Ken Hensley IN LVIV

WARSAW CHAMBER OPERA IN LVIV

November 17th, The Gas Station (20 Dzherelna St.)

November 16th at 19:00, Lviv Opera & Ballet Theatre (28 Svobody Ave.)

Lviv club/pub “The Gas Station” is pleased to host a concert by keyboardist, guitarist, singer, songwriter, and producer Ken Hensley. Best known for his tenure with long-running heavy metal act “Uriah Heep”, singer/multi-instrumentalist Ken Hensley was born in Hertforshire, England on August 24, 1945. During the mid-60’s he formed the psychedelic blues combo “The Gods” with Greg Lake and future “Rolling Stone” Mick Taylor, although Hensley only remained in the original line-up until the 1968 release of their debut album “Genesis”. After releasing “To Samuel a Son” the following year, the band added Cliff Bennet and rechristened the group “Toe Fat”. They then released a pair of John Peel-produced LPs before splitting up and in 1970 Hensley signed on to play guitar and keyboard for “Spice”, soon renamed ‘Uriah Heep’ in honour of the Charles Dickens character. Despite near-unanimous critical animosity, Uriah Heep earned a loyal following in hard rock circles and in 1973 Hensley recorded his solo debut, “Proud Words on a Dusty Shelf” with the aid of bandmates Lee Kerslake and Gary Thain. “Eager to Please” followed two years later and after completing Uriah Heep’s 1980 album “Conquest”, Hensley left the group to mount a full-time solo career, issuing “Free Spirit” in 1981. The next year he joined the Florida hard rock outfit “Blackfoot”, and remained with the group until they disbanded in 1984. Hensley then settled into semi-retirement, compiling his unreleased material into the 1994 collection “From Time to Time” and touring as a solo musician. Tickets range from 199–448 UAH. More information/ book tickets, call (093) 0000754 or (096) 074-77-46.

The Lviv Opera and Ballet Theatre is pleased to host the opera “Halka” by Stanislaw Moniuszko, the famed Polish composer, conductor, and teacher who is considered to be the founder of the Polish national opera. The renowned Warsaw Chamber Opera will perform this ambitious staging of the opera on November 16th at 19:00.The Warsaw Chamber Opera was founded in 1961 by Stefan Sutkowski, who has served as its Managing and Artistic Director ever since. The repertoire of the Warsaw Chamber Opera spans a wide variety of musical styles and genres: from medieval mystery plays to the operas of the Baroque and Classical periods; from 18th-Century pantomimes and operas by Rossini and Donizetti to works by contemporary composers. “Halka”, a two-act opera featuring 100 artists, will be presented in the ‘Vilnius’ version from 1848 based on the libretto by Włodzimierz Wolski. With its clear conveyance of substance and drama and supported by innovative music, “Halka” has been staged in leading theatres across Western Europe and has garnered international success. It is certainly worth staging an example of Stanislaw Moniuszko’s modern outlook at such a young age, not tainted by the routine of the opera theatres of those times. “Halka” is expected to be a very special musical event and a pleasant surprise for all opera-going people. The three evening festival, running from November 16th to 18th, promises to be even more interesting and exciting this year. The last time Lviv hosted Museum Nights, on June 28–29, the city’s museums saw over 6000 visitors: families with small children, young couples, and elders. Designed to showcase that Lviv’s cultural life doesn’t end when the sun goes down, night tours have quickly gained popularity and recognition as one of the city’s most anticipated tourist attractions. You won’t want to miss the theatrical fire shows at the Italian courtyard, the eerie night tour of the city’s underground, the spooky night tour through Lviv’s Lychakiv cemetery, or the workshops on medieval dances and reenactments of battles at Lviv’s “Arsenal” museum. Special interest will surely be drawn to the unique opportunity for visitors of “Lviv Nights” to climb tower at City Hall and enjoy the night view of our ancient city. For more information about the event, please call: (032) 297-5780.

CHEESE & WINE FEST 2013

One of the most anticipated gourmet events of the year – the “Cheese & Wine Festival – 2013” – was held in Lviv from October 18-20. A huge fair featuring several varieties of cheese and wine from Ukraine’s renowned manufactures and local artisans was the event’s showcase. The Cheese & Wine Festival also provided Leopolitans and guests of the city with the unique opportunity to learn about cheese-making culture and wine-making traditions. Culinary workshops took place alongside musical performances by local artists. Some highlights from the festival include: art exhibitions of portraits drawn with wine, artistic wine postcards, and the “Wine Cork Art Style” fashion show by designer Sergiy Tkachyuk that showcased outfits and accessories made with wine corks. On the final day of the festival guests were treated with a delightful 200kg cheesecake that was especially prepared by local restaurants according to traditional recipes.

MONUMENT TO COFFEE HERO

A monument of Yuriy Kulchitsky, a Galician merchant, spy, diplomat, and soldier – considered to be a hero by the people of Vienna for his actions during the 1683 Battle of Vienna – was unveiled in Lviv’s Danylo Halytsky Sq. on Oct. 22. 1683 was also when he opened his first café in the city, the Hof zur Blauen Flasche (House under the Blue Bottle), using coffee beans left behind by the retreating Ottoman Turks. In time, his café became one of the most popular places in the city. Kulchitsky alsways served the mortar-ground coffee wearing Turkish attire, which added to the place’s popularity. Kulcycki, who popularized coffee in Austria, also innovated the idea of serving coffee with milk, a manner that was unknown to the Turks. He remains a popular folk hero and patron to all Viennese café owners even though his café closed soon after his death on February 20, 1694. According to Zygmunt Gloger, until recently Viennese café owners organized a special “Kulchitsky Feast” each October, during which they decorated their shop windows with Kulchitsky’s portrait. Kulchitsky is memorialized with a statue on Vienna’s Kulchitsky St. and now Lviv coffee lovers have also paid their tributes to the man that taught Europe to drink coffee.

So high in fact, that nearly 20 years after setting the current world record, not a single human has even come within 10 cm. So when he announced at the third Ukraine Sports Congress in Kyiv this summer that Ukraine was moving ahead with a bid for the 2022 Winter Olympics in Lviv and the Carpathian Mountains, it made sense to hear him out. After all, this is a man who has made a career out of (literally) reaching for the sky and making believers out of non-believers. ‘But surely a Ukrainian Olympics too much to hope for?’ one might earnestly ask. Isn’t this the same place that footballer Sol Campbell famously warned not to go to or “you’ll come back in a coffin”? Buoyed by what by all accounts was a wildly successful and popular hosting of the 2012 EUROs, the Ukrainian Olympic Committee has developed an audacious plan to modernize winter sporting facilities in Western Ukraine in preparation for a 2022 Winter Olympic bid. With the host application deadline set for November 14th, Lviv Today looks at the plan to bring the world’s largest winter event to the friendly confines of Western Ukraine.

Lviv opinion The Bid: Events in Lviv, Tysovets, Slavske & Volovets IThe Government of Ukraine commissioned a feasibility study entitled ‘Olympic Hope – 2022’ which provides a general outline of the planned bid proposal. The study outlines two primary Olympic bases: the ‘Ice Zone’ in Lviv, which proposes to host the hockey, curling, short- and long-track speed skating, freestyle skiing, luge, bobsled, skeleton, and figure skating events as well as an Olympic and Media Village; and the ‘Snow Zone’, 140 km away in the Carpathian Mountain resorts of Tysovets and Slavske, that would host ski jumping, Nordic combined, biathlon, alpine skiing, snowboarding, and a second Olympic/Media Village. In addition, the Transcarpathian resort of Volovets would host some alpine skiing events. The Opening and Closing Ceremonies would take place at the new Arena Lviv, recently completed for the 2012 EUROs. It isn’t uncommon for a Winter Olympics host to split events between a host city and a mountain community further away; in 2010 Vancouver shared the hosting with Whistler (124 km away), while both 2014 host Sochi, Russia and 2018 host PyeongChang, South Korea have also split the events between mountain and city clusters. While this all may sound great in theory, the harsh reality is that neither Lviv, nor the old Red Army resort of Tysovets, nor underdeveloped Slavske, has anything approaching world class winter athletics facilities. This is what drives Bubka though, “the Games could be a great way to help develop the region” he argues, “At the moment, there are not many jobs in the west of Ukraine but [this] would help to create a lot of jobs and stop people from the area moving away in order to find work.”

The Legacy: Roads, Rail, Hotels & Sporting Facilities The Lviv organizers did a wonderful job in hosting EURO 2012; however the Winter Olympics provides an altogether different set of challenges. While Lviv hosted over a million fans over the course of a month, the reality is that only three matches were held at one venue over the span of 8 days. The current 2022 bid plan calls for daily events at a minimum of 5 venues over the course of 16 days. In addition, most EURO 2012 fans spent only a few days in the city – to see a match or while passing through to another venue. The demands of hosting additional events and visitors mean that Lviv will need to continue to improve its tourism infrastructure. “This equals 17 World Cups!” says Mykhailo Kostiuk, Chairman of the Lviv Regional State Administration. Ignoring the hyperbole, he does throw out some interesting statistics: 3000 athletes, 2000 security personnel, 6000 journalists, 20,000+ volunteers, 3000 vehicles transporting 5000 passengers every day, 1.6 million tickets sold, a 3 billion worldwide viewing audience – the numbers are impressive. All the more so if you consider that Lviv has not yet built any of the competition venues, the ski resort at Tysovets is an aging Soviet relic, and the road to Mt. Trostian in Slavske can only be traversed by jeep. Moreover, serious improvements would need to be made to improve the road and rail links to Skole and other communities hosting events, as well as to the metro lines in Lviv which currently don’t even run out to Arena Lviv, let alone any of the yet-to-be-built venues. These realities haven’t dampered the enthusiasm of people close to the project though. As Kostiuk is quick to point out, some of the work has already begun.

Rinks, Arenas, More Arenas, and Other FacilitiesL For example, the new arena expected to host BC Politekhnika-Halychyna broke ground this summer in the Zaliznychny District near Arena Lviv. While the facility is being built to host the 2015 FIBA EuroBasket tournament, Yuriy Maiboroda, Head of the Department LVIV TODAY | November 2013

for Physical Culture at the Lviv Regional State Administration, envisions it hosting the hockey tournament in 2022 as well. With an expected capacity of up to 10000, this would bring it in line with Russia’s main hockey venue in 2014, the 12000-seat Bolshoy Dome. Of course, the city would also need to construct at least four more ice arena venues (with seats ranging from 6000 to 12000), a bobsled run, a hill for freestyle skiing, and modern accommodations for athletes and media. Additional sporting facilities would need to be built in Tysovets and Volovets, including a new ski jump to replace the cement relic that stands there now. Kostiuk figures the cost to be €1.4 billion for the Lviv venues with another €1 billion for the Carpathian resorts.

Roads, Rail, Metro, & Hotels In addition to sporting facilities, transit infrastructure will need to be improved. Actually, this is the area in which Lviv is most well prepared with the investments for EURO 2012. Lviv already has a modern, international airport and over 6400km of Ukrainian roads were either renovated or built for that tournament, including many of the international highways leading to Lviv. The 2022 plan calls for a €1.3 billion investment for the construction and renovation of Carpathian roads and the M-06 Kyiv-Chop highway. This is in addition to the construction of the new double-track, 1.8 km-long tunnel that will replace the current single-track bottleneck Beskid Tunnel on the Lviv-Chop railway. The project, which began last year, will cost €102.7 million and is being funded by Ukrainian Railways and a loan from the European Bank for Reconstruction and Development (EBRD). Additional investment will be needed to extend Lviv’s metro to all Olympic venues. As far as hotel infrastructure, the plan cites the need for 22000 additional hotel rooms, including the athlete’s villages, with 15500 needed in Lviv. This is expected to cost another €1 billion, but it is hoped that private investment will cover much of the anticipated cost. Overall, according to Kostiuk’s preliminary estimates, the cost of bringing the Winter Olympics to Lviv, including investments in infrastructure, energy, telecommunications, the medical sector, security, and all the rest, will be nearly €8 billion

The Context: Tourism & Development So why is the Ukrainian government and business elite considering this massive investment? Major sporting events, like the EUROs, EuroBasket, and the Olympics, can bring a myriad of benefits to a host, including increased labour, investment, and tourism. The primary concern, of course, is return on investment. The preEURO 2012 assessment expected Ukraine to spend €18 million on its hosting of the tournament, with fully 72% dedicated for infrastructure such as roads, rail, airports, and hotels. In addition it was expected that this would generate €25 million in tourism revenue from 2013-15, a major boost to a sector that had declined by almost 50% from 2003-06. While it may be too early to tell whether Ukraine experienced a financial boon due to its hosting of EURO 2012, other examples are worth noting. When the municipal government of Los Angeles, USA announced that it had made a profit €145 million after hosting the 1984 Summer Olympics, it demonstrated just how lucrative hosting a major sporting event can be. Perhaps the finest example, 1992 Summer Olympic host Barcelona, Spain, used the €8 billion investment to transform the city from an industrial hub to a major tourism destination. In fact, the transformation was so successful that Barcelona is now the 4th-most visited city in Europe after London, Paris, & Rome. This is a major goal of the 2022 plan: to turn Lviv and the Carpathian mountains into a prime Eastern European tourism destination.

2022 – Establishment or Emerging Host? It is in this context that Lviv finds its ambitious bid to land the 2022 Winter Olympics. Although final applications aren’t due un-

LVIV TODAY | November 2013

Lviv opinion til November 14th, the field looks to include up to six cities that fall into two broad categories: establishment cities that have already hosted an Olympic Games (Munich, Oslo, & Stockholm) and emerging cities aiming to leverage their growth with the economic impact of becoming an Olympic host (Almaty, Krakow, & Lviv). This has become somewhat of a trend in recent Olympic bids. For example, Tokyo, Japan, host of the 1964 Olympics, recently defeated emerging contender Istanbul, Turkey for the 2020 Summer Olympics. That the IOC decided to make the ‘safe play’, as the Tokyo bid designated itself, shouldn’t be looked at as trend-setting. Over the past two decades major sporting events have competed to open up new frontiers in host cities, with such non-traditional hosts as South Africa (2010 World Cup), India (2010 Commonwealth Games), Poland/Ukraine (2012 EUROs), Brazil (2014 World Cup & 2016 Olympics), and Qatar (2022 World Cup) as just a few examples. With the IOC making the safe bet with the cash-cow Summer Olympics in 2020, it serves as plausible that an emerging nation stands a shot at winning the 2022 bid. With that in mind, the real race will be between Almaty, Krakow, and Lviv as to which city is chosen to become a 2022 Olympic ‘Candidate City’ to compete in the final vote the establishment cities.

The Reality: Olympic Hope or Olympic Nope? While some may insist that the Olympic Games are about sport, and others may argue they’re about politics, surely one can agree that the Olympics have always been about improving the allure of the host city. The Lviv bid to host the 2022 Games should not be looked at as a cheap publicity stunt, designed to generate interest in the Lviv region’s winter sports potential. The bid has a solid foundation upon which to build, a successful recent track record in hosting major events, and the united enthusiasm of Ukraine’s political and sporting elite. Indeed, the Ukrainian NOC has already signed agreements with six major Ukrainian companies (MTC, Bosco, Samsung, Coca-Cola, McDonald’s, and P&G) to sponsor the Olympic team and all NOC activities including the 2022 bid. Further, Lviv Mayor Andriy Sadovy has stated that Lviv expects to receive nearly €3 billion from the national government. Besides the already committed support of business and government, there seems to be a real appetite for a Lviv Olympic Games among the Ukrainian population itself. According to the Kyiv International Institute of Sociology, 78% of Ukrainians welcome the idea, with Leopolitans 81% in favour. If these numbers stand up, they will be sure to contrast the relatively lukewarm support of other hosts. For example, just 55.1% of Oslo citizens voted in favour of their Olympic bid in a September referendum.

LVIV TODAY | November 2013

Olympic ‘Nope’: Infrastructure One word can sum up the major challenge to Lviv’s bid for the 2022 Winter Olympic Games: infrastructure. With virtually no world class winter sporting facilities in the region, and inadequate transit and accommodations infrastructure, the Lviv bid begins nearly from scratch. This doesn’t daunt organizers though. “There is more than enough time,” says Bubka as he notes that it generally takes about 7 years for a city to prepare for the event, “Plenty of previous host countries have begun from scratch and we will do the same.” He makes a strong argument; Sochi has been labelled ‘the world’s largest construction zone’ due to the complete retrofit the Russian government gave the resort in preparation for the 2014 games. More importantly, Krakow and Almaty will be in a similar position with the need to build or renovate most of the Olympic infrastructure.

Olympic ‘Hope’: Magical Lviv & the Majestic Carpathian Mountains Lviv is already an established tourist gem, regularly winning recognition as one of the top travel destinations in Europe. Whether it’s the arousing smell of a freshly-brewed coffee at one of Lviv’s outdoor cafés that dot our quaint, cobblestone roads; or it’s a mouth-watering beer in the shadow of one of Lviv’s UNESCOprotected historic buildings; or maybe it’s the romantic allure of an arm-in-arm couple walking along one of Lviv’s beautiful urban parks; but it becomes easy to envision the city as an ideal place for the Olympic community to congregate. Yet €8 billion represents a very substantial investment in the tourism and sporting infrastructure of Lviv and the Carpathian mountains. It is hoped that this investment will be able to transform the region into one of the leading ski and winter resort areas in all of Eastern Europe; that Lviv and the Carpathian resorts of Tysovets and Slavske can form a formidable tourism partnership that will reap the economic rewards for generations to come. The first step was to announce its interest by the November 14th deadline. The next step, to be announced in July 2014, is to pass the applicant phase and become a ‘Candidate City’. “This is a historic moment for sport in Ukraine,” explains Bubka, whose influential position in the IOC is likely to provide additional support for Lviv to reach the ‘Candidate City’ category. That front-running Munich has new IOC President, and former German IOC member Thomas Bach, in their corner doesn’t faze the ever-confident Bubka. “We have the resources and the support of the nation – we must now move forward.” For Bubka, a man that has built his entire life around setting his sights higher than anyone thought attainable, ‘Nope’ isn’t a word in his vocabulary. There is one more Olympic glory this legend has yet to attain: and it’s his Olympic Hope for 2022.

Ukraine Finishes 2nd – To Play France for Spot in 2014 World Cup The Ukrainian National Football team capped off a strong qualifying run for the 2014 World Cup in Brazil with an 8-0 trouncing at minnow San Marino on Oct. 15 to close out the campaign in second place in Group H with a cool 6-3-1 record. The squad had the opportunity to take the group going into the final game; however Poland was unable to take points from group leader England who earned Group H’s automatic qualification spot to Brazil. The team was led by Marko Devic’s hat trick and Andriy Yarmolenko’s team-leading 4th goal of the campaign. Captain Anatoliy Tymoschuk added to his record number of caps, which now stands at 131. Ranked #20 in the world, Ukraine was drawn to play one the worst four second place qualifiers in Europe. Unluckily for the yellow-blue, they were drawn to play the best of those teams – #21 France. While the 1998 World Cup champions remain a formidable foe – they’ve managed to qualify for every World Cup – let’s remember that France needed a clearly illegal extra-time goal to qualify in 2010. Ukrainian manager Mykhaylo Fomenko has his team playing sparkling defence in leading the squad to a 8-2-0 record while conceding only 2 goals in that span. The squad will need to continue their strong run if they hope to book their tickets to Brazil in June. Games are November 15th at Olympic Stadium in Kyiv and November 19th at the Stade de France near Paris.

BC Politekhnika-Halychyna Off to Fast Start LAfter BC Politekhnika-Halychyna’s 4th-place finish last season, what does the team do for an encore? Smacking SC Kryvbas 91-56 at their home opener on Oct. 18th was a good start. The 35-point margin of victory, the largest in the league so far in the young season, was punctuated by a double-double by centre Yaroslav Lemyk (17 points, 10 rebounds). Politekhnika, who led by 22 points after the first quarter and increased their lead after each quarter, controlled the game with rebounding – outclassing their opponents nearly 2:1. Politekhnika then travelled to Kyiv to play last year’s Ukrainian SuperLeague champions BC Budivelnyk on Oct. 27th. The Lions, led by American shooting guard Kendal Dykes’ 21 points, once again used superior rebounding to overcome a 3rd-quarter deficit and win 81–77. The win vaulted the squad to 2nd-place in the 14-team league early in the season. Be sure to catch the home side on November 22nd and 24th as they host BC Donetsk and BC Azovmash respectively. All games take place at Halychyna Sports Palace (8 Kerchenska St.). Tickets run from 10-40 UAH. For more information, please visit the team’s website at: www.bcpg.lviv.ua.

UKRAINIAN CUP ACTION – FC KARPATY KICKED Lviv’s FC Karpaty bid for a third Ukrainian Cup finals appearance ended with a 2-0 loss at home to Metalist Kharkiv in the Round of 16 on Oct. 30th. The closest the Lions could get to responding to two first half strikes by the visitors was a crossbar off a corner and a header into the woodwork. The loss to the Ukrainian Premiere League frontrunners followed a home 1-0 victory over FC Sevastopol in September. Kharkiv joins Ternopil, Cherkassy, and Chernihiv, as well as Dynamo Kyiv and Shakhtar Donetsk in the quarter-finals. Karpaty next hosts Chornomorets on Nov. 3rd and Metalurh Donetsk on Nov. 23rd.

How do you position yourselves on the market? I am a Vice Director, Head of the Training Department of Business Support Center Newbiznet, also I am a co-owner of this company. Our Company founded in 1990 as a consulting department of Lviv Institute of Management. In 1992 Business Support Center started providing entrepreneurs with training and consulting services. In 1995 Newbiznet was registered as an affiliated (subsidiary) company of Lviv Institute of Management.

Do you have any plans for expansion? What are your growth ambitions? Our experience in the market of consulting and training services shows that it is necessary to have a strategy of development that divide all team members, and will meet the conditions the environment in which the company exists. It is necessary to set ambitious goals, and based on this, we plan to conduct training and consultancy services not only in Lviv and Western Ukraine, but in countries neighboring Ukraine. Also, we plan the development and the entry of new training and consulting products in advanced training for managers, participation in projects for the development of entrepreneurship in Ukraine. What key market drivers are positively impacting your business?

Our reputation is built upon twenty years of developing progressive solutions to business and is confirmed by a list of many successful projects. The strategy of the Center is focused at development of long-term result issued business cooperation and aims at extending the range of business services under the process of implementing the newest standards of client service.

The most important factor that positively influences the consulting business – is economic growth. If the economy is growing, small and medium-sized companies are developing and rising, which are our main clients. The political stability of the country, as well as the laws that regulates business activity an important role, as our practice and experience shows.

The mission of our company is to encourage entirely the process of entrepreneurship due to the international business standards. This mission is undertaken by delivering professional consulting and training support to Ukrainian and foreign companies, local authorities, and potential businessmen. About twenty years Business Support Center – NewBiznet has performed as a co-partner at international projects implementation under the aegis of United States Agency for International Development (USAID), Department for International Development of Great Britain (DFID), TACIS Project, Polish American Ukrainian Cooperation Initiative (PAUCI) and United Nations Organization, Podkarpacka Akademia Przedsiębiorczości.

What is your top priorities for the next 12 months?

50

Briefly, I can say that the main priorities are: implementation of projects that we started this year, and more focusing on short-term and medium-term trainings for managers in cooperation with our partners from the European Union. This will enable managers to be trained by the best European coaches, undergo training abroad, well, which is also important – obtain the Certificates of European exemplar. Which business sectors presents the most interesting investment opportunities in today’s Western Ukrainian market?

In my opinion first of all it is IT sector, HoReCa sector, the sector of alternative energy and energy saving technologies. Speaking about Lviv region, the first and foremost, it is the development of farming. We have interesting examples here in Lviv region; I’m talking about the production of cheeses by Belgian investor. What is the most important management lesson you have learned? The most important management lessons I get from communicating with my customers on trainings, that I conduct, or post-training sessions, as well as from experts in the field of management and human resource management, with whom I always try to keep in touch, if not in online communication then at events. Communication has always two directions – you get something and something you give, a mutual exchange take place and both parties enrich with information, knowledge, experience, if they are open to communication. I like the expression of S. Vakarchuk recent times “One of the greatest mysteries of nature - human relations. This is harder than quantum mechanics”. Thus, the most important capital in business is a team of professionals, that reaches its goals and the ability to create this team, develop it put ambitious goals for it and, in my opinion, this is the main lesson management. This can be a lot to talk about. Could you share your business success story? I build my history every day. But if we speak about last year, it was important for me, as a coach, come out to the markets of neighboring countries, I conduct trainings in Poland for Polish small business owners in the HoReCa, for me it was a new experience, including the language ( I lead trainings in Polish, of course ) and new peaks and new challenges. This is a very interesting experience. The EBA focuses its actions on 7 vectors of economic development – Corruption LVIV TODAY | November 2013

fighting, Court system and Land reform, Currency regulation, VAT refund activation, Customs Procedures simplification and Technical barriers to trade elimination. Which one(s) so you foresee as the most vital and why? I would like to mention that all the areas which focus EBA are important at this time because it affects the effective operation of each company in the market of Ukraine. This is an extremely effective and powerful thing, thus our company one time has become a member of the EBA. EBA is influential business association in the Western Ukraine. Work within the EBA enables us to exchange ideas and opinions, generate support for certain initiatives. Also a major benefit of EBA membership is networking opportunities. What in your opinion can be done to improve investment attractiveness of Ukraine? In my opinion, there is plenty of work, given the fact that large foreign companies come out of Ukraine, our government has the subject to think about. Firstly – this is absence of guarantees for the protection of investors, raider attacks, bureaucratic pressures, transparent work of the courts,

LVIV TODAY | November 2013

total corruption of all processes – these are the main reason that scares foreign companies working in Ukraine. All of these barriers imposed on the objective problems of the Ukrainian economy, the volume of the Ukrainian market loses its appeal due to the low purchasing capacity of the population, and painful problems such as lack of access to sources of finance – affordable loans unreasonably high rates for rent make it impossible to plan the business development. However, there are positive changes, particularly in the annual ranking of Doing Business Ukraine went up by 25 positions. Secondly, if to speak about the Association Agreement with the EU. By itself, the association also does not mean the investment inflows. This, of course, is a positive signaland to Ukraine will anew to look closely. How could you see the future for your sphere of activity in Western Ukraine? What are the prospects in this sphere in general? Can the infrastructure support planned growth? I want to emphasize that Training and Consulting business is closely related with the development of entrepreneurial business environment. Although on the other hand owners of small and medium-

sized businesses realize that well-trained staff is their main competitive advantage. That is why even during the crisis, the company ordered the training, although in a smaller amount and times during year. Our trainers conduct trainings not only in Ukraine, but in Russia, Moldova, now and in neighboring Poland, so they can compare the business environment in other countries. I must point out that demand for consulting and training services increased last year, but it must be said that increased only on the good services and it is normal, as the time for a single order passes, there should be consistent systematic approach. What are your personal recommendations for anyone who wants to be successful in business? My recommendation is never stop developing yourself – self-education as a part of self-developing are the basis of success in business and in life. We always have to remember that “The one, which does not grow, does not develop or somehow ceases to grow is doomed to die.” So in my opinion we need constantly nurture, develop and make efforts as women do – give birth, care, educate their children and do it with love.

n this issue of Lviv Today Markian Malskyy, Partner of Arzinger law firm, Head of West Ukrainian Branch Office, attorney-at-law, PhD, is answering the following question:

EBA CUSTOMS COMMITTEE October 15, EBA Customs Committee was held at the Advice Group Company. The experts of Advice Group told about carrying out of customs expertise, its problems and solutions. There were discussed reasons and procedures for conducting expertise. Managing Director of Advice Group Anton Podilchak highlited role of law enforcement agencies (Security Service of Ukraine, Tax Police) in the process of customs clearance.

On the 5th July 2013 the Ukrainian parliament ratified the new double taxation agreement (DTA) between Ukraine and Cyprus. It is expected to be applied starting from 1st January 2014 and it will replace the previous Cyprus-USSR agreement dated 1982. Does this mark the beginning of the end of Cyprus as the Ukraine’s most favorable treaty partner? Total absence of withholding taxes (WT) on dividends, interests and royalties was arguably the most notable feature of the old DTA. Given the huge political pressure around this issue, the loss of the zero tax rates was inevitable. As expected, the new agreement allows for the imposition of withholding taxes, but at reduced rates. So, the maximum rate of WT on dividends is limited to 5%, if the beneficial owner is a resident in the other contracting state and holds at least 20% of the capital of the company paying the dividend or has invested at least EUR 100.000. The maximum rate of WT for investments not meeting these criteria is set at 15%. In short, the principal changes introduced by the new agreement can be summarized as follows: DTA 1982 DTA 2012 Interest 0% 2% Dividends 0% 5/15% Royalties 0% 5/10%, whereby 80% of royalty profit is exempted from corporation tax under the newly changed Cypriote legislation, reducing the tax paid on royalties at the effective rate of 2,5% instead of 5%. As seen, the new agreement retains the beneficial features of its predecessor, in particular regarding the taxation of capital gains on disposal of shares. The new tax rates are modest and Cyprus remains as one of the most favorable of Ukraine’s DTA partners in this regard.

Not many Leopolitans know that it was in our city where the world’s first vodka production factory was opened. It’s true – the Baczewski brand, now more closely associated with Warsaw and Vienna, first appeared in Lviv in 1782. The factory was located on today’s Khmelnitsky Street, where one can still see the “Almazinstrument” sign on the gates.

For a short time, the Baczewski factory was only popular locally, competing with hundreds of other small private distilleries. The factory produced high quality, perfectly distilled vodka – which was accordingly very expensive – even though vodka was considered to be a beverage primarily purchased by poor people. So when Józef Adam Baczewski, grandson of the founder, took over the factory in 1856, he made several adjustments in an effort to change that. Due to his large advertising campaigns, a Baczewski brand shop on Rynok Square, and agreements with owners of expensive restaurants, Baczewski vodka slowly gained popularity among Leopolitan nobleman and aristocrats. Baczewski often presented his fine product at European exhibitions and regularly won different prizes. By the end of the 19th Century, the Baczewski brand managed to unite members of the upper bourgeois class and aristocrats with the usually underprivileged ‘batyars’ – representatives of the city’s subculture. As early 20th Century Leopolitan publicist Krzysztof Bulzacki described, “For Baczewski [vodka], a Lviv batyar will tear anyone to shreds.” Soon the factory became the supplier to the Austo-Hungarian royal family. The storied brand produced all kinds of local legends about the vodka and the producers’ family. For example, in some 1920s Polish newspapers appeared a story about members of the Baczewski family meeting with American tycoon Henry Ford on a visit to the USA. It is said that Ford presented Leopolitans with a bottle casted in silver which was later sealed in the wall of a mansion on Rynok Square. Mr. Baczewski, and other members of his family, soon became noted politicians and art patrons. As deputies in Lviv’s city council, the Baczewskis became famous advocates of reform, who attempted to bring equality between Lviv’s rich and poor. As patrons of the art, they established a foundation that created opportunities for talented local students to study at Europe’s best universities. In addition, the Baczewskis sponsored renovations to many of Lviv’s mansions, provided food to Lviv’s poorest citizens, and arranged social evenings for single women. Unfortunately, the socialist ideals of the Baczewski family didn’t help them in 1939 when the Soviets came to Lviv. Some members of the family disappeared without a trace in many of the Soviet camps, while others were forced to emigrate to Austria or the USA. Today, Baczewski vodka, which continues to bear the “Lviv” mark, is still produced in those two countries. Leopolitans with a sharp eye will have noticed that Baczewski vodka returned home only last year, and it could be found in three restaurants and one shop. Rumours continue to persist that a new venue dedicated to the famous Baczewski family will be opened in Lviv next year, which will be accordingly named ‘Baczewski’!
