Australia’s high rises drive air conditioning innovation Trends in the residential property market continue to drive innovations in the air conditioning industry. A prime example is increasing demand for more lightweight, compact and well-designed units that are better suited to high rise apartment living in Australia’s capital cities.
“Good quality is all about how the space is used,” he said, adding that the majority of apartments built over the last decade have, for the most part, been of high quality.
Apartment living is a lifestyle choice for those who prefer the big-city vibe and proximity to work, social and entertainment activities, not to mention the benefits of communal on-site facilities such as gym, pool and concierge.
For suppliers this means ensuring products for this segment of the market are well designed.
Two thirds of Australians already live in capital cities, according to the Australian Bureau of Statistics (ABS), and this ratio is set to trend much more urban as future generations flock to the main centres.
The leading air conditioning manufacturer is one of the few businesses that has managed to stay ahead of the pack by releasing products specifically to meet the new residential dynamics.
ABS figures also show that by 2030 the most common dwelling units will be childless couples and single person households.
Daikin’s national VRV manager Simon Langstaff said the company foresaw the growing preference for apartment living in Australia and created products to suit out of its $550 million per year global research and development program.
This lifestyle shift has been accompanied by a preference for homes with high-end design that optimise limited space. “When it comes to apartments bigger doesn’t always mean better,” according to Asher Judah, Victorian acting executive director of the Property Council of Australia.
One company that has a distinct advantage over competitors when it comes to design for high-density living is Daikin.
Its newest VRV IV S series is compact, lightweight, aesthetically pleasing, yet powerful making it ideal for high-end apartments. In addition, the Daikin FXDQ compact series
can actually fit in the bulkheads above built-in wardrobes and cupboards. “These bulkhead indoor units have a depth of just 450mm and height of only 200mm which is ideal for drop ceilings and wardrobes,” Langstaff said. “They are compact enough to fit above the wardrobe and still allow for plenty of air flow behind the units.” Just last year Daikin released its entire VRV IV S series, offering an extended range of outdoor units from 9kW through to 24kW and the FXDQ compact bulkhead series specifically for high rise apartments offering a range from 2.2kW to 7.1kW. An advantage that Daikin has over competitors is that the company can design and manufacture its residential ducted range right here in Sydney. “One of the key differentiators that sets Daikin apart is that we can design each product range to meet the specific requirements of the market and we can do it locally,” he said. “Most VRV units can now be connected to our residential range so we can meet the demand for larger multi type product to be used in high end housing.” For more information on Daikin products visit www.commercial.daikin.com.au

Queensland apprentice wages
Budget needs to drive activity

In late 2009, a special regulation to the Fair Work Act 2009 was introduced, which preserved the more sophisticated competency-based wage progression for Queensland apprentices.
The state government’s recent Queensland budget initiatives are a welcome injection, but more work needs to be done to ensure a consistent and wellmanaged pipeline of building projects for Queensland.
This regulation allowed certain companies in Queensland to continue to pay apprentices under the lesser wage rates sourced from the old state awards. The regulation was to continue until the modern awards adopted a competency-based wage progression and a suitable transition was settled with the Queensland Government.
While $10.2 billion has been allocated to capital works, a large chunk of this has been shaved off for the Cross River Rail. That still leaves a good sprinkling of spending on schools, health facilities, and other projects including the Cairns Convention Centre and the Townsville Stadium.
This was thrown into disarray on 12 August 2016, when Commissioner Spencer of the Fair Work Commission (FWC) determined that the federal regulation was no longer in force and the greater modern award wages should have been paid to these apprentices since 1 January 2014. As at 1 July 2016, the modern award is up to 15 per cent greater for first year level apprentices. Group training schemes are particularly exposed to large sums of back-pay adjustment. However, Master Builders estimates less than 100 members may be affected by the decision as many businesses report they’re already paying the modern award wages. The decision of the FWC was in stark contrast to the widely held view by the Fair Work Ombudsman (FWO), Master Builders, HIA and all other employers, that the regulation was still in force.
Master Builders has questioned why the government allocates money but has consistently underspent by an average of $1.7 billion annually for the past six years. The government needs to ensure it spends all of the money it has allocated, as well as show that it’s prepared to pursue new opportunities to unlock investment. The government also needs to pursue new opportunities to invest in additional projects like the Townsville City Deal and Brisbane’s Queens Wharf. Future demand is unclear beyond the current pipeline of work – in the south east, building approvals are trending down and many regions continue to struggle. There has been little growth in demand by owner occupiers, with new housing often unaffordable for home owners. Builders are responding to the affordability challenge by squeezing margins, often to unsustainable levels.
Master Builders and the key respondent, All Trades Queensland Pty Limited (ATQ), sought urgent discussions with the FWO and both federal and state governments. The FWO agreed it had advised the preserved wage rates in the period, but took no responsibility for the apparent error in that advice. However, FWO advised that it won’t investigate or prosecute for underpayment of wages prior to 12 August 2016. The state government was unable nor prepared to challenge the FWC decision. The federal government is considering some form of assistance.
There are reports that anywhere between 20 and 40 per cent of the cost of a new home is attributed to government taxes, duties and charges.
ATQ, with support from Master Builders and HIA, appealed the decision to a Full Bench of FWC, however the appeal was dismissed in January 2017.
Meanwhile, the $20,000 first home buyers grant has been extended until the end of December, and this is welcome news as we’re confident it will stimulate more demand from first home buyers.
Master Builders has since joined ATQ in a final appeal to the Federal Court. Although the prospects of success are less than favourable, the appeal is warranted. If the appeal is upheld, then no back payment will be due, and Master Builders will begin discussions with both governments on a suitable transition.
The housing strategy is expected to boost construction across the state, with 656 social and affordable dwellings to be constructed in 2017-18, and about 4,000 new dwellings over five years. However, it appears to be heavily weighted towards South East Queensland without targeting the regional areas that are doing it tough.

We need to find new ways to drive down, or at least contain, the cost of new construction. And the government in turn will need to look at the role it plays in adding to the cost of construction.

The Building Code 2016 is in full swing With Nigel Hadgkiss, Commissioner, Australian Building & Construction Commission The re-establishment of the Australian Building and Construction Commission (ABCC) as the industry regulator in December 2016 provides an exciting opportunity for us to continue our important work of ensuring building sites are fair, efficient and productive, and that the rule of law prevails. An essential part of the ABCC’s new responsibilities is monitoring of the Building Code 2016 (the Code). The Code assists stakeholders to understand the Commonwealth’s expectations for all building industry participants involved in Commonwealth-funded building work. The Australian Government wants value for money on its projects. The Code seeks to increase the likelihood of timely, predictable and cost-efficient delivery of building work completed in a lawful manner. The Code, which is already in full swing, applies to stakeholders who have tendered for new Commonwealth-funded building work since 2 December 2016. At the time of writing: ○
1 ,706 agreements and individual clauses have been received for assessment from unions, industry associations and contractors
○
3 00 agreements are being assessed a month and we’re receiving about 170 a month
○
1 60 Commonwealth-funded projects subject to the Building Code 2016, as identified by the ABCC, are currently out for tender or expression of interest, or in an EOI/tender assessment
○
5 0 projects have had a head contractor appointed, of which 31 projects have already commenced construction.
Contractors who want to tender for and be awarded Commonwealth-funded work must have a code compliant agreement from 1 September 2017, unless other transitional arrangements apply. For example, the entity is exclusively covered
by a modern award or is exclusively covered by an enterprise agreement made before 25 April 2014, which has not been varied. The Code sets out important new rules, including requirements for health and safety, security of payments, engaging non-citizens or non-residents, freedom of association, and the use of building materials that comply with relevant Australian standards. For example, failure to comply with state and territory safety laws is also a failure to comply with the Code and may result in exclusion from Commonwealth-funded work. To ensure the ABCC is able to effectively seek exclusion sanctions in such circumstances, we’re liaising with all state, territory and commonwealth occupational health and safety regulators to establish information sharing arrangements with them. This will enable the ABCC, where appropriate, to take steps towards a sanction under the Code when we’re notified a code-covered entity has contravened a safety law. The ABCC aims to achieve cultural change in the industry by providing code-covered entities the necessary tools to achieve compliance, as well as having a robust and consistent regulatory program. This includes our investigators conducting audits and inspections that aim to identify non-compliant behaviour. To this end, we’ve already commenced a number of compliance activities under the Code to ensure code-covered entities are complying with their legislative obligations. The building and construction sector is the second highest contributor to Australia’s gross domestic product and experienced the highest amount of non-productive days in the March quarter. We all have a vital role in ensuring that Australia’s construction market is attractive, affordable and productive. Non-conforming building products with Paul Bidwell, Deputy CEO The tragic apartment fire in London recently highlighted an urgent need for the use of dodgy building products to be addressed. Closer to home, there was the discovery of 24,000 square-metres of non-compliant wall cladding at Brisbane’s Princess Alexandra Hospital. Then there’s Infinity electrical cable – where even after four years there is still 20,000 metres of the dangerous cable unaccounted for in possibly hundreds of homes across Queensland and even more nationally. We know that builders and trade contractors try hard to avoid these kinds of products, but when retailers and importers are selling them it’s sometimes difficult to distinguish between a legitimate product and one that shouldn’t be touched. For about five years, Master Builders has been calling on other parties in the supply chain to take responsibility for non-conforming products. Now, the state government is proposing new laws that will crack down on dodgy building products.
The state government’s proposal Master Builders supports the broad intent of Minister Mick de Brenni’s proposal: ○ Everyone in the supply chain, including the manufacturer, importer, supplier and designer – not just the builder or contractor – will be responsible for ensuring building products are safe and fit-for-purpose ○ All parties in the supply chain will have a duty to provide information about a product’s suitability and how it is to be used, to ensure only conforming building products are supplied and are installed correctly ○ Significant fines will exist for non-compliance, with the maximum penalty under the new regime being more than $120,000 ○ T he Queensland Building and Construction Commission (QBCC) and the Minister will have extended powers to investigate and test building products and recall them if they’re non-conforming.
Master Builders concerns Although the state government proposal has many benefits, we still have some concerns about how it will work. We’ve therefore identified a number of points that need to be addressed: ○ Duplication of some requirements in the work health and safety and electrical safety acts will create an unnecessary burden on building contractors ○ Safety definitions need to be provided, for example, there is no definition of serious risk, even though it can lead to loss of licence.

A non-conforming building product is defined as being ‘unsafe’ as well as ‘not meeting relevant regulatory requirements’ – this duplication is unnecessary and can result in confusion ○ Architects, building designers and engineers who specify building products must be included in the chain of responsibility ○ Information requirements need to be practical and workable, given there are around 4,000 building products installed in the average home. Contractors who install products should have a duty to give owners product information linked to the existing building certification process ○ W hen determining who to hold accountable if there’s a breach, it needs to be clear that parties can rely on the undertakings of those further up the chain ○ T he QBCC will need to be appropriately resourced to properly undertake its role. It’s unreasonable to expect licence holders to cross-subsidise a product compliance regime ○ I nformation shared across the chain must be robust, reliable and provided by an independent third party. A number of third party product certification schemes already exist including Watermark, CodeMark and schemes run by manufacturer industry associations. These schemes could be more effective by streamlining them into one third party certification system.
Investigation continues In response to the London apartment fire and the 2014 Lacrosse fire in Melbourne, the Queensland Government is conducting an investigation into the use of non-conforming aluminium cladding in Queensland. To date it has identified 26 buildings with potentially flammable cladding – 10 of which are government buildings. This leaves us with some important questions: ○ W hat level of information is needed so that industry can be confident the wall-cladding products they install are safe and fit-for-purpose? ○ If rectification is required (as in the case of the Lacrosse tower), who is responsible? Wage rates have increased
New wage circulars now available
The Fair Work Commission (FWC) has increased the national adult minimum wage by $22.20 a week or 59 cents an hour (on the basis of a 38-hour week). This means it is now $694.90 a week or $18.29 an hour. This decision took effect from the first pay period on or after 1 July 2017. The FWC also increased modern award wages by 3.3 per cent, with weekly wages rounded to the nearest 10 cents. Most, but not all, allowances also increased from 1 July 2017.
What if I currently pay over the award? Master Builders wage circulars identify minimum wages only. If you’re already paying above the relevant minimum wage rates, the wage increase may be absorbed automatically and therefore no adjustment is needed.
What if I currently pay according to an enterprise agreement or individual flexibility agreement (IFA)? You may have an obligation to increase the wage rates contained in your enterprise agreement or IFA as a result of the minimum wage decision. Legislation states that the base rate of pay under any enterprise agreement must not be less than the rates payable under the relevant Modern Award.

Run-down on renovations
The future looks bright for Master Builders members, with most members upbeat about Queensland’s business outlook. Our latest Industry Snapshot shows that while conditions in the residential and non-residential sectors have cooled, respondents remain confident in the future. The only thing holding the industry back is the high cost of labour and materials. The snapshot also surveyed members about trends in residential demand. It shows customers are a price-sensitive lot who care mostly about the bottom line (86 per cent), followed by building quality (72 per cent). Once the renovation bug has hit, it’s hard to hold back, with many people (38 per cent) renovating a number of rooms or the whole house. Bathroom renovations were popular with nearly one-in-three respondents (32 per cent). Interestingly, kitchens (often completed by cabinet makers rather than builders) weren’t significant (7 per cent), and swimming pools (by specialist pool installers) were also not significant (3 per cent). In bathrooms, freestanding showers are top of the list of desirables. Showers are also expected to include double showerheads, no glass screens, and a no-step entrance. Freestanding bathtubs are also important. Smart technology such as smart lighting and intelligent toilets are definitely finding their place in the bathroom. In kitchens, island benches continue to be the most sought-after amenity, while butler’s pantries have also become a key feature. Smart technology and appliances such as wine coolers, built-in coffee machines and smart fridges are important. Other highly requested features include manufactured stone bench tops, breakfast bars to save on space, and top-quality appliances. In Queensland’s tropical climate, it’s only natural that outdoor kitchens are becoming more sought after. But to some extent, they’re still regarded as a luxury and will be one of the first things to go if budget is a concern.

Reports from our members indicate that there has been no abatement in activity on the Gold Coast in quite some time. Consumer confidence is high and so is the number of new buildings. Land shortage is a perennial issue that has seen various areas of the coast rebirthed, with older properties now making way for new homes or duplexes. It was inevitable that our region would see such a resurgence as many owners take advantage of living close to the beach. The legacy left by the Commonwealth Games will be a bonus for the region – the light rail is just one example – that is reminiscent of Expo 1988. Not to mention new world-class facilities that will be used long after the games are over, and will attract more sporting opportunities. The lead-up to the Games has given local contractors opportunities to be part of various tender processes, which was part of the GOLDOC mandate. Many believed that projects such as the Games Village would create a shortage of trades for general work. But although tough at the time, we managed to get through, and the village will be handed over in October 2017. The hockey facility has already been trialled, as has the sporting complex at Carrara.
With around 40 high-rise cranes dotting the Gold Coast skyline, the building trades are all smiles. They are just one part of a $13 billion infrastructure construction program that is underway. And, the pace of residential development is just as frenetic.

It would be easy to think this is largely due to the Commonwealth Games we’ll be hosting next year. As the largest event in the southern hemisphere and the biggest to be staged in Australia for a decade, the Games are generating lots of economic activity. With a viewing audience of 1.5 billion expected to tune-in we do want to look our best. But, the Gold Coast is now the largest city in Australia, outside the capitals, and it’s the heart of a $27 billion regional economy that is booming. With more than half a dozen development projects – each worth more than $1 billion – underway or about to start, construction comprises a little more than one third of our economic activity. Our Council is the second largest in the nation with this year’s budget set at $1.4 billion. When I came to office in 2012 much of our procurement allocation was flowing out of the city. In the past five years, we’ve boosted local spending from 53 per cent of outlays to 75 per cent. That’s an extra $235 million invested into small business here on the coast. There are now about 63,000 businesses and we’re experiencing a growth rate of five per cent every two years.

With the recent opening of the Gold Coast Hockey Centre, all Games venue developments, as part of the Queensland Government’s $320 million package of new or upgraded venues, are now complete. From the Anna Meares Velodrome and Coomera Indoor Sports Centre to the Broadbeach Bowls Club and the Gold Coast Sports and Leisure Centre, this new wave of sports developments will wow athletes, spectators and media during the Games . They will also meet local demand for the next generation of elite athletes. The Commonwealth Games (Athletes) Village remains on schedule for completion, well in advance of the Games getting underway and GOLDOC’s overlay program to get venues Games-ready will begin later this year. Taking local businesses on the Games journey has been a key priority. To date, 70 per cent of GOLDOC contracts have been issued to businesses with a Gold Coast presence and 86 per cent to companies with a Queensland presence. In addition, $606 million in construction contracts have been awarded for the venues and Games Village projects, of which $261 million was awarded to Gold Coast contractors and a further $284 million to businesses in South East Queensland. By the end of the Games, GOLDOC will have released in excess of 210 major procurement packages. This represents a strong and healthy pipeline of opportunities for regional, local and Indigenous businesses that are able to demonstrate capacity, capability and commerciality. This will also leave a genuine legacy in terms of an upgraded skills base within the building and construction industry.

Today’s time poor society is looking for options that are easy to prepare, readily available and cost effective. Eating regularly is an important part of a healthy eating pattern and weight management strategy. However, concern arises when healthy snacks are replaced with processed snacks, which lack the nutrients that bodies need and simply add kilojoules to your daily intake. There are few industries where this is more true than in the construction industry. Fatigue, dehydration, long working hours and varied working conditions (such as working across multiple sites) all contribute to a greater reliance on energy-dense convenient snacks, rather than following a structured meal pattern. Research shows that those who follow an unstructured, snack-dominated meal pattern typically have lower fibre, vitamin and mineral intake compared to those following a meal-dominated pattern. This can ultimately lead to increased waistlines and poorer health outcomes. front-end loader when he injured his chest and bicep trying to crack the sump plug. He immediately felt pain across his chest and used ice packs to help manage it, but he continued to work. A few days later, Tim developed severe bruising so he decided to seek medical help. He was diagnosed with a ruptured pectoral muscle, which required surgery to reattach the muscle and tendon to the bone. The surgeon recommended regular physiotherapy post-surgery for Tim’s rehabilitation, which he did two to three times a week for almost three months.
Tim’s physiotherapist helped him incorporate some modified work tasks into his rehab program so that he could return to work in a reduced capacity during his recovery. Tim has now recovered and is back working to his full, pre-injury work duties.

Here are some simple things you can do to help yourself or someone you know through tough times.

○ Find the courage to ask RUOK?
Everyone goes through tough times, but when you’re personally in the midst of one, life can feel really unfair. This is quite normal, though some people seem to go through more difficulties than others. Tradies in particular are often reluctant to seek help for themselves. However, they’re usually keen to offer support and will do anything to help out a mate. When someone is going through a difficult time they may feel like it will never end, which can be very overwhelming. For most people, tough times do pass – but everyone needs a mate to let them know they’re not alone. So how do you support your mates or family through a difficult time? Or what if you’re the one going through a rough patch?
You could begin the conversation by saying, ‘You don’t seem yourself today, can I help?’, ‘That’s not like you, is something up?’ or ‘You seem a bit distracted, is everything ok?’– anything that lets them know you’ve noticed that they may be struggling. ○ Listen if they want to talk It’s not your job to fix someone, just to simply be a mate who stands by them – and together you can get the right help if needed. ○ Do activities that lift your mood Take a long hot shower, walk in nature or near the water, exercise, soak up the sunshine, eat healthy (especially green vegetables), drink a little more water, use a notebook to jot down your thoughts, or volunteer in your community. ○ Chat to a good friend or visit a doctor or counsellor It can be a great feeling to get things off your chest and talk them through. You might feel a sense of relief and may even see things from a different perspective.
Solidarity not sympathy MATES in Construction and the Central West and South West Lions Clubs have teamed up for the MATESHIP Matters program. The program is themed on ‘Solidarity not Sympathy’, and together they’ll be travelling to 10 remote towns around the state to host barbeques and talk about the importance of mates looking out for mates who are doing it tough. MATES in Construction is a not-forprofit organisation committed to raising awareness about mental health, preventing suicide in the industry, and dispelling any negative stigma about reaching out for help.

Managing hazardous manual tasks Workplace Health and Safety Queensland (WHSQ) recently conducted a campaign aimed at decreasing musculoskeletal disorders (MSD), commonly known as sprains and strains, for construction workers. The campaign involved assessing leadership activity around various hazardous manual tasks (HMT). It also assessed how HMT safety management systems are being implemented at construction sites. A number of large construction building members got involved.
Following the campaign, WHSQ released, The Leadership in major contractors: preventing sprain and strain injuries campaign report. The report, which can be downloaded from worksafe.qld.gov.au, suggests that the industry has a long way to go in addressing this risk at all levels of the business and throughout the construction project and its lifecycle. To address this issue and the lack of tools and practical guidance available in managing HMTs, WHSQ has established a working group, comprising Master Builders members and others, who are looking at solutions to the long term and ongoing issues of HMT and MSD management.
The working group is currently developing a number of industry specific tools, including an MSD/ HMT hazard identification guide, risk assessment tools and information on emerging technology for managing risks – with the aim of providing practical tools to help construction businesses. We’re expecting to see the new tools released by the end of this year, so keep your eye on our regular newsletters for updates.

This small cabinet making business has specialised in the design, construction and installation of kitchen cabinetry in new homes and home renovations since 2012. Owner, Dallas, is very hands on in the business, while his wife, Melissa, manages the office and the accounts. Together they work with a close-knit team.
How did you get into the industry? I started my cabinet making apprenticeship back in 1988 at the age of 15. Now I’m coming up to 30 years in the industry.
What appealed to you about the profession?
Is there someone who inspires or mentors you?
I’ve always enjoyed building and woodworking, even through my school years – and it just followed on from there.
Two of my previous bosses inspire me. I worked with one of them for around 10 years, and he’s who I model a lot of my business around.
How many staff do you have? Where are most of your jobs?
What do you love the most about your job?
We have eight full-time staff and one part-time staff member, plus three contract installers. We work from Ballina up to Brisbane, with the majority of our work on the southern Gold Coast and in Tweed Heads.
Describe the service you offer to clients? We offer a full service from design, including CAD drawings and 3D renders, right through to colour consultation and cabinet installation.
How do you ensure quality control? We only use the best hardware and products. I’m a big believer in checklists and systems throughout the various stages of a job. We also have regular ‘toolbox meetings’ to promote good communication within our team.
Tell us about some of your memorable jobs? Producing all of the cabinets for Koryzma Constructions and Addinsall Constructions Pty Ltd – both took out their categories in this year’s Master Builders Gold Coast Housing & Construction Awards!

I really enjoy the creativity associated with design and incorporating the latest finishes, hardware and textures into our cabinetry.
What do you find most challenging about your job? The biggest challenge for me at the moment is space! But, we’re moving into a bigger factory in about one month so that should ease the issue.
What do you like most about being a Master Builders member? The ongoing support we receive. It’s been critical to the success of our business, both on the employment contractual side and in understanding my obligations as a business owner. Master Builders has been invaluable to us.
What interests/activities do you do in your spare time? Quoting! And spending time with my wife and two children. I also like to do a bit of kickboxing and water skiing whenever I can.

J C Concreting Business owner John Cook has been operating his local business, J C Concreting in Townsville since 1974. John started out as a swimming pool builder, but also branched out into concreting about 20 years ago.
How did you get into the industry? As a junior I was involved in freestyle and backstroke state competitions and went on to become Australian Champion Springboard Diver, so getting into swimming pool construction was a natural progression. When fibre glass pools made concrete pools seem dearer, we branched into concreting.
How do you source ideas for the work you produce? I get inspiration from pool and spa magazines, and moving around building sites and new developments.
What have been some of your most rewarding jobs? Construction of the Cobalt Plant at QNI, extension of the cooling tower reservoir at Collinsville Power Station, work on Pimlico TAFE Campus High Rise and more recently, building a domestic pool nine metres above ground level. We also layed the first concrete at Sun Metals Corporation, when it was still an open paddock.
What do you love most about your job? I love being able to follow projects from scratch right through to satisfying completion.
What do you find most challenging about your job? It’s difficult to get every facet of a job to flow smoothly.
What do you like most about being a Master Builders member? I enjoy mixing with like-minded, devoted members and staff.
What’s been a memorable moment in your career? Concreting wasn’t really deemed a trade back in the day, so we put Townsville’s first concreter through a traineeship with our business.

What classifies as high risk construction work? High risk construction work is construction work that: ○ Involves a risk of a person falling more than two metres ○ Is carried out on a telecommunication tower ○ Involves demolition of an element of a load-bearing structure
or is otherwise related to the physical integrity of the structure
○ Involves or is likely to involve disturbance of asbestos ○ Involves structural alterations or repairs that require
temporary support to prevent collapse
○ Is carried out in or near a confined space, a shaft or trench with
an excavated depth of more than 1.5-metres, or a tunnel
○ Involves the use of explosives or diving work ○ Is carried out on or near pressurised gas distribution mains
or piping; chemical, fuel or refrigerant lines; or energised electrical installations or services
○ Is carried out in an area that may have a contaminated or

I hired my employee as a casual for three months before changing their employment to full time. Do they begin a new probation period? Under the Fair Work Act 2009 probationary periods (otherwise known as ‘minimum employment periods’) start from the employee’s first day with the business. If an employee is engaged as a casual on a regular and systematic basis, and then changes to full-time employment, their original start date with the business as a casual employee marks the commencement of their probation period. Their probation period doesn’t restart if they change employment status.
If my employee resigns but wants to work out their notice period, do I have to let them? If an employee gives you their resignation and you don’t want them to work out their notice period, you can terminate the employment earlier but must pay their notice period out in lieu. For example, if an employee gives four weeks’ notice, you must pay them four weeks wages if you don’t want them to work out that period. You can also incorporate a combination of work and payment in lieu – for example, they work for two weeks, then you pay the remaining two weeks in lieu.
Do I have to pay superannuation on sick leave? Employer superannuation payments are based on an employee’s ordinary time earnings (OTE). An employee’s access to paid sick leave during a period of service is deemed OTE and will therefore attract superannuation payments. Superannuation is currently calculated at the rate of 9.5 per cent.
I’ve lost my general safety induction card. What do I need to do?
Do I have to pay superannuation on annual leave that is paid out on termination?
To replace your white or blue card you’ll need to contact the registered training organisation (RTO) that issued your card, for example Master Builders. You may also need to provide a statutory declaration identifying the circumstances in which your card was lost, stolen or destroyed.
Superannuation is paid to an employee based on their ordinary time earnings (OTE). OTE, as defined by the Australian Taxation Office, doesn't include a period of annual leave that is being paid out on termination. It therefore won't attract superannuation contributions.

What development assessment categories are there under the new Planning Act 2016?
What must a payment schedule include?
The Planning Act 2016 now has three development assessment categories: accepted, assessable (code or impact) and prohibited development. Accepted development has replaced exempt development. No development approval is required and all development is ‘accepted’ unless it’s identified as assessable or prohibited. Code assessable development is subject to a bounded assessment, and development conditions can be imposed. Applications are assessed by assessment benchmarks and any matters prescribed by the regulation. Impact assessable development needs must be assessed against assessment benchmarks, matters prescribed by the regulation, and any other relevant matters – excluding personal circumstances (financial or otherwise). Prohibited development means an application cannot be made.
How do I find out what approvals I need to install shutters on a unit on the Gold Coast? Most local planning schemes offer online interactive mapping and property development tools. First you need to identify what zone the site is located in, then determine the level of assessment under the relevant local planning scheme. To install shutters on unit balconies under the Gold Coast planning scheme, you may find that a change to the façade (streetscape) or an overlay mapped on the site could require a development approval.
If I’m repairing or replacing a carport, what approvals do I need? If you’re replacing a carport or you’re repairing a carport and the work will affect more than 20 per cent of the building’s structural components, you’ll require a building approval. You’ll also need to refer to the local planning scheme. Even if the carport was built to boundary in the past, it might now require the adjoining owner to provide a statutory declaration or trigger a development approval. An overlay or the zoning could also trigger higher assessment.
A payment schedule doesn’t need to state that it’s a ‘Payment Schedule’ and it doesn’t need to refer to the Building and Construction Industry Payments Act 2004 (Qld) (‘BCIPA’). It does however, need to refer to the payment claim, state how much the respondent proposes to pay (if anything) and why it’s less than the amount claimed – if less. That’s all that’s required by s18 BCIPA, so be sure to include the correct information in case the claimant proceeds to adjudication.
Can I send a payment claim via email with a link from XERO or MYOB? A BCIPA payment claim sent via email with a link to the invoice is unlikely to be considered a valid service of the payment claim. This is because the respondent must take a second step to obtain a copy of the payment claim. In order to have a valid payment claim, you must properly serve the payment claim on the respondent. Section 103 of the BCIPA sets out how to validly serve a payment claim notice. If you're serving a payment claim notice on a company, you should send it to the company's registered office address to ensure there is no doubt that the notice was properly served. If you’re still unsure how to properly serve a notice, please contact us for help.
Is there a maximum payment timeframe for a subcontract? Section 67U of the Queensland Building and Construction Commission Act 1991 (QBCC Act) states that any provision in a subcontract providing for payment of a progress payment more than 25 business days after submission of the payment claim is void. The QBCC Act applies to contracts for building work. If you’re unsure whether it applies to your specific contract, please contact us.

Bringing sunshine to lives In essence, Master Builders is more than an association. It's a community. And, many of our compassionate members, sponsors and staff – take that spirit out into the world at large, generously volunteering their time, skills and money to various charity organisations. Not only do they instil a sense of collectiveness in the community, they make a real difference. Helping those in need, brings sunshine to the lives of the disadvantaged or those who are just going through a rough patch. We spoke to some of our people to find out about the rewarding volunteer work they do.
Success is within everyone’s reach For more than three years, John Wheeler – Director of Stokes Wheeler – has been a mentor at Men of Business (MOB). MOB was started by a group of business men who banded together to run a program for young men that the system has given up on. They contributed their own money for it and have turned many lives around. Often these young men have been brought up in broken homes without a decent father figure. Many don’t even have a home and ‘couch surf’ instead, sharing their time with various friends, living from home to home. “One young man we helped had a mother who was a drug addict and dealer. He was kicked out of home by his father at the age of 17 and literally had nowhere to live. He was in a fragile and unhappy place, but MOB took him on as a labourer and promised that if he worked hard, we’d offer him an apprenticeship. I’m pleased to say he’s now part way through that apprenticeship, enjoying a regular pay packet and well on his way to saving a deposit for his own little unit,” says John. MOB also pioneered a special 10-week program with Pacific Pines State School – as a spinoff to the regular MOB program. John and his team mentored boys at the school on how to build a sun shelter. “The idea was to show the boys that what they learn at school, especially in maths, does have real world application.” John together with his business partner, Damien Stokes, helped the boys measure out raw materials for the sun shelter. John then enlisted the help of two of his employees, who are both former carpenters, to help them construct it. “The boys really enjoyed the field work aspect and were very proud when we presented them with certificates at the end of the project.”

Changing the world, one man at a time Adrian Gash is a render, texture and paint specialist at Lyndons Pty Ltd – a Master Builders’ sponsor on the Gold Coast. He’s also a volunteer for Mankind Project Australia, helping out at meetings and weekend workshops. Mankind Project Australia (MKP) is a not-for-profit men’s support group working with men who are struggling through life’s battles and looking to make a change for the better. Their work is focused on helping men not to feel bogged down with life’s every day pressures and struggles, and in turn prevent issues of domestic violence, substance abuse, suicide and self-harm. Ongoing
support is provided to these men who come from all walks of life. Adrian’s journey with MKP began about six years ago, when he sought help to deal with some life challenges of his own. “They (MKP) were an absolute life saver for me when I was going through an extremely difficult time. I reached out to MKP through the advice of a counsellor, and a senior volunteer from MKP would check in with me to see how I was doing. He encouraged me to attend a few weekly meetings and do the New Warrior Training Adventure weekend – and doing so truly changed my life. It was one hell of a journey, but it helped me to make many new male friends, which I consider to be like brothers,” says Adrian.
After his personal success at the New Warrior Training Adventure weekend, Adrian was inspired to get more involved in the organisation and be a helping hand for others who were in a similarly dark place to where he once was. The New Warrior Training Adventure is a two-day workshop that is held three times a year in Queensland. Men who attend the workshop are called on to dig deep and discover who they really are and what they truly want from life. The workshop tackles things like sexual abuse and domestic violence – two issues that are often repressed. It concludes with a graduation, and the men get an opportunity to bring along their partners, kids and parents to the ceremony. “Families get to see their loved one interacting within the supportive community and witness how empowered they have become after working through their issues. It’s extremely gratifying to see that these workshops go a long way in helping to repair strained relationships and bring family units together again.”
Navigating choppy waters Master Builders Regional Manager for Central Queensland, Dennis Bryant has spent the better part of 15 years as a volunteer of the Coast Guard at Keppel Sands Flotilla, QF20.
“I’ve been part of many community groups over the years, but one thing that stands out to me is the dedication and commitment of the Keppel Sands Coast Guard members. The volunteers come from all walks of life
and give their time selflessly to not only perform rescues at sea, but also attend countless hours of training to ensure they’re prepared and ready to help others in a time of need. I salute them.”
The Coast Guard rescue service assists mariners who get into trouble at sea. This can involve rescuing sinking craft or people who are stranded, and searching for people who are reported missing at sea – often in high winds or volatile seas. Dennis spent four years as Flotilla Commander of QF20, coordinating the activities of 24 members. The QF20 rescue craft is a 7.8 metre twin hull vessel with dual outboards. A 4.5 metre polycraft is used to service the creeks and estuaries. The flotilla covers the coast from Emu Park through to the mouth of the Fitzroy River – a distance of approximately 30 kilometres, and approximately 100 kilometres out to sea. He is licensed as a radio operator, acting as a conduit between the rescue vessel and relevant authorities in an emergency. Dennis received imperial honours earlier this year, when he was awarded a national medal issued by the Governor General. His 15 years of service carving a mark on the National Honours List – congratulations Dennis!

Winter comfort and efficient buildings As Queensland ‘freezes’ through the worst of our relatively sunny winters, utilities companies announce price hikes, and the world considers the withdrawal of the US from the Paris climate deal, it’s timely to consider how we use energy and how buildings can be improved thermally. The Australian Building Codes Board (ABCB) has announced changes to the Energy Efficiency Provisions of the Building Code of Australia in the National Construction Code 2019. These changes are initiated under COAG’s National Energy Productivity Plan, and form part of the Australian Government’s broader strategy to reduce greenhouse gas emissions. The exact details of the proposed changes aren’t yet available. However, the intent is to set the foundations for an increase in stringency for residential buildings, and introduce economically feasible increases in stringency for commercial buildings. NCC 2019 will consider condensation issues in buildings, on-site renewables and thermal bridging. The ABCB is also considering blower door testing, where a building is tested by fitting a blower door machine that measures airtightness. It can also be used to measure airflow between building zones and help to physically locate air leakage sites in the building envelope. Boomers retirement sweetened Industry superannuation fund BUSSQ is sweetening retirement by offering a reward to people opening a Retirement Pension account. Known as the Retirement Reward, it will see people who open a new Retirement Pension account paid a bonus of up to $11,520. It can be taken as a cash payment or left to top up their account as savings for a rainy day.
The Retirement Reward is funded by a tax surplus, created when someone moves their money from a super account to a Retirement Pension account, meaning that money put aside to pay the tax can instead be used to pay the Retirement Reward.

BUSSQ CEO Linda Vickers said that people work hard to get to retirement, so they should be rewarded, “It’s our way of saying welcome to retirement.” The incentive ranges from 0.5 per cent to 0.72 per cent depending on how long the person has been a member of the fund and their investment option. This is the highest incentive paid by any super fund, and could mean that someone opening a new Retirement Pension account with a balance of $500,000 could be eligible for a bonus of $3,600. Ms Vickers acknowledged the fund’s unique position in offering the incentive noting that, “no other fund rewards existing pension members or has chosen to pay a bonus to brand new members, but BUSSQ values the importance of being fair to all members.”

Pushing the boundaries
Master Builders recently caught up with member, Daniel Klinge of Klinge Constructions and Developments, after he returned from a whirlwind trip to Melbourne as a guest judge on the national finale of Channel 10’s, Australia By Design.
Australia By Design is a popular television show, which tasks a panel of 10 judges with counting down Australia’s most architectural buildings for 2017. Selecting from a field of innovative commercial, government and residential projects the goal is to find that special building that really ‘pushes the boundaries’. Daniel, who was originally asked to be on the show by referral from another of the judges – Antonio from Ace Stone & Tile, came on board as a judge in the state (Queensland) competition. However, his expertise and engaging personality cemented an invitation to return as a judge in the national finale. “I jumped at the chance to be on Australia By Design as it offered a new experience and I relish the innovative. Being on the show enabled me to not only raise the profile of the Klinge brand but also mix with respected industry professionals and learn a thing or two.” Sydney architect and host of Australia By Design, Tim Horton, leads the judging panel, which comprises a cross-section of building industry professionals. They include a government architect, landscape architect, engineer, town planner, builder, building certifier, building lawyer, interior designer, stone and tile supplier, and a real estate agent. The judges are given a shortlist of 10 buildings selected from finalists in the state competitions held throughout Australia, and are required to rank them from 10 to 1 – with 1 being the winner. The judging process involves round table discussions and evaluating the projects as a group, using architectural plans, photos and aerial shots. Tim Horton personally inspects each project and describes in detail the complexities of each build. Each judge then gets the opportunity to voice their opinion about what they like or don’t like about a project, then they debate their perspectives amongst the group. mb

Daniel conceded that one of the biggest challenges he faced while being on tour with the show was to make sure he gave his business equal love. “You do need to be flexible when working in TV but I didn’t want my business or clients to suffer, so I had to juggle my time effectively between both. Keeping the lines of communication open with clients about when I would or wouldn’t be available was critical in keeping everything ticking along and ensuring I kept them happy.” While a full day of filming can be quite demanding and require lots of decision making, for Daniel it's also been a very rewarding experience. “It does take up time and it is hard work, but you’ve got to go in with a positive attitude and an open mind. TV is different to being out in the real world – as you’re often put on the spot. So you need to maintain a level of professionalism but also have fun with it and enjoy the experience. I found it really interesting talking to other professions and getting their different views on what makes a building unique.” We asked Daniel what he looks for personally as a builder when judging the entries. “I look at the complexity of the build, the site of the building, the budget, the materials that are used and how they integrate with the local environment. Australia has such a diverse climate and terrain, so it’s important that you’re able to design and build with those needs in mind.” Klinge Constructions and Developments is a boutique residential building business based in Brisbane, specialising in delivering high-quality luxury homes, renovations and extensions. In 2016, the business took out the category, ‘Home Renovation/ Remodelling Project $576,000 – $1 million’ at the Brisbane Housing & Construction Awards. It later went on to win the state title and was nominated for a national award.
