love summer… And it has nothing to do with getaway seasons, vacations or adventures in a tropical paradise. You seem content, that’s why. They say that spring is great for starting something new, autumn is perfect for collecting your harvest and winter is fantastic for enjoying your well-earned rest and planning your future. I think summer is perfect for doing all of these. Some might think launching a new English language magazine in Ukraine in the middle of a summer break is madness. Well, to me it is not as mad as our government’s attempts to raise customs tariffs on an almost daily basis. Oleg Pinchuk, Ukraine’s most popular contemporary sculptor, may seem mad to some Ukrainians as well. But he starts every day of his life with creation, not with destruction, and I am proud he is one of people I can call my friends. I am also proud to be supported by our big brother, Mir Deneg, who is celebrating 16 years on the market as you are reading these lines. Happy Birthday, bro! Finally, I should like to wish our first readers a happy summer break if you still haven’t been enjoying it.

The Wizard of Bronze By Alex Berdnick
I You are arguably the most famous contemporary sculptor in Ukraine. How vital is it to be famous? O.P. You have to be seen and known to be talked about, so it is very vital. A banker earns money, and so does a shop assistant. An artist is no exception and must live from selling their works of art. And to do so, you have to learn how to sell yourself. That is, always to be the centre of attention. Then, when you have been spotted, your pictures and sculptures can speak for you… I have always liked to be a man in the middle, even when I was a child. Back in the seventies, I remember visiting all Kyiv’s popular discotheques and other going-out spots where I would make new acquaintances. I am a very open person, and so is my art. I think that if after seeing my works a visitor to the exhibition wants to see me and know more about me, that is what recognition is all about. Sometimes I feel that my blood and my emotions through bronze are passed on to the people who come to see my sculptures. I When did you understand that
a sculptor is who you want to be? O.P. I always wanted to do something with my hands. Not just sculptures, but, for instance, jewellery items. Back in my childhood, I even tried to do knives and swords, or sometimes carved small sculptures out of wood. Obviously, being a typical Soviet kid, I also wanted to be a spaceman, a pilot, a football player. But, believe it or not, since the age of twelve I have always wanted to be a sculptor. Then I have been learning this wonderful craft ever since, and I still do.
Because when I was 15 I thought I was the same sculptor I am now. Maybe then I thought I was even more of a genius. But it is one thing when a child draws senseless lines and dots on a piece of paper and his parents keep talking how wonderful he or she is. But when you enter the life of an adult and you have to earn money with what you can do, it is a completely different thing. And to do so, you have to learn, learn and learn, as one of the classics used to say. I Do you remember the first sculpture for which you were paid? O.P. Of course I do. It was an Olympic Bear, the symbol of the 1980 summer Olympics. Also, being students of the Academy of Arts, we used to design kids’ playgrounds with various fairytale creatures, and I was paid quite decently for that. In the beginning of the eighties, I would get 300 roubles per month, and on Wednesday I had a so called creative day, which means I only had four working days a week. Not bad. I Do they blame you for going out and partying too much? O.P. I have got used to such blames. Yes, Pinchuk does party, but he also creates and sells sculptures, he prints catalogues, he buys canvasses by other artists and he organises his exhibitions in London and Paris. It is sad when a person does nothing else but partying, but this is not about me. By the way, I never go to those functions and parties because someone tells me. I do so just because I enjoy it. Besides, it is also a part of my business life, because I meet new people at those functions, I get to tell them

about myself, I receive new clients and new orders, after all. I do not have a manager as such, so I have to manage the brand of Oleg Pinchuk by myself. It means that I have to sort out everything concerning public relations, press, exhibitions, client orders and so on. I How exactly did you start promoting the brand of Oleg Pinchuk? O.P. Many years ago, a friend of mine placed me on the cover of the New Generation magazine with the caption “I Am a Genius”. That caused uproar, people started talking about me. Of course they accused me of being too vain and not very modest, but at least they noticed me! And since then I have been following a very simple rule – always make friends with journalists.

I You take part in various art projects and regularly organise your own exhibitions. How do you finance your endeavours? O.P. Sometimes by myself, sometimes my friends from business circles help. This is completely normal, and I hope that the traditions of arts patronage set by Tereschenko and Khanenko will come back to Ukraine one day. I And are the business circles mentioned by you ready to invest in arts? O.P. Our artists tell fables about being enormously rich by selling their works, and in reality they live in rented flats and drive second-hand cars. And the reason they have to blow dust in your eyes is they have to create the image of a successful person, because only then
somebody will buy their works. I do not do such kind of nonsense, because I do not have to prove anything to anyone. You can see a canvass by Maria Prymachenko hanging on my wall, and this is one of the most famous artists of Ukraine. Sometimes I buy works by my friends who need money. As for Ukrainian businessmen investing in arts, the problem is they would rather invest in a popularised name than in the message that a painting or a sculpture brings. It is sad, of course, but at least it is better than nothing. I Can you accept the fact that your works may cost much more in a certain period of time, which means you may get the money your deserve much later, or you might not get it at all?
c o v e r patrons and private collectors. But there are too many artists and too few collectors. Those collectors cannot save us all. I What do you do to break through in the West? O.P. I simply work a lot. I have good connections, both in Russia and in Switzerland, London, Paris. This is all far from simple, but at least my works are in demand. I How do you get new clients? Do they just call you and say “I want to buy your sculpture”? O.P. Usually that’s exactly how it happens. They see my works at exhibitions or at their friends’ homes and ask for my telephone number. Sometimes they come to me and if they do not choose from what I have in stock they ask if I could sculpt an exclusive work for them. If I have time I agree, but if I do not I simply pass this order to my colleagues so that they could make money. This is quite unusual for our artists, by the way – usually they are too vain and too reluctant to share clients with their colleagues. I How often do existing clients come to you in order to buy another sculpture by Oleg Pinchulk?

O.P. You have to understand what country you live in, how people here treat money and on what place arts are in the shopping lists of rich people. The paradox is that sometimes, in order to become a successful artist, all you have to do is find several soulmates among rich and influential people, and try to play your game with them. When you find out that some weird installation costs millions in the West, then it is definitely some kind of game. But that is the wild West, and it is completely different here. ‘Padded wallets’ prefer investing in marble sculptures and framed classical paintings, and it is much more difficult with contemporary art in Ukraine. And since we still do not know where to go – to the EU or to Russia – we are where we are and can only hope on local art

O.P. Being a sculptor, I am pleased that people collect not only cars and French cognacs, but also arts. And you do not necessarily have to consult Pinchuk to do it. Myself, I will buy a painting first, and only then – a car. I Does a successful artist have to possess qualities of a manager? O.P. Yes, and this is what young artists have to consider. When I started out, we virtually had no competition. All Soviet masters were gone, and there were no young Ukrainian artists and sculptors to replace them. The market was largely free and whatever we were doing would be accepted positively. Back in the nineties, you would appear on a magazine cover, and all Ukraine would be talking about you! Now young artists have to use all known business tools to promote themselves, and manager’s skills are a valuable asset here. I The initial cost of bronze sculptures is very high. Where did you get the money to sculpt your first works? O.P. I was lucky to sell my first works to the Ministry of Culture of Ukraine for a very good price. Also, a private American collector bought some of my sculptures in the beginning of the nine-

O.P. Quite often, and I’ll tell you why. First of all, I have series of compositions, and sometimes people buy the whole series at once or each item separately. Second, there is a belief that my sculptures bring luck. That is, if you put a sculpture by Pinchuk in your office you are bound to be successful. I approach this differently and think that these are successful businessmen buying works by a successful sculptor. Of course they can buy an item at Sotheby’s, but for someone born in the USSR sculptures by Oleg Pinchuk are closer and more understandable.
I How often do businessmen wanting to increase their knowledge of arts consult you, and do you help them?
“

I bought instruments, I organised my studio and whenever I would get money surplus I would invest it in the creation of new sculptures. I prefer working with bronze because it is an expensive high-quality material, and it perfectly interprets my emotions and my soul. Besides, bronze lasts longer than stone or wood. I Your sculptures come from a unique and inimitable world. Have all those rhinos, birds and fish been following you since your childhood? O.P. You could say that. For instance, I often use horns and tusks in my sculptures, and this is the result of my childhood visits to the zoological museums.

Money gives you freedom and possibility to do something other than sitting in an office from nine to five Monday through Friday
I tried to draw those tusks to various fairly tale creatures, but it didn’t always work. And now, being a grown-up man, I keep on working on my childhood dreams. By the way, there is a certain pattern in my sculptures of different periods. I cannot express everything in one item, and this leads to the creation of a series of items. Each story has its moments, rises and falls, joys and sorrows. Therefore my rhino of 2001 is different from my rhino of 2011. But is clear that both sculptures were made by Oleg Pinchuk, and this is important.
I What is contemporary art to you? O.P. I am pretty conservative in my work, so talking about me as of a contemporary art representative would be too much. I remember that at some point everybody started painting and sculpting in the genre of post modern without even understanding the genre! I prefer sculpting in accordance with the rules set thousands of years ago, though I obviously follow the recent trends of contemporary art. Besides, now and then I also do some kind of installations. You obviously remember ‘Singing Microphone’ or ‘Bus Stop’.

But I still do it with some kind of mockery. Once I brought a thousand empty metal barrels to the Ukrainian House, and that’s how ‘Evolution’, yet another installation, appeared. To me this is more of a performance with too few spectators, unfortunately. I What has changed in contemporary art? O.P. It is more important to create your brand than be able to paint or sculpt normally. Many graduates from the Academy of Arts simple do not know what to do, because they need to earn money. And to do it successfully, one needs to think in a creative way and analyse the situation at the arts market. If you can adjust your talent to the rules of the game, then you will be OK. If not, then you will have to start doing something else. I Did you ever have to protect your rights of authorship in court? O.P. Only once, and it happened with the ‘Person of the Year’ organisation, but we eventually managed to settle our dispute out of court. In general, it is very difficult to protect intellectual property rights in Ukraine.

I Did you manage to surround yourself with all necessary material goods? O.P. In general, yes. Being the head of my family, I make sure my wife and two kids are happy. We have a nice loft here in Kyiv and a fantastic house outside Ukraine’s capital. I obviously have cars and things like that, but what I want is make my kids spend less time with a computer. They should be outside with their mates instead. How strange – modern technologies called to connect people actually distance them from each other. I How do you treat money and do you manage to operate it? O.P. Money is a very serious tool that should not be underestimated. It gives you freedom and possibility to do something other than sitting in an office from nine to five Monday through Friday. It is also the measure of your recognition and the guarantee of your future. All I can say is that I have managed to work with money and always make sure that my income is more than my expenses, so there is no problem with accounting in the Pinchuk family. I

ince 14 April 2013, Ukraine has been applying special customs tariffs on newly imported cars at the rate of 6.46% for cars with an engine capacity of 1000–1500 cubic centimetres, and at the rate of 12.95% for cars with an engine capacity of 1500–2200 cubic centimetres, irrespective of the producing and exporting country. On 9 July Russia informed the World Trade Organisation it was planning to increase customs tariffs on chocolate, sugar, coal and float-glass imported from Ukraine. This is Russia’s response to Ukraine’s newly increased special customs tariffs on imported cars. Previously, Turkey had imposed a similar tariff on walnuts. If the increase of customs tariffs on walnuts was made without much sadness, then Russia’s intentions have caused uproar.

Who started the fire? The estimated amount that Russia will receive (36.1 million dollars) is much higher than the one that Turkey receives (6.11 million dollars). In addition, the goods on which Russia intends to increase customs tariffs are very sensitive for Ukraine. We all understand to whom the coal mines where Ukrainian coal is excavated belong. The owners of factories producing chocolate and exporting it to Russia are very famous and influential people in Ukraine. What we do not want to precipitate is a snowball effect, where other countries follow Russia’s example. Ukraine already has problems in creating and conducting international trade policy. This latest trade spat highlights other problems, connected with the logistics of conducting international trade. Kommersant newspaper reported that Russia’s actions had taken Ukrainian offi-
cials by surprise. The same newspaper quoted Valery Muntiyan, a government official responsible for co-operation with Russia, CIS countries and Eurasian Union, as saying “I am in Moscow now, but nobody consulted us before making such a decision. We shall be dealing with that.” The subsequent development of events was quite obvious, however, so the government representatives’ astonishment is beyond our understanding. Russia’s actions should not be viewed as surprising. First of all, the existing Article 8 of the WTO Agreement ‘On Safeguards’ foresees the right of a member of the organisation to seek adequate means of trade compensation for the adverse effects of safeguard measures introduced by the other trading nation. Second, the possibility of the introduction of such protective measures has been on the cards since the beginning of 2012, following on

Foreign Trade Snowball Ukraine has recently faced problems connected with the absence of strategically and tactically thought policy in the field of international trade By Sergii Koziakov, associate professor at Kyiv Institute of International Relations
from the very investigation on car customs tariffs, as earlier described. In the course of trade investigations the responsible Ministry of Economic Development and Trade is obliged to offer the opportunity for the interested parties to provide necessary statistics and give their own comments. The investigation has to comply with the procedures set by the national legislation and the WTO regulations. In the course of the investigation, the interested sides – importers, foreign producers and governments – stressed that the investigation did not comply with the WTO regulations and practice, and that the sides could introduce possible counter-measures towards Ukraine. For instance, this is what was written in a comment by one of the interested parties. “Having entered the WTO, Ukraine has accepted a range of obligations, non-fulfilment of which may lead to the respec-
tive sanctions from the side of other states, not to mention degradation of our country’s image. Therefore, in case of implementation of special measures without enough reasons Ukraine may violate its obligations within the framework of the WTO membership and provoke an introduction of the respective measures from the side of other states.” So the commission that featured two representatives of the Ministry of Economic Development (the minister himself and his first deputy) both in the time of the decision’s adoption and its publication, must have been very well informed about possible negative consequences. Maybe that’s why Petro Poroshenko, who was at the time the Minister of Economic Development and also the head of the commission, was surprisingly slow to publish the commission’s decision on the customs tariffs. The document was subsequently published and became effective already under the new minister and commission head, Ihor Prasolov. The official message about the adopted decision merely states that “international obligations accepted by Ukraine do not prohibit the state from introducing special safeguard measures towards the increasing import that threatens the national producer”. Empty, meaningless words… The commission had to analyse possible counter-measures foreseen by the WTO agreement and about which much has been said in the many documents the government has had at its disposal, as well as in the course of multiple meetings of foreign and Ukrainian negotiators on the problem. Therefore, Russia’s planned actions come as no surprise, especially after the measures introduced by Turkey on the very same grounds. Counter-strike Another important detail is to be noted. As a compensation measure, Russia will increase customs tariffs on float-glass imported from Ukraine. This item didn’t appear in the Russian list at random. On 26 April 2012 as the result of another, this time, anti-dumping investigation in
regards to the importation of float-glass, the commission by its decision fixed the size of the rate of the final anti-dumping customs tariff in the amount from 5.11 to 30.78% on importing float-glass from Russia. So Russia used this situation to introduce counter-measures. But the consequences for the countries are different. In Russia, glass plants keep working successfully. The initiator of the investigation, Lisichansk Plant Proletariy, while being the only float-glass producer in Ukraine, has been suffering great losses for several years leading to a slowdown in production and the loss of a considerable number of jobs. The decision of the commission made in favour of the plant over a year ago has not been helpful so far in terms of the plant’s financial recovery. For the causes of the plant’s difficult financial situation didn’t disappear. Besides, the commission’s decision has been adopted only regarding several foreign enterprises. So now other producers ship glass from the countries which are not in the list of “the punished”. Moreover, almost all players examined by the investigation received higher rates of the final anti-dumping customs tariff. For instance, Russian plants got the rate of 15.02% for the most popular glass (3.5– 4.5 mm), Polish plants –over 17%, plants from Turkey – 13.52%, Bulgarian producers – 28.5%. Interestingly, plants from the neighbouring Belarus producing the same popular glass received a present from the commission – 0% of the rate! So while Russian suppliers have to carry out additional expenses when exporting glass into our country, Belorussian producers have extremely loyal conditions and keep exporting glass into Ukraine. In reality, the commission’s decision has not protected the local producer and is useless. Now, if Russia, together with other countries of the Customs Union, fulfils its threat and increases customs tariffs on Ukrainian-produced float-glass as well, the situation at Lisichansk Plant Proletariy will only get worse. Service for Supervision of Consumer Rights Protection and Human Welfare, said his institution had got issues with Ukrainian chocolate, especially that produced by Roshen. One can assume that now Petro Poroshenko’s business interests are under attack, and do not forget that it was Poroshenko who was the head of the commission when the decision to increase customs tariffs on imported (also from Russia) cars was adopted. So now it’s Russia’s turn to retaliate! It has to be admitted that Russia has been playing in exact accordance with the script written in one single place, where all players act strictly to their roles. As with all trade wars, you hit your trade enemy (sorry, trade partner) where it hurts most. But the problem is that not only initiators of such wars suffer because of their actions. The ironic fact is that the WTO was actually created to sort out all trade conflicts peacefully. Time for action Ukrainian problems in international trade have been piling up like a rolling snowball. Just when we thought we got rid of the problem with supplying Ukrainian cheeses to Russia, the USA are not happy again with the intellectual

property protection in our country. In solving such complex problems where all long-term consequences have to be considered, Ukraine lacks harmony in the work of state institutions responsible for development and realisation of state policy in the field of international trade. We lack specialists in international trade who understand how trade policy on two-way, regional and global levels should be conducted. Such specialists had to be trained the day before yesterday. There is no understanding that foreign trade is the most important part of foreign policy which has to be implemented in close ties with the economic policy of the state. Such understanding should have come to us before Ukraine entered the WTO. We don’t have a real centre of making decisions in the field of international trade, where state interests have to be agreed with interests of businesses and consumers. To solve this problem, the President created the State commission on co-operation with the WTO. The time has come for the commission to start working. We are sure that in autumn the Agreement of Association and Zone of Free Trade Ukraine-EU will be signed. Have the respective co-ordination bodies
been created in order to implement this vital and civilised agreement? The EU websites are full of analytical materials on the upcoming agreement and plans of its explanation and popularisation. Conversely, from the Ukrainian government, on the website of our Ministry of Economic Development, the latest news in the section ‘Measures on the implementation of the Agreement of the Association of Ukraine and EU’ are dated… May 2012! What will Ukraine do when gigantic free trade zones are created with participation of the USA and EU, including those in the Pacific Ocean? Have the ambassadors and trade representatives been given respective instructions? How many trained professionals work at the WTO office? Do we actually have an agency of sorts representing the WTO here in Ukraine? How seriously has the experience of the respective agencies from other countries been assimilated? Who co-ordinates the work of analytic centres in the field of international trade? All these are problems of the state, but branch associations of industrials and entrepreneurs have the same problems. And they have virtually no specialists. Looks like it’s time to finish off summer holidays… I

V
olkswagen is one of the most popular and loyal motor car brands to the clients in Ukraine. But the success of a brand is defined by its representatives who actually deal with end users and make sure they are happy. We decided to find out from Taras Ryzhikov, director of Avtosoyuz company servicing Volkswagen cars in Kyiv and Kyiv oblast, what his keys to success are.
I Taras, how did you manage to increase the affection of Ukrainians towards Volkswagen? T.R. Eight years ago, when I started working with Volkswagen brand, I most of all wanted to understand what a client wanted, and I also wanted my employees to understand it. Thankfully, my previous experience as a doctor turned out to be very useful here. The thing is, healing a human and repairing a car have pretty much the same principles. By repairing a car and prolonging its lifespan, we also heal the vehicle’s owner. I am proud to tell you that we have managed to increase the lifespan of client’s servicing at our service centres up to seven years. An average servicing lifespan at an official dealer is three years in Ukraine. At our company, 45% of the clients have the car’s lifespan from four to seven years. I What problems do drivers face when servicing their cars, and how are those problems solved at your company? T.R. When you deal with a successful official representative of a foreign automobile brand, it is very difficult to arrange services for your car. Sometimes it is even difficult to reach them by phone! What we organised is our own call-centre allowing us to answer any incoming call, that is, speak to any client seeking help. If the respective repair specialist is for some reason unavailable, our operators will make sure the client receives proper consulting later. Also, many car service centres have a very complex procedure of legal paperwork when you bring your car in to be repaired.

sure the price of the repair fits the client. Understanding how vitally important it is for our clients to be always on the move, we provide for them free taxis, or we offer a temporary car for the time of the repair. It has to be noted that the provided car is the same class as that of the client, or even higher! The final problem is all about safety. Usually, when a traffic accident happens, the client faces difficult obstacles connected with the right actions at the place of the accident and the car’s subsequent transportation and repair. Therefore we, together with our insurance partners, have developed special insurance packages which are the best by each type of clients (age, driving experience and so on). What is important, we do not just sell an insurance product. We actually offer a service that includes such an option as distant settlement. Thanks to this package, in case of a traffic accident the client has to perform minimal actions in order to sort out the emerged difficulty. Basically, the client only has to inform the insurance company about the traffic accident, and then organise transportation of the car to our service centre by using Volkswagen Assistance card. Then our specialists and our insurance partners deal with all the issues related to evaluation of the cost, repair of the car and so on. And, like I said earlier, the client remains mobile for the whole period of the repair thanks to a temporary car provided by us as a replacement. Besides, we regularly inform the client on what is going on with their car. The most complex repairs take place within a timeframe of ten days, and during this period the client does not need to run like a headless chicken between the insurance company, car service centre and a traffic police unit.

As a result, all that routine takes a very long time. For instance, changing an oil filter should take no more than half an hour, but in Ukraine it usually takes three hours. Because of unprofessional production management at a service company, clients lose their precious time! We decided to sort out many issues by a simple phone call from our side to the client. We remind clients about their planned upcoming visit and agree all their wishes and the amount of services to be rendered. As a result, bringing your car to our service centre and registering the repair takes five minutes! Another problem is how fast your car is repaired. Why does it take over three hours to do a simple procedure usually requiring no more than half an hour? We have eliminated this problem by dividing the scope of work into certain directions, and this has allowed us to have separate stations doing express-service jobs. These stations largely resemble the work of Formula-1 pit stops. Two mechanics and a master are involved, and they sort out minor problems with your car in the course of 15 minutes. All the client can do during that time is relax and have a cup of coffee! Such approach to servicing makes our clients more than happy. Now, a couple of words about what happens to the clients during their cars’ repair. So, you have got a broken car. This is a huge stress leading to a large number of additional problems: you have to change your schedule, your meetings are shifted or cancelled, your life rhythm slows down. Not to mention that your family budget carries additional painful expenses. And now imagine our almost impossible mission – to remove all difficulties caused by the fault, ensure an acceptable time frame and even make

The director of Avtosoyuz company stressed the problem that has affected not only businessmen related to the car market, but also entrepreneurs from other business spheres. Basically, government officials did not properly foresee the midterm and long-term consequences of the decision to introduce special protective customs tariffs on importing new cars. As a result, the level of import has fallen, and so has the level of customs tariff fees collected. Also, Turkey and Russia have announced their counter-measures related to certain Ukrainian goods (walnut, chocolate, float-glass, sugar and coal). Finally, Ukraine is in danger of initiation of a dispute within the framework of the WTO from several car producing countries that could be joined by other interested parties.

I How did you manage to organise both sales and service in such a way that a Polo client and a Touareg client are treated equally highly? T.R. We do not divide clients by the class of their cars, and this philosophy is supported by all divisions and in all activities of our company. Of course, clients driving more expensive cars are treated to more pleasant surprises, but this affects neither our attitude to our clients nor the level of services. After all, both Polo and Touareg owners are united by the magic logo of Volkswagen on their cars. I What can you offer to high-class customers? T.R. First of all, we offer such model as Phaeton in the luxury segment. This
I What external factors, in your opinion, can influence the Ukrainian car market in the remaining months of 2013? T.R. The market already reacted badly to the rise of customs tariffs on petrol cars. We noticed the market top in April due to the customers’ reaction to the state’s intention to raise the tariffs, but the market has been showing negative trends since then. The car price rise has led to the erosion of purchasing power and, as a result, to the fall of the market. Having foreseen the situation with the tariffs, Volkswagen importers were very well prepared and brought to Ukraine the necessary car stock allowing us to sell cars at the old prices till the end of 2013. For instance, over 2,000 of the popular Polo Sedan cars were brought into Ukraine. And considering that in the Volkswagen product line virtually each model has a modification with a diesel engine, this gives us a tangible advantage over other brands. Today our clients have the possibility to buy a car with a high technology and economical diesel engine, which is considerably cheaper to operate than a petrol engine. A second quake will hit the market on 1 September 2013, should the government adopt a decision to introduce a car recycling tax. This tax will make all cars considerably more expensive, and the prices may rise from 5.5 thousand to 38 thousand hryvnyas. Again, the end user will end up paying for that. Unfortunately, this decision would be overwhelming for Ukrainians, and the negative dynamics of sales will continue, resulting in a market displaying record low sales figures. But we believe in the victory of common wisdom and hope for the better. I

Innovations in Ukraine: A door to New Reality With a great potential in innovative sphere and many reputed scientists, Ukraine has to start cherishing those who make new inventions possible By Ivan Buntov, partner of Liberty international legal consortium
I
t has been our tradition since the industrial revolution in Europe to chase economically developed countries. However, our producers couldn’t find a better solution than to buy a German or Japanese, and now even a Chinese machine and try to reach the same efficiency as that in the countries producing those machines. From the other side, we have always had inventors able to create fantastic and efficient tools out of practically nothing. Innovative approach, imagination, dreams of jumping into the future on the base of unconventional solutions, have always been reflected in Slavic fairy tales – magic table-cloth, flying ship and so on. Ingenious inventions that can easily be called innovations remain fairy tale characters in our country. There are several reasons for it. Haven’t We Got the Brains? The first and most important factor is the absence of the mechanism of efficient copyright protection. People are simply afraid of not getting anything for their inventions and they would rather shelve them. I think we shall be having difficulty trying to remember a case when a local innovation in Ukraine provided recognition and wealth for its author. The second factor is bureaucracy. Hardly any official will agree to take responsibility and help embody innovative solutions, because this means changing the existing bureaucratic system. When talking, every state official wants progress, but in reality they want someone else to be responsible for possible consequences. Therefore our inventors walk in circles trying to find access to the big boss able to make a decision and provide money for their inventions. Local oligarchs are the third serious factor stonewalling the embodiment of

innovations in our life. How can they allow the loss of demand for their goods and services, which is inevitable in the situation where revolutionary technologies are implemented? In addition, these oligarchs are almost certainly supported by high-level state officials, who are also interested in maintaining the existing technological status quo in the society. Imagine what would happen to the state as the system of force and control should all households and then productions become energetically independent and refuse central heating, electricity and oil products? Yes, we are talking about a revolution: first technical, then political. The elites’ fear of losing control over people and their established forms of income do not allow them to try and create an efficient system of innovation support in Ukraine. Moreover, they are doing their best to make sure those innovations remain only on paper or in the heads of their creators. Therefore both state officials and oligarchs are happy to maintain outdated technologies and depend on Western economies, thereby denying Ukraine the remotest prospect of ever appearing among the leaders. Make Oligarchs Your Allies Slavic history teaches us that the condition under which elites, officials and simple people forget their individual fears is unification in front of one global enemy, when separation means death to the country in total and for each individual personally. Then everyone is doing their best in searching for optimal solutions and fulfilling them. We are talking about moving production powers thousands of kilometres away from the war zone, creating Katyusha rocket launchers and T-34 tanks, using snowshoes to transfer tank divisions through marshes. When the victory is achieved, everybody is back at
their social and economic niches and appearing in parallel class worlds. It is pointless to blame officials for stonewalling innovations. Their historic mission is supporting the system’s stability and maintaining the state’s balance irrespective of fantasies of the people below and change of the elites above. Therefore innovations by definition should not touch this class, or they will die when taking off. So, believe it or not, but we can look for allies in trying to set Ukraine on the way of innovative development in the camp of the first faces of the state and oligarchs sponsoring them. The driving force here would be their ambitions. From a political point of view, the adoption of the European integration scenario by the Ukrainian government is an innovation. It gives the state a considerable push forward in many spheres of its life and forces the society to gradually refuse the previous clan-based system of forming the government and other state bodies. Later, it may even lead to changes in the redistribution of income. The next stage is complete economic inexpediency of maintaining the old technological park and the system of labour organisation at local productions, non-efficiency of the extensive way of development at the expense of widening the resource base as well as complete unprofitability. What should we do, then? Shall we change the equipment from that

aged 70 years to the one aged 15 and thus slightly increase the efficiency of labour? This way of evolution reminds a suitcase without a handle – it is too heavy to carry, but too valuable to throw away.

Don’t Drift with the Current! One wants to believe that the world crisis which has been actively breaking all economic models will make big business search for completely new ways of utilising its capitals. The traditional policy of following the western countries will not do any good, because they are dealing with their own crises and they will still be way ahead of us. This is where an active dialogue of inventors and innovators with the capital owners has to begin, and the initiative has to proceed from the latter. The difference of an idea from material goods is that the idea is hard to be taken by usual methods – raider attacks, inspections by various state bodies and so on. In case of a hostile takeover, it is hard to keep your production powers, warehouses and even money or move it all to another country. But your ideas, inventions and innovations will still be with you. There are enough businesses in the world willing to use your ideas and ready to share their profits with you on fair grounds. So local companies, in order not to lose potential ideas and not waste the remainder of their capitals, will have to do their best to actually support innovations and fair distribution of profits from their use. What do simple citizens and entrepreneurs, who don’t want to waste their lives waiting for a change of ruling elites, have to do? At this stage – conduct innovative breakthroughs themselves. For any system or ideology exists until people believe it and follow its rules. As soon as people stop waiting for gifts from state officials, hoping for happy and affluent old age at the expense of their payments to the Pension Fund, waiting for a miracle from an obsolete and virtually destroyed economic model, then real changes are possible. Innovation is everything that changes our lives in any sphere, including social. From that point of view, crisis is a great thing, for it makes us become creators of our destiny, not drifting with the current. I summer 2013| Insider М ир

In the light of the expected association agreement to be signed in November, the time has come for the European Union and Ukraine to come closer together, to create a bridge between east and west, says Mr Prodi. The EU officials, in Prodi’s opinion, also have to understand that it is better to turn their faces to Ukraine, not their backs, for such an opportunity may not present itself again any time soon. The article also pays attention to something we know only too well – the very same factors that make Ukraine such a valuable partner for Europe are also pulling it towards Russia. Union of former Soviet republics, Romano Prodi writes that Ukraine boasts a significant Russian population, and Ukrainians are torn between European and Russian futures. Nevertheless, Mr Prodi is very optimistic about Ukraine’s future in the EU and refers to his memories of 2004… No, not those of the Orange Revolution, but those of the largest single enlargement of the European Union in its history when ten new members were added. “Those same states are now bulwarks of Europe”, writes Romano Prodi, referring largely to the Baltic countries who were a part of the Soviet Union once. But despite the positive tone of the article and a very balanced way of presenting the information, you still don’t feel much happier. And the problem is… we have heard it all before when Western leaders congratulated Viktor Yuschenko on his presidential victory in the beginning of 2005. Eight years on, we are much more distant from the EU than we were then, despite a few notable baubles like the Eurovision Song Contest and the Euro2012 football tournament, which was considered a great success. Therefore reading this article feels like receiving a letter that got lost in the mail for years and arrives too late.

The Financial Times Ukraine: will new tax law hit the oligarchs? 10 July 2013 by Roman Olearchyk

Oligarchs win again in game of Ukraine monopoly 8 June 2013 by Jim Armitage “Depressing news from the Ukraine, where yet another vast monopoly asset has just been handed over to one of the tiny group of uber-rich oligarchs who pretty much run the show there”. That’s how the article in the Independent starts, and that’s how Ukrainian topics generally sound in the British press. This time, it is about Rinat Akhmetov buying the country’s fixed-line telecom monopoly and sole 3G licence Ukrtelekom for a reputed $1bn. Jim Armitage does not forget to mention that it was Akhmetov who spent
£136.4m buying Britain’s most expensive property – the penthouse at the billionaire’s bolthole, Number One Hyde Park. Then, predictably, Mr Armitage starts playing a broken record of Tymoshenko’s “politically motivated” imprisonment and speculating about whether President Viktor Yanukovych sets her free in order to get a major free-trade agreement signed at a summit in Lithuania at the end of this year. After that, Jim Armitage simply repeats the words of nodding donkeys from Brussels and says, “Mr Yanukovych is failing to agree to release her from jail because she would be a powerful political opponent come his re-election campaign in 2015. Until she is freed and allowed to run for office, surely we in the West should ignore his pleas for trade”. So whose position is politically motivated, Mr Armitage?
Finally, we would like to mention an article written by ex-pat journalist Roman Olearchyk, in which he tries to analyse what can happen if President Viktor Yanukovych signs a law, recently adopted by the Ukrainian Parliament and aimed at “cracking down on transfer pricing and other tax evasion schemes by exporters that have long shown losses or small profits at their domestic factories, while funnelling big profits offshore into affiliated trading companies registered in tax havens such as Cyprus”. Then Olearchyk quotes Oleksandr Klymenko, Ukraine’s minister responsible for tax and customs collections, who said that transfer pricing schemes utilised by exporters of steel and grain alone robbed the state budget of nearly $1bn in revenue each year. But it was not Roman’s brilliant article that drew our attention, but a response to it! On 18 July the Financial Times published a reply to the article, written by… Oleksandr Klymenko, Minister of Revenues and Duties of Ukraine. In his response, Mr Klymenko intended to “clarify a few points about Ukraine’s new transfer pricing control legislation”. The letter seemed to have been written by a Soviet state official thirty years ago and contained no factual information, some quotes from the existing laws and what we call ‘lots of water’, but the fact of the reply itself was quite impressive. Well done, Roman!

Maybe the word ‘mafia’ was indeed associated with a Sicilian criminal clan, but much has changed since then. To me it is, first of all, family values. We have seen many Italian films depicting those values without idealising them. Imagine – the south of Italy, summer terrace by the sea… A big friendly Italian family is having dinner. ast summer I had no idea where to go for my two-week break, so that I didn’t have to spend a fortune and at the same time could collect impressions and strength for the following year. Possible solution came to me by chance and first sent me into the state of geographical shock. “I spent such fun in Casablanca”, my friend told me by the phone. “It’s really affordable, and, besides, it’s only a taxi drive from Odesa.” I even didn’t want to begin to think what magic brought Morocco to Odesa oblast of Ukraine, but my friend calmed me down. She was not talking about a Moroccan city immortalised by the legendary film starring Humphrey Bogart and Ingrid Bergman, but about some recreational resort in a cosy spot of the Black Sea coast – Zatoka village. I asked for the resort’s website and started examining a potential place for my summer vacation… The taxi is taking me and my significant other from Odesa airport to Zatoka village, and soon I am met by a sand-bank with a long beach, warm and playful sea and golden sand. course, tender sun specific for the region – the one that slightly warms you up without burning you down. “Well, should the weather be OK, at least I am guaranteed two weeks of decent holiday season,” I comforted myself in thoughts and went on to examine the actual Casa-Blanca resort. The first thing that impressed me was white bungalows with individual exits to the beach. At first you get the impression they hang in the air, but then you realise that is the way they are designed. can watch for their kids running over the whole village. Soon we reached our love nest for the next two weeks. That turned out to be a nice room for two with all modern conveniences, a plasma TV and everything you need when vacating far away from Kyiv. Frankly speaking, I was scared by all those conversations about the horrors of resorts at the Black Sea coast and expected to see much worse, so this nice bungalow came up as a pleasant surprise. But what really made my day was an astonishing terrace with a fantastic seascape. I have to admit that this was the romantic spot where I mostly enjoyed the two weeks of my summer vacation… My very communicative companion soon made acquaintance with a young couple renting the same romantic nest in the neighbourhood. It turned out that it was not their first vacation in Casa-Blanca. But if earlier they would spend here three weeks at most, this year, to celebrate their successful university graduation, they rented a cottage for the whole season! Apparently it is possible to rent a cottage here in Casa-Blanca for a month or two for a very nice price. A point of interest is that the number of sunny days a year exceeds 280 in Zatoka, which means that comprehensive holidays from May through September are guaranteed. Now it would make sense to teach you some geography. Zatoka village is like a pearl in a shell, cherished by the Budaki Lagoon, with the sea in the south, forests and parks on the main shore and heath and steppe valleys towards the north. By the way, our new friends told us it would be their first autumn season, or velvet season, as they call it here in Ukraine. The days not so hot, the beaches not so crowded… During my first days of staying in Casa-Blanca I noticed how wisely the resort was planned. For instance, the recreational zone does not cross with the entertainment complex, therefore party animals cause no problems for those who want to go to bed early. There is a snack bar on the beach, something my companion definitely appreciated, for unlike me, he wasn’t
going to watch his weight. The cafeteria where we ate would turn into a social club of sorts, where men could discuss the results of the latest football match, and women could show all the dresses they took with them to their vacation trip. Young kids are also well catered for in Casa-Blanca. Besides the obvious sea, beach and several playgrounds, children have two unique spots in the resort – Willow Yard and Flower Yard. But as the resort has professional security guards, parents can relax without worrying too much about their kids, while the latter can play football wildly or read a book peacefully. However, all I did during the first week of my summer break was lying on the beach or spending time with my iPad on that cosy romantic terrace. But then my childhood came back to me in the form of a travel bug that soon turned into wanderlust, and I decided to travel a little. The closest tourist Mecca would be Bilhorod-Dnistrovskyi, an ancient city with over 2500 years of history. Formerly known as Akkerman, it used to be a Greek town of Tyras many centuries ago. If you want to know more about this vanished page of Ukrainian history, then you should visit the local museum of regional national history (www.bdkm.ucoz.com). However, my significant other almost missed the visit to the museum, because on our way to Akkerman we also popped into the Centre of Wine Culture in Shabo (www.shabo.ua). So I had to maintain sobriety for both of us… Those fascinated by old monumental constructions will appreciate the legendary Akkerman Fortress which is said to exceed in size any ancient fortifications of Ukraine. Finally, if you still have the urge to move on, pay a visit to the world capital of illegal trade and Jewish humour. That’s right, I mean Odesa… All in all, I was happy I spent those two weeks in Casa-Blanca. Perhaps my vacation was not too exotic, but at least I didn’t catch tropical fever, I wasn’t eaten by a crocodile and I wasn’t washed into the sea by a rogue wave. But my iPad got new amusing photographs and merry video clips, my Facebook page – posts about time spent in Casa-Blanca, and my heart – warm and tender memories which I will keep forever. Basically, what we did was create a spa-hotel for your fur coats, where they are kept in a special contained environment at a temperature of 10-12 °C. Then your favourite clothing items will avoid such problems related to fur as overdrying, discolouration and eclipse.
I What guarantees do you give your clients? S.Y. All clothing items given to us to be cleaned are insured with Ingo Ukraina insurance company, one of the exclusive advantages of OSCAR studio and UN MOMENTO chain. Unfortunately, sometimes absolutely unforeseen situations are encountered, usually connected with the quality of the fabric. All of a sudden, your clothing item shrinks or loses one of its garment accessories, or something happens to its colour. In these cases, OSCAR studio compensates the replacement cost of the damaged clothing item.
I What can you do if a clothing item requires something more than dry-cleaning? For instance, if it contains an irremovable spot or even a cut? S.Y.
