First Quarter Presidents Message: First of all, let me pay respect to Karen Dierickx for her service this past year and complement her not only for her leadership in 2015, but for the countless hours she has voluntarily dedicated to our association over for the past 25 plus years. Karen, thank you for all you have done! Secondly, thank you for allowing me the opportunity to serve as your 2016 President. I will strive to serve the association and all of our members to the best of my ability and keep your interests at the center of all that we do. I am looking forward to working alongside our new incoming 2016 Board of Directors. It is very exciting to be working alongside such a diverse and talented group of people. As we embark on a new year, it is a time to reflect on the past year’s endeavors and project success going forward. We, as an industry, an association, and as individual professionals are going to be faced with many challenges. These challenges are not only in our daily business life, but also at the local, state and national levels. Your 2016 board met in 2015 to develop a strategic plan for our association over the next 3 years; and many of the challenges our industry faces were discussed. We look at these factors, not as challenges, but as opportunities to position our association as a leader and an innovator in providing our members and communities the best in service. I would ask each one of you to become involved in the association and partake in the excellent educational and networking opportunities available to you. We would ask if you can find just a couple of hours a month to get involved in any of the following: education, community outreach, global alliances, public policy advocacy or any other special programs, such as the Wounded Warrior project or addressing homelessness within our communities. Your time and effort is needed, is welcome and will provide fulfillment to you and make a difference in somebody’s life. We look forward to a successful and rewarding 2016. OSCAR Members Appointed to OSCAR Members Advisory Boards Appointed to NAR Leadership A number of Osceola County Association of REALTORS® (OSCAR) members, affiliates and staff have recently been appointed to leadership positions with the National Association of REALTORS®(NAR). OSCAR congratulates and commends these individuals for their initiative and drive. Among these leaders are Jeff Perry, our incoming Board President who will serve as Director; Richard Fryer who will serve as Director and NAR Research Committee Member; Tim Weisheyer, who will serve on the Strategic Thinking Advisory Committee; Veronica Malolos, who will serve on the Housing Opportunity Committee; Patty Smith-Wyant, who will serve on the Certified International Property Specialist Advisory Board; John Goldsborough, who will serve as a NAR Real Estate Business Institute Committee Member; Cheryl Grieb, who will serve on the Smart Growth Advisory Board; and lastly OSCAR Chief Executive Officer, Carol Platt who will also serve on the Smart Growth Advisory Board and the NAR Real Estate Business Institute Committee.

The City of Kissimmee has made its annual appointments for its Advisory Boards, and members and staff of the Osceola County Association of REALTORS® are among those appointments. The Kissimmee City Commission relies on Advisory Boards made up of local citizens and business members to make recommendations about a variety of City departments and services. Congratulations go to Olga Costano who was appointed to the Fire Pension Board, Frank Fernando “Ben” Robles who was appointed to the Charter School Board, and our very own staff member Christina Barnhardt who was reappointed to the Charter School Board. “It’s wonderful news to hear that our members are representing us in these important board positions!” said OSCAR Association Executive, Carol Platt. “Each of these individuals has proven their commitment to excellence in myriad ways over their time with the Association, and I just know that will translate to further success in their respective positions with the City Advisory Boards.”

Faces of the Future Chair, Holly LaRosa OSCAR members were in attendance at the Faces of the Future fundraiser benefitting children in the area this past October. This all day event held at the Tupperware Center raised funds to assist kids who are a part of the Osceola County Boys and Girls Club. The mission of this organization is to enable all young people, especially those most in need, to reach their full potential as productive, caring, responsible citizens. It achieves that mission by teaching health and life skills, offering access to sports, fitness and recreation, as well as arts programs, education and career programs, and character and leadership programs. In attendance at this event was OSCAR member Holly LaRosa who serves as Chair of the Osceola County Faces of the Future event. Also showing support were members Raja Ackley, Leslie Zimmerly, 2015 Board President Karen Dierickx, Augie Bylott, Charles Castellon, Diamela Ortencia, Jo Marie Hemphill, Valerie Crabtree, Cheryl Grieb, Jose Alvarez, Representative Mike LaRosa. and Association CEO, Carol Platt. These members are Creating Hope in our community by giving to the Boys and Girls Club.

Our Annual Faces of the Futures Breakfast in 2015 was supported by OSCAR. It makes sense that local REALTORS® see the positive impact that our Clubs have in the children we serve as our Club members feel at home every time they walk through our blue doors. The Boys & Girls Clubs are so grateful for the community spirit! A total of $150,792.00 was raised at the breakfast from our supporters. As you know, OSCAR is charged with the responsibility of receiving and resolving ethics complaints. Many “complaints” received do not expressly allege violations of specific Articles of the Code of Ethics, and many do not detail conduct related to the Code. Some “complaints” are actually transactional, technical, or procedural questions readily responded to. It is the belief of the National Association of REALTORS® (NAR) Professional Standards Committee that many ethics complaints might be averted with enhanced communications and initial problem-solving capacity at the local level. As such, OSCAR has implemented policy to provide Ombudsman services to its members and consumers alike, beginning January 01, 2016. The Ombudsman process usually involves parties who have not filed an ethics complaint or arbitration request, but have experienced a breakdown in communication requiring informal resolution (although an Ombudsman may also be used where a complaint has been filed). Often the Ombudsman functions as an intermediary who communicates the concerns of one party to the other over the phone, so a positive relationship can be restored. The Ombudsman process can be beneficial for both consumers and REALTOR® members who need an immediate, informal resolution to common misunderstandings. For example, Ombudsmen can field and respond to a wide variety of inquiries and complaints, including general questions about real estate practice, transaction details, ethical practice, and enforcement issues. Ombudsmen can also receive and respond to questions and complaints about members, can contact members to inform them that a client or customer has raised a question or issue, and can contact members to obtain

information necessary to provide an informed response. Ombudsmen can field and respond to a wide variety of inquiries and complaints, including general questions about real estate practice, transaction details, ethical practice, and enforcement issues. Ombudsmen can also receive and respond to questions and complaints about members; can contact members to inform them that a client or customer has raised a question or issue; and can contact members to obtain information necessary to provide an informed response. In cases where an Ombudsman believes that a failure of communication is the basis for a question or complaint, the Ombudsman can arrange a meeting of the parties and to facilitate a mutually acceptable resolution. Disputes can often be resolved through the Ombudsman process in as little as a few hours or days, depending on the availability of the ombudsman and the parties. Persons filing complaints, or inquiring about the process for filing ethics complaints, will be advised that Ombudsman services are available to attempt to informally resolve their complaint. Such persons will also be advised that they may decline Ombudsman services and can have their complaint considered via the formal ethics complaint process. Transitional Land (Entitled Land) Transitional land sales are picking up in the Orlando and Tampa Metropolitan Statistical Area (MSA) as buildable residential lot inventory is low in these areas. Investors and national builders are purchasing land for future development at prices well below the 2006 market top but at prices that are attracting sellers. Primary urban infill and suburban locations appear to be strongly favored over tertiary areas for development-oriented property types.

Residential Housing Market The rural residential market is starting to see an improvement in sales but is still a small part of the

overall residential market shown in the charts. Two of the largest MSA in the state “Many of the metro areas with the fastest price appreciation over the past year were in the South — particularly in Florida,” says Lawrence Yun, National Association of REALTORS® Chief Economist. “A combination of solid job gains, above average shares of vacation and foreign buyers and little new construction being added was behind these areas’ faster price growth.” The National Association of REALTORS®, in November 2015, stated that existing–home sales in the South climbed 3.0 percent in the third quarter and are 6.9 percent above the third quarter of 2014. The median existing single–family home price in the South was $200,700 in the third quarter, 6.0 percent above a year earlier.

Good testimonials are crucial to making it in the business world. It seems that many people will only buy products or use services that have received good feedback from consumers. This has become an increasing problem in the online world, with many people paying for reviews and false ratings. It is of great importance that any business that wants success get accurate and legitimate testimonials. Consumers are more likely to listen to each other than hear it directly from you, so it’s important that the best foot is put forward when attracting new customers. There are several ways that it is possible to get good testimonials.

Generate Quality Reviews The first and foremost way to get good testimonials is to provide an outstanding service or product that is not available anywhere else. Word of mouth is the most effective way for people to be marketed to as this information seems more genuine and real. This leads to higher levels of trust in the product or service rendered and less buyer scrutiny. It is very important to provide a product that can’t be beat. This way the testimonials will be genuine and take care of themselves. It may be easy to pay someone to testify for your product, but that does not mean that people are going to fall for it. Getting found out for fake testimonials is a great way to sink the reputation of your product or service.

Avoid Negative Testimonials It is perhaps a separate art form all together to avoid negative testimonials. These are some of the worst things that a business can accrue in the course of day-to-day transactions. Given the pace of the social media world, it’s important to know how quickly a negative message can travel. This is why it is so important to nip these problems in the bud. Corporations pay big money to people who monitor what is being said about them online in order to

quickly and effectively address public issues within the company. It is often hard to avoid every mistake but action should be taken very quickly in these instances to avoid public embarrassment.

Other Tips for Gaining Reviews Another way to get a testimonial is to give an incentive to provide feedback. Whether it be a discount or another offer, this is a good way to find out what the customer is really thinking. These testimonials can be used to promote the product or service and are in fact genuine appraisals. The key thing to look for is honest feedback. The right testimonial can make all the difference to a business website. The focus must be on genuine feedback. In this way a testimonial can serve as both a means of promotion and a way to improve the company. Making general improvements and tweaks are a great way to stay ahead of the competition.

Importance of Testimonials The key idea to take away is that testimonials are critical to the success of a business. High quality products and services will give this kind of positive feedback organically, but it can also be in the benefit of a business to jump-start the feedback loop by offering special promotions of their own. Stay away from negative testimonials and nip negative feedback in the bud and you will have a huge head start in cultivating a successful business environment.

CASE INTERPRETATION CODE OF ETHICS, ARTICLE 12: MEDIA CONTACT: Bob St. Gordon

Case #12-1: Absence of Name on Sign (Reaffirmed Case #19-3 May, 1988. Transferred to Article 12 November, 1994. Revised November, 2001.) Prospect A observed a sign on a vacant lot reading: “For Sale—Call 330-5215.” Thinking he would be dealing with a For Sale by Owner, he called the number on the sign. He was surprised and offended that the lot was exclusively listed by Realtor® A, and the telephone number on the sign was the home number of Realtor-Associate® B in Realtor® A’s office. Prospect A filed a complaint against Realtor® A and Realtor-Associate® B. Realtor® A and RealtorAssociate® B alleging a violation of Article 12 of the Code of Ethics. At the hearing, Realtor® A stated that he permitted Realtor-Associate® B to put up the sign. RealtorAssociate® B’s defense was that the sign was not a “formal” advertisement, such as a newspaper advertisement, business card, or billboard, to which he understood Article 12 to apply. The Hearing Panel determined that the sign was an advertisement within the meaning of Article 12; that its use violated that Article of the Code; and that both Realtor® A and Realtor-Associate® B were in violation of Article 12.

There are two reasons for this. First, any sanction imposed must always fit the offense and must involve every consideration of justice, equity, and propriety. Eat out; leave a review on Yelp. Stay at a hotel; leave a review on TripAdvisor. Buy or sell a home; leave a review … where? In the digital age, consumers are king and queen, but a ubiquitous digital rating and review system for real estate agents has yet to emerge. One broker-owner hopes for a change: Nelson Goulart, broker of record and co-owner, along with his wife, Maria, of Better Homes and Gardens Real Estate Signature Service outside Toronto. He says rolling out a digital survey system to his 50 brokers earlier this year provided them with realtime analytics, insights, and validation.

Offering a digital survey to clients, Goulart says, is an important way get up to speed with the times. Many clients, especially millennials, not only like leaving reviews but have come to expect the ability to do so. “Today’s consumer wants to rate and comment on everything,” Goulart says. “It’s a great way to keep tabs on customer needs and wants.” While some brokers use SurveyMonkey or Reach150 for digital surveys, Goulart chose RealSatisfied, which gives customers a way to have their voice heard when their real estate

purchase or sale is complete with just a few clicks. Plus, the platform also offers real-time analytics for brokers and agents. Like HomeLight, Stik, or Mountain of Agents, RealSatisfied also becomes a way for potential clients to research and choose agents by automatically producing individual agent profile websites displaying customer feedback and survey performance.

While he doesn’t yet know the influence the survey made on referrals and hasn’t received any negative responses, he noticed a boost in his agents’ enthusiasm for the survey system after they started seeing positive feedback flow in. For example, one of his agents received a testimonial attributing survey results and reviews on the agent’s RealSatisfied profile website as the number one reason the customer chose the agent.

“Today’s consumer wants to rate and comment on everything,” Goulart says. “It’s a great way to keep tabs on customer needs and wants.” Goulart says the process is simple for agents and clients. After each transaction is completed, Goulart’s agents e-mail the client a RealSatisfied survey link. Clients rate their satisfaction and other qualities using one to five stars; they’re prompted to leave feedback on what could be improved, as well as a testimonial. Results automatically populate in each agent’s analytics dashboard, on the broker’s companywide analytics dashboard, and on each agent’s client-facing RealSatisfied profile website. If a client leaves a low rating on the survey, a flag through the survey system immediately alerts Goulart so he can follow up with a phone call. Everyone who fills out a survey receives a Starbucks gift card from his agency as a thank you, he says. Before implementing a survey system, “there wasn’t a vessel for client feedback: it was word of mouth or asking for a testimonial, but often not getting quality, personal referrals,” he says. At a previous agency, Goulart used postal mail surveys. “We would have been happy to see a 34 percent return,” he says. But since his company implemented the digital surveys earlier this year, about 64 percent of clients have filled it out. At this rate, he expects to have 300 surveys completed by the end of the year. Goulart says in the past, agents have expressed frustration when a previous client chose to work with a different agent. Goulart sees the survey as a potential solution to this issue as it allows clients to easily express feedback and voice issues, which an agent can address promptly.

“It’s a third-party insight into the work the agents are doing,” Goulart says. “If agents put in extra diligence and effort, it shows validation.” As the broker of record, Goulart says RealSatisfied’s real-time results also help him lead the company in the right direction. For example, he has a pulse on how the majority of clients found his agency: The survey asks if the client is a referral, found the agency online, or came to it through other means. He monitors the results and targets agent training toward the areas where they are seeing the most inbound traffic. “This gives us real numbers,” Goulart says. “For example, we know 15 percent of our business is coming from online. We can say, this is our marketplace, not another city. It cuts through the noise.” The digital survey is a powerful and needed tool, Goulart says. “I always believe the customer should have a strong voice,” he says. “I hope it will take off in the industry. After working at the association and pushing our members to complete the CIPS Institute that we offer, our OSCAR Advocates were asked to also complete the designation by our CEO, Carol Platt. As our Association is exceptionally diverse, Carol felt that it would be beneficial for the OSCAR Advocates to learn about the different cultures that surround us in our own community. As I went through the training I began to understand what a Certified International Property Specialist (CIPS) really must recognize and practice. When earning the CIPS Designation as a REALTORŽ, you are earning the tools to globalize your business. Once you have completed all the courses, submitted your application, and received your designation, you will gain instant access to not only business enhancing products but also many services that are offered exclusively to CIPS Designees. RESPECT IS PARAMOUNT WITH

GLOBAL BUYERS It’s a no-brainer that when you’re working with international clients, you should know something about their culture so you can communicate more effectively. “But awareness isn’t sufficient—you need to change your behavior,” said 2011 NAR Past President Ron Phipps during a forum on global buyers at the 2015 REALTORS® Conference & Expo in San Diego. What global clients most want from you is respect for who they are and where they come from. It’s not the way you manage their home search or negotiate their offer that will convey respect. It’s the sensitivity and empathy you demonstrate in conversation and other interactions with them. “You can be the top producer in your area and be really, really offensive,” Phipps said. During the session, several attendees role-played mock scenarios depicting common mistakes practitioners make when dealing with international clients, including: • •

Mispronouncing their name (and not attempting to correct yourself) Making false assumptions about their finances (such as their family is funding their real estate

• • • •

purchase) Ignoring their customary greetings Dismissing their business card Assuming they have a narrow focus on neighborhoods Not matching their energy level or communication style

“Be careful on the simple behaviors,” Phipps said. He also suggested that one way to mitigate your chances of offending a client is to ask nonleading questions. For example, to avoid making assumptions about your client’s family structure, ask them how many people are in their family. Then ask, “What kind of home will meet your family’s needs?” “In our culture, we want to get to the information quickly and move on,” Phipps said. “But take your time. I am very honored a Vice-Chair of this Committee to accept this proclamation on behalf of the members of the AHAC and the wonderful staff who all work so hard to serve our community in safeguarding and promoting affordable housing in Osceola County. In the next few days, Chairman Karl and I will be visiting with all of you to discuss incentives that we believe will further affordable housing in Osceola. We appreciate your openness to new ideas and your willingness to do what it takes to make sure that we increase and protect the supply of affordable housing in our County. A few days ago, Chairman Karl and I personally participated in the workshop provided by the Human Services department and CDBG as we discussed the initial Housing Study that will provide the data to help us develop and focus not just the AHAC’s efforts but the efforts of all stakeholders. Home prices have risen again and rental rates have skyrocketed due to supply and demand. This leaves a gaping hole in the affordable housing stock that could lead to more homelessness. The families and individuals who are waiting to move in to a permanent home but cannot

afford the high rates are left with no choice but to stay in their current situation whether it be doubling up with other families or continuing to live in hotels and motels. In closing, the AHAC would like to thank all of you for your dedication and service for the betterment of our community. I look forward to our meetings in the next few days and hope to bring back positive news to the AHAC regarding your support of the incentive programs we will bring to you. Thank you.
