, кав’ярні Львова та інших галицьких міст, що з’являлись тут з початку 19 століття – про це вже досить багато сказано останнім часом. Аж ні, не все так просто… Львів’яни відкрили для себе шоколад ще в середньовіччі. Тоді у Львові з’явилися східні солодощі та французькі десерти. Потім місцеві майстри-пекарі та кондитери самі почали виготовляти розмаїті солодкі смаколики. З початком ХХ ст. у багатьох будинках центральної частини міста були цукерні. У той же час Львів став другою європейською столицею шоколаду після швейцарського Берна. Бо що може краще смакувати до філіжанки львівської кави, ніж шматочок чоколяди! Звичайно ж, власниками більшості цукерень Львова були поляки. А тому цікавою є історія львівської кондитерської фабрики «Фортуна Нова», що була ще й однією з перших українських фабрик у Галичині. Заснована вона була 1922 року у Перемишлі, того ж року вона переїздить до Львова. Від початку мала назву «Фортуна», а заснувала її Климентина Авдикович (повне ім’я - Климентина Миколаївна Авдикович-Глинська). Відома вона не лише своєю діяльністю у промисловій галузі, але й як меценат. Активно підтримувала «СоюзУкраїнок», і навіть спонсорувала Жіночий конгрес у Станіславові, в якому брала участь. 1924 разом з митрополитом Андреєм Шептицьким Клементина Авдикович заснувала спільне підприємство – парову цукеркову фабрику «Фортуна Нова». Шептицький, який походив із заможної галицької родини, заінвестував 50 тисяч злотих. Проектна потужність фабрики після добудови та модернізації становила 5 тонн продукції в день. На фабриці працювали, як правило, українки із середньою або вищою освітою. Наприкінці 1930-х, у період найбільшого розквіту, тут працювало 125 робітників і 6 агентів, які забезпечували збут продукції у містах. Фабрика в різні часи мала декілька крамниць у Львові та по одній у Стрию та Дрогобичі. Асортимент продукції був досить широкий – різноманітні цукерки, шоколад, печиво, морозиво, фруктові желе тощо. Навіть було випущено спеціальну серію шоколадок «Солодка історія України», на обгортках яких намальовано портрети правителів України від Володимира Великого до гетьмана Павла Скоропадського. Якість продукції була високою, тому чоколяда з фабрики «Фортуна Нова» швидко завоювала популярність серед львів’ян, та й галичан загалом. Фабрика співпрацювала з «Центросоюзом», «Народною торгівлею», «Земельним банком» та іншими українськими кооперативними організаціями. 1939 «Фортуну Нову» націоналізувала радянська влада. Після Другої світової війни фабрика разом із кількома іншими увійшла до складу підприємства, що відоме нині як кондитерська фабрика «Світоч». Сьогодні, нажаль, у Львові майже не лишилося фактичних згадок про «Фортуну Нову». Однак з’явилися небайдужі, що віднайшли автентичні рецепти чоколяди з фабрики Клементини Авдикович, і зараз солодощі під назвою «Фотуна Нова» можна покуштувати у низці львівських кав’ярень.

Society VII CITY COFFEE HOLIDAY If you were lucky enough to be near Lviv’s central Rynok Square over September 26–29, you were sure to have taken part in the festivities of the “Na Kavy do Lvova” (For Coffee to Lviv) festival. In its seventh year, the festival is an important event for Lviv’s colourful coffeehouses – many of which are architecturally and thematically unique. Throughout the event, Leopolitans and visitors had the chance to vote in a number of festival-related contests. “Svit Kavy” took the honours of ‘Best Coffeehouse 2013’. Besides stunningly tasty coffee, this venue boasts an interior with original 17th Century beams and brick walls discovered during restoration. As Lviv’s newly-crowned best café, “Svit Kavy” faces the imposing Katedralnyi (Latin) Cathedral at 6 Katedralna Square and sits next to “Strudel Haus”, winner of the ‘Something Sweet with Coffee’ award for its famous desserts. PUBLISHERS’ FORUM CELEBRATES 20TH ANNIVERSARY Lviv hosted the XX International Publishers’ Forum from September 10th-15th. The event brought together 300 publishing houses as well as over 100 writers from Slovakia, Serbia, Croatia, Romania, Hungary, Germany, France, Norway, Canada, Sweden, Australia, and New Zealand. The stars of this year’s festival included English children writer Jeremy Strong, bestselling Russian author Tatyana Tolstaya, and famous Polish writer Janusz Leon Wisniewski. Several literary competions were held over the course of the Publishers’ Forum, including the national “Best Book of the Forum” contest, the festival-wide “Young Republic of Poets” competition, the interregional “Library Innovations for Communities” fair, the German Goethe-Institut’s “Night of Non-Stop Music & Poetry” literary project, Meridian Czernowitz’s and Publishers’ Forum’s joint project “Poetic Train”, the International Translators’ festival’s “TRANSLIT” project, the “Context2” project, and many more. This year’s Book Forum, held for the 20th time, is the first to have a country as a partner. This year it was Poland, but organizers promise more to come. У цьому літературно заході взяли участь понад 300 видавництв і понад 100 письменників зі Словаччини, Сербії, Хорватії, Румунії, Угорщини, Німеччини, Франції, Норвегії, Канади, Норвегії, Швеції, Австралії та Нової Зеландії. Зірками цьогорічного форуму були, зокрема, англійський дитячий письменник Джеремі Стронг, відома російська письменниця й публіцист Тетяна Толстая, а також польський письменник Януш Леон Вишневський. У рамках Форуму видавців відбулося кілька літературних проектів – національний конкурс «Найкраща книга форуму», фестивальконкурс «Молода республіка поетів», міжрегіональний ярмарок «Бібліотека інновацій для громад: створення майбутнього», літературний проект німецького Гете-інституту (Німеччина), проект «Ніч нон-стоп музики і поезії», спільний проект «Поетичний поїзд» проекту «Меридіан Черновіц» і форуму видавців, «Міжнародний фестиваль перекладачів «TRANSLIT», проект« Context2 «і багато іншого. THE FLYING DUTCHMAN ON TOURH Over September 12–13, the Lviv Opera and Ballet Theatre hosted the most ambitious staging of the Donbass Opera – Richard Wagner’s opera ‘The Flying Dutchman’. This joint Ukrainian-German art project was held in conjunction with the great composer’s bicentennial, which is being marked by the world community in 2013. The production of The Flying Dutchman involved 300 artists from four countries. The Lviv production of this opera featured soloists Lesja Alekseeva (Ukraine) as Zenta, Andreas Macco (Germany) as the Flying Dutchman, David Yim as Erik, and Walter Fink (Austria) as Daland. The Flying Dutchman was a truly remarkable event in the cultural life of Lviv and a pleasant surprise for all music lovers in Western Ukraine. USA PROVIDES GRANT FOR UKRAINIAN WOODEN CHURCH On October 2nd, Jeffrey Payette, the U.S. Ambassador to Ukraine, visited Drohobych, Lviv Region and signed an agreement to financially support the “Preservation and Restoration of Murals” project of the St. George’s Church of Drohobych as part of the U.S. Ambassador grants program. Dating from ca. 1500, St. George’s Church in Drohobych is one of the oldest and best preserved timber churches in Western Ukraine. The wooden church is one of 16 church buildings in Ukraine and Poland that was inscribed on UNESCO’s World Heritage List in August 2013. Drohobych mayor Oleksiy Radzievskyi, “Drohobychchyna” Museum Director Alla Gladun and painter/restorer Lev Skop were all in attendance.

If you happened to be in Rynok Square on September 1st, you would have surely witnessed the jolly and colourful performance “A Hasene in Galitsiye”. The event, held as part of the Fifth International Festival of Jewish Music “LvivKlezFest” 2013, showcased a Jewish wedding. A great audience witnessed many interesting customs and traditions along with spectacular Klezmer music – the music of joy and happiness, which just so happen to be the key elements of Jewish weddings. This year the festival, first organized 5 years ago by the All-Ukrainian Jewish Charitable Foundation “Hesed-Arieh” (Lviv), offered workshops on Jewish dance and handicrafts, walking tours through the Jewish quarter, and of course the tasting of traditional Jewish cuisine.

У перший день вересня в рамках п’ятого міжнародного фестивалю єврейської музики LvivKlezFest-2013 на пл. Ринок відбулась весела й барвиста вистава «Хасене ін Галіціє», в якій відображалось традиційне єврейське весілля. Зібралось чимало глядачів, щоб побачити цікаві звичаї й традиції у супроводі клезмерської музики – музики радості і щастя, без якої не обходилось жодне єврейське весілля. Цього року на фестивалі, вперше організованому 5 років тому всеукраїнським єврейським благодійним фондом «Хесед-Ар’є», до уваги всіх бажаючих були майстер-класи з єврейських традиційних танців і ремесел, екскурсії єврейським кварталом і, звичайно ж, дегустація традиційної єврейської кухні.

LEGENDARY SPY FILM SHOT IN LVIV РІМЕЙК ЛЕГЕНДАРНОГО ФІЛЬМУ Lviv was the setting for “Star Media”’s new TV show “Wolf’s Ыгт”, a remake of the Max Otto von Stierlitz Soviet syp film “Seventeen Moments of Spring”. Stierlitz has become a well-known and loved character in post-Soviet culture as a stereotypical Soviet spy, comparable to James Bond in Western culture. The show, being shot in Lviv and Minsk, is directed by Sergey Ginzburg and features an adventure story and is set in the 1920s. The cast includes feature actors Gela Meshi, Oleksandr Robak, Volodymyr Ilyn, Andrey Merzlikin, and Olga Krasko, among others.

Over the September 21–22 weekend, Lviv Art Palace hosted “LvivScaleModelsFest 2013”, an international exhibition of scale models. High-quality, detailed, and authentic models of aircraft, motor and military vehicles, marine vessels, figurines, and dioramas were on display. The event gathered scale-model masters from Poland, Russia, Belarus, and the Czech Republic. Some of the models at the event had previously won awards at international competitions. One highlight for “LvivScaleModelsFest’ 2013 participants was the workshop offered by well-known Spanish modeler and founder of MiG Productions company, Miguel “MiG” Jimenez.

EUROPEAN MOBILITY WEEK The European Mobility Week, from September 16-22, offered the perfect platform to highlight cycling as a modern, clean, sustainable, and truly European mode of transport. Based on a comprehensive cycling development programme, the City of Lviv started building new cycling routes in 2011. According to the plans, Lviv will feature about 270 km of cycling infrastructure by 2019. Several events were held in Lviv as part of European Mobility Week, including the fashion show “Velomoda”, which showcased casual cycling outfits created by young, talented designers Lilya Sas, Tetyana Shymon, Natalya Krasnevytch, Evhenya Kuz, and Olga Steblak.

TRADITIONAL TASTE OF THE NEW KUMPEL! OAnother venue of the well-known “Kumpel Group” network recently opened at 2B Chornovola Ave. The new venue named “Beer restaurant “Kumpel” is much larger and more spacious than existing restaurant in Mytna Square. The new venue boasts of a modern interior and affordable prices, and promises to host numerous artistic and musical attractions. The cuisine and its own brewed beer are legendary “Kumpel” specialties and are highly appreciated by both Leopolitans and our visitors. The menu, which features traditional Galician cuisine as well as new beer brands, can be found at both locations. The festive opening of the venue, which was attended by representatives of the Leopolitan business-elite, opened with a short speech by “Kumpel” co-owner and restaurant guru Mark Zarkhin. Guests in attendance enjoyed tasty beer, traditional Galician food, live music from the well-known local jazz band “Papa Jazz”, an exciting dance show, and a bartending show by the “PROMIX” bartending team. PRACTICAL TAX SEMINAR The Third “General Changes in Ukrainian Tax Legislation” Practical Tax Seminar took place in Lviv on September 27th. Organized by “HD Partners” LLC legal company, in partnership with “Baker Tilly” auditing company, the event was attended by 120 accountants, their deputies, and CFOs of leading Western Ukrainian companies. Participants were acquainted with important issues regarding changes to Ukrainian tax legislation and were given the opportunity to share their own experiences in adapting their corporate activities to the new legislation. As is common, the seminar offered a friendly place for participants to actively discuss topics on the agenda.

West Ukraine’s football standard-bearers shocked 2012–13 Ukrainian champion and perennial Champion’s League contender Shakhtar Donetsk 3–2 at Ukraina Stadium in Lviv on September 13th. The teams entered the tunnel at half tied 1–1 after a Shakhtar free kick cancelled out an Oleksandr Gladkiy opener on 8 minutes. Mladen Bartulovic put the home side ahead with a penalty on 51 minutes before finishing a wonderful long-range free kick effort 10 minutes later to give Karpaty a 3–1 lead. The club managed to hold off the Shakhtar bombardment afterwards, conceding just once over the last half hour and seven minutes of extra time. The exciting finish was highlighted by a late game, close-range free kick stop and a pair of outstanding saves by Karpaty goalkeeper Oleksandr Ilyushchenkov. The win, the first over Shakhtar in years, helped move Karpaty to the middle of the table while preventing the powerful Shakhtar from moving on top. Львівські «Карпати» таки здолали чемпіона України - донецький «Шахтар» з рахунком 3:2 на своєму полі у Львові 13 вересня. Олександ Гладкий відкрив рахунок на 8-й хвилині матчу, «Шахтар» зрівняв рахунок з вільного удару – в результаті команди пішли на перерву, коли табло показувало 1:1. Младен Бартулович виводить команду господарів поля вперед ударом з пенальті на 51-й хвилині, а через 10 хвилин – його ж чудовий дальній удар виводить львів’ян уперед – 3:1. Далі, до кінця гри плюс сім хвилин додаткового часу «Карпати» впевнено стримують бомбардирів «Шахтаря», пропустивши лише один м’яч у свої ворота. Чудово відзначився в цій грі воротар біло-зелених Олександр Ільющенков. Ця перша перемога над «Шахтарем» за останні роки, допомогла вийти «Карпатам» в середину таблиці, стримуючи донеччан на шляху до вершини. INTERNATIONAL ARCHERY TOURNAMENT

50-Й МІЖНАРОДНИЙ ТУРНІР ЛУЧНИКІВ

LLviv hosted the 50th International “Golden Autumn” Archery competition from September 10-14. This year’s event gathered 242 athletes from Russia, Belarus, Moldova, Kazakhstan, Slovakia, Poland, and 14 regions of Ukraine, Crimea, and Kyiv. The city has a glorious archery history as the World Archery Federation (known as FITA) was founded in the city in September 1931 and Lviv has hosted the “Golden Autumn” tournament every year since 1964. Among the winners of this year’s individual and team competitions include local athletes Dmytro Marchenko and Kateryna Shabalitova. All athletes were awarded with special participation medals, while finalists were awarded a purse from Lviv mayor Andriy Sadovyi.

У Львові 10-14 вересня відбувся 50-й ювілейний міжнародний турнір «Золота осінь». Цього року під прапорами змагань зібрались 242 лучники з Росії, Білорусі, Молдавії, Казахстану, Словаччини, Польщі та 14 областей України, Криму та Києва. Наше місто має славну історію стрільби з лука – адже саме тут у вересні 1931 року була створена Всесвітня федерація стрільби з лука (FITA) і проводиться традиційний турнір «Золота осінь» починаючи з 1964 року. Серед переможців цього року в командному та індивідуальному заліку львівські спортсмени Дмитро Марченко та Катерина Шабалітова. Всі учасники змагань отримали пам’ятні медалі, а фіналістів нагороджував особисто мер Львова Андрій Садовий.

Kickboxing Tournament

МІЖНАРОДНИЙ ТУРНІР З КІК-БОКСИНГУ

An international K-1 kickboxing tournament was held in Lviv on September 7th. The event was organized by the Lviv-based club “Union”, which is officially certified by WKF World Director Mr. Fritz Exenberger and has all the rights to conduct top level tournaments. Fighters at the tournament came from around the world, including Austria, Sweden, Finland, Poland, Iran, Pakistan, and India. The finals featured seven spectacular and eye-catching fights, two of which saw women compete.The highlight of the tournament undoubtedly came when local kickboxer Roman Udut matched up against multiple World Champion Pury Kuila (Finland). Unfortunately, the fighter from Lviv was defeated in the sixth round and the European Champion’s belt went to the Finnish fighter. However, local sports did have a reason to be proud and delighted as Lviv’s own Olena Ovchynnikova defeated Natalya Leskiv.

FASCIST FOOTBALL FANS DAMAGE LVIV AND UKRAINEs

I

f you had the chance to attend the September FIFA World Cup qualification match between Ukraine and San Marino at the Lviv Arena, you would have been treated to a masterful performance from the home side and an unforgettable atmosphere. Over 34,000 noisy national team fans were given plenty of reasons to cheer during their team’s record 9-0 demolition of minnows San Marino. The atmosphere was unequivocally Western Ukrainian – from the black and red of the Ukrainian Insurgent Army (UPA) flags to the cheeky chants poking fun at neighbour Russia: “Those who aren’t jumping, must be Russian”. The team seemed to respond, rewarding their doting fans with a goal almost every 10 minutes to help maintain the festive atmosphere. However, elsewhere in the stadium, unsavoury incidents involving both racism and fascism where unfolding which would eventually come to cast a cloud over the team’s impressive performance. Thanks to the actions of a minority of extremist fans in Lviv, FIFA imposed sanctions on Ukraine, forcing the country to play its next match behind closed doors. As a result, Ukraine’s international image has been tarnished and Lviv has been barred from hosting international games for five years. What should have been a night which would live long in the memories of Ukrainian football fans will now be one which most would rather forget.

EXTREMISTS RUIN NIGHT OF PATRIOTIC PASSION

In retrospect, there were signs on the night that sections of the crowd were getting out of control. Parts of the stadium were noticeably louder and more rambunctious than others, singing and chanting and generally inspiring the crowd to get on their feet and sing and dance along. When the home side scored - which was often - it would set off a new wave of wild celebrations involving flares, or ‘pyrotechnical devices’ as

FIFA calls them. This continued throughout the nine-goal rout, despite repeated official warnings over the stadium PA system that the team could be penalized for flares. It is not clear what role this defiant setting off of flares played in FIFA’s later decision to sanction Ukraine, but it is an indication of the mood among certain sections of the crowd. Lviv fans are certainly creative and the Lviv Arena stadium was richly decorated on the night of the match with a vast array of home-made banners – from the black & red UPA banners and images of WWII-era Ukrainian nationalist hero Stepan Bandera, to tryzubs (‘tridents’) and lions and all sorts of clever and not so clever messages. One of these banners was cited in FIFA’s case against the Ukrainian Football Federation – a yellow and blue banner featuring a lion representing the Nazi-affiliated ‘SS Galizien’ Ukrainian division which fought as part of Hitler’s army during WWII. Another banner was displayed reading ‘Good Night Left Side’ and featuring brass knuckles and a razor blade, a well-known neo-Nazi message used to incite violence against left-wing political opponents. Elsewhere in the stadium, a man displayed a T-shirt baring the number ‘88’ prominently – a neo-Nazi code for ‘Heil Hitler’ (H is the eighth letter of the English alphabet). Several fans also performed Hitler salutes. These incidents of football fan fascism were reportedly accompanied by examples of racism. The target of racist abuse was Metalist Kharkiv midfielder Edmar, who is Brazilian-born but who changed citizenship in 2011 in order to play for Ukraine. When Edmar scored in the first half, some fans could allegedly be seen making monkey noises and gestures at the player. The Lviv response to this extremist challenge fell well short of minimum FIFA expectations. Stadium officials failed to remove the offending banners during the match. They also failed to prevent the repeated use of LVIV TODAY | October 2013


Lviv SPORT flares or remove any fans for racist or fascist conduct. Security did not warn the crowd of FIFA’s rules regarding the banning of political messages. In short, according to FIFA, the Ukrainian authorities did not do enough..

Ukraine Qualifies for 1st Basketball World Cup

Two years before Lviv and Ukraine are set to host Europe at the 2015 FIBA EuroBasket tournament, the Ukrainian National Basketball Team is giving the country something to look forward to. The 50th-ranked Ukrainians posted wins over Belgium (77th), Israel (31st), Germany (13th), Great Britain (23rd), Serbia (12th), and Italy (21st) on route to an unprecedented 6th-place finish – the highest ever for the team. Led by former NBAer and new Ukrainian citizen “Pooh” Jeter and shooting guard Sergii Gladyr, the team met expectations by qualifying for the second round and then exceeded them by making the medal round. The team crashed out of the quarterfinals after a loss to Croatia (16th) and ended up losing to host Slovenia (14th) in the 5th-place match. The unexpected run of success has allowed the team to qualify for its first Basketball World Cup, to be held next year in Spain. Ukraine’s previous best result was a 13th-place sixteen years ago. This is an especially exciting time for Lviv basketball fans as the success of Ukraine’s national team mirrors Lviv’s BC Halychyna SuperLeague team’s strong 2012-13 campaign. Last season Halychyna finished one game out of second place and made the semi-finals before losing out to eventual champion Kyiv Budivelnyk. Halychynan small forward Leonid Stefanishin was invited to the national camp, but didn’t end up making the final cut. According to former NBA coaching legend and current Ukrainian head coach Mike Fratello, the team had a long-term plan to succeed at home in 2015. With such early success, Ukrainians have reason to believe that the team will compete with the best of Europe even before that time. In this year’s final, France (8th) defeated Lithuania (5th) for its first European title. Ukrainian Vice-Prime Minister Oleksandr Vilkul was in attendance and revealed Ukraine’s 2015 EuroBasket logo. The design features a colourful basketball that forms the body of a jumping person and was inspired by traditional Ukrainian dances – Arkan and Hopak – that are known for their jumps. Lviv is set to host several matches of that tournament in a new arena being built in the Zaliznychny District. Ukraine expects well over one million visitors to attend the tournament in 2015.

FIFA has been at the forefront of international anti-racism activity for decades, making the accusations leveled against Lviv fans particularly damaging. FIFA’s disciplinary code states that “anyone who offends the dignity of a person or group of persons through contemptuous, discriminatory or denigratory words or actions concerning race, colour, language, religion or origin shall be suspended for at least five matches. Furthermore, a stadium ban and fine of at least 20,000 Swiss francs shall be imposed.” The code lists several penalties for violators that include playing a match behind closed doors, forfeiting of a match, deduction of points or even disqualification from the competition and notes that a stadium ban can be imposed for “serious infringement”. FIFA certainly seem to have taken events in Lviv seriously. The world football governing body has penalized the Ukrainian Football Federation (FFU) with most of the available penalties, including forcing them to play behind closed doors, a 45,000 Swiss francs fine, and banning matches in Lviv for 5 years (meaning Lviv will not host any 2018 World Cup qualifiers). For the most part, FFU first vice-president Serhiy Storozhenko, tends to agree, noting: “Make no mistake … there is no place for political statements or political expressions in football.” He acknowledged all of the safety and racist violations cited by FIFA, save for the ‘Galizien’ banner, which he noted probably had more to do with the lion on the banner representing Lviv than any association with neo-Nazism. For their part, FIFA is very clear on who is accountable for respectable fan behaviour, as the code outlines that sanctions will be levied ‘regardless of the question of culpable conduct’, meaning it is the sole responsibility of the football federation to moderate fan behaviour. It seems probable that the FFU would have faced penalties following the repeated use of flares at the match, but this would likely have been limited to a fine of some sort. Reports of racist and fascist behaviour at the same match made a more serious punishment from FIFA inevitable. While Storozhenko disagrees with the severity of the penalties and has vowed to appeal, even he concedes that action had to be taken and notes that the “chances are slim” of FIFA lessening the punishment.

HARD LESSON FOR UKRAINIAN FOOTBALL

Fan conduct in Lviv has cost the FFU dearly, but the national football governing body is not willing to brand all Lviv supporters with the stigma of the few fascists whose behavior proved so damaging to the city and to Ukraine. As Storozhenko points out: “from a total of 35,000 spectators at the Lviv match, there were three to nine stupid people present. We believe that radical and extremist individuals cannot be regarded as representative of modern Ukrainian society.” He makes a good point: 99% of fans at the Lviv match behaved impeccably; they were loud and they were patriotic, but they were also responsible and good-humoured. As a fan who attended the game, I can attest that the behaviour of the wide majority of supporters in the stadium was sublime. The atmosphere was unlike any football game I’ve attended and the fans were genuinely great. However, I was one of many in my section to notice the unsafe atmosphere in the stands to our left. Many were thankful that they were not near the fans with the flares, while others commented on the more unsavoury behaviour in those sections. FFU officials at future matches need to work more closely with fan club presidents and stadium authorities and do more to remove troublemakers and react to infringements. Any fan who breaks the rules needs to be removed and banned. This is necessary to protect the safety of the fans, the security of the players, and the integrity of the match. One small group of people in Lviv has left a black mark on the Ukrainian national team’s chances of qualifying for the World Cup, while also sullying the good name of Leopolitan football fans. What was supposed to be a celebration of a record win has instead turned into the reality of a record loss for Lviv and Ukraine. Let’s hope that the country’s football authorities can now act to protect the reputation of Ukraine’s passionate and patriotic fans, while also repairing the damage done to Ukraine’s international image. EBA Progress: Transfer Pricing Draft Law is Adopted Due to the efforts of the European Business Association, our list of suggestions was taken into consideration in the revised version of the Draft Law “On Amendments to the Tax Code of Ukraine regarding Transfer Pricing” No. 2515, dated 12 May 2013 and adopted on 4 July 2013. Background: On 12 May 2013, the Draft Law “On Amendments to the Tax Code of Ukraine regarding Transfer Pricing” No. 2515 (hereafter – Draft Law 2515) was registered in the Verkhovna Rada. The idea of implementing into the national legislation the transfer pricing rules that have been already implemented both in the developed markets of Europe and the developing markets was initiated and fully supported by the European Business Association (hereafter – the Association) from the very beginning. However, a number of provisions of Draft Law No. 2515 caused significant criticism from the business community, particularly in relation to: • Control over operations within the country; • Uncertainty about sources of information on the prices and rules for calculating the range of market prices and profitability; • Reporting and documentation requirements for high taxpayers; • Extremely high penalties for failure to submit reports and primary documents; • Terms of entry into force of the Law; • Special transitional provisions for the taxation of import / export of certain headings, etc. The Association has made significant efforts to improve Draft Law No. 2515. The

Association has repeatedly appealed to the Ministry of Revenues and Dues of Ukraine and to the Committee of the Verkhovna Rada of Ukraine on Taxation and Customs Policy with the suggestions prepared and processed by member companies, took part in the meetings of the Public Board and workgroups of the Committee, etc. Unfortunately, not all of our suggestions were taken into account by legislators. However, we are pleased to announce that Draft Law No. 2515 includes a number of suggestions from the Association, namely: • Control will apply to transactions inside the country only with residents that are unprofitable, enjoy special tax regimes or pay income tax and VAT distinct from the base rate, etc.; • Providing documentation about economic operation will be carried out only at the request of the tax authority; • High taxpayers will be exempt from the obligation to submit original documentation; • Penalties for failures in documentation decreased to 100 minimum wages, etc. Along with these positive changes, there were many problematic issues that could not find a solution during the parliamentary hearings. In particular, this applies to the 5% penalty of the amount of the controlled transaction for failure to report, a number of uncertainties regarding the scope of controlled operations, the methodology of calculating normal price, holding inspections, adjustment procedures, reporting and coordination of prices, etc. Apart from the controlled operations, the

Tax Code of Ukraine continues to refer to the normal price in many cases, but the calculation of said normal price is uncertain. Furthermore, given that Draft Law No. 2515 comes into force on 1 September 2013, there are many issues concerning the application of new transfer pricing rules over the last four months of 2013, in particular regarding income tax. Draft Law No. 2515 still refers to a number of regulations that have yet to be developed and adopted by the Cabinet of Ministers of Ukraine, the Ministry of Revenues and Dues of Ukraine, and the National Bank of Ukraine, failing which the application of the law is impossible. The urgency of entry into force of Draft Law No. 2515 and significant uncertainty about a number of its provisions create many practical problems for businesses in the implementation of new rules that must be resolved in a very short time – even when declaring taxes for 3 quarters of 2013 and for 2013, and for the preparation of the first report on transfer pricing, which should be submitted as early as 1 May 2014. We want to thank all member companies of the Association’s Tax Committee for their active participation and persistence and the People Deputies of the Parliament for their assistance in solving this problem. The Association will continue to work for the resolution of these problematic issues to protect the legitimate interests of its members.

HR COMMITTEE MEETING The EBA held its HR Committee Meeting on Friday, September 27th at 16:00 in its office in Lviv. We invited Mr. Petro Kholyavchuk to speak about “Emotional competence in HR practice”. Petro Kholyavchuk is a director of the Kiev Institute of Training, certified psychologist, author and leader of the “Mastery of Trainer”. The meeting’s agenda included a discussion of the following subtopics: management of emotions, self-regulation, empathic communication, as well as a case study. Mr. Kholyavchuk also spoke about emotional intelligence. The meeting ended with an analytical exercise on empathic communication skills. LVIV TODAY | October 2013

EBA EVENTS EBA Business Breakfast On 10 September 2013, the Western Ukrainian office of EBA met with Mr. Andriy Sadovyy, Mayor of Lviv, at the EBA Business Breakfast. Participants at the meeting were informed about Lviv City Council activities in the area of attracting investment. For example, the industrial park was mentioned. The lease of land, issues concerning construction permits, roads and airport, etc. were discussed following the presentation.

EBA EVENTS TAX AND ACCOUNTING MEETING The actual topic on transfer pricing was discussed at the regular Tax and Accounting meeting. The meeting was held on 24 September 2013 at 17:00 at Lviv’s EBA office. The topic was presented by the invited speaker, Vadym Belik, Senior Manager of PwC. Mr. Belik briefly overviewed the law on transfer pricing, shared information about the documentation requirements for the preparation of transfer pricing and finished on its justification methods. During the meeting participants discussed the procedures of how a business can be prepare for the new rules of transfer pricing. The speaker answered all questions from his professional opinion.

LEGAL COMMITTEE Obtaining employment permits according to new procedure. The meeting was conducted in a Q&A format. Since the new procedures of obtaining employment permits raise many questions regarding their realization, we invited the Head of Inspection of Monitoring the Observance of the Legislation on Employment from the Lviv Regional Employment Centre, Oreslava Dmyterko, the Deputy Head of the same agency, the Secretary of the Commission on the Employment of Foreigners, Victor Savchenko, as speakers to our discussion. The new Order on issuance, prolongation and annulment of permits for employment of foreigners and apatrides (adopted on 17 May 2013) entered into force on 5 July 2013. The new order was supposed to facilitate the procedure of obtaining employment permits for foreigners. At the meeting participants studied this new order in more detail and learned how the procedure is facilitated and what issues still remain. In particular, Tetyana Karpyak, associate of Arzinger, spoke about the new procedure of obtaining permits, terms, problematic issues of obtaining certain documents from the foreigner and prolongation of the permit. Ms. Oreslava Dmyterko kindly shared her experience concerning obtaining employment permits according to the new procedure and discussed with the participants a series of unclear questions for them. Following the discussion, the participants and speakers agreed that medical certificates to obtain work permits for foreigners may need additional clarification and agreed to elaborate on these issues. Over the course of the meeting, Ms. Dmyterko and Victor Savchenko actively answered the participants’ questions and profoundly revealed the topic. Invited speakers encouraged the participants to contact them directly with any questions in the future and in working together to answer any unclear questions.

n this issue of Lviv Today Markian Malskyy, Partner of Arzinger law firm, Head of West Ukrainian Branch Office, attorney-at-law, PhD, is answering the following question: Legal entity from Slovakia rents the office facility in one of Ukrainian business centers on the basis of rent agreement. Validity of the rent agreement terminates in two years. Due to increase of Slovakian company employees, a company needs to change the office and considers the possibility of withdrawal from agreement. Does Ukrainian legislation prescribes such a possibility?

Taking into account the wide use of rent agreements of immovable property in the current economic activity of legal entity, the issue of potential withdrawal from such an agreement of one of the parties becomes of importance very often. Except this, as rent agreements of immovable property are usually concluded for several years and this process is connected with expenditure of much time and expenses of funds, uncontrolled withdrawal from an agreement by the initiative of one party may cause serious losses for the other. Civil Code of Ukraine prescribes, that unilateral withdrawal from the contract or unilateral alteration of its terms is forbidden, unless different is foreseen by the law or the contract. The Code also states, that one of the consequences of violation of the contract terms is its termination in result of unilateral withdrawal from the contract. Nevertheless, Commercial Code of Ukraine, which is a special law against a Civil Code of Ukraine and prevails a Civil Code when regulating legal relations between legal entities, directly states that unilateral withdrawal from a rent agreement is forbidden, i.e. even in case such a possibility was prescribed within the contract. In case that one of the parties of agreement is a physical entity, provision of Civil Code shall be used, which foresees а bit different procedure of withdrawal. Thus, early termination of the rent agreement should be executed in the bilateral form, i.e. agreed by both parties. In other case, lessee risks to receive from the lessor motivated demands on compensation of damages and, consequently, bear additional expenses.
