NAR CENTENNIAL - 100 YEARS IN CELEBRATION OF THE AMERICAN DREAM This is the third in a series of articles each month that will document the history and formation of the National Association of REALTORS®, the largest trade association in the world. REALTOR®: Term of Distinction
as a trademark. At the time of the word’s adoption, federal law did not allow for it to be registered a trademark. Many states did allow the registration of the term, however, and by the time he retired, MacChesney had successfully registered the trademark in 46 states. With the passage of the 1946 Trademark Act, known as the Lanham Act, the National Association was able to register the term as a collective membership mark. Continued on Page 14.
The history of the REALTOR® trademark is long and storied, but for this article I will shorten it up a bit. In 1916, the same year it became known as the National Association of Real Estate Boards, the Association adopted the term REALTOR® as a mark to be used exclusively by its members to set themselves apart from “irresponsible curbstoners” – the term used to describe fly-by-night practitioners who operated from the curb rather than an office. The term was coined in 1915 by Charles N. Chadbourn, a member and past president of the Minneapolis Real Estate Board. Mr. Chadbourn had addressed the Executive Committee at the 1916 annual convention in New Orleans. He wanted the members to raise the standard of real estate “men” (there were no women members at this time) throughout the country and raise the standard of the business. He had read a news article that talked about a scandal in a real estate office. The member of that office was not a member of the board, but nevertheless, because he was called a real estate man, had brought disgrace on the whole profession to some extent. Mr. Chadbourn thought that board members should have some distinctive title. He submitted a resolution to the Executive Committee and on March 27, 1916, eight years after the founding of the National Association and three years after the establishment of a Code of Ethics, the Executive Committee passed Chadbourn’s resolution. Chadbourn realized that the newly coined word needed to have lasting significance in the eyes of the public. He expressed this intention in the March 15, 1916, issue of the The National Real Estate Journal by publishing a sample certificate along with his plan to have the Association adopt the REALTOR® term. On the draft certificate, “copyrighted” appears immediately beneath the work REALTOR®. The term REALTOR® gained acceptance quickly. It wasn’t long however, before people began using the term generically to refer to any practitioner, as they might use doctor or lawyer. Inevitably, practitioners who weren’t members sought access to the term. As a result, local committees formed to ensure the word was being used correctly. Nathan William MacChesney, who served as general counsel for the National Association from its founding in 1908 until his retirement in 1947, helped lead the effort to register the word

“Now is the Time to Buy” Campaign Counters Negative Media For the past 10 years, the Public Awareness Campaign has been working on behalf of the National Association of REALTORS® (NAR) members to educate and persuade consumers about the value of hiring a REALTOR®. In 2008 the campaign will go even further, countering some of the recent negative national media reports related to the housing market facts about the value of housing as a long-term investment and helping our members educate consumers about actual conditions in the Osceola real estate market. Recently, the Association has been running the ”Now is the Time to Buy” ad in various publications, such as, the Orlando Sentinel, the Osceola News Gazette, and Homes. com magazine, to name a few. We have seen measurable results in consumers’ attitudes and beliefs as a result of the campaign. The most recent 2007 tracking study found that the percentage of consumers that would use a REALTOR® to buy or sell a home has increased significantly over the past five years, from 52% in 2002 to 71% today. This is a member-driven campaign, and REALTORS® are encouraged to use the materials NAR has developed and provided for its members as part of this effort. Although only local and state associations can place the materials as advertising to promote the value of all REALTORS®, individual members can use the materials to: • Demonstrate the long-term value of homeownership to home buyers who may be on the fence. The 2008 campaign includes a separate, consumerfocused website, www.HousingMarketFacts.com, which provides more information about the benefits and value of owning a home, identifies current public policy issues of importance to consumers in the real estate transaction, and of course, allows visitors to link directly to the site so they can learn more. • Educate buyers and sellers about the importance of using a REALTOR® in today’s real estate environment. Members can view and download the new “Building Wealth” and “Home Values” campaign materials, including television ads, radio spots, print ads, and Web banners for use in presentations, emails, and Web sites.

• Distinguish yourself from licensees who are not REALTORS®. All REALTORS® must complete training in and subscribe to a professional code of ethics. The REALTOR® Code of Ethics is something that distinguishes REALTORS® from other real estate licensees. Visit www.realtor.org/ codeofethics for downloadable materials to use with your potential customers and clients, including a simplified Code of Ethics document in both English and

Brokerage Design By Jeremy Conaway Reject the Blindfold; Enlightenment Is the Way to Go We are seeing seven distinct reactions, among our community members, to the current environment that we know as the American real estate marketplace. The focus of these observations was behaviors of 13 different brokerage communities, ranging from California to Massachusetts, Houston to Minneapolis and Miami to Missoula. All of these markets are experiencing some level of stress and transition. Some are down almost boutique levels of 18 to 20 percent. Others are experiencing major market downturns that are 35 to 40 percent below levels experienced in 2006. The pervasive current of the down market is maneuvering many within brokerage communities into one of seven reactions. Reaction 1 - Hunker Down: Most brokers started trimming expenses in 2006 and 2007. For some the trimming has evolved into slashing that is reaching well into resources and internal services that some might consider essential. IT, training, web, marketing and communications programs are all now considered fair game. However, a sustainable market is not likely to return until the third or fourth quarter of 2009. Furthermore, brokerages may well be operating in this reduced configuration for the next 18 months. Reaction 2FAST – Try•toACCURATE Sell: Some • brokerages are opting to FRIENDLY leave or attempt to leave the marketplace. Reaction 3 – Rollup: A number of the stronger regional players are engaging in acquisition programs called “rollups”. These are offerings in which the regional brokerage acquires the assets of the smaller brokerage (typically single to three office firms with 25 – 100 agents) in exchange for assuming debt and a payment equal to 10 – 15% of the 2007 company dollar. These payments are sometimes in cash and sometimes over a 24-month period. Rollup is a technique used by investors (in this case stronger regional players) where multiple small companies in the

same market are acquired and merged. The aim is to reduce costs through economics of scale. Rollups are also created to reduce competition in small risky markets (in this case real estate), where there are often many companies but room for only a few to succeed. Such an investor, faced with an opportunity to invest in two competing companies, may reduce risk by simply investing in both and merging them. As is the case here, rollups are often part of the shakedown and consolidation process during an economic downturn or as new market sectors begin to mature. Reaction 4 – Merger of Convenience: For firms seeking to terminate operations that do not meet the regional brokerage acquisition profile, a more severe option called a “shotgun merger” or “merger of convenience” has evolved. In this scenario the terminating brokerage simple exchanges its assets for the payment of its debts by a brokerage competitor, generally from the same market. Reaction 5 – Same old, same old: Perhaps most unusual of all down market reactions can be found in the firms that continue to conduct their business in the same fashion as before the down market only with lowered expenses. Despite the overwhelming amount of information and guidance that is available from a wide variety of sources regarding real and effective ways in which to address the challenges of the down market, an impressive number of firms are simply “doing what they have always done”. A number of interviews were undertaken over the past 60 days in an attempt to better understand this behavior option. No simple answer has been forthcoming. The Continued on Page 8

Reaction 7 – Co-opetition: Kami’s comment shows us that all of us, working together, must feel the pulse of this change on a daily basis. Most of all we must work together. For the purposes of this moment in history we must not see ourselves in competition, but rather as the stewards of America’s most important legacy home ownership. Our survival is neither required nor mandated. In fact there awaits at our flanks those who are betting on our demise so that they can assume a commanding position in this great marketplace. Whatever happens moving forward we should never question that we have the strength, the wisdom and, indeed, the resources to survive this challenge. There are solutions, answers and options available here. This is the moment that we have been living for. Do not opt for the blindfold. Let’s work together, and see this time in history as an opportunity to take our industry to the next level, for the benefit of our consumers, our market and, yes, our legacy. Reject the blindfold; enlightenment is the way to go. ■

Reaction 6 – Go It Alone: None of these markets observed the brokerage community coming together to address either the circumstances or the solutions. Unlike other industries similarly disposed (e.g. the airline industry) the American real estate brokerage appears to find no value whatsoever in using the institutions (e.g. organized real estate at the local, state and national levels) that they have created over the past 50 years to solve this historic situation. We all understand that the current market is not under our control. It is under the control of an irrational consumer and society. As master strategist Michael Kami so wisely stated, the changes in the consumer’s needs, desires, and demands will tell us where we need to go. We must be curious, observant and analytical. We must seek out the clues of change and translate those clues into opportunities and action.

AMENDMENT 1 PASSES. WHAT NOW? WHAT’S NEXT?
By Mike Mayo, Public Affairs Consultant Amendment 1 passed decisively on January 29 with 64% of the statewide vote. People keep asking two questions: What now and what’s next? First, let’s briefly discuss what voters approved January 29. The main components of the projected $9.3-billion property tax cut Amendment include: Increasing the Homestead Exemption An additional $25,000 homestead exemption is provided for the value of property between $50,000 to $75,000. Be advised, this increase does not apply to school taxes, which is approximately 40% of your property tax bill. The provision takes effect retroactively to January 1, 2008. All persons currently receiving a homestead exemption and who continue to qualify for the exemption will automatically qualify to receive the additional exemption. No further application will be necessary. “Save Our Homes” Portability Arguably the Amendment’s most significant component, this provision is designed to alleviate the “lock-in” effect that punishes many people for moving. Homeowners may

now transfer their accumulated Save Our Homes (SOH) benefit to a new homestead anywhere in Florida within two years of leaving their former homestead. Those who sold their homes in 2007 can transfer their SOH benefit to a new homestead if they establish it by January 1, 2009. There is no limit on how many times an owner can transfer or “port” the accumulated savings. And, this provision applies to all taxes - including school taxes. A “portability calculator” is also available on the Property Appraiser’s website: http://www.propertyappraiser.org/ Tangible Personal Property Tax Exemption The amendment also includes a $25,000 tangible personal property tax exemption. Property and business owners with less than $25,000 worth of tangible personal property will no longer have to file returns, completely removing this administrative burden. This provision takes effect retroactively to January 1, 2008. Assessment Cap for Non-Homestead Property This provision limits the annual growth in assessed value of non-homestead property to 10% per year. The 10% cap will sunset after 10 years, at which time it will be presented to voters for re-authorization. This cap does not apply to school taxes, and goes into effect January 1, 2009. Residential properties of nine (9) units or less will surrender accumulated protections at change of ownership or control. For all other properties – residential properties of 10 or more units and business properties – the Legislature must define by general law how the property will surrender accumulated protections at change of ownership or control. FAR will be working with the Legislature during the 2008 Session, and with the Florida Taxation and Budget Reform Commission, for further relief.
