Our message ahead of the 2020 Queensland Election was simple, but powerful: when construction stops, Queensland stops. And we need a government that backs the industry so that we can keep Queensland moving. Our policy platform covered six central themes: drive construction activity, shake up the QBCC, scrap impractical tender processes, improve security of payment, safeguard building quality, and a balanced approach to safety. Whether you’re a builder or subbie, a supplier, manufacturer or a consultant, the aim was to benefit everyone who works in the industry. It wasn’t about telling our valued members who to vote for; but ensuring their chosen 4 | Master Builder

party and local candidate is one that puts the building and construction industry first. Launched in September, our advertising campaign included a 30-second TV commercial, print advertising in the CourierMail, billboards on some of the state’s busiest roads and highways, and an extensive digital campaign across high-traffic news sites. Our election toolkit, made available to members, included a letter for sending to local MPs or candidates, social media tiles to share our cause on Facebook, LinkedIn, Instagram and Twitter, a 30-second YouTube video, an email signature for download, and a poster. Head to page 26 for more detail on our high-visibility campaign. We’ve had some wins through the election campaign, with the Queensland Office of State Revenue announcing a pre-approval step in the HomeBuilder application process, which provided a solution to a problem we had been lobbying to fix for members. Numbers that count forward-thinking we have been calling for, from all sides of politics, in the lead-up to the election. However, as campaign promises were announced by both sides of politics, our election scorecard quickly make it clear to us that neither major party listened or took our calls for reform seriously. No party made a genuine commitment to addressing the red tape and impractical processes that are tying our industry up and impacting our ability to do business. As the printing presses rolled out this edition of our magazine, Queenslanders were heading to polling booths to make their voices heard. Rest assured, no matter the outcome, we will continue to lobby in the best interests of our industry, reminding our MPs how important we are to the post-COVID economic recovery, and calling for reforms that really make a difference.

W While there were positive aspects, like the apprentice wage subsidy and extension of the First Home Owner’s Loan Deposit Scheme, the federal infrastructure spend is heavily focused on civil projects like rail and roads, which aren’t the projects that will provide a shot in the arm for commercial builders. The federal government has definitely favoured tax cuts over direct investment to stimulate the economy – and that puts the pressure back on the Queensland Government to support our state's commercial builders. Many commercial builders, big and small, across the state are reporting a drop in their pipeline of work, which will result in significant loss of revenue and shedding of staff if things don’t improve. 6 | Master Builder

The Queensland Government has announced a $14 billion capital works program, to be spent on both civil works and public buildings, and Master Builders will be pushing for the commercial sector to get its fair share of this spend. The reality is, spending on public buildings supports more jobs for each dollar spent, because it’s much more labour-intensive than civil work, and creates jobs immediately. For every $1 million in work done per year, 8.7 jobs are created in commercial building compared with 1.4 jobs in engineering construction. In our view, investing in commercial construction is a no brainer and definitely gives governments more bang for their buck. As we go to print for this edition of Master Builder, the state election result is unknown, but it’s important to note that we’ve been busy calling on the incoming government to shore up Queensland jobs by boosting the commercial sector and we’ll continue to do that, whichever party is elected. A significant portion of the capital works

program must be channelled towards public buildings or further stimulus for the commercial sector has to be considered. It’s also important to bring greater transparency to the three-year building work pipeline to further boost confidence. Providing more detail will ensure the industry has a comprehensive picture of all planned government spending on public buildings – and reassure commercial builders they’ll have more work in the coming 12-18 months. We’re also calling for the Queensland Government’s controversial Best Practice Principles and Minimum Conditions policy for major construction projects to be scrapped. Without addressing these issues, Queenslanders will be paying more than they should for government buildings. The danger in all of this? We’re now experiencing a two-speed construction economy. The residential sector fuelled by HomeBuilder is bursting at the seams, but the commercial sector is all but dead in the water.

Their launch of a HomeBuilder pre-approval process means first home buyers in Queensland can now have the $25,000 grant considered as part of their deposit, boosting lending eligibility. 8 | Master Builder

confidence and demand for new homes, but it begs the question: what happens when construction of this current crop of homes is HomeBuilder needs to be extended to take it through to the end of 2021, to enable larger-scale apartment projects to access the scheme and make the most of demand. Our industry has also been saying from the start that the three-month construction commencement timeframe was too short – land titling, building approvals and finance applications can easily take longer than that.

In commercial urban environments where space is at an ever-higher premium, a building’s roof level is potentially a rich source of usable space. Buzon say their Pedestal System can be used to maximise a roof’s potential, both hiding all manner of services and protecting roof substrates from the elements, maximising integrity and longevity.

The pedestals are extremely strong as they are precision-engineered from high strength, UV resistant, recycled polypropylene and capable of supporting loads of more than 1000kg each. At roof level, this load is evenly spread by the wide base area of each unit, making them ideal for installation on any waterproofing membrane without causing damage, they can even be used directly over insulation material. The Buzon Pedestal System is also simple to install. Desired height is achieved by thread adjustment, which is lockable when reached and a range of interchangeable spacer tabs of 2mm, 3mm, 4.5mm, 6mm, 8mm and 10mm, allow for precise gaps between pavers and provide positive drainage without any concern of ponding or flooding.

he Master Builders Downs & Western region encompasses an area that extends east from Toowoomba to Rosewood, North to Carnarvon, West to Birdsville and South to the New South Wales border. Within this region we have approximately 760 members. Toowoomba is the largest city and commercial hub of the Darling Downs surrounded by many productive and thriving smaller towns. Toowoomba has experienced substantial growth in the past couple of decades, resulting in an amazing transformation from a quiet country town into a thriving and bustling inland city. Toowoomba’s economy is resilient and has a diverse range of strong economic drivers including health, defence, agriculture, primary producers, tourism, education, mining and construction, to name a few. Toowoomba has an active business community, whose own investments in the region have demonstrated to government that it is a growth region. Our internationally-capable airport, Pilot Academy, data centre, intensive horticulture projects and agtech investments underline the confidence of private investment.

These new industries add value to our rich traditions of agriculture and our region's role as a service centre for education, health and, importantly, the retail sector.

Kong and Singapore Airlines trial, a new CBD hotel, new apartment building and the early planning for a new Toowoomba Hospital will enhance the project pipeline. In the next few years we will see the start of the Melbourne to Brisbane Inland Rail line. This nation building project will include the most significant local construction project ever undertaken in our region, the $5 billion inland rail tunnel project to be drilled right through our Toowoomba Range. We will also see the creation of complementary projects, such as Interlink SQ and investment in our Toowoomba Trade Gateway. The $1.6 billion Toowoomba Bypass has improved access to the Toowoomba Trade Gateway, Wellcamp Airport and future intermodal hubs attached to Inland Rail. We are already seeing the benefits, and it highlights the strategic importance of the region as a significant transport and logistics hub. There really is a big heart at the core of our community. Our resilience, endurance and compassion inspire others.

On top of this, the recently approved Regional Trade Distribution Centre at Toowoomba Wellcamp Airport, a second weekly freight service to Hong

nder Public Health Directions it is mandatory for some types of businesses to operate under a COVID Safe Industry Plan, COVID Safe Checklist, or complete COVID Safe Training. These are business services that have been identified as having a higher risk of COVID-19 transmission and therefore are required to meet a high standard of safety to manage these risks before being allowed to commence business. As the construction industry sits outside of the definition of a ‘restricted business’ type under Public Health Directions, it has created some confusion for construction businesses as to the documentation required to manage the spread of COVID-19 and provide evidence of a safe system of work. Regardless of whether a business is classified as restricted or not, all Queensland employers have obligations under Work Health & Safety legislation and must take action to protect workers and others at the workplace from the risk of exposure to

All employers should put in place their own plan to respond to COVID-19 and to any directives issued by Queensland Health. They should consult with their workers on this plan and it should be made available when requested. This is an internal plan that does not need to be submitted to Queensland Health. Items you should consider in your plan include:

Infection prevention and control policies and procedures

Safe systems of work

How workers will be consulted about COVID-19 issues

How you will monitor and update your plan as public health information changes.

If you have an existing WHS plan in place that covers COVID-19 risks and you have consulted with your staff to put it together, you should continue to use it. For construction businesses, this could be

toolbox talks or other safety policies and procedures you already have in place. If you do not have a WHS Management Plan or other safety documentation that covers COVID-19 risks in place you can download a COVID-19 plan template from the Workplace Health and Safety Queensland website at worksafe.qld.gov.au Master Builders has also developed a toolkit of additional resources that businesses can use to manage the spread of COVID-19 in the workplace, including checklists, signage and disclosure forms. At 300 George St, our judges were impressed with Multiplex’s ability to solve a complex risk with a simple innovation. By custom designing a hydraulic vehicle attachment to stand up columns for the building façade, the team avoided using a dual tower crane lift, therefore limiting workers' exposure to rigging and falls risks. GOLD COAST: JAKASPA PTY LTD T/A COASTAL ASBESTOS REMOVAL FOR ASBESTOS REMOVAL MANAGEMENT SYSTEM, BURLEIGH HEADS

Coastal Asbestos Removal were tasked with designing and implementing a system that allowed them to safely remove asbestos pipes from a live sewerage pump. Their solution was a three-step process involving lowering the sewage levels, setting up a decontamination booth and designing a “balloon” style plug, made from an everydayuse exercise ball, to stop the sewage from travelling up the pipes. This is a great example of simple solutions for a very complex and dangerous task. WIDE BAY BURNETT: WK PROJECTS PTY LTD FOR IWC STAGE 2, BUNDABERG WK Projects’ innovation not only addressed safety risks, but also resulted in improved productivity. The project required a bulk excavation and installation of basement level block walls. To avoid the obvious excavation collapse risks, and any musculoskeletal risks to workers, the perimeter block walls

were laid at a reduced height and the core was filled early. This reduced the need for tradies to be working between the block wall and excavation wall. This simple change also resulted in reduced labour time and costs. NORTH QUEENSLAND: WATPAC CONSTRUCTION PTY LTD FOR QUEENSLAND COUNTRY BANK STADIUM, RAILWAY ESTATE With an overall goal of eliminating or limiting the time required to work at heights, this winning innovation involved the development of a specifically designed and fabricated lifting frame for large pedestal columns. The unique solution was designed to conform with the Watpac philosophy and process of building large structural components on the ground to eliminate tall scaffolds, manual handling and falls from heights issues, as well as allowing for better quality control. hen it comes to staying safe at work, complacency is public enemy number one for Shane Webcke.

potentially dangerous or risky – if you are chastised for that, put down your tools, walk out, and get another job.

Sadly, the NRL's Brisbane Broncos and Maroons legend knows first-hand the cost of a workplace fatality. In 1994, Shane was just 18 years old when his mother phoned him in the early hours after a State of Origin match to say his father had been killed in a workplace incident.

“The more often you do a dangerous task that doesn’t hurt you, the less likely you think that it will ever happen – and that’s what complacency is. The weapon against that is playing it safe, which becomes almost habitual.”

“My family was ripped apart because of what happened to dad, and you never ever go back together again properly – it just doesn’t happen,” Shane said. “So forever and a day, we can’t be a normal family anymore. We got through it, we aren’t sooks and we don’t cry ourselves to sleep at night about it, but our family will never again be complete because my dad took a risk at a silly bloody job that he didn’t even love.” October is Safe Work Month, with Queenslanders asked to make a commitment to improving safety and health in the workplace. Shane said sharing his story in his role as Queensland Safety Ambassador added for him

While things like PPE and keeping equipment in safe working order may be more obvious, the “unseen” risks that can stem from life outside the workplace should be taken just as seriously. “If you have other issues, if you’re drinking too much, if you take drugs, if you go out and have a huge night and get home at 3am full of drink, then get up at 6am and think you’re going to work, you’re mad,” Shane said. “Another thing I encourage people to think about is yes it will affect you, but what if one of your actions because you’re influenced by drugs or alcohol or stress, leads to the injury or death of somebody else?

If it feels dangerous, it is some meaning to the death of his father. “Perhaps by me telling other people the lessons from my father’s death if you like…if it prevents it from happening to somebody else then my dad didn’t die for nothing. “What I console myself with, is that if one person changes the way they view safety because of what I have said about my dad, and the blunt way in which I deliver it, well then it’s been worth it.” Shane said the responsibility for safety rests equally in the hands of the employee and the employer. “I’ve been to a lot of places where people have been badly hurt or killed, and I’m yet to go to one where it wasn’t something that the employee did contravening what the businesses’ platforms were about. That’s not to say every business is perfect, that’s not to say every employee’s got the wrong attitude, but that’s what I see. “If it feels dangerous, it is, and it doesn’t matter if your misunderstanding has led you to believe something is dangerous when it isn’t – you put your hand up. “If you are in a workplace where you if speak up about something you believe is wrong or is

You know what would have changed in my dad? Absolutely nothing,” he said. “But if he could have crystal-balled that moment and seen what would happen to his family as a result of the risk he took that night, he would never have taken it. If he could see what I’m doing now, he would applaud me, simply because he wouldn’t want someone like him, with his attitude, to not change their ways and then potentially not do to their family like he inadvertently did to his. “That would be important to him, I know it would be.” TO LEARN MORE, HEAD TO WORKSAFE. TELL US ABOUT YOUR ROLE: I’m the Manager of Safety and Environment, which involves mostly policy, advocacy and lobbying, or as I like to say, “having robust negotiations and discussions (sometimes arguments) with the government on behalf of our members”. I sit on about 15 different committees, forums and working groups as well as on the Work Health and Safety Queensland Board. IF YOU COULD SUM YOURSELF UP IN ONE SENTENCE, WHAT WOULD IT BE? I am firm, fair and passionate and always (maybe not 100% of the time) deliver my opinion with a smile!

At the moment for me everything is about COVID, but usually I answer a lot of questions about how and why the government enforces laws the way they do, and how certain laws or rules can be changed to make working more practical. My days can look very different , however a typical day would generally start by waking up with the birds to get my two kiddies ready and off to daycare and school. I would then spend my morning at work delivering safety training to a group of our wonderful members, followed by a meeting with my team to discuss some new safety products or documents we are developing. I would then spend

some time reviewing and writing safety document templates, training courses or other resources that need to be developed or updated, and assist members with any safety enquiries they have. It’s a role where you go with the flow as you never know what might change in the safety space! There’s a lot of coffee and laughs thrown in there as well. REPORT: STAYING ASBESTOS

T

he latest data suggests early detection and improved treatment options are extending survival time after a mesothelioma diagnosis - but there's no room for complacency when it comes to prevention of the incurable disease. Despite all forms of asbestos having being banned in Australia for the last 16 years, hundreds continue to be diagnosed with the rare and aggressive type of cancer predominantly caused by exposure to the fibrous mineral material, formerly used in building and construction. Statistics from the Australian Institute of Health and Welfare (AIHW) shows 659 cases of mesothelioma diagnosed in 2019 were reported to its Australian Mesothelioma Registry. The death rate has also risen from 1.9 deaths per 100,000 people in 2012, to 2.9 per 100,000 in 2019, with at least 729 people losing their lives. Diagnosis is more common in men than women – likely owing to more men commonly working in industries like construction, where they may have been exposed to asbestos. Worryingly, an AIHW survey of those diagnosed with the disease since July 2010 reveals 81 per cent of those who had ‘probable’ exposure to asbestos worked in trades-related jobs. That’s compared to 75 per cent who worked in water transportrelated jobs, and 40 per cent of participants who worked in land transport-related jobs. The AIHW’s Justin Harvey said the increased 22 | Master Builder

death rate in 2019 largely reflects changes in historical exposure to asbestos because the disease takes many years to develop and cause symptoms. “Due to its aggressive nature, most cases of mesothelioma have a poor prognosis. “However, the length of time people usually live after a mesothelioma diagnosis is gradually increasing, which may be due to earlier detection or improved treatment options.”

“Our concern is where they may know, it’s sort of knowing about the dangers, knowing what they need to do – but then whether they go and carry out those safe practices, or take a ‘she’ll be right’ attitude. Because we’re dealing with a disease with that long latency, it’s different to what we’re dealing with regarding the COVID situation, which is more immediate in terms of danger and risk.” Ms Ross said having a professional asbestos assessor come in before work begins is key.

Of the women surveyed, a staggering 99 per cent provided information indicating nonoccupational exposure.

“That then keeps the builder safe when they come in, as they have that assessment to say where the asbestos is or where it’s likely to be encountered, if there’s a situation where it’s likely to be hidden.

Asbestos Safety and Eradication Agency CEO Justine Ross said the diagnoses and death rates are largely a sad legacy of past workplace practices – but also served as a reminder that we need to remain vigilant, particularly as more people embark on home renovations during the COVID-19 pandemic.

“I know some Master Builders do go and get a B-class licence so if they do come across it, they can remove it themselves. With most workplace health and safety laws there’s a rule you can’t remove more than 10m² of asbestos without being licensed.

“We acknowledge there are very good workplace health and safety laws in place, and they’re very strict around what you need to do to prevent asbestos exposure,” Ms Ross said.

“We encourage either they get that licence so when they encounter over that amount, or even under it, they know how to remove it safely. Or if they think it’s beyond their capability to remove it safely, that they call on a removalist as well, with the benefit being they’ll take it away and dispose of it.”

“But, our concern is mainly in the smaller residential sector, in the area of home renovations, and people doing it themselves, or when they may call in a trade to help them out with jobs they can’t do themselves, and they’re making that discovery of asbestos.

fatigue management guide Workplace Health and Safety Queensland has published a new guide for preventing and managing fatigue-related risk in the workplace. This important advisory covers the effect fatigue has on drivers, shift workers, plant operators and those who are required to concentrate highly, on an ongoing basis. There are many factors that have the potential to increase the risk of fatigue. These are categorised as both work-related and personal factors.

The new guide aims to help employers understand their duties under the Work Health and Safety Act 2011. It provides guidance on how to: • • •

Identify hazards and risks related to fatigue Consult and communicate with workers Eliminate and minimise risks related to fatigue

The Bureau of Meteorology’s 2020-21 outlook shows an increased risk of tropical cyclones in the north this season, with roughly average potential for severe thunderstorms.

Following these practical steps can help secure your worksite. SCAFFOLDING • A scaffolding supervisor should undertake a full pre-shutdown inspection • Check scaffold foundations such as screwjacks, baseplates and sole boards are appropriate, and any potential stormwater run-off will be diverted away from the foundations • Re-tension screw-jacks where needed • Ensure sufficient ties are in case of strong winds • Check integrity of shadecloth and reattach or repair where damaged • Ensure access to incomplete scaffold has been prevented through barricading and signage

Respond to and learn from incidents involving fatigue to improve prevention.

ith the summer storm season underway, unattended worksites are at risk of damage and can also pose a potential serious safety risk in the form of flying debris, if not properly prepared.

"Every northern wet season has had at least one tropical cyclone cross the Australian coast, so we can never be complacent," Bureau climatologist Greg Browning said. "Communities right across northern Australia need to be prepared now and stay informed from the very start of the tropical cyclone season in October, right though until April."

• Ensure all planks on the uppermost lift are secured to the transoms with tie-wire, unless a captive plank system is incorporated in the transoms’ design • Remove all loose materials from the scaffold platforms on the uppermost lift. • Ensure an emergency contact number has been supplied by the scaffold contractor in case an inspection or repairs are needed after a storm. FORMWORK • Remove all loose sheets of ply, fillet and penetration mesh from the deck area and platforms on climbing formwork systems • Strap all packs of formply in exposed areas • Chain all shutters on storage racks • Remove all loose materials from stripping areas • Ensure all platforms on perimeter screens have been cleaned of debris and loose materials • Ensure all mesh infill panels are in place between screens.

ROOFING • Remove all loose sheets, guttering, sarking, ridge capping and safety mesh from • the roof or secure to the structure with rope or strapping to the structure, for example purlins, portal frames or rafters. OTHER EXPOSED OR OPEN AREAS Remove or secure loose materials in windexposed areas of the site, such as formwork decks, climbing formwork system platforms, podium levels, balconies, ground floors and any areas on a high-rise where windows have not been fitted and the openings are not covered by perimeter screens, scaffolding or similar. UNAUTHORISED ENTRY TO YOUR SITES Site security is also important to stop unauthorised people from accessing your worksite and injuring themselves, stealing materials or tools, or causing damage. ummer in Queensland makes for arguably some of the toughest weather conditions in the nation. With the mercury rising and higher humidity, it’s important to take steps to work safely, and prepare your worksite for any significant weather events. According to the Bureau of Meteorology’s latest climate outlook, day and nighttime temperatures this summer are likely to be warmer than average across northern Australia. Heat stress can impact heavily not only on a person’s well-being, making them more susceptible to injury, but can also affect the safety of others, and productivity in the workplace. It occurs when the body heats up and is unable to cool itself to maintain a safe temperature. Risk factors include working in the sun, which can lead to dehydration, and working in areas with poor ventilation such as confined or ceiling spaces. SIGNS TO LOOK OUT FOR: • • • • • • •

Significant sweating Slurred speech Tiredness or weakness Red or hot skin Nausea or vomiting Muscle spasms or cramps Headaches or fainting.

Despite the risks, it’s easy to put practical measures in place to help avoid heat stress and dehydration. These include: • • • • •

Ensuring workers have access to drinking water Giving workers adequate rest periods to cool-off, in designated cool-down areas Supplying workers with cooling clothing such as vests and neckties Being mindful heat stress can also occur in shaded outdoor areas Including heat stress management in the planning phase of a job, such as scheduling of work and rest breaks, and designating cool-down spaces. Educating workers, through toolbox talks and inductions, how to identify the signs of heatstroke and respond to them effectively. Ensuring workers protect themselves from UV radiation by using SPF 50+ sunscreen, wearing a broad brimmed hat, and wearing long sleeved/ legged clothing where suitable.

DID TRAVEL PAYMENTS CHANGE IN THE ONSITE AWARD

WHAT IS CORROSION PROTECTION FOR JOIST HANGERS?

On 1 July there were a couple of changes to the Daily fares and Travel provisions clause 25 of the Building and Construction General Onsite Award that were a mixed bag for employers.

Metal connectors are commonly used for timber framing in buildings. This includes strapping, framing anchors, cyclone ties, gang nail plates and joist hangers.

In a win, it is no longer necessary to make the $17.43 payment where the employer provides a fully maintained vehicle for the employee's use. In addition,this payment is also no longer required where the majority of workers (excluding those doing prefab then going on site) start and finish work at a depot.

The minimum level of corrosion protection on metal connectors is typically Z 275 gsm. They should only be used within the building envelope, protected from the weather, and kept permanently dry.

On a less positive note, the Commission also changed the provisions for payment outside of the 50km radius without consultation. As a result, if an employee is attending a site that is not in the radial area they live in, and if that site is more that 50km by road from the employee's home, and if where they were first employed the job they were on was less than 50km from their home, they get paid time and $0.47 per km from home to the job and return. This is clearly a complex provision so please call us to discuss this change if you think it may impact your businesses. MISCELLANEOUS AWARD SCOPE The coverage of the Miscellaneous Award also changes on 1 July which has the potential to impact on members who engage traditional awardfree roles like supervisors, estimators and cadets.

In external weather exposed locations such as balconies and decks, all unenclosed metal connectors including the joist hangers must have higher levels of corrosion protection such as Stainless Steel 304 or equivalent or 300+ gsm Hot Dipped Galvanising. Between 1km - 10km of a surf coast or 100m - 1km of bayside areas, the options are Stainless Steel 304 or equivalent or 600+ gsm Hot Dipped Galvanising. Within 1km of a surf coast or 100m of bayside areas, or within a 2 metre splash zone of a swimming pool, only Stainless Steel 304 or equivalent may be used. Treated timber can also cause corrosion to metal connectors when moisture is present. All galvanised metal connectors in these situations should be isolated from the treated timber with a protective coating such as epoxy paint.

The changes to the Miscellaneous Award remove a number of limitations on who was excluded from the Award because the nature of their role had not traditionally been award covered. The changes mean that any employee who is not covered by another industry or occupational modern award can now potentially come within the reach of the Miscellaneous Award.

WHERE IS A DAMP PROOF COURSE INSTALLED?

This is subject to the following exceptions. Firstly, the Award still lists an exclusion for “managerial employees” (i.e. those in senior positions in a business). Moreover, given the highest classification under the Award is someone with “advanced trade qualifications or a sub-professional employee”, the award is unlikely to extend to an employee who requires a degree-level qualification to perform their role. Secondly, the Award still indicates that it does not apply to “professional employees such as accountants and finance, marketing, legal, human resources, public relations and information technology specialists“.

The proposed slab height, weep hole height and external surface gradients must be determined prior to commencing works.

Master Builders is seeking guidance at a national level on the exact application of these changes, including how building cadets will be covered as they progress through their studies.

The DPC must be installed: 150 mm above the adjacent ground level ; 75 mm above external surfaces such concrete or landscaped areas graded away from the building. For low rainfall intensity areas 15mm; 50 mm above external surfaces such concrete or landscaped areas graded away from the building and protected from the direct effects of the weather by a carport or veranda.

The correct positioning of the damp proof course (DPC) to the external masonry wall of a building protects the masonry from rising damp. DPC is installed a minimum height above external surfaces and at no higher than the finished slab height.

I’VE NOTICED THAT MASTER BUILDERS DOESN’T PROVIDE OFFTHE-SHELF, TRADE SPECIFIC SAFE WORK METHOD STATEMENTS (SWMS) FOR MEMBERS, WHY IS THIS?

IF I RECEIVE AN INVOICE BY EMAIL AND POST, WHICH DO I RESPOND TO?

It is a legal requirement that your SWMS identifies all of the hazards, risks and controls specific to your workplace, workers and high risk construction tasks being undertaken. This is very difficult to capture in an off-the-shelf SWMS. Your workers must also be able to work in accordance with any SWMS you have in place so it is important that the content of your SWMS reflects exactly how high risk work is being undertaken on site. There are significant fines associated with not complying with SWMS. Using an off-the-shelf, generic SWMS typically prepared by a third party, puts you at risk of not complying with these important legal requirements, as your specific workplace conditions, workers and work processes have not been considered. Master Builders believes that it is important that your workers, and you as a business owner, have a key role in the development of these documents. I'VE BEEN TOLD I NEED TO REVIEW MY SWMS ONCE A YEAR. IS THIS TRUE? No. A SWMS must be regularly reviewed to ensure if it effective and compliant, and revisions made if applicable. This could be as a result of control measures or work processes changing, or feedback from workers as a result of consultation. HOW LONG DO I NEED TO KEEP MY SWMS? You must ensure that your SWMSs are kept and made readily available for inspection until the high risk construction work that you are capturing in your SWMS, is completed. If you have revised your SWMS, all versions should be kept. If you have a notifiable incident occur, which relates to the high risk construction work captured in your SMWS, you must keep that SWMS for at least two years from the date of the notifiable incident. If the construction work at the workplace has ceased within that period, you must keep the SWMS readily available for inspection.

The first claim that you receive on or after the reference date that meets the requirements of a payment claim under chapter 3 of the Building Industry Fairness (Security of Payment) Act 2017 will be the valid payment claim. Any subsequent claim will be invalid unless there is a second reference date that it can attach to. This means that if you receive a claim by email and a copy of that claim later by post, the first is likely to be the valid claim that you are required to respond to. However, to ensure that you do not get caught out if there is another reference date, we strongly recommend that you respond to both claims in any event. If you are giving the claim, only give it once. I THINK THERE IS ROCK ON MY SITE, WHAT DO I DO? If the contract is for domestic building work, you are required to obtain foundations data prior to entering into the contract so you should know whether there is rock on the site or not prior to entering into the contract. However, it is often difficult to estimate the costs associated with removal of the rock or excavation in the rock. So ensure that you provide a reasonable allowance for the rock and set out what you have based the allowance on e.g. six hours of rock breaker, eight hours of excavator, etc and include as a provisional sum item in the contract. If your actual costs differ from the allowance, you will need to submit a variation to the contract for the adjustment. Also remember that you must provide evidence of your actual costs if requested by the owner. WHAT IS AN AMOUNT OWED FOR A SUPPORTING STATEMENT UNDER CHAPTER 3 OF THE BIF ACT? An amount owed is an amount that is due to be paid. It is not an amount that you acknowledge you owe to a subcontractor on the due date for payment, i.e. an amount you state on a payment schedule or payment certificate.

From 1 October 2020, it is an offence not to release security held under a building contract in accordance with the requirements of the contract, unless you have a reasonable excuse (the maximum fine is approximately $26,000 or one year’s imprisonment).

Small Business thrown a lifeline to restructure their business for success As a result, members have been forced to restructure their businesses to meet the legislative requirements. One of the biggest expenses when undertaking a significant business structure change is the cost of transfer duty “tax”. Transfer duty is payable when you transfer assets between entities, potentially costing thousands of dollars. This cost is often why licence holders do not make the structural changes to their business they need to make to become compliant. The good news is the Queensland Government, through the Office of the

Small Business Commissioner, recently introduced a program where small business owners may be fully or partially exempt from paying transfer duty. There are some eligibility criteria, so if you are in the process of changing or considering changing your business structure, please contact your accountant. This exemption couldn't be timelier as licence holders start to lodge their 2020 annual reports to the Queensland Building & Construction Commission (QBCC). The process for lodging this year’s report is the same as last year. Simply login to the myQBCC portal and lodge your report via the online form. It is critical you lodge your report on time. Additionally, this year you must comply with the MFR. Failure to meet the MFR rules may see your licence conditioned, suspended, and ultimately cancelled.

Financial Statements as part of your report, however because you must now comply with the MFR rules, you should seek advice. The consequences could otherwise be disatrous for your business.

LICENCE MAINTENANCE For contractors who are the nominee for their own company, now is the time to ensure your licences are set up appropriately. Your individual licence should be a nominee supervisor licence and not a contractor. Why is this important? If your personal licence is a contractor type licence this means that you must personally meet the MFR requirements as well as the company, essentially doubling the asset requirements. Over the past two years there's been an increased demand for ensuring building and construction industry businesses are structured correctly to comply with both the ATO and the Minimum Financial Requirements (MFR). The consequences for not getting this right can be catastrophic, including loss of licence.

New Statutory Trust Account model The current Project Bank Account (PBAs) model will be replaced with the new Statutory Trust Account (STAs) model on the following dates: •

1 March 2021 – all state government projects (current cohort) – projects between $1M and $10M (ex GST) 1 July 2021 – all state government and hospital and health services – projects over $1M (ex GST) 1 January 2022 – first tranche of trust accounts in the private sector plus all state authorities and local governments – projects over $10M (ex GST) 1 July 2022 – second tranche in the private sector plus all state authorities and local governments – projects $3M to $10M (ex GST) 1 January 2023 –trust accounts apply to all private and public projects over $1M (ex GST).

Key differences between the models include:

n the April - June edition of Master Builder magazine, we discussed the risks associated with doing the things that you do, even when those activities are not actually building work, like visiting sites to give quotes. We received a number of calls from members who were unaware of these additional - and potentially uninsured - risks. Here's some further clarity and suggestions.

As an experienced contractor (licensed or unlicensed), the duty of care you owe to others is higher than the average person. You are expected to understand how to safely build something, and identify when something is unsafe. It's that knowledge the average person doesn't have that sets the bar higher for you over others. That doesn't mean that you have to inspect the whole house when you visit a site to quote on the renovation of the rear deck for example. However, it does mean you must look around the property to give the

quote. If you see the stairs off the back deck are unsafe or a handrail is missing, you must tell the owner. If you know what they're asking you to quote on won't comply with the National Construction Code, you must tell them. You should always voice your concerns while you are on site, and also repeat that advice in writing so you have a record of it. Set out what appears to be unsafe as well as what consequences could result if the owner doesn't fix it. Both matters must be addressed in your notice so the owner clearly understands what could go wrong if they ignore it. Make it clear you take no responsibility if the owner chooses not to address your concerns. If it's a rental property, ensure you tell the tenant about the risk and send a written notice to the leasing agent with a request for confirmation that they have forwarded it to the property owner. he safety of workers on Queensland building sites is of the utmost importance and everyone in the industry must do their part to keep each other safe. There are laws in place to improve the safety of Queensland buildings, which include mandatory safety notifications under the Queensland Building and Construction Commission Act 1991 (QBCC Act). Queensland Building and Construction Commission (QBCC) licensees have an obligation, under the QBCC Act, to report serious workplace safety incidents or face disciplinary action. It is a requirement to tell the QBCC about deaths, serious injuries or incidents that present a serious health and safety risk on a building site. Action must be taken to notify the QBCC of safety matters as soon as one is seen or heard about.

Failure to notify the QBCC about a notifiable incident is illegal, with penalties including the issuing of up to 80 penalty units, which carries a maximum fine of more than $10,000. The QBCC may also suspend or cancel a licence if building or other work on a building site under the licensee’s control may have caused the death of a person, caused grievous bodily harm or otherwise involved a serious risk to the health or safety of a person. Site safety also encompasses building products, with laws preventing the manufacture, distribution and installation of non-conforming building products (NCBP) commencing in November 2017. The NCBP laws improve safety by placing responsibility on anyone in the chain of responsibility, including installers and supervisors, to report unsafe, non-compliant or misrepresented products. When it comes to NCBPs, the QBCC has the power to issue a recall notice for a building

product, issue a warning statement to raise public awareness, and prosecute offences relating to supplying or installing a NCBP. It is important everyone in the building industry understands their responsibilities to check products comply with relevant Australian Standards and are safe, and to notify the QBCC about suspected NCBPs or unsafe building products identified on site. Timely reporting of suspected NCBPs is not only a legal obligation, it enables an investigation to take place which benefits both industry participants and consumers. If a product is found to be a NCBP, it can be removed from sale or rectified, and there can be regulatory action for those in the chain of responsibility to correct or adjust their behaviour. GW HOMES 50 YEAR

F

rom a £100 bank loan back in the day to a respected multi-faceted building company spanning South East Queensland, the GW Homes story is one built on a simple but solid foundation: family. The company is now celebrating another milestone in its proud history – 50 years as valued members of Master Builders.

GW Homes founder Grant Williams, who sadly passed away last year, started out in the 1960s with friend Peter Makepeace, buying and selling land, then secured the equivalent of a $200 loan to build a house. Over the years he and his family built the brand up to the respected name it is today. Grant was a great friend to Master Builders, and highly-regarded in the industry. He held

positions in Queensland and at a national level, including President in 1994/95, served as a judge for the Awards programs, and was honoured as a life member in 2001. Grant’s son and GW Homes Director Andrew Williams said his father’s Master Builders membership had meant “everything” to him – and remained highly-valued by the family today.

“The assistance Master Builders has given us over the years has been invaluable, and dad recognised that early on," Grant said. “In the later years when I took over from him, he spent nearly every single day at Master Builders doing judging - he well and truly liked it better there!”

Having expanded to include a home improvement arm and rental management company, as well as building bespoke and high-end homes, GW Homes remains dedicated to growth - and loyalty. “With subcontractors, our electrician for example is third generation - that particular company wired our first house, and still works for us today. Now my son is third generation – he’s finishing his building degree and will come up through the ranks" Andrew said. “You don’t realise and suddenly, it hits home – you know, we’ve been doing this for over 50 years. It’s humbling to be recognised for the input that both myself and my father have given to Master Builders, and we thank you."

Timber is a beautiful medium to work with, and it really allows me to be creative. I much prefer working with solid timber versus the more ‘regular’ mediums.

he excitement was palpable as work began on stage two of the $2.5 million redevelopment of Queensland’s first and oldest Autism-specific school. Master Builders CEO Grant Galvin joined Autism Queensland Director and Chairman Ian Langdon and Armstrong Building founder Clive Armstrong,to turn the first sod on the project at Brisbane’s Sunnybank Hills. Half of the funding for the three-stage redevelopment work at the school was received from the Independent Schools Queensland Building Authority, with the former Master Builders Foundation tipping in $115,000 towards the remainder. The second stage sees an existing brick classroom building dating back to the 1970s gutted and transformed to feature six modern classrooms. Autism QLD CEO Pam McCrossan said the work was geared around optimising the

education environment. “We use materials that absorb sound, so the teacher’s voice and the students’ voices are the most important sounds happening in the classroom. Every classroom we build or renovate also incorporates an outdoor learning space ,” Ms McCrossan said. “The grant from Master Builders helped make this possible – without it, it would not have been able to go ahead. So, we’re incredibly grateful.” Armstrong Building began demolition in August, with construction scheduled for completion in December. “It’s fantastic to see the project begin whilst utilising one of our well-respected and credentialed members,” Mr Galvin said. “Master Builders is proud to have facilitated the remaining voluntary contributions from our members to help support these works

and make a difference in the community for these very-deserving students and teachers.” Mr Armstrong said Armstrong Building was thrilled to work on the project. “We just really, really enjoy the concept of creating something that kids can enjoy, and that changes society. I think our team do too, and we love working with good people – it’s very rewarding.”

“Watpac has been in Townsville for over 20 years now, but for a project that size we needed to obviously increase our numbers and our site management team, so we

engaged local personnel to do that as well,” Brian said. “That’s a legacy left for them, for the town – they can drive past it in years to come and say, ‘I was involved in doing that.’ “If we were to bring external contractors in, it’s just a job to them, whereas for the local contractors it’s not just a job, it’s their footy team, it’s ingrained into the social fabric of the local community.” Master Builder | 43

This is a magnificent contribution to the skyline of the City of Townsville, the likes of which we will probably not witness AGAIN for generations Mother Nature was also determined to make her mark on the project, with Townsville’s monsoonal flood event hitting right in the middle of the construction program, bringing work grinding to a halt for several weeks. “Even the workforce after the floods was quite reduced because people’s homes had been inundated, so naturally they were looking after their families and livelihoods first,” Brian said. “We took that on board, we spoke to a few contractors we had at the stadium and engaged them to help out with bobcats, excavators and trucks. We gathered a team together and went out across a number of days to help clean up the devastation that was left behind. “It was quite an emotional journey as well for the team because you can imagine walking into people’s houses – they’re devastated, and you’re asking them, what can we do to help? You can see the devastation going right through their faces, and it was one of the aspects about the project that sunk it home that it’s not just about building buildings, it’s about the local community.” Despite the floods, the Watpac team 44 | Master Builder

managed to overcome and keep the project on track, delivering on the design which pays homage to the stunning North Queensland landscape. Featuring a horseshoe-shaped, cantilevered roof inspired by the pandanus plant, the stadium boasts panoramic views to the city, Castle Hill and Magnetic Island. While the unique nature of the roof made it Brian’s favourite, he said it was also the most complex he’d ever worked on for a stadium project. “Especially being in a cyclonic region, the cantilevers on that roof are phenomenal when you consider the wind category it’s in. Not one out of the 36 trusses were the same, so it involved quite an intricate setup. “Each truss jig that was set up had to be changed for the next truss to go into it; each element was different, there was quite a lot of welding involved, so it needed quite a high level of skillset to actually put those trusses together…but it all went well.” Beyond the stands lie state-of-the art facilities for home NRL team the North Queensland Cowboys and other athletes,

including dedicated wet areas, spa baths, warm-up zones, medical and massage rooms, event management, green and dressing rooms, while the sustainability box is ticked by the recycled water network. Patrons can also walk the full 600 metres around the stadium via a nine-metre-wide concourse, with unobstructed views of the playing field thanks to lighting being installed in the roof, instead of on towers. Having being delivered for client the Department of Housing and Public Works, in collaboration with Stadiums Queensland, North Queensland Cowboys, the NRL and Townsville City Council, the Master Builders Housing & Construction Awards panel noted this project would always be subject to political and public scrutiny. “Watpac appears to have handled the delivery with considered and appropriate professionalism,” one judge said. “This is a magnificent contribution to the skyline of the City of Townsville, the likes of which we will probably not witness again for generations,” praised another. Brian was clearly humbled by the accolades –

and the positive response from the locals. “It’s gratification for all the hard work, especially that all the team has put together,” he said. “You put your heart and soul into it, you wake up at night dreaming about the project and send yourself emails at 2am so you don’t forget something. It was a whole team effort. “As someone who loves what they do, I would love to see more of it, because that’s what we like – building complex projects and architectural greatness. “That project’s not just the building itself, but the environment we built it in, the regional area that we built it in. I think it’s going to be hard to beat it, to be honest, and get that community aspect around it.” In September, Watpac Construction merged with BESIX, the company behind the world’s tallest building, Dubai’s Burj Khalifa, to become BESIX Watpac, promising even more exciting projects to come. HUTCHIES HITS HISTORIC MILESTONE For the first time in Master Builders' history, we have a member celebrating 100 years of membership - the iconic Hutchinson Builders. Just eleven years after the Federation of Australia in 1901, John (Jack) Hutchinson I and his young family emigrated from England, where he established the national brand now affectionately known as "Hutchies." The company joined Master Builders in 1920, with John (Jack Snr) attending he 1937 Convention of the Master Builders' Federation of Australia. John (Jack) Hutchinson II served as President from 1940 - 42, with Jack Hutchinson III following suit in 1996-97. Jack also served as Master National President and on the Master Builders Queensland

State Council and Executive for many years. In 2001, after 17 years as Master Builders Executive Director, Greg Quinn joined the Hutchies team as Managing Director. In 2009, Jack Hutchinson was honoured as a Master Builders Life Member, and two years later was appointed a Member of the Order of Australia for his contribution and service to the building industry. Hutchies remains a privately-owned Australian business, built across five generations. Third generation Jack Hutchinson (Snr) AM is a drector, while fourth generation Scott Hutchinson is the chairman. The youngest, Jack Junior, currently serves on their board and is a licensed builder.

In 2020, they walked away with two out of three majors at the Queensland Housing & Construction Awards, including Project of the Year and House of the Year - a feat never before accomplished in the Awards’ history. Master Builders President Ralf Dutton presented Jack Hutchinson III with a trophy as part of the Awards' broadcast event. "As business leaders within our industry, you continue to lead the way and break new ground," Mr Dutton said. "We are so proud to call you our members and anticipate that our long and proud association will continue – here’s to another 100 years."

Verified steel conformity from source to site

From the structural and reinforcing steels used in the construction of buildings, bridges and other infrastructure, through to the reinforcing steel used in piling cages or precast concrete components, ensuring that the construction steels being used conform with all relevant Australian and New Zealand Standards and Building Codes — irrespective of their country of origin — is of paramount importance. Notwithstanding the potential issues that can result from using non-conforming construction steels — including structural failure and the serious health and safety ramifications — in these days of widespread litigation and strict ‘chain of responsibility’ legislation, using materials that don't conform with all of the relevant Standards and Codes can spell disaster for engineers, specifiers, suppliers, builders and contractors in more ways than one. Importantly, when it comes to conformity of construction steels, it’s not only about the steel manufacturer. Philip Sanders, CEO, Australasian Certification Authority for Reinforcing and Structural Steels (“ACRS”), explained: “When designers and procurement officers specify steel to particular standards, steel suppliers, builders, and building surveyors not only need to actively confirm that the steel they receive and sign-off for is the right steel — they also need to confirm that this conforming steel was cut, bent,

and welded so it is still compliant when it is delivered and installed on the project.” “In short, even the best steel in the world can easily be ruined by inappropriate processing or fabrication — and if the steel was the wrong steel in the first place, the best steel processing, or fabrication won’t make it right… and that’s why ACRS 2-Stage steel certification is so important,” he added. THE BENEFITS OF ACRS 2-STAGE CERTIFICATION Adapted for Australian and New Zealand conditions from European best practice for high-risk building materials, ACRS' integrated, 2-stage certification system certifies both the steelmaking at the mill and again the last point at which the steel properties can be changed before delivery and installation in the structure. Known as a “bookended” system, the type of 2-stage certification is far more robust than a single point certification of either just the mill, or just the processor or fabricator (or of one stage being certified by one certifier and the second stage by another). As ACRS steel certification covers both ends if the supply chain, the ACRS 2-stage system inherently includes full materials traceability — not just for reinforcing and prestressing steels, but also for structural

welded sections manufacture, covering CC1 to CC3 to AS/NZS 5131, which are increasingly used in construction. Philip Sanders commented: “You cannot just accept certification of the steel mill (Stage 1). You need to know what arrives on site. Is all the steel you expect? If it is, has it then been properly processed or fabricated?” “Historically, Australia and New Zealand have accepted a more relaxed product verification regime at the processor or fabricator (Stage 2) level than most developed countries, and these less onerous requirements have saved builders significant time and money in checking and testing costs.” “However, in today’s dynamic market with global sourcing and supply, we can only maintain our traditional approach by the use of expert and independent certification systems to provide the minimum necessary assurance of both steel manufacture and equally the supply of that steel to site,” he added. “If not, as shown increasingly over the past few years, there will be more poorly performing structures as non-conforming materials are substituted for those the customer, and the public have been led to expect.”

n recent years concern has grown over the health impacts of exposure to respirable crystalline silica dust (RCS). Silica is contained in many common construction products, and exposure can result in severe medical conditions, such as lung cancer, silicosis, kidney disease and chronic obstructive pulmonary disease. Due to the high number of construction products containing silica, it is a hazard that cannot be eliminated completely, so it must be managed safely. Three years ago, Master Builders identified that despite the abundance of silica products used, there was a lack of resources and training designed specifically for the construction industry on the health effects of RCS and how to control exposure effectively. Existing resources on the topic were highly technical and disjointed, making education and compliance on this issue a challenge. The Master Builders silica awareness training course was developed with the aim of providing businesses and their workers with a consolidated source of construction industry-specific information on how to work with and around RCS safely. The course gives participants the ability to identify silica risks in their workplace, highlights the health effects associated with silica, and provides practical examples of control measures they can put in place within their business to protect themselves and others. Close to 500 workers across Queensland have completed Master Builders’ silica awareness training course in the last year alone, with many businesses taking the

next positive step of implementing new systems and control measures following the completion of the workshop - which is fantastic to see. One of those is Mackay property maintenance business Jayden Enterprises. Owner and director Dirk Neugebauer said he decided to enrol his staff after being made more aware of the dangers through Master Builders’ member communications. “The main reason was to ensure we protect our workers, our clients and their clients from a disease that has been around for years but has come more to light by losing so many unprotected and unprepared workers and companies,” Mr Neugebauer said. “Having put our 10-plus employees through the Asbestos licence course and several through the asbestos awareness and waterproofing course, we knew that the best place to get the information and training for this newest danger in the building industry would be through Master Builders.” Mr Neugebauer said the best aspect of the course was the way it was set out, and the level of information it contained. “It was well planned out - not just a 20-minute pretend course. It’s allowed our guys to gain the knowledge and the knowhow for protecting not only themselves but the greater community whenever they do works involving cutting, grinding, drilling, sweeping or working in and around materials which may generate silica dust.” Armed with their new-found knowledge, the Jayden Enterprises team has since implemented new controls including a

silica Safe Work Procedure outlining how to identify, treat and work in and around silica, as well as fit testing, supplying appropriate masks, purchasing M-class vacuums and drill adaptors.
