No time for a big stick approach with Ralf Dutton, President
PRESSURE is building for our industry, and as we continue to face new legislation and regulation that is impacting productivity and competitiveness, it’s time to get back to basics… and drop the big stick. As an industry, we are increasingly facing a media landscape that is intent on laying blame on builders and subbies, for a seemingly unending list of issues. Add to that a regulator who is unapologetic about their black and white approach to enforcing the law and a series of new laws and regulations being imposed on our industry in a short period of time, it’s easy to forget that the vast majority of the industry are consistently doing the right thing. So when it comes to new laws, it’s not surprising that the same majority of good builders and subbies are tiring of these new laws, rules and regulations, which ultimately make it harder for good operators to stay competitive. 4 | Master Builder
While there is a general consensus between industry and the regulator that “taking the cowboy builders and subbies out of the industry is a good idea”, there is no united front on how this huge task should be undertaken. What we know is that as a result, for many the pressure is building. There are big industry players, and some mum and dad operators, particularly in the regions who consistently tell us “this is all getting too hard”. And that’s where Master Builders comes in. We are out there lobbying to all levels of government regardless of their political affiliation, that layer upon layers of new legislation in what is already a complex industry, is not the answer. Unfortunately, though, the solutions that will go a long way to addressing these issues are not particularly headline grabbing – they are about ‘getting back to basics’, not adding more complexity.
Solutions like payment fairness from developers and consumers; including fairer contract provisions which ensure the owner has to pay for a job completed; compulsory education (particularly business management); and a regulator that is balanced and pragmatic. Over the next 12 months – and particularly as we approach a Queensland Election in 2020, we’ll be supporting you. Sometimes it might seem like we’re silent on an issue – but rest assured, we are working hard behind the scenes and at a state and grassroots level, having conversations, meetings, policy discussions and phone calls with ministers and commissioners. And as we continue the countdown to the next election, we’ll use platforms like this as well as our regular communication channels to keep you informed on our progress.

Where to for the industry in 2019/20 with Paul Bidwell, Deputy CEO
WHILE the dust has settled on the Queensland Government’s 2019-20 Budget (handed down on 11 June), it’s looking increasingly certain that the Treasurer missed an opportunity to provide muchneeded financial support to our industry. The one positive thing was for the commercial sector, where the government allocated $10.2 billion for public buildings and infrastructure, up $1.4 billion from the $8.8 billion spent in 2018-19. This spending will be welcomed by commercial builders across the state. But it’s still short of the 25-yearaverage, which is what we think they need to be spending. Beyond funding this shortfall, the government needs to make sure that they spend what they’ve allocated in the Budget. In 2018-19, they spent about $8.8 billion, $200 million less than what had been budgeted. Across the past four years the Government has underspent to the tune of $4.7 billion. As a result, thousands of potential construction jobs across the state have gone begging. The other thing that we asked the Treasurer 8 | Master Builder
was to bring back the $5,000 Boost to the First Home Owners’ Grant (FHOG) for regional Queensland. The housing sector needs some sort of injection to stimulate demand – particularly in regional Queensland where builders are desperately looking for some good news. The outlook for the sector is grim and getting grimmer, with dwelling commencements down to around 39,000 for the past 12 months. This is the first time housing starts have dropped below 40,000 in the past five years. Not only are commencements at a considerable low, total dwelling approvals have plunged, down 24 per cent for the 12 months to June. Despite this, there are a range of recent factors that could increase economic growth. Things like the latest tax and interest rate cuts may influence confidence and it's good news that we no longer have the specter of negative gearing and capital gains tax changes hanging over our heads. And there’s the recent announcement that Rockhampton Regional Council is providing
grants of $5,000 to residents who build a new home. This could just be the kick-start the Rockhampton housing market needs to turn a corner. We know that $5,000 can often be the difference, particularly for first home buyers, between building a new home or not. And with Rockhampton leading the charge, we’re calling on other regional councils to follow suit. Unfortunately, the Treasurer ignored us in the State Budget, but it’s not too late for the Queensland Government to change its mind. Rockhampton’s decision to introduce the incentive locally will be a great opportunity to test the waters for how successful the incentive is in creating demand. The unfortunate reality is the housing sector is in a state of freefall. We are hopeful that economic conditions will turn around; the question remains when. Until then, our message to all levels of government remains to consider the outlook for our industry when making any policy decisions.

News update ARE YOU COMPLYING WITH THE EARTHQUAKE STANDARD? WITH earthquake standard compliance on the industry’s radar, it’s time to get across your obligations. The Australian Building Codes Board (ABCB) has the Earthquake Standard in their sights, recently reminding industry stakeholders of their obligations to comply, and with the Queensland Building and Construction Commission (QBCC) also carrying out audits.
WASTE LEVY NEWS THE waste levy is now in action. It kicked off on 1 July 2019 at $75/tonne. A higher rate of up to $155/tonne will be charged on regulated waste (e.g asbestos, white goods and architectural and decorative paints). The levy rate will increase by $5 per year over the next four years. Who pays? The operators of the waste disposal facilities will be responsible for collecting the levy. GST will also be charged on the levy by the waste facilities. The government claims that the levy will have no direct impact on households; however, this will not be the case for those wanting to build a new home or renovate their existing home. You should also understand how your local council fee structure will be impacted. NEW PERIOD SUBCONTRACT AGREEMENT AND WORK ORDER THE new look Period Subcontract Agreement (PSC) and Work Order (WO) are now available in eDocs. As well as being fully compliant with recent legislation changes, the new versions of the PSC and WO are more comprehensive than previous versions. If you’re already an eDocs user, the new documents are now available and replace the previous versions. If you’re not an eDocs user, sign up today or contact us for advice on which contract to use.
There are varying reports on this issue, with word from the industry that certifiers have begun asking for evidence of suitability that building products used, as well as design and construction certificates meet the standard. It’s important to understand your obligations and to know that manufacturers and suppliers are aware of the issue and are working to improve their documentation to assist builders to supply satisfactory evidence. We’re calling for a sensible, risk-based approach to the issue, and will push for changes to the Earthquake Standard, including potentially modifying earthquake provisions in particular locations – as has been done for cyclonic wind design requirements. PI INSURANCE CLADDING CRISIS GETS SOLUTION THE Queensland Government has heeded our calls for change in rules for licensing building certifiers.

On 9 August, government amended the regulation to allow building certifiers to have an exclusion on their Professional Indemnity (PI) insurance for external cladding made from a composite material. This is an important reprieve for private certification and should help the majority of the industry (largely the housing sector) which is not affected by the cladding problems caused by the use of aluminium composite panels (ACP’s). The ball is now back in the court of insurance companies who should now be in a position to offer insurance that meets the certifiers’ licensing requirements. There will be ongoing problems for those working Class 2-9 building where they will continue to need to work with composite cladding in some form. With the insurance industry increasingly unwilling to cover external cladding,, we will continue to work with government to identify a new way to indemnify the certification of this work.
ANNUAL Financial Reporting for all licensees will be in action from 1 January 2020 and it’s imperative to prepare your business right now. It forms the final part of the Minimum Financial Requirements (MFRs) regulations and will be relevant to self-certification categories (SC) 1-2 and category 1-3 licensees.
WHO WILL PAY? CLADDING RECTIFICATION WHILE there has been movement on the front of PI insurance, what remains unknown is who will pay for cladding rectification.

This medium/longer term issue pertains to the 100 existing buildings that will be identified through the Safer Building Program as having combustible cladding.
Check-in with your certifier to see how they are tracking for their PI insurance renewal - especially for any projects that are currently underway. See page 12 for further information.
The bottom line is builders, certifiers and building owners should not be left to pay for the rectification of buildings which were deemed compliant at the time that they were built.
While 31 December 2019 might seem like a world away – it’s important to get in early and be prepared. To be safe, we recommend you aim for submission by the end of October. Earlier this year, we strongly recommended you start the financial year off on the right foot with the correct reporting in place. If you haven’t done so yet, it’s not too late and will make it so much easier to meet the 31 December 2019 deadline. If you miss the reporting deadline, you risk licence suspension and having to pay a fine. Master Builders is here for you to ensure you’re across what you need to know and what you need to do. What a difference a few months make – last edition we identified the challenges being faced in the industry with non-conforming products and building quality, and we have continued to call for change in the rules for licensing of building certifiers. It was great to see the Minister for Housing and Public Works, Mick de Brenni, announce that building certifiers will be allowed to have an exclusion on their Professional Indemnity (PI) insurance for cladding made from a composite material. This should help the majority of the industry, especially the housing sector, which is not affected by the cladding problems caused by the use of aluminium composite panels (ACPs).

With the insurance industry increasingly unwilling to cover combustible cladding, we will continue to work with the government to identify a new way to indemnify the certification of this work. Answers still needed Industry also needs an answer for existing buildings identified with ‘combustible’ cladding, as the owners and builders will no longer have the certifier’s PI insurance to call on in many cases. The Minister’s announcement included details of a ban on ACPs panels with a PE core of 30 per cent or more on all new buildings.

For new buildings, we support this ban as it is in line with the current rules under the NCC for the use of combustible materials. For existing buildings where ACPs have been used, it is important to acknowledge that they can be made safe by way of a performance solution. The Minister also called for a national ban on the importation of ACPs with a PE core. We have some concerns with this step as there are safe and compliant uses for these products – for example signage. The use of ACPs is better controlled by the measures that focus on how they are used in buildings.

Far North Queensland Region
The Far North Queensland region covers a total area of 273,157 sq km or 15.8 per cent of Queensland.
Far North Queensland lays claim to over 70 national parks, including Mount Bartle Frere with a peak of 1,622 metres (5,322 ft). It’s the highest peak in northern Australia and Queensland.

WHAT HAPPENS IF MY EMPLOYEE GETS SICK WHILE ON ANNUAL LEAVE?
HOW COULD A LOCAL PLANNING SCHEME AFFECT A BUILDING APPROVAL?
If your employee gets sick while on leave, they can request to have the leave reinstated. An employee who gets sick while on annual leave or long service leave and provides a medical certificate to support this can take personal leave for the sick days and have the annual or long service leave credited for that period.
In some circumstances, a local planning scheme could trigger a material change of use requiring a development approval. A development approval is required before the certifier issues the building approval. Therefore, you won’t be able to start building work until you have both approvals.
WHICH PUBLIC HOLIDAY SHOULD I PAY?
Building work for a class 1a or class 10 building is accepted development under the Planning Act 2016, requiring no development approval. However, this could alter under a local planning scheme if the acceptable outcomes are not met or there is a relevant overlay mapped over the site.
When a company has operations that are spread across multiple regions or does away work, it can be difficult to know which public holiday to pay. For example, if an employee is based in Brisbane but is working in Gladstone over the Ekka week, how should they be paid? The relevant public holiday is the one at the employee’s home base. In this case, an employee working in Gladstone can either have the Ekka show day off or work the day and be paid penalty rates. An employee is not obligated to work on a public holiday if it is not reasonable to do so. If it was the Gladstone show day while the employee was working in that region they would not be entitled to the day off or penalty rates for that day’s work. This can make life difficult if there are restrictions on work in the distant region because of the holiday or you can’t provide work because you are reliant on others who are not working. If this is the case, you can seek the agreement of the employee to take another day as the public holiday instead. If you can’t reach agreement, give Master Builders Workplace Relations team a call to discuss your options.
DO I HAVE TO PAY SUPERANNUATION ON ANNUAL LEAVE LOADING? A recent ATO case has clarified that there are limited times when an employer will not have to pay superannuation on annual leave loading. Superannuation will not be payable on annual leave loading if the loading can be clearly linked to the loss of opportunity to work overtime when on leave. Just saying that this is what the purpose of the loading is not enough, there must be some factual basis for the claim. An example would be where an employee has an agreement that states 45 hours per week will be worked, that being 38 ordinary hours and seven reasonable additional hours. And in addition, the policy or employment contract clearly states that leave loading is paid as compensation for the loss of overtime while on leave. You would meet the evidence requirements and decide not to pay superannuation on leave loading. Where an employee is paid a salary, superannuation will always be payable on leave loading as there is no separate amount of overtime to be compensated.
The acceptable outcomes under a dwelling code within the local planning scheme mostly cover building setbacks, building height and site cover. An overlay provides additional information about the land, mapped within the local planning scheme and works in conjunction with a code, e.g. house code. Most overlays do not follow property boundaries because the mapping shows physical or land features, e.g. dense vegetation.
WHAT IS A PRE-PURCHASE BUILDING INSPECTION REPORT? A pre-purchase inspection is a non-invasive visual inspection and must be undertaken by a QBCC licensed completed residential inspector. The inspector will provide a report on the visual condition of the residential dwelling in accordance with Australian Standard (AS) 4349.1. If the inspection relates to an inspection for termites, the report will be in accordance with AS 4391.3. Professional Indemnity insurance is required if undertaking prepurchase inspections. The purpose of the inspection is to advise the prospective purchaser of the condition of the property at the time of the inspection. The report generally covers interior, roof void, exterior, subfloor and roof exterior. The pre-purchase building inspection does not include an invasive inspection, inaccessible area, areas that are unsafe, timber pest activity and damage, asbestos and mould. A good pre-purchase inspection report needs to list unsafe conditions and other inspections that are recommended and why. The use of photos keeps the reader engaged and shows the buyer what the inspector did and didn’t see. Importantly, an inspector needs to be provided professional courtesy at all times.

WHAT IS A SAFETY DATA SHEET? A Safety Data Sheet is a document that outlines important safety information about hazardous chemicals. Types of information they contain may include: •

Emergency procedures

Disposal considerations.
Safety Data Sheets should be used when making an assessment about the types of chemicals used in the workplace, whether they are hazardous and how they should be managed. You can request a copy of a Safety Data Sheet from the manufacturer, importer or supplier of a hazardous chemical. Many manufacturers and importers make electronic copies of Safety Data Sheets available on their websites.
WHAT IS A HAZARDOUS CHEMICAL REGISTER? A hazardous chemical register is a list of all of the hazardous chemicals that you are using, handling or storing in your workplace. You must keep a copy of all current Safety Data Sheets with the hazardous chemical register for your workplace. It is required to be kept under the Work Health and Safety Regulation 2011 and must be readily accessible to all workers involved in the use, storage and handling of the hazardous chemicals and to anyone else who is likely to be affected by the chemical at your workplace.
CAN I USE A GENERIC SAFE WORK METHOD STATEMENT (SWMS)? A generic SWMS can be prepared and used for work activities that are carried out on a regular basis and involve similar hazards, risks and controls. A review and revision must still be undertaken on the generic SWMS prior to each activity being undertaken to ensure there are not any extra hazards, risks or controls that need to be included.

IS IT AN OFFENCE NOT TO RELEASE A BANK GUARANTEE? Under the new section 67NB of the Queensland Building and Construction Commission Act 1991 (QBCC Act), it is an offence for a person not to release cash retention in accordance with the contract, unless it is the subject of a dispute or paid into court. This carries with it a maximum fine of approximately $26,000 or one year’s imprisonment. However, this new offence does not apply to security held in the form of a bank guarantee.
HOW DO I GET THE BANK GUARANTEE RETURNED? Review the terms of the contract and determine what the process is for requesting the release of the bank guarantee. Follow the process as set out in the contract and take note of any applicable timeframes and pre-conditions.
WHAT CAN I DO IF THE BANK GUARANTEE IS NOT RELEASED? You should formally raise a dispute under the Dispute Resolution Clause in the contract. This will typically involve the escalation of the dispute to a senior executive of the company rather than the person that you may have been dealing with previously. If no agreement is reached, consider making an application to the court for a direction for the bank guarantee to be released. This situation may be avoided by providing bank guarantees with an expiry date. Often banks will insist on this anyway so that the bank guarantee is of no effect once the expiry date has been reached.
CAN THE QBCC HELP ME WITH A BANK GUARANTEE DISPUTE? Recent changes to the QBCC Act (s42E) include the addition of a new offence for a person, without a reasonable excuse, to cause significant financial loss because the person deliberately avoids complying with, or fails to comply with, the contract. This carries a maximum fine of approximately $46,000. A Notification of Offence form can be completed and submitted to the QBCC to investigate.

Let's talk tolerances BUILDING works are required to be ‘fit for purpose’ and finished to an acceptable standard. But sometimes the finished works may not meet someone’s expectations. This reason alone is a good reason to have standards. Standards in part have tolerances which, amongst other things, allows for a degree of variation to the building work. However, specifying tolerances in accordance with an Australian Standard may not cover all aspects of variations found within the
completed works. For example, there will be structural and visual appearance (cosmetic) considerations for the building work. Building work can be structurally sound but if expectations for the visual appearance are not met this exacerbates disputes about the quality and compliance of building work. If the nominated Australian Standard doesn’t have visual tolerances, reference to the product manufacturer recommendations would be appropriate. Manufacturer’s recommendations carry a lot of weight
when it comes to settling building disputes. Importantly, manufacturer’s tolerances show variations are acceptable in regards to their products and consequently within the finished building work. Builders should ensure trade contractors are made aware of the tolerances necessary for their projects by clearly referring to any specification, code or standard relevant to the contract’s scope of works. Procurement policy changes are here These changes impact you. From 1 August, the state government has introduced three significant changes to their procurement policy.

What is it?
The system is designed to provide good performers with more opportunities to work on state government building projects; and poor performers with less opportunity.
It involves supplier demerit points and sanctions. It will apply to building, construction and maintenance contracts starting after 1 August 2019.
Further to the demerit scheme, government has further complicated the process by introducing an Ethical Supplier Threshold, which relates to correct payment of employees. Breaching any one of these things means 20 demerit points and the sanctions referred to above can apply.
What you need to do No action is required by building contractors, but if you regularly tender for Queensland Government work, be aware the new system will be in place and that you will be rated on your performance.

Tradie: Ronald Walkley From working in a bakery to running his own tiling business, Ronald has a great story to tell of diversifying your skillset and never saying no to a new opportunity. Ronald recently took out Master Builders Gold Coast Residential Trade Contractor of the Year.
At what age did you start working in the industry? How did you get into it? After finishing up as Production Manager in Buttercup Bakeries Burleigh, I started in the tiling trade when I was 30. A friend wanted help with a tiling job one day, and I haven't stopped tiling since.
What appealed to you about this profession? After being governed by machines in the stressful baking industry, the relaxing, unstressful and artistic trade of tiling really appealed to me, along with my problem solving skills.
Tell us about one of the most memorable jobs you’ve done? That would have to be the renovation I just completed for Richard Parsons Constructions. There were so many unique challenges and a variety of skills required. I had to lay the French limestone around the pool and stairs which required an in-depth set out. I tiled random stone wall cladding to retaining walls, fireplace and a fire pit. We even had stone stair treads, three metres long that required cutting into existing boulder walls, with edges requiring chiseling. Finally, the driveway and path were individually cobble stoned, with curves. Not many homes are this varied.
How did you come to learn your craft and expand your skills? I was taught tiling on new houses on Sovereign Island, but as with many trades, it’s up to the individual to progress further to greatly improve his or her skills.
What do you love most about your job? I love the variety of doing custom homes and the variety of work that each offer. I love working with glass mosaics and have tiled my own bathrooms floor to ceiling with these. I have shown what you can achieve with glass mosaic if you have the patience to go that extra distance.
What do you find most challenging about your job? What I find most challenging is the size of tiles now being produced and the small difficult areas in which they are to be tiled, being floors or walls.
Have you won any work awards? If so, what are they? Winning the 2019 Gold Coast Master Builders Residential Trade Contractor of the Year is the pinnacle of my achievements.
Where do you see yourself five years from now? I hope to continue working on more awardwinning homes and I’m possibly looking at starting a specialist training course to teach the skills I have learned over my career.
Have you completed any training with Master Builders? If so, what courses were they and how have they helped you? I completed the blue card induction course (now known as General Safety Inductions (White Card)) with Master Builders early in my career, and intend to do further courses with them.

I collect vinyl records, play pool, darts and am learning the guitar.
Tell us an interesting fact about yourself. When I started as Production Manager for Buttercup Bakeries Burleigh (their flagship, brand new bakery, run by computers, and with the first robots to be installed in a bakery), I was the youngest Production Manager in the bakery group Australia-wide. How long has your business been operating?
What do you love most about your job?
iBuild Consultants started operation in 2015.
When I go to a new home handover inspection and see that the builder has done a fantastic job and built a high-quality product for our mutual clients. It always puts a smile on my face to see a building supervisor proud of the home he has built.
Tell us a little bit about your business. We specialise in pre-settlement handover inspections and 12 month maintenance inspections on new homes.
At what age did you start working in the industry? How did you get into it? I started my apprenticeship at 18 after attending a trade technical college. As a kid, I would always be building something and dreamed of being in construction, so I pursued my dream. My first job was working on the Rialto Towers in Melbourne.
How did you come to transition from builder to consultant? After 32 years of working in residential building and completing hundreds of handovers there was a gap in streamlining the process. I wanted to create a user-friendly inspection report. I consulted with clients and industry experts and worked on a reporting system that would efficiently and accurately communicate to clients, builders and buyers advocates.
What’s been one of the most rewarding jobs you’ve done/ creations you’ve made? I feel that right now I am lucky enough to see clients excited about the prospect of moving into their new home and them feeling confident about the product they have purchased.
What do you find most challenging about your job? Gaining the respect and confidence of a new builder so we can work collaboratively to ultimately provide a great product for their client.
What do you like most about being a Master Builders member? The ability to have access to up-to-date industry information and support.
What is your formula for success in business? A great client experience, consistency and keeping it simple and honest for our clients.
What do you wish someone had told you when you were starting out in the industry? Be confident to start your own business, surround yourself with good people and make a success of it.
How have you used innovation to have a point of difference in your business? We have developed an innovative reporting system specifically designed to communicate the necessary and accurate
information required in a quality handover inspection, whilst being user-friendly for all stakeholders.
What’s been one of the funniest moments of your career? On a job site, I picked up a four litre can of paint and shook it not realising the lid was not on properly and covered myself from head to toe, my painter thought that was a real gag.
What are your top three tips for anyone starting out in the industry? Always wear your PPE and know how to ask for help. Communicate and be friendly. If you are lucky enough to work alongside a Master Builder, listen and learn.
What’s the best advice you can give to someone about running their own trades business? Trust your instinct, create a reliable team, stay on top of your bookkeeping and be the master of your own destiny.

Opportunity a dream for newbie Ziem THE BRIEF: Build an authentic Moroccanstyle dream home on a narrow, absolute beachfront block.
of the site that it would be a mammoth task but remained focused on the learning curve and rare opportunity.
The multi-million dollar lot fronts a busy, oneway street in popular Palm Beach and you’ve got to demolish the existing house on the block first. Would you take it on?
“With the build being an authentic Moroccanstyle home that would involve significant input from the client, I knew it would be a tough year of construction. But I was 100 per cent willing to put in the extra work,” he said.
It’s a tough gig for any builder but there’s added pressure when the client is your brother and his prominent, fashion designer wife. Alley Building owner Corey Ziems, 36 admitted it was “extremely daunting” having only had his builders licence for a few years at the time. “We’d only being doing smaller renovations and making recycled furniture for local cafes and businesses up until that point,” he said. “But when this opportunity came up, they asked me if I’d be willing to look at it and of course, I thought it was a great opportunity. “It’s obviously something that with my early stages of experience, I wouldn’t have had the opportunity to work on without them. I knew it would be a good feather in my cap.” Ziems said it was clear from first inspection 38 | Master Builder
And with that view, Ziems agreed to take on the job. “We had a standard arch plan but not a whole lot of details internally, they left that up to me, my sister-in-law and the designers,” Ziems said.
“I had a 30 page inspo book from Pinterest and Instagram that we followed and used," Corey Ziem, Alley Building “In authentic style, the work was all block and concrete. We had two suspended slabs and everything else was blockwork. My sister-inlaw had a strong idea of what she wanted to do.” Ziems was upfront about how difficult it was to find trades to carry out the work.
“No-one had really come across this Moroccan style and they wanted to be as authentic as possible, we weren’t allowed to batten any of the walls,” Ziems said. “There’s no timber frame in the house, it’s all blockwork and rendered. So when you touch the home and feel it, it feels authentic.” He said the nature of the blockwork required significant logistical planning. “Every single thing that had to go into the walls with electrical, plumbing and everything to service the whole house, it had to go in at once as there was no battening,” he said. “It all had to be perfectly in place and that right there was probably the main challenge we had in the build. That really blows out the construction side of things, but the end product speaks for itself. It really does have that authentic feel so we got it to what she wanted.” Adding to that, the limited site access required the home to be built in a phased approach from the oceanside to the street to maintain storage and site access on the tight block. “We had to build in the order of leaving the

carport off so we had room,” Ziems said. The other “big issue” as Ziems termed it was site access for cranes and deliveries. “You couldn’t load block or store block, everything needed precision coordination, the crane had to lift it straight off and put it into place, there was no room for overlap or error as there simply was no storage space,” he said. “Then building the carport out, we had absolutely no space. But we were lucky to be granted access to the spare block adjoining the site.” Featured in the March edition of Elle magazine, Ziems’ work has gained national coverage and significant interest locally. With that project wrapped up, he’s looking to continue work in the luxury market going forward and gave some golden advice to those up and coming in the industry. “Don’t be scared to put in that extra time in the early stages, I think you need to do it to be able to get what you want. I wanted to be proud of the end product. You have got to put in the hard work and the extra time,” Ziems said. Master Builder | 39

Bizarre reno a tough gig
FROM chop sticks to tooth picks, an experienced Gold Coast builder admits this bizarre renovation is one of the most difficult he’s ever taken on. Clamroc Constructions owner Tony Parente was tasked to convert a long-established, renowned but extremely run-down Chinese restaurant into a high-end dental boutique. But there’s a catch, or two. The renovation site is smack bang in the middle of Broadbeach and the client’s existing lease is ending on their current building so they need the project to meet deadline. The only access is a single set of stairs to the second storey site, the shops below need to continue uninterrupted trade and the Commonwealth Games will run through the life of the project. Armed with 20 years of experience, Parente was looking to diversify his skillset from the mid to high end residential space. Having 40 | Master Builder
already completed another space for the client, he was confident in their established relationship and was up for the challenge. What he discovered on inspection of the site was beyond what anyone could have anticipated. “Basically if you can imagine, they’ve just walked out and left it as is. There was tables and chairs, full bar and kitchen,” Parente said. “The state of it was just like something you’ve never seen.
“The first day we opened up the cooler rooms, we had to get out ... it was horrific.” Tony Parente, Clamroc Constructions Unfortunately, it was a downward spiral of discovery from there. “When we got to the demolition stage, we realised just how rundown the place was, the
water damage was massive from the roof above. And the years of food preparation on site involved a lot grease that had seeped into every part of the building. “We said, ‘let’s strip the place completely out’, the architect designers came up with the plan.” Parente said the extremely hard and limited access was one thing but the logistics of body corporate, council approvals, police permits and WHS in busy tourist areas was on a whole other scale. “A lot of kitchen ovens were built in and these are things that you don’t know initially. We had to literally get a crane and cherry pickers and lift out these monster ovens and fish tanks,” he said. “The demolition took a massive amount of time and we had to be highly aware as we were in a mall where WHS came into play along with permits, approvals and fully active

restaurants below us. “After demolition, we could sit down and map out where to go from there. Normally with a commercial fit-out it’s just that, but this had a lot of structural elements and the plan was to create more of a day spa vibe than your usual dentist. “Stage one of the fit-out was enclosing a large balcony. The client wanted windows cut-out that were 250mm thick slabs and the main structure of the building that acted as the fire wall – it was extremely tricky. “As you can imagine with a dental surgery, every chair required electrics and had multiple pipes and sinks and taps. We couldn’t just drill into the slab and instead had to build a whole sub floor to accommodate.” When the site was finally ready for the fit-out, the Commonwealth Games were just four months away and preparations were already being made for the area.
“Security was such a primary part of the Commonwealth Games, we couldn’t even drive a car into the site at all. We had to plan everything three months ahead and get everything on site. They shut the area down for a good fortnight before the Games, we were only able to do minimal works, we had workers doing metal frames and plastering,” he said. “We had to be very organised and pre-plan. We didn’t know what the outcome was going to be, we were told we had some access during the Games but we were told to act as though we’d have no access. And if there were any security scares, they said we would lose all access and that was non-negotiable. “There was so many unknowns and we had to keep addressing each hurdle we came across and push on knowing the client needed the space to continue their work.” Now complete, the project is a showpiece on Victoria Avenue, Broadbeach, complete
with an engineer designed off-form concrete entry. The Oasis Dental Broadbeach project also recently won Master Builders Gold Coast Refurbishment/Renovation over $750,000. Parente said his golden advice to others in the industry was to not be too proud to ask questions no matter what your experience level. “If you think you know everything, you’re wrong. The industry is constantly changing and evolving and you learn as you go,” he said. “Don’t be scared to give anything a go, just come armed with motivation and you’ll learn from mistakes. You don’t make the same mistake twice and that’s how you move ahead in life. “If I make an error, I say, “How do I not do that again?” and I’m constantly talking to and getting advice from other builders I look up to. Insulation is as old as houses WHILST many of us think of insulating the walls, floors and ceilings of our homes as a relatively new innovation, it’s actually as old as building itself. Insulation is an innovation that reduces greenhouse gases, reduces energy use, meets building regulations and improves comfort. Industry faces regulation shake-up THE Queensland Government has proposed new regulations to ban combustible cladding in a bid to support those in the building industry caught up in the insurance crisis. The measures, discussed at an urgent extraordinary meeting of the Ministerial Construction Council (MCC) held recently, are in response to a disturbing national movement of private insurers increasing premiums for certifiers or removing themselves from the market altogether. “The global reverberations in the wake of the Grenfell Tower inferno in London are being felt close to home, with insurers pushing premiums as high as 200 per cent,” said Garland Waddington Partner, Brendan Bathersby. The Queensland Government is attempting to address this issue by proposing new regulations that will help reduce risk and stabilise the building industry by banning the use of combustible cladding on buildings over three storeys. The proposed ban would extend to all aluminium composite panels with a PE core of greater than 30 per cent and would restrict usage across all buildings in Queensland.
The proposals discussed at the MCC meeting include requiring certifiers to declare that combustible cladding has not been used and that there has not been any product substitution during the construction process. The other key solution proposed by Government during the meeting, was to allow certifiers to remain licensed while they are holding Professional Indemnity (PI) insurance featuring cladding related exclusions. “This is an immediate action to allow certifiers in Queensland to continue operating” he said. In the meantime, the compliance period for Part 2 and Part 3a of the Queensland Government’s Safer Buildings Program has been extended to 31 July 2018 and 31 October 2019, respectively. “This gives property owners and body corporates more time to meet deadlines around identifying buildings with potentially combustible cladding,” Mr Bathersby said. Brendan and the team at Garland Waddington are keeping a close eye on the combustible cladding issue and the effects that its use is having across the building and construction industry in Queensland.

Goop ~ starting from scratch. The genius of Goop came from observations by founders, Shane and Kirstee while trading in their first business, a builders cleaning company. The damage to expensive items like windows, window frames, bath tubs, benchtops and flooring from scratching and impacts during the construction stages was a glaring issue in need of a solution. Conventional methods of protection were mostly deficient and often totally useless in preventing a damage bill that was adding cost to the build and delays in completion and eventual hand over. Fire regulations and full-scale testing to ease compliance fears In 2017 Grenfell Tower, a residential block in West London, caught fire with catastrophic consequences. Gaining worldwide attention, the tragedy rightly put a global focus on building product fire compliance. According to a subsequent inquiry, the presence of cladding that didn’t meet local building regulations was a major cause of the fire engulfing the building. What started on the fourth floor when a malfunctioning fridge caught fire, quickly spread to higher floors with the assistance of the combustible material. From a global perspective, the Grenfell Tower tragedy wasn’t the first incident of its type. Similar fires had occurred elsewhere, including here in Australia. For example, the Lacrosse Tower in Melbourne’s Docklands was found by the Metropolitan Fire Brigade to have non-compliant combustible cladding following the fire in 2014. And more recently, in February this year, the 43-storey Neo200 in Spencer Street, Melbourne. These incidents, and anecdotal concerns about the presence of non-compliant building materials of all types, forced the Australian governments to act. A recent audit by the Victorian

Government, identified 500 buildings in need of rectifications to replace non-compliant cladding; and prompted it to announce a $600 million plan to address the problem. Despite this sum, some say more needs to be spent and claim the identified buildings don’t represent the full scale of the problem. More, they say, will need to be done.
Australia, is one product that meets these requirements, having been independently tested by Warrington Fire to ISO 9705 and AS 5113/BS8414 as required by the NCC. Dincel Structural Walling has achieved compliance to both ISO 9705 as a Deemed to Satisfy solution and AS5113/BS8414 as a performance solution.
Apart from identifying and removing non-compliant product, from this point on, it is important that the problem does not become worse. Every effort must be made to prevent the installation of more non-compliant product on new or renovated buildings.
The new test standards prescribed by the NCC in 2016, put the responsibility on designers, specifiers, engineers, builders and certifiers to ensure that a compliant product is used. Likewise, this responsibility also extends to building product manufacturers/suppliers to ensure they carry the full suite of the latest tests as required by Australia’s building code regulations. Only then, will the building industry avoid the issue of non-compliant product getting worse.
New Regulations For its part, the Australian Building Codes Board has acted to update and strengthen the National Construction Code in 2016 and 2019. According to the new changes, many internal walls and building façade walls comprising of composite systems with linings must meet fire test requirements to ISO 9705 and/or AS 5113/BS 8414, which are full-scale tests, to demonstrate fire compliance. Despite these new requirements being in force for quite some time, some wall systems be it for internal applications or external façade applications are still not being tested to these new requirements as per NCC regulations. Fire compliance for Composite Wall Systems NCC regulations and standards offer a clear path of compliance for composite wall systems. Waterproofing: Course provides 'immense benefit' COMPLETING his own waterproofing work has saved Mackay-based builder Steve O’Keeffe time, money and significantly streamlined his project timelines.
because I can physically do the work myself. I can then continue on and have my tiler come in and it’s ready to go – that’s an immense benefit,” O’Keeffe said.
O’Keeffe, owner of Alysto Construction works predominately on renovations and regularly finds himself busy with insurance work.
“We seem to be getting work all the time. We do a lot of insurance work, a lot of it is bathrooms that have had pipes break. There’s a lot of paperwork involved and I no longer need to wait to get Form 16’s to submit invoices because I’m doing the work myself when I need it done.”
To diversify his skillset and benefit his business, O’Keeffe completed Master Builders Certificate III in Construction Waterproofing. He said the course was a huge eye opener on exactly how jobs needed to be carried out to ensure costly defects are avoided. With this skillset, O’Keeffe has removed the middle man and carries out his own waterproofing. “Now I don’t have to wait to get a contractor
Brisbane-based business owner Aaron Fisher recently completed the four-day waterproofing course with the view that applied knowledge was power. Fisher, owner of A Fisher Renovation was seeking to know what waterproofers were doing on his job sites and exactly how they should be doing it.
He said the skillset had been invaluable for his business and work opportunities. “Having completed the course allows me to instruct people on how I want things done rather than being dictated to on how they’re going to do it – that’s the biggest part,” Fisher said. He said the opportunity and flexibility to carry out his own waterproofing should he want to down the track was also a big attraction. “Having my fingers in a lot of different pies really opens me up to greater work opportunities,” he said.
