I would like to present my Installation speech to those of you who missed a wonderful, exciting evening on Saturday, January 12, 2008, at the Gaylord Palms Resort: INSTALLATION SPEECH 2008 President Osceola County Association of REALTORS® Good evening. It is an honor and a privilege to stand before you, my family, friends, colleagues, community leaders, business partners, and many leaders in the real estate industry, as your 2008 President of the Osceola County Association of REALTORS®. I remember six years ago, the first day that I walked through the doors of this Association. I was very eager to participate and to get the most benefit for my career from the Association. With many of you in this room that I have mentored throughout those years, that is what has brought me to this podium tonight. One of the first REALTORS® that I met was Mike Levine. From Mike I learned that the most important part of our business is professionalism. Thank you, Mike. That is how I modeled my business and how I have led and will continue to lead our Association. Another REALTOR® shared with me the importance of RPAC (REALTORS® Political Action Committee), and how hugely it affects the decisions that are made in our industry. Thank you, Linda Goodwin. I have been a Golden R member of RPAC and will continue to heavily support it and get the word out to our members of its importance. I remember one time bumping into Rajia Ackley in the parking lot of the Association and she shared with me a story about how important it is to always be positive when you are growing a company and leading others. Thank you, Rajia. To this day, my positive attitude is what has helped me through many adverse situations. One of my very first deals was with Jeff Perry. Jeff always returned my phone calls, acted in a very professional manner, was eager to help a new REALTOR® close a transaction without making me feel like I was in fact a new REALTOR®. Thank you, Jeff. When I was looking for an office for Prudential Sapphire Realty, I called a REALTOR® to help me find the perfect location to start our real estate company. After opening, that REALTOR® has continued to be a good friend, a great advisor, and a tremendous leader, not just in the Association, but in the community. Thank you, Cheryl

Grieb, our office has become a wonderful home for our company. When I started our company, I thought I was creating for myself a 9-5 typical office job. Quickly, I learned that was not the case. Not just working long hours, but my passion for real estate issues and our Association has taken up many more hours than I could have imagined. You could not accomplish what I have without having a husband like mine. Gene, I appreciate you allowing me to be me and continuing to support me no matter what, you are the rock of our family. My two children, Brandon and Kurtis, who have always had to share me with so many others, thank you for your selflessness. You two are the reason that I have worked so hard to be successful. Twenty-two years ago, when I needed an attorney, I walked in to the law offices of Randy Hillman. I never knew that day that I would be gaining a lifetime friend. Throughout the years, Randy has counseled our family, advised me personally in many business decisions that I have had to make, and I am proud to say that he is my business partner, but most of all, I am proud to have him as my friend. Randy, you are near and dear to my heart, and it has been a privilege and a pleasure to know you and grow our company together. It would be very hard to be the President of a 2,914, member REALTOR® Association if I did not have such a tremendous strong partner at our office. Thank you for always making me look good. When a young and impressionable high school student came into my office to mentor me two years ago, two years later I find myself mentoring her. No longer is she a teenager, but is now a college student and business professional, whom on a regular basis makes our company look great. Carly, thank you for your hard work, your friendship, and motivation. It is a pleasure to work with you and an honor to know you. I remember when Randy and I started our company. He and I sat in our building alone, and today we have 48 business partners whom are all REALTORS®. All of you are our company. I want to thank each one of you for your undying support for anything that I do, but especially for your support in my presidency this year. Cyn, from you I learned how important it is to always do what is best for the membership, even when it is not popular. I will bring this quality to my presidency. The next president that I served under is Jack Frey. I served under Jack as his President-Elect. From you Jack, I will bring to this presidency patience. Jack, I wanted to take this time to thank you and tell you what a pleasure 2007 was to me, and to ask you to not go very far because I will be looking to you for your wisdom. To all the past presidents, committee chairs and vice chairs, and REALTOR® members that have helped me along the way, and made our Association what it is today, thank you. To David Bennett, and the staff at the Association, we could not be here tonight if it wasn’t for all of your hard work. Thank you all so much. And most of all, the 2008 leadership team, thank you for your vision and support in this upcoming year. You are an enthusiastic team, and I believe we will really be able to make a difference in improving the real estate market using the tremendous strengths that you all have. One of the most important goals that our leadership has for 2008 is to improve our services and relationships with our affiliate members. With today’s current market conditions, every single member must support each other. I encourage all REALTORS® to use the services of our affiliate members, who continue to support us, year after year, event after event, no matter what the condition of the market is. We want to get the word out that our affiliates make a difference in our community, and in our Association. When David Bennett told me that I would need to raise the money for the installation, I began making phone calls to our affiliate members, and they stepped up to the plate and sponsored this event. To all of the affiliates in the room, I want to thank you for your continuous support to REALTORS®. You have enriched our Association and our businesses. Will you all please stand by your chair, and will you all give these affiliates a big round of applause.

I am feeling really good about being your president in 2008. At a time where interest rates are low, prices of homes are reasonable, and we have a great inventory to choose from. In the past several weeks our phones have been ringing more significantly in our company then in the previous months, and I have gotten the same feedback from many of you. It is a great time to buy real estate, and it is our duty as REALTORS® to educate the consumer. I went to David Bennett and asked if we can start an “It’s A Great Time To Buy” campaign to the consumer. One of David’s concerns was that how could our budget allow us to battle so much negative media. My answer to that is we must enlist all of the members of our Association to partner with us in this campaign. The Association this year will do its part and we will advertise to the public that it is a great time to buy real estate. I am asking all the brokers, that whatever their advertising budget may be, that they have a place for a statistic or a one liner, letting the consumer know how great the market is. If we do this as a team, we will change the 2008 market. There are many affiliate members in the room tonight that work for banks or mortgage companies. I encourage you to go back to your employers and ask them that when they place an ad that they please mention how low interest rates are, and what a great time it is to buy real estate. I believe it is the Association’s duty to meet the members’ needs. Our members’ needs right now are to put more money in their pockets. I intend, as well, in that campaign, to promote the advantages of using a REALTOR®. I want to create a situation that no one would think about doing a real estate transaction without using a REALTOR®. A consumer would not think to have open heart surgery without obtaining an open heart surgeon. A consumer would not think about appearing in court without using the services of an attorney. I want the consumer to not think about buying or selling a home without using a REALTOR®. I commit to you that this will be my focus this year. In our Association, we currently have 2,778 REALTOR® members, and 136 affiliate members, totaling 2914 members. What is a stronger lobbying organization than the Osceola County Association of REALTORS® in Osceola County? Power comes in numbers, and I want our Association to be a force. Our city and county is in great hands with some of the finest leaders that I have ever seen, but I want these leaders to know that REALTORS® care about the issues that affect our homeowners in our great county. So this year under our public policy committee, I have Randy Hillman, who has agreed to be our Liaison of the City of Kissimmee and our county of Osceola. every city and county commission meeting, and report to the Board of Directors what the issues are that are affecting our community and citizens. At your tables there are committee sign up sheets, and I encourage you to sign up and get involved, and this is a great area that we could use involvement in attending these meetings. Another goal of mine is to get more participation from membership, and to show members the value of our great Association. So I have created a new Welcome Task Force that Terri Carroll has agreed to lead, where every time a new member signs up they will be contacted by this task force, very similar to the welcome wagon idea. This task force will meet with the new member and share with them the products and services that we have to offer, and share positive experiences that they have personally had with our Association, as well as the volunteer opportunities and how it could help their personal real estate business. I want all of you to know that I am a consensus leader, and I know that this is your Association. Each one of you contributes to making our community and our Association a better place. I am looking forward to working with all of you this year, and don’t ever hesitate to call or send an email with any ideas, questions, or concerns. I want to thank Moe Veissi, a past president of the Florida Association of REALTORS®, and the future National Association of REALTORS® President. Sam Zell is the soon to be CEO of the Tribune Media Company. - Mr. Zell, himself a REALTOR® with decades of real estate development success, has accepted the challenge of redefining the relationship between real estate and newspapers. This at a time when the industry’s participation with classified advertising is at an all time low due to market levels and the rise of the Internet.

Kerry Killinger is the CEO of Washington Mutual, Inc. - Mr. Killinger may well be either the last CEO of this traditional big time mortgage factory or the first CEO of a new generation of mortgage service units. Either way he is in a key position to impact how American consumers finance homes moving forward.

Andrew Cuomo is the New York State Attorney General. - Over the past year he has brought an almost Law and Order like atmosphere to the current mortgage industry crisis. Mr. Cuomo seems to be of the mind that “someone” rather than something is to blame for the mortgage crisis and that “someone” ought to be punished. Starting with the appraisal community, Cuomo has expanded his investigation to include both private (large mortgage companies) and quasi public (Freddie Mac) entities in a search that will, in all likelihood, at some point include an examination of the REALTOR® role.

Lawrence Yun is the current NAR Chief Economist. - Mr. Yun is caught in a classic professional dilemma between the traditional role of the economist in a free enterprise environment and the role of an economist who is part of a trade association communications program. He alone may have the power to tame the current media assault on the industry. He may also have to account for the path taken by his predecessor.

2008: The Year of the Industry Outsider For most American real estate brokers the challenge of 2008 will be to maintain balance. On one end of the scale is their ongoing business operation. On the other end is the fast changing real estate industry environment as the market returns to a sustainable level of production, profitability and participation. This task will become increasingly difficult given the sheer number of external forces that are currently positioning themselves to impact some facet of the traditional real estate industry. Inman News recently provided an interesting perspective of this dynamic by identifying a group of individuals whose efforts will have a significant impact over the next year. Over and above their remarkable personal, professional, and power profiles these individuals are distinguished by the fact that none are real estate industry insiders. None, with the exception of Mr. Yun, represent traditional real estate brokerage players. All are positioned to move the industry in new directions. Who are these folks and how might they impact the real estate industry in mid 2009 and beyond? •

Errol Samuelson is the current President of REALTOR.com. - He and his technical expertise are at the helm when the very future of REALTOR.com is in question. Unfortunately the real challenge for REALTOR.com is probably not technical in nature but rather its inability to build an affinity relationship with the REALTOR® community sufficient to drive loyalty and patronage for its technology. Living with the ghosts of its Homestore origins it can’t seem to find a place in the REALTOR® business life. With the current national market downturn, the pressure’s building for a national MLS and growing Internet competition, 2008 may well be a REALTOR.com “make it or break it” year. This may be unfortunate given the fact that the REALTOR® community may not have another chance to realize its Internet potential. Sheila Bair is Chairwoman of the FDIC. - Her initial role will be to continue efforts to stem the rising flow of foreclosures through “work out” programs. However, ultimately she will play an even more powerful role by influencing the new laws, rules, and regulations under which the mortgage industry will operate moving forward. Her work will do much to address issues of affordability, consumer confidence and access to credit in the markets of 2009 and 2010.

Animosity between REALTORS® or buyers and sellers is a terrible situation to be in. Some REALTORS® have a BAD habit of creating bad feelings between the Buyer and Seller. This occurs when the REALTOR® does not have enough experience, training, knowledge, or selfconfidence to take control of the transaction. This is extremely unprofessional. Never talk badly about the Buyer or Seller that you are not representing. If this occurs and the Buyer and Seller get together and compare notes, then you ARE in trouble. If the other party is being, what you think is unreasonable, do not tell the party that you are representing that the other party is wrong, dumb, or unreasonable. BE PROFESSIONAL. In a transaction, there must be a win/win situation and if your party starts being belligerent and hard to deal with because of your demeaning the other party, then the possibility of killing the transaction arises. Never say anything that you can't prove or defend in court. Never....Never.

Kurt Pfotenhauer is the recently named CEO of the American Land Title Association. - He assumes power at a time when the title industry is under a tremendous amount of pressure to rehabilitate long standing business practices and industry relationships that many state regulators, consumer groups and even the GAO suggest are inappropriate and possibly illegal. The real estate market of 2009/2010 may see title services marketed under a whole new set of rules and relationships.
While the power position of any one of these players might be discounted, together they reflect the serious transition that is occurring within the practices and patterns of the traditional real estate business. Therein lies the message of this column and the only broker themes for 2008 that makes any sense: survival and surveillance. Over the next year brokers must not only concentrate on surviving the remaining months of the down market, but also focus on preparing their companies to conduct business and address competition in an environment that is far different from that which existed in November of 2005. ■

NAR CENTENNIAL 100 YEARS IN CELEBRATION OF THE AMERICAN DREAM This is the second in a series of articles each month that will document the history and formation of the National Association of REALTORS®, the largest trade association in the world. The National Association of Real Estate Exchanges was officially incorporated on July 2, 1908, making its first home in the offices of the Chicago Real Estate Board at 57 Dearborn Street. Edward Halsey was selected as the first executive secretary and given a stipend of $200 for the first four months to cover expenses and August H. Frederick of St. Louis was elected president. Halsey undertook a campaign to recruit new members. During his tenure as executive secretary, which ended in June 1909, he also worked on a list of goals that the Association might accomplish in the future, a list that included such ideas as the widespread use of an exclusive agency and making available a sign that could be displayed on members’ office walls showing their membership in the National Association. While those first meetings of 1908 and earlier focused on how to organize a national association to represent them, the annual conventions after 1908 marked the first time that real estate businessmen from around the country could gather to discuss topics of interest to their profession. Discussions of city planning, building restrictions, and subdivision layout dominated the first convention after the founding, held in Detroit in June 1909. Taxation was the major issue discussed in 1910, and uniform state property laws and model housing codes were on the minds of attendees of the 1911 convention. In a tradition that continues with the NAR’s annual meetings today, the early conventions allowed those involved in the real estate business to explore common issues and trends and identify areas where action was needed. By 1912 the National Association had begun in earnest to tackle the problems that faced the real estate profession. Under the leadership of Samuel Skidmore Thorpe, the Association’s president in 1911, the organization took steps to strengthen itself. In addition to educating members through annual meetings and the National Real Estate Journal, it began making its positions known to the nation’s lawmakers. Of more direct importance to individual real estate practitioners was the adoption of the Association’s Code of Ethics in 1913. In 1916 the Association changed its name to the National Association of Real Estate Boards. The year 1916 also saw the introduction of a new name for the Association’s individual members, the term REALTOR®. Coined by Charles Chadbourn, a past president of the Minneapolis Real Estate Board, the word quickly become a vital and enduring tool in conveying the benefits of membership in the Association to both real estate brokers and the general public. DID YOU KNOW…… The Three Way-Agreement - In April 2004, the National Association surpassed 1 million members for the first time in its history – and the growth spurt did not stop there. By early 2007 membership stood at more than 1.3 million. Home sales, the growing recognition of REALTORS® as real estate professionals and a concept known as the threeway agreement contributed to the astounding gain. The agreement gives state and local associations the right to use the term REALTORS® in their name. It also allows state and local associations to grant use of the terms REALTOR® and REALTOR®-Associate to individual members. In exchange, state and local associations agree to accept the charge of properly granting the membership terms and to subscribe to and uphold the Code of Ethics. Each local association also agrees to maintain membership in good standing in its state association. Put simply, through the three-way agreement, the National Association is part of a federation in which membership in one organization is tied to membership in all. ■

The GRI designation, epitomizes a level of distinction and knowledge in the real estate industry, demonstrates to clients that the agent has continued to enhance their knowledge and skills to better assist the client.
QUADRENNIAL CODE OF ETHICS TRAINING Must be completed by December 31, 2008. Between January 1, 2005, and December 31, 2008, every REALTOR® is required to complete 2 1/2 hours of Code of Ethics training. REALTORS® who have joined the Association after January 1, 2005, and attended Orientation, have already fulfilled their training requirements. All other members must complete their training by December 31, 2008, to continue their membership with NAR. Failure to complete the required periodic ethics training shall be considered a violation of a membership duty; for which, REALTOR® membership shall be suspended until such time as the required training has been completed.
OSCAR MEMBERS RECEIVE CRP DESIGNATION Three members of the Osceola County Association of REALTORS® have received the Certified Real Estate Professional (CRP) designation. This designation is designed for the real estate agent to better assist them by obtaining the knowledge they need to further their Real Estate careers. Membership News By Stephanie Escurra-Hendricks, Membership Services Let iMAPP Help With Your Mailing Labels So you’ve put together a stunning brochure and it’s time to get it out there. Why not let iMapp help you get it into the right hands? Among the many nifty tools that iMapp offers you is the ability to print out mailing labels directly from the iMapp interface or the results of a search. Here’s how to set-up your search to print address labels – that you can use over and over again. Start with a Search iMapp’s search utilities are incredibly flexible. You can search the MLS database and county tax records via multiple tools and interfaces. You might choose to search the tax records for owners of homes whose last sale was five or more years ago (because they’re most likely to be ready to move up), query for all addresses within a zip code or search with the map to find all homes that fit a specific criteria within a given area. Search the map: 1. Log-into MLXchange. 2. Click the Tax Search at the top. 3. Click the iMapp Tax Search at the top and Log into iMapp. 4. Go to Tax Search Tab. 5. Define your search criteria using the checkboxes and dropdown boxes. Once you’ve selected your criteria you can select your area using the map below it. 6. Select the County you want to search from the “Search Area” drop-down box, just above the map. 7. Select a City from the “Search Extents” dropdown box. 8. On the map that appears, use the pan and zoom tools to find the area you want to search. 9. Use the Select Area tool to define the area you want to search 10. Left-click and drag the cursor to create your shape. 11. When you close your polygon or other shape, the search criteria box will open. 12. Click “Perform Search”. 13. Your search results will open as a spreadsheet view.
You can also narrow your list by refining your search, or broaden it by changing your search criteria to refine the parameters. When you’re ready to print labels, you’ll have the option to remove duplicate addresses. When you’ve modified your search results to include only the addresses that you want, I recommend saving your search, click “Save This Search” in the box to the right. Set Up Your Labels Click on the “Create Mail Labels” in the box on the right. A box will open to allow you to set up your labels for printing. A few things are important to remember: • Occupant will print “Occupant” on the first line of each label, and the actual physical address of the property. • Owner will replace “Occupant” with the name of the property owner and the mailing address for the tax bill. • Either Occupant or Owner with bar code will print either Occupant or the owner name with a bar code. The remaining checkboxes in the label setup box will allow you to: • Replace the first line of the address label with a specific line • Remove duplicate addresses based on different criteria • Choose the text alignment for your labels • Choose the label type for your labels from the list of supported labels Once your labels are set up to your satisfaction, click on the “Create Labels as PDF” button. A file download dialog box will open. Choose “Open” to view and print the completed PDF file. Print as usual form the Adobe Acrobat PDF file. That’s it. That’s all there is to it. You can easily save the file as a PDF and call it up to print the labels any time that you want to reuse the address file. If you need assistance with any of this, call the MLS Technology Helpline at (407) 513-7288. ■
Select the Addresses you Want In spreadsheet view, you can easily eliminate any addresses that you don’t want to include in your mailing. Just click in the checkbox to deselect it, and it won’t show up on your labels list.

Knowledge Services News By Michelle Smith, Director of Knowledge Services What is your Destination? Now that 2007 is over and we have begun a new year, the Knowledge Services department is focusing on you and your destination. What does this mean for you? We have developed a new program entitled “Destination:Success” which includes classes regarding both our professional and personal life. Classes such as Brokerage Risk Management, Life+Work=Balance, Personal Achievement, Short Sales/Foreclosures and Web Tools just to name a few. Some of these classes will have continuing education credits awarded and a few others will have certifications included. At this time there are 13 classes scheduled throughout the year with the Destination:Success series covering a variety of topics, some of which are mentioned above. Of course, with all of the great classes there must be a cost, so the classes are $15.00 each or $125.00 for all classes scheduled under the Destination:Success. Certified Real Estate Professional (CRP) The Certified Real Estate Professional designation was such a success last year that we decided to offer the classes again this year. These classes are instructed by leading broker members of the Association and were designed to assist REALTORS® in fine tuning their skills with such topics as prospecting for listings, presenting the offer and communication skills. Because this is an Osceola County Association of REALTORS® designation only, there is a cost involved. The cost is $95.00 for all 14 classes and 10 of the 14 classes must be completed to receive the designation.

Graduate Real Estate Institute (GRI) Graduate Real Estate Institute, or GRI, is a very lucrative designation recognized nationally. It is proven that REALTORS® who have earned this designation have a 28% increase in their profits. GRI-1 is also used by many REALTORS® as their post licensing requirement mandated by the State of Florida Department of Business Professionals (DBPR). In order to receive this designation REALTORS® must complete the 3 sets of classes, GRI-1, GRI-2 and GRI-3, and you have 5 years to complete all 3 GRI’s. This year the Association was awarded GRI-1 being held at the Association on February 20-21 and 27-29; and GRI-3 being held at the Association on September 2-4 and 8-9. Network & Knowledge

Ever since I have known you, which is a long time, you always thought you were right about everything. Well, this time you are wrong and whoever told you about the new rule on Title Company/Attorney’s information is correct! Ralph there are two kinds of laws and rules that regulate our conduct when practicing in the real estate business. There is the Florida Statute Chapter 475 and then there are the rules that Department of Business & Professional Regulations (DBPR) use to control or regulate. (I added these two symbols, #1 and #2, to show that there are two subjects in the following rule and are not a part of the written rule.) Here is what has happened: DBPR (FREC) added to rule “61J2-14.008 Definitions” under 475.01 (2) (b) the following: (#1)“When escrow funds are placed with a title company or an attorney, the licensee shall indicate on the sales contract the name and address of said entity. (#2) The licensee shall obtain and retain written verification of said deposit upon delivery of the funds to the title company or attorney”. I was told by a DBPR auditor that this could be a Violation and could be a full disciplinary action and is NOT considered a minor offense if the preceding rule was not followed. (#1) If you will notice, Ralph, when you are using the new FAR or FAR-BAR contracts, there is a space for the above information on the Title Company/Attorney. (#2) To protect our company, I created a form that verifies and acknowledges that the escrow check has been received from the receiver of the escrow deposit. Always your friend Oscar ■
