GUINNESS: 5 THINGS YOU DIDN’T KNOW It was in 1759 when 34 year old beer fan Arthur Guinness took a 9,000 year lease at £45 per annum for the unused brewery near St. James Gate in Dublin and started his brewing business. Over 250 years have passed and Guinness, a dark beer, has now became the world’s №1 beverage and a source of pride for all Irishmen. 1. Arthur Guinness never brewed a stout Till the second half of 1770’s Arthur Guinness brewed only ale, and it was in 1799 when he made up his mind and started brewing porter until his death in 1803. In 1821, his son Arthur Guinness II established the recipe for a Guinness Extra Superior Porter, the precursor to the Guinness stout known worldwide today. 2. Three of the five Guinness breweries are in Africa Although Guinness is brewed in 49 countries and sold in 150, Guinness itself owns 5 breweries worldwide, including St. James Gate in Dublin. One is in Malaysia, and the rest are in Africa (Nigeria, Ghana, Cameroon). 3. Guinness saved St. Patrick’s Cathedral The relationship between Guinness and St. Patrick’s Cathedral dates back to Arthur Guinness, who donated 250 guineas to the Chapel Schools of St. Patrick’s. However, most of the credit goes to Arthur’s grandson Benjamin Lee Guinness, who between 1860 and 1865 donated a whopping £150,000 toward the restoration of the crumbling cathedral. Little surprise, then, that a statue of Benjamin sits prominently on church grounds today. 4. Dead rats have nothing to do with the flavour of Guinness The legend that dead rats provide Guinness its flavour is pure myth - the story goes like this: early brews didn’t taste good until some dead rats were found in a barrel that, apparently, contained better-tasting Guinness. The subsequent success led Guinness to fortify the beer with rat bones. This ludicrous story is just a myth. In truth, the unique flavour comes from the perfect recipe of roasted & malted barley, hops, yeast and water. 5. A draught of Guinness has fewer calories than orange juice Two common misconceptions surround the physical make-up of “the black stuff.” The first is that it’s black (officially it has a ruby red colour), and the second is that it’s a heavy-handed beer, calorie-wise. The reality is that 0,3 l of the full-bodied Guinness has just 125 calories, which is less than the same amount of orange juice (183 calories) or milk (135 calories). Notwithstanding legends world famous Guinness stout, the result of Arthur Guinness’s years long good work, equals around 7 mln. glasses of beer consumed daily! LVIV TODAY | October 2012

Артур Гіннес ніколи не варив стаут До другої половини 1770-х, Артур Гіннес варив тільки ель. У 1799 Гіннес повністю перейшов на виробництво портеру. Так тривало аж до його смерті в 1803. І тільки в 1821 його син Артур Гіннес II склав рецепт пива Guinness Extra Superior Porter, попередника стаута Guinness, відомого сьогодні у всьому світі. 2. Унікальний смак пива Guinness ніяк не пов’язаний з мертвими щурами Легенда свідчить, що своїм унікальним смаком і насиченим кольором пиво Guinness зобов’язане мертвим щурам: нібито спочатку смак пива був поганеньким, але одного разу в чані, де пиво було надзвичайно смачним, знайшли мертвих щурів, які випадково туди впали. Успіх цього пива змусив Guinness додавати в пиво щурячі кістки «для збагачення смаку». Насправді своїм унікальним смаком пиво зобов’язане ідеальному поєднанню підсмаженого ячменю і солоду, хмелю, дріжджів та води. 5. Розливнє пиво Guinness містить менше калорій, ніж апельсиновий сік З темним пивом пов’язано два міфи. Вважається, що темне пиво - дійсно дуже темне, майже чорне (між тим, воно темно-бордове), і що воно дуже калорійне. Насправді, 0,3л. розливного Guinness містить всього 125 калорій, тобто менше, ніж апельсиновий сік (183 калорії) і молоко (135 калорій) того ж об’єму! WITTY HUMOR OF LES PODERVIANSKY November 6–7, Lviv Philharmonic Concert Hall named after S. Ludkevich (7, Chaykovskogo str.,) During the new theatre season, the Kyiv based theatre «КРОТ» will make a pleasant surprise for the fans of Ukrainian painter, poet, playwright and performer Les Poderviansky and present plays “Pavlik Morozov” and “Dreams of Vasylysa Yegorovna” (Art Director- Andriy Kritenko (Germany). After Kyiv, the performances will go on a national tour and will be presented in Lviv, Uzhgorod, Lutsk, IvanoFrankivsk, Khmelnitsky, Chernivtsi. Les Poderviansky is most famous for his absurd, highly satirical, and at times politically incorrect and obscene short plays. Their average duration is five to fifteen minutes, with some exceptions. Podervianskyi’s works are highly regarded owing to his attention to detail. Many behavioural modes are easily recognizable, and people are able to recognize themselves in the plays. The general absurdity of the situation makes the characters’ bizarre actions more acceptable, and although certain phrases the author uses are politically incorrect, his humor is generally neutral. Багато типажів і моделей поведінки з нашого життя легко впізнати у цих п’єсах. Загальна абсурдність ситуації робить абсурдні вчинки персонажів більш прийнятним, і, хоча деякі їх фрази можуть звучати політично некоректно, його гумор, як правило, нейтральний. During October 13–23rd, Lviv will host the 10th Early Music Festival, the one and only of its kind in Ukraine. This musical feast will feature ancient music culture from all over Europe. “Early music festival” is a generic term for musical festivals focused on music before Beethoven, or including historical performances of later works. The increase in the number of music festivals specializing in “early music” is a reflection of the Early Music Revival movement of the 1970s and 1980s. This year the festival will be held for the 10th time and will be entitled “Gratitude to Music 2012”. It will present music lovers performances by orchestras and choirs from Switzerland, the UK, Austria, Poland, Russia, Ukraine, as well as, world-renowned musicians Christopher Stembridge (clavecin), Natalya Sikorska (clavecin), Svitlana Shabaltina (clavecin), Peter Benovych, Marek Toporowski (harpsichord, organ, conductor), ensembles “Starck compagnay” and “Consortium sedinum”. NEW GERMAN FILMS FEST 2012 November 4–8, Lviv Art Palace (Kopernyka str, 17) Lviv movie fans are awaiting the exciting selection of modern German films, which will be screened from November 4-8th 2012. This year’s German Film Fest will be held at the Lviv Art Palace and will present a selection of films that have played in German theatres over the last twelve months. The films will also be screened in Kyiv and other major Ukrainian cities for the first time and include a variety of genres. The programme consists of drama “Was bleibt” (directed by Hans-Christian Schmid), drama “Halt auf freier Strecke” (directed by Andreas Dresen), historic melodrama “Wer wenn nicht wir” (directed by Andres Veiel), drama “Die Unsichtbare” (direced by Christian Schwochow). The film “Barbara” - a 2012 film directed by Christian Petzold, tells the dramatic story of a doctor working in 1980s East Germany, and finds herself banished to a small country hospital, is expected to garner a great deal of attention. “Barbara” is Germany’s official submission to the Best Foreign Language Film category of the 85th Academy Awards 2013. Composer Aleksei Rybnikov has always boasted non-conventional thinking and an original approach, so it is only natural that he is the author of the first Soviet rock-operas, the first rock-n-roll broadcast on the national radio, and a variety of ingenious novelties in composition and sound recording. In the course of his long and prolific career he has composed music for over a hundred well-known Russian feature films. The composer gained recognition and fame mostly due to his works for musical theatre. Rybnikov is widely known for his modern opera Yunona and Avos (Juno and Avos, based on Voznesensky’s poem) which combines the traditions of Russian Orthodox prayer with English art rock. Its premiere took place in 1981 in Lenkom Theatre. In 1982 the Ministry of Culture of the USSR banned the release of the album Yunona and Avos. Rybnikov appealed to the court and won the case. Later the rock opera started touring around the world. The play has been performed for over 30 years and still remains a sell-out show. Початок: 19.00 Композитор Олексій Рибников відомий своїм нетрадиційним і оригінальним музичним мисленням: він є автором першої радянської рок-опери, перших програм рок-музики на радіо, багатьох новацій в композиції та звукозаписі. За своє довге й плодовите творче життя він написав музику до понад ста відомих російських фільмів. Композитор здобув популярність і визнання в основному своїми роботами для музичного театру. Найбільшу відомість Рибнікову принесла його рок-опера «Юнона і Авось» (за мотивами поеми А. Вознесенського), в якій поєднані традиції російської православної молитви з англійським арт-роком. Її прем’єра відбулася в 1981 році у московському театрі Ленком. Коли у 1982 році Міністерство культури СРСР заборонило випуск альбому «Юнона і Авось», Рибніков звернувся до суду і виграв справу. Потім ця рок-опера почала гастролювати по всьому світу. Вистава вже йде протягом 30 років і досі проходить у переповнених залах. On October 22, 2012 at Lviv’s popular «Gloria Jean’s Coffee», casting will be held for the upcoming beauty contest “Miss Lviv 2013”. The final event will take place this year on November 29th at the Lviv Opera and Ballet Theatre. The event is expected to attract young women aged 15 to 26 years old. During the three-hour procedure the girls are expected to present their skills and personalities in order to impress the jury. CHURCH OF SAINTS OLHA AND ELIZABETH

he elegant neo-Gothic Church of St. Elizabeth that pierces the sky with sharp spires is the first to welcome guests of the city who arrive at the train station. It is one of the Lviv most admirable and fascinating monuments and is truly considered city's trademark for over a century. The church was built by the Latin Archbishop of Lviv Saint Joseph Bilczewski in the years 1903-1911 as a parish church for the city's dynamically developing western suburb. It was designed by Polish architect Teodor Talowski, in the neo-Gothic style, similar to that of the Votive Church in Vienna. St. Elisabeth's, placed on a hill which is the watershed of the Baltic and Black Sea, with its facade flanked by two tall towers and an 85 m belfry on the north side with imposing spires was envisioned as Lviv's first landmark to greet visitors arriving in the city by train. Primarily, built as Catholic Church it was named in honor of the wife of Austrian Emperor Franz Josef I - people's favorite Empress Elizabeth, who was killed by an Italian anarchist. The architecture of the Church of St. Elizabeth embodies the best traditions on the neo-Gothic style that harmonically interweave with the elements of the Roman style - peaked spires extending upward, tracery lancet windows, portal with a large rose in the center. The entrance to the cathedral is decorated with the sculpture, created by famous sculptor Peter Voitovich whose works adorn many religious buildings in Lviv. Church's interior - contrary to the luxurious exterior - is surprisingly simple and modest: high pillars, white walls with decorative dark red elements, shining stone floor, soft light pouring through the stainedglass windows. Cathedral's pride is the huge 73-chord organ installed here in 1926. It was manufactured by the famous Polish company of brothers Bernatsky, considered one of the best in Europe. But this beautiful and majestic church has a very tough fortune. The history of the Lviv Roman Catholic cathedral is the series of tragic events. Just five years after temple's opening, the First World War started, and the Austro-Hungarian government confiscated the church bells for the military necessity. Soon LVIV TODAY | October 2012

afterwards, the Church of St. Elizabeth suffered new losses: during the PolishUkrainian War of Lviv, it was significantly damaged by Ukrainian artillery. In 1939 - with the outbreak of the World War II church's walls and spires partially collapsed, after air bomb had exploded next to it. From 1st to 17th of September 1939, the German Luftwaffe conducted five relatively heavy (30-50 bombers) air raids on Lviv. Although the primary targets were strategic objects, as usual bombs also often hit other areas (the church is located very close to the main railway station). There were no Polish fighters to defend the city, so it must have depended only on its anti-aircraft artillery, which despite of a few successes wasn't strong enough to stop the enemy planes. Lviv was attacked by Wehrmacht on September 12th, 1939. The city garrison was consisted of some infantry units (11 battalions), supported by policemen, boy scouts and other citizens. At first the German grenadiers broke through the Polish defense and managed to get to the St. Elizabeth's church. They were admittedly soon repulsed by Polish counter-attack, but the enemy troops encircled the city. On September 17th , according to the Ribbentrop - Molotov Pact, Soviet Union invaded Poland from the east, and Red Army units joined the siege of the city. In the late evening on the 19th of September, Polish

infantry for the last time tried to counterattack in a desperate and unsuccessful attempt to open the road for Gen. Sosnkowski's units, trying to fight their way to Lviv. The forest in the outskirts of the city where the fierce battle took place, was called by the Germans "Der Totenwald" - which tells more than a long story. On September 22nd, 1939 the city capitulated. It still could have been defended for some time, but the commander of Lviv, Gen. Langner decided to save the civilian population and the city from further destruction. Obviously, it was a good decision, as defending Lviv for a week or two more was of no strategic importance, as the war was already lost. However, during all this tragic times of war church remained open and the most severe period of decline for the Cathedral of St. Elizabeth fell on Soviet times. In 1946, it was closed and continued crumbling, and thirty years later the church was turned into warehouse. The temple started to revive only in the late twentieth century. In 1991 a Ukrainian Greek Catholic was established and the church was reconsecrated as the Greek Catholic church of Sts. Olha and Elizabeth and became one of the most attractive sights of Lviv. LVIV FASHION WEEK D

uring October 03–07, 2012 in Lviv was held 10th jubilee Lviv Fashion Week – Spring/Summer 2013. During five days, guests of this glamorous fashion holiday could admire latest collections by fashion designers Roksolana Bogutska, Oksana Mukha, Petro Nesterenko-Lanko, Mykytyuk&Yatsentyuk, Anna Yakovenko, Artem Komarov, Amina Gasem, Syuzanna Slastion, Olya Romanova, Ivanna Yukhymchuk, youngest designer Sofi-Mari Sedova and others. Debut collections were presented by David Bacali (Slovenia), Kristina Chegodaeva (Russia), Oksana Piekna (Lviv), Khrystyna Rachytska (Lviv), Svetlana Vozian (Sevastopol). Among highlights of the event was special fashion-show “Mercedes-Benz White collection” at luxurious Mirotel Resort & Spa (Truskovets)

dedicated to event’s constant official partner Mercedes-Benz. Within joint project with Fashion Philosophy Fashion Week Poland premiere collection was presented by event’s special guest designer Natasha Pavluchenko (Poland). Also special attention of fashion and retail specialists including marketing directors, PR experts, fashion event organizers and designers was attracted to the meeting-lecture by Marlena Woolford, Managing Director of Inspiration Trend Analysis Ltd. Lecture entitled “Behind the scenes – the work of trend forecasting companies. Trends for s/s 2013 and a/w 2013/2014 tackled issues of trend forecasting and analysis, fashion marketing and business development. As usual Lviv Fashion Week featured fashion shows within IV Young designer’s contest

“SABOTAGE”, student’s collections OFF schedule and In AVANT GARDE, in addition to traditional daily show rooms, exhibitions, lections. longside with spectacular catwalk shows, Lviv Fashion Week included special events like exhibitions of contemporary art FASHION GAMES and S.A.L.I.G.I.A F.A.S.H.I.O.N. featuring creative works by Polish fashion illustrator Maggie Piu, as well as photography and jewelry.

During September 13-16th 2012, Lviv hosted the 19th International Publishers’ Forum. The event brought together over 300 publishing houses as well as over 100 writers from Russia, Serbia, Norway, Poland, Latvia, Canada, USA, Australia, Croatia, Georgia, Spain, Slovakia, Czech Rep., etc. This year’s special guest for the event was Australian writer, Peter Warren Finlay, (known as DBC Pierre) who became world famous with his novel Vernon God Little, which was awarded the Booker Prize for fiction in 2003. Within the Publisher’s Forum several literary projects took place - “Bruno Schulz Fest”, the festival “From Skovoroda till Skovoroda”, II International Translators’ festival “ TRANSLIT”, “Night of non-stop music and poetry”, “Night of erotic poetry”, as well as the workshop project: “Context and VII Literary festival featuring Adam Zagajewski (Poland), Martin Pollak (Austria), Henryk Grynberg (Poland-USA), Oksana Zabuzhko (Ukraine), Valeriy Panushkin (Russia) and many others.

PHILHARMONIA LAUNCHES MUSICAL SEASON 2012/2013 From September 15-16th 2012 Lviv’s theatre-goers were presented the with exquisite musical talent of the Youth Academic Symphony Orchestra “INSO-Lviv”, under the direction of maestro Fahraddin Kerimov, who invited both Leopolitans and guests of the city alike, to Saturday’s youth concert: “Elegance of The East in The World of Classics” which featured the opening of the “INSO-Lviv” concert season for 2012/2013. Fahraddin Kerimov is an Honored Artist of Azerbaijan and since September 2004 he has been the conductor of the State Philharmonic Symphony Orchestra of Baku and professor of vocal and opera training at the Baku Music Academy. During the concert Lviv music lovers were delighted with compositions by R. Wagner, J. Sibelius, M. Rymsky-Korsakov, which are truly world classics and the greatest examples of eastern classical music. The soloist was a Turkish violinist, Palin Halkatsi Akin, who in addition to her active career as a soloist, is also an instructor at the Mimar Sinan Arts University State Conservatoire and Leader of both the Borusan Istanbul Philharmonic Orchestra and the Borusan Chamber Orchestra. She played a violin made by Fransiscus Gobetti in 1725, with permission of the Borusan Company. On Sunday 16th, the concert “Opening of the new symphonic music season” was dedicated to the 110th anniversary of the first symphonic music event, which took place on September 27, 1902. The concert featured the Lviv Academic Symphonic Orchestra of the Lviv Philharmonic Theatre and the great conductor Aidar Torybaev, who wowed the audience with compositions by C. M. Weber, D. Shostakovich and S. Ludkevych.

На вихідні 15-16 вересня 2012 р. львівські любителі музики отримали вишукані подарунки - в суботу Молодіжний академічний симфонічний оркестр «INSO-Львів» під керівництвом маестро Фахраддіна Керімова виступив у концерті «Елегантність Сходу у світовій класиці», яким відкрився концертний сезон 2012/2013 у львівській філармонії. Фахраддін Керімов, заслужений артист Азербайджану, з вересня 2004 року є диригентом Державного симфонічного оркестру філармонії Баку і професором вокалу та оперної підготовки Бакинської музичної академії. Слухачі були у захваті від виконаних творів Р. Вагнера, Я. Сібеліуса, М. Римського-Корсакова, які найяскравіше відобразили приклади східної музичної культури. Солістом була турецька скрипалька Палін Халкаці Акін, яка, окрім своєї активної кар’єри соліста, також є викладачем Державної консерваторії університету мистецтв ім. Мімара Синана та керівником Стамбульського філармонічного оркестру Борусан і камерного оркестру Борусан. Вона грає на скрипці роботи майстра Франціско Ґобетті 1725 року, з дозволу компанії Борусан. On September 20th 2012, the Consulate of the Austrian Republic in Lviv celebrated their 10th Anniversary. The venue for the festive event was hotel “Suputnyk”, which lent an added air of cosiness to the celebration. During the formal program of the evening, the honorary consul of the Austrian Republic Mr. Yaroslav Nakonechnyy, was bestowed a special award for the successful and devoted work as consul during his 10 year tenure. Austrian Ambassador to Ukraine, Mr. Wolf Dietrich Heim, as well as the Lviv Region Governor Mykhaylo Kostyuk attended the event. The Austrian consulate in Lviv provides services for 8 Western Ukrainian regions, making international relationships between Ukraine and Austria more effective and transparent.

From September 20–30th 2012, the Lviv Art Palace hosted the IV Festival The World of Dolls 2012 – Project Lady & Teddy. The Festival featured a countless number of dolls: from the ethnic Ukrainian hand made motanky to textile, knotted, knitted, carpet dolls and dolls woven using grass, straw, yarn, dolls from paper-maché, ceramics, wood, mohair, glass, etc. Among the highlights of the event was the presentation of the so-called “born-again” dolls, which looked exactly like newborn babies. Also, visitors were particularly drawn to the numerous master classes on doll making techniques provided by famous doll makers from Ukraine and abroad.

У Львівському Палаці мистецтв 20–30 вересня 2012 року відбувся IV фестиваль «Світ ляльок-2012» – відомий також як «Lady & Teddy». На цьому традиційному фестивалі можна було побачити неймовірну кількість ляльок: увагу відвідувачів привертали і давні українські ляльки-мотанки ручної роботи і виготовлені з тканини чи гобелену, і плетені, і в’язані, з трави, соломи, пряжі, ляльки з пап’є-маше, кераміки, дерева, мохеру, скла і ще багато з чого. Серед найцікавіших подій фестивалю була презентація так званих «відроджених» ляльок, які виглядають як живі немовлята. Крім того, відвідувачів запрошували на численні майстер-класи з виготовлення різних ляльок, які проводили відомі майстри з України та зарубіжжя.

With its sixth year, the festival is an important event for its various coffeehouses, many of which are architecturally and thematically unique. Lvivites together with the guest of the city, voted for different festival nominations. It was “Svit Kavy” coffeehouse which became winner in nomination “Best coffeehouse” besides stunningly tasty coffee this venue boasts an interior with 17th century beams discovered during a restoration process and original brick walls. LVIV ADORES ITS GOLDEN LIONS During September 27th – October 6th 2012, in Lviv the XXIII International Theatre Festival “Golden Lion” was hled and dedicated to the 125th birthday anniversary of Les Kurbas. In theatres across the city, teams from Kyiv, Kharkiv, Luhansk, Chernigiv, Lviv, Krakow and Jelena Gora, Vilnius, Brest, New York, Georgia, Dushanbe, Paris, Brussels and Prague presented Lviv’s theatre-goers with a truly magical feast of spectacular performances. The program of the event was rich and interesting and

featured a colorful theatrical carnival, a 3-day seminar dedicated to the works of Les Kurbas, where famous theatrical critics, theatre directors and actors shared their ideas and thoughts with admirers and fellow colleagues. The highlight of the festival was the meeting with Lviv born theatre director, Roman Viktiuk, which attracted many admirers.

METRO CLUB’S NEW RECORD In Lviv was held traditional festive quest organized by “Metro club” longside with “Perfect party for perfect people”, which was dedicated to the glorious achievement – 100 000 “likes” on Facebook page of “Metro club”. As specialty of the quest became close connection to the social network, as each participating team had own personal page where everyone could see results of the quest stages fulfilment. Within first quest task ceach team had to represent one letter in the word METRO, which was compiled from participants directly in front of City hall. And from now on, for good memory and highlighting record amount of fans of Facebook page of “Metro club” in Lviv were planted five white cedars. “Perfect party for perfect people” featured colourful fireworks over etryshevych square where “Metro club” – Lviv’s best club according to TripAdvisor ratings is located. According to the finals as winner of the quest came “Red team”, members of which got “Metro club” regular customer cards with granted entrance to the venue free of charge during 12 months and especially made trinkets. Looking forward to new parties and new victories with “Metro club”.

CAMERA, ACTION, HRUSHEVSKY CINEMA JAZZ…OPEN! On September 28, 2012 in Lviv took place unique event – presentation of the completely new and original restaurant HRUSHEVSKY CINEMA JAZZ (Shevchenko avenue, 28). Venue is located in the heart of the city’s central part, in the very same building where in 1912 was opened first Lviv’s cinema “Corso”. Festive presentation was dedicated to the 100th anniversary of the foundation of “Corso” cinema. Especially for the festive opening, to the guests of the event was offered exhibition of 19 unique retro cinema-posters, provided by private collector Roman Davyd, who’s collection consists of over 2000 items. Guests of the presentation - politicians, cultural and social activists, artists, businessmen, mass-media representatives got wonderful opportunity to plunge into cinematic atmosphere of Lviv of the beginning of XX century. General manager of the venue Mr. Taras Kolodiy is sure that in the future Lviv’s first restaurant of improvisations will continue to surprise it’s guests and visitors not only with delicious European cuisine, but also with numerous art events. Film screenings, catchy exhibitions, live concerts, book presentations, glamorous parties and much more will come on the future menu of HRUSHEVSKY CINEMA JAZZ restaurant. Mr. Kolodiy promised that in the future citizens will see launch of brand new projects aimed on renewal of glorious Lviv’s past traditions of local hospitality.

At the London 2012 Paralympics, Ukraine placed fourth in the final medals table, with a total of 84 medals: 32 gold, 24 silver and 28 bronze, successfully passing Beijing’s gold medal total of 24.

mong the heroes of the Paralympic games is Lviv’s athlete, Roman Pavlyk, who is competed mainly in category T36 sprint events. avlyk competed in the 2008 Summer Paralympics in Beijing, China and won a gold medal in the men’s 100m -– T36 event, a gold medal in the men’s 400m – T36 event and a silver medal in the men’s 200m – T36 event. On Thursday, September 6, Roman Pavlyk took the gold in the men’s 200m (T36), with a result of 24.70 seconds. Ravlyk has also won a gold medal in the men’s long jump (F36) final after a tough contest at the Olympic Stadium. The Paralympian recorded a personal best jump of 5.23m, which was enough to place him at the top of the group and take home the gold medal. In addition, Roman Pavlyk picked up bronze medals in the men’s 100m and 400m (T36). Lviv’s wheelchair fencer Anton Datsko won the silver medal at the Paralympic Games in London due to a loss during the finals to China’s Hu Daoliang 10-15. At the Paralympics in Beijing Datsko placed seventh in foil and was tenth in sabre. Datsko, 29, who suffered a spinal cord injury in 1990 when he fell off the tree, has been practicing fencing since 2003 and has been apart of the national team since 2005.

The Ukrainian national basketball team qualified for the FIBA EuroBasket 2013, that will take place in Slovenia in September 2013. Ukraine won over Austria with a result 68–57 in a match in Lviv, which took place on September 2, 2012. Ukrainian basketball player Serhiy Hladyr used the match in Lviv as an opportunity to show off his skills. The player scored 17 points for the team. Maksym Kornienko was a close second with 12 points.

Fencing

The annual fencing holiday took place at Lviv’s central square on September 23, 2012. The event was dedicated to the “Olympic week in Ukraine” and featured fencing shows by students of local sport schools, colleges and the Physical Culture University. The main attraction of the holiday were the master classes led by London 2012 Olympics gold medal winner Yana Shemyakina.

Archery From September 9–15, 2012, the International Archery Tournament “Golden Autumn 2012” took place at Lviv’s stadium of the educational and sports camp of the Regional Football Sports Society Dynamo. This tournament which is considered to be the highest ranking tournament of Ukraine’s 2012 archery season gathered 270 participants from Russia, Belarus, Poland, Romania, UK, Moldova, Kazakhstan and 14 regions of Ukraine.

Weightlifting

During September 15–22, 2012, stadium “Arena Lviv” hosted the IWF-World Masters Weightlifting Championships of 2012. This sporting event brought together nearly 500 participants representing 40 different countries (including China, Japan, India, Russia, etc.). Among the most prominent and notable athletes of the competition was the sixth world record by Gennadiy Yurkevych (two times World Champion, three times European champion, five time World and Europe record holder), who in his 40-44 years age category and weight up to 85 kg lifted 163 kg barbell.

On September 22, 2012, Lviv hosted the sixth festival for active tourism and leisure: “Manivci”. The festival’s main aim was to promote healthy recreation of citizens and domestic tourism in Lviv region, and introduction of the types of extreme leisure activities like hiking, cycling and trailering, climbing, parkour and kayaking.

Could you start to introduce yourself and your company? How do you position yourselves in the market? I have been in business education for over 12 years now. In 2008, three companies operating nationally and internationally and headquatered in Lviv (Softserve, Galnaftogas and Trotolla) offered to Ukrainian Catholic University to launch a business school in Lviv within its premises. Since I had experienced with other business schools and in building corporate learning and educational system I was offered to lead the LvBS. Business education is a very interesting and new area for Ukraine. All business schools in the market today have to work quite actively to create demand for our services. Dynamics and tendencies of business education in Ukraine are also a bit different from the global ones, thus it makes us work in both directions – to follow international trends as well as monitor the needs of Ukrainian business environment and respond to them. Do you have any plans for expansion? What are your growth ambitions? Our clients (participants of the programs) represent all regions of Ukraine. Due to the specificity of the filed we have numerous international projects – on some programs we have 30% of international faculty, we take participants of Executive MBA to Learning tours to China and Hong Kong as well as to Central European University in Budapest. Unfortunately, no Ukrainian business school has international students (or appropriete ratio of international students) at the moment. What key market drivers have a positive impact on your business? It is the growth of global economy, and

national economy in particular. The first line cut in the budgets of companies in 2008 was training and development. While in short term prospects saving money is the right decision, in long term plans companies looking for growth and development need to invest in their human resources. What is your top priorities for the next 12 months? This September we start a new program: ‘MS in Innovations and Entrepreneurship’. It is meant for young entrepreneurs and professionals willing to develop their start-up projects or to work with innovative projects within companies. The group we have enrolled are very inspiring and ambitious so we are looking forward to some breakthrough in this area. Also, LvBS launched a very interesting project with IT cluster in Lviv and Lviv City council to develop and implement low cost value innovation for IT sector development in Lviv.

Next steps for the school include the increase the number of Excellence Centers. For example, Value Innovations Center is one of them. Now, we are engaged with the topic of Succession and Family Business. Due to our connections in China, we expand our Asia Center. All these knowledge areas are crucial for Ukrainian companies if they want to be competitive on global and national markets. Which business sectors present the most interesting investment opportunities in today’s Western Ukrainian market? IT and agriculture. What is the most important management lesson you have learned? Every manager needs a strong and challenging team. If you don’t have such, you become complacent and lazy. While a company willing to be successful can LVIV TODAY | October 2012

not have a lazy and satisfied leader. The EBA focuses its activity on 7 vectors of economic development – Combatting Corruption, Court System and Land Reform, Currency Regulation, VAT Refund Activation, Customs Procedures Simplification and Technical Barriers to Trade Elimination. In your opinion, which of these will soon become the most vital and why? Combating Corruption as corruption ruins all principles and values in business and destroys the very notion of human dignity. I think that most of business people would like to work in a transparent environment and it is not true that business got used to work in corrupt conditions. As for me, Georgia is a prominent example in combating corruption. I had an opportunity to see myself how much they managed to achieve in the last years, moving step by step. In your opinion, what can be done to improve investment attractiveness of Ukraine? These are exactly the areas EBA is working in – combating corruption, court system and tax regulation improvement. Of course, there is an issue of brand building of the country. However, if there is no legal structure at place, investors will head for the abundant choices globally. How do you see the future for your field of activity in Western Ukraine? What are the prospects in this sphere in general? Can the infrastructure support the growth planned? I hope that many mature companies thinking strategically and long term will grow. We will have more business leaders with ambitions for national and global competition. If that happens there will be a great need for high quality business education. What would you advise to those willing to be successful in business? As a Chair of LvBS Advisory Board Pavlo Sheremeta says: Expect nothing. Blame nobody. Do something.

EBA EVENTS CUSTOMS COMMITTEE MEETING Meeting was held at the EBA office in Lviv, 24th of September 2012. EBA Customs Committee members had an opportunity to discuss about the Court practice in the sphere of determination of the customs value (in light of recent Resolutions of the Supreme Court of Ukraine). The speaker: of the meeting was Anton Podilchak, Member of the Board & Head of Customs Committee of Western Ukrainian Branch of European Business Association (Advice Group). Anton Podilchak provided generalization of the legal position of the Supreme Court of Ukraine on the methods of determination of the customs value and sequence of their applying by the officials of the State Customs Service of Ukraine. Based on the results of live discussion of this issue during the meeting practical recommendations was summed up, regarding methods of protection of own rights and interests while determining of the customs value, including in court authorities of Ukraine.

HR COMMITTEE MEETING 18th of September 2012, EBA HR Committee meeting was held at the EBA office in Lviv. The invited speaker of the meeting – Alan Lees, Operations Support Manager at Discovery Drilling Equipment Ltd, worked as Operations Support Manager in the Oil & Gas Drilling industry for the past 30 years, both on-shoe and on offshore drilling platforms in many different countries from as far away as Mexico & Trinidad, Congo & Saudi Arabia, Papua New Guinea and throughout South East Asia. Mr. Lees spoke about the peculiarities of Management in an environment of different cultures based on his own experience by the example of the company in Papua New Guinea. In his presentation the speaker demonstrated innovative approaches to the management process in the company activities and in HR management. A colourful story aroused great admiration and active discussion about the management features in Papua New Guinea among the participants, and gave inspiration for the development and broadening horizons for the attendees.

Talking point Memorandum of Cooperation On 20th September 2012, EBA Western Ukrainian office hold a General Membership Meeting in the frame of the Council of National and Foreign Investors. Among the honored guests were Mykhaylo Kostiuk - Head of Lviv Regional State Administration, Vitaliy Pekarchuk - Head of the State Tax Administration in Lviv region, Lubomir Hembara – Head of the State Tax Inspectorate to work with large taxpayers, Serhiy Papazohlo - Head of Lviv Customs, Artur Horbenko - Head of the Western regional Office of the State Border Service of Ukraine. Participants discussed the realities of the investment climate in Lviv region. Moderator of the meeting, Mariana Lutsyshyn, noted that due to the results of the survey, conducted quarterly by the European Business Association, the trust of the existing investors to the authorities decreased. Taras Yurynts, Deputy Chairman of the EBA Western Ukrainian office, in his speech said that one of the main levels of declining confidence in government was fiscal pressure from the side of the last one. In return, Mykhaylo Kostiuk assured that the government fully supports and will support those companies that conduct their business in Lviv honestly and transparently. Vitaly Pekarchuk, head of the State Tax Administration in Lviv region, stressed in his speech that cooperation with honest taxpayers is of the vital importance and stands at the first place. As the guarantee that Tax Administration is opened to cooperation are plans to sign the Action Plan between the Tax Administration and EBA, which is being prepared at the moment. Also, the participants voiced problems concerning the border crossing between Poland and Ukraine. The Governor replied, saying that there are negotiations planned on a so-called business corridor to facilitate businessmen crossing the border, in the case when those crossing the border go to establish or maintain business contacts with Europe. In general, the participants responded positively concerning the Lviv Regional State Administration. As the result of the discussion was the signing of a Memorandum of Cooperation, between the five present governmental agencies and the European Business Association, whose members operate in Western Ukraine.

We see our task in strengthening partnership relationships with all foreign companies operating in the region and attracting new investments in its economy. And signed Memorandum of Cooperation is a proof of that. Therefore I would like to reassure foreign investors that in the face of the TAX officials they will find reliable partners who will always treat them objectively, impartially, carefully and with an understanding of their problems.

For Lviv Customs it is very important to be a part of signing this Memorandum, since this is an example of practical dialogue between government and business. Depending on the objectives each of us - customs, tax, etc. – is involved in the creation of a favorable investment climate in the region. And this joint work shows that we all have a single and only goal. And combining efforts, we can achieve it faster. n this issue of Lviv Today we continue to discuss legal issues with attorney-at-law, PhD, Mr. Markian Malskyy. Mr. Malskyy is answering the following question: What is the notorious concept of «beneficial ownership» introduced by the Tax Code and what kinds of transactions are affected? Since entry into force of the new Tax Code in 2011, the national tax authorities declared that they would consider the beneficial ownership rules under existing double taxation treaties (DTT) during their tax inspections. According to Art.103.3 of the Tax Code, agents, nominee holders and other intermediaries cannot be regarded as beneficial owners of income sourced in Ukraine, and therefore, are not entitled to favorable treaty provisions. This provision especially refers to companies entering into credit and licensing agreements with non-residents. It is insofar important for them, since attracting credit facilities from non-residents and using the sub-licensing structures with payments of royalties to offshore companies is widely practiced in Ukraine for tax planning/avoidance purposes. What are the consequences of the application of this concept? Formerly, in order to be able to apply treaty provisions (exempting the payments from WHT or reducing the standard 15% WHT to 10% or 5%) it was sufficient to provide a tax residency certificate from a non-resident entity. Since the introduction of the beneficial owner concept, the application of favorable DTT clauses has been subject to two conditions: 1) confirmation of the tax residency of the non-resident (by way of obtaining the residency certificate); 2) confirmation of the beneficiary status of the non-resident, i.e. that such person is entitled to receive the income in question and is its actual recipient. Now the principal question is how the beneficiary status of the non-resident should be confirmed and who should do it – the resident company or the tax authority? Given that most DTT treaties do not mention the term «beneficial owner» and that its definition in the Tax Code is rather incomplete, this may pose a major problem for Ukrainian tax-payers involved into such agreements.

BARRY KERZIN On 27th September 2012, in the frame of EBA Training Center, EBA Western Ukrainian office in partnership with and co-organization of Mr. Volodymyr Kolyvay and business training center «Andante» hold a meeting with Dr. Barry Kerzin - Buddhist monk and Dalai Lama’s personal physician under the topic: Business and Unknown Mental Potential. During the meeting Mr. Kerzin spoke about: what is happiness?; making decisions, relying on short and long terms; what is meditation and what are its types?; how to concentrate? types of minds in Buddhism. Barry Kerzin also shared his knowledge about how to train our minds to make us more resilient to lives difficulties and told participants about the state of “tukdam”. The seminar consisted of two sessions, one of which was theoretical and the other was more practical, where participants along with the speaker meditated and were involved in the “questions and answers” session. Does the business needs to beware the application of the «beneficial ownership» rule by the tax authorities? Since the concept of the beneficial owner is new to Ukrainian legislation, the court practice on this issue is scarce. Still, the existing few judicial decisions enable us to identify the attitude of the tax authorities in dealing with this problem. In particular, trying to target the sublicensing structures with payments of royalties to offshore companies, the tax authorities adopted a rather simplistic, formal approach. They argued that the companies having no exclusive proprietary rights to the object of intellectual property can be considered only as a nominal owner of income in form of royalties (that is, no beneficial ownership and no application of favorable DDT clauses). Nevertheless, the courts adopted a similar formal approach and ruled that the (sub-)license treaty between the parties was sufficient to prove the beneficial owner status of the non-resident and that the respective DDT did not contain the term «beneficiary owner» able to impose additional restrictions. Likewise, in cases involving the credit agreements with offshore companies the courts ignored the economic (substantial) context and ruled in favor of the tax payer without examination of potential intermediary status of the non-resident. Given that the current European practice of application of the beneficiary owner concept is based on the economic (substantial) approach - revealing possible intermediate characters of the so called conduit companies - it is only a matter of time till the national tax authorities and courts become more confident with the new concept and take over the same approach. This means that some of currently used tax planning schemes will be rendered obsolete and it will have to be taken into account when structuring the cross-border transactions.
