Government plans new green rebate scheme The Federal Government has vowed to introduce new rebates for ceiling insulation and solar hot water systems within months, after suddenly scrapping its previous program in the wake of allegations of rorts and poor safety standards. Environment Minister Peter Garrett has announced that the government’s home insulation program and solar hot water rebate were being immediately discontinued. Garrett says the new scheme will provide: • rebates of $1000 for ceiling insulation; • rebates of $1000 for solar hot water systems; and • rebates of $600 for heat pump hot water systems. The new rebate scheme will cover hot water systems and heat pumps installed after February 19, when the previous scheme was scrapped, Garrett says. The insulation component of the new scheme will be in place by June 1. Instead of paying installers directly

for ceiling insulation, the new system will allow householders to claim a $1000 rebate directly through the Medicare system. A new registration scheme will require all insulation installers to re-register, pay a cash bond, show evidence they’ve met the training and skills requirements of the program, and provide certified quality assurance and occupational health and safety plans. The government has also put in place transitional arrangements to cover the closure of its previous programs. Under the previous home insulation program, the government made payments to installers. Insulation installers have been told they’re entitled to claim for work completed up until February 19.

The Environment Department says eligible solar or heat pump hot water systems purchased or installed prior to February 20, 2010 “may be eligible for a $1600 rebate for solar hot water or $1000 for heat pumps, if proof of purchase or installation prior to February 20, 2010 is included with the application”. “Applicants who ordered or made partial payment for their solar or heat pump hot water systems but had not had their system installed prior to February 20, 2010 must include written evidence of their order with their rebate application,” the department adds. “A receipt for a deposit or a copy of their supplier’s order form is required. A quote is not sufficient evidence of an order. “In all cases final decisions regarding rebate eligibility will be made by the government.”

Let there be low-energy light! The federal government’s phase-out of standard incandescent light globes has already begun.

Since November last year, Australian shops have only been allowed to sell their pre-existing stock. But we don’t need to be scared of the dark — there are eco-friendly options to brighten our homes and save us money. There are two main kinds of low-energy lighting technology: fluorescent lamps — both old-style tubes and newer compact fluoros (CFLs) — and light emitting diodes (LEDs). David Baggs, technical director of Ecospecifier says that to get the right light, you should consider both colour and brightness. “To get a light that has the warmth we’re comfortable with, ask for ‘warm white’ CFLs or LEDs,” Mr Baggs says.

Then, to be sure your lowenergy globe will shine brightly enough, compare the power of the light (measured in ‘lumens’) against similar incandescent bulbs.

They’re often used in clusters as a substitute for general illumination. “You don’t need downlights over a dining room,” Mr Knox says. “Try a pendant light fitting with a CFL instead.”

“Any good lighting shop or online retailer will have that information,” he says.

If you want to keep your downlights but cut their energy consumption, the simple option is to install high-efficiency halogens, which cost about $10 each. LED downlights will set you back a hefty $30 to $60 each, but they have an elephantine lifespan.

Your home needs two types of lighting: general lighting for all-over illumination and task lighting for specific areas. Good-quality household CFLs last up to eight times longer than incandescents and cost between $5 and $15. Dimmable versions cost about $30 each. CFLs are widely available in spiral and stick shapes, but you can search online to track down more exotic versions. Halogen downlights are the most energy-draining task lighting in Australian homes.

LEDs aren’t yet as bright as halogens, so they’re best suited to lounge areas, hallways or toilets, and can be bought with a driver that makes them dimmable. For best results, you may need to replace the transformer (an extra $25). CFLs are also available as downlights ($10 to $15 each), but you’ll need an electrician to replace the fitting.

QCAT - The New Tenancy Tribunal in Queensland QCAT replaced the former Small Claims Tribunal on December 1 2009. Whilst the principles of the former Small Claims Tribunal remain similar, there are a number of significant changes. Tenancy disputes that have exhausted self resolution methods such as disputes regarding bonds, terminating tenancies due to rent arrears or monies owing above the bond can be heard in QCAT. QCAT will make a legally enforceable decision based upon the evidence of the parties and what is fair and equitable (this is stated in the QCAT Act). QCAT has a President (Supreme Court Judge) and a Deputy President (District Court Judge) who are judicial members that oversee the Tribunal. The introduction of QCAT saw 23 former tribunals in Queensland, amalgamate into one Tribunal and is the most significant change to the Queensland Judicial System in over 50 years. • QCAT now hears matters (tenancy applications) up to $25 0000 (used to be $7500). • An adjudicator (lawyer who has been appointed by the president of QCAT) may hear the claim and be empowered to make a decision. This will be most common in South East Queensland. Regardless of who hears the application, the QCAT laws have to be adhered to. • All hearings are recorded and copies of transcripts can be requested (for a fee). • Applications must be filed at the registry of the Tribunal closest to the property OR the registry of the Tribunal in Brisbane. All magistrates’ courts in Queensland

(except Brisbane Magistrates Courts) are now open to receiving and hearing QCAT applications. • Adjudicators and magistrates MUST provide reasons for their decisions, either orally or in writing. It is thought that the majority will provide oral reasons. In saying that, transcripts of the reasons given orally can be ordered at no cost by request of the parties. The decision will advise how the transcripts can be ordered. • Appeals can be requested; on the basis of a question of law or a question of fact (or a mix of both). There is a fee for making an appeal request. Currently the fees are $250 for up to $10000 and $500 for over $10000. If the appeal request is not granted, the fee paid is not reimbursed. To make applications to tribunal there are fees payable by the applicant. For monies owing up to $500 or no amount claimed - $201. • For more than $500 but no more than $1000 – the fee is $502. • More than $1000 but no more than $10 000 - the fee is $903. • For monies over $10 000 – the fee is $2504.

Some procedures are the same as they were under the former Small Claims Model; namely there are two types of QCAT applications, Urgent and Non Urgent Applications. Urgent and Non Urgent applications are defined legally in the RTRA Act. Urgent does not mean urgent in the normal sense of the word. Urgent in brief indicates that the matter can be taken straight to Tribunal without the need for dispute resolution through the Residential Tenancies Authority (RTA). Whilst the main difference for non urgent applications is that for a non urgent matter to be heard, it must have evidence that conciliation through the RTA has been attempted and was not resolved. Healthy start to 2010 for housing market AUSTRALIAN house prices have made a strong start this year, defying the threat of rising interest rates. Melbourne and Adelaide led the way, recording January increases of up to 4.3%, The Australian reported. Nationally, house prices grew 1.8% during the first month of the year, translating to an 11.8% jump over the past 12 months, according to residential researcher RP DataRismark’s home value index. In Sydney, values increased 1.7% to a median price of $494,500, Melbourne rose 4.3% to $455,000, Brisbane 1.8% to $440,000, Adelaide 3.2% to $379,600, while Perth prices fell 0.6% to $472,500. Prices continued rising despite Reserve Bank rate rises in October, November and

December, and additional increases from the banks that, combined, have lifted the average mortgage rate from 5.8% to 6.65%. The latest figures come ahead of next week’s Reserve Bank board meeting, with economists expecting interest rates to increase up to one percentage point this year. RP Data noted price rises in December were lower, suggesting the pace of price growth was easing. However, RP Data’s head of research, Tim Lawless, said there was confidence in the housing market. “Buyers are for the time being outweighing sellers and new supply is being quickly consumed,” Mr Lawless said. “Auction volumes are higher than

at the same time last year and the national weighted clearance rate last week was a very healthy 73%.” Rising house prices have pushed down the return for investors, with the gross rental yield for houses nationally falling from 4.7% in January last year to 4.2% this year. The rental yield for apartments dropped from 5.3% to 4.9%. “With rental demand likely to be higher during 2010 due to continuing strong migration and fewer first-home buyers, we anticipate that rents, and consequently yields, will improve over the year,” Mr Lawless said.

Have You Heard Of The New Sustainability Declaration? adjustments to properties In Queensland it is now compulsory for property owners to fill out a Sustainability Declaration to be provided to prospective home buyers looking to purchase their property. Any property that is being marketed (on the market) from 1 January 2010 must have this form filled out by the owner ready for sale, even if the property was actually listed prior to that date. The form must be presented to potential buyers on their request and if a home is open for display or for auction then it must be presented at that time.

The purpose of it is to make buyers aware of sustainability living and to encourage them to consider this when purchasing, but of course this will have a roll on effect too as it becomes more popular with buyers specifically looking for homes with high sustainability levels. The key areas being addressed are water and energy. The form can be downloaded from the Department of Infrastructure and Planning and there is information on this site to help you fill it out if you have difficulties. This most certainly is a step by governments to encourage owners to use eco-friendly

when doing renovations. • Think about to maximising light – do you need to put in a sky light or a window to give better light and ventilation? • Do you need to create a better air flow to save on air-conditioning? • Are the windows and doors large enough to allow a good air flow through the house? • What about putting in a rainwater tank? • Put in a low maintenance garden with drought resistant plants


BEAT FUTURE RATE RISES As consumer confidence continues to fall in the face of increasing concerns over future rate rises, Mike Gray from First National Real Estate Nerang advises home owners to plan now to avoid unnecessary stress and the potential of losing the family home. While the Reserve Bank has held interest rates for the time being, further rate rises in 2010 are inevitable, along with the strong possibility that living costs will also go up,” Mike said. “Which is why we are suggesting people take a good look at the household budget and start factoring in how they will meet these challenges in the coming year. “Even a 1 per cent increase in interest rates, which is expected by the end of 2010, will translate to extra repayments of $193 per

month on a $300,000 home loan, which may force many homeowners to default on their mortgages and lose much of the value they have built up in their homes. “But there are some simple steps we advise homeowners should consider when planning for these future interest rate rises.” Minimise the home loan balance. Pay off as much as you can over and above the minimum monthly repayments. There are a number of ways this can be done, including making fortnightly rather than monthly repayments; putting any additional cash into the mortgage (e.g. live off the amount of last year’s wages and put any wage increases into the home loan), chart spending and expenses and any surplus achieved as a result should go into the mortgage.

Consider refinancing. There are often better deals to be found in a competitive market and even a small reduction in the home loan rate can significantly reduce the mortgage over the long term. Even if you do not refinance, make sure the valuation on your home is up to date and reflects recent price increases. Prepare a budget. Draw up a budget, clearly outlining all your expenses and spending and factor in rates 2 per cent above the actual current level. Consolidate Debt. Put all debts under the one umbrella – the housing loan. Home loan rates are often much lower than those of credit cards or car and personal loans. “Your home is not just your major asset, it is also where you live, so it is important that it does not cause you stress,” Mike said.

Sales are expected to rise as Generation X’ers continue to be lured to the state given the attractiveness of the Queensland market, particularly the Gold Coast and Tweed region. Hot spots for the state are expected to be anywhere on the Gold Coast and Tweed, along with South-East Queensland, with predictions of up to 18,000 homes needing to be built in new residential estates each year for the next two decades to meet forecast demand.
