Implement HC order, NTC asks R&B deptt `342.2 cr DRAWN DURING 2016-17 BUT NO SIGN OF IMPROVEMENT

D I M A P U R , AU G 1 6 (NPN): Gauhati High Court, Kohima bench on Wednesday passed an interim order, in response to a PIL filed by social activists-ST Yapang and Odi Jamir, directing the Roads & Bridges department to restore the conditions of the roads and bridges in Nagaland. The interim order was passed on August 16 after the court held its first hearing on the petition filed against R&B department, NTC media cell informed in a press note. NTC has therefore demanded that the R&B department implement the court’s directive. In the PIL, the petitioners pointed out that the RTI reply revealed that “Finance department (Budget and Monitoring Cell) issued 62 withdrawal authority(s) to the Roads and Bridges department of under demand No. 58 a whopping amount of Rs 342 crores 22 lakhs and 8 thousand from May 6, 2016 to March 31, 2017.” The PIL contended that despite the drawal of such an amount within

a span of 11 months, the roads and bridges in Nagaland, particularly Dimapur, were in deteriorated condition. NTC further informed that the petitioners, who are also governing body members of Nagaland Indigenous People’s Forum, had filed PIL(s) against 10 other departments-- Police, Civil Supplies, Irrigation & Flood Control, Social Welfare, School Education, Rural Development, PHE, Planning, Medical and Urban Development, for allegedly drawing money without execution of works. Despite developmental activities coming to a standstill in Nagaland due to non-allocation of funds from Centre, NTC alleged that during the last one year (from April 2016 to March 2017), “not less than Rs. 2355 crores, 38 lakhs and 64 thousand was drawn and utilised fully by 11 departments” purportedly for public distributions and infrastructural projects excluding departmental and establishment expenditures. In this regard, NTC

has resolved to wholeheartedly support the PIL filed by ST Yapang and Odi Jamir. NTC listed out the departments against which PILs were filed with regard to withdrawal of funds within a span of 11 months: NTC said Social Welfare department withdrew Rs. 222 crores 49 lakhs 48 thousands 346 for the purpose of payment of old age pensions, grants to blind persons, implementation of wheat nutritional programme and payment of bills for purchase of biscuits for children. School Education had withdrawn Rs. 248 crores 67 lakhs 76 thousands for the purpose of up gradation and construction of School buildings, Midday Meal scheme, payment of SSA teachers’ salaries and scholarships. Civil Supplies had withdrawn Rs. 12 crores 55 lakhs 21 thousands within one month for the purpose of handling and transportation charges of AAY and BPL rice. Rural Development had withdrawn Rs. 719

crores 67 lakhs 50 thousands 200 for the purpose of implementation of MGNREGA Scheme/Project, National Rural Livelihood. PMAY and grant in aid to VDB Secretaries salaries payment. P H E - - w i t h d r aw n Rs. 174 crores 21 lakhs 87 thousands for the purpose of operation and maintenance, coverage water quality sustainability, Swach Bharat Mission, NLCPR and NRDWP. Planning-- withdrawn Rs. 85 crores 69 lakhs 30 thousands 447 for the purpose of construction of Hostel for ST girls, construction of Training Centre for Skill Development, acquisition of land for Fire Stations, KV Power line, Colleges and black topping of roads and other civil works of drainage and retaining walls. Police department had withdrawn Rs. 259 crores 05 lakhs 93 thousands 799 for the purpose of repairing of vehicles, purchase of tyres, tubes, batteries, payment of POL, procurement of VVIP security equipment, Police Modernisation scheme, payment of ration bills,

costs of deployment of IR & Police Jawan and purchase of clothing. Irrigation & Flood Control had withdrawn Rs. 57 crores 31 lakhs 12 thousands for the purpose of Flood Control Management, Rain Water Harvesting, PMKSY and implementation of various Irrigation Projects. Medical department had withdrawn Rs. 162 crores 71 lakhs 06 thousands for the purpose of implementation of various centrally Sponsored Schemes viz; Flexi Pool, Capacity building. Ayush Mission, National TB Programme, upgradation of Hospitals, PHCs, grants to Naga Hospital authority. And Urban Development department had withdrawn Rs. 70 crores 67 lakhs 31 thousands 790 for the purpose of implementation of various Centrally Sponsored Schemes viz; NERCCDIP/NERUDP, Swach Bharat Mission, AMRUT, NULM and construction of bridge over Dhansari at Dimapur. Court clarifies order on NPF case D I M A P U R , AU G 1 6 (NPN): The court of the civil judge (senior) Mon division has clarified on its ad-interim injunction order passed on August 14, 2017 restraining the defendant (Neiphiu Rio) from using the name of Naga People’s Front (NPF), its symbol and flags and also against the opening of any office using the name of NPF party. Civil judge (senior) division Mon, Inalo Zhimomi, who passed the modified order on August 14, 2017, clarified that the ad-interim injunction order issued earlier was to operate only within the jurisdiction of his court .i.e. within Mon district, but the court had inadvertently failed to particularly mention the same. “As such, a modification of the earlier order is necessitated and the same is hereby modified in the following manner: ‘Accordingly, the defendant is hereby retrained from using the name of NPF, its symbol and flags and is further restrained from opening of any new office using the name of NPF party in the district of Mon, Nagaland till the next returnable date.’” the order stated.

US declares HM as ‘specially designated’ terrorist outfit NEW DELHI, AUG 16 (AGENCIES): The US State Department has declared the Hizbul Mujahideen as a “Specially Designated Global Terrorist” (SDGT) organisation. This comes as a major blow to Hizbul after Yaseen Ittoo, one of its commanders, was killed in an encounter. This comes as a major diplomatic win for India since Jaish-e-Mohammed and Lashkar-e-Taiba, along with its leader Hafiz Saeed, have also been declared as SDGTs by the US. According to a statement from US department of States released this evening, “The designations seek to deny HM the resources it needs to carry out terrorist attacks. Among other consequences, all of HM’s property and interests in property subject to U.S. jurisdiction are blocked, and U.S. persons are generally prohibited from engaging in any transactions with the group.” Formed in 1989, HM is one of the largest and oldest militant groups operating in Kashmir. Hizbul Mujahideen is led by Specially Designated Global Terrorist Mohammad Yusuf Shah,

also known as Syed Salahuddin. Hizbul Mujahideen has claimed responsibility for several attacks, including the April 2014, explosives attack in the state of J&K, which injured 17 people, according to the statement. India has been pushing for ban on HM and its chief with UN Security Council but has been vetoed by China. The designation by US may help New Delhi to argue its case before the UNSC and will also put pressure on other countries to take action against HM and its leader. “Today’s action notifies the U.S. public and the international community that HM is a terrorist organization. Terrorism designations expose and isolate organizations and individuals, and deny them access to the U.S. financial system,” a statement from US department reads.

NEW DELHI, AUG 16 (AGENCIES): More than 200 people have died and over one crore affected in recent floods and landslides across India. The toll in the flood rose to 72 in Bihar, where 73.44 lakh people have been hit by inundation in 14 districts triggered by incessant rains in Nepal and some districts in the northern part of the state. Special secretary in the state disaster management department, Anirudh Kumar said 73.44 lakh people are in the grip of flood which has engulfed 110 blocks and 1,151 panchayats in 14 districts of the state, the latest being Gopalganj, which was submerged today. The flood situation in Assam too continued to deteriorate with 11 more lives lost today. Around 33.45 lakh people in 24 districts of the state remained affected due to the flood. With the deaths reported today, the toll in the third wave of floods has

gone up to 39 in the northeastern state. The floods have claimed 123 lives so far this year in Assam, including eight in Guwahati. In Meghalaya, over one lakh persons have been affected by floods in the Brahmaputra and Jingiram rivers, the waters of which have inundated 136 villages in western Meghalaya, an official said on Wednesday. No loss of life has been reported so far. The official said 30 relief camps have been set up to accommodate those affected. In West Bengal, at least 32 people have died and over 14 lakh people affected due to floods in six districts of north Bengal partly due to overflowing rivers of Bhutan, Bihar and Jharkhand. In Uttarakhand, two more bodies were recovered from Dharchula area of Pithoragarh district, taking the death toll in the recent cloudbursts to eight as relief and rescue operations continued in search of the missing,

Rail connectivity in flood-hit portions of Bihar and West Bengal continues to be affected with marginal improvement in situation today. “However, virtually no accessibility to most of the damaged sites has affected the restoration work. Telecommunication network in the entire section is badly affected also,” he said.

NEW DELHI, AUG 16 (PTI): Industries in the North Eastern and Himalayan states will continue to get tax exemption till March 2027, albeit as refund, under the current GST regime which was rolled out on July 1, Finance Minister Arun Jaitley said Wednesday. “Within the framework of the GST Act each industry will be entitled to its own refund mechanism during this particular period (March 31, 2027),” he said after the Cabinet meeting headed by Prime Minister Narendra Modi. Industries in the north eastern and Himalayan states of Jammu and Kashmir, Himachal Pradesh and Uttarakhand under the previous excise regime used to get 10-year exemption, he said. As per the scheme, industries which commenced operations during the period got excise tax holiday for 10 years, he said, adding that there is a separate residuary period for every industry because of commencement of production and their consequent entitlement of 10 year exemption. Under the new Goods and Services Tax (GST) regime, there is no provision for exemption but there is one section under the Act which permits refunds. “Therefore, refund would be permitted through DBT. The sunset clause of these exemption has been extended to 2027. 4,284 industrial establishment will entitled to this benefit. Budgetary provision for this Rs 27,413 crore,” he said.

WOKHA, AUG 16 (NPN): All Commercial Vehicles Association Wokha (ACVAW) on Wednesday called off the restriction on movement of all commercial vehicles (goods carrier) along the Wokha-Merapani state highway which was imposed since August 5 last. The bandh was lifted after the intervention of

minister Geology & Mining and Border Affairs, Mmhonlumo Kikon, who assured to immediately look into their demands. AVCA Wokha had called the bandh demanding immediate construction of “plyable” road, which was in deplorable condition, and commencement of work by the concerned contractor. AC VAW h a d a l s o taken serious note on the

deplorable condition of the Doyang bridge that connects Wokha-Merapani and demanded that the authorities take up early repair/ construction of the bridge. Kikon, along with deputy commissioner (DC) Wokha, Wezope Kenye, and Road & Bridges (R&B) officials met AVCA Wokha members on Wednesday and deliberated on the issue.

Union said that the decision to call off bandh was taken following an assurance from executive engineer to repair road from Sümi Settsü to Akuluto Town within seven days and from Akuluto to Khitsakita within 21 days. The bandh was to be imposed along NH- 2 (from Izheto village to Doyang bridge V.K Town) and NH-702 (A) from Sumi Settsu Village to Zunhekuta Akuluto Town).

Banks to go ahead with nationwide strike on Aug 22 C H E N NA I , AU G 1 6 (IANS): United Forum of Bank Unions (UFBU) on Wednesday declared that their nationwide strike call for August 22 stands as the talks with the Indian Banks’ Association (IBA) in Mumbai have failed. The UFBU has given notice of a nationwide strike on August 22 to protest against reforms in the banking sector and other issues. “Since nothing positive emerged (at the talks) on the issues raised by us, our call for strike on August 22 stands,” C.H. Venkatachalam, general secretary, All India Bank Employees’ Association, told IANS. “The IBA requested to withdraw strike without any concrete solution to the demands. DIMAPUR: Parliamentary secretary of Land Resource Department & Excise, B.S. Nganlang Phom has formally inaugurated new office building of district project officer, Longleng on August 16. PHED to introduce water metering system in Kohima

DIMAPUR: With the concern of water supply to the consumers in the state capital kohima, the Public Health Engineering Department (PHED) accordingly will introduce water metering system phase-wise in the colonies. Er. Vikeduolie Mepfhuo, EE (U) Koihma, PHED informed that water supply distribution point at Old Ministers’ Hill near VIP guest house area would be converted to water metering system. In view of this, the water supply would be disrupted for a week from August 21. Hence the consumers are requested to clear their outstanding dues and report to the concerned junior engineer of the Ministers’ Hill section. They are to produce necessary receipt for conversion of their water supply lines with necessary payment. The department also requested the consumers to kindly bear the inconvenience.

CRBC would also take measures to prohibit use of alcohol and other intoxicating substances and discourage open declaration of support in favor of a particular candidate/political party in the name clan/ khel /ward/ community or village. It also urged and appealed administration and other law enforcing agent to firmly implement the election code of conduct for free, fair and peaceful election. CRBC would also co-ordinate with each other in all pertinent issues.

I M P H A L , Au g 1 6 : Manipur chief minister N Biren Singh Wednesday promised to construct houses of the four families within a week, after their houses were reduced to ashes in a communal clash in Thoubal district in December 2016. Singh made the assurance after family members aired their grievances, at the Hill Leaders’ Day and Meeyamgi Numit (People’s Day) at CM’s secretariat complex. “Hill Leader’s Day” and “Meeyamgi Numit” held respectively on the 10th and 15th of every month, but have been postponed to August 16 as the chief minister was out of station. Members of the four families are taking shelter at a market-shed at Mayang Imphal Bazar. Biren expressed sadness when he was informed about the sufferings faced by the victims.The govern-

ment would build new houses for these people within a week, he said adding that the government would also provide assistance under the Chief Minister’s Relief Fund and housing schemes under PMAY etc. He therefore directed the responsible DC to resolve the issue and rehabilitate the affected people as soon as possible. The chief minister also attended as many as around 350 complaints and personally met nearly 1500 people from 9 a.m. to 2.30 p.m., a statement from CMO said. Singh could not meet with the people on August 10 and 15 last due to the recent flash floods and his urgent engagements inside and outside the country. Later, Singh told media persons, that “today, I have received complaints on not taking proper action in some cases by the departments concerned despite my directives given in the earlier Hill Leaders’ Day and Meeyamgi Numit.”

Itanagar, Aug 16: Twenty one students and a school teacher sustained grievous injuries when the suspension bridge they were crossing collapsed in Arunachal Pradesh, an official said on Wednesday. “One patient is said to be in critical condition while the condition of all other victims have been reported to be stable and out of danger,” a government official said. The incident occurred on Tuesday at Jamupani in Desali circle under Lower Dibang Valley district when the students were on Phrabat Pheri. Chief Minister Pema Khandu directed the district administration to take up all possible measures to evacuate the injured teacher and students to Assam’s Dibrugarh for proper treatment. “11 critical patients – students accompanied by a doctor and officials from administration were airlifted by an Indian Air Force helicopter to Dibrugarh and are being treated at Aditya Hospital,” an official said. He said the remaining patients were evacuated by road to Dibrugarh for further treatment. Khandu has ordered for immediate release of relief to the victims and wished for their speedy recovery. New Delhi, AUG 16 (AGENCIES): Indian and Chinese officials were meeting at the border in Ladakh on Wednesday, a day after their troops were involved in a scuffle in the area. The clash near the Pangong Lake, which divides Indian and Chinese territory, was triggered by an incursion bid by Chinese troops that was foiled, sources said. The incident came at a time when the two neighbours are in a standoff thousands of miles away in the disputed Doklam plateau close to Sikkim on India’s northeastern border. Government sources said a “pre-scheduled border personnel meeting” was in progress in Ladakh’s Chushul area since Wednesday afternoon, adding the Pangong Lake incident was also on the agenda. The two sides were also discussing strengthening of existing mechanisms for maintaining border peace and tranquillity, the sources said. “This is not a subject on which the government normally makes a comment,” defence minister Arun Jaitley said.

New Delhi, AUG 16 (AGENCIES): The National Investigation Agency (NIA) told the Supreme Court on Wednesday that the alleged conversion and radicalisation of a Hindu woman and her marriage to a Muslim in Kerala is not an “isolated incident” and it has detected a “pattern” emerging in the State. The court promptly ordered the NIA to start an investigation even as the Kerala police readily obliged to bow out of the probe into the case. A Bench of Chief Justice of India J.S. Khehar and Justice D.Y. Chandrachud set up a committee led by the former Supreme Court judge, Justice R.V. Raveendran, to supervise the NIA probe and ensure it is fair. Additional Solicitor General Maninder Singh submitted that the case of conversion and marriage of the woman in question is “not an isolated case and we have come across another case with a similar pattern and involving the same people who are acting as instigators”. Inhuman neglect

t is unfortunate that politics has clouded the inhuman negligence by the UP government which has resulted in the deaths of 72 children in Gorakhpur hospital during the past weeks. The children, mostly infants could not be given the basic treatment for various ailments including encephalitis. The BJP chief minister Yogi Adityanath, who is the local MLA of Gorakhpur got his facts wrong when he initially said the deaths were due to encephalitis, precipitated by lack of hygiene. Adityanath promised to improve the situation through vigorous implementation of Swacch Bharat initiated by Prime Minister Narendra Modi. It was quite unbefitting and out of sync to hear the chief minister talk about Swacch Bharat and invoking the name of the prime minister. There is a time and a place for praises and sycophancy. However as per reports from various media sources, Acute Encephalitis Syndrome (AES) was not the main cause of deaths. It was reported that the lack of proper treatment and at times had acted as contributory factors. The other cause of deaths was blamed on lack of oxygen in the medical college hospital. It was reported that the wife of the principal was the main supplier of oxygen. The lack of oxygen was due to non-supply since the supplier was not paid pending bills. From January to August 13, 1208 cases of AES have been reported in UP, and of these 152 resulted in the death of the patient. However, as pointed out by doctors all the deaths were not due to AES. However government administrators believe that encephalitis—a long-time scourge in this part of the state—was the reason for the mounting death toll of children. Of the first 30 deaths that occurred on 10 and 11 August, only five were due to acute encephalitis syndrome or AES; one was due to hepatic encephalopathy, which is related to AES. The other deaths were of terminally ill newborns. In 2017 (till July), the total number of admissions to the paediatrics department was 3,878, of which 596 patients died. The figures for the neonatal intensive care unit (newborns) arouse even more concern—of the total 2,386 admissions, 931 died. Uttar Pradesh has the worst infant mortality rate in the country of 78 (per 1,000 live births) according to the National Family Health Survey- IV (201516). The national average is 41. The deaths in UP among infants and children has been largely due to utter neglect by the state health authorities. It was also reported in some media, that in a particular health centre, instead of a trained doctor a medical attendant was on duty. The media has alleged that most government doctors run private clinics nearby and so out of necessity, the hospital staff used to take care of the patients. The neglect of the state government cannot be denied since it had failed to ensure that medical doctors did their job, paid the oxygen supplier six months due and provided necessary life saving drugs to the hospitals. The BJP has always avoided and evaded responsibility whenever things that have gone wrong. Instead, the habit of the BJP is to blame the Congress for the problem. Such arguments cannot absolve the BJP of its responsibility of governance when it had promised better days and good governance.

ndependence celebrations bring to my mind the days I spent in hometown Sialkot City. After earning the law degree I was settling to be a lawyer, but partition upset my whole plans. 70 years of joy and pain

my parents that they could travel by the same train a day after. They were frank enough to admit that there was a plan to kill all passengers at the nearby Narowal Bridge. And this happened. The following day they came to our place and told my parents that they could travel. They said they have made it sure that their journey would be safe. Not only that they helped my ailing parents to cross the bridge on foot and bid goodbye at the border. I stayed back for a few days and took the other road route to Wagha. A brigadier who had been transferred to India came to my father before he left and asked if he could do anything. My father looked towards me and asked the brigadier to take me across the border. I travelled in the back of the jeep which was full of luggage. Sialkot is a little removed from the main road to Amritsar. But I was aghast to see the road was full of hundreds of people. One small stream was pouring into Pakistan and we, the bigger one,

travelling to Amritsar. One thing was sure and there was no going back. I could smell the stench of dead bodies. People would make way for the jeep. At one place and old Sikh with a flowing beard stopped us and begged to carry his grandson to the other side. I told him that I had just completed my study and I could not afford to bring up a child. He said it did not matter and requested me to leave him at a refugee Kuldip camp and he would catch up with him soon. I said no and even today his helpless face haunts me. At Sialkot one wealthy Muslim, Ghulam Qadar, opened one of his bungalows and told my father to occupy it as long as he felt that things were not safe in the city. That bungalow itself became a refugee camp and at one time we were about 100 people living there. Qadar would provide ration to all of us. Our milkman was very regular in his supply. When I crossed the border,

I had only a small bag with a pair of trousers and Rs. 120 which my mother had given. But I had BA (Hon) and LLB degrees and was confident that I would rebuild my life. However, I was worried about my father who would have to start all over again at Jalandhar. And he became very popular within a few days and patients would flock in from morning to evening. I travelled to Delhi where maternal Nayar aunt was living at Darya Ganj. Jamma Masjid was quite near and I would eat there because good non-vegetarian food available at cheap price. That is where I met someone who took me in the Urdu paper, Anjam, and that is how I began a career in journalism. The rest is history. But I do not want to dwell on it. Was partition necessary because one million people died on the two both sides? That bitterness still lingers. And they continue to live in hostility. India and Pakistan have

gone to war three times, in 1965, 1971 and 1999. Even today, the border bristles with enmity and armed soldiers who are always ready to trigger the guns. We have already celebrated the 70th Independence Day. But instead of having soft-borders, which I imagined, we have the barbed wires and patrolling all the time. The level of escalation on the long borders never subsides. The two countries are not on speaking terms. Foreign Minister Sushma Swaraj has said that there could be no talks with Islamabad when it encourages infiltrators. Pakistan says that they are not the stakeholders and had no control over the infiltrators’ movement. Thus the two neighbouring countries continue to be at a distance without any contact. Getting visa has become very difficult. Relatives and friends on both sides are the real sufferers. Pakistan wants the solution of Kashmir before any kind of relations. Kashmir itself is a long story because the

partition formula recognizes India and Pakistan. There is no provision to reopen and think about the independence of the valley which the people there want. In fact, they have taken to guns to achieve their goal. Only recently, I met some of them in Srinagar and found them to be adamant to make the valley an independent Islamic state. No amount of argument that this was not possible convinces them. I cannot imagine our parliament even entertaining a resolution to make Kashmir independent. Pakistan considers that it was the lifeline for it. Therefore, I do not see any solution even for the next 70 years, the period we have wasted in firing at each other. The first thing should be to withdraw the petition from the UN and assure Pakistan that India wanted peace and good relations with Islamabad. Maybe, the media heads on both sides should sit across the table and make some concrete proposals, if that is possible.

T

he present political imbroglio started from the 7th of July 2017 when majority of the misguided NPF Legislators initiated their impractical motion demanding the resignation of the Chief Minister Dr. Shurhozelie Liezietsu from Kaziranga through the Governor’s Office. When it is within the ambit of a political party, no matter how big the number of legislators may be, it becomes immaterial unless the matter is brought to the notice of the party forum for deliberation and resolution. Summing up all these facts, the question of moving for NO CONFIDENCE MOTION in the Assembly becomes unconstitutional and unattainable like the 2015 crisis when Kaito Aye, who could not achieve his goal in spite of majority NPF MLAs supporting him. The Governor, in his haste to accomplish his clandestine hidden agenda, agreed upon with TR Zeliang and Rio to destabilize and dismantle the strong fabric of the NPF Party Government, has infringed upon the Constitution of India. He had the nerve to summon Assembly even on Wednesday which is a traditional holiday for Assembly or Parliament, and also when the duly constituted Council of Ministers headed by the Chief Minister did not recommend summoning of the Assembly. In his hasty pursuit to install an unconstitutional Government, the Governor had on 19th July 2017 dismissed the constitutionally-elected Government headed by Dr Shurhozelie, and invited an expelled individual in the person of TR Zeliang to form the most undemocratic government as Chief Minister in the state of Nagaland. Taking everyone by surprise, TR Zeliang who was expelled from the NPF Party at the time of his Oath Taking, became the Chief Minister of Nagaland without letter of support from the party he belonged to, and also, without the letter of support from the legislature party. No meeting of the NPF Legislature party was held and such a meeting can only be called by the Leader of the Legislature Party which was no other than Dr. Shurhozelie who continued to be leader of the house in the NPF-led DAN government and had the authority to summon the Legislature Party meeting of the NPF by virtue of being

the sitting Chief Minister till the 19th of July 2017.The Legislature party meeting can only be called on the approval of the leader of the house, but all these democratic practices were not adhered to. TR Zeliang, claiming to be the leader of the Legislature party under Para 3 and 4 of the Tenth Schedule as per the Rules of the Members of Nagaland Legislative Assembly (Disqualification on ground of defection) Rules 3, which mentions about the duties of leader of Legislature party. However, he cannot take the shelter of this Rule 3 Provisions because Paragraph 3 of the Tenth Schedule of the Constitution of India which talks about split by one third of legislators in a party has been omitted by the 91st Amendment of the Constitution of India. Para 4 of the Tenth Schedule talks about disqualification on ground of defection not to apply in case of merger. In this case also, he cannot take the shelter of Rules 3 of the Members of the Nagaland Legislative Assembly (Disqualification on ground of defection)Rules 2003 because no merger had taken place. Considering all these facts, there is no constitutional or legal provision for TR Zeliang government to continue. The argument put up by TR Zeliang and his Council of Ministers , Advisors and Parliamentary Secretaries that though the Constitution and the law is with DR. Shurhozelie, legal battles would however drag on till they complete the remaining period of the 12th House, is a blatant mockery to the Constitution of India. Governor P B Acharya, as the Guardian of the Constitution of India, allowing the unconstitutional govt. of TR Zeliang in the state of Nagaland is shocking, to say the least. In other words, it would mean that the Constitution of India does not apply to the state of Nagaland! The Governor, by allowing an unconstitutional and undemocratic government to function, is legalizing corruption in its highest degree and the Governor has no moral right to talk about corruption or call upon the Naga insurgents to give up their political struggle to join the national mainstream of India. Saying that they have enough numbers to run the government is quite contrary to the provisions of the Constitution of India and the Tenth Schedule. In

2007, Tokheho Yepthomi, who happened to be an NPF legislator having defected from the Congress, had the support of 36 MLAs comprising of 13 NPF, 17 Congress ,3 Independent MLAs, 2 JDU and 1 BJP. But even with these numbers, he could not become the Chief Minister of Nagaland in spite of the majority MLAs he commanded in the house of 60.The UPA government at the centre realized that this was not in tune with the constitutional provision of India and thereafter President Rule was imposed in the state of Nagaland in 2008. When TR Zeliang and coterie were lodged in Kaziranga, even the Governor lent his voice saying that the prevailing situation is not an intra-party issue, but all of a sudden, after the setting up of an unconstitutional government being installed at the behest of the Governor, they altered their statement altogether to the extent saying now that it has become an intra-party issue. The Speaker of Nagaland, being the brother in law of TR Zeliang has misused the highest office and had placed the family relation interest above the citizens of the state. The unconstitutional government cannot discharge the duties and responsibilities enshrined in the Constitution of India because it is an insult to the Naga intellectuals and had posed to be the most shameful treason to be committed in a country like India which is the biggest democracy in the world. The election of Neiphiu Rio as interim President of NPF by NPF Legislature Party is another unconstitutional evidence to legitimize the unconstitutional government. Two wrongs cannot make a right and the issue is not between Dr. Shurhozelie or TR Zeliang’s government, or between Dr. Shurhozelie’s Presidentship or Neiphiu’s interim Presidentship in the Naga People’s Front. But the issue now is whether the government of the day is constitutional or unconstitutional. It is for the citizens of Nagaland to judge. For NPF, the rights of the citizens of Nagaland to be governed as per law and constitution of the country shall remain as our top priority responsibility. (From previous issue....) It was Dr. Shurhozelie himself who expressed his desire to work together and they know what transpired in course of the discussion. Whatever was discussed in those two meetings were reneged by Dr. Shurhozelie and Shri KG Kenye as they went back on their word and forced Shri TR Zeliang to do everything according to their own wishes as usual. On both occasions, the erstwhile Congress MLAs never approached the NPF leaders to join hands and hence the question of being frustrated does not arise in any manner whatsoever. The Media and Press Bureau (M&PB) of Dr Shurhozelie mentioned about a cabinet meeting held on 31st January, 2017. Indeed, a Cabinet meeting was held at 11 a.m. at the residential office of the Hon’ble Chief Minister where it was decided not to hold elections in those places where there was problem while elections were given the go-ahead in places which did not have any problem or opposition. This was especially in Eastern Naga areas and only after 1 p.m. the meeting concluded. Then around 3 p.m., an emergency Cabinet meeting was again called to review the decision taken earlier. I along with other Cabinet colleagues shared the view that whatever collective decisions the Cabinet takes, such decisions should be prompt and that we should stick to it instead of reviewing them again and again. It was Dr Shurhozelie who submitted in written to the Hon’ble Chief Minister to hold the ULB elections and he also attended one of the Cabinet meetings and strongly suggested to conduct the civic polls. That was how it was decided that ULB elections would be held. The M&PB should come out clearly as to when I approached to take over the leadership. I have never expected to replace Shri TR Zeliang or anyone for that matter. The meeting that took place at my official residence on February 16th, 2017 was the arrangement of Shri KG Kenye, Hon’ble MP Rajya Sabha and Shri Kiyanilie Peseyie who was the then Minister for Parliamentary Affairs. Whatever papers were signed by 42 MLAs in that meeting were taken away by Shri KG Kenye. Dr Shurhozelie staked claim to form the Government and that paper

containing the signatures was annexed and submitted to Raj Bhavan at 4 p.m. on 18/02/2017 by Shri KG Kenye and Shri Kruzakie, PS to Dr Shurhozelie. I do not deny that I have never contested from the NPF party and for the last 5 terms I was elected only from the INC party. The difference between Dr. Shurhozelie and Shri Neiphiu Rio is only because Shri Neiphiu Rio did not give his blessings to Dr Shurhozelie while leaving for Delhi as an MP. All said and done and without any prejudice, the Rajya Sabha MP should have been from Mokokchung District but it was Dr. Shurhozelie’s decision to have Shri KG Kenye elected to the Rajya Sabha. When I was not included in Dr Shurhozelie’s Ministry, he blamed Shri TR Zeliang and offered me Chairmanship with Cabinet status but I declined. Again, on the 8th of July, 2017 after majority of the MLAs moved for change of leadership, Dr Shurhozelie sent two of his men asking me to meet him at Kohima. He contacted me through telephone around 11 a.m. the same day and again asked me to meet him at Kohima while continuing to blame Shri TR Zeliang. On 20th February 2017 after he was elected to be the Chief Minister, Dr Shurhozelie said that as far as possible, he will maintain status quo in Government formation and therefore he need not blame or shift responsibility to others for his own acts of omission or commission. Some of the party workers who could not even get elected to Town Councils are rebuking the legitimate elected Members of the Nagaland Legislative Assembly without understanding their own position and credibility. Political parties are formed to have elected MLAs and MPs to form the Government and not only to maintain the party. I am amused to see that Dr. Shurhozelie’s group wants to remain on the side without MLAs. Therefore, I appeal to the rank and file of the party to understand the ground realities and join the Government under the leadership of Shri TR Zeliang, Hon’ble Chief Minister and Shri Neiphiu Rio, Hon’ble MP Lok Sabha and Interim President, NPF. SC panel to assess 241 cases of 1984 anti-Sikh riots

New Delhi, Aug 16 (AGENCIES): The Supreme Court on Wednesday said it would appoint a supervisory committee comprising two of its former judges to vet if the investigation into 241 antiSikh riots cases was properly conducted before they were closed by a Special Investigation Team (SIT).

The Supreme Court was informed in March that 199 cases were closed as the trial had gone cold and investigation was on in another 59 cases. Appearing before a Bench led by Justice Dipak Misra, Additional Solicitor General Tushar Mehta submitted that 42 cases have been further closed

while charge sheets were filed in 12 and investigation was pending in five. To this, the Bench said it intended to appoint the committee to go through the records of the 241 cases closed and confirm that there is nothing more to do on them. The committee would report back to the court in three months, the Bench recorded. The names of the two judges would be finalised after consultations, it said. The case is scheduled for hearing on November 28. In March, the Bench decided to investigate the reasons that motivated the SIT to close such a large number of the riots cases. Senior advocate Arvind Datar, for the petitioners drawn from victims of the riots, submitted that none of the closure reports were filed in a court. In March, the court even pointed out that there was “some dispute” on whether closure reports were filed in any of the 199

cases. A total of 3,325 people were killed in the 1984 riots in which Delhi alone accounted for 2,733 deaths, while the rest occurred in Uttar Pradesh, Haryana, Madhya Pradesh, Maharashtra and other States. The SIT was set up on February 12, 2015, following a recommendation by the Home Ministryappointed Justice (retd) G.P. Mathur committee. It is headed by Pramod Asthana, an IPS officer of 1986 batch. It has Rakesh Kapoor, a retired district and sessions judge, and Kumar Gyanesh, an additional deputy commissioner of Delhi Police, as its members. The SIT had questioned Congress leader Sajjan Kumar thrice and asked him questions about the allegations that he instigated a mob in Janakpuri on November 1, 1984, which led to the killing of Sohan Singh and his son-in-law Avtar Singh.

There is, however, no Indian behind bars in strife-torn Syria — a country where government has warned citizens against travelling — and Palestine. The region hosts over 8 million Indians, who are mostly blue collar workers. The exact nature of crimes committed by them are mostly not revealed by the host governments to Indian missions unless they are as serious as murder, drug trafficking, financial fraud, adultery and prostitution, said officials. maintained by the UIDAI,” Chaudhary informed the Rajya Sabha. The Aadhaar numbers were deactivated for a number of reasons which are stated in Section 27 and 28 of Aadhaar (Enrolment and Update) Regulations, 2016. “Prior to enactment of the Aadhaar Act, 2016, the deactivation (suspension) of Aadhaar numbers was done as per the Aad-

haar Life Cycle Management (ALCM) guideline,” Chaudhary said. He added that regional offices of UIDAI have authority to deactivate the Aadhaar numbers. As per the provisions of Sections 27 and 28, a person’s Aadhaar can be cancelled or deactivated if multiple Aadhaars have been issued, or there are discrepancies in the biometric data or support-

ing documents. It may be noted that children who enroll before the age of 5 years should update their biometrics once after attaining the age of 5 years and then again after turning 15 years of age. According to the global financial services major, both CPI (Consumer Price Index) and WPI (Wholesale Price Index) inflation have troughed in June and are expected to rise further in the coming months. The wholesale inflation rose sharply to 1.88 per cent in July from 0.90 per cent in June 2017, mainly on account of turnaround in prices of food articles, especially vegetables. Retail inflation jumped to 2.36 per cent in the month, chiefly driven by hardening of prices of sugar and confectionery items, pan, tobacco and intoxicants. “We estimate August CPI and WPI inflation to rise further to 3.0 per cent and 2.1 per cent year-on-

(PTI): The government Wednesday capped prices of knee implants at a significantly lower rate than current market rates, a move that could result in savings of Rs 1,500 crore annually to patients requiring surgery. The decision comes a day after Prime Minister Narendra Modi announced from the ramparts of Red Fort in his IndependenceDay speech that prices of knee surgery would be brought down. As part of the initiative, the National Pharmaceutical Pricing Authority (NPPA) has capped the price of widely used Cromium Cobalt knee implants at Rs 54,720. It used to cost between Rs 1.58 lakh and Rs 2.5 lakh earlier. “After cardiac stents, we have now decided to bring knee implants under price control,” Chemicals and Fertilisers Minister Ananth Kumar told reporters here.

NEW DELHI, Aug 16 (PTI): The government has banned exports of gold jewellery, medallions and other articles above 22carat purity in a bid to check round tripping of the precious metal. In a notification, the Directorate General of Foreign Trade (DGFT) has said certain provisions of the foreign trade policy (2015-20) are “amended to allow export of gold jewellery (plain or studded) and articles containing gold of 8 carats and above up to a maximum limit of 22 carats only from domestic tariff area and export-oriented units, electronics hardware technology parks, software technology parks and bio technology parks”. This means that export of gold jewellery, medallions and other articles of the precious metal above 22 carat purity is not permitted by any exporter, including from these parks, which are meant for sectorspecific shipments.

But the Australian Transport Safety Bureau cautioned that the drift analysis by Australian science agency CSIRO is based on French satellite images of

“probably man-made” floating objects without evidence that they were from Malaysia Airlines Flight 370. But the locations could provide potential starting points to search within a 25,000-square-kilometre (9,700-square-mile) expanse identified by a panel of experts in November as the most likely resting place of the Boeing 777 and the 239 passengers and crew on board.

That expanse adjoins the original search zone far southwest of Australia that was identified through satellite analysis of the final hours of the flight that apparently ended when the plane ran out of fuel. Malaysia, China and Australia agreed to suspend the deep-sea sonar search in January after 120,000 square kilometres (46,000 square miles) of seabed were combed without finding any trace of Flight 370. The new analysis is based on French military satellite images gathered on March 23, 2014, two weeks after Flight 370 mysteriously veered far off course during a flight by Kuala Lumpur, Malaysia, to Beijing and were taken near the original underwater search zone. The Australian bureau took over the search for Flight 370 from Malaysia a week later. Satellite experts at Geoscience Australia were not asked to analyse the images until March this year.

Basel, Aug 16 (IANS): India tennis star Leander Paes and his German partner Alexander Zverev bowed out of the Cincinnati Open, losing their men’s doubles first round match here on Wednesday. The Indo-German pair was outplayed by the Spanish duo of Feliciano Lopez and Marc Lopez 6-2 6(2)-7 6-10 at Court 11 here. The Spanish pair will now take on fourth seeded American twins Bob and Mike Bryan in the second round. “I know him (Paes) quite well. He’s a good guy. Unfortunately we lost today but it was fun playing with him,” Zverev was quoted as saying by the Association of Tennis Professionals’ official website. Zverev said that the doubles games will improve his play in the singles matches. “The serve and return helps. You get used to the conditions a little bit more, the match conditions. That’s very good. Obviously the volleys improve,” Zverev added.

RFYS to transform India into multi-sport nation

NEW DELHI, Aug 16 (Agencies): The second edition of the Reliance Foundation Youth Sports’ national football competition kicked off on Wednesday in Kochi, with its chairperson Nita Ambani committing to transform India into a multi-sport nation in the near future. Ambani, a member of the International Olympic Committee, seeks to build a grassroots sports eco-system in the country that will not only encourage kids and youngsters to take up sport but will also provide every child a platform to nurture his or her talent.

Cheered on by hundreds of school kids at the Rajagiri Public School in Kochi, Ambani launched the second season along with India striker and Kerala Blasters star CK Vineeth. The championship will be played in 30 cities across the country. “Reliance Foundation Youth Sports has been conceived to reignite sports in schools and colleges,” Ambani said, just before the inaugural match between Rajagiri Public School and Assisi Vidya Niketan. “We are aiming to create a unified sports structure through RFYS and

have a holistic plan for all major Olympic sports. We would like to provide a viable sports career opportunities for the youth of our country,” she added. The RFYS football tournament is set to become the biggest grassroots effort in the country, with over 3,000 educational institutes and more than 60,000 children preparing to compete over the next five months. The championship which was held in the eight ISL cities in the inaugural year will see the participation from Bengaluru, Ahmedabad, Shillong, Aiz-

Excel Six FC finished in second position. The winners and runners-up received cash prizes of Rs. 15,000 and Rs. 8000 respectively. Third and fourth

Naga coach led women boxing team win medals

DIMAPUR, AUG 16 (NPN): Boxing coach from Nagaland, Tsungchetrenla Tzudir, who lead the youth India women’ boxing team along with three other coaches, returned with ten medals in the 6th golden glove boxing tournament of Vojvodina, Serbia. The tournament was held from August 8 to 14. Ts u n g c h e t r e n l a Tzudir as team coach along with three other coachesBhaskar Bhatt , Raffael Bargamosco and Virender Sukla led the team. The team won two gold, four silver and four bronze. In the tournament,

two pugilists- Vanlalhriatpuii was awarded best technical boxer and Jyoti awarded best fighter. Prior to the tournament, the team underwent three months intensive coaching camp at Bhopal and also training-cumcompetition at Kazaksthan. The team is preparing for the coming world championship which is going to be held at Guwahati, Assam in the month of November 2017. sports Pakistan batsman dies after being struck by bouncer New Delhi, Aug 16 (Agencies): Cricket was struck by another tragic incident when a young Pakistan batsman Zubair Ahmed died after being struck by a bouncer during a game in Mardan. The Pakistan Cricket Board (PCB) took to micro-blogging site Twitter to break the news. “Tragic death of Zubair Ahmed is another reminder that safety gear i.e. helmet must be worn at all times. Our sympathies with Zubair’s family,” the tweet read. The incident happened on August 14, Pakistan’s Independence Day. Zubair featured in four List A matches and represented the T20 team Quetta Bears. Earlier in the day, Australian vice-captain David Warner retired hurt after being hit in the neck by a bouncer during a warm-up match ahead of the upcoming Bangladesh tour. A focus on player safety has been heightened since the tragic death of Australian batsman Phillip Hughes in 2014.

Kohima, Aug 16 (NPN): Ziekezou FC and Addax FC won their respective matches in the ongoing Kohima Football League (KFL) organized by Kohima Town Club (KTC) at Kohima local ground on Wednesday. standard. He said coaches from BBFS, New Delhi would monitor the centre at Tura and would provide right platform to ensure that they reap the benefit from the coaching centre. “North East has lot of talents in football and they just need a right environment and an opportunity to excel,” Bhutia said

“Clubs like Aizawl FC and Shillong Lajong FC has demonstrated that North East has huge football talents. We should continue with the spirit to dominate in the Indian football and ensure that all the Northeastern states gets adequate attention and an environment for promotion of football talents”, the former Indian skipper said.
