MBA celebrates membership milestones We recently held our annual dinner and I had great pleasure in handing out 21 certificates to members who this year celebrated significant membership milestones of 20, 25 and 30 years with MBA. We are immensely proud to have them as members and were very touched by their remarks on how the MBA had helped them throughout the years. We thank them for their loyalty! Our member success stories demonstrate the depth and breadth of the MBA’s membership base from surveyors, residential and commercial builders, civil contractors, architects, building consultants and engineers, lawyers, suppliers and real estate services. All working together to deliver outcomes for the industry. This time last year the MBA was going through a very difficult period and many hard-hitting decisions had to be made, decisions that we hoped would put the organisation back on track. We weren’t sure the measures would achieve the desired outcomes, but we certainly hoped they would. What we couldn’t do was sit back and hope for a miracle. Thanks to the unity and trust of the Board along with the tremendous efforts and unwavering enthusiasm of our CEO Michael, his management team and the great staff at MBA, I am very pleased to say that we have turned our fortunes around and are now in a much better position to deliver for our members, the industry and the community. I would like to express my gratitude to all the team.
I would also like to congratulate all those appointed to the Board after the recent sector Council elections. I look forward to welcoming the new members and to working with them. I would also like to thank the departing members who selflessly contributed to the MBA. MBA Australia recently launched its campaign against Labor’s policy to abolish negative gearing. One doesn’t have to be a Rhodes Scholar to know that this will have a detrimental impact on our industry. Abolish negative gearing and investors will find investment alternatives that provide better returns, thus reducing the rental supply which in turn increases the cost to renters making it harder for them to save the deposit for a house. MBA ACT will lobby at both federal and local level against these and any other policies which we believe are bad for business and bad for the industry. October saw us kick off our Women Working In Construction program sponsored by Snedden Hall & Gallop Lawyers. This program aims to engage women in the building and construction industry. This includes women that work behind the scenes, on the front line, in management, in entry level roles or have an interest in construction. The program is tailored to them so they can meet and interact with other women, share advice and learn from others. Our first event was a resounding success and there are more planned for the coming year. Don’t miss out, contact the MBA and ask to be added to the mailing list. A MESSAGE FROM CHIEF EXECUTIVE OFFICER, MICHAEL HOPKINS
MBA has raised more than $3 million for local charities The Master Builders Association makes an incredibly positive impact on the lives of many people. In the last decade, the MBA has raised more than $3 million for local charities through the construction of three charity homes and a range of other fund raising activities. Last month we were excited to announce our next MBA Charity Home which is being delivered with the generous support from Village Building Company and Hands Across Canberra. The 2019 MBA Charity Home was kindly launched by Chief Minister Andrew Barr. In Canberra, our membership has grown steadily from our establishment in 1925 to now represent more than 1,200 local small and family businesses. Our membership growth is occurring at a time when the trust in our large institutions is on the decline, Union membership has plummeted, and satisfaction with our political leaders is at an all time low. Research repeatedly proves that the Master Builders brand is a trusted indicator of quality and integrity. We will be shortly commencing our 2018 membership survey and I encourage all members to respond to the online survey to help us improve our training, services and advocacy aims. Over our 93 year history we have needed to constantly adjust our service offering to members as our industry and environment changes. Our industry has always been dominated by small and family businesses. Many small construction businesses are owned and managed by a husband and wife team, often with the assistance of other family members. In recognition of this, we have recently identified the need to engage deeper within our members organisation, and consequently in October we held the
inaugural Women Working In Construction event. Such was the success of this event that we will be holding a range of future Women Working In Construction events and developing a range of new membership services aimed at supporting our small business members. While the MBA is focusing on supporting small business, during October the ACT Government passed controversial laws which will impose additional costs, uncertainty and red tape on these same small businesses. Amendments to the Work Health and Safety Act and the new Secure Local Jobs Package means that many local businesses will go into the Christmas break not knowing if they will be eligible for lucrative ACT government contracts in 2019. Rest assured that the MBA will continue to work with the ACT government this year, and next, to help our members implement these new laws. Finally, I would like to thank all of the members that attended the MBA Annual Dinner last month, especially those members that celebrated 20, 25 and 30 year membership milestones. Our members are our core, and we thank all of our members that have again renewed their MBA membership and continue to support the MBA.

MBA enjoys success for Women in Trades Master Builders ACT was successful in gaining a government funded grant this year which allowed women interested in trying out a trade to come and get involved at MBA ACT. The program ran for four weeks and aimed to increase the number of women in male dominated trades, to increase the understanding of best practices for recruiting and retaining women in trades, and to improve the networking connections between apprentice employers and women. MBA ACT President, Gracie Ferreira said that women are an essential part of the building and construction industry. “I strongly believe that women have a lot to contribute to the industry and that they have certain traits that complement what the men are already doing. It should be about doing what you enjoy and love, and not about it being a male or female industry”, Gracie Ferreira said. Participants of the program were provided with the opportunity to gain insight into a full range of experiences within the construction industry including structured training, hands on simulated work, and work site placements. The program allowed women to determine whether they would like to pursue a career in the construction industry. Program participant Anita Hac said the Women in Trades Program provided her with many opportunities.

“Having completed a Bachelor of Arts in Architecture I knew I wanted to do more and expand my knowledge on the practical aspects. The Women in Trades program allowed me the opportunity to get a feel for what it would be like to work in a trade in the building and construction industry. I met wonderful people and networked with inspiring employers and employees”, Anita added. One of the biggest goals we had for the program was to provide women with an inclusive worksite culture which is free of discrimination or bias. A participant of the program, Jess Pinney-Martin said that the program has given her a great sense of accomplishment and happiness. “Following this program I was offered an apprenticeship with MBA which I am now six weeks into, and I can honestly say that this is the happiest I have been in a long while. Every day I am learning new things and can go home at the end of a work day and be proud of what I have accomplished”, Jess Pinney-Martin said.

It was a wonderful experience to see the overall impact that the program has had on these women. I enjoyed watching them overcome many personal barriers and seeing the positive impact their involvement in the program has had on their friendship circles and family groups. Since the completion of this incredible program, the MBA has employed 50% of the participants in apprenticeships. MBA are always looking to improve equality and inclusiveness within the construction industry. We currently employ 50% of apprentice female carpenters in the ACT. Currently, only 10% of people working in non-traditional trades are women, my goal as MBA Commercial Director is to increase that to 20% over the next four years. We are well on the way to achieving this by offering fantastic programs like this and having the support of our Board, leadership team, staff and members.
Following on from the great success of the 2018 Women in Trades Grant Program, MBA ACT looks forward to being able to provide more opportunities to women wanting to enter the building and construction industry.

A MESSAGE FROM THE LEGAL AND COMPLIANCE DIRECTOR, ASHLEE BERRY
2018: Year in Review There has never been a more interesting time to be in the building and construction industry in Canberra. The building and construction sector is now the fourth highest industry contributing to the ACT economy, at 6% of GDP in ACT, the largest it has ever been. The construction of private dwellings has also been increasing rapidly over the 2016–17 and 2017–18 years but is likely to moderate over the next few. Despite the boom, there is growing concern amongst the MBA and our members about the recent legislation enacted by the ACT Government, in particular the amendments to the Work Health and Safety Act 2011 (ACT) and the implementation of the Secure Local Jobs Code. The prompt action that the ACT Government has taken on these issues is in stark contrast to the delays and slow action on important issues such as Building Quality. BUILDING QUALITY The closing date for submissions into the Inquiry into Building Quality in the ACT has now been extended numerous times and will close on 30 November. At the time of going to print, the MBA is finalising our submissions which will be available on our website (www.mba.org.au).

A report from the University of NSW released by the ACT Committee inquiring into ACT building quality estimates that for every $100 million spent on construction, over $5 million is wasted as a result of poor building quality. If this figure was applied to the value of construction work completed in the ACT since 2010, the cost of poor building quality has been $995 million. Poor building quality has a significant financial cost on consumers, industry and governments, however the financial impact does not factor in the stress on home owners, and the commercial impact on subcontractors and small businesses who can’t compete with operators who cut corners on quality and safety. The MBA has consulted widely with our members, community groups and other industry professionals to identify solutions to the ACT’s building quality problem. Ultimately, the MBA is calling for the introduction of engineer, building designer and trade contractor registration and licensing, mandated continuing professional development training, and minimum design and documentation reforms to be introduced as a priority. The ACT Government should also ensure existing building laws are enforced and a wellresourced and timely complaints process is implemented.
WHS AMENDMENTS The ACT Government has passed legislation that will come into force on 1 January 2019 that will see the ACT depart from the model-WHS laws that came into effect almost ten years ago. The new laws apply to all construction projects over the value of $5 million. Further information about these laws can be found on page 34. SECURE LOCAL JOBS The ACT Government passed the Government Procurement (Secure Local Jobs) Amendment Bill 2018 on 25 October 2018, despite opposition from the MBA and other industry associations that represent small businesses across various industries in the ACT. The legislation, which enacts the Secure Local Jobs Code, ultimately responds to a bullying campaign run by local Unions and will do very little to ensure that local jobs and businesses remain secure. Our concerns are threefold: >> The legislation increases red tape, which will have a detrimental effect on local businesses and local jobs; >> The legislation will impact the cost of construction and other services in the ACT; and >> The legislation conflicts with Commonwealth legislation, including but not limited to the Fair Work Act 2009 and the Code for the Tendering and Performance of Building Work 2016.
A number of the concerns we have raised regarding the conflict between the new ACT laws and the Commonwealth laws have not yet been answered. In fact, the actual Secure Local Jobs Code, which contains the crucial sections about what contractors need to do in order to comply with the new legislation, has not yet been finalised or released. This means that local Canberra businesses will start 2019 not knowing what they need to do in order to comply with the new ACT procurement legislation, nor will they know whether they can continue to tender for lucrative ACT Government contracts and also comply with existing Federal building code requirements. It is clear that in this case, the ACT Government has backed the interests of big Unions over small business. The MBA requested that the government extend the commencement date for the new laws by six months to give small business (and the Government) time to prepare for the new procurement rules, which include mandatory audits. Unfortunately, this request was ignored. The MBA will continue to advocate on behalf of members in relation to the Secure Local Jobs Code. At the end of the day, every requirement of the new ACT procurement rules is already covered by an existing law. This new legislation is simply a law to comply with existing laws (with some rewording to create greater rights for unions), which is the very definition of red tape. The new ACT procurement rules will add uncertainty, time and cost to the process of tendering for ACT Government work, meaning many Canberra based small businesses will simply not bother.

NEGATIVE GEARING & CGT POLICIES TO IMPACT HOUSING
Independent economic modelling commissioned by Master Builders Australia has revealed that Federal Labor’s policies on negative gearing and capital gains tax (CGT) will not increase the supply of new housing or create new jobs in the building industry. The impact of Labor’s negative gearing and CGT policies in the ACT would be: >> Up to 900 less new homes built over 5 years from the implementation of the Labor’s policies >> Building activity would be reduced by $250m >> The loss of the equivalent of 680 full time jobs Master Builders has called on the ALP to rethink their policies in the light of this new research and a changed housing market. Australia cannot afford for housing supply, building activity and employment to go backwards. Cadence Economics was commissioned by Master Builders Australia to test Labor’s claims that its policy to restrict negative gearing to investments in new housing and halve the capital gains tax (CGT) discount to 25 per cent for all properties will increase the supply of new housing and employment in the building industry. The results of the modelling show that within five years of Labor’s property tax policy being implemented the construction of new housing would fall in all states and territories and employment would fall over the same period. Master Builders Australia CEO Denita Wawn said, “Labor has previously stated their policies would boost new dwelling construction “by thousands of new homes each year”. On the other hand independent modelling by Cadence Economics shows that Labor’s policy would mean up to 42,000 fewer new homes would be built over the five years following the implementation of Labor’s policies, resulting in a reduction in the value of residential building activity of between $2.8 billion and $11.8 billion.” Home renovations would also be hit by an expected reduction of between $50 million to $210 million in activity over a five year period. Inevitably this would mean a fall in employment which is expected to be between 7,200 and 32,000 less jobs across the country,” she said.

Property Styling
When decorating your own home, it’s not the latest trends that should be at the forefront of your design choices. The inspiration should come from you. It’s all about what you love and how you live. Journey Home’s 1960s revival Rumpus room project combined both interior design and styling that was inspired by the client’s collection of artifacts from PNG. The project was included in Australian House and Garden Top 50 rooms awards for 2018. Principal designer Nadine Neilson attended the awards luncheon in Vaucluse House, Sydney. While accepting her Award, Nadine said she was privileged to meet other award-winning national designers. “This award speaks to me and hopefully to like-minded clients looking to create homes that inspire them every day. The award was especially important as it recognizes design that is layered and along classic lines for lasting effect.” Nadine Neilson said Nadine went on to say that while her rooms are installed for long term enjoyment by the owners, she respects the work of property stylists who dress homes for the real estate market and is amazed at the value they add in a short period of time.
When dressing a house for sale of course it’s a whole new ball game. Not everyone will share your style. So, stick with a neutral, but not a boring palette. Add furniture that is timeless so that it will appeal to a broader market. The way the property is styled should still make the viewer’s heart skip a beat, however it shouldn’t be polarising. Include fresh flowers and scented candles. Make sure the fruit bowl is laden with fresh appetising produce and hang matching towels neatly in the bathrooms. The little things make a difference. Remember you’re selling a lifestyle upgrade, as much as anything else, so keep the style simple and elegant with a touch of charm that makes it memorable.

STYLED TO SELL When you walk into an older property with mismatched furniture, a dull décor and chaos everywhere, it’s easy to miss the great bones hiding underneath the clutter. On the other hand, if you walk into the same home that has been beautifully styled with contemporary furniture and clever storage, it’s much easier to overlook the flaws, and to see the potential. Shows like ‘Selling Houses Australia’, ‘Love it or List it’ and ‘The Block’ among others, stimulate and inspire. Of course, it’s never quite as easy as these shows would have you believe, although when you work with an experienced property stylist you can achieve outstanding results. Property Styling is now being considered an essential part of the sales strategy when releasing a property onto the market. The Building Confidence report makes a number of recommendations calling for national consistency around registration and training of practitioners (builders but not tradesmen); mandatory point in time inspection; measures to strengthen independence of builders and building surveyors; improving the quality of design and construction information; and provision of broad powers for building regulators to audit building work and take effective compliance and enforcement action.
Master Builders response to the Building Confidence report is focusing on recommendations that:

Master Builders CEO Denita Wawn has been appointed to an industry reference group that is reporting directly to Building Ministers on the implementation of the Building Confidence report. At the first meeting of the reference group, Master Builders led debate on key areas that BMF has agreed to focus on immediately. These include recommendations around: •
Registration, licensing and training.
•
Measures for building surveyors.
•
Responsibility of design practitioners (engineers and architects).
States and Territories are continuing their respective cladding audits, issuing rectification orders, and introducing regulatory reforms that introduce chain of responsibility obligations or that ban/restrict use of ACPs.
All states and territories have committed to restricting the use of aluminium cladding on buildings. NSW has taken the strongest action by imposing a building product use ban that prohibits the use of aluminium composite panels with a core comprised of greater than 30 per cent polyethylene by mass in any external cladding, external wall, external insulation, façade or rendered finish in certain multi storey buildings, subject to specific exceptions. The 2016 National Construction Code (NCC) includes an out of cycle amendment that clarifies concessions for bonded laminate materials and introduces a new standard for wall assembly testing. The 2019 NCC removes deemed to satisfy concessions for bonded laminate materials. To assist industry to better understand processes available

to verify the suitability of materials, the Australian Building Codes Board has produced an Evidence of Suitability Handbook. The Handbook is a non-mandatory guide that includes references on what tools can be used to demonstrate product compliance. The Handbook is available at: http://www.abcb.gov.au/Resources/Publications/EducationTraining/Evidence-of-Suitability Master Builders Queensland is leading work with support from national office on testing product information templates in the ABCB Evidence of Suitability Handbook with product manufacturers and suppliers; certifiers and other industry stakeholders. The expectation is for Master Builders to establish partnerships with key parties in the chain of responsibility on a standard form of required information and a practical industry response to improving compliance. Chemistry Australia members, for example, are developing product technical statements in consultation with MBA on polyurethane foam products such as sandwich and insulation panels. Other activities and tools being developed to assist in sourcing better product and checking authenticity of products, include: •

This involves consultation with product manufacturers and suppliers and builders and free access for the member network to the business services offered in this marketplace. Where to next Master Builders is continuing to engage with Government on audit and reform activity including the following: Building Ministers implementing recommendations in the Building Confidence report over the next three years. Standards Australia development of a labelling standard for aluminium cladding products. The Building Regulatory Forum (reporting to Building Ministers) review of state and territory responsibilities for rectification of non-compliant building work. Senior officials (reporting to Building Ministers) developing options for an Australia-wide approach on professional indemnity insurance. Master Builders is working with product manufacturers/suppliers and others in the building and construction supply chain to develop a consistent view on what’s needed in product technical statements. Master Builders will continue to seek feedback through the national NCP committee and broader member network on the impact of building regulation policy and regulatory change on the sector.
NATSPEC has launched a National Construction Products Register that provides a tool for all industry parties to check verification of authenticity of product conformance certificates. Work Health & Safety Overview Every year, October is National Safe Work Month. This year, the theme was “a moment is all it takes” – it only takes a moment for an injury or fatality to occur, yet it only takes a moment to choose the safe option. The MBA team attended a number of events in support of National Safe Work Month, including the ACT / NSW Cross Border Construction Breakfast on 26 October, a seminar for WHS Managers and Professionals on Occupational Cancer, and a Trivia Night hosted by PBS Advisory in support of OzHelp. To the surprise of many, the MBA team claimed victory on the night and were thrilled to provide ongoing support to OzHelp. Safety is the number one priority of the MBA. Past editions of Canberra Builder usually touched on or referred to safety, but we intend to dedicate a section of each edition to safety developments or news that everyone in the building and construction industry should be aware of. Indeed, a lot of the safety information contained applies far beyond just our industry. Safety is a shared responsibility – and we know that our members share our view that safety is the number one priority. However, there have been a number of high profile prosecutions commenced against not only the companies, but also company directors and employees. This is a timely reminder that it is the responsibility of all workers, including employees, labour hire workers, subcontractors and employers to maintain the position that safety is also the number one priority on all construction sites in the ACT.

At the forefront of our minds now are: WHS AMENDMENTS Legislation has passed that will apply to all contracts dated on or after 1 January 2019 that results in the ACT departing from the model-WHS laws that came into effect almost ten years ago. The new laws apply to all construction projects with a contract value of $5 million or over, and requires a head contractor to: >> Consult with each eligible union about the formation of work groups and the number of Health and Safety Representatives; >> Negotiate with your workers (which includes employees, subcontractors and labour hire) about the formation of work groups and the number of Health and Safety Representatives per work group; >> Pay for the Health and Safety Representative(s) to attend training; and >> Form, elect and train a Health and Safety Committee. As previously advised to members, the MBA made submissions to the ACT Government that this proposed amendment should be submitted to the national review of the WHS legislation rather than going it alone. There are also a number of ambiguous sections in the legislation that have not been properly defined or explained – such as when “work starts”. We are concerned that the ACT Government is using safety as a guise to prosecute an industrial relations agenda. We have held a number of workshops with our members throughout October and thank all members who attended for their invaluable insight, suggestions and knowledge. It is intended that we will hold future industry education sessions with representatives from ACT Government before the end of the year.
WORKSAFE ACT REVIEW Earlier this year, the ACT Government announced that there would be an enquiry into WorkSafe ACT as part of a regular health-check review. The findings of that review were recently released and are summarised as follows: >> a change to the organisational structure to support the independence of the regulator >> greater clarity about the roles of the regulator and Work Safety Commissioner

>> more clarity and consistency in the work health and safety compliance framework and supporting documents >> better and more strategic use of data to inform the activities of the regular >> increasing capability, collaboration and engagement within the regulator. The MBA has long advocated for a strong, independent, regulator to oversee workplace safety and we are pleased that the review has acknowledged this as a key priority. With safety being a shared responsibility, it is important that government work with all stakeholders to continue improving the ACT’s safety performance. The review commented that there has been a disproportionate focus on safety in the construction industry compared to other industries in the ACT. The MBA considers that is important that Government work to improve the safety performance of all industries and recognises that unfortunately in the construction industry safety is often used by some stakeholders to advance other agendas, including industrial relations agendas. The MBA will maintain our focus on improving safety in the construction industry because it is the number one priority for the MBA and our members.
2019 In addition to the WHS Amendments, it is possible that 2019 will see more legislative changes. Safe Work Australia has commissioned a review into the Model WHS Laws, and we are expecting the findings to be handed down late in 2018, with recommendations to be considered early in the new year. There are also several Senate Enquiries concerning safety, in particular, the Senate Enquiry into industrial manslaughter (They never came home – the framework surrounding the prevention, investigation and prosecution of industrial deaths in Australia). Members will be provided with further updates regarding all the above issues when they are to hand. STAY TUNED As part of our commitment to implement Recommendations 10 and 11 of the Getting Home Safely Report, the MBA has been developing frameworks for the management of safety on ACT construction sites. Following consultation with our members and WorkSafe ACT, we hope to release the frameworks to all members in the new year.

Milin Builders Celebrate 20 years as a Member of the Master Builders Association ACT
Dennis Milin has seen a lot of changes in the building industry since Milin Builders became a member of the Master Builders ACT in 1998.

“It’s not just the buildings that have changed, but Canberra has changed. We’ve evolved over that time too, from building single houses on big blocks in the early 1990s, to courtyard houses on small blocks, then semi-detached houses on smaller blocks, then single-storey townhouses, then twostorey townhouses then three-storey walk-up apartments, and now high-rise,” Dennis says.
It’s very much a case of building running in the blood for the three Milin Builders directors: Dennis, his brother Martin Milin, and Mel Grebowski. Dennis learnt his craft as an apprentice carpenter in the late 1980s, working for various builders in Canberra, before returning to the family business to build houses with his father Peter and uncle Stan – the original Milin Brothers. Martin started his working life as a building cadet with a major construction firm, and found his way into a range of positions within the industry before returning to work with Dennis when he set up his own business in the early 2000s.

An award-winning builder, most recently taking out the 2016 MBA Excellence in Building Award for Apartments and Units 4 Storeys and Above (for Brooklyn in Turner, designed by architects Ring and Associates), Dennis has nothing but praise for the work of the MBA. “We originally joined the MBA because we felt they had a better understanding of what members needed; things like insurance, advice, staff with excellent knowledge. They were just able to understand and represent our needs better. “Whatever you need they can help you with, whether it be training and education so you can develop your people, help with insurance or legal advice, industrial advice, building contracts to name a few. “They have been really helpful with interpreting planning laws, building guidelines, and showing us how to work with government and authorities. “And, being a member of the MBA connects you with other aspects of the industry and opens your eyes to advanced knowledge, innovation and new products as well as to new suppliers.” Dennis says a major change in the industry over the past two decades has been the greater collaboration between builders, trades, consultants, suppliers and governing bodies. “As we have grown over that time we have engaged more and more experts to get the best possible advice, and to deliver the best options and the best products. We’ve even conducted peer reviews on that advice to ensure we secure the best outcomes. “The result across the industry ultimately is better service delivery to our customers.”
Mel, who worked in construction in Sydney (including for Transfield on the AirportLink Tunnel) prior to being employed by Milin in Canberra, joined the company as a director in 2008 and also has building in his veins; his grandfather was a builder and his brother is a builder, while his dad Jan is a fitter and turner who works for Milin. The company has grown from building single houses to one of Canberra’s largest builders with $450 million worth of projects under construction or in the pipeline. Milin is setting the standard for building in the new Molonglo Valley suburbs of Coombs and Denman Prospect, as well as the spectacular “Ivy” development on the light rail route at the gateway of the resurging Woden Town Centre.
Dennis believes building in Canberra at the moment is “streamlined” compared with some other states. “We have a city plan that clearly defines its zones and what’s allowable within them through individual master plans. It’s a very straightforward process.” However, he is concerned about the apparently increasing influence of the local CFMMEU on government at the expense of local businesses and workers. “The MBA well understands this and has been particularly supportive of companies like ours and others who have been targeted by the union. “We are grateful for that ongoing support.”

celebrates 30 years in Canberra and welcomes its second CEO
In an interview discussing Village’s 30th anniversary celebrations, CEO Travis Doherty reflects on his experience in the business so far as well as looking forward to the future.
persona which I have been privileged to experience. He is one of the most supportive, loyal and caring people I have ever met. I will never forget our first weekend in Canberra as a family. Bob invited my wife Sarah and I and the kids over for dinner. Bob cooked a roast! He was so proud to have us in his home with his beautiful and magnificent wife, Vlada. The first impressions of a workplace can be quite informative. What were your first impressions of Village?
You formally took over the role of CEO of Village Building Co in July after two years working along side founding CEO, Bob Winnel. What are your first memories of Bob? I’ll never forget the first time I met Bob Winnel. It was for this job, CEO Village Building Co, a role he had filled since founding Village back in 1988. The interview was set for 45 minutes and after an hour and half Bob and I were still engaged in a broad ranging conversation about Village, the building industry and life in general. He was so focused and enthralled by the company, his people and the social benefits of home ownership that is was impossible not to inspired by Bob and excited about the prospects of being Village’s second CEO. Reflecting on this unique conversation I realised Bob was sounding me out. I was not a builder, a planner nor a Canberran and fair to say an unusual choice for the job. He was interested in my character, my values and importantly my resilience for the job that he had dedicated his life to. Now after more than two years with Village, I continually ask the question: “How did he do this job for so long?” I think the answer lies in his deep belief in the social benefits of home ownership. Being at the forefront of home ownership has been and continues to be at the heart of the Village’s purpose. Bob is a fierce advocate for the property industry. He stands up for what he believes in and he is known as a unique and colourful character. But there is more to Bob than his public

When I first walked into the Village offices at Argyle Corner in Mitchell, I felt the family-like culture. There was a generosity and warmth that was unusual for me after spending my career in the corporate sector as an accountant and a banker. I liked the culture, but I was wary of it. In my world, warmness and generosity were treated with suspicion. People might be ‘too comfortable’ and not getting their job done. I am the first to admit that I underestimated the horsepower in the business. Village has been a prolific developer and builder with more than 18,000 homes to its name. And strategically, Village had the foresight to diversify out of Canberra into new markets – which would not have been easy for Bob, such a proud and passionate Canberran. There is also an entrepreneurial spirit to invest in new and difficult sites and into ventures like the Big Banana which continues to generate recurring income to smooth out the peaks and troughs of property development. How did you feel about moving to Canberra? As a child of a motor mechanic and a nurse, I grew up on a block of land outside the northern Victorian country town of Tatura. After studying, working and living in Melbourne and Sydney for many years, the prospect of moving to Canberra for a country kid was pretty appealing. The best of both worlds is what comes to mind. Canberra to me and my family has a friendly and connected feeling about it. You are likely to bump into friends at the local shops or sporting events. Sarah and I and the kids settled in easily.
How would you describe your leadership style? For me leadership is all about a balance between empowering and supporting good people to do their job and to grow professionally and by implication enjoy work and life. But also that there are times when you need to deep dive quickly get across the detail, navigate the business through it and hand it back to the team. There is a balance between empowering and trust and taking responsibility. Bob has taught me over the leadership transition to be very adaptable and very resilient. The property industry is relentless and like no other. There are rewards for patience and resilience and good leadership. What are the goals for Village over the coming years? Continue to have a diversified development portfolio in Canberra and our other markets – SE Queensland, Coffs Harbor, Wollongong, Sydney and Melbourne. We need to be developing master planned communities, urban infill projects, townhouses and apartments. I try and keep it as simple as possible – we need to deliver our current developments on time, on budget to a high-quality standard. We also need a pipeline of work. You need nous, rigour and gut feel to get it right. I am not sure if it is an art or a science. How do think the Canberra market is going? Canberra is still looking solid. We are seeing some corrections of the markets in Sydney and Melbourne, but Canberra seems to be holding up. We are not currently exposed to the Canberra apartment market. ABS Residential Property Prices FY17–18 show that in the time that Sydney prices declined by 3.9%, Melbourne’s increased by 2.3% and Canberra by 3.0%.

Village’s profile over the years has been driven by our projects – and former CEO Bob Winnel’s public positions on issues of importance to him and the business. Our 30th year advertising campaign is about thanking the Canberra community for their support in the past and setting the scene for Village in the future. We want to remind people of our heritage of creating places of value that connect people with their communities. For us, the emphasis is on building foundations that stand the test of time, creating connections that grow with families and future generations. For our clients, whatever their lifestyle or life stage, we want to create a place where they feel safe; a place they can proudly call home. My favourite is the Village branded bus. It is all over Canberra just like we would like to be! Thanks Travis. Any closing comments? A personal thanks to Michael Hopkins and his team at the MBA ACT. We are particularly excited about being involved in the Charity House project in partnership with the MBA and local foundation Hands Across Canberra. The Charity House is to be built in one of our flagship developments in Weston with the proceeds of its sale staying local and going to Canberrans in need.
The demographic of Canberra is different, and we feel relatively comfortable in bringing South Jerrabomberra and Weston to the market over the coming years.

Women Working in Construction (WWIC) PROGRAM AND EVENT REVIEW
Master Builders ACT have begun the Women Working in Construction initiative which recognises the many women working hard behind the scenes of our member businesses that we represent. Their contribution through their varied roles is often critical to the operation and success of the businesses they work in. Many are also partners of our builder/subbie members. They run the office, the family and all things in between. The aim of the Women Working in Construction initiative is to connect women with other women in order to share ideas, advice and thoughts. On October 22 MBA ACT held the first Women Working in Construction event. THE IMPORTANCE OF VISUAL AND SAFETY ACCESS IN THE CONSTRUCTION INDUSTRY According to Vision Australia Foundation “It is estimated that there are approximately 400,000 people living in Australia with legal blindness or low vision. This number is expected to double in the next 20 years, as a result of the aging population”. It is not just the vision impaired individuals in our community that are protected by hazard and directional indicators, 4.5 million people across the world benefit from the correct installation of visual and tactile indicators. Visual and safety access is an aspect of design in residential and commercial buildings that can be often overlooked, even those with the best intentions may not correctly interpret the standards or unintentionally install the indicators incorrectly. Architects and builders have a moral obligation to effectively install surface indicators that allow blind and visually impaired people to access all areas confidently, meeting the BCA and AS1428 requirements and maintaining the aesthetics of the overall design. An access consultant will be able to advise you on your compliance to standards but also how your intended design will function in a practical
application. We would highly recommend engaging with an access consultant as early in the design as possible to ensure the best outcome to allow all members of the community equal access. One of the most common problems associated with the installation of safety indicators actually relates to luminance contrast. The Australian Standard 1428.4 requires a minimum of 30% high luminance contrast between most indicators and the surrounding surface. This includes indicators such as stair nosing, visual indicators on glazed panels and tactile surface indicator tiles. Interestingly for the single coloured individual TGSI cones a 45% luminous contrast is required and 60% luminous contrast for two colours or materials used for individual TGSI cones. This allows them to be easily identified for those who are vision impaired. Whilst this would seem quite straight forward, issues with contrast luminance is one of the most commonly seen issues with compliance when varying conditions are not taken into consideration.
When measuring contrast and luminance it is important to reflect on how these indicators will appear in sunny, wet and overcast conditions. It is not just a matter of comparing saturation, you must consider how the material will reflect light when wet, dry and practically speaking even exposed to some degree of dirt. Taking these factors into consideration, it must be applied across a vast array of access products such as tactile ground surface indicators, stair nosing and visual indicators on glass or glazed panelling to ensure those with low vision are able to safely navigate hazards and reduce the risk of personal injury. As it currently stands, visual and safety access can often be unintentionally neglected, installed incorrectly or underutilised. At CE we would like to do our part to change this trend through education and help the industry move towards making access better integrated into design. With the support of architects, builders and Access consultants we hope to contribute to a more inclusive, practical and accessible Australia.

With Icon Water’s new design and construction standards now being in force for four months, the time has come to consolidate feedback from all users of the standards so that any issues can be resolved and the new standards can be “locked off”, bearing in mind that all Icon Water standards will be reviewed and amended (as required) on an annual basis. To this end, Icon Water has been logging all stakeholder feedback so that there is scope for amendments. Initially, a pleasing amount of feedback was provided which has allowed Icon Water to consider amendments. However, in recent months feedback has been more sparing – particularly from designers and constructors.

Professional Indemnity Insurance With many residential builders now involved in sourcing designs, and design & construct contracts becoming increasingly common in the commercial sector, it’s important to understand how this can expose your business to potential losses should you not have the right insurance cover in place. Historically Professional Indemnity (PI) insurance was only considered by engineers, architects, or designers and the like. Whether or not you provide these professional services in house or engage an external consultant you assume liability to your clients or other parties for claims arising out of injury or loss incurred as a result of a breach of professional duty in the provision of these professional services. Whether you direct clients to a particular architect/ draftsperson, or your clients provide you with full plans without your input, builders are typically the first port of call for design/ product specification losses. It costs time and money to defend against PI claims, and while you may ultimately only be found 10%–20% responsible for the loss, the legal defense costs and proportionate liability judgement can result in $100k+ losses.
If your business is involved in construction (not exclusively design) – you should be insured through a Design & Construct (D&C) PI policy. Without being insured through a D&C policy, your PI policy may not cover you for jobs that you’ve constructed, even if your advice/product specification on the build was the direct cause of loss. D&C PI policies encompass a broad definition of the various professional services involved in designing and building. A non D&C PI policy will require you to specifically list the professional services to be covered, with anything not specifically listed, uninsured.
What is business succession planning? According to the Australian family and private business survey 2010 (RMIT University) the average age of small business owners in Australia is 58. It is estimated that over 50,000 small business owners will be looking to exit each year. But how many of these have planned how they will exit? Many business owners want to maximise the value of their business so that one day they can sell it and fund their retirement. But while that may be the plan, very few business owners successfully achieve that outcome. In fact, in Australia 55% of business exits are the result of some kind of failure – be it divorce, a partnership dispute, death, illness, bankruptcy, and so on and so on. While we have many successful longterm small-to-medium-sized businesses (SMEs) here in

Australia, the statistics are not encouraging in terms of survival of the business through and beyond a succession event. The main reason that this has become such an issue is that business owners are typically so caught up in the many aspects of managing and running their business that they very rarely have enough time to dedicate to strategic succession planning. This can especially be the case in the building and construction industry, where many successful businesses have grown quickly and involve the key business owner being on the ground working ‘in’ the business, rather than ‘on’ the business. This then has the potential to jeopardise the very purpose for which they entered into the business in the first place – to build it up to eventually sell to fund their retirement. Succession Planning is about taking a strategic approach to your business exit. Without it, the value in your business will retire when you do. A successful exit for a business owner revolves largely around taking a strategic approach and taking the time required to plan and manage the succession. It takes about six months to sell a business, but to get the maximum price you can, or to facilitate passing the business to existing management and employees, planning needs to start at least three years – and preferably about five years – before intended retirement. The most successful plans often take between 10 and 15 years. Waiting until you are 64 to start succession planning does not leave you with enough time to get the business ready for exit and maximise the value of the business before exit, and therefore often results in a poor price for the exiting business owner. Business succession and exit planning is about combining the business, financial and personal goals of business owners to design and implement a strategic exit. It involves building a plan around the future of the enterprise; a personal financial plan for both the owners and their successors, if they are family members; and addressing your personal goals. We also need to deal with the very important issues of how and who will run the business into the future. Many family business owners intend to just hand over the family enterprise to their kids, but may not take the time to have the key discussions about what that looks like in reality; how
the sale is funded; and whether the kids want to, or are ready to, take the reins. Taking a strategic approach to a family sale can ensure that these conversations take place, and that there is a sufficient time for the business and the exiting and new owners to prepare for the sale so the handover is smooth. This could involve training for the new owner, and sometimes some coaching for the existing owner to hand over control.
There are many exit options open to business owners – the trick is to work out which one is most suitable for your business. The following graph shows a range of exit options for business owners – those that will result in the highest sale price also involve more effort and time, and may not be possible for all industries. The options at the bottom of the scale may take place quickly, but are unlikely to be the best result for the exiting business owner.
A successful succession plan should consider three important factors, and we look at these using a five-stage approach:
Many business owners are susceptible to the risk of key staff leaving, taking with them valuable clients, company information and relationships, which all have a negative impact on the overall value of the business. A growing element to successful business secession planning in Australia are employee share plans – this can assist with keeping key staff, keeping them engaged in the business and thinking like owners. Having in place an employee share scheme can help facilitate a business owner’s exit through whole or partial sale to employees, but can also make the business more attractive for a trade sale due to the maximising the commitment and engagement of your business’s best asset – your staff.
1. Identify value: What is the current value of the business? What do the business owners need as a purchase price to be able to fund retirement? How does the business look from an exit-readiness perspective – both financially and non-financially? 2. Protect value: After identifying potential risks for the business, we work with you to improve these areas to protect the value you have created in your business. 3. Maximise Value: Focusing on areas for improvement identified in stage 1, taking steps to maximise the value of your business from the perspective of a buyer. This can also involve preparing the owner and the business for exit – after spending years building up the business, it can take some time for a successful handover to take place.

PHOTOGRAPHY TIPS FOR 2019 MBA AWARD WINNING PROJECTS
>> Closing date is March 2019 – don’t leave it too late for the photography, especially as some photography is weather dependant. >> Remember that your project generally looks its best just after completion or just after handover. >> Decide if want your project photos to show an empty building or with some furniture/fittings carefully selected and styled. >> Create a shot list that matches the category you are entering. Maybe you need to show a particular technique or material. >> Consider taking progress photos to add to your submission. >> Check the entry rules and ensure your photos have the resolution required and can be printed correctly. >> Using mobile phone or tablet photos will generally not give you a high quality photo. They may have enough resolution but unless you understand their other limitations, you will not get the quality that your entry demands. >> Use a good quality printer for your entry prints >> Remember you are presenting your best project, so you need the best photographs to excite judges before they do an onsite visit. >> Consider aerial photos for large jobs or a different viewpoint. You could use a plane, helicopter or drone. If using any of these, ensure your pilot and aircraft are registered for commercial operations. Be aware that a drone cannot be used in many areas because of CASA restrictions. Check CASA app – ’Where can I fly?’

A good professional photographer will shoot them at maximum resolution. 2019 MBA Charity House Update On Friday October 26, Master Builders ACT announced, in partnership with Village Building Co. and Hands Across Canberra, the 2019 Charity House Project. The most recent MBA Charity House Project was created in 2016 when two homes in Deakin were built and sold, resulting in more than $2 million being donated
to the Canberra community sector. The 2019 MBA Charity House Project will be delivered in Village Building Co.’s new Weston Precinct.
