The week commencing 6 February was National Apprenticeship Week, a celebration of the apprenticeship programme, and several events marking the week took place across Dorset and the whole of the UK. We were also delighted to announce the opening of the second Dorset Apprenticeship Awards, working with the Dorset and Somerset Training Provider Network and sponsored by Superior Seals.

The awards are open for entry until 17 March and free to enter and open to all people in Dorset that are either on an apprenticeship programme now or have completed their apprenticeship in the last 12 months. The awards celebrate not only the hugely important contribution that apprentices make to business in Dorset but also the personal achievements of apprentices and the impact of the apprenticeship programme on lives. Each finalist, along with two guests and their employer will be invited to an awards celebration lunch on 16 May 2023 at Superior Seals Training Academy, Ferndown and will be presented with their trophy by His Majesty’s Lord-Lieutenant of Dorset on behalf of His Majesty. Hello and a very warm welcome to the March edition of Dorset Business Focus. March already, where does the time go?!

Digital Markets, Competition and Consumer BillAre you ready?

The UK government has confirmed it will bring forward the Digital Markets, Competition and Consumer Bill. Consequently, some of the most significant reforms of consumer law for years are anticipated, perhaps as soon as Autumn 2023. The bill is expected to provide new powers to the Digital Markets Unit within the Competition and Markets Authority (CMA) to foster more competitive digital markets, which will impact most businesses in the UK.

Much of the bill’s intended effect is expected on the biggest digital firms, but a significant consumer law reform is also likely. Consumer law can be onerous on businesses. If they are not aware of their responsibilities, they can fall foul of the rules with harsh consequences. The bill will likely give the CMA greater enforcement powers, including new capabilities to fine firms up to 10% of their global turnover for mistreating customers. Businesses should therefore look out for any revised CMA guidance relating to consumer protection, merger control, and competition law and adapt their processes accordingly. Businesses may wish to have their consumer terms and conditions reviewed and their contracting processes audited to ensure compliance with evolving consumer law.

One key area of focus with the changes to consumer law is expected to be a move against “subscription traps”. The CMA has scrutinised ‘subscription models’, particularly where contract terms do not warn of automatic renewal. Concerns have been raised as to whether such contracts are fair, as consumers may find themselves locked into paying a subscription for a service they are not actually using, being subject to unexpected price increases and not being able

to get out of the contract easily. In addition, there may be renewal fees, cancellation fees, and other costs, which were not anticipated or communicated at the outset. Businesses should clearly inform their consumer customers about any autorenewal terms and send reminders before the renewal occurs. The CMA has previously set out its expectations, with companies ensuring that cancellation is no more complex than steps taken to purchase.

The CMA has already taken enforcement action against anti-virus providers Norton and McAfee concerning their auto-renewing anti-virus software subscriptions. In October 2021, the CMA produced guidance setting out nine’ Compliance Principles’ and providing examples of terms ‘more likely to comply’ and ‘unlikely to comply’ with consumer law. It has therefore been anticipated for some time that such rules will soon extend to all businesses using a subscription model with auto-renewal terms and it seems likely that the bill will bring about this change.

Another key focus from a consumer law perspective will be on fake reviews, with the Autumn 2022 statement saying that the bill will seek to protect consumers in fast-moving markets by tackling fake reviews online. Online reviews influence a consumer’s decision to purchase and therefore the bill is expected to prohibit the submission, commission or facilitation of fake reviews and will require businesses who host consumer reviews to take reasonable

steps to ensure they are genuine and originate from bona fide consumers.

A third focus of the bill in respect of consumer law will be to strengthen protections where consumers use “saving schemes”, for example, Christmas saving clubs. Currently, the schemes do not protect consumers if the business goes bust. The bill will seek to avoid repeats of scandals like Farepak in 2006, where the Christmas saving club went bust, and many people struggled to recover their money. The new law is expected to require such prepayment schemes to safeguard customers’ money through insurance or trust accounts fully.

In light of the new bill and anticipated changes, businesses should check their documentation and contracting processes. Consumers must be provided with clear information about their rights, meeting all requirements under current consumer law, particularly in respect of subscription payments, auto-renewal terms and the ability to cancel contracts. Businesses should look at their review processes and how they will comply with new rules, particularly the need to take reasonable steps to verify that reviews are genuine.

Farmland values to continue growing

Constrained supply and competing demands are expected to provide resilience in the farmland market in the face of wider economic challenges, according to Savills.

During 2022, there were 127,900 acres of farmland publicly marketed in Great Britain – the most since 2018, and an increase of 5% on the previous year. In the South East, 14,000 acres were marketed last year, representing an increase of 9% from 2021, while the South West saw an increase of 3%, to 18,100 acres during 2022.

Despite this modest increase in supply, the demand for farmland remains high and this gap in supply and demand underpinned 8.7% growth of prime arable land values across Great Britain to £10,000 per acre, while the value of poorer quality pasture land experienced the largest increase in value during 2022, climbing by 12.4% to a record of £5,000 per acre.

With inflation anticipated to fall in 2023, Savills forecasts that real values for prime GB arable land will increase by an average of 2.5% per year and poorer quality pasture by an average of 6% per year over the next five years.

Geoff Jones, of Savills rural agency team in the south, said: “The farmland market across the south performed well in 2022 with the supply of land marginally up on 2021.

The lack of quality opportunities, in terms of commercial viability and scale, meant that there were a number of hotly contested sales and fantastic resulting sale prices.

“Looking ahead, we believe 2023 will perform similarly to 2022 with a slight increase in availability but not enough to meet demand. Existing landowners should be in

a good position having taken advantage of the strong commodity prices achieved last year, rollover buyers will continue to be active as their deadlines loom and the increasing demand from natural capital buyers should keep prices moving in an upwards trajectory, if not quite as steep as previous years.

Greendale Construction starts 12-month SCOLA refurbishment

Greendale Construction has started work on a 12-month SCOLA refurbishment project for The Wavell School, in Farnborough.

The 12-month works for Hampshire County Council will be split into four phases to enable the school to retain use of parts of the building.

Andy Musselwhite, contracts director for Greendale Construction, said: “The main works involve the removal of the 1960s designed existing external façade and roof, and replacing with new, highly insulated brick slip façade and replacement roof. This includes new aluminium double glazed windows, and a number of internal upgrades, including Natural Ventilation with Heat Recovery (NVHR) units to provide tempered fresh air to classrooms.” www.greendaleconstruction.com

Expert View: BCP Industrial Property Market

Historically, the conurbation, and in particular Poole, has suffered from a limited supply of employment land. This shortage of industrial stock will remain a problem into 2023 and beyond.

Occupier demand continues to outstrip built and available industrial supply, with pipeline supply also affected by the reduction in speculative development amid build cost inflation and funding costs.

Bryony Solan, associate at Vail Williams: “Despite new development coming through, we are aware of occupier requirements which still cannot be fulfilled in the BCP conurbation due to a lack of appropriate stock.

“An employment land shortage is exacerbating the issue, with delays to the Local Plan compounding the situation. If this issue is not addressed, it may force local employers to move their operations outside the area.”

Collaboration is key

Bryony continued: “More collaboration is needed between the local authorities and the commercial property agents on the ground. This will help to establish

where demand is coming from, what is needed, and where land needs to be allocated for industrial development.

“We also need to see more done to address the planning challenges the area faces – specifically, an improvement in planning timescales from the Local Planning Authority, to allow industrial development to come through in a timelier fashion.”

What will occupiers do?

According to Ben Duly, Senior Surveyor at Vail Williams, increasing rents, rising energy costs and the spectre of rising business rates, which could increase by up to 26% in the BCP area, are all putting pressure on occupiers to look at their costs.

He said: “Occupiers of poorer quality units with lease events in the next 18 months, are likely to consider moving to higher quality, better insulated space, to help with their energy costs, whilst meeting their ESG policies.

“Landlords of ageing industrial stock may therefore wish to think about investing in their units, either through extensive refurbishment or complete redevelopment, to deliver

a higher specification of unit to market, boasting green credentials. This in turn will support them in meeting their requirements ahead of the EPC Regulations in April.

Chinks of supply light

Despite supply challenges, 2023 will see the delivery of nearly 200,000 sq ft of new high-quality industrial stock come to market. Bedrock Park on the Ferndown Industrial Estate will deliver much needed highquality stock with the 26-unit scheme offering a range of green credentials from solar PV panels and EV charging points to target EPC ratings of B.

Construction of a 14,690 sq ft speculatively built unit at Link Estate, Holton Heath Trading Park, Poole has completed. Vail Williams are also due to launch a new scheme at Magna Park, Poole, in 2023, which will deliver c.50,000 sq ft over two units, subject to planning consent.

There is no doubt that there will be choppy waters ahead in 2023, but there will be opportunities to take advantage of in changing market conditions. www.vailwilliams.com

In this month when we recognise all mothers, what better time to talk about ‘Mother Earth’ which is clearly urging us all to act. Nature is suffering. Oceans filling with plastic and turning more acidic. Extreme heat, wildfires, and floods have affected millions of people.

The healthier our ecosystems are, the healthier the planet - and its people. Restoring our damaged ecosystems will help to end poverty, combat climate change, and prevent mass extinction. But we will only succeed if everyone plays a part.

Carbon offset is one way of balancing the emissions of carbon dioxide or other greenhouse gases and is becoming increasingly embraced by businesses. Carbon offset schemes allow individuals and companies to invest in environmental projects around the world to balance out their own carbon footprints.

Dorset Chamber recognises the impact businesses can have and are working in partnership with Dorset Council and BCP Council, to create an online free event to introduce carbon offset as part of our ESG programme for Dorset businesses. During the event, we will talk through the concept of carbon reduction and provide information on practical steps businesses can take in reducing their impact on the environment through carbon offset. We will also offer the opportunity for a Q and A discussion, and signposting to further support available.

So, in this special month for Mothers, let’s think about ‘Mother Earth’ and remind ourselves more than ever that we need to make a shift that works for both people and the planet.

An Introduction to Carbon Offset online event takes place on 9 March and is open to all Dorset businesses - Booking is essential.

Just under 40 individuals attended the session at Vitality Stadium in what was week three of the Kickstart programme. Sponsored by Vitality and supported by iPro, Cherries Kickstart is a wellbeing scheme for those of all abilities to get fit at the start of 2023.

The five-week programme aimed to help all participants complete a 5k parkrun on Saturday 11 February around Kings Park, as well as giving individuals the opportunity to meet others in the local community.

Week three’s theme centred around musculoskeletal health and staying injury-free, with Dembele on hand to partake in a question-and-answer session to offer his advice.

Holly Humphreys, Amber Treweek and Kaitlyn Elliott from the club’s women’s team were also in attendance and even joined in with the session. Official wellness partners, Vitality, popped in too and enjoyed meeting the dedicated participants.

This month, Dorset Chamber’s chief executive, Ian Girling, chatted with Malcolm Tuck, managing director of ESET UK. ESET UK is part of an award-winning global business providing vital online security for people and businesses. Hello Malcolm. Tell me a little about ESET UK…

As a starting point, one area I am really interested in is the positioning of tech as a force for good. What are your thoughts on this?

Absolutely – tech is an amazing force for good, revolutionising how we live our lives, from communication to collaboration and beyond. But with this newfound convenience comes an increased risk of cyber threats. We leave digital traces of ourselves everywhere. It’s our matchmaker, therapist, teacher, wallet, guardian of our memories… What we think is invisible is, in fact, very much visible sometimes. And if this data falls into the wrong hands, it’s mined into a trillion-dollar-a-year cybercrime industry – making us the commodity.

To embrace the amazing technological process we see today, it’s more important than ever for us to take active steps towards better cybersecurity. As I said before, ESET’s mission is to protect the progress that technology enables.

Cybercrime seems to develop at an ever-increasing rate and is becoming increasingly sophisticated. How can we keep up to speed with the latest scams?

The digital world is like a Wild West of online criminal activity, with new and increasingly sophisticated scams developing every single day, as you say. There are so many myths, too

– these hackers aren’t ‘nerds’ in the basement but sophisticated, trained, organised crime groups that operate strategically.

Having a bird’s eye view of your attack surface is crucial, something I really can’t stress enough. Businesses must have visibility. You can’t protect what you don’t know exists. They need to play the long game and look at cybersecurity from a strategic perspective, no matter your sector or budget.

We recently interviewed Europe’s number one ethical hacker Jamie Woodruff, who also happens to be a big advocate of ESET (shameless plug!) and says we need to stop living like analogue clocks in a digital world. This is the mindset business leaders need to take when planning. We need to implement dynamic security strategies to stand against new threats. So how can we encourage businesses to make this a higher priority? So often, this only seems to become a priority once a business has suffered some kind of attack. Sadly, this is all too true, and it’s often a case of too little too late. And it’s not just the financial costs you’re dealing with as a business – how can you pick up the pieces

after your company’s reputation has been damaged? How can you rebuild that trust?

I think having a strong cyber armoury is a competitive advantage in itself; it’s something to be prioritised in the business interest. Any company that seeks longevity needs to be talking about security and proving that protecting their customer’s data is a priority.

As parents and carers, we all worry about the safety and wellbeing of our children online. How can we better protect our children?

It’s no surprise online safety is becoming a growing concern for parents and guardians. Online activity is an enormous part of our lives now, and it’s not much different for kids. So, as a parent myself – I get the frustrations. Though, it’s encouraging to hear the UK government is introducing an online safety bill to bring tighter enforcement of cybersecurity and safety measures in the UK. It’s definitely a step in the right direction for online safety measures overall, which offers peace of mind for individuals and businesses throughout the UK.

We aim to reframe the narrative that technology is dangerous for kids – yes, they may not even consider their security when gaming or answering emails – but it is a pivotal part of their learning. ESET’s CSR initiative, Safer Kids Online, is a free educational resource designed for schools in conjunction with Internet Matters that assists parents and children and provides learning materials about staying safe online.   www.eset.com

Leading law firm backs Dorset Business Festival

Dorset Chamber has joined forces with leading law firm Lester Aldridge as more details of a major business festival are unveiled.

The Dorset Business Festival – the first event of its kind in the chamber’s 74year history – is being held from 10-12 October. Delegates from across the region are expected to attend the threeday extravaganza, which will include a conference, expo and the long-awaited return of the Dorset Business Awards.

Lester Aldridge has pledged its support as Premier Festival Partner for the summit at the Hilton Hotel in Bournemouth town centre.

Dorset Chamber chief executive Ian Girling said: “We are thrilled to welcome Lester Aldridge as our Premier Festival Partner for the Dorset Business Festival.

College submits redevelopment plans

Bournemouth & Poole College is due to submit a planning application to BCP Council seeking approval to transform its Lansdowne campus into a learning environment suitable for the next 25 years.

The plans seek to deliver some of the highest-quality education facilities in the country, following investment from the government’s FE Capital Transformation Fund.

The Department for Education (DfE) funding will be used to improve much of the Lansdowne campus educational facilities, providing increased opportunities for future learners, while fitting in with the historic landmark Clock Tower building.

Phil Sayles, principal of Bournemouth & Poole College, said: “We are delighted to have been awarded government funding, which will future-proof our facilities for future generations. The proposals for Lansdowne campus include best-in-class facilities, enabling students to develop the most indemand skills in BCP and beyond, including media, cyber security, visitor economy, and hospitality. Our plans to upgrade the campus are a critical part of keeping BCP on the map as a prosperous, forward-looking economic hub, delivering a bright future for businesses and workers.”

Blue Sky transfers 100% ownership to employees

Blue Sky Financial Planning Ltd, a Dorset Chamber premier business partner, is pleased to announce that, as of the end of its financial year December 2022, 100% of its shareholding has been transferred to an Employee Ownership Trust (EOT) for the benefit of employees.

The EOT legislation was introduced in the UK in 2014 and was established to encourage more shareholders to establish a corporate structure similar to the John Lewis model. The aim is to facilitate wider employee ownership but less than 2,000 companies have embraced an EOT across all sectors since the legislation was introduced. However, numbers are growing rapidly and Blue Sky is delighted to be amongst them.

Blue Sky’s eligible employees now indirectly own 100% of the business and collectively, are beneficiaries of the trust, receiving financial benefits that ordinarily would be given to shareholders.

Gary Neild, the founder and CEO of Blue Sky said: “It seemed poignant in our

twentieth year of development to make such a progressive and dynamic change. Myself and the team are delighted.”

What was the rationale for choosing an EOT?

As part of his diligence, Gary spoke to a number of potential suitors who were interested in buying the company but the exercise, over a three to four year period, merely reinforced to him what he always believed. Gary said: “Any succession plan had to protect our legacy and continue to support our ethos and culture. It had to provide continuity for both clients and the Blue Sky team.

“It’s always been a privilege to look after clients’ money but our approach is so much more than just looking after assets. We are financial planners. We are coaches, mentors and educators. Our approach is very much focused on enabling our clients to live the most fulfilling life possible. To enjoy their money whilst they have good health, in the knowledge they will never run out of money.”

Why transfer 100%?

Consideration was given to a partial transfer of ownership, but it was felt by Gary that if there was conviction for engaging with an EOT, then why not embrace the concept in its entirety.

Routes to Roots, a local charity dedicated to supporting rough sleepers, vulnerably housed and newly housed – formerly homeless –adults in Poole, has served more than 4,540 meals to those in need since the Genesis Centre on Hill Street opened its doors in March last year.

The charity acquired a Baptist church, now known as the Genesis Centre, in 2020, using a £150,000 interest-free loan given by Talbot Village Trust, a grant-giving charity that supports worthy causes across south east Dorset, and is only repayable if the building is sold. Two subsequent grants from the trust, totalling £60,000, enabled Routes to Roots to complete the first phase of the centre’s renovations ahead of the opening last year.

Kate Mellor, chair of trustees at Routes to Roots, said: “Routes to Roots is very grateful to the Talbot Village Trust for its support in getting the Genesis Centre up and running. Without the trust’s funding, we would have really struggled. The impact on homelessness

services in Poole has been immensely beneficial due to the trust’s help. We hope that the building’s use will grow over time as other services come into the building to benefit local people who are struggling.”

Nicholas Ashley-Cooper, chairman of Talbot Village Trust, said: “As the only support for the vulnerably housed and homeless people in Poole, we felt it was imperative to support Routes to Roots with the refurbishment of the centre to help the charity to provide fundamental care to those who need it most. The charity has shown immense dedication to its cause since 2002. Not only does this service help hundreds of people directly, but the wider community has also been able to benefit through volunteering opportunities. Raising awareness of the charity is crucial so that the local community can appropriately direct those in need to a safe place for care and support.”

Ferndown Community Support celebrates successful year

Ferndown Community Support (FCS), provides community support, the Food Bank+, and Community Larder in Ferndown and beyond. With its army of 180 active volunteers, it is able to support the more vulnerable people in society and bring fun and happiness through events.

Throughout 2022, FCS has continued to support residents who need help with shopping and prescription delivery. This is a vital part of its work and of keeping residents happy, as healthy as possible and indeed out of services and hospitals.

Hannah Hobbs-Chell, CEO of FCS, said: “The fact that the more frail, or carers who can’t get out, can use us to get them the essentials they need to live, means they are not risking falls and ill health by going out, and they can stay in their own home instead of a care home for much longer. Similarly, carers can feel safe in the

knowledge that they don’t need to rush and risk their loved ones’ health by going out.

“FCS’s first ever Christmas Fayre raised a fantastic £1,760 for its ‘operation Santa Sacks’. Each Santa Sack not only contains toys and sweet treats, but also useful and practical things such as toiletries, hats, scarves and stationery. We wrap each and every item, even the toothpaste!

“This was our third year of running this project, and each year it grows a little more, encompassing young people from a wider area, and referrals from more agencies. This year we used over 500m of sellotape, and

1km of wrapping paper, with seventeen, eighthour working days used to wrap the items. A big thanks to Vantage Accountants and The Affinity Group for their kind sponsorship and wrapping skills for several hours.

“Our mission was thoroughly and completely exceeded. We delivered 130 sacks to disadvantaged young people in the local area. There were tears of joy and relief from parents and young people, and teachers and staff. What a great result.

And last but by no means least, FCS’s Community Larder and Food Bank+ opened in mid April. “What started as a distant dream has snowballed into a massive and hugely important community resource for all. The number of visits is exceeding 750 per month now, from the whole of East Dorset and parts of BCP,” said Hannah. “ We have been able to add on other support too, including benefits and welfare advice and application support, a baby bank, pet food bank, and data bank so that people can have access to the internet from home for homework, job applications and searches, and so on, to help lift people out of difficult situations.”

Its successful holiday Cooking Clubs continue to go from strength to strength too. The food waste saved as a small part of this project is phenomenal, and means the collective carbon footprint in our local area is markedly reduced.

Hannah added: “Thank you to all the shops, businesses and organisations who help make this possible. With your continued help, 2023 looks bright for FCS, with some amazing projects in the pipeline to grow its offering, including Saturday Brunch Club for families and a new allotment project.”

County’s first secure public cycle hub to open in The Dolphin

The Dolphin has partnered with BCP Council to deliver Dorset’s first secure public cycle storage facility in Poole town centre, opening in March 2023.

Legal & General Investment Management Real Assets (LGIM), the owners of The Dolphin, worked with BCP Council to secure a £30,000 grant from the Department for Transport’s Active Travel Fund to open the modern facility, located in a unit opposite Primark’s entrance.

The Dolphin Cycle Hub is part of BCP Council’s ‘Transforming Travel’ programme to create and promote greener, healthier, betterconnected travel options across the county, particularly for shorter journeys. The ‘Transforming Travel’ programme aims to transform local travel, reduce road congestion and greenhouse gas emissions, improve air quality

and bring economic and health benefits across the conurbation.

LGIM, in partnership with BCP Council, identified a need for a secure public cycle storage hub within Poole to encourage people to cycle when visiting the town. The Dolphin was chosen as the ideal location for the brand-new facility due to its high footfall from local residents, shoppers, employees, and commuters who use both the bus and train station for onward travel.

Cycle parking platform Spokesafe has been appointed to bring its innovative cycle hub model to The Dolphin. The unit will include secure parking for up to 34 bikes, scooters, cargo bikes and nonstandard cycles safely, providing 24-hour access for members. www.dolphinshoppingcentre. co.uk

Family brewer, Hall & Woodhouse, announced the successful recipients of more than 35 grants totalling £50,000 for worthy causes across the south at its annual Community Chest Awards.

Charities and community groups located in key regions within Hall & Woodhouse’s managed house estate across south England, from Dorset to Devon, have benefited from the annual fund.

Encouraging over 50s back to work

Over 90% of the 3000 children attending Tops Day Nurseries attend part time. Records show that grandparents and extended family often look after their children for the remaining days/hours needed while parents work, or parents work at the same time as childcare. This is largely because parents do not have the money to pay for all their childcare.

The government has recently announced its plan to encourage over 50s back to work. One option for grandparents, which coincides with the government idea, is that they could be trained in early years education and work in early years settings if they have enjoyed working with young children.

Cheryl Hadland, managing director of Tops Day Nurseries commented: “To my

understanding the Treasury cannot take factors like extra income into consideration as the impact is not a specific figure, they cannot work out the extra tax income that would come in against the cost of investing in childcare. If I understood correctly, then this makes no sense to me as an entrepreneur.  You have to take risks to grow.  We believe more children will be able to attend early years education and childcare if the fees are dropped, and in turn parents and grandparents will be able to work or work more. There is plenty of evidence that good quality childcare prepares children for school and for life where they earn more, are happier, and achieve more.”

with Peter Harding Watch out for unexpected tax traps

Dorset financial expert, Peter Harding, says the UK’s tax system is famously complex. It means that, for many people, tax represents much more of a threat than an opportunity, with pitfalls at every turn.

From investing in a way that incurs much more tax than is necessary to making pension-income decisions without being aware of potentially expensive tax implications, even the most financially savvy among us can fall foul of the UK’s many tax rules and regulations.

The full list of errors to avoid and opportunities that shouldn’t be missed is a long one. But here are just some of the most common and costly tax traps to look out for.

Forgetting to share the load – Most tax allowances, exemptions and tax-efficient investment opportunities are available to each person in a couple. For example, if only one person in a couple has used up their ISA allowance for the current tax year, they can gift some money to their partner who has some or all of their allowance left. The same approach can be taken to each person’s annual Capital Gains Tax (CGT) allowance.

Leaving it to the last minute – Many of us are in the habit of paying attention to our allowances only at the start and/or end of each tax year. This can mean it may be too late to use them, especially Income Tax allowances and exemptions that can’t be carried forward.

Joining the tax-free cash rush – A common mistake among those reaching retirement and accessing their pension is to take all their tax-free cash in one go. It can be used as income in most Defined Contribution (DC) pension schemes to help reduce the Income Tax paid each year, so if you don’t need the lump sum to pay off something, then don’t take it all out. Also, if taken out and not spent, it can increase your Inheritance Tax (IHT) liability.

“As a chamber, we’ve been keen to do more to support our future business leaders, our next generation, in terms of supporting their personal and career development. Mazars also raised this as an area they are very keen to support and, following discussions, we were delighted to hold the first meeting of our Future Leaders Forum on 26 January at the Mazars office in Poole.

“Our Future Leaders Forum is a new network for our next generation of leaders, younger people in the early stages of their career where they can come together to network, learn from each other, and develop their skills as they look forwards in their career.

“Around sixty people aged under thirty from a wide range of businesses attended the event and, I have to say, the room was absolutely buzzing with conversation. I outlined our ongoing ambition to be a modern, relevant and inclusive chamber – that is very much in touch and engaged with our next generation. This message was well-received and we had a lively and positive discussion about the support people attending the forum would welcome. This included areas such as networking skills, hearing from inspiring business leaders, development of soft and interpersonal skills and the opportunity to discuss key issues such

as sustainability within business. We’ll also be introducing wellbeing activities such as our walks in nature, which have become incredibly popular, as well as some social events. Mazars have very kindly agreed to sponsor and become the regular home for future events although we would very much like to visit other businesses as well.

“I was absolutely thrilled with the response and enthusiasm from the forum from all who attended. Our original plan was to form a committee to oversee and direct future activities for the forum; however, with thirty people putting themselves forward for the committee and our aim to be fully inclusive, forward events and activities will now be discussed at the main events so everyone has an input into the forum. We are also very keen that we have younger representation on our board and will be seeking to appoint someone from the forum as a Dorset Chamber board member.

As with many categories of personal protective equipment, foot protection can too often be approached the wrong way. Wearing the right safety footwear can limit musculoskeletal disorders (MSD), which account for 24% of lost working days. So, don’t go by brand alone. Instead, prioritise footwear that has the design features engineered for safety. You should only buy footwear from a trusted BSIF accredited supplier, so you know it meets all the necessary EN standards.

Employers should also have one of each size and style available to try on. This will give everyone a chance to find the most comfortable fit, instead of just picking ‘their size’. Dorset Neon Run back at Poole Park

Diverse Abilities, Dorset’s disability charity, has announced that its Dorset Neon Run is returning to Poole Park on Saturday, 22 April.

The Dorset Neon Run is a fivekilometre evening fun run for participants to run, walk, dance, or jog around during the colourful fundraiser. Entertainment will come from HOT Radio on the night, as well as a fun Clubbercise warm-up.

Lucy Rowley, events fundraising officer at Diverse Abilities, commented: “Dorset Neon Run is a really fun event and as it isn’t time chipped allows participants to run, jog, walk, or dance at their own pace. It’s a great excuse to dress up in neon gear and face paint, while having a laugh with your mates. If you’d like help to prepare, you can join our Facebook group where we will guide you through Couch to 5K.”

Macro Blues & Micro Bounce? legal

Business activity in the southern regional economies has been in decline since August. Although SW England still has the lowest UK unemployment rate (ONS 2.1%, three months to November), the highest employment rate (79.3%) and the lowest inactivity rate (18.9%), the latest regional survey (from Nat West/S&P) shows SW orders, employment and exports falling through to the end of 2022.

As interest rates climb and real incomes slide, creditors and debtors are tightening their belts. The housing market is sagging. Over the festive season, retail sales volumes were fair, but the lack of consumer confidence (lowest readings on record) does not augur well for activity in early 2023, especially with household savings ratios being under pressure from the cost-of-living crisis. Will precautionary savings pick up now? For the long term, this would be good – making funds potentially available for productivity enhancing investment. In the short term, however, it might take spending out of current demand. This should be part of a necessary adjustment to relieve the stagflation economy, but it would not be pleasant for businesses and markets right now.

The official inflation measures are still high (CPI 10.5%, CPIH 9.2%) in the year to December, but there are tentative signs of some price pressures easing, with the world wholesale gas price back to pre-Putin levels.

Are we at a turning point or just a pause? Much depends on three elements: domestically, on how the myriad labour cost disputes resolve; internationally, on how the Ukrainian war evolves; and financially, on how further tightening of monetary policies by the central banks is paced and scaled. Meanwhile, as well as energy prices dropping, other commodity and shipping costs may be easing towards lower inflation but beware a Russian spring offensive. Food prices continue to accelerate, (reaching +16.9% year-on-year to December). Overall, ‘core’ inflation may be starting to soften, albeit slowly, from the recent peak.

Against this background, January’s keynote speech by Chancellor Jeremy Hunt set out the government’s plans to boost economic growth. The Chancellor identified “four Es” (enterprise, education, employment and ‘everywhere’) as agendas in need of improvement if we are to address poor UK productivity, skills gaps and low business investment. Hunt spoke of opportunities to use the regulatory freedoms of Brexit to boost sectors including technology, life sciences, clean energy, creative industries and advanced manufacturing. He talked of lower taxes in the medium to long term and the need to address structural labour shortages. The Chancellor did not ease, however, the general concern about the UK’s absolute and

relative economic performance. Afterwards, business representatives, from CBI and FSB alike, criticised the lack of policy detail in the speech. Many hope that March’s budget will provide important details for action to quell inflation and yet support growth: no mean feat.

On 2 February, the Bank of England raised base rates to 4%. The UK’s ‘stagflation’ problem remains and further increases in interest costs are possible, despite, (indeed, to ensure), the recession risk. IMF Forecasters are predicting a UK recession – (the only major economy predicted to experience negative growth in 2023). This prospect reflects the country’s relatively high exposure to dissonance in its supply chains and workforce flows.

With respect to labour, there is clear demand for two broad types of skills. First, there are those skills which are commonly required across places, sectors and occupations. These include a range of basic digital, services and, perhaps, green competences which nearly all workers will need to demonstrate to employers: abilities in using foundational and advanced software and awareness of relevant drivers of energy and material sustainability. Second, there are the specialised skills needed in specific industries or for key functions. These include parts of finance, manufacturing and/or certain services where innovation drives overall growth and business and personal success. Areas such as AI, automation and energy/ climate substitution are part of this category.

In its current cycle, the UK economy is a low productivity enterprise with weak competitiveness. A recent FT column has listed the following areas as those holding back the UK economy: disruptive tax and regulation systems; poor management and planning; weak educational performance, inadequate skills and inequality; trade barriers and low investment; skewed business finance and regional disparities; short termism, imbalanced innovation and disjointed politics.

That’s quite an agenda of areas needing improvement in the years to come. It took at least a decade and a half to get into the present situation. The task, to lift the structural macro blues and build on any tactical micro bounce, starts now. www.bournemouth.ac.uk

Many of you will have heard in the news about Elon Musk, having bought Twitter, making many of the company’s workers redundant. Now

43 ex-employees of the company are looking to take Twitter to an employment tribunal for unfair dismissal. The company failed to consult with employee representatives for the minimum 45 days, having proposed to make at least 100 employees redundant. In addition, Twitter failed to provide adequate reasons for the dismissals and, practically, suspended them from their jobs, with no contractual right to do so.

If the allegations prove to be correct, Twitter was in breach of the Trade Union and Labour Relations (Consolidation) Act 1992. This legislation obliges employers to carry out collective consultation with employee representatives when making large scale redundancies.

Twitter is also potentially liable for unfair dismissal claims by each of the ex-employees, if they can show either the redundancy was a sham or individual consultation with employees was not carried out.

If the matter goes to an employment tribunal and the ex-employees succeed, they could each receive a protective award of 90 days’ pay, plus loss of earnings of up to a year’s pay, if they are unable to obtain new employment.

Twitter can, even if they did not go through a proper procedure, argue that it wouldn’t have made a difference and that the employees would have been made redundant regardless. Any loss of earnings claim would therefore be low value. It is quite likely many, if not all, of the ex-employees will be offered settlements not to continue with legal proceedings.

This story is an important reminder to employers about the potential cost, both financial and in reputation, that failing to follow a fair redundancy procedure can bring. If you would like advice on a redundancy situation, please contact me below.

R&D tax credit claims under closer scrutiny

Research and development (R&D) tax credits are intended to incentivise investment in innovation, and we have helped many businesses in Dorset to access this support.

HM Revenue & Customs (HMRC) has recently ramped up its audit activity and, like other firms, we have received more R&D enquiries in the last three months alone than in the last decade. Currently most of these enquiries relate to claims with qualifying expenditure of under £50,000, though we anticipate attention will eventually turn to larger claims.

The challenge for HMRC is that promoters of dubious claims continue to play an active role in the marketplace. Chamber members should therefore undertake due diligence on any prospective adviser in this area before proceeding.

From April 2023, there will be significant changes to the rates within the R&D regime. Companies making claims should ensure they factor these changing rates into any longer term forecasting exercise so there are no nasty surprises.

The Treasury is currently consulting on simplifying R&D tax reliefs by merging the existing schemes for small and mediumsized enterprises and large businesses. It is also considering whether to introduce different levels of tax relief based on industry sectors. If implemented, the new scheme is expected to be in place from April 2024.

We strongly recommend that businesses considering making R&D claims ensure their submissions are carefully thought through, with a suitable amount of disclosure. Claims with little or no supporting information are now almost certain to be picked for HMRC audit, even if the sums of tax involved appear to be low.

The employer’s responsibility for the working spacewhat has changed?

During the pandemic and since the world of work has entered the hybrid working era, employers have found their teams working in weird and wonderful locations. However, employers should note that whilst staff are working away from the office, it remains their legal duty to ensure that employees have a safe working environment. Even a location as mundane as the kitchen table poses risks. For example, a chair unsuitable for long periods or an uncomfortable height difference from the table could lead to injuries over time. Employers should provide a risk assessment for their staff to determine the suitability of their workspace and equipment. Consideration should be given to issues such as whether there’s sufficient lighting, the suitability of computer equipment (mainly if not provided by the employer) and the ergonomic features of the workstation.

The next time you’re on a Zoom call with your staff, take a moment to think about the suitability of their working environment. And consider whether you’ve got a risk assessment on file to mitigate any liability you might face for that RSI injury sustained from typing on a laptop balanced on a compost bag in their garden shed.

A commitment has been made by the UK to meet Net Zero targets by 2050. To do this, it is expected many will need training to implement and manage Net Zero targets and green/ climate change goals in the next 2-3 years. Understanding the details of what is needed will help providers plan courses to meet this emerging demand. What skills do you need for your business to be carbon neutral?

This will help to ensure the changing skills needs across the region are understood and relevant opportunities are provided to upskill the current workforce and prepare young people to meet emerging and new workplace needs.

This is known as the Dorset Local Skills Improvement Plan (Dorset LSIP).

During the last two months, the Dorset LSIP team has been reaching out to hundreds of businesses of all sizes across Dorset, inviting managers, leaders, and HR professionals to complete a short online survey or take part in a telephone interview. Insights and findings generated through this process will be shared in an action plan to develop post-16 technical education provision in Dorset, working with our Colleges, independent training providers, employers and learners.

As part of the Dorset Local Skills Improvement Plan (Dorset LSIP), five sectors have been identified within the region as high need, growing and innovating.

These have been selected by a panel made up of local government, training providers and employer groups. They will be the focus of the change plan after the research gathering.

The focus sectors are:

• Land and water-based industries: Agriculture, Agri-tech and Aquaculture

• Advance Manufacturing and Engineering including Aerospace, Defence and Marine

• Construction

• Digital Tech and Creative

• Health and Social Care
