Are your showers ticking time bombs? Despite builders best efforts, leaking showers are consistently listed in the BSA’s top ten defects. Sadly, sometimes this is due to substandard workmanship, but most of the time it is the design of the shower itself which is creating the potential for disaster. Most contractors are at a complete loss as to why, but detailed testing has shown how, by the action of expansion and contraction, water is “pumped” along glue cavities to escape the shower enclosure, no matter how well it is water-proofed. WITH HOMEBUILDER SET TO KEEP THE RESIDENTIAL SECTOR FIRING ON ALL CYLINDERS WHILE THE COMMERCIAL SECTOR SPLUTTERS ALONG, THE OUTLOOK FOR 2021 AND BEYOND IS FOR A TWO-SPEED INDUSTRY. Close to 30,000 new dwellings are expected to be built in Queensland during 2020/21. This is almost 60 per cent more than we projected back in April 2020, prior to the introduction of the HomeBuilder grant. The extension of the grant until 31 March (dropping from $25,000 to $15,000), together with the Queensland government’s $5,000 boost in the regions, are set to carry the housing sector through until the end of 2021.

forecast is better than originally projected, the reality is that this is 4 per cent down on the previous year - and a far cry from the 42,000 new builds back in 2017/18 (of which more than half were units). The figure is expected to again fall slightly in 2021/2022 to 28,344 — and we don’t expect to return to 30,000-plus new commencements until 2022/23, when it’s hoped overseas migration will have turned around. For now, the residential sector will have a steady pipeline of work until December. On the other hand, due to the drastic plunge in overseas migration during 2020 as a result of COVID-19, the outlook for non-residential building activity, in particular the unit market, is less optimistic.
There is ample data to support this optimistic view: in addition to HomeBuilder, dwelling approvals are up for new homes right across the state and loans to owner occupiers for new home construction are the highest on record, buoyed by ultra-low interest rates.
With many segments of the economy spending most of 2020 in mothballs, the demand for building new projects in areas like entertainment, short-term accommodation, retail and industrial has taken a substantial hit.
In fact, things are going so well we’re concerned that some builders may have taken on too much work, amid emerging problems of trade shortages and price hikes in labour and materials.
In addition to this, increased pessimism about the economy’s prospects has substantially reduced the appetite of the private sector for investing in building projects. This negativity will only be alleviated once a clearer picture of the economy’s path to recovery from the pandemic has been sketched out for the

business community, which we hope will happen in the coming months. Fortunately, the public sector accounts for a large portion of demand for non-residential building work in areas like health, education, culture and recreation. The Queensland government has committed to spending a sizeable $14.8 billion on capital projects, totalling $56 billion over the next four years — although how much is spent on building, as opposed to civil projects, remains to be seen. The value of non-residential building work done in Queensland during 2020-21 is forecast to decline by 3.7 per cent to $7.9 billion, off the back of falling demand for retail, commercial and industrial buildings. In 2021/22, despite additional government spending, non-residential building activity is expected to fall again to $6.9 billion - a further 3.6 per cent drop - and it’s not until 2022/23 that we expect the retail, commercial and industrial sectors to bounce back. All in all, our industry has ridden out the COVID-19 pandemic to date remarkably well in comparison to many others, and the outlook is remarkably optimistic as we embark on another year.

W QUEENSLAND’S REGIONAL BUILDING INDUSTRY HAS KICKED OFF THE NEW YEAR ON A HIGH NOTE COURTESY OF THE EXTENSION OF THE HIGHLY POPULAR HOMEBUILDER GRANT AND REGIONAL HOME BUILDING BOOST GRANT. In early December, the HomeBuilder grant extension was the best Christmas gift our industry could have received, after months of tireless lobbying for an extension of both the grant itself and the construction commencement timeframe. Following the federal government’s lead, the Palaszczuk government then confirmed it had extended the Regional Home Building boost grant until 31 March 2021. After a lot of disappointment that the regional grant 6 | Master Builder

missed a mention in the state budget, the announcement definitely boosted confidence in regional Queensland. The extension of both stimulus measures gives builders and tradies a longer pipeline of work, which we know is exactly what the industry needed, with uncertainty around the pandemic continuing. At this stage, the housing sector has a strong pipeline of work at least until the back end of 2021. We know many builders had been forced to turn potential new customers away because they couldn’t meet the previous 31 December deadline, so the announcement will also give a hand up to new home buyers who might otherwise have found their dreams out of reach.
All of the data points to the success of these stimulus measures. Lending data, building approvals figures and the HomeBuilder statistics themselves all confirm government stimulus continues to feed demand. In Queensland alone, 16,600 HomeBuilder applications had been received, a massive 22% share of the total 75,000 applications received nation-wide. With Treasury forecasting 86,000-plus interstate migrants will move to call Queensland home in the next four years, the extension of both the HomeBuilder grant and the Regional Home Building boost grant will give our industry the tools it needs to get on with leading our state.

Y CEO This year, we’ve got some key issues that we’ll be lobbying for on your behalf. COVID -19 RECOVERY In the absence of private sector investment in new building projects, the state government needs to fill the void. We’ll be calling for a procurement pipeline that provides accurate 8 | Master Builder
and timely information on the government’s program of building work, as well as a commitment to spending more of the capital budget on new public buildings. We’re also calling for a reduction of property taxes to support the delivery of new construction. UNFINISHED BUSINESS Following on from our previous advocacy work in 2019 and 2020, there is still much to do to fix the waves of legislation that have tied the industry up in red tape and added significant extra costs. We’ll continue our calls for a shake up of the QBCC to ensure they wield their powers fairly and consistently, as well as for the government to fix security of payment reforms. We’re also pushing for impractical tender processes to be scrapped, the introduction of building rules that safeguard building quality and

Focus on advocacy enable efficient construction, for a balance in workplace safety rules between enforcement and engagement and fair workplace rules that are properly enforced. EMERGING ISSUES There are a number of new issues facing the industry that we’ll add to our advocacy efforts in 2021. These include ensuring the ‘Building Confidence’ reform agenda actually delivers improved building quality, while avoiding unnecessary red tape, and exploring practical measures to address the increased prevalence of mental health issues in the workplace. I am proud of how we as a council and a community responded to ensure the safety and well-being of everyone in our region. The strict lockdowns imposed throughout April and May meant up to one-third of our Mackay region residents had their employment negatively impacted. But we are a resilient bunch, and it was fantastic to see our residents’ out-ofthe-box thinking that ensured many businesses remained viable.

2020 was a year of challenges and I continue to be proud of our Whitsunday community and how we have dealt with the COVID-19 pandemic. A special shoutout to our frontline heroes, especially our amazing Council staff, who have worked tirelessly to ensure the essential services of water, sewage and waste were maintained for our community.
We are in the top ten truly regional cities in Australia and our regional GDP per capita is way ahead of the state and national averages. This is a region that is not only great to live in, but also a powerhouse for the nation through resources, agriculture, and tourism. Council’s Facilitating Development in the Mackay Region Policy, which council supported through concessions of about $1.1M, generated an estimated $83.32M in economic output and 226 construction jobs. The Mackay Region is well and truly open for business, with plenty of job opportunities and options for investment. We look forward to a prosperous 2021. Construction has continued to grow with output of the sector increasing by almost 20 per cent over the last five years fuelled by major infrastructure developments and commercial, industrial and tourism investment.
We reside in the best region in the world and improving liveability continues to be a strong focus. Council has embarked on a number of projects to re-vitalise the region as a leading tourism destination, laying the platform for future growth and supporting investment.
Significant opportunities exist to continue the pipeline of construction work well into the future through primary infrastructure, developing the region’s agriculture and aquaculture industries, re-vitalisation of Island resorts and growth in mainland accommodation, expansion of transport, logistics and resources sector capability or emerging industry developments in the maritime, renewable energy and aerospace industries.

With its mineral and food production, the Isaac region feeds, powers and builds communities across the world. Its annual gross regional product is estimated at more than $11 billion, a 51 per cent increase since 2017. The region experienced growth in both residential and non-residential

It’s certainly been a year for adaptation and diversification in order to overcome the challenges brought about by the COVID-19 pandemic.

Newlands reaches for the stars after
National Award Win
T
he brief for the Amaroo Environmental Education Centre Eco Classroom was both challenging and exciting: construct a classroom to meet the criteria for the world’s best practice Green Building Council Australia (GBCA) 6 Green Star rating. The result delivered by Newlands Commercial Construction saw the project win the prestigious National Environment and Energy Efficiency Commercial Building category at the 2020 Master Builders Australia National Excellence in Building & Construction Awards. The accolade followed wins for the Toowoomba builder for Excellence in Energy Efficiency and Environmental Management at the Master Builders Queensland and Downs & Western regional awards. “This was our first year in the Awards, so to go from Toowoomba to state then to nationals – obviously we’re very humbled,” Danny Charlesworth, Newlands’ General Manager Commercial said. Behind the cutting-edge concept was Amaroo’s Principal Cameron Mackenzie, who said he was “rather chuffed” to see the project recognised at a national level.

“It wouldn’t have come to fruition without our architect, Chris Gay from Elia Architecture. He’s the one who took on board my vision not to just build another ‘four walls and a roof’ classroom,” Cameron said. “The building becomes a teaching resource, so you’re not just sitting there seeing it on a PowerPoint – you’re seeing it in the real world.” With the project built around ecologically sustainable development principles, Danny said its non-traditional nature proved a welcome challenge. “Understanding those materials and products and how they work is very specific, and you have to put a lot of work into achieving the right outcome. It seems simple, but for example we used earth-friendly concrete, which is totally different to using normal concrete, and built rammed-earth walls." Cameron said the team worked hard throughout construction to uphold the project's founding environmental principals. “For example, we had to reduce our landfill to under about 501kg, so I physically weighed
and measured every single piece of material that wasn’t consumed on site." The classroom features Wagners’ awardwinning eco-friendly concrete, estimated to reduce the building’s carbon footprint by around four tonnes, while a Tesla power wall stores energy during the day and feeds back into the building at night. It also boasts Marmoleum flooring, a wind turbine, solar panels and hot water system, DC fans, insulation and soundproofing tiles. The Amaroo and Newlands teams are continuing to work on the detailed application for that coveted 6 Green Star rating. Danny said they were even working to prove the building doesn’t leak air. “Looking forward, we’d always like to do this again, but I’ve been in construction for 20-something years, and it’s not often that it comes around." Cameron said they were also still unpacking all the benefits for their students, allowing them to see the environmental impacts firsthand, and monitoring its green footprint.

nvironmentally friendly materials are those that have a low environmental impact on their production, use and maintenance. The material should be durable, reusable, or include recyclables in their composition. To ensure the comfort and cost effectiveness of your client’s home you need to be careful when incorporating eco-friendly materials. It can be complex selecting products but there are eco-product databases that can assist you. These databases enable you to access the information on the sustainable credentials of a broad range of materials and products. It is not just the end-material or product that needs consideration. The embodied energy to get the material or
product onsite also plays an important part when building eco-friendly. Embodied energy is the front-end component of the material’s cycle. The energy consumed to produce a building, including manufacturing, transport, and delivery, establishes the amount of embodied energy for that building. By taking an holistic approach when looking at different materials and construction methods, you can reduce the amount of embodied energy used. The impact can also be reduced by designing the building for a longer and more durable life. A lot of energy goes into the manufacture and transport of building materials. Eco friendly building also requires reducing waste on site. This can be achieved by designing with the building
material in mind; what size the material is, whether brick or cladding ensure the design allows for less waste. This can be as simple as the external wall reflecting the actual brick size dimensions. Another way to reduce waste is to build smaller homes that are better designed for your client’s needs. You can reduce demand for new materials by reusing existing building or recycled materials. Make sure the materials are fit for purpose and fit for their intended use. There are some other considerations when using recycled and re-used materials. Firstly, if using second-hand windows, you will be required to produce a Form 15 for the glazing to the certifier. Secondly, the recycled timber beam will need to be assessed for its structural integrity if reusing in a structural capacity. Lastly, and most importantly, ensure the materials or products meet the Australian testing requirements. When choosing natural products be mindful of accepted moisture levels and any other constraints that need to be met for Queensland's high humidity.

From band-aid solution to healing lives Hi-tech Aussie invention wrapping up the pain for storm victims
A
s he worked amongst the devastation wrought by a severe hailstorm in Sydney 14 years ago, builder Matthew Lennox witnessed the angst of affected residents as the bad weather continued, inflicting more damage on their exposed and vulnerable homes and belongings. “Every time it was windy, the tarps blew off, and soon a $50 million storm turned into a $500 million one. I thought to myself, there must be a better way,” he said. In a previous job, Matt had watched 18 | Master Builder
electricians use shrink tube for cable insulation and wondered if it was possible to shrink wrap a roof. Working with leading Australian chemical polymer engineer John O’Neill, Matt came up with Stormseal – a hi-tech film designed to endure all the same elements a roof is exposed to over a temporary period, withstanding them much more effectively than traditional quick fixes like tarpaulins. After the ingenious solution was rigorously tested - including on his own roof for six
months - then patented, Matt’s work helping victims of the 2008 storm at Brisbane suburb The Gap caught the attention of a leading insurer for their customers’ use. In the wake of 2017’s Cyclone Debbie, Stormseal won a coveted federal government grant as part of a bid to make Australia more disaster-resilient – the funding helping Matt expand into the UK and US. “We do this around the globe and it happens in every storm. The first thing you go through is this shock, it’s like can you believe it

happened? Then around about the four to five weeks mark, you start to see the realisation sink in. You would not wish it upon your worst enemy. They’ve got to the stage where the tarps have blown off three times now in subsequent storms, and they’re going ‘is this what we’re going to have to live with?’”, Matt said. “Each time the tarp blows off the builders need to reassess new damage, reprice that work, and submit it to the insurance carrier for approval. That process usually takes two to three weeks, then when another storm hits, tarps blow off, resetting the process. On average this occurs four to five times during the claim lifecycle. “We look at Stormseal like it’s almost a permanent application – a plaster cast instead of a band-aid solution. What we’re trying to do is weather that person in so they can get on with their life.”
Matt and his team witnessed the vicious cycle as they worked to help those affected by the monster storm that unleashed in the Ipswich suburb of Springfield Lakes last October, battering homes with hailstones measuring as big as 14 centimetres – equal to the largest ever recorded in Australian history. More than 8,500 insurance claims were lodged, with estimated insurance losses skyrocketing to more than $110 million.

It’s a really terrible circumstance and I really feel for those people.” In a bid to stop dodgy unlicensed tradies taking advantage of storm victims, only Safely at Heights certificate are permitted to complete the Stormseal installation course at designated training centres here and overseas. The company also won’t sell the technology to anyone who hasn’t been trained. “We need more builders and roofers to become accredited - that is how we will make Australia more disaster resilient,” Matt said. Tech tool taking the stress off site A
n app designed to increase productivity on work sites has delivered an unexpected benefit, helping reduce stress and conflict for employers and their staff.
“People started telling us the app had reduced arguments – it was having this knock-on impact, helping all the site team from builders to subbies work more collaboratively and in-sync,” Richard said.
Working as an engineer on mega construction projects, it didn’t take Richard Fifita (pictured above right) very long to realise the old daily whiteboard plan wasn’t going to cut it.
After launching a collaborative survey and collecting anecdotal evidence from managers, supervisors, traffic controllers and crane riggers, more than 75 per cent said the Veyor app helped reduce workplace stress, with around the same number reporting it assisted them with minimising conflict and unexpected changes.
“I was looking after the logistics, coordinating deliveries to site and that sort of thing. There were over 100 calls a day going back and forth, chopping and changing, and everyone had off-site suppliers and were relying on people on site to coordinate things,” Richard said. “Often there would be two gates for deliveries being coordinated in a meeting on whiteboard, but by the end of the day what people thought was going to happen would get rubbished. “So, I came up with a live scheduling tool, Veyor, which enables visibility on what everyone else is doing live during the day, allowing them to plan the logistics ahead, reducing conflict with things like site access.” What came as a surprise to the start-up CEO though, was the positive impact his high-tech solution was having on workers’ mental health and wellbeing. 20 | Master Builder
Having been in the line of fire himself on the worksite, Richard said stress was a major problem in the construction industry. “I was massively stressed out initially – I was right in the centre whenever there were delivery issues – I got angry phone calls about trucks being backed up, money being lost as people were standing around waiting for material, unable to get on with their work.

While the app has so far mainly benefitted workers on large-scale, multi-site developments such as infrastructure projects, Richard said residential builders had also reaped the benefits. “It’s not just for those big jobs – if you think about it, if there’s one crane or one access lift, that sort of thing, people are all competing to get their time. “If things become a free-for-all, you end up with no room on site with material stacked up and spend hours reshuffling everything. Anything that can help people be more organised and improve planning helps diffuse things.” Buildcorp Contracting Construction Manager Ron Sorich is among those who have realised the benefits.
“I knew that having that digitised central point of coordination would make processes more efficient, but it wasn’t until it was being used in practice that we started to see the other benefits.”

Female students get virtual insight into real world of building Q
UT Lecturer in Construction Project Management, Dr Fiona Lamari has collaborated with Multiplex to create a Virtual Construction Site Tour, with the objective of helping students become better informed. The technology is now being offered to high school students in Brisbane, Toowoomba and Townsville, after a successful tour of three schools in Far North Queensland back in October. “I want to demystify the construction industry through a virtual experience that can mimic a realistic building construction site,” Dr Lamari said. “I want to ignite the curiosity inside female school students and have them walk away with excitement, wanting to find out more.” “It’s important that we reach out to young
women when they are in their high school years and beginning to consider their career path. “We want them to realise that there are many avenues open to them in construction; to know it is safe, rewarding and that there is plenty of support available.” Dr Lamari’s work was realised through the 2019 $20,000 NAWIC International Women’s Day Scholarship Award, recognising her contribution to the enhancement of women’s careers in the construction industry. She is also NAWIC Queensland’s Chair of Education and Mentoring. “I’m so proud to see the ongoing results of the NAWIC National IWD Scholarship and am looking forward to seeing what the 2020 Scholarship recipient brings,” NAWIC National Chair Kristine Scheul said.

revolutionising contract management in the digital space M
aster Builders’ eDocs system provides our members with an easy, fast and convenient way to complete their documents, providing a one-stop shop when it comes to contract management across the residential, commercial and subcontracting sectors. The system uses a custom-designed contract builder admin interface, making it easy for non-technical users to build the contracts using a range of field types, along with property and conditional controls. eDocs has received significant positive feedback from members since its launch in early 2018, with 6,300 of our 8,800 members now actively using it for their contractual and safety documentation needs. Since DocuSign was introduced, 30 per cent of documents have been signed electronically, versus the traditional pen 24 | Master Builder
and paper method. During 2020, DocuSign’s use jumped by 55 per cent, with members loving the no-contact benefit and ease of completing digital contracts throughout the COVID-19 pandemic. Our in-house support desk team is dedicated to the eDocs platform, with phone and email support provided during office hours at no extra charge to members. This expert team always acknowledges support requests within one business day and 80 per cent of requests are resolved on first contact. C
igarette butts could soon be found more frequently on building sites - but not in their usual form. Researchers have come up with an exciting plan to transform the butts into bricks. An RMIT University team led by Associate Professor Abbas Mohajerani has already proven fire-clay bricks made up of just one per cent recycled cigarette butt content are as strong as regular bricks – with the added benefit of using less energy to produce. They’ve also worked out that if just two and a half per cent of the bricks made globally each year incorporated one per cent of cigarette butts, that would offset the six trillion cigarettes produced. With Aussies smoking between 25 and 30 billion filtered cigarettes each year, and seven billion of those ending up as litter, Associate Professor Mohajerani said recycling butts into bricks would not only help the environment, but also cut back on brickmaking production costs. “Cigarette butts are saturated with toxic chemicals, including over 60 known to cause cancer," he said.
“We need to do far more to stop cigarette butts from polluting our streets, rivers and oceans, and prevent them leaching harmful toxins into our environment. “Our ultimate goal is a world free of cigarette butt pollution: our industry implementation plan outlines the practical steps needed to bring this vision to reality.” The plan outlines different methods using whole butts, pre-shredded butts, or a pre-mix where they have already been incorporated into other brickmaking materials. It also looks at safety concerns over toxins from the cigarettes remaining in the bricks, putting builders and homeowners at risk. While heavy metals like arsenic, chromium, nickel and cadmium trapped inside cigarette filters leach into the soil and waterways over the years it takes discarded butts to break down, Associate Professor Mohajerani said they are killed off during the firing process. “The idea for fired clay bricks was to make sure that most of the contaminations will be destroyed. "Later, when we made bricks and did research on this, we discovered that heavy metals are
immobilised inside the bricks,” he said. “During the firing all contaminations, bacteria and all other types of microorganisms disappear, and harmful chemicals combine with other materials during the process of firing, up to 1000 degrees. “Bricks made with cigarette butts are also lighter and provide better insulation – meaning reduced household heating and cooling costs.” Mohajerani has also developed technology for incorporating cigarette butts into asphalt concrete during his 15 years of research into sustainable recycling methods. He said stricter laws and harsher penalties for littering would also need to come into play for the plan to work. “Local authorities would need to provide more specialised bins for cigarette butts, to both prevent littering and enable smooth collection for the brickmaking process. “My dream is a dedicated brickmaking recycling facility in every country that can recycle butts - and solve this pollution problem for good.” Master Builder | 25

ACRS 2021 certificates are online with some important changes
As many of you would have read in previous ACRS features, a number of new Standards were released during 2019 and 2020, some suppliers left the local market whilst others entered, and numerous projects have found that their basic assumption that materials specified and purchased would consistently meet the required standards and specifications have been severely challenged, including that materials would be supplied to projects under ACRS certification, as required. ACRS Certified Steel Reinforcing Materials: Manufacture and Processing The recent release of AS/NZS 4671:2019 and its product requirements initially caused some confusion in the marketplace particularly whether the 2001 edition of AS/NZS 4671 remains valid, or whether the 2019 edition must apply to any supply delivered under ACRS certification. A transition period of 2-years is currently operating, and suppliers are progressively moving to the new Edition. ACRS early JAS-ANZ accreditation to certify to both AS/NZS 4671:2001 and AS/ NZS 4671: 2019 has continued to assist suppliers, building surveyors, government departments and consumers retain confidence in the uninterrupted supply of compliant materials. ACRS is continuing to issue certificates to AS/NZS 4671:2001 and seamlessly update suppliers to AS/ NZS 4671: 2019 as they complete their transition.

AS 4100:2020 Steel Structures was released in August 2020 with ACRS JASANZ accredited to include this new edition in certification from November, providing an important link with ACRS existing JASANZ accredited certification of structural welded sections to AS/NZS 5131:2016 Structural Steelwork Fabrication.
To assist users of ACRS certificates more clearly understand the scope of each certificate there have been some significant wording changes this year that you should be aware of.
With this latest extension to our accreditation, ACRS provides certification across all the necessary standards and government specifications forcibly ending the false claims by some parties that ACRS certification of structural welded fabricated sections does not cover AS/NZS 5131, leaving customers and government departments without their expected coverage by ACRS certification, with consequent contract problems when this was discovered.

WHAT IS HAPPENING WITH THE CASUALS DOUBLE DIPPING CASE?
HOW CLOSE CAN I BUILD TO THE BOUNDARY?
On 20 May 2020 the Full Court of the Federal Court brought down its decision on WorkPac Pty Ltd v Rossato [2020] FCAFC 84, which represents the current legal position on the definition of casual employment in Australia.
The local council planning scheme will generally nominate the Queensland Development Code (QDC) for boundary setbacks. The QDC defines where and how single dwelling houses and associated structures are located on a property. There are different setback requirements depending on the size of the lot.
The decision defines the key indications of casual employment as including irregular work patterns, intermittency of work, unpredictability and the absence of a firm advance commitment to the duration or hours of work. Despite what a contract says, an arrangement that looks like being an offer of continuing work to be performed according to an agreed pattern of full-time hours of work, is indicative of a "permanent" employment relationship. Whether an employee is paid a casual loading is a relevant consideration. To effectively identify the loading, contracts of employment should specify which component of the rate of pay is allocated to a casual loading or monies in lieu of paid annual leave. However, these references will not be sufficient to offset a finding or permanence, if in reality the employment is for an indefinite duration with stable, regular and predictable work. WorkPac has been granted leave to challenge the Full Court decision in the High Court because of the significant impact of this decision on the classifications of millions of casual employees, and the potential costs to businesses who may have to back pay permanent benefits in addition to the casual loading already provided. This is of particular concern in construction where we are advised employees regularly refuse offers of permanent employment in order to access higher hourly casual rates. The outcome of the High Court is not expected to be delivered until the middle of this year. The federal government has recognised the uncertainty and anxiety that is felt by business as a result of this decision and has indicated their intention to intervene in support of the WorkPac appeal. The government has also drafted changes to the Fair Work Act to provide a legislative definition of when employment is casual, when permanent employment must be offered and casual loading may be used as an offset for any later claims for permanent benefits. This bill is currently part of a larger bill before a parliamentary committee, before it will be considered by parliament, most likely within the next two months. It is unknown at the moment what the final content of the legislation will be, but we will keep you up-to-date as information becomes available. In the meantime, employers are advised to ensure that they meet the casual conversion notification requirements of their various awards and use an employment contract that addresses the specifics of the casual employment. There are two parts for design and siting in the QDC: • •
MP 1.1 Design and siting standards for single detached housing – on lots under 450 square metres. MP 1.2 Design and siting standards for single detached housing – on lots 450 square metres and over.
A local planning scheme can provide alternative siting provisions. In some instances, the adjoining neighbour/property owner(s) will need to agree in writing if the setback does not comply with the siting provisions. When building to the boundary you need to check if there are any covenant or development approval requirements. Do these requirements dictate which boundary you can build up to? If you start on site and the adjoining dwelling has already begun and is built to the boundary you were to build up to, raise this with the certifier as soon as possible. There are fire separation and termite requirements under the National Construction Code that you need to comply with. WHAT IS A RESILIENT BUILDING? A resilient building involves adapting the design, construction, and materials into the building to minimise damage caused by natural disasters. This will considerably reduce the effort, cost, and time to get back into your house and get back to normal after a natural disaster. The recent Queensland regional Household Resilience Program saw homeowners get a $350 reduction on their yearly home insurance premium. There are easy retrofits that can be completed If in a cyclonic area: add cyclonic rated window shutters, install additional bolts and stronger hinges to entrance doors so they are less likely to blow open during a cyclone, upgrade the roof and tie down where you can, upgrade the garage door, carry out regular inspections and maintenance of the building. Resilience against floods: Replace carpet with flooring that can be easily cleaned, replace plaster board with wet wall linings, use marine ply where applicable, upgrade windows and doors with materials that better resist flood water. Resilience against bushfire: sealing small gaps around the building preventing ember attack, add fire rated shutters, add fire resistant gutter guard, ensure gutters and yard are clean and maintained. HOW DO I CONTROL FALLING RISKS WHILE WORKING ON A ROOF?
A CONTRACTOR HAS REQUESTED THAT I USE A PAYMENT SYSTEM SUCH AS PAYAPPS OR BUILDTREND. DO I HAVE TO USE THESE SYSTEMS?
Workers installing roof trusses and roof cladding are exposed to the risk of falling through the roof framing, resulting in serious injury. The greater the openings in the roof framing during construction, the greater the risk for a worker to fall. Risks of falling through roof framing include: • • • • •
Installing roof framing where trusses/rafters exceed 600mm centres Installing roof bracing Measuring the top chord for batten setout Installing battens and sarking Installing metal or tile cladding.
Options to control the risk of a fall may include: 1. 2. 3.

Roof design, with truss spacing not exceeding 600mm Roof battens must be installed at 450mm centres A fall arresting platform or temporary work platform erected under where a person is working, and erected to ensure the fall distance is not >2m and can sustain the additional loads that it may be subjected to i.e. person, tools or materials Safety mesh designed to prevent internal falls through a roof and installed in accordance with the manufacturer’s instructions Fall restraint equipment such as harnesses, lanyards, static lines or inertia reels, that physically prevent a person from reaching a position where there is a risk of a fall A combination of controls i.e. fall arresting platform and fall restraint equipment.
“Work where there is a risk of a person falling more than 2 metres” is a high-risk construction activity and requires the PCBU to prepare a SWMS. Controlling the hazards and risk of a fall may vary from project to project. The SWMS for each project must be reviewed with consideration to specific project hazards and risks.
If your contract for that project requires you to submit all payment claims through a payment system such as Payapps or Buildtrend, then it is a contractual obligation to do so. Failing to comply with a contractual obligation is likely to be a breach of your contract. It is important that you carefully read the terms of your contract before signing to determine what method, if any, you are to use to submit a payment claim and then ensure that you comply with that obligation. IF I SEND MY INVOICE THROUGH A PAYMENT SYSTEM, IS IT A VALID PAYMENT CLAIM UNDER THE BIF ACT? If your invoice meets the requirements of a BIFA payment claim (i.e. describes construction work, states the amount claimed, includes a request for payment, is sent on or from a valid reference date and is given to the person who is required to pay you) and you have agreed to give claims through that payment system, then it is likely to be a valid BIFA payment claim. However, care should be taken if you also email a copy of your claim to your client as the first to be sent will take the reference date and is likely to be your BIFA payment claim as only one valid claim can be made from each reference date. THE SYSTEM WON’T LET ME CLAIM FOR UNAPPROVED VARIATIONS SO I WANT TO SEND IT SEPARATELY BY EMAIL AS WELL – CAN I DO THAT? It is best to ensure that you include all items that you want to claim payment for in the one payment claim. Therefore, if there are items that the system does not let you include in your claim then send the full claim by email PRIOR to submitting a part claim via the payment system. The email sent first in time is likely to be the valid BIFA payment claim. IT COSTS ME MONEY TO SIGN UP TO THESE PAYMENT SYSTEMS, CAN I CLAIM THESE BACK FROM THE CONTRACTOR?
WHAT ARE THE REQUIREMENTS FOR BATTEN SPACINGS ON A ROOF?
These apps often require a monthly fee to use. Make sure your contract states who will pay those fees. If nothing is stated, then it is likely to be you because you have agreed to use the app to submit your payment claims under the contract.
Where the roof framing members are >600mm spacing, there is a significant risk to a person falling due to the opening size.
HOW CAN I TELL IF MY SUBCONTRACTOR HOLDS THE QBCC LICENCE FOR THE RIGHT ENTITY?
In these situations, roof battens must be installed at 450mm centres, providing significantly reduced openings due to the increase in truss spacings. It must be remembered that ceiling battens are not roof battens and ceiling sheets should not be relied upon to arrest a fall.
The QBCC Licensee Register has been recently updated and now shows the ABN and/or ACN of the entity that holds the licence. We strongly recommend that you check that your licence matches the entity that you are running your business through and do a similar check on all of your subcontractors. If you have any concerns or identify any errors, it is important to promptly advise the QBCC in writing to ensure that you are not in breach of the QBCC Act and/or your contract.
The battens must be strong enough to span the top chord of trusses or rafters and prevent a person falling through the spacing. Roof batten installation presents a degree of risk, additional control measures mentioned earlier, may be required during batten installation. Lobbying win for erosion and sediment control Following relentless lobbying of the Department of Environment and Science, Master Builders has successfully made changes to the compliance Procedural Guides for erosion and sediment control on building and construction sites. The new guides address the problem previously faced, where a $10,000 penalty could be applied to a contemplated offence. That means a situation where no actual earth sediment deposit has occurred. The change now clarifies that authorised
officers are required to exercise discretion when making compliance and enforcement decisions in certain circumstances. Specific scenarios are now provided that describe where it is necessary and appropriate to bring the issue or offence to the attention of the builder, and allow them reasonable time to rectify before they can be held accountable for the deposit. It is recommended that in these situations the builder - as identified by the signage on site, and any follow-up enquiries with the
relevant local government - is given a warning directly by telephone or via email identifying that a prescribed water contaminant has been deposited on the site, or that the potential for release exists. The guide also now advises that builders have up to 24 hours to notify the authorised officer the rectification has been completed. In the absence of confirmation, further action will be taken. Dealing with MEETINGS OF CREDITORS A liquidator may call a creditors’ meeting from time to time to inform creditors about the liquidator’s progress, to find out creditors’ wishes on a matter or to approve the liquidator’s fees. Creditors can use a creditors’ meeting to ask questions about the liquidation and tell the liquidator what they know about the company. WHAT IS A LIQUIDATOR? A liquidator is person appointed to take control of a company so its affairs can be wound up in an orderly and fair way to benefit creditors. In essence, their role is to collect and sell all of the assets of the company and distribute the funds to the company’s creditors in accordance with priorities laid out in the Corporations Act 2001. HOW IS A LIQUIDATOR APPOINTED? A liquidator can be appointed either by the shareholders of the company voting to liquidate the company and appoint a liquidator (i.e. a members’ appointment), or the creditors of the company voting to liquidate the company and appoint a liquidator following a voluntary administration or a terminated deed of company arrangement (i.e. a creditor’s appointment). THE ROLE OF THE LIQUIDATOR Liquidators owe a duty to all of the company’s creditors. Their role is to protect, collect and sell the company’s assets, as well as investigate and report to creditors about the company’s affairs. This includes unfair preferences (payments made to certain creditors over others) that may be recoverable; uncommercial transactions that may be set aside; possible claims against the company’s officers (including insolvent trading); and creditor-defeating dispositions, including illegal phoenix activity. They also inquire into the failure of the company – and possible offences by people involved with the company – and report to ASIC; and distribute money from the collection and sale of assets.
SECURED CREDITORS VS UNSECURED CREDITORS
REPORTING TO CREDITORS
A secured creditor holds a security interest, such as a mortgage, in some or all of the company’s assets, to secure a debt owed by the company. If the creditor wants to ensure their security interest over personal property (i.e. an asset other than land) is enforceable, and given priority in an insolvency, they must have registered the security on the Personal Property Securities Register (PPSR) in accordance with the requirements of the Personal Property Securities Act 2009.

Before any dividend is paid to creditors, they will need to give the liquidator information to prove their debt. The liquidator will notify creditors if funds might be available for payment and will call for formal proof of debt forms to be lodged. The liquidator must give creditors at least 14 days’ notice of the deadline to everyone claiming to be a creditor whose debt or claim has not already been accepted. Creditors should attach copies of all relevant invoices or other supporting documents, because the debt or claim may be rejected if there is insufficient evidence. The completed form must be delivered or posted to the liquidator.
If there are funds left over after secured creditors have been satisfied, and the liquidators’ costs and priority creditors (including employees) have been paid, the liquidator will pay unsecured creditors a dividend, generally in the following order:
If the liquidator decides to reject a claim, they must notify the creditor within seven days and provide reasons why. If dissatisfied with the decision, a creditor ought to follow the steps outlined in the notice of rejection and/or seek competent legal advice on your options to appeal the decision. A failure to appeal a liquidator’s decision in time will mean the liquidator’s decision is final.

Each category must be paid in full before the next one. If there are insufficient funds, the available funds are paid on a pro-rata basis, and the next category or categories will be paid nothing.

WHO NEEDS TO PROVIDE AND RECEIVE REQUIRED INFORMATION? Everyone in the chain of responsibility (supply chain) needs to provide and receive required information. This includes those who design, manufacture, import, supply or install, including principal contractors. A building product used or intended for use in Queensland must have required information available to articulate how products are used safely and compliantly. If you receive a building product, you should ensure you get the required information. Make sure you are satisfied it tells you everything you need to know to use the product safely and compliantly. Ensure that this record is kept where it can be accessed and reviewed by everyone within your business involved with the supply and installation. HOW CAN TECHNOLOGY HELP YOU? Technology can make the means of providing required information simple and effective. For example, preparedness for COVID-19 contact tracing has increased awareness and use of QR codes. QR codes could be included on packaging, invoices, or pointof-sale materials linking to product data on your website. This can make it easier for those using or gathering information on the intended use of the product. It also allows for website information to be updated or expanded, without having to reproduce hard copy documents, allowing potential time and cost savings. YouTube or an online video streaming service is another option. You can provide an instructional video for the use and installation of products that can direct users
to your website for further information. UNDERSTANDING THE PRODUCT For a person to use a product correctly, they must understand: •
a product’s intended use
•
all relevant requirements of the National Construction Code or other applicable laws regarding the use of the product
•
required information, including instructions on how the product must be installed to avoid: •
it becoming unsafe, or
•
no longer meeting requirements for its intended use.
Technology can be used to help everyone in the supply chain better understand a product. It can provide easy access to a product’s required information for its intended use. This helps give people confidence in your product as they can readily gain knowledge about it, while at the same time assisting in discharging your duty to provide the required information. QBCC Minimum Financial Requirements: Start 2021 the right way Did you know that you’re required to keep quarterly financial statements for your business to ensure you continue to meet your Minimum Financial Requirements (MFR) obligations? Xact Accounting CEO Michael Renton said investment in quarterly reports was well worth the time for licence holders. “There is a high volume of QBCC licensees who have been shocked to find out their licence has been conditioned or suspended by QBCC for failure to meet MFRs,” Michael said. “Often, the financial statements have been poorly constructed, or the licensee has been poorly advised about how best to ensure they continued to meet MFRs.” The QBCC Act and Regulations are highly detailed and outline requirements for the current assets to liabilities ratio, Net Tangible Assets and Maximum Allowable Turnover.
Net Tangible Assets must not fall by more than 30 per cent at any time for licence categories SC1, SC2 (categories 1, 2 and 3). For categories 4, 5, 6, and 7, it must not fall more than 20 per cent. Similarly, turnover cannot exceed your Maximum Allowable Turnover by more than 10 per cent during the financial year. The continued monitoring of these conditions allows a business crucial time to amend any potential shortfalls. “Recently we worked with a young builder who was referred to us by Master Builders Queensland after his accountant failed to properly arrange his balance sheet to comply with the QBCC Regulations,” Michael said. “He had not shown work-in-progress, had not properly classified the current and noncurrent liabilities, and had also written-off his assets according to tax rules rather than accounting rules.
“We were able to revalue the assets writtenoff by the previous accountant and properly arranged his balance sheet. We were then able to show cause why his license should not be suspended and since, the builder has been working as normal.” All annual financial statements must satisfy MFRs and be lodged before 31 December. Steel reframing carpentry skills With steel house frames becoming increasingly popular as a mainstream alternative to timber, the next generation of tradies undertaking Carpentry Certificate III will be required to show equivalent skills and knowledge with steel frames, which was previously only mandatory for timber frames. The inclusion of steel frames as part of this qualification will ensure apprentices are job ready with knowledge, experience and skills specific to steel frame installation. idely acknowledged and respected as one of the driving forces in Queensland’s construction industry, former President and Life Member Walter Sommer OAM will always be regarded as a pioneer and friend by Master Builders, following his untimely passing on 24 November 2020. Walter’s career began in masonry in his native Germany before he moved to Australia at age 14. Here, he took up a bricklaying apprenticeship before switching to carpentry, on a recommendation from renowned architect Harry Seidler during a chance
meeting. Walter was given the opportunity to work in Bougainville, inspiring his passion for training through his role educating local staff. Walter joined Master Builders in 1975, making an outstanding contribution to our organisation with a personal desire to enhance the industry, equalled by only a few. He served as President in 1988 and ‘89, was the initial Chair of the QLD Housing & Construction Group Training Scheme, a QMBA Trustee, Executive Member of the State Training Council and Construction Industry Training Council, Chairman of the
QLD Institute of Arbitrators, and Director of the Construction Industry Skills Centre. He won Master Builders’ inaugural Outstanding Achievement in the Building & Construction Industry award, received an Order of Australia medal in 2004 for his service through the development of industry-based training programs, and was elected a Master Builders Life Member in 2009. As Walter himself told Master Builder in 2001, “there’s a lot of satisfaction to be gained from teaching people who really want to learn and improve themselves.”

“It’s something that’s provided me with strength that not all others have in this industry,” he said. “I saw that I could bring a different approach with my experience renovating homes in London and dealing with clients with a positive approach. So, I decided to go out on my own, and I’ve never looked back. “It feels amazing to get the accolade for all the hard work – the blood, sweat and tears over the years. Something I’m really proud of is that I built TCNQ up from the ground, started out all on my own, growing to all the employees we have today…never in my wildest dreams would I have thought that we would be where we are today, and I am very grateful for that. “The thing I love most about my job is delivering a dream space for our clients and seeing their reactions to what we have created for them and the memories that they will be making in their new spaces and homes.” Working alongside wife Melissa every day is something that brings them both joy – and that family connection is something Ricky regards as at the core of their business. “We want to create that feel-good

approach in our business, and having Melissa with me through this journey paves the way for the future. We’re enthusiastic as a team and share the same values and passion which is showing through our success in business so far…and she puts me in my place when I need to be told every now and then!” Like countless others in the industry, TCNQ lost several contracts when the COVID-19 hard lockdown began, but the Townsends managed to adapt and keep all their employees busy through the initial wave of uncertainty. “We ensured we followed every email from Master Builders and adhered to their checklists and support documents,” Ricky said. “Our year has been a difficult one, however we have remained calm and educated and have been able to prevail through these difficult times and secure our biggest contracts to date. We remain vigilant and take on the work as hard as we can, whilst the work is there.” As for 2021, Ricky said this year was definitely “starting off with a bang.” “We are looking at building spec-type Hamptons-style homes that fit with the Queenslander style but are new, meaning home buyers don’t they have to spend their weekend maintaining them. “We've also purchased our first commercial property which we're very proud of."

BECOMING A TRADIE WAS NOTHING SHORT OF INEVITABLE FOR BAILEY. “If you ask my parents, they’d say that all growing up, I’d wear a hard hat and walk around saying I wanted to be like Bob the Builder,” Bailey said. After discussing his career plans with a mate, Bailey decided to give Tech NQ’s try-atrade program a go – and found carpentry was the most “easy flowing” for him, winning several academic awards and high praise from his teachers. It was the buzzing atmosphere of tradies at work on a new residential street during his work experience that Bailey credits for confirming it was where he wanted to be. Three years into his apprenticeship at TCNQ, Bailey’s natural talent and commitment made him a standout for the Award.
“Life takes you on many roads, and this path I honestly did hesitate taking it initially, but I am very glad to be on this journey now and embracing the many different elements of the building industry,” Melissa said. “I think the houses talk to me. I am all about restoring the old and adding modern elements to really bring out the beautiful features within homes. I definitely wasn’t interested in the building industry initially, but I have a large interest in it now.” Melissa is the backbone of the family business, running the contracts, accounts
and bookkeeping – as well as being a mum to the couple’s three children – meaning no two days are the same. She also pioneered a renewed focus on social media, working with a photographer to pinpoint and promote the TCNQ brand – something that’s proven to be a smart move given the emphasis on the digital space in the COVID-19 environment – and is now studying interior design. As for her Women in Building Award, Melissa named it her proudest achievement in her career thus far. “Master Builders has provided an amazing platform for women, particularly in the construction industry, and allowed them to have a voice. " It means so much to me to win such a significant award in construction, and I hope it helps empower other females to be more involved.”
“It was a real surprise, because I went to school with a lot of the great apprentices in Townsville and I’m still friends with a lot of them,” he said. “So the fact that Ricky nominated me and I that actually came through and won it was a big shock. It was a big kind of reassurance that I’m doing the right thing, and the fact that I won it definitely confirms that this is what I should keep doing, and this is what I’m good at. “Making sure my quality of work stays up there is the most important thing to me. " The Townsends credited Bailey for his “immense” work ethic - saying the apprentice beat the boss to the office every day, raring to go. “I’ve had some tradesmen come through that can’t make it through the end of the week, and he’s showed them up," Ricky said.

From rising star to people’s choice FOR MORE THAN 30 YEARS, THE HOUSING & CONSTRUCTION AWARDS HAVE PUT THE SPOTLIGHT ON THOSE AT THE TOP OF THEIR GAME AND ARE REGARDED AS THE PEAK OF SUCCESS ASPIRED TO BY OUR MEMBERS, SPANNING THEIR ENTIRE CAREERS. Among the cream of the crop in 2020 was Paul Harms. Seven years on from his Gold Coast Rising Star Award, the Burleigh-based director of PJH Constructions picked up two Awards for his stunning Bajo El Sol project: the Ron McMaster Award for Excellence in Craftsmanship at the Gold Coast awards, and People’s Choice at the Queensland awards. “It has been an absolute honour to receive these awards,” Paul said. “I was absolutely blown away to win the Rising Star Award back in 2013 and I remember being in awe of the individuals receiving the Ron McMaster Award at the time. “Winning that is definitely the proudest moment in my building career. Ron was apparently well- known for his excellence in craftsmanship, and to receive this award on
the Gold Coast is amazing. “I completed my apprenticeship in a small country town where we did every part of the build from the ground up, which has given me a great appreciation of hard work, attention to detail and quality craftsmanship. “The People’s Choice award is really exciting to win because it’s so gratifying knowing that people really love the work you produce. Bajo El Sol is such an exceptional home and it’s captured so much attention and positive feedback.” Paul said the way he approaches his work and business has become more streamlined since the early days. “Initially I did absolutely everything from quoting through to cleaning a project. Now we have a more professional building project management program, designated high level supervisors coordinating every project, and an office manager. We feel privileged that people seek us out to undertake their builds and entrust us to bring their dream home to fruition.”
There have and will be plenty of lessons learned along the road to success – with the most important for Paul being that his team is his greatest asset. “I have the utmost trust in all of my team to do an exceptional job all of the time. We are family centred and knowing that your carpenters and staff are professional, quality focused and respectful is the most valuable thing any business can have.” Buoyed by his success, Paul now has the 2021 Awards in his sights. “We will be entering a few categories this year. Most likely a multi-residential project, a renovation up to $575,000 and a new build in the over $1.25 million category. “These are all local projects in Burleigh Heads that we are proud of. We treat all of our projects as if they will be entered in for an award ensuring they are completed to the highest standard. We are committed to entering awards each year and feel it’s important to have achievements recognised and to support our fellow building companies.” Master Builder | 51

aster Builders CEO Grant Galvin and Director – Business Development and Membership Sue-Ann Fresneda were proud to join an esteemed group honoured at Autism Queensland’s 2020 Creative Futures Recognition Awards. Now in its 14th year, the awards recognise the contributions of people living with autism, as well as the parents, carers schools and businesses who support them. The Governor of Queensland and Autism Queensland patron, the Honourable Paul de Jersey AC presented the awards at Government House, Brisbane to coincide with the International Day of People with Disability on December 3. Mr Galvin accepted a special commendation in the Patronage Award category, recognising Master Builders’ donation towards the redevelopment of Autism Queensland’s school at Sunnybank Hills, utilising the remaining voluntary contributions from our members. Armstrong Building began work on the $2.5 million project in August 2020, with construction completed in mid-January.

Schooling up on BIF as QBCC clamps down T
he QBCC is in the process of auditing contractors to check compliance with their obligations for payment schedules under the BIF legislation. The audit program covers both builders and trade contractors. The focus is Category 2 licensees ($3 million to $12 million) who have not had a moneysowed complaint or adjudication in the past 18 months. This category appears from the QBCC data to have the highest proportion of moneys-owed complaints, suggesting they’re at a higher risk of failing to comply with payment schedule obligations. By focusing on licensees who have not come to the QBCC’s attention recently for payment issues, they expect to be able to ascertain the underlying rate of (non-)compliance within that cohort.

It's not yet clear how the QBCC will determine whether a payment claim and/or payment schedule is valid. It's an offence not to comply with the document request by the due date. The maximum penalty is 100 penalty units, or approximately $13,500 - and/or your licence could be suspended or cancelled. The QBCC has advised us it will take an educative approach to the audit as long as there is no serious harm to a subcontractor discovered. However, it's likely to be best for you to acknowledge past mistakes and to provide some evidence that you have made changes to your system to ensure future compliance.

The audits will be completed by 30 April 2021, and it's expected that 200 out of the estimated 5,000 Category 2 licensees will be sent notices.
