EWS that the government has formally approved plans to introduce an opt-out system for organ donation, giving the green light to Minister Harris to start drafting legislation is set to generate much discussion over this serious issue over the coming months. The major change, outlined in the Human Tissues Bill, providing people with the opportunity to opt out rather than opt in is expected to result in an increase in the general level of organs available in an environment where the country’s hospitals have been reporting a serious lack of donors. According to Minister Simon Harris: “Organ donation is among the most selfless acts we can bestow upon another person. An opt-out system and accompanying publicity campaign will raise awareness among individuals and encourage discussion among families of their intentions...” The current “opt-in” system gives people the opportunity to volunteer their organs through the use of a donor card, or for their families to grant permission after their death. The new proposals would mean that a person’s organs would be automatically harvested unless they specifically requested not to allow this. In practice, the new rules mean a person would have to sign a register to state that they do not want their organs removed once they pass. If they do not, their consent will be taken as given. However, their next of kin will still ultimately have the power to refuse the removal of the organs. North-West Express spoke to a man who feels so lucky that he was a recipient of a kidney a few years ago – a development which has transformed his life. While he encourages more people to donate organs he has reservations about the new proposals as they stand. He fears additional, unnecessary pressures could be placed on relatives of the deceased at a sensitive time under the proposed new legislation, particularly if appropriate organisational structures are not put in place to introduce the new system. The matter is bound to generate some debate and even controversy and it is hoped major consideration will be given to the Madden Report (2006) on post-mortem practices before the legislation is finalised.
