The farm is closing to the public Oct. 31 after selling produce for more than 60 years SIMON MARTIN smartin@yrmg.com

ilbert Whittamore wanted to grow strawberries. He had a bought a 50-acre farm on Steeles Avenue in 1952 with his wife Evelyn, and by 1957, he had a pretty good strawberry crop. The only problem was the weather conspired against him. A big rain came the July 1 weekend. "We couldn’t commercially pick the strawberries anymore," he said. While many of the berries were damaged there were still some that were in decent shape. Whittamore didn’t want to see them go to waste, so he put a sign up on the road: pickyour-own strawberries. A number of people saw the sign and came to take part. "We did a pretty good salvage job," he said. The next year, conditions weren’t ideal again. "It wasn’t wet. It was dry. The patch dried up after one picking," he said. There were still some nice berries to be had here and there so he put the sign up again and raised the price slightly. Again, a good number of people stopped to harvest the crop themselves. "There was this one lady that was quite happy to chat with me," he said. "She said, ’Gee this has been fun. You should do it every year.’" That advice stuck with Whittamore and by 1959 he was selling strawberries to the public. Fast-forward 58 years and Whittamore’s is the preeminent entertainment farm in the GTA. That’s why it came as a shock to the community when the family announced 2017 would be the

last year the farm would open to the public. The Whittamores will continue to own and farm the land, but the farm shop, Fun Farm Yard, pick-your-own and Pumpkinland facilities will no longer be operational. On a sunny October weekday, the parking lot was jammed with school buses and cars as

people made one last visit to the farm. Andrea, of Stouffvile, remembers coming with her mom 50 years ago to pick strawberries. "I made a point of coming before it closes," she said. A multi-generational customer is the norm at Whittamore’s. People like Norman and Marga-

ret Hughes have been coming to the farm for more than 20 years. "We’re sorry to see them go," Norman said. "It’s good crops. Very fresh with good service." Margaret once made her own , chili sauce and rhubarb jam. But now she comes to Whittamore’s to get her fix. It’s much the same story for Helen McCubbin and Joanne Cleator, who made the trip from Scarborough. "We try to make it twice a year," McCubbin said of 20 years of visiting the farm. Dressed in blue jeans, a Whittamore’s T-shirt and sunglasses, Frank Whittamore was busy fixing a driveway on the farm as customers poured in. In less than a week, Frank, wife Suzanne and brother Mike Whittamore will encounter a new reality-a bittersweet one for the family. "We had amazing customers,"

Frank said. But at the same time the business is a grind; it’s basically a 24/7 job during the season, he said. With no next generation waiting in the wings to take over, Frank said the family had to make a decision and it is one they are comfortable with. Mike said he will continue to farm the land but will change some of the crops. Encased in the Rouge Park, the farm looks to be spared from imminent development. Frank started the shop on Steeles in the late 1980s - an evolution of a roadside stand. As the business grew, the Whittamores employed thousands of people over the years. Maybe none longer than Lillian Igel, who started working at the farm as university student in 1992 and never left. "It’s been a true privilege to work for this family. They are very special people," she said. When she first started working there were six girls, now there is up to 65 employees depending on the time of year. She says the farm helps fill a desire people have for getting back to the basics. hat environment that so many people have come to enjoy is a testament to the owners, she said. "They are unsung heroes of the community," she said. Across the road, Dale Reesor was out combining soybeans in his John Deere. He grew up with the Whittamore boys when Steeles was a gravel road. "I remember the strawberries," he said. "They were pioneers for doing pick-your-own." Reesor, who has his own sweet corn stand on Steeles and in various locations Scarborough, describes Whittamore’s as the original buy local in the area. He can remember the cars parked down the road on Steeles on Canada Day to pick strawberries. "It got crazy busy," he said. "It will certainly be different without them."

Good riddance to employee discount tax idea Hopefully, by now, employees in Canada’s retail sector - or what remains of it, at least - can breathe a little easier knowing the Canada Revenue Agency isn’t poised to take aim at the discounts they receive from their employers. Such incentives, which range from the meagre - a small percentage off the retail price of a given item, for example - to the generous - such as being able to buy merchandise at the employer’s cost - are commonplace in the customer service industry and serve as something of an enticement for would-be employees in a sector where a great many of the front-line staff members are paid minimum wage. Given that, it seemed the CRA was effectively talking about flipping retail workers upside down and shaking them by the ankles until their loose change fell out. The controversy began earlier this month when a 2016 update to CRA documents, stating that employees who receive a discount on the price of merchandise owing to their employment should have the value of said discount included in their income, was thrust in the spotlight via a Globe and Mail story. The policy went on to say the value of the benefit should be calculated as the difference between the retail price of the item less the amount the employee paid. No amount would be included in the event the same discount was offered to members of the public in some manner. Business groups, some of whom had decried the notion when it first came up but whose objections largely went unnoticed, argued it would be a nightmare to track their employees’ discounts, while other stakeholders voiced concern that employment incentives could be scrapped altogether by companies simply to avoid the aggravation. Despite a Liberal MP initially suggesting that any employee discount not offered to the public at some point would be fair game under the new rules, the federal government quickly distanced itself from the policy, expressing "disappointment" in CRA bureaucrats, and prompted Prime Minister Justin Trudeau to tweet assurances to retail workers that their discounts weren’t in the crosshairs. The government, in consultation with industry stakeholders, will now go back and review the policy and craft a new response to the 2011 court ruling that triggered the update in the first place. In any case, after the PR mess, it’s safe to say the idea of taxing retail employee discounts won’t soon be resurrected, and that’s a good thing. It was a wrong-headed idea that unfairly targeted workers in a sector primarily comprised of people at the lower end of the income spectrum.

• LETTERS & COMMENTARY • Pavement not solution for market’s parking issues Re: Opposition explodes to Unionville farmers market parking lot plan, Sept. 13. On Sunday, Sept. 24 it became very obvious how important the trees and grass were to the Historic Stiver Mill property. With temperatures hovering in the mid-30s (95 degrees) vendors and market patrons alike were most thankful for the coolness that trees and grasses provided. Mayor Frank Scarpitti is totally aware of this fact, having gone through a heat wave at the Stiver Mill during the Grand Opening in June 2014. Cutting down 65 trees and paving over the Histor-

ic Stiver Mill property will only destroy the current Stiver Mill Farmers Market. The Unionville Stiver Mill Farmers Market is a very special community space. It’s not just a place to buy locally grown vegetables and fruits. It’s a meeting place where neighbours get a chance to visit and socialize. Just ask the seniors who live in the area. The Historic Stiver Mill property has had a new life now for the past eight years. Many thousands of dollars and hundreds of volunteer hours have been freely given to create the park like setting that it is today. Unionville will never solve its parking problems by covering over all its green spaces with pavement.

Even Deputy Mayor Jack Heath doesn’t agree with paving over the Historic Stiver Mill property. Mr. Heath identified the property ground already appears hard enough and doesn’t require pavement. Had the market property been paved, the site would have been unbearable an unfit for human use. Market volunteers and patrons are becoming more than a little dismayed at the lack of support and response from Markham’s city councillors. When it comes time for photo opportunities at grand openings, you can guarantee their attendance. To date only Coun. Nirmala Armstrong has signed our petition to Save Unionville’s Historic Stiver Mill property.

Dr. Helena Jaczek has been nominated to run for the Liberals for re-election in the newly-formed riding of Markham-Stouffville for the June 2018 provincial election. Jaczek, first elected MPP in Oak Ridges-Markham in October 2007, was re-elected in October 2011 and June 2014. These are one of the items we occasionally make and sell at the meat department, and it came up in one of our staff meetings how we’d never featured them, so we gave it a go this summer and it was a wild success. I took one home and loved it, as did many of our customers, but perhaps nobody enjoyed it as much as our bakery manager, Andrea. In fact, I don’t think I can accurately summarize her feelings, so I’ll just copy her text: “I just read the ad and I just tried smoked chicken for the first time. I made it in a sandwich: Portuguese kaiser with spicy cherry red pepper jelly, grilled artichokes, smoked chicken and melty brie…I don’t want to tell you how good this sandwich makes me feel. You realize there is now even less of a chance I will ever be a size four. A lot of reason behind that is that once we find quality, we buy it and don’t flinch over the price. I think the avocados we sell are the perfect example of that. WILLS AND POWERS OF ATTORNEY FREQUENTLY ASKED QUESTIONS

The Wills Lawyer Over the last year, I have been writing about the importance of Wills and Powers of Attorney. I have tried to provide some insight into this very complicated area of the law. It is a topic that most people would rather not think about but realize they must, in order to protect their family. Many people have called me with questions, and I would like to share some of these questions with you. 1. Q. If I have a Will, why do I need to make a Power of Attorney for Property? A. It is important to realize that your Will only takes effect after you pass away. It has no relevance during your lifetime. Only a Power of Attorney for finances will protect you, in the event you are unable to manage your financial affairs due to accident or illness. The executor you name in your Will cannot help you, if you are ill and unable to manage your financial affairs. The executor’s role only takes effect once you pass away. 2. Q. I have a Will naming my brother as executor. Michelle Kotzer Now that my son is in his twenties I want to appoint him as my executor. Can’t I just scratch off my brother’s name and write my son’s name in? A. I do not recommend scratching any part of your Will. It would be prudent to see a lawyer about drafting a Codicil to your Will. If it is a minor change such as the name of an executor, a Codicil would revoke the appointment of your brother and appoint your son as your executor. It would also preserve the other existing clauses in your Will. If you want to make major changes to your Will, it is recommended that you make a new Will rather than a Codicil. 3. Q. My spouse and I cannot agree on whom to appoint as guardian for our minor children. Can’t we just leave this out of our Wills and let our families work it out after we pass? A. Appointing a guardian in your Will is an extremely important decision. If you do not appoint a guardian, you could have your parents fighting against your spouse’s parents over who is best to raise your children. This is not a good formula for family harmony. 4. Q. I have a son who is collecting benefits from the Ontario Disability Support Program from the Ontario Government (ODSP). I want to leave him my estate. How does his collecting ODSP benefits impact my Will? A. If you leave your child your estate as an outright distribution, this will most likely mean that he will be cut off his ODSP benefits. Setting up a Henson Trust for your son in your Will will mean that you are protecting his ODSP benefits, after you pass away. 5.Q. How often should a Will be reviewed? A. A Will should be a living breathing document. It should be reviewed on an ongoing basis to make sure it reflects your current life situation. If you are married, be aware that any Will you made before your marriage is revoked, subject to some technical exceptions. If you have separated since you made your Will, remember that under Ontario law, you are still considered married and if your Will refers to your spouse as the beneficiary of your estate, that spouse is the person you are separated from. He or she will inherit your estate according to your Will. If your previous Will made reference to your two children, but since that time you have two additional children, the additional children will not inherit from your Will. The same applies for grandchildren. If your Will leaves your son your house on Yonge Street but you have moved to a house on John Street, your son will not get that house on John Street. In my wills practice, I offer the public a free Will review. This means that you can make an appointment with me for me to look at your Will to see if it is up to date or a recipe for a family fight. I have found many problems in Wills that I have reviewed. Firstly, many of the Wills I have reviewed left assets that no longer exist or assets were left to people who have passed away with no back up beneficiary. I have reviewed Wills that were invalid because they were either not signed, not witnessed or signed and witnessed on different dates. Many of the Wills I have reviewed had no back up executor or back up beneficiaries in case the primary beneficiaries are not alive. If you are not sure if your Will is up to date, please feel free to give my office a call and set up an appointment for a free Will review. 6. Q. If I want to make a Will with you, what is involved? A. If you want to make a Will with me, generally there will be two appointments necessary. The first appointment will be for me to sit down with you, discuss your life situation, discuss your assets and draw up a Will plan for you. After the initial meeting, we will set up a time for the signing of your Will. At the signing appointment, I will go through the Will clause by clause with you. I will make sure that the Will reflects your wishes and that you understand each clause of the Will. If you have also made Powers of Attorney for Personal Care and Property, I will do the same clause by clause. If you are satisfied that the Will reflects your wishes, you will then sign the Will and/or Powers of Attorney in front of myself and my assistant. You will take the original Will home with you and I will keep a copy in a file in our office. If you do not have a Will and are not sure where to start, I offer a free Will consultation. You can make an appointment with my office and we can talk about a Will tailored to your particular life situation. My office is at 7951 Yonge Street in a turn of the century home. The atmosphere is relaxed and friendly. I understand that to many people the process of making a Will is intimidating. I also know that making a Will is one of the most important things a person can do to protect his or her family. Aviva Canada celebrated its new office at its location in downtown Markham as up to 1,800 employees got to enjoy popcorn, ice cream and the chance to take a test drive in one of a handful of brand new Tesla cars. The Tesla Owners Club was also on hand to show off their half-dozen models and allow employees to sit

in and admire the electric cars which have their trunk space where the engines would be in traditional automobiles. The Aviva-Tesla connection comes in with Aviva acting as one of the chief underwriters for Tesla insurance policies. As a result, employees had the chance to win some Tesla goody bags in an impromptu contest. For Aviva executive Jason Storah, the day was an exciting one as he talked about the insurance and financial company’s move to Markham. "We’re really, really proud to be part of this community. But nearly six decades ago, Ram Pillay of Markham was there when such giants as J. Robert Oppenheimer, leader of the Manhattan Project that developed the atomic bomb, were trying to stop nuclear proliferation. Pillay proudly shows a photo he took in the late 1950s of Oppenheimer holding a poster that says "One and a quarter million unborn children will be born dead or have some gross defect because of nuclear bomb testing." The message has added impact coming from the man who once quoted the Bhagavad Gita, "I am become Death: Destroyer of worlds," just before the twin atom bombings of Hiroshima and Nagasaki, Japan, the only time nuclear weapons have ever been used. But Pillay worries it could soon happen again. "Who knows what could happen with these two," Pillay said. The longtime Markham man, 91, has just about seen it all.

Ninety-one-year-old Markham resident Ram Pillay holds a picture of a United Nations meeting in New York which he attended in the late 1950s. Born in South Africa, he escaped the deeply racist apartheid regime in the 1950s. Not before, however, getting his head bashed in during a "peaceful demonstration" - he has the scars to prove it - and taking some punches as a sparring partner for a young, tough slugger named Nelson Mandela. Pillay made his way to New York City to study to

study photography and radiology and applied for status. South Africa wouldn’t release his forms, he said, so he wound up working in the UN for India as a messenger for six years. "I said there was no way, I’m going back to South Africa. My family was there, but I stood up for my rights and one of the Indian diplomats stood up for me," he said.

Roofer madness: Markham woman wakes to find workers ripping up wrong roof Resident turns disaster into deal by getting company to replace her shingles for a song TIM KELLY tkelly@yrmg.com That thumping she heard on her roof Thursday morning wasn’t a raccoon, another animal or even Santa Claus.

No, Markham resident Dora Tam, 58, woke up to find a team of roofers busy dismantling her roof. Tam’s home was mistaken for another nearby and the roofing company simply started working without checking with her first, she said. By the time the confused homeowner confronted the workers they’d ripped plenty of shingles off the roof. But the sharp-negotiat-

ing Tam says she turned a disaster into a deal by talking the company’s president into doing what would have been a $7,000 entire roof job into what she is now paying $2,000 for. "This morning I was so scared, I called animal control, it was banging so loud," Tam said. "But I talked to the company boss. They were supposed to go to the next street. We negotiated, I said I need a new roof, and he said, ’I

will give you a good deal.’" Tam, who had planned on getting her roof done next year anyway, said she’s satisfied with how it all worked out.

York Region District School Board maintains students are safe to drink the water at their schools TERESA LATCHFORD tlatchford@yrmg.com High lead levels were found in the drinking water of 24 York Region schools in 2016. A list released by the Ontario Ministry of the Environment and Climate Change shows the drinking water of more than 640 schools and daycares across the province, including 24 from York Region, tested above what Ontario deems safe lead levels of 10 parts per billion last year. The York Catholic District School Board’s St. Joseph Catholic Elementary School in Richmond Hill tested 12 times

above mandated levels. While Sutton District High School didn’t test as high as the Richmond Hill school, it failed 17 of its 20 tests with results ranging from 46 PPB to 10 PPB from July to September in 2016. "We take action to remediate the problem immediately when exceedances occur," YRDSB environmental safety officer Kori Zsigmond said. "The first step we take is to cut off all access to the water source until it is resolved." Children are safe drinking the water at YRDSB schools, Zsigmond added. If there is any question about water quality, the taps are bagged and sealed to prevent use, bottled water is provided and parents will be notified. According to Health Canada, the toxicity of lead has been extensively documented in humans, based on blood lead levels. The strongest effect of exposure documented is in

tion in adults and adverse neurodevelopmental and behavioural effects in children. While 10 PPB or under is considered acceptable lead levels in drinking wa-

ter across the province, organizations like the World Health Organization warns that any lead exposure is too much. It also points out that children under six years absorb more lead if exposed and any loss of intelligence is irreversible since the human brain is incapable of repairing itself. Health Canada requires schools and daycares test drinking water fountains or cold water taps where water is used for drinking or food preparation at least once per year. Standing and flushed water are tested. The York Region District School Board has an independent vendor responsible for testing the water at all schools annually. If a school’s water exceeds the allowed 10 PPB, it is reported to York Region Public Health, according to Zsigmond. The school board takes direction from public

health and increases flushing, replaces pipes, valves or fixtures or whatever else is found to be the source of the increased lead levels. "I wish there was a defined pattern in what causes lead in the water," Zsigmond said. "It can be any of number of causes so each incident is investigated on a case-by-case basis." If there is a concern, a letter is sent home to parents with information regarding the situation, water alternatives that will be available to students and contact information should they have any questions. Additional water testing is conducted until lead levels are deemed acceptable and access to the water is reinstated. Markham, Vaughan eager to host Amazon l Continued from page 1

the jobs and $5 billion investment that comes with it. A total of 238 cities have sent in bids, the majority of them from the United States. So the GTA bid, which includes sites in Milton, Burlington, Oakville, Mississauga, Brampton, Pickering, Ajax, Toronto as well as Vaughan and Markham, is in tough. Amazon has stated it needs a footprint of up to eight million square feet for its headquarters, limiting the available sites. That’s more than twice the size of the parking lot at Canada’s Wonderland. In Vaughan, the site falls in the Vaughan Metropolitan Centre on lands that were previously targeted for a potential casino. Vaughan has up to 475 developable acres of land while Amazon has stated it needs about 100 acres eventually. Mayor Maurizio Bevilac-

qua said Vaughan is ready to welcome Amazon. "The bid by Toronto Global clearly demonstrates that Vaughan is the place to be. We have a broad view of the world and endless opportunities to take our city to the next level. As a growing city we take pride in our ability to attract investment," the mayor said. "The Vaughan Metropolitan Centre is about creating a unique experience where people can live, work and play, all within the same city core." In Markham, the land pegged for Amazon’s headquarters would lie just east of current developments, north of the 407 and south of Enterprise Road. Markham’s site is 55 acres, or six to eight million square feet, which is more than adequate for Amazon’s needs, Mayor Frank Scarpitti said. “It is a human friendly environment, where we’re going to have shops, the Pan Am Centre is located there,

a five-star hotel is opening up later this year, and of course the addition of the new campus of York University, make it an ideal situation along with the 15-minute transit service that GO is providing to the site,” he said. York Region Chairman Wayne Emmerson touts York Region in the bid by highlighting its high-tech workforce and its focus on technology, a natural fit for Amazon. "York Region has the highest concentration of technology companies in the country and is already a top Canadian headquarter location for global companies such as IBM, AMD, Huawei, Honda, Toshiba, J&J, BMW, Allstate and Adidas. As Ontario’s fastestgrowing large municipality, we are committed to creating world-class communities that attract and retain top global talent," he said. There is no firm date for when the company will announce the winning bid.

RAHUL GUPTA rgupta@insidetoronto.com The Ontario government has formally handed back 1,600 acres of land to Parks Canada for use in the redevelopment of the Rouge Valley National Urban Park. The handover ends years of acrimony between the province and Ottawa dating back to the Harper government, which effectively split Rouge Park into separate fiefdoms separately managed by the clashing governments. A resolution was reached back in June and both sides stated their intention to ensure ecological protections and unify the park lands. On Saturday, representatives from the two governments announced the land transfer is complete. "The transfer of lands will allow Parks Canada to complete (Rouge Valley National Urban Park) and means people will be able to continue enjoying its

Allowing farming to take place on the federally managed parklands was a key reason attributed to the standoff, with environmental watchdogs voicing concern leasing those lands for agriculture puts

The agreement still allows for farming, leading some environmental advocates to criticize the agreement for not doing enough to safeguard conservation. However Anna Baggio, of the Canadian Parks and Wilderness Society (CPAWS) Wildlands League, said compromise is required to ensure the park is completed as planned. "There are definitely

challenges, but the point is to put nature first," said Baggio, director of conservation planning for the group’s Ontario chapter, who attended the announcement in Scarborough. "It’s important to establish a baseline and work with Parks Canada to improve conditions over time." A federal commitment was urgently required because of the unique nature of placing a wilderness area within a large urban area, said Baggio. Federal protections could potentially mandate road closures or other urban infrastructure if it negatively impacts the park. Completing the urban

park is critical towards satisfying a federal commitment to designate 17 per cent of Canadian land and water protected as conservation areas. Currently the number stands just over 10 per cent, well below the global average of 15 per cent, said Baggio. After the Harper government announced plans for the park back in 2012, the Ontario government refused to hand over its lands without the addition of stronger federal environmental protections, which was dismissed by the federal Conservatives. As a result, the valley portion of the park in Scarborough remained with the province, leaving lands

north into Markham under the jurisdiction of Parks Canada. The 2015 election of Justin Trudeau ensured a potential resolution to the dispute thanks to the shared environmental goals of the two governments, but it wasn’t until June of this year an amendment to the Park Act, guaranteeing "ecological integrity" for the Rouge, received royal assent to become law, easing the way for the transfer of provincial lands. The land transfer now secures 80 per cent of the land allocated towards the Rouge park redevelopment -with files from Mike Adler

Mike Downie Hundreds of people gathered at the Richmond Hill Centre for Performing Arts this past weekend in an emotional tribute to the late musician Gord Downie and to honour the Secret Path story of a 12-year-old Indigenous boy, Chanie Wenjack. Downie, the Tragically Hip frontman who passed away Oct. 17, was an iconic Canadian musician, but he was never really comfortable with what it meant to be a Canadian, his brother Mike Downie told the gathering Oct. 22. Gord did not like the way Canada’s national identity ignores mistreatment of Indigenous populations, instead "gets crunched down into hockey sticks and coffee cups," Mike said to about 600 attendees at a special film screening this past weekend.

It’s why the musician made his famous "call to action" at a concert in Kingston, Mike said, and why he worked to spread the word with the Secret Path project. The Secret Path film pays tribute to Chanie Wenjack, who died after fleeing a residential school in the 1960s, and to the many other residential school kids who never got a chance to share their story. It was an emotional event for many at Sunday’s soldout event. Jeremy Hoyle, who performed acoustic version of Downie’s "The Stranger" immediately following the film screening, described it as "the most emotionally challenging performance I’ve ever done. Right before I walked out (on stage) I saw the image of Chanie at the end of the Secret Path film. Instead of making me sad, it filled me with purpose." Joel Clements, a Richmond Hill resident and organizer of the event, was

brought to tears listening to feedback from attendees and to keynote speaker Dr. Shirley Williams, professor emeritus at Trent University, as she described her own experience at an Indian Residential School. Members of the Wenjak family also took part in the evening, some, like Chanie’s nephew Greg Munroe, traveing from as far away as Pond Inlet, Nunavut. After the event, a vigil was held outside the Yonge Street theatre with candles, a smudging ceremony and Indigenous performances. Proceeds from the event will be split between the Gord Downie & Chanie Wenjack Fund and the Biindigen Healing and Arts, an organization assisting York Region’s Indigenous community. The film, which was screened on the 51st anniversary of Chanie’s death, continues to raise awareness, Mike Downie said, "but the next piece is action. "The big work lies ahead.
