HomeBuilder extension welcomed

IDENT After months of Master Builders’ lobbying, we were delighted to hear that federal Housing Minister Michael Sukkar finally approved the extension, which will give builders 18 months (instead of just six months) to start work on those contracts signed in response to the HomeBuilder grant. needed it most. Treasury statistics reveal that Queensland had the second highest number of applications across the lifetime of the grant, which closed on 31 March, with 26,293 new home buyers and renovators applying out of the total 121,363 applications submitted nationally. The time extension provides us with some much-needed breathing space, in what we’ve labelled a pressure-cooker environment. Even prior to the pandemic hitting, our industry was headed for the proverbial cliff face and faced a dire short and medium-term future if nothing was done. As a direct result of the grant and ultralow interest rates and strong interstate migration, the demand on our industry has been huge, and created the first-class

problems of trade and materials shortages, and rising prices. We know this extra time will take some of the pressure off builders, helping them fulfil their promise to start work for their customers so they are still eligible for the $25,000 or $15,000 grant, depending on when the contract was signed. However, we urge you to use this time sparingly, as prices will keep going up and margins will be under mounting pressure the longer it takes to start construction. However, it is only part of the puzzle and on page 8, our Deputy CEO, Paul Bidwell, explores the issue of trade and material shortages and cost hikes, and what we’re doing to lobby and advocate on behalf of the industry for fair and workable solutions.

WITH THE CURRENT ROUND OF STIMULUS PROVIDING MUCH-NEEDED WORK FOR THE INDUSTRY, IT’S VITAL WE CONTINUE TO USE OUR LOBBYING VOICE TO SPEAK UP ON BEHALF OF THE INDUSTRY FOR SHORT-TERM SOLUTIONS, WHILE STAYING FOCUSED ON ITS LONG-TERM VIABILITY. There’s no doubt the housing stimulus has done the job it was made to do, but we can’t ignore the fact that it has created problems for the industry and homeowners that we are working hard with government to solve. However, while there’s important work to do in the advocacy arena, it’s also imperative we don’t lose sight of the long game. We need to keep building a long-term pipeline of work and stronger future for our industry. That’s why, in addition to our lobbying work, 6 | Master Builder

we have forged ahead with programs like our annual Housing & Construction Awards, and are continuing to promote the importance of engaging a trusted Master Builders member when completing building work in Queensland. Despite the industry being under the pump, we have been urging members not to get caught up in the ‘I’m too busy right now’ mentality and enter their amazing projects from 2020. The reality is, boom times don’t last forever, and our winners will be grateful for the accolades in the future when they are looking for that next job. We’re also investing again in our annual advertising campaign that boosts Master Builders’ respected brand profile, and that of our members.

Some of you may ask why we’re waving the Master Builders flag when the industry is so busy and dealing with trade and materials shortages. In our view, it’s never been more important. We need to remind the community there will always be bumps in the road when building – whatever side of the fence you sit on, builder or homeowner. We’ve been telling the industry and consumers for a long time that the road is a little bit smoother when you’ve got a Master Builder on your side. When you’re a Master Builder, you have our support, and everyone gets a helping hand. Now while building is booming and, in the future when this flurry of activity may wane, we want the community to remember the strength and trust that are synonymous with the Master Builders brand.

Perfect storm shaping up as profitless boom Y CEO

The perfect storm continues to rage and is growing in ferocity - and while the HomeBuilder grant construction commencement timeframe extension was welcome, it doesn’t come close to solving our woes. Huge levels of demand resulting from the HomeBuilder grant and increased insurance work have placed significant pressure on the building supply chain. Members are reporting shortages of building materials and trades across the state, impacting on the progress of building works, as well as driving up costs. 8 | Master Builder

Anecdotal reports are telling us that delivery times on timber and steel supplies are stretched, with prices going up by more than 15 per cent. Roofers are especially hard to find because they’re busy with insurance work, new builds and renovations. We’re also hearing of shortages in concrete pipes which is impacting on land developments, with a minimum wait of 14 weeks, and anywhere upwards of 18 to 20 weeks, depending on the product. It’s great builders have more time to turn the first sod, but those pipe shortages mean that land can’t be developed – and a house can’t be commenced until the land has been developed, and the title issued. With our focus firmly on solutions, we’ve secured a commitment from the Queensland Government and QBCC to get involved and

support our industry and ensure fairness for both builders and consumers. They’ve agreed to a process that will give builders more flexibility to use Extension Of Time (EOT) provisions in genuine and reasonable circumstances, access to their existing Early Dispute Resolution (EDR) process which could include mediation, as well as an education and awareness campaign that will ensure builders and their clients are aware of the situation and the need for patience and communication. As we go to print, we’re awaiting the finer details on how the campaign and new process will be rolled out, but we are confident it will assist in addressing the myriad of problems facing our industry. While nothing is a silver bullet during these times, all of the pieces come together to solve the puzzle.

Lysaght Australia celebrates 100 years of local manufacturing

Leading Australian steel building products company, Lysaght, is this year celebrating 100 years of local manufacturing, an impressive achievement that goes against the trend of offshoring which has prevailed in Australia during recent decades. While the current Lysaght range covers roofing and walling, architectural cladding, guttering, fascia and rainwater goods, fencing and screening, steel sections, formwork and framing, patios, carports and structures, it’s undoubtedly corrugated iron that it’s long been known for. This steel building product has been used on everything from the roofs and bull-nose verandas of heritage homes, through to shearing sheds and outback dunnies, and more recently in en vogue architectural building projects. The product’s journey to national icon status can be traced back to Britain, where entrepreneurial Irishman, John Lysaght, began galvanising corrugated steel sheeting in Bristol during 1857. He registered the product under the trademark ‘ORB’ , which continues to be used to this day. After satisfying demand in the United Kingdom which was being fuelled by the Industrial Revolution, Lysaght turned his attention to export markets, namely Australia, where he saw huge opportunities arising from the gold rush of the late 1800s. He began exporting to the colony soon afterwards.

ORB was first sold in Australia through independent merchants until Lysaght established his own distribution company, the ‘Victorian Galvanised Iron and Wire Company’, which acted as a central selling agency. The venture worked well and by 1913, some 80,000 tonnes of ORB had been shipped to Australia.

At this point, the popular ORB corrugated profile began its Australian-made journey and 100 years on, the company has never looked back. Lysaght General Manager, Peta Renkin,

It would be fair to say that our city has endured the worst 12 months of its history.

In March, we had a total of 94 new dwellings approved, representing a 147% increase on March 2020.

However, like we have seen time and again, our region is resilient, and we always bounce back stronger than before.

Council has also provided significant stimulus to help the city with its recovery.

I am confident this will be the case again and I am heartened by the surge in building and development approvals. Regional residential building approvals have shown strong growth, no doubt in part driven by government stimulus targeting the construction sector. Significantly, the value of residential building approvals for the Cairns SA4 region doubled from $24 million in the month of July 2020 to $48 million in October 2020. Council data reveals that approvals of new dwellings this financial year to the end of March totalled 692, an increase of 92% over the same period in the previous financial year.

Notably we handed down a record $181 million capital works program for 2020-21, and fast-tracked the $28 million Esplanade Dining Precinct redevelopment to ensure it was ready for the anticipated strong return of visitors in June. The past year has brought us unexpected and unprecedented challenges but it has also brought us together and has allowed us to challenge ourselves to create and prepare our region for a brighter, more sustainable future. Though this year was marked with many successes, it wasn’t without loss and hardship due mainly to the COVID-19 pandemic. The work done since the beginning of last year by our frontline workers, residents and businesses has been paramount to helping the region face the pandemic and the constantly changing environment. With wide open spaces, crisp, clean

air, the heart of the Wet Tropics and Great Barrier Reef on our doorstep as well as easy access to many parks and wildlife, we have ample opportunity to enjoy a wonderful standard of living on the Cassowary Coast. I am proud of the role Council played this year in contributing to our liveability, through the provision of clean and safe drinking water, efficient waste disposal and well planned and maintained infrastructure. Our future is looking bright, but our present is worth appreciating. I truly believe the past year is one in which we can look back and feel proud. As a community we will continue moving forward together to restore and improve the health and prosperity of our region in 2021 and beyond.

ndy King is regarded a leader and innovator in the industry thanks to her marketing and social media nous, as well as her knack for helping shape awardwinning projects from start to finish. Despite being seemingly destined to take the path she did, Andy’s rise to the top of her game hasn’t been simple. Like many others, her success story is punctuated with challenges she’s confronted – and overcome. Andy has lived and breathed building literally all her life. As a child, scaffold was her “monkey bars”, and building sites inspired imaginative play as her “parks”. Her mother is an interior specialist, her father and brother are both builders – and she married one. Beginning her career as a teacher, Andy juggled the administration of family business King Builders while working full-time – and while undergoing numerous rounds of IVF to bring four beautiful children into the world with her husband Brendon. “We kind of did that thing where we went out and quoted every single job – everyone that rang you’d go out, so Brendon was spending every afternoon and night and weekends quoting, and we kind of got to the point where we thought, this isn’t a great way to run a business,” Andy said. While there was plenty of bathroom and kitchen work flowing, the ambitious couple wanted to get into more major renovations and high-end new builds. After hiring a business coach and marketing expert, the pair overhauled all their systems and processes – and haven’t looked back.

Now working full-time as a project manager and assisting clients with renovating and building their dream homes, Andy believes the industry’s culture has shifted so that women are a lot more accepted. “It was quite funny with my name being Andy, often I found when people were dealing with me when I was emailing back and forth, they assumed I was a man. “So, it was interesting the first time I had a phone call with them they’d say ‘Oh I’m actually after Andy’ and I’d say ‘Yes, that’s me’. Then a few of them would say ‘Oh well is Brendon available?’ – once they worked out that I was a female. “In the past I had men challenge my role in the business – because of my gender – but that was years ago, and I can’t remember the last time that has happened. I have witnessed a huge shift over the years.” A new study by Construction Skills Queensland shows the participation of women in construction trades has jumped to almost 5 per cent over the past five years, numbering more than 13,500 in 2020 – more than double the figure 20 years ago. CSQ’s Director - Research and Digital, Rob Sobyra, said the female participation rate is sitting at 15 per cent in ‘off the tools’ roles, and just 5 to 6 per cent ‘on the tools’, which compares badly to other industries. However, a shift in the culture in and around the industry is translating to a significant jump in the number of female apprentices. “We’ve seen women working in occupations

on the tools increase over the last five years by 44 per cent – and that compares to only a 6 per cent lift in men in the workforce, so they’re really outperforming,” Rob said.

s building and construction businesses continue to rebuild towards a postCOVID future, 2021 is being highlighted as an opportunity for employers to focus on diversity. The construction industry currently employs approximately 1.183 million people, which accounts for 9.2% of the total workforce, including 91,600 people living with disability. Disability employment service atWork Australia pointed to the figure as showing an underrepresentation of people with a disability, owing to a possible perception it’s not a suitable industry. atWork’s General Manager DES, Steve Carder, said that couldn’t be further from the truth. “It’s vital that decision makers in the construction industry are re-educated on their views toward people living with disability, as many don’t require any modification to their workplace, and there

are grants available for those that do,” Steve said.

Making site delivery a whole lot

A

s the old saying goes, time waits for no man – or woman – and in today’s ondemand world, it was a gap in the time management space in Australia’s building and construction industry that proved a lightbulb moment for Getter founder and CEO, Tom Burton. With a background in building and construction finance, as well as project management and technology, and solar distribution and installation, Tom has witnessed countless incidents of companies running into roadblocks around procuring materials – especially in unforeseen circumstances. “It doesn’t matter how efficient construction or project managers, or tradies are in planning it, there are just things that come up on site constantly that need additional materials or a change in what’s required for whatever reason,” Tom said. “Historically, the only way really to solve that problem was to send people off site to go and get those goods – and there’s obviously a lot of wasted time, effort and money associated with that. So, the simple problem we’re trying to solve is to remove that wasted time and

allow for better project timelines, and reduce the costs associated with all of that.” After doing some research into solutions which had been out in the U.S market for 24 months, Tom found there was nothing similar on offer here. 18 months on from its first trial, Getter is now operating in Brisbane, Sydney and Melbourne. They also source materials from major centres for those in regional areas, so far delivering to locations including the Kimberley, the Far North, and even Papua New Guinea and the Pacific Islands, engaging third-party freight for these requests. Customers can either order their trade materials online, or select the delivery only option, and have them delivered on-demand to their job site, allowing them to keep on working while they wait. “We have a flat fee if they use our online e-commerce platform and they want us to source the product and deliver it. If they want to use our delivery-only service, it’s a bit like Uber – so it’s about 30-40 per cent cheaper than somebody leaving the site themselves," Tom said. While it just might sound like Uber Eats for materials, Tom said the key difference was

employing tradies as drivers. “What we’ve found is our reliability and our customer service is what’s winning builders and other contractors over, because we’re not a courier company that doesn’t care about the product they’re delivering…because we’re tradies, we’re owning it from start to finish – and I think that’s really important." G.J Gardner Homes Director, Darren Wallis, jumped on board with Getter after being asked to take a look at the business plan in the early days, and after realising its potential to make the industry more efficient, decided to invest. “For this sort of service, it’s paramount that people know what they’re doing – otherwise you end up with the reverse problem of worsening inefficiency,” Darren said. “We’re just about to start a trial at one of my franchise operations – it’s obviously targeted towards the tradies, but there’s a lot that could be done at the builders’ level. Ultimately what helps the tradie helps the builder – and if the builders can get their houses built quicker, in a more efficient way, it drives down costs and helps their cash flow." tiny tech a lifesaver A

tiny, sticker-like device being made right here in Queensland could soon be helping to save lives in the building and construction industry.

Dehydration affects physical and cognitive capability, leading to risk of injury, death, lost productivity, higher business costs, and the risk of non-compliance in the workplace.

The ‘Microwearable’ sensor developed by WearOptimo and the Australian National University (ANU) is stuck on to a patient’s wrist, and scanned with a mobile device, delivering instant data to detect issues like dehydration. The sensor is painless, quick and offers a continual data point, unlike the traditional approach using needles, which can be slow and painful.

The ten-year, $30 million project is being funded by WearOptimo, the Queensland Government, ANU, and supported by the Australian National Fabrication Facility and other partners, with the Brisbane facility expected to manufacture 26 million devices each year, creating close to 100 jobs.

Workplace health and safety on building and construction sites are among the key markets for the world-leading medical technology, as well as aged care and mining. Once the dehydration sensor is out in the market, the WearOptimo team will look at moving on to using the technology to detect patients at risk of having a heart attack.

Mother Nature A ustralia arguably holds the crown when it comes to extreme weather conditions – and Queenslanders know better than anyone what can happen when Mother Nature throws her best at us. Now, a house is fighting back – or more specifically, One House. As Head of Suncorp Insurance, Paige Vincent has stood side by side with devastated homeowners at many a ground zero in the wake of a natural disaster. It was this repeated experience that led to her involvement in the mission to build awareness and starting the conversation among industry, community and government around how to make Australian homes more disaster resilient. Suncorp teamed up with CSIRO, James Cook University and Room11 Architects to design, prototype and test what’s now known as One House.

Inspired by the iconic Queenslander, the home utilises normal building materials and unites them in a way to help it withstand natural disasters, while remaining competitive to the price of a standard architecturally designed home. Builders can replicate One House completely or use aspects of it to improve the resilience of an existing property. “Every time we go out to a customer’s house that has been impacted, there is almost like this level of shame, that they don’t want people to see the condition that there home is in post the disaster, and a little bit of questioning around what they could have done differently to prevent it,” Paige said. “So, I think this is absolutely giving homeowners and customers the power back, to say these are the changes that I can make to protect my home better.” The house copped a lashing at the Cyclone Testing Station in Townsville, and the

CSIRO-operated Bushfire Burnover Facility in southern NSW, as the research team worked to understand what aspects would fail or resist particular fire, cyclone and flood impacts. “I must admit it was almost a little bit of disbelief that the house was still standing there, pretty much intact apart from that it had turned a slight yellow colour, but once the heat dissipated it went back to the greywhite colour that it was,” Paige said. Now the technology is available, the insurance expert said it’s time for industry and government to work together to put it into practice. “You just kind of sit there and say it’s crazy that we don’t have this in building codes. “Being displaced for 12 to 18 months while your home is being rebuilt, the pressure that comes with just everyday situations, it’s just such an upheaval, so any way that we could reduce that, I think is a step forward."

My role is to identify and research display village opportunities across South East Queensland, in line with our growth corridor strategy. My most memorable moment so far would have to be my first time out in the village with Greg and unbeknownst to us there had been a break-in. Have Your Say – Digital Licences Carrying around a stack of plastic licences each day is nothing short of a punish. From QBCC licences, high-risk work licences such as cranes, machines, and scaffolding, to occupational licences such as asbestos and demolition and gas work, builders and tradies are burdened with making sure they have their cards on hand when they’re on the job, leaving them with bulging wallets…for all the wrong reasons! Often, the plastic cards end up smudged and faded beyond recognition, or destroyed altogether, making for wasted time and money on replacements, or if left at home, spell a fine from the inspector, or embarassment in front of a client.

ValeEric Pickering T

here’s no doubt Eric Pickering has left an indelible mark on his home city of Brisbane. Landmarks including the Mater Hospital and the now heritage-listed former Department of Main Roads building at Spring Hill remain testament to his wonderful work. It is for his widely respected building career, and 40-plus years of dedicated and exemplary service as a member and Life Member, that Eric will always be remembered as a leader and friend by Master Builders. There’s no doubt Eric was made of strong stuff. As a young boy in his native Ireland, he experienced the war and the bombing of Belfast. At age 22, Eric and wife Lyn set off to make a new life in Brisbane ‘with just 18 quid in his pocket.’ Shocked to find his qualifications weren’t recognised at the Central Technical College, Eric persevered, carrying his toolbox on four different modes of transport to work each day. Over the years, he advanced to become general foreman for

CP Hornick. In 1975, Eric joined Master Builders, later becoming Building Advisor and Manager of Housing, and Technical Advisor for 15 years. In 1981, Eric was the building contractor and coordinator of Master Builders’ ‘Dream Home’ promotion. He also coordinated the 1988 Housing & Construction Conference and worked on the Carindale display village before becoming Display Villages Manager. Eric won the Master Builders Award for Technical Excellence in 1992, was Chairman of the Institute of Building Consultants from 19982000, a regional Housing & Construction Awards judge in 2001-02, conducted training, and toured on Roadshow. He was also a respected arbitrator and mediator, and especially loved his time as President of the Master Builders Bowls Club. He was made a Life Member in 2012. Eric is survived by wife Lyn, seven children, 13 grandchildren and nine great-grandchildren. Vale, Eric.

Youth on the yellow Abrik road to

“It’s pretty easy waking up every day knowing you’re helping those who need it.”

T

hat simple but powerful philosophy has led Master Builders member Ralph McMillan on an inspirational journey that began in Cambodia 20 years ago, and now back home to Brisbane, where his company Abrik is helping give disadvantaged young people jobs, and hope for the future. Passing through Asia on his way to play rugby in Wales all those years ago, Ralph fell in love with Cambodia, and decided to establish a plumbing business there. With his skills considered rare locally, he won plenty of work with embassies and major hotels. “Then we were lucky enough to be able to start employing kids who were living off the rubbish tip over there and train them up; we brought in Australian volunteers, including retired ex-plumbers to come in and help them,” Ralph said. “We had quite a lot of staff and that went really well, it was just a joy to be a part of it to be honest.” After returning to Australia when it came time for his own children to start high school, Ralph successfully ran a business for 34 | Master Builder

someone else, but last year found himself wanting to do something more to help disadvantaged kids, this time on home soil.

When it came time to name his new plumbing maintenance business, Ralph decided to go with his uncle’s advice and go with A or B so it would be “at the top of the list” – leading to a title it feels like he was destined for. “Abrik stood out – when I Googled it, it actually means ‘The Golden Child’ in Hindu – and just the fact that I was trying to do something with youth, I thought that really related. “I used the ‘golden’ out of that and I sort of thought about the yellow brick road, and the journey that Dorothy and the bunch of misfits took, and how they found themselves. So, I thought that’s exactly where we needed to go.” Ralph soon learned about the wonderful work being done by NRL legend Johnathan Thurston through his Academy’s Believe program, and most recently the JTYouthJobs platform, connecting youth with real work opportunities in a streamlined way. According

to the ABS, one in three young Aussies were unemployed or underemployed at the end of 2020, prompting Thurston – and Ralph – to take further action. “I was quite lucky in a way that before JTYouthJobs was set up, I was already working directly with staff at the JT Academy, but now we’re putting on ads through there and looking to take on more people, even just through internships and things like that – we currently have six,” Ralph said. “Our goal is to have one plumber to one apprentice, and that apprentice will stay with that plumber for at least a six-month period to work through that mentorship side of it, so they can create a bond and gain that trust and bit of support. “The whole goal is to get them hands on – these kids really thrive in not just going out to a job and digging a hole, but to actually learn something; and it’s been amazing they’re learning so quickly, it’s just fantastic.” One success story is that of Isaiah, who arrived at Abrik as a shy young man with a tough past.

“When he started with us, we didn’t get a lot from him, but he was always keen, always on time and worked hard. Then he started to get that rapport with Jim our plumber – Jim is fantastic with the boys. “Jim had been training them – simple things like how to cut the angles in gutters. The first day, Isaiah’s put together his gutters, cut his angle, held it up for Jim to get a picture and he’s just got this great big smile on his face. He’d achieved something – he’d put together something with his own hands, it was pretty impressive. "We sent it back to the Johnathan Thurston Academy and JT wrote back and was over the moon. JT also recently presented our youngest apprentice Tyrone with a Lion Heart award (pictured above left). It's fantastic to be a part of." One unique feature which caught our eye is the Ronald McDonald statue perched on a bench keeping watch over the ‘piece de resistance’ wine cellar in the basement of this stunning property.

ill May and Courtney Kain have taken very different journeys to get where they are in the building and construction industry, but there is one common denominator – the courage to be different. Both are part of the team at iQ Construct, a Head Contractor and Construction Specialist company based in Brisbane’s West End. 42 per cent of its workforce are women, compared to 18 per cent across the industry. Last year, its all-female team on the DFS T Galleria project in Cairns was one of the 38 | Master Builder

roach Meantime, Courtney dreamed during her teenage years of being a carpenter – but after leaving school, she met with a few unexpected roadblocks.

“Even only 11 years ago it was still really hard as a female for anyone to take me seriously, and I probably applied for about eight to 10 jobs as a chippie – no go,” Courtney said. “I went to a construction company and basically just asked for any position that they would hire me at, and that’s sort of how I got into the head contractor side.”

“I just laughed – and it probably took him about three weeks to convince me, and so we did a trial and I never looked back after that first project – it was really successful, and it worked really well… I’ve never wanted to go back to the office.” Jill said the ethos of hiring the best person for the job – no matter their gender – is at the heart of all their projects – including the DFS T Galleria overhaul. “It’s not about putting together an all-female team – for us it’s about finding the right fit for purpose. These three women at that stage were the right team, the right fit, and delivered the best product for the client,” Jill said. Courtney recalled the initial challenges of shifting from Brisbane, where she’s been a well-known part of the industry for a long time, particularly as a female in a leading on-site role. “Showing up in Cairns, everyone thought I was the project coordinator; when I had to say I was the site supervisor there were definitely

some raised eyebrows,” Courtney said. “I’m not going to lie – I was scared, I was nervous. After about a week on site with the guys I was completely fine, they were so respectful. I panicked a little bit too much when I really didn’t need to at all. “They were obviously shocked – they made comments that they’d never met or heard of a female site supervisor before, which is fair, it’s somewhat rare. Once they’d got over that fact, they were completely fine. “I was lucky enough to procure just fantastic…I wouldn’t call them tradesmen, they were craftsmen the guys I had up in Cairns, they were just amazing.” Jill agreed that the tide is turning for women who want a career in the industry, on and off the tools. “There’s definitely an understanding that they can do it. I mean, Courtney is a prime example – you leave school really wanting to do it, but you don’t really understand that you can. “There’s been a lot of push – obviously some great work from organisations like Master Builders and NAWIC and other women-focused organisations just to get the message to young people that there’s even an option.” Master Builder | 39

House Saved from Demolition A two-storey, nine-year-old residential property was suffering from severe differential settlement of up to 95mm. As the property was under warranty, the owner sought resolution from the original builder. Important information about timber and moisture

Recent extreme rainfall in Queensland and New South Wales has created conditions in which timber products may become affected by moisture. Whether you are building with new timber, or repairing water-damaged structures, the following information will help you optimise performance and service life. Structural and appearance grade timber products sold in Australia are generally kiln dried during manufacture to a specific moisture content, usually between 1215%. This is particularly important as kiln dried timber is stronger, more stable, and less prone to mould or decay – providing a product that will effectively last indefinitely in a properly designed and maintained structure. To ensure this, it is helpful to understand the role of moisture content in your timber products. When you receive timber on site, it may be plastic wrapped. This is important because wrap covering helps protect the timber from rewetting. You can help ensure that water stays out by: •

Not placing the timber directly on the ground, and use blocks or bearers to create separation

Avoiding or repairing tears in the plastic wrap

Storing undercover, if possible, or at least out of direct sunlight

Ensuring adequate ventilation around the timber - free air circulation will help dry out any condensation that might accumulate under the cover

Installing the roof covering, and wall sarking, to minimise the risk of wetting

If you open a pack and of timber and it is wet or mouldy, it could be because: •

There were tears in the plastic wrap

The pack was stored in contact with the ground, allowing water to wick up

The pack was stored in direct sunlight which encouraged condensation

If the timber is wet, let it dry. Remember, wood swells as it absorbs moisture and shrinks as it dries. This effect is greatest on the wide face, a bit less on the narrow face and negligible along the length. Drying wetted wood can create some stresses that may lead to warping, twisting or bowing. Wet timber that

redries may experience some movement, so the best approach is to place it into the structure as quickly as possible and allow it to dry in place. Once the wood has dried below 20% MC (moisture content) mould growth can no longer be supported and the spores will become dormant or die. Test the wood with a moisture meter to make sure it has a MC less than 20% before any claddings or linings are installed. Mould fungi grow on sugars stored in the wood and do not cause any loss in structural properties. Small amounts of mould can be removed by washing the wood with a mild detergent and water and allowing the surface to dry. Wood is a naturally renewable building material. Now in his 50th year in the construction industry – and with not even a whisper on retirement – seminar creator Don Dixon knows a thing or two about how things should be done right. A look at Don’s extensive CV tells the story. He’s currently Master Builders’ Renovations and Technical Committee Chair, sits on the IBC committee and Housing Committee, and is an elected member of our Electoral College. A licensed builder with a background in project and site management, as well as roles in recruitment and marketing, Don is also licensed in pest control, pool safety inspection, asbestos removal, and certified in construction waterproofing. Surprisingly, when he got the tap on the shoulder about becoming a professional building consultant and expert witness, in “the twilight years” of his career, he didn’t know what was required. “An expert witness provides a written report and sometimes testifies in building dispute matters at a tribunal or court hearing.” Don explained. “You might have seen on TV on the Law and Order-type shows, they’ll call on an expert witness to provide evidence. The expert witness must be completely independent and impartial. Their primary duty is to the court,

not as an advocate for the person who has engaged their services.” A typical building dispute might involve a homeowner withholding the final payment from the builder, alleging building defects as justification. Sometimes it’s the other way around. If mediation fails, a lawyer for one or both parties will advise them to get an expert building report to look impartially at the issues in dispute – and that’s where a building consultant comes in. “I look at the allegations listed and inspect the alleged defects. I take notes, photographs, and do any tests that are required,” Don said. The Uniform Civil Procedure Rules spell out the duties of an expert, including documenting all tests and the inspection process as evidence to support their professional opinion. “That evidence is compiled into a written report, and provided to the parties in dispute,

to show what an independent expert says with regard to the alleged defects, in the hope that the parties can then mediate to settle without legal proceedings,” Don said. “If still not resolved, the report can be submitted to a tribunal or the courts.” With a shortage of recognised consultants in Queensland and plenty of dispute work around, Don decided to reduce his workload and share his passion by writing a one-day seminar for his fellow Master Builders members. “It’s targeted at those in the industry who might want to transition to a specialist practitioner’s role. It's also not just for licensed builders – there are recognised experts in roofing, hydraulics, fire services, waterproofing - to mention just a few. Following the decision of Workpac Pty Ltd vs Skene employers were left with uncertainty regarding their casual workforce, with concerns of misclassification and back pay claims for leave entitlements.

Contrary to what people might think there is no problem with risk; it is how you identify, assess, and manage risk that is important.

In March new legislation was passed that has significantly amended the casual employment regime. This includes a definition of casual employment and new obligations of casual conversion. Most of the casual conversion changes don’t apply to small businesses leaving us with a two-tiered system. WHAT IS A CASUAL EMPLOYEE? The most important change is that a casual employee is to be assessed on the basis of the employment offer and not on the actual hours worked during employment. To meet the terms of a casual offer it needs to be clear that there is no firm advance commitment of continuing and indefinite work and the employee understands and accepts based on this offer. When deciding if an employee should be offered casual or permanent employment the factors to consider are: Shifts will be offered on the needs of the business; the employee can accept or decline shifts, and the employee is entitled to casual loading or a specific rate of pay for casual employees. CONVERTING CASUALS TO PERMANENT EMPLOYEES – BUSINESS OVER 15 EMPLOYEES Businesses with over 15 employees must offer a casual employee conversion to either part-time or full-time employment if: the employee has been employed for a period of 12 months; during the last six months, the employee has worked regular hours on an ongoing basis and that these hours will continue in the foreseeable future. Businesses are not required to make a conversion offer if there are “reasonable grounds” that are based on facts that are known or reasonably foreseeable at the time. REASONABLE GROUNDS WOULD INCLUDE: The hours of work will be significantly reduced or cease in the next 12 months; there would be significant adjustment to the employee’s hours of work. An employer will still need to issue a notice of decision to the employee providing details as to why an offer of conversion is not being provided. Businesses over 15 employees must comply with both the NES and any applicable Award or EBA. For businesses with under 15 employees the existing casual conversion obligations under your Award or EBA still need to be followed. CASUAL EMPLOYMENT INFORMATION STATEMENT (CEIS) All casual employees (new and current) need to receive the new Casual Employment Information Statement as soon as possible. If a contractor decides to take on a risk the benefit/s should outweigh the risk-cost. A risk-benefit analysis requires an holistic approach that among other things tells you as much as possible about the magnitude of the consequences of taking on the risk for the business overall, and of course how will this add to the businesses bottom line. Having undertaken the risk-benefit analysis the next step involves putting in place a risk management process. For example, as a minimum include three basic but critical steps for a building contract scenario: STEP 1 - IDENTIFY THE RISK FACTORS These may include: conditions in industry overall; Owner/Principal profile; resources allocated to health, safety, and environmental issues; availability of labour and materials; insurance requirements; scope and content of contract documentation; site-specific issues, services, storage, rubbish; financials, cash flow, progress payments; government regulation, taxes, fees, and contract administration. STEP 2 - ASSESS THE RISK Sub-contracts mirror head contract terms; progress payments defined in relation to cash flow needs; retentions, securities; extended defects liability periods; payment claims and payment schedules; extended warranties from suppliers, manufacturers; owners/principals confirm in writing accuracy of documents supplied by them; access to site owner/principal responsibility; owners/principals finance approved and confirmed prior to commencement; security of payments if they are cash clients; trades responsible for storage and removal of own trade waste from site; assessing likelihood and consequence of safety risks. STEP 3 - MANAGE THE RISK Manage the owners/principal’s expectations; prepare a project/ works program; head contractor allocates appropriate resources; subcontractors’ resources allocation is sufficient; check contractor’s (builder/trade) suitability to undertake the contract; regular site meetings with owners/principals; administer the contract’s Extension of Time and Variation claims - watch for time bars; administer the lodgement of progress claims; regularly monitor the construction progress and as required update the program; ensure adequate site supervision; ensure the owner/principal pays the progress payments on time, and put in place safety control . RISK IS LIKE YOUR SHADOW - IT FOLLOWS YOU EVERYWHERE. Review the management strategies that you have put in place on a regular basis throughout the project to ensure that they are working and achieving the desired outcomes.

DO I NEED TO ENSURE THAT MY WORKERS RECEIVE THE COVID -19 VACCINATION?

As members know from bitter experience, the cost and availability of materials, supplies, labour, and subcontractors can change during the course of a project. The profitability and progress of a project can change dramatically overnight.

There is no requirement under the WHS Act for employers to mandate vaccinations in their workplace. The Chief Health Officer may however designate certain workplaces as high risk and issue public health orders requiring employers to ensure their workers are vaccinated. In this case, employers must follow public health orders. For example, there is currently a public health order in place for those health professionals treating COVID-19 patients, requiring them to be vaccinated. Employers do need to demonstrate that they are putting in place control measures to eliminate the risk of COVID-19 in their workplace. It is important to understand that the COVID-19 vaccine is only one control measure to eliminate or reduce the risk of serious effects of COVID-19 in workplaces. If employers intend to implement a vaccination program at work they must: • Consult with workers and health and safety representatives giving them a reasonable opportunity to express their views and contribute to the decision-making about vaccination as a control measure • Provide workers with access to medical and health information regarding the safety and efficacy of the vaccine • enable access to the vaccine for all workers • Protect workers’ privacy in relation to their decisions on vaccination • Obtain advice from a reputable source such as Worksafe Queensland, Queensland Health and/or Master Builders Queensland about policies and procedures that will need to be implemented ARE CONSTRUCTION WORKERS A ‘HIGH RISK INDUSTRY’ UNDER THE COVID-19 VACCINES NATIONAL ROLLOUT STRATEGY? The construction industry has not been classed as a high risk industry, under the COVID-19 Vaccines National Rollout Strategy. Some workers may be individually classed as high risk due to certain characteristics such as age or pre-existing medical conditions which will place them in a priority group for vaccination. CAN I PASS ON INCREASES IN THE COSTS OF MATERIALS, SUPPLIES, LABOUR OR SUBCONTRACTORS TO MY CUSTOMER? You can only pass on price increases if your contract allows it. If your contract is for an agreed price or agreed rates (and does not allow for changes to those prices and rates due to increases in the cost of materials, supplies, labour, or subcontractors), then you cannot charge more than those agreed prices and agreed rates. There are options available to include flexibility for prices and rates in your contracts. These include: a.

‘Cost escalation’ or ‘rise and fall’ clauses. These clauses set out agreed pricing from which increases are calculated, a process for claiming an increase, and when the increases are payable by the customer.

b.

‘Prime cost items’ where an item has not been selected, or its price is not yet known, and an allowance for its cost is included in the contract.

c.

‘Provisional sums’ for services where a set amount cannot be included in the contract.

Please note schedule 1B of the QBCC Act restricts price flexibility for building work under a regulated domestic building contract. WHAT IF I CANNOT PASS ON INCREASES IN THE COSTS? If your contract does not include price flexibility, then you are bound to perform the works under the contract for the prices agreed in the contract. Any changes to the works and pricing in the contract can only be made if agreed by all parties to the contract. CAN I CLAIM AN EXTENSION OF TIME FOR DELAYS CAUSED BY THE UNAVAILABILITY OF MATERIALS, SUPPLIES, LABOUR OR SUBCONTRACTORS? Whether you can claim an extension of time depends on the terms of your contract, and whether it allows you to claim for delays caused by a shortage in, or delays in obtaining, materials, supplies, labour, and/or subcontractors. To claim an extension, you will need detailed evidence of: the delay caused by a shortage or delay in obtaining materials, supplies, labour, or subcontractors, and your efforts to get the required materials, supplies, labour or subcontractors. For those undertaking domestic building work under a regulated contract, schedule 1B of the QBCC Act restricts your ability to claim. Section 42 of schedule 1B limits claims for an extension of time to only delays which were not reasonably foreseeable and out of your control.

Nominee supervision P

oor site supervision can lead to defective building work. Defective building work can cause significant financial impact on contractors. Does your company and the company nominee provide the correct supervision on site? Have you got a system of supervision in place? A QBCC licensed company must have a nominee to maintain the licence. The nominee must have authority, and undertake duties and responsibilities to ensure the adequate and personal supervision on site for works being carried out by the company. The nominee must be an employee, or an officer of the company and suitable supporting evidence is required to be supplied to the QBCC in applications and on change of nominee. The company nominee is its technical expert. The nominee has a responsibility to the company and the QBCC to uphold that level of expertise. Company directors and the nominee have a responsibility to ensure that a system of supervision is in place that ensures the company’s building work is adequately supervised, complies with the plans and specifications, and is of a competent standard. When you are thinking of operating under a company structure you must understand the obligations as a company director and those of the company nominee/s. If your system of supervision is found to be inadequate, both the company and the nominee may be committing offences under the QBCC Act and can be prosecuted. A system of supervision should have regard to the size and complexity of the building work to be carried out under the licence,

A QBCC licensed company must have a nominee to maintain the licence. and how the building work is proposed to be checked during all stages of construction and before final payment by a person authorised to supervise the work. Suitable evidence includes employment status, such as the formal employment agreement and nominee supervision plan. A nominee supervision plan should cover the structure of the company and the roles on site, communication systems, nominee site attendance and the management of defect identification, and how the building work is proposed to be checked during all stages of construction, on its completion and before final payment by a person authorised to supervise the work. EMPLOYEE YOUR NOMINEE Our Workplace Relations team fields lots of calls from builders wondering how to best employ their nominee. Some of the common issues that arise are: •

My workload is not consistent, so I don’t know how many hours I need

my nominee for. •

I want to pay my nominee according to my contract value, not for hours worked.

My nominee has their own company and so can’t guarantee set hours of work.

Beside these scenarios posing challenges of providing evidence of suitable levels of supervision to the QBCC, there are also issues around what makes for a suitable employment contract. In general, you will have greater flexibility in your employment relationships if your nominee is only providing the supervisory oversight of your works rather than being a hands-on site supervisor. A person acting solely as nominee will be Award-free and so there are a number of greater flexibilities available in your employment contracts. For example, an Award-free nominee may be contracted as a part-time employee with guaranteed minimum hours per week,

which do not necessarily have to be fixed in advance. This gives the flexibility to contract for and pay for a set number of hours per week, whether needed in a given week or not, but pay additional up to the market rate as required. This coupled with a low hourly minimum rate that we need to guarantee as a legal floor means that we can consider the feasibility of financial arrangements such as retainers or contract value rates that still meet the national Employment Standards. Unfortunately, we can’t guarantee the exact outcome you want because the more flexibility we can build into your employment contract the more you may be questioned, rightly, about whether your employment arrangement provides the supervision requirements required by the QBCC. Low Density Asbestos Fire Board Classified as Friable from May F

rom 1 May 2021, low density asbestos fibre board (LDB), also known as asbestos insulating board, will be classified as a friable material in all circumstances. This means LDB can only legally be removed by a class A asbestos removal licence holder.

LDB will be prohibited unless the task is one of the following and the work is done in the way specified by a regulator-approved method:

If you’re a class B asbestos removal licence holder and want to be able to remove LDB after 1 May 2021, you will need to apply to Workplace Health and Safety Queensland for a class A asbestos removal licence. These changes will also affect businesses and tradespeople who carry out maintenance and service work involving LDB installed in buildings and plant or equipment prior to 31 December 2003. Super guarantee increase 1 July 2021 T

he superannuation guarantee (SG) is scheduled to increase to 10% from 1 July 2021.

Despite media reports suggesting the SG increase may not go ahead as planned, businesses need to be ready for this legislated increase in super contributions and factor the additional cost into new work they’re undertaking post 1 July 2021. The SG is scheduled to increase from the current rate of 9.5% to 10% from 1 July 2021. It is then planned to increase by half a percent each year until it reaches 12% in 2025. SG is the minimum super an employer must pay their employees. From 1 July 2021 the minimum super that must be paid to

an eligible employee will be 10% of their ordinary time earnings – the amount an employee earns for their ordinary hours of work (including over-award payments, commissions, allowances and paid leave). As an employer it’s important to ensure you pay super at this new minimum rate from 1 July 2021 as there are financial penalties from the ATO for not meeting your SG obligations. The Super Guarantee Charge (SGC) is the penalty charged by the ATO when employers don’t pay: the required super guarantee contributions for each eligible employee; super contributions by the cut off date for payment, or super to each employee’s chosen super fund.

Joe (water) proofing the future OF HIS BUSINESS

ith five years’ experience running a business, Joe Brookes has his finger on the pulse when it comes to best industry practice.

Based in Cairns, Joe’s small-medium commercial construction company Brookes Build has built a solid reputation working on commercial fit-outs of restaurants and pubs, as well as the occasional office. With waterproofing consistently earning an unenviable place as a stayer on the QBCC’s top 10 defects list, experienced builder Joe had himself spotted a real need in the industry for it to be stepped up. “Our tiler and waterproofer is very good and I trust his work – but we’ve had other waterproofers come on and it’s been quite shocking to see what they think is acceptable, and what they get away with,” Joe said. 60 | Master Builder

“It’s quite an expensive trade to get in to do the work, so we thought that we would get our own licence. I put our foreman through the Master Builders waterproofing course last year, so he was doing all our waterproofing for about 12 months. He said the course was really intense and informative, so I decided that I wanted to do it as well.” Joe said having a skilled trainer with lived industry experience running the course made it all the more relevant. “The instructor Andrew is very passionate, and he can see a real need for this in the industry – that there’s just not enough training. “Obviously there are so many waterproofing problems that are arising in the industry and he sees it – he flies all around Australia handling repairs to some horrible waterproofing jobs, and some really

complicated ones. He made the course really enjoyable with his knowledge and enthusiasm for it.” Since completing his study, Joe has found an increased confidence that his jobs are being done correctly, avoiding costly issues cropping up. “It allows us to bypass the issue of getting waterproofing contractors in to do the work. Also, the cost – we’re saving a lot of money for our business and our clients by doing it ourselves. Construction timing is also definitely a point. “The CSQ funding made doing the course incredibly affordable. To be honest I was going to do it anyway, but to get that funding was a really nice surprise. You will get guys that are on the fence about doing it because of the cost, and the funding will definitely push them to take the step.”

How to guarantee the quality of your reinforcing steel

Over 140,000 tonnes of steel reinforcement is supplied in our market each year from unknown origins. If ‘uncertified’ steel is supplied on one of your projects then there is a high risk the reinforced concrete element may not perform. Even though design drawings might specify AS/NZS 4671 Steel for the reinforcement of concrete, it’s difficult to prove conformance once the steel is fixed and the concrete is placed.
