Bring Back the Boost with Ralf Dutton, President

OUR recent campaign calling on the Queensland Government to bring back the First Home Owners' Boost was met with approval from members and industry and sparked significant engagement with local MPs across Queensland. Regional Queensland is facing a gloomy year ahead in the wake of a trending decline in building approvals. Armed with data that proves the First Home Owners’ Grant is critical in supporting demand for new housing in regional Queensland, in November 2018 we launched a campaign calling on the Queensland Treasurer to Bring Back the Boost. As the declining data trends continue, we know that something needs to be done to spark demand and spending an expected 4 | Master Builder

surplus in mining royalties seemed like a good opportunity. The mining royalties’ windfall is expected to pour an extra half a billion dollars into the government’s coffers this financial year, and our view is that it’s a good opportunity for the Treasurer to reinvest the money back into regional areas. Armed with support from members across regional Queensland, our Bring Back the Boost campaign features a television campaign, digital advertising, print and radio campaigns across Queensland. We also engaged extensively with MPs from across the regions to garner support. Response to the campaign was overwhelming with members voicing their support and getting behind the campaign by contacting

their local MPs personally. So far, we have received an indication of strong support from many MPs, particularly those in regional areas who are really suffering the effects of weak demand and would benefit greatly from a shot in the arm. The $5,000 extra boost was a vital tool for first home buyers to get their foot in the door of the housing market and if we Bring Back the Boost, we can start to stimulate demand and give would-be home owners a leg up. While no announcement was made during the mid-year Financial Update, we will continue to push the government as part of our annual lobbying campaign and 2019 State Budget submission.

BIF train has left the station with Grant Galvin, CEO

THIS YEAR is going to be a big one for the building industry in Queensland with BIF changes, including Project Bank Accounts (PBAs), set to be introduced this year. The time for opposing Project Bank Accounts is unfortunately officially over. Despite our best efforts, Minister for Housing & Public Works, Mick de Brenni, is hell bent on introducing these reforms into the private sector – regardless of our warning that they will be to the detriment of many in the industry and will not provide the level of security he promises. The government’s review panel is meeting one-on-one with builders across the state who are already delivering government projects with PBAs. It has also conducted a second round of Industry Forums. However, word on the street is that regardless of the outcome of the review, PBAs will be introduced in the private sector during 2019. When is unclear, but we shouldn’t be surprised when their introduction is announced. 6 | Master Builder

We maintain our stance on PBAs and don’t support their introduction into the private sector, but it’s now time to focus our efforts on the elements we can change, rather than the ones we can’t. We are recommending a number of changes, which include applying PBAs to the entire supply chain, from principals/developers through to suppliers. If the government’s view is that PBAs will work so effectively, why not allow everyone in the chain to benefit – particular those builders who suffer non-payment at the hands of developers; and sub-subcontractors who aren’t paid by subcontractors? All’s fair in love and war, after all. Some of the detailed changes for the PBA regulations include: a minimum subcontract price for subcontracts to fall within a PBA; a minimum payment to be made out of the PBA; inclusion of a ‘reasonable excuse’ provision for payments; removing the principal’s viewing rights; removing the requirement for

bank accounts to list the transactions for a retention account; and permitting retentions to be accessed by the head contractor when permitted to do so under the subcontract. We’re also recommending some changes to progress payments: removing the requirement that payment claims must state ‘payment claim made under Chapter 3’; removing the restriction for resident owners in Chapter 3 and applying the adjudication process to all respondents; fixing the discrepancy between the two acts in the definition of ‘business day’; including ‘reasonable excuse’ provisions for respondents responding to payment claims; and deleting the provision that a written document bearing the word ‘invoice’ is taken to be a request for payment. As we’ve stated in the past, we have issues to face as an industry, but overregulation is not the answer. Let’s work together to get these issues fixed before costs and red tape increase further.

What’s on the horizon: 2019 with Paul Bidwell, Deputy CEO

BUILDING activity levels continue falling from the highs of 2016 and we face the prospect of more daunting legislative changes 2019 – will be a challenging year. We expect the residential sector to slip slightly from the 42,000 commencements in 2018 to 40,000 in 2019. Worryingly, the drop will be largely in detached housing, with the impact felt across the state. Tightening in lending requirements is largely to blame for this dip. However, we hope this is a passing phase, due to solid underlying market fundamentals of employment growth, rising wages and a rising population growth rate. While regional Queensland was looking up in 2018, this has also begun to turn, with our regions particularly vulnerable to tightening lending conditions. On the flip side, there are some large scale resource and renewable energy projects and the tourism sector is performing well. This should drive some construction demand and prevent a return to the grim conditions from which our regions have only just emerged. 8 | Master Builder

Non-residential building activity is also expected to fall and construction in the retail and wholesale trade sectors looks to decline significantly over the coming year. The tourism and office sector will also fall away. However, there is some good news for commercial builders in the health, aged care, industrial and transport sectors. The outlook for 2019 is far from rosy. The forecast for industry conditions to continue deteriorating during 2019 means it’s critical that we lobby on behalf of industry for positive change to will soften the impact. Our message to the state government will be to consider the outlook for our industry when making any policy decisions. As well as dealing with tricky economic conditions, the industry will need to cope with a wave of legislative change. It is clear that Minister Mick de Brenni is determined to introduce Project Bank Accounts into the private sector sometime in the second half of the year (see more on page 6). We also expect the state government to continue with the next tranche of reforms laid out in the 2016 Building Plan, which includes:

We’ll be proactively lobbying and working with government to get the best result we can for the industry and to minimise the impact of these reforms. In addition to responding to these issues, we will push the government to increase the capital spend on government buildings and to reinstate the $5,000 Boost to the First Home Owners' Grant (see page 4). A casual’s right to elect full-time employment A RECENT decision by the Fair Work Commission (FWC) has extended the right for casual employees to request to convert to full-time or part-time employment across a range of industries. Workers engaged in the construction industry and covered by any of the following awards, have always had the right to convert to fulltime or part-time employment following a period of six months’ regular and systematic work as a casual employee: •

Building and Construction General OnSite Award 2010

Plumbing and Fire Sprinklers Award 2010

Manufacturing and Associated Industries and Occupations Award 2010

Joinery and Building Trades Award 2010

Mobile Crane Hiring Award 2010

Timber Industry Award 2010 (wood and furniture stream)

A recent decision by the FWC has extended this right to convert to a number of additional industries, including workers covered by the following Modern Awards: •

Clerks Private

Sector Award 2010

Pest Control Industry Award 2010

Gardening and Landscaping Services Award 2010

Under these Modern Awards, casual employees will have the right to elect to permanent employment following a period of 12 months’ regular and systematic work.

The casual employee is not truly a regular casual employee

It’s known or reasonably foreseeable that the regular casual employee’s position will cease to exist within the next 12 months

It’s known or reasonably foreseeable that the hours of work which the regular casual employee is required to perform will be significantly reduced in the next 12 months; or

It’s known or reasonably foreseeable that there will be a significant change in the days and/or times at which the employee’s hours of work are required to be performed in the next 12 months which can’t be accommodated within the days and/or hours during which the employee is available to work.

What is regular and systematic work? A ‘regular and systematic’ casual employee would generally have worked an ongoing pattern of hours which, without significant adjustment, could continue to be performed as a part-time or full-time employee. What do I have to do? For employers who engage workers under any of these newly captured Modern Awards, you are required to, within their first 12 months of employment, provide to casual employees a copy of the casual conversion clause (existing employees should have received a copy of this clause already). For employers who engage workers under any of the awards that have always had this right to convert, your obligations have not changed, and employees must be informed of their right to convert within four weeks of reaching their six-month anniversary. Can I refuse a request to convert? Should you refuse a request to convert, the reasons for doing so must be fully explained

Latest blog: 2019 set to be a challenging year What’s going to work in our favour? Renovation activity will remain solid. Tougher credit conditions will encourage many owners to stay put and renovate rather than sell and upgrade to a new home. Concentrated population growth in the south east will continue to favour unit developments, while detached housing will see growth where there’s land and finance available. In the non-residential space, the health and aged care segment will continue to benefit from high demand due to an aging population. Many projects are likely to be advanced to take advantage of the reduction in infrastructure charges in Brisbane, pushing up the statewide totals. Industrial and transport buildings are also all expected to enjoy strong demand. What will make it a challenge?

The tightening access to finance is going to affect all parts of our industry. Restrictions on development finance, builders’ overdrafts and customer mortgages will leave no-one unaffected. The effects of the government’s new restrictive building industry legislation is also likely to affect the viability of new construction, causing further concern. Demand in the most important area for non-residential construction, the retail and wholesale trade buildings, will decline significantly over the coming year. Office building will also fall away in 2019 before bouncing back in 2020. Investment in the tourism industry has passed its peak and new work will fall away significantly. What will keep the industry afloat across Queensland? In Brisbane, the Cross River Rail, new Brisbane Airport runway, Queens Wharf, Brisbane Live and the ICON Ipswich renewal project will drive the capital’s long-term growth. The Jewel Development, Gold Coast Integrated Resort, The Surrounds at Helensvale and Westfield Coomera will be big players down south, while the Sunshine Coast Airport Expansion and Maroochydore CBD will help non-residential work along at the other end of the coast. Toowoomba, which enjoys the state’s strongest employment growth will benefit from the catalytic investment in the Second Range Crossing and the Brisbane West Wellcamp Airport, while the Wide Bay Burnett region will gain further momentum with local councils that are proactive and ready to support and develop the economy. Work from the Australian Defence Force’s investment in Shoalwater Bay will be a major driver in Central Queensland, and the Stadium Northern Australia in Townsville will continue to create a spike in work. Demand is back for new construction in Mackay & Whitsunday and Far North Queensland is set to become the growth centre for renewable energy investment and continue its tourism success.

The Wide Bay Burnett region is serviced by four regional councils and is separated into two major, distinct economic areas; the Fraser Coast and Bundaberg.

Ian Langer THE Wide Bay Burnett region extends north from Gympie to Agnes Water and inland to the grazing and agriculture areas of the North Burnett. It covers approximately 50,000 sq km, has a combined population of more than 211,000 people and is anticipated to reach over 265,000 by 2036.

The region’s economy is driven by a diverse mix of agriculture, health services, construction and manufacturing. Iconic brands such as Bundaberg Rum, Bundaberg Brewed Drinks and Bundaberg Sugar are still manufactured locally and continue to expand operations adding construction and manufacturing jobs to the local economy. commercial and residential construction and attracting new residents. This has been supported by good availability of land for developments. A new $53 million sports precinct is also nearing completion. In Maryborough, Hyne Timber, and manufacturing giant Downer, well-known for train building in the city, continue major operations. Hyne has just announced a $20 million investment in the construction and fit out of a state-of-the-art advanced manufacturing glue laminating timber plant that will employ an additional 42 jobs and position Hyne as the largest manufacturer of glue laminated construction products in the Southern Hemisphere. Downer has recently received another $80 million contract to rectify the Indian manufactured trains purchased by the state government. The North Burnett’s diverse wealth of agriculture and mining operations contribute strongly to the local economy and it has been experiencing solid growth in building approvals recently. Several major new solar farm developments are in various stages of completion, creating new jobs and will contribute strongly to local renewable energy sources.

FROM drone technology to artificial intelligence and exosuits, 2019 is set to be a year of continued innovative advances with applications for the building and construction industry progressing. Be it time saving, cost saving or life changing opportunities that push boundaries and create new opportunities, it’s an exciting time to look forward and delve into what might be on the horizon for our great industry.

DRONE TECHNOLOGY IT’S NOT necessarily a new technology but the way drones are used in the building and construction industry is likely to advance in 2019 and beyond. A CSIRO report, Are you ready for change, Farsight for Construction Exploratory scenarios for Queensland’s construction industry to 2036, noted Building Drone Operators as a possible job for the future of our industry. The report indicated these professionals would use drones to conduct activities that may include site inspections, maintenance and deliveries. This would allow operators to be based in offices whilst providing timely, on-the-ground support. Other applications may include site surveying, surveillance and security along with communication activities.

EXOSUITS STRAIGHT out of a Marvel movie, exosuits are designed to mimic or automate human movement to make difficult tasks, such as overhead work or heavy lifting, easier. Whilst a long-running barrier of their roll-out has been the ability to power the suits, an application in the construction industry may be passive and unpowered, rather than relying on counterweights. This would allow the suit to be used to prevent or reduce injuries, wear and tear on the body and allow injured workers to return to work sooner by taking pressure off muscles and joints. Whilst they may not give you the powers of Ironman, a CSIRO report looking at Queensland’s construction industry to 2036, indicated the suits could also be used for the ageing population.

ROBOTICS AND AI AN INTRODUCTION of robotics and Artificial Intelligence (AI) could be used to support labour intensive, highly repetitive and dangerous activities in our industry. When thinking about these advances, it’s important to understand the difference between a robot and a machine. While an exoskeleton or a drone may seem robotic, it’s controlled by a worker and currently, is unable to be used and guided without the interaction of a worker. Robotic creations may include everything from brick and tile laying to building timber and steel structures. Beyond this, complete autonomous vehicles, such as dumpers and dozers, could transport materials and work around the clock on building sites without the requirement for breaks due to fatigue. Email the way to go EMAIL is, and continues to be, an important and effective way to market your business and engage your audience. Changes to the NCC in 2019 to create new timber opportunities for mid-rise designers, developers & builders

C

hanges to the 2019 National Construction Code Volume One (NCC) increase the range of buildings, up to an effective height of 25m, in which fire-protected timber construction systems can be used. The new Classes add schools, retail premises, hospitals and aged care facilities to the previously approved multi-residential, hospitality accommodation and office buildings.

In 2016, following extensive work and a successful submission by Forest and Wood Products Australia (FWPA), the company behind the WoodSolutions Program, a Deemed-to-Satisfy solution was introduced to the NCC permitting, for the first time, construction in fireprotected timber building systems to an effective height of 25 metres (typically 8 storeys) for Class 2, 3 and 5 buildings.

FWPA National Codes & Standards Manager, Boris Iskra, who lead the submission process for the 2016 and the current 2019 NCC changes, said that due to the new provisions, builders and developers wanting to use timber will no longer have to undertake timeconsuming and expensive ‘performance solutions’ to gain building approval, as long as their designs meet the Deemed-to-Satisfy requirements. In effect, it opens the door to a wide range of options and combinations, for example, designers can now create mixed use mid-rise timber buildings, with residential upper levels and lower levels used for office space or retail.

In the 2019 edition, these concessions will be extended to include all Classes of buildings, enabling the use of timber building systems in aged accommodation, schools, retail and hospitals. Timber building systems include traditional lightweight timber framing and the newer mass timber

These new concessions include some reductions in fire resistance levels and extended travel distances which will translate to potentially improving lettable space within buildings. Boris provided the example of a building that will now require one fire stairway, whereas it previously might have required two. He pointed out that there are also modifications to hydrant protection that may also deliver cost savings, further offsetting the additional cost of sprinkler protection. CAN A CASUAL GET A CASUAL LOADING AND CLAIM ANNUAL LEAVE?

WHAT TOLERANCES APPLY TO STAIRS?

On 18 December 2018, the federal government introduced a new regulation to prevent the situation where a casual employee can be paid a casual loading but still claim for leave that would accrue to a permanent under the National Employment Standards (NES). The potential for a “double dip” situation had arisen from a recent Federal Court decision where a casual employee who had an ongoing and regular work pattern was found to have been misclassified as a casual. How? Because his roster demonstrated a firm commitment from both parties to ongoing engagement. The regulation makes it clear that casual loading is paid in lieu of usual entitlements associated with permanent employment. The regulation applies if:

Stairs must be built with constant goings and risers, except as permitted by the variations stated within sections 3.9.1.2 Volume Two and D2.13 Volume One of the National Construction Code. The variations are intended to account for conditions, such as movement of materials due to atmospheric moisture changes or minor deviations in materials. The finished going and riser dimensions must not exceed the limitations for the maximum and minimum dimensions as stated in the code. The allowable tolerances have two concurrent requirements: A)

Adjacent risers or adjacent goings must be within 5mm of each other; and

B)

The largest and smallest riser, or the largest and smallest going within a flight must be within 10mm of each other.

An employer has paid a clearly identifiable loading to compensate a person for not having one or more relevant NES entitlement

The diagram below illustrates an entire flight with minor deviations in the materials affecting the finished riser dimensions.

The person makes a claim to be paid an amount in lieu of one or more of the relevant NES entitlements

The person is found to have been misclassified as a casual employee for the purposes of the NES and is therefore entitled to NES entitlements (such as annual leave accrual).

In addition to the 5mm difference permitted between adjacent goings or risers, the maximum difference between the smallest and largest going or riser within a flight must not exceed 10mm. The same principle applies for variations between goings.

In these cases an employer may make a claim to have the loading amount offset against any amounts found to be payable for leave accruals under the NES, thereby reducing any amount payable. Examples of where a loading amount is considered ‘clearly identifiable’ include in correspondence, pay slips, contracts or in a relevant industrial instrument. The regulation makes clear that it applies to employment periods that occur before, on or after commencement of the regulation. DO MY EMPLOYEES HAVE A RIGHT TO TAKE FAMILY AND DOMESTIC VIOLENCE LEAVE? On 1 August 2018, all awards were updated to include unpaid family and domestic violence leave. From 12 December 2018 this entitlement was extended to all full and part-time employees, even those who aren’t Award covered. An employer can ask their employee for evidence that shows the employee took the leave to deal with family and domestic violence (for as little as one day off work). If the employee doesn't provide the requested evidence, they may not get family and domestic violence leave.

HOW DO I PREVENT SLAB EDGE DAMPNESS? It’s a common practice in Queensland to build residential concrete raft slabs in a two-pour process. The installation details in AS 2870 Residential Slabs and Footings indicate that where justified by satisfactory local experience, a vapour barrier may be terminated at the internal face of the external footing beams during that process. It’s important to note that Sect 3.2.2.6(c) of the Building Code Volume 2 states a construction practice that differs from the option in AS 2870.

WHY ARE INSPECTORS INCREASINGLY VISITING WORKPLACES? Increased Workplace Health and Safety Queensland (WHSQ) Inspector activity at workplaces can be attributed to the recent change to the regulator’s compliance and enforcement policy. WHSQ inspectors may come to site for a number of reasons. Predominatly, their presence is to ensure safe work practices are being implemented and adhered to.

WHAT WILL HAPPEN WHEN AN INSPECTOR VISITS MY WORKPLACE? WHSQ aims to work with businesses to help improve workplace health and safety. When an Inspector visits your workplace they will identify themselves on entering and advise you, the person conducting a business or undertaking (PCBU), of the reason for their visit. WHSQ Inspectors may visit workplaces in response to an incident, complaint or at the request of a business asking for assistance to ensure the effectiveness of your WHS systems. When an inspector conducts an investigation it’s to establish the cause of the incident and if there has been a breach of work health and safety legislation. During the visit an inspector may undertake inspections of the workplace or plant and equipment, such as scaffolding or mobile plant, ask questions of workers or supervisors and review documentation, such as plant inspection records, to ensure you’re complying with your obligations to manage health and safety.

WHAT COULD RESULT FROM THE INSPECTORS VISIT? An inspector may issue notices, such as an improvement notice, prohibition notice or infringement notice (on-the-spot fines) for a contravention with WHS legislation. An improvement notice is issued when there has been a contravention that doesn’t pose a serious risk to health and safety. A prohibition notice requires immediate action and may be issued if an activity is occurring, or may occur, that involves or will involve a serious risk to the health or safety of a person. As part of this process, an inspector may take statements, photographs and copy documents, such as Safe Work Method Statements (SWMS), as evidence of non-compliance. Notices may be issued at the time of the inspector’s visit, or issued via email. Prior to leaving your workplace an inspector may summarise their findings and explain the actions needed to comply with any directions or notices issued. You’re entitled to ask questions about actions you need to take.

I HAVE JUST DISCOVERED AN EMPLOYEE HAS BEEN STEALING FROM THE COMPANY. I’VE SACKED THEM IMMEDIATELY WITHOUT NOTICE. IS THIS OKAY? Whilst theft is a valid reason to terminate under the Fair Work Act 2009, a failure to follow a fair and reasonable process leading up to the termination could still result in the termination being seen as ‘unfair’. Regardless of the reason for termination it’s important to ensure that prior to any decision being made, a formal investigation is undertaken. This should include obtaining a response from the employee, interviewing any witnesses or obtaining copies of any reports or information that may be relevant. Should ‘on the balance of probabilities’ your investigation support the allegation, then a decision to terminate can be made.

MY EMPLOYEE RECEIVES A COMPANY CAR AS PART OF THEIR ‘REMUNERATION’ PACKAGE. I’VE RECENTLY PROVIDED THEM FOUR WEEKS’ NOTICE OF TERMINATION THAT I AM PAYING OUT IN LIEU. THEY’VE ASKED ME IF THEY CAN KEEP THE COMPANY CAR DURING THIS PERIOD. WHAT DO I DO? Should an employee’s remuneration package assign a value to a company car then it will form part of their remuneration for all purposes. Whilst you may have terminated an employee, they still remain entitled to their remuneration for the notice period provided. If they’re working this notice period out, this would likely involve them maintaining the company car during this time. If you’re making payment in lieu of notice then monetary compensation should be considered. In terms of calculating the compensation a review of the employment contract and the monetary value assigned to the car should be undertaken.

WHAT ABOUT IF THEY ARE ON LONG-TERM LEAVE? If the company car is assigned a value as part of the remuneration package then the same principle will apply - if the company car is removed from the employee a form of monetary compensation should be offered in its place. If the contract doesn’t include a company car as part of the remuneration package but rather states a company car will be provided for the performance of the employee’s duties only (i.e. as a tool of trade), then you may be able to request the employee return the car for the duration of their absence.

Know how to manage the risk of falls in housing industry THERE are specific requirements for managing hazards and risks working at heights in the housing industry. Firstly, a Person Conducting a Business or Undertaking (PCBU) must prepare a Safe Work Method Statement (SWMS) where there is a risk of a person falling more than two metres. There are two scenarios where the risk of falls must be managed. Where there is risk of falling three meters or more or working on a roof with a pitch more than 26 degrees, what do I do? Fall prevention controls must be in place, i.e. edge protection and perimeter containment screening. Perimeter containment screening i.e. mesh, must be installed to handrails or scaffold to control the risk of falling objects. When working less than three metres? When working at a height less than three metres, fall prevention controls aren’t mandatory. However, the PCBU must manage the risk of a person falling from one level to another that will cause injury, including: •

Working from an elevated workplace

In the vicinity of an opening in a floor

On a surface, such as a brittle roofs

In any place from which a person could fall.

A PCBU must review all control measures that are put in place and if necessary revise the planned work and amend the controls. Trestle Ladders are suitable to use at heights greater than two metres when guard rails and toe boards are incorporated to prevent people and materials falling. They’re suitable for light duty tasks (225Kg) such as painting or facia and gutter installation with a minimum platform width of 450mm.

Perimeter guard rails are effective at the edges of roofs, walkways or stairs. The top rail should be between 900mm to 1100mm above the working surface, incorporate a midrail with a nominal clear distance of 450mm and a 150mm wide toe board securely connected.

Fall restraint systems Personal Protective Equipment (PPE) is the lowest level of control. It can be used in conjunction with high order controls. People using fall restraint systems must be provided with training to ensure they’re competent to perform the work.

Could your apprentice be entitled to back pay? AN IMPORTANT message for incorporated employers in Queensland. Starting on 1 January 2010 Modern Awards have provided the minimum award wages and conditions across Australia. While these Modern Awards replaced the old state award system in Queensland, it was the policy of the Queensland Government to ‘preserve’ the competency-based training and wages system unique to Queensland apprentices employed by employers that were

incorporated prior to 27 March 2006.

What’s my exposure?

This ‘preservation’ has meant these apprentices have continued to be paid under the state award system, despite receiving lower rates of pay than those apprentices engaged by employers subject to the Modern Award (employers incorporated post 27 March 2006).

If you have always been paying your apprentices under the Modern Award, you have no exposure.

These rates of pay were calculated and provided to employers by the Fair Work Ombudsman (FWO).

However, for those paying under the old state award system, the Fair Work Commission and Federal Court on appeal in 2017 determined that the ‘preservation’ of wages for those Queensland apprentices ceased on 31 December 2013, despite up until 2017, the Queensland and Federal Governments both

indicating that these rates of pay would apply. This means that back pay claims may extend back to 1 January 2014. Given that the FWO concedes the underpayments occurred as a result of it providing incorrect wages advice to employers, we’ve been advised that they won’t prosecute employers to recover back pay for apprentices for time worked prior to 7 February 2017 (which is the date of the first appeal decision by Fair Work Commission), however will provide support in organising a

payment plan as may be necessary. What we’ve done to help Master Builders committed considerable resources in supporting the two appeals because, in our view, employers were only acting on advice from the government at the time and were not at fault for any underpayment of apprentices. Since the decision in 2017 we have lobbied the federal and state governments to provide a financial package to help employers cover

some of the shortfall in wages. As late as November 2018 we believed this assistance was still possible, however neither the federal or state government will provide any commitment to such a package. As a result, formal advice to incorporated employers is (if you haven’t yet done so) to calculate and provide back pay. BIF reforms are now in action, here's what you need to know LEGISLATIVE changes to security of payment are now in effect. We’ve highlighted the important information you need to know to ensure your business is compliant. The legislation – Building Industry Fairness (Security of Payment) Act 2017 The Building Construction Industry Payments Act (BCIPA) has been removed and replaced by Chapter 3 of the Building Industry Fairness (Security of Payment) Act 2017 (BIF 3). However, BCIPA will still apply to all payment claims that were validly served under the BCIPA prior to 17 December 2018. This applies to all construction work and related goods or services, not just building work under the QBCC Act. Chapter 3 will govern payment claims, payment schedules and the adjudication process. It applies to all payment claims made from 17 December 2018, even for contracts entered into before this date. The Subcontractors’ Charges Act 1974 (SCA) 32 | Master Builder

will be repealed and replaced by Chapter 4 of the BIF Act (BIF 4). However, SCA will still apply to all subcontractors’ charges that were given prior to 17 December 2018 that haven’t been extinguished or otherwise come to an end. All subcontractors’ charges given on 17 December 2018 onwards, fall under the requirements of BIF 4. Chapter 4 will govern subcontractors charges given from 17 December 2018, even for contracts entered into before this date. The legislation – Queensland Building and Construction Commission Act 1991 Serious new offences came into force in the QBCC Act on Monday, 17 December 2018 in relation to retention and the Defects Liability Period.

Notice about end of Defects Liability Period All contractors who are holding retention or security under a building contract must provide a notice in the approved form within 10 business days before the end of the defects liability period. The notice must state:

The date that the defects liability period ends

For a retention amount:

o The amount to be paid at the end of the defects liability period if no amount is required to correct defects in the building work under the contract, and

o The date the retention amount is proposed to be paid.

Payment claims •

Payment claims will no longer need to be endorsed under BCIPA (you no longer need to include specific wording) but must describe construction work or goods or services, state how much is claimed and include a request for payment. A written document that includes the word ‘invoice’ is taken to be a request for payment but a payment claim does not need to be an invoice.

Payment claims may be given by contractors, subcontractors, sub-subcontractors, suppliers or consultants.

Payment schedules •

You must respond to every payment claim for a progress payment by either paying the claimed amount in full by the due date or responding to the claim with a payment schedule

Payment schedules must be given within 15 business days of receiving a payment claim (or earlier if provided for in the contract)

High penalties (up to $13,055) may apply for failing to provide a payment schedule in response to a payment claim or for not paying in full by the due date (IMPORTANT: this relates to all payment claims from 17 December 2018, even for contracts signed prior to this date)

Make sure you know what the due date for payment is under BIF 3 because it may not be what the invoice or contract says it is.

Changes and penalties

The below changes introduce new requirements and penalties to the security of payment process in Queensland.

Adjudication and disputes •

Claimants are no longer required to provide a Respondent with a ‘second chance’ to provide a payment schedule

Respondents cannot raise new reasons in an adjudication response that were not included in a payment schedule regardless of the size of the payment claim

New application time-frames of up to 30 business days.

Subcontractors’ Charges •

If given a subcontractors’ charge, contractors must respond. There are penalties for failing to respond within ten business days.

There is a penalty of up to $13,055 for failing to issue the notice.

Master Builders new Subcontract Agreement has landed IT'S BIGGER and better, fully compliant and now available in eDocs. Following on from legislation changes that came into effect on 17 December 2018, we’ve launched the new Subcontract Agreement in response to member feedback and requests. The new version is fully compliant with these recent legislation changes and is a significantly more comprehensive document than the previous version. It has many options that will suit a variety of head contract arrangements and provides both parties with flexibility as to how the risk is allocated in the contract. It’s available for use in our eDocs system for $15. Why use it? This new version has some beneficial inclusions, including offering more flexibility regarding forms of security and progress payment reference dates. It also offers clarity as to how and when retention is to be

released (if applicable to your situation). What about the old version? The previous version is still available, but is now called the Subcontract Agreement – Basic. This new name reflects its smaller, more compact size – but rest assured, it is still compliant, sets out the rights of both parties and can be amended, as needed, through special conditions. For eDocs users, it is the same document that was available before. Which version should I use? This really depends on the type and scale of work you do. If you’re looking for a comprehensive document that provides flexibility regarding security, payment arrangements, or liquidated and delay damages, or are looking for a subcontract that is suitable for a more comprehensive head contract, the full Subcontract Agreement is probably the best option. The Subcontract Agreement – Basic is a smaller

version suited to lower risk subcontracts or smaller work projects. If you’re not sure which version to use, contact us and our team of experts can talk you through it and provide advice on the best version to use to suit your circumstances. For current eDocs system users If you’ve been using this document within the eDocs system, it’s business as usual. The version you have been using previously will now be known as the Subcontract Agreement – Basic and will continue to be available. Your silica guideline to working with stone benchtops

WORKCOVER Queensland has released a guide outlining how to control exposure to Respirable Crystalline Silica (RCS) dust in stone bench top fabrication industry. Uncontrolled dry cutting, grinding or polishing in the Benchtop Fabrication and Installation Industry has been prohibited due to the high level of dust containing RCS that is generated from the products being used by this industry. Recommended control measures for the engineered stone benchtop industry include dust extraction, water suppression, isolation and the use of respiratory protective equipment for all workers. WorkCover has also implemented a program of medical screening for all persons working in this industry to assess whether they have any symptoms or signs of disease, such as silicosis. Health monitoring is also required for people working in this industry. Health monitoring is used to detect changes in a worker’s health because of exposure to certain substances. Tradie: David Minniecon DAVID Minniecon works at Bama Services and his employer refers to him as "a star". Bama Services was established under Cape York Partnership in 2010 as a small construction and landscaping business to provide a ‘transition to work’ for young Indigenous school leavers. It's rapidly expanded into a dynamic, multi-faceted enterprise providing civil and domestic construction, facilities and asset maintenance.

At what age did you start working in the industry? How did you get into it? I started in the building industry when I was 17 years old. Originally I wanted to be a plumber but my uncle asked me to come and work with him in the building industry.

What appealed to you about this profession? The initial appeal about working in the building profession was being able to work with my uncle. I had no intentions of pursuing a career in building but decided to take up the offer my uncle gave me so I could work with him.

Tell us about one of the most memorable jobs you’ve done? I was a part of the team that did some of the housing upgrades on the homes in the Mossman Gorge community. I felt proud about working there because that is my community and the homes I was working on were for my people.

Is there someone who inspires or mentors you? If so, who are they?

Someone who inspires me and is a mentor to me is Shane Woodman. He was my old supervisor when I was undertaking my apprenticeship. He really helped me out a lot when I was starting out and went above and beyond to make sure I was okay. I had a couple of challenges outside of work and he helped me and made sure I was okay. He was a really good mentor for me as well, has taught me a lot and is someone whose advice I respect.

Where do you see yourself five years from now?

What do you love most about your job? I like working with the team that I am with at the moment. I like the camaraderie.

Have you completed any training with Master Builders? If so, what courses were they and how have they helped you?

What do you find most challenging about your job?

I am currently enrolled in a Cert IV in Building & Construction with Master Builders.

The most challenging thing about my job is trying to find the right balance between work and home life. Some of the work we do is in remote locations and we will spend a bit of time away from home.

Tell us an interesting fact about yourself. I have had a very encompassing working life that has had me involved in aviation, logistics, steel fabrication, mechanical services, hair salons, automotive supplies, seafood, surf rescue and all elements of construction. Gong a shock for Jock A TWENTY-NINE-YEAR-OLD is debunking the avocado on toast millennial stereotype as he builds multi-million dollar construction projects, takes home a national gong and redefines the meaning of hard work. It was at boarding school in Brisbane in 2006 that Jock Kent, knowing he wanted to be hands on and outdoors with his work, did a ring around to local builders in a bid to secure a job post-graduation. “I thought carpentry was a skill I’d benefit from for the rest of my life,” Jock said. Starting out with a small building company, he then progressed to a supervisor role and later went on to work for a personal connection. “A builder I knew moved overseas and he asked me to take over his jobs while communicating with him remotely,” Jock said. “That was the first time I realised I could handle most jobs myself.” At the same time, Jock was getting an increasing number of friends asking him to do small jobs and projects for them. 40 | Master Builder

“I realised if I kept saying no they wouldn’t ask again and so I sort of stumbled into it,” he said. In 2015, Jock launched Taranaway Building & Landscapes, a nod to the namesake family farm he grew up on in Longreach featuring the same, distinct red writing as his brand. With just an apprentice and himself, he worked in the blue-chip suburb of Graceville. Their reputation for unwavering dedication and high-quality work quickly spread in the tight-knit community. Word of mouth led him to be approached for his biggest job yet, a million dollar ornate Queenslander renovation at Verney Road. “Realistically, we had done nothing to deserve the opportunity of taking that project on,” Jock said. “We’d started in 2015. In 2016 we did a small renovation a couple of streets away from Verney Road and then we took the (Verney) project on in June that year. “Experience wise, there was nothing saying we could even do the project, let alone do it

Questioning his own abilities, but keen to take on the challenge for the experience, Jock met up with an industry contact turned mentor. “I took the plans to him and he helped me through pricing it. I asked him, ‘Should I be doing this?’ and he told me to pull my socks up and rip in,” Jock said. “‘Are you confident in building it?’ he asked me, ‘What makes you nervous?’ “Him asking that made me realise it wasn’t building I was worried about, it was inexperience in pricing and business that made me nervous.” Agreeing to take on the project, Jock said he discovered by doing the absolute best job you can, 'you work construction out'.

Jock Kent, Taranaway Building & Landscapes “It’s the rest of it that’s tricky, you spend your whole career learning how to build, then suddenly you're expected to run a business and quote perfectly.” Jock’s small team poured their blood, sweat and tears into Verney Road. “We absolutely dedicated ourselves to that place for 14 months, “ he said. From installing cold rooms inside the kitchen, sunken cinema seating , building the pool themselves to installing a 20,000 litre water tank in the front yard, their skills were certainly tested on every level. The high-end project went on to take out the Master Builders Australia National Luxury Alterations/ Additions over $1M in Adelaide in November 2018. “It’s so good for myself as the leader of a young team to set a standard and be acknowledged for it, it lets you know you’re on the right track and gets rid of any insecurities about the way you are running things” he said. “We’ve completely evolved as a team because of that and the boys deserve to be rewarded for the attitude they have towards their work everyday. Now you’ve got guys who have been working with us since Verney Road who are setting the same standard for new guys coming on,” he said. With a team of 14 and growing, he gave two golden pieces of advice to those up and coming in the industry. “Learn to do everything yourself, I did my own books until I didn’t have time in the day to do them,” he said. “And do the right thing. It’s so easy to do and it ends up paying you back. You do the right thing for someone and they’ll tell someone else." Master Builder | 41

'Whim' entry wins big EMAILS with subject lines, “Enter the awards” and “Have you got your home entered” were rolling into Blinco Constructions’ owner, Mark Blinco’s inbox. With the ping of each new notification, Mr Blinco’s interest and intrigue grew. “I thought, well, I’ll just see what’s involved,” Mr Blinco said. It was a curious click that would lead to honour and adoration for Mr Blinco’s craftsmanship as he went on to win National Project Home $350,000 - $500,000 at Master Builders Excellence in Building and 42 | Master Builder

Construction Awards for his Kingfisher build at Palmview Forest. “I just put my (regional entry) in there hoping it would generate more work and enquiry,” he said. Mark's Kingfisher won at the Sunshine Coast Housing & Construction Awards in August, at the Queensland Housing & Construction Awards in October and he then flew to Adelaide in November for Nationals. “I was very surprised, I didn’t expect that at all,” Mark said.

“I just entered it off a whim, and it’s great to be recognised, that’s a big thing. Mark said his family and the Blinco Constructions team were over the moon with the National win.

“There's thousands of builders out there, so to be recognised ... is huge." Mark Blinco, Blinco Constructions From the outset, Mark said he knew he wanted a split level home for the 2,796 sqm site. “I’ve got a mate that’s a designer and I engaged him, we both went out there and looked at the site, I wanted split level design to utilise the site and we came up with that,” he said. The four-bedroom home incorporates a media room and multipurpose room. “The home then steps down a metre into the lounge and kitchen area which open up on the veranda and pool,” Mark said. A second generation builder, Mark has been working in the Sunshine Coast and further afield for more than 20 years. “I’ve been building in the UK for four years in the capacity of site supervisor and project manager and I’ve been a contract administrator for two companies for five years,” he said. “I do custom, one-off builds, every job I do is different. I do smaller lot builds, seven and a half metre frontages that are 20 metres long to major renovations – anything and everything.” His biggest piece of advice for up and coming builders? “You’ve got to be versatile,” Mark said. The name displayed on the award will be the licensee name and, if applicable, one recorded trading name (as per the QBCC public register). If you have more than one recorded trading name, we will contact you for clarification.

Safety Alert

Changes to General Safety Induction (White Card) FROM 1 February 2019 changes came into play for the General Safety Induction (White Card).

Here’s what’s changed in a nutshell: •

If you hold a White Card attained in another state and you need a replacement card you will either have to re-sit the course or seek a replacement from a registered training organisation in that state.

You’ll no longer be able to gain a White Card via an online training provider unless you live more than 100km from a registered training provider offering face-to-face delivery.

NOTE: You can still work if you have a Blue Card. You don't need to upgrade at this time.

If you lose, destroy or have your Blue Card Stolen you’re no longer able to have it replaced with a White Card and you’ll need to re-sit the course.

Brisbane members:

If you need to replace your White Card you must provide to the training provider a copy of the statement of attainment that you received with your White Card. If you don’t have the statement of attainment you will have to re-sit the course.

Here's how we're supporting you, our members and the industry with these changes; •

From 1 February, every Monday from 10am, a White Card course will be held at our Brisbane office.

Limited places will be available. You’ll need to book in from 7am and be at the Brisbane office by 9am to complete forms.

Every second Thursday, a course will available for pre-bookings. Regional members: If you, your employees or sub-contractors need to complete the White Card course please contact your local Master Builders office to book into the next available course. All Queensland members: •

For urgent White Card requirements, we offer a drop-in service anytime between 7.30am and 12noon, Monday to Friday.

If you completed your White Card with Master Builders and lose it, destroy it or it’s stolen, you can attend any Master Builders office for a replacement (fees apply).
