Hindi interpreter flubs case Mistrial declared in alleged sexual assault Words matter, and how. A “physical” assault is not the same as a “sexual” assault. Touching “between legs” is not the same as touching “genital area.” And “a couple of weeks” is definitely not “two days.” But a Hindi interpreter translated exactly that in a sexual assault case in Brampton, triggering a mistrial and sending ripples through Toronto area’s legal community.
Superior Court Justice Casey Hill declared a mistrial in a case against Vishnu Dutt Sharma — an Indian citizen on a work permit in Canada — because the interpreter’s Hindi interpretation of the proceedings was poor and substandard, according to court documents. “In this case, the non-English speaker was prejudiced by a denial of full linguistic presence at his trial on April 27, 2011, on account of
Court documents only identify interpreter by her initials, A.K. pervasive departure from the guaranteed standard of interpretation to which he was constitutionally entitled,” Hill said. Stories about lack of accredited interpreters are common in courthouses in the GTA — ask any lawyer. What is unusual in this case is that audio tapes from cross-examination were sent to an expert in the U.S., who in turn wrote a scathing report. TORSTAR NEWS SERVICE

Toronto: Balanced and Bolder First debated at city hall committee meeting Thursday, new report will influence this year’s mandatory five-year review of official plan, which contains land-use policies that govern growth A new research report is painting a vision for urban planning that could help the city’s future growth. Commissioned by Etobicoke-Lakeshore Coun. Peter Milczyn (an architect by profession), the report, called Balanced and Bolder, includes recommendations for more pedestrian-only streets and design competitions for significant projects in the city. Milczyn said a key issue in the report is achieving a better balance of mix-use development that combines residential and com-

But it’s “not nearly enough,” said Milczyn. “We’re doing phenomenally well in attracting residential development, but extremely poorly in attracting new office and commercial development beyond just retail,” he said, adding other cities, like London, England, require 25 per cent commercial use in cer-

But the “million-dollar question,” as Andre Sorensen, an associate professor at the University of Toronto’s department of geography, put it, is “Who will implement all this?” Sorensen added that the capacity of the city’s planning department has been gutted by retirements and lack of hiring over the last few years, resulting in a serious manpower shortage. Brampton family dies in Jamaica crash
TORSTAR NEWS SERVICE
Couple and relative were rushing to hospital to seek help for two-year-old child who had stopped breathing A Brampton couple, their infant son and a relative in Jamaica were killed in a car accident on the island while rushing to hospital en route to seek help for the boy on Wednesday. Two-year-old Ronaldhino “Nekeil” Dixon wasn’t breathing when his parents woke up around 6 a.m. Wednesday morning. Along with his grandmother, with whom they were staying, they rushed him to hospital but made it less than five minutes from home. While trying to overtake a line of traffic in a desperate move to save Nekeil, the car collided head-on with a truck, police said. Nekeil,
his father Garieno “Keil” Dixon, mother Nadeen “Diane” Dixon and Keil Dixon’s mother Marie Myrie-Smith were pronounced dead at hospital. The horrific crash scene in St. Catherine, a parish 30 kilometres west of Kingston, left some onlookers weeping and in hysterics, local television reports showed. “To lose them all at one time, it’s devastating for the family,” said Otis Harvey, a cousin of Keil Dixon. “It’s like a bad dream that won’t go away.” Nekeil had respiratory problems from when he was born, and his condition

Gang sex assault: Is public being informed? It could be among the most shocking sex crimes in Toronto in recent history — a woman, forced at random off the city’s bustling main drag and into a car, where she was driven to a home and allegedly gang-raped by six men. Police have released little information about the crime. And, with some in the area unaware of the incident, questions are being raised about whether police have adequately informed the public. The details released so far by police paint a terrifying picture: the woman, 27, was walking south on Yonge Street near Gerrard Street just after 9:30 p.m. Tuesday when a black minivan carrying six men pulled up. The occupants demanded she get in the car. Police will not say how the woman was coerced into the vehicle, but said she did not know the identity of her attackers. She was taken to a home in the Yonge Street and Eglinton Avenue area and was sexually assaulted by all six men until, hours later, they fled the home, allowing her to escape. All the suspects in the violent crime are still at large. Security services at Ryerson University have not been issued a bulletin to publicize the incident. “They would normally issue a warning for this,” said Caitlin Smith, Ryerson Student Union president. “When anything like that happens it’s good for the community to know.” TORSTAR NEWS SERVICE

Cuts expected in spring budget, but Tories doubt McGuinty will follow economist’s recommendations DAVE CHIDLEY/THE CANADIAN PRESS
Core public services, such as health care and education, will remain top funding priorities as Ontario makes deep cuts to trim its $16-billion deficit, Premier Dalton McGuinty said Thursday. Economist Don Drummond has signalled he will make some difficult and unpopular recommendations in his review of the province’s public services, suggesting spending cuts as deep as 30 per cent in some ministries. However, speaking at Wilfrid Laurier University in Waterloo, McGuinty strongly suggested the Liberal government will not follow through on all of the several hundred recom-

mendations Drummond is expected to make later this month. “Mr. Drummond’s responsibility of course is to advise and ours is to decide, so there’s a distinction, first of all, to be drawn between his responsibility and our responsibility in govern-
ment,” said McGuinty. “After we have received those recommendations, we will ask the legislature to help us by giving the best advice on those, and we also want to give Ontarians an opportunity to comment as well.” The spending cuts will not have the same impact in schools and hospitals as the cuts implemented by former Conservative premier Mike Harris in the 1990s, said McGuinty. “We will do everything we can to protect our health care, protect our education and put in place the kind of measures that can support a stronger and growing economy.” THE CANADIAN PRESS

Mubarak should die: Prosecutor Says ex-leader ‘politically and legally’ responsible for killing of protesters in uprising that toppled regime Prosecutors on Thursday called for Hosni Mubarak to be hanged, saying he bore full responsibility for the killing of protesters during the uprising against him, in a courtroom moment unthinkable barely a year ago when the longtime leader held unquestioned power. The demand for the death penalty at the 83year-old former president’s trial played to the widespread resentment of Mubarak among Egyptians who hoped that punishment for his oppressive rule would be fruit of the Arab Spring. Still, some of the activists who helped topple

him are skeptical the sentence would ever be carried out, if he is convicted. A conviction would be followed by a possibly lengthy appeals process that the ailing Mubarak’s lawyer would likely draw out, and Egypt’s new rulers — the military — have the power to veto a death sentence. Mubarak has been brought to every hearing
since his trial began on Aug. 3 on a hospital gurney, wheeled into the courtroom cage where defendants are held, alongside his two sons, former security chief and six top police commanders. On Thursday, prosecutor Mustafa Khater gave a passionate speech demanding the death penalty for Mubarak, former Interior Minister Habib el-Adly and four of the police commanders. They are charged with complicity in the deaths of some 800 protesters during the 18-day uprising that led to Mubarak’s fall on Feb. 11. THE ASSOCIATED PRESS

Iraq attacks kill dozens
Shiites targeted The attacks began during Baghdad’s morning rush hour when explosions struck the capital’s largest Shiite neighbourhood of Sadr City and another district that contains a Shiite shrine, killing at least 30 people, according to police. Several hours later, a suicide attack hit pilgrims heading to the Shiite holy city of Karbala, killing 48. Hospital officials confirmed the causalities, speaking on condition of anonymity because they weren’t authorized to release figures of the dead and wounded, who numbered more than 100.
An apparently co-ordinated wave of bombings targeting Shiite Muslims killed at least 78 people in Iraq on Thursday, the second large-scale assault by militants since U.S. forces pulled out last month. The attacks, which bore the hallmarks of Sunni insurgents, come ahead of a Shiite holy day that draws hundreds of thousands of pilgrims from across Iraq, raising fears of a deepening of sectarian bloodshed. Wine and mixed drinks are so 2011.
Kiyoshi Kimura, president of Kiyomura Co., left, cuts a bluefin tuna on Thursday in Tokyo.
Tuna fetches record bid Giant bluefin tuna sold at auction for $750,000
67 calories per 341mL bottle. That’s about half the calories of wines or mixed drinks*. Here’s to a win-win resolution.
Must be legal drinking age. *Calculations based on an average serving (6 oz glass of wine and single serving of mixed drink). Details at molsoncanadian67.ca
This tuna is worth savouring: It cost nearly threequarters of a million dollars. A bluefin tuna caught off northeastern Japan fetched a record 56.49 million yen, or about $750,000, Thursday in the first auction of the year at Tokyo’s Tsukiji fish market. The price for the 593-pound tuna beat last year’s record of 32.49 million yen.
The price translates to 210,000 yen per kilogram, or $1,262 per pound — also a record, said Yutaka Hasegawa, a Tsukiji market official. Though the fish is undoubtedly high-quality, the price has more to do with the celebratory atmosphere that surrounds the first auction of the year. The winning bidder, Kiyoshi Kimura, president
of Kiyomura Co., which operates the Sushi-Zanmai restaurant chain, said he wanted to give Japan a boost after last March’s devastating tsunami. “Japan has been through a lot the last year due to the disaster,” a beaming Kimura said. “Japan needs to hang in there. So I tried hard myself and ended up buying the most expensive one.” THE ASSOCIATED PRESS

As well, 44 per cent said they will have debt when they retire, and 13 per cent said their debt will be significant. Many Canadians are in for a rude awakening, said Cynthia Caskey, a portfolio manager with TD Waterhouse. “Early retirement is only achievable if you take steps needed to get there,”

As evidence mounts of underfunding in company pension plans and rising household debt, Canadians appear to be on a collision course with harsh reality when it comes to their increasingly unrealistic expectations for an early and comfortable retirement, a TD Bank survey suggests. The survey of Canadians spanning three generations shows on average that people want to retire at 61, and the younger they are, the earlier they want to retire. Those between 25 and 30 actually expect to call it quits at 59. The online poll of 1,006 shows six in 10 Canadians have less than $100,000 in household assets, not counting home equity. Sixteen per cent have no assets at all.

Kate turns big 3-0: Her name is already forecast to be the most-used word in social media this year, and watch how NEIL MORTON much attention Kate gets next METRO Monday (Jan. 9) when the duchess turns 30. What would be the icing on the cake? When Will and Kate announce they’re having a baby. Twitter would completely melt. Rob Schneider: His new comedy, Rob, airs next week (Jan. 12). It’s about a newlywed dealing with his wife’s close-knit Mexican-American family. TV critic Jace Lacob watched the pilot and live-tweeted his disdain for it. Sample tweet from @televisionary: “If Hell exists, it would be watching the Rob pilot over and over again for eternity. And I am only two minutes in ...” Must-watch. @RupertMurdoch: Eighty-year-old media mogul Rupert Murdoch opened his (rather boring) Twitter account over the New Year’s holiday and already has more than 100,000 followers. Murdoch, whose media empire, News Corp., has been under increased scrutiny due to phone hacking at his U.K. newspapers, better hope his Twitter account never gets hacked. Team Canada: Our juniors were getting smoked 61 in the semifinal by Russia at the Calgary Saddledome, and staged what was almost an epic comeback, scoring four goals in the third and hitting a post late before falling short 6-5. Even though they didn’t make the final, they can hold their heads high after that valiant comeback. 2013 will be their golden year. Twins born a year apart: In a story gone viral this week, a Minneapolis couple welcomed twins six hours apart, with a boy, Beckett, born 6:40 p.m. on Dec. 31, 2011, and a girl, Freya, Jan. 1, 2012, at 12:26 a.m. New Year’s Day. This means a) separate birthdays for both, and b) whenever the siblings fight, Beckett can go, “Yo, I’m a year older.” Butt out: A giant 12-foot acrylic cigarette butt was erected in Toronto Tuesday as The Canadian Cancer Society launched its seventh annual Driven to Quit Challenge. If you’re thinking of quitting, try it. I’ve been clean from the cancer sticks for over 10 years. All you need is 20 seconds of insane courage. And willpower. Steve Jobs action figure: A Chinese toy company called InIcons is releasing a detailed 12-inch action figure of Jobs wearing his signature black turtleneck, rimless glasses and blue jeans. Due for U.S. release late February (if Apple gives permission), word is they’re getting tons of pre-orders. Accessories such as iPhone, iPad and iPod are not included! 4,700 self-portraits: For 14 years, Canadian photographer Jeff Harris has been doing an epic art project whereby he takes a self-portrait each day and then posts it on his website to take his readers along on his adventures. Think of it as his personal diary, but in photos. Check it out at jeffharris.org

Calligraphy contest honours Japan’s tsunami victims DISASTER. Around the
world, people ring bells or shoot fireworks to welcome the new year, but in Japan they celebrate by showing off their brushwork. Thousands of contestants took part in Japan’s 48th annual New
Year Calligraphy Contest. About 3,000 filled the Nippon Budokan indoor arena for the event. Calligraphers this year were encouraged to write banners of well wishes for those affected by last year’s devastating earth-
quake and tsunami. “My banner reads ‘Strong will’ — for those hit by the disaster. I also wish an early spring will arrive there,” said Kuramochi Jun, a 12-yearold student. METRO WORLD NEWS

HANDOUT
Synopsis
2
Award season is upon us. Soon Hollywood will hand out more gold than Fort Knox on free doubloon day. This week the Reel Guys have a look at the first major awards, the Golden Globes.
scene Scene in brief
George Clooney’s turn as a father in crisis in The Descendants looks like a solid contender for the best actor in a dramatic film.
Reel Guys
RICHARD CROUSE & MARK BRESLIN
Going for the gold Breslin and Crouse make their picks for the Golden Globes Richard: Mark, I enjoyed bits and pieces of a lot of movies in 2011 so choosing winners in the Golden Globe Best Movie categories is giving me a bit of a headache. In the drama category I’ll have to go with Moneyball as the film that hit it out of the park. As for comedy or musical it’s a toss up between The Artist, which was the best time I had at the movies overall this year, and Bridesmaids, which made me laugh more than any movie this year. You? Mark: Yes, Richard, Moneyball was a fine film. But I can’t believe it will take away any top prizes be-
cause it just lacked any real emotional content — and the ending, while true to life, was a bit of a dud. I think it’s George Clooney’s year, and that The Descendents is the film to beat in the drama category. As for comedy, Bridesmaids is the funniest movie of the year, although The Artist is a more audacious achievement. I notice its director is nominated in that category, and I hope he wins. He made me feel like I was in 1928! RC: I think you’re right about Clooney. He brings with him the kind of star power the Globes crave for their broadcast. The Artist,
George
BROWN gets you the job. #1 rated college grads among GTA employers.
not so much. With that in mind it seems likely Meryl Streep will take the Globe for best dramatic actress for The Iron Lady. Her mix of star power and chops almost guarantees a win. As for Comedy or Drama, I’d like to see Kristen Wiig take it for Bridesmaids. Of all the nominees it is the only fullon comedic performance. MB: You’re right about La Streep. Frankly, she won it the day the trailer aired. And with Michelle Williams shunted into the comedy category, there’s little competition for her. And although it’s a real stretch to call Williams’ Monroe homage ‘comedy’,
Is it Clooney’s year? her only competition will be Charlize Theron’s dress. Kristin Wiig is a comedic genius — the best thing since Carol Burnett — but I think her bid will be scuttled by the movie’s poop jokes. Unfair, perhaps, but pure comedy scares votes away — it just doesn’t seem like acting.
Actress-turned-director Sarah Polley is adapting Margaret Atwood’s award-winning novel Alias Grace for the big screen. The project once again pairs the Toronto filmmaker with an acclaimed Canadian writer — Polley's celebrated directorial debut Away From Her was based on Alice Munro’s short story The Bear Came Over the Mountain. THE CANADIAN PRESS
RC: One movie I think is a lock is the hands-down favourite for Best Foreign Film, A Separation. I’ll be shocked if this doesn’t win. MB: Haven’t seen it, but the buzz has been deafening. As long as Cars 2 doesn’t win for Best Animated Picture, I'll be a happy man.
Hugh Jackman plans his Broadway return as Harry Houdini in a musical by Aaron Sorkin.

Where does the time go? My first column of the New Year has traditionally been dedicated to my boozy predictions for the next 12 months, and here they are. In the wine world old will be new again. Italy began a comeback late last year and its European neighbours in France and Spain are destined to share in the resurgence of consumer love for classically designed wines. New World grape crushers from Canada (especially VQA vino from Ontario and B.C. and those earning the Tidal Bay appellation in Nova Scotia) will broaden their fan base and Chilean winemakers will get the recognition they deserve. Though premium vodka will rule the spirit world, I predict liqueurs will be the hard liquor breakout star with seemingly simple mixtures like the smooth and mouth-massaging combo of whiskey and honey that is Jack Daniel’s Tennessee Honey ($28.95 to $29.99). PETER ROCKWELL IS THE EVERYMAN’S WINE WRITER, WORKING IN THE LIQUOR INDUSTRY FOR MORE THAN 25 YEARS AND TRAVELLING THE GLOBE LOOKING FOR SOMETHING TO FILL HIS GLASS AND PUT INTO WORDS.

hard and it’s great to see Mark play so well today and get the shutout. Visentin had finished Canada’s 6-5 semifinal loss to Russia on Tuesday because starter Scott Wedgewood was injured in the second. The Canadians trailed 6-1 early in the third in that game but a spirited comeback fell just short. The short-staffed Canadians needed a big game from their goalie Thursday to get a medal and the Phoenix Coyotes prospect delivered. Visentin was named player of the game for Canada. A depleted Canadian team dug into its reserves to beat Finland 4-0 and capture the bronze medal at the world junior hockey championship Thursday. Down three players due to injuries and a suspension, Canada extended the country’s streak of winning a medal in the tournament to 14 consecutive years. Goaltender Mark Visentin was the feel-good story of the game. He stopped a second-period penalty shot and made a no-look, around-the-back save early in the third. He finished with 27 saves for

the shutout. “It was pretty wicked to watch the puck go off my shoulder and off the crossbar, said Visentin of the acrobatic save in the final period. “I just saw it out of the corner of my eye go into my glove when I was reaching for it. “I was kind of worried that I swept so far back
that I put it in my own net, but once I saw it on the replay and the crowd started to go nuts, I had a feeling it wasn’t in. Visentin was in Canada’s goal in last year’s final in Buffalo, N.Y., where Russia scored five third-period goals to win the gold medal. “Our best player was Mark Visentin who played outstanding and made big saves in each period, said head coach Don Hay. “I’m really happy for Mark and what he’s gone through from last year’s tournament. “He really competed

Jonas Gustavsson can count on getting another start for the Toronto Maple Leafs. The man known as The Monster stopped all 24 shots he faced Thursday for his second career NHL shutout as the Maple Leafs beat the Winnipeg Jets 4-0. With the Leafs facing a key stretch of schedule, coach Ron Wilson says the goaltender that wins will stay in net for the following game. Gustavsson was barely used during a mediocre 4-6-3 December as Wilson elected to ride James Reimer following his return from a head injury. But the backup now has consecutive victories to open an important homestand and should be back in Saturday when the Detroit Red Wings come to town. Phil Kessel, Tim Connolly, Mikhail Grabovski and Clarke MacArthur scored for the Maple Leafs (20-155), who moved into seventh in the Eastern Conference. The Jets saw their record fall to 19-16-5 and dropped below Toronto in the standings. Gustavsson’s only previous NHL shutout came as a rookie in December 2009, when he stopped 25 shots in a victory over Boston.
Sports in brief
The Sacramento Kings fired coach Paul Westphal on Thursday, cutting ties after two-plus seasons amid a slow start and an escalating dispute with young centre DeMarcus Cousins. Geoff Petrie, Kings president of basketball operations, made the announcement ahead of the team’s home game against Milwaukee on Thursday night.

Post-season offers unique twist in 2012 with appearances from inexperienced Lions and Texans Hey, Stranger. Here’s a playoff headscratcher: Accompanying the New England Patriots, Green Bay Packers, Pittsburgh Steelers and New York Giants, are the Detroit Lions and Houston Texans. On Saturday, the Texans kick off the NFL playoffs hosting Cincinnati. It’s merely their first post-season game in a franchise history spanning 10 seasons. At night, the Lions, whose last trip to the playoffs came in 1999, play the Saints in New Orleans. The lack of playoff familiarity doesn’t seem to concern Detroit coach Jim Schwartz. “We haven’t always played our very best, I don’t
“There’s one thing of learning about something, there’s another thing experiencing it firsthand and seeing how it affects the team.” DETROIT LIONS COACH JIM SCHWARTZ
think any team ever does,” Schwartz said. “But I think we’ve learned from some of the things that have happened and I think we’re a little bit more battle-tested,
a little more seasoned.” Born in 2002, the Texans didn’t have a winning record until last season. Houston was impressive for most of the season, but struggled down the stretch and lost their final three games. Indeed, the Texans’ last win was at Cincinnati, 2019. And it’s the Bengals who visit Reliant Stadium in Houston on Saturday. “It’s just, go play it like any other game,” Texans coach Gary Kubiak said. “(The players) know that the result — the biggest factor — is you can move on.” On Sunday, Atlanta is at the Giants, followed by Pittsburgh at Denver. Alfredsson, three other Sens voted as all-stars
WEEKEND, JANUARY 6-8, 2012
The Ottawa Senators are assured of having at least four familiar faces on the ice when they host the NHL all-star game this month. Defenceman Erik Karlsson led all vote-getters in fan balloting, and captain Daniel Alfredsson and fellow forwards Milan Michalek and Jason Spezza also were elected for the game on Jan. 29. The NHL said Thursday they will be joined by Toronto defenceman Dion Phaneuf and Boston Bruins
goalie Tim Thomas in this year’s game. The four Senators hold the top four spots on the club’s scoring list, with Spezza leading the way with 40 points — three more than Karlsson. However, Karlsson topped everyone in the league with 939,951 votes, 42,536 more than Alfredsson. Michalek got his spot with a late rush, beating out Toronto’s Phil Kessel by 42,144 votes. Kessel had been in line to be voted in
during the election period. “It’s great, obviously, to see all four of us getting in,” Alfredsson said. “You look at Jason, Erik, and Milan, too, they’ve had great starts to the season. If we would have had to choose one player, it would have been tough because they’ve all played great to start the season. To be able to all get in when it is in Ottawa, it’s going to be a special occasion for all of us and something we’ll cherish forever, I’m sure.”

About 24 million votes were cast by fans from Nov. 14 until Jan. 4 in the all-digital balloting, a 66 per cent increase over last season. Missing from the initial list of stars are Tampa Bay’s Steven Stamkos, who leads the NHL with 27 goals, along with Rangers forward Marian Gaborik, Kessel, Jonathan Toews of Chicago, and Pittsburgh’s James Neal — the next four top goal scorers ahead of Michalek.
