Your OSCAR leadership were recently marked in attendance at the NAR Mid-Year Legislative Meetings in Washington DC. The Mid-Year Meetings are an opportunity for REALTOR® members to take an active role to further the industry and help shape public policy while attending special issues forums, committee meetings, and legislative activities. Members in attendance representing OSCAR were President Karen Dierickx, PresidentElect Jeff Perry, Directors, Patrice DeNike, Wanda Linscott, and Woman’s Council of REALTORS® member Tina Johnson. 2015 OSCAR President Karen Dierickx said of the event, “These Mid-Year Meetings provide an excellent venue for concerned REALTOR® members to engage in the legislative process. These meetings are both enlightening and productive, and offer many chances for REALTORS® to network with other REALTOR® professionals across the country while having a dialog about

important events and legislation facing the industry.” Also in attendance was OSCAR Association Executive Carol Platt, who was not only present, but headed up a Local and Global Forum emphasizing the benefit of developing partnerships with government agencies to help bring together REALTORS® and foreign commercial investors. Carol stated, “This meeting of minds was a perfect opportunity to address the global nature of business and real estate in today’s age. Through coordination with our partners at Experience Kissimmee, we’ve been able to shine a light on our commercial sector and make connections that build our community and create jobs. Last quarter, we looked at making those initial contacts that put you at the forefront of generating business. Whether you are a first time REALTOR® or a long-time REALTOR®, it’s the continuous communication with clients and prospects that gets that deal rolling and gets it closed! So many good sales associates make the initial contact, only to lose the deal as communications fall through the cracks. Today’s environment is information and workday overload, but a little planning, organization and discipline can protect sales associates from financial loss. 1. Have a strong database that is current, accurate and accessible. While database software can be utilized differently for different businesses, the most important aspect is that you actually enter the data, whether you are utilizing simple Google Contacts or Outlook, or a more elaborate REALTOR® specific database. The strength of your database defines long-term effectiveness in every sales profession and creates value! 2. Have a weekly contact goal. Those contacts can be arranged by priorities in urgency, income potential,

and referral potential, but the most important part of contacting potential business is to make the call and/or schedule the appointment. It’s almost a certainty that X number of sales will be made if X numbers of people are contacted. Track your contacts each week and hold yourself accountable. Some people even schedule initial contact calls for certain days and times each week. Find what works for you to be effective. In fact, Tom Ferry has created an App, Thriving Daily, which can be used to create personal accountability to make those contacts with specific income generation in mind. 3. Schedule annual meetings. Just like a performance review, a family Christmas letter, a reunion or a conference, having that annual “conference” with clients that you have closed continues to build your personal brand and sustain client loyalty. It’s a great opportunity to update that client on your business and to update yourself on your client’s real estate investment status. Make that appointment! 4. Consider automated “touch” programs. Whether it’s a themed

or market update post card, print or electronic newsletter or even automated phone calls, keep your name and your brand in front of the people that you have spent so much time (and time is money) cultivating. The first step toward a harvest is to consistently water the seeds that you have planted. Our Board of Directors and our REALTOR® Advocates love touching base with you. Let us know what you need to be effective. We are always interested in knowing about your success stories. Share those stories with us, along with any potholes or speed bumps. We are always looking for ways to make your road smoother and straighter to help you gain the traction necessary to reach your goals!

To avoid misunderstandings, listing agents should not delay communications with sellers when a buyer makes a bid. Question: How much time does the listing agent have to present an offer to the seller on a property once a buyer makes an offer? Can the listing agent hold the offer knowing another offer might be coming in? Answer: Standard of Practice 1-6 speaks directly to the timing of the presentation of an offer. “REALTORS® shall submit offers and counteroffers objectively and as quickly as possible.” While there can be different perspectives on what “as quickly as possible” means, it’s clear from the Code of Ethics that the listing agent doesn’t have the right to decide unilaterally when an offer is presented. The listing agent must always keep the key concepts of Article 1 in mind. “When representing a buyer, seller, landlord, tenant, or other client as an agent, REALTORS® pledge themselves to protect and promote the interests of their client. This obligation to the client is primary, but it does not relieve REALTORS® of their obligation to treat all parties honestly.” The presentation of offers is one of the ways in

which a listing agent “protects and promotes” the interests of the seller, so the agent should take instructions from the seller on how the offer is presented. It’s possible the listing agent and seller jointly agree on a negotiation strategy in which the seller decides to wait for other offers to be presented. However, the seller should be told the risk of doing this. State contract law may allow a buyer to withdraw an offer before a valid acceptance, so the seller could be left with nothing to consider. As a courtesy and as part of the negotiation, the seller and listing agent should discuss and decide whether to tell the offering buyer of the seller’s decision to wait for another possible offer. In my view, “as quickly as possible” means the listing agent should notify the seller immediately of an offer so a dialogue can begin between them about when, where, and how to present it and other offers. Certainly, with today’s array of technology, there are few barriers to communicating an offer to the seller as soon as it has arrived. Whether a business is in its beginning stages or has been in operation for years, social media creates a unique opportunity for advertising. Unlike expensive billboards and commercials, social media allows businesses to connect to their key audience and extend their reach to new customers. Social media permits space for creativity and is relatively easy to operate without any training. Understanding why social media is essential to a business and utilizing it correctly not only helps one gain a larger profit. Correctly using this media also gives one the satisfaction of representing their business positively.
Free, Effective Advertising Most social media websites are free, or a reasonably low price. This is great for small businesses that may struggle with price management when it comes to advertising. Traditional advertising, such as television commercials, are expensive. Even a low quality commercial can put a business back by thousands of dollars and it will only reach a small audience. Also, if it’s made low-quality, a TV commercial could actually have a negative effect on a business leading to the potential loss of customers. Social media, on the other hand, is inexpensive and reaches customers from all over the globe, and one can always change and update their advertising with the times. Another priceless benefit of social media is that a person can clearly see their marketing audience with ease by checking the people who “follow” or “like” the company’s social media accounts. Through that, it’s much easier to get to know the customers better. If a business is just starting out it’s essential to know the audience they are advertising to, that way customers can share with others the link to the profile resulting in a growing customer base. Social media allows for one to post in a matter of seconds, making it the fastest advertising market. Communication with clientele and competitors is key to helping a business grow. Social media allows for a safe

way to share information with others, and learn what one’s audience likes and dislikes about certain brands. These days many places have a social media account for their fans to follow; following other businesses can help keep an eye on the competition. Most of all social media creates a place for conversation, it makes marketing a personal experience–and not just for the consumers.
Endless Possibilities Good management of a social media account nearly guarantees good business. The internet allows creative and innovative thinkers to portray their company through various platforms. Whether it be videos, pictures, or articles, the way one can advertise is almost endless, but most of all it’s effective. All sorts of demographics use the internet so when an article or video catches their eye, they are more likely to remember a brand, opening up a whole new audience. While extending an organization’s reach, it is also important to keep a good reputation. As it was mentioned earlier, bad advertising loses customers. Anything that is low-quality or does not accurately portray a company is harmful to its reputation. One bad advertisement has the power to possibly ruin a business. Social media allows for high-quality marketing, posts can be edited and deleted, and there’s more room for personalization. Never again does one have to worry about sending the wrong idea about their business. Social media is simple to operate and, when used appropriately, it opens doors without tightening a budget. No matter what kind of business someone runs, media is key to its success. Social media makes advertising fun, easy, and profitable. Through it, a company can learn and grow while extending their reach to places it couldn’t get to before. Traditional advertising is no longer practical and may be detrimental to an organization. Social media has allowed success for thousands of businesses to flourish and connect to their audience. It has the power to turn a small business into a giant enterprise almost overnight.

During the NAR Midyear Legislative Meetings, your Association Executive, Carol Platt, along with Maria Grulich of Experience Kissimmee participated in a presentation panel at the Local and Global Business Forum, along with the Texas and Silicon Valley Association of REALTORS®. OSCAR’s Community Involvement Committee is proud to sponsor another round of scholarships to Osceola County High School Seniors. This year they awarded seven $1,000 scholarships to local students based on winning essays centered around the theme: The Value REALTORS® Bring to the Community. This year’s winners are pictured above, and their essays can be read below. Congratulations to these students for their academic achievements! “Home is where the heart is.” But what if your home keeps changing? My life changed the day I came home and saw a piece of paper taped on the exact spot which had held wreaths from many years passed. This small piece of paper altered everything. My home I had lived in for nine years was taken away with a simple word: “FORECLOSED.” Until this event, I was unaware of financial status or adult responsibilities; suddenly, I was thrown into reality. I’ve moved twice since this loss. Each move has led to fewer boxes unpacked and more memories left
behind. My focus, determination, and hard work in my academics helped me during tumultuous times. Although, I wish I could go back into the past and contact the Osceola County Association of REALTORS to solve our predicament before it occurred. Instead of staying in the house, which we were becoming more and more unable to afford, we should have contacted help. A REALTOR® could have helped sell the house and find my family a nice home we could afford. A real estate broker from OSCAR would have ethically worked to sell our house and buy a new one with collaboration and

020 commuication. Thankfully, I did not lose my way in academics; however, many other students would have been unstable in school because of the lack of stability of having homeownership. Osceola County Association of REALTORS® is the basis for creating a secure education and happy household. - Sarah Bodman Being an Air Force brat my whole life, REALTORS® have always had a role in my life. Whether they were helping my parents rent out our house in Germany to help pay it off, or they were finding us a temporary rental for our transition periods, they have always had an influence on my life. One REALTOR® in particular had a great influence in the lives of my whole family. Moving from what had become my home in Germany to Alaska could never be easy, but luckily we had help. His name was Mike, and he was my grandmother’s REALTOR®, and eventrually friend. With my dad working all the time he did not have time to house hunt and needed all the help he could get. I remember looking at house after house in hopes of finding something to settle in, his hard work came out through every new front porch, every new yard that seemed to show his love for his job and his care for our family. Eventually he found us a house and we enjoyed it all of the three years we were in Alaska. REALTORS® can often be taken for granted as someone just doing their job, but to this Air Force brat, I understand how important their job is. It was the difference between living in a hotel room, or in a house that soon became a home. - Sawyer Root There are a variety of REALTOR® Professionals who work to establish benefitting factors for all in our community. Their basic goal is to support and assist their clients (“Why Use a REALTOR®?). Having had to move into seven homes in my life, I have realized that REALTORS® have made transitions much more comfortable for my family. An example was a previous relocation from Arizona to Nevada. Our family moved blindly to this area not knowing what kind of housing market, property values, laws, and quality of schools were in this new area. We were blessed to find a highly qualified and knowedgeable REALTOR® who abided by the Code of Ethics on the
local level. She provided a luxurious amount of key information to ease our anxious emotions. When buying a particular home in Nevada, our REALTOR® expressed her understanding of legal issues that affect real estate transactions, negotiation skills, and mutual contracts witht he seller (“Scholarship Application”). Most importantly she gave us professional advice and objective insight into a process that usually would be extrememly stressful (“Scholarhip Application”). Through all of the professionalism and knowledge the REALTOR® brought to us, the most important thing was the frienship that was developed. Our family felt that she helped us fit into the community, making our stay worthwhile. I am grateful for the role REALTORS® play at all levels of our society, especially in our local communities. They do make a difference. - Evan Morris I believe REALTORS® provide more than just houses in growing communities. REALTORS® provide homes where memories are made, where couples can grow old together and watch their family tree prosper. Living in St. Cloud for over thirteen years, this city started out as a small, grassy, and cattle filled town. With the help of REALTORS®, the small town of St. Cloud has transformed into an economically thriving and populous city. At four years old, my family and I made the move from Orlando to St. Cloud. Entering our neighborhood, Sawgrass, a sea of dirt filled the landscape. Confused, I questioned why were living on a “big piece of sand”. My parents then informed me that REALTORS® were working on meeting our needs for our new dream home. Fast-foward to the present, thirteen years later, my family still resides in this beautiful home REALTORS® helped us find. Through the years of education, dinners around the kitchen table, and family gatherings, I couldn’t be more thankful to have had this place to call my home. Home is a feeling of comfort and safety that overcomes an individual as they step through the door, and I have been able to experience this through the contribution of REALTORS®. - Hannah Richards Our great nation was founded on freedom. We enjoy so many freedoms that are not afforded to all people in other parts of the world. One of

those freedoms is the ability to buy and sell on the open market. Our country grew and became a world leader through westward expansion and the industrial revolution. Real estate often drives the economic direction of our communities. REALTORS® are the people who ensure that this process works in an efficient and expeditious manner. I think the greatest contribution REALTORS® provide to our community is being able to provide all types of people with the pursuit of the American dream to own a home. Having an established home is one of the basic necessities of life. Only the REALTOR® has the ability to represent our needs and find a solutions to those needs. No other person or profession can be your friend and companion when embarking on a new search; whether it is next door or across the country. I believe that REALTORS® are one of the most important groups in our community and so important to personal and economic stability. The REALTOR® may be your first friend in a new neighborhood. I cannot think of another more powerful, significant first impression a REALTOR® provides for people in transition. They are a powerful representative for the new homeonwer’s interests. Like a REALTOR®, if I am selected for your organization’s scholarship, I will also be a powerful representative for your organization. - Shannon Donnelly As many people know, buying and owning a house is a huge investment, usually the biggest investment of a person’s entire life. This process is both exciting and daunting. It in many cases can enhance someone’s lifestyle or destroy it. The importance of REALTORS® is often overlooked entirely, very few people have come to realize that REALTORS® are one of the few very important groups that work behind the scenes to ensure a high quality of living for communities and keep the American Dream alive. Before I moved to Florida, I lived in a small town in Michigan. We relocated to Kissimmee, in 2007, just before the housing bubble burst. Both Michigan and Florida experienced some of the highest foreclosure rates in the entire country. Several personal family friends lost their homes during this time and entire neighborhoods were in disarray. It became obvious to me that lending
institutions did not represent the best long term intersts of buyers, and often buyers themselves were blinded by desire to own bigger and better, spending well beyond their means. As Osceola County emerges from the economic recession and home sales are once again on the rise, I believe it is the role of REALTORS® to help rebuild neighborhoods and communities. The REALTORS® strict Code of Ethics helps assure families make intelligent and fiscally sound purchasing decisions and in turn builds stable neighborhoods and communities. - Dalton Lackey REALTORS® are typically known for having expert knowledge of a local area and helping individuals and families make one of the biggest financial decisions of their life. However, REALTORS® bring countless vital contributions to the community that are frequently overlooked. THe public often doesn’t realize that REALTORS® indirectly bring business, money, and work to the community. According to Natalia Siniavskaia, “NAHB analysis shows that during the first two years after closing on the house a typical buyer of a new single-family detached home tends to spend on average, $7,400 more than a similar homeowner who does not move.” During the buying process, work is given to local businesses such as the real estate brokerage, title company, property management, inspoector, and appraiser. Money was also flowing into the community when the consumer bought goods from the local businesses. In 2007, it was detected that new home buyers spent $12,332, outspending non-movers 2.8 times within the first year rof moving (Siniavskaia). These expenditures included appliances, furnishings, and property alterations. All of this money was flowing into the community due to the REALTOR® professionals. When more people are buying houses and spending money, it forces businesses to hire more poeple to take care of customers, giving the community more disposable cash to spend at local businesses. Local buinesses with more sales means more tax dollars being pumped back into the community. Indirectly, through the REALTOR®, the local community flourishes. REALTORS® are niot only an asset to their clients, but professionals that benefit the entire community. - Kaitlyn Bircher

Following the incident, a Mississippi Subway restaurant employee posted a photo of herself in her work uniform on Facebook in an apparent celebration of the killings. The woman, according to news reports, wrote the following status with her photo: “2 police officers was shot in hattiesburg tonight! GOT EM,” followed by three handgun emojis. A social media uproar ensued, the employee was fired,

Issues & Technology Forum at the REALTORS® Legislative Meetings & Trade Expo in Washington, D.C., May 14. The first thing brokers can do to mitigate the risk of an agent tarnishing their business’s reputation—or opening up the potential for a lawsuit— is to develop and enforce a social media policy. That means training agents on what is and isn’t appropriate to write in their statuses and comments. “These issues are hot and we have to deal with them now,” says Brian Copeland, chief of broker services at Village Real Estate Services in Nashville, Tenn. “Brokerages are behind on this and we’re here to start the conversation.” Copeland notes that real estate professionals have to adhere to at least four sets of compliance standards when it comes to social media: state real estate commission policies, NAR’s Code of Ethics, their broker’s policy, and the social media website’s terms

of service. It’s up to brokers to reinforce the importance of compliance, because their business is on the line, Copeland says. “As a broker you need to be there, you need see what’s going on and how people are truly handling themselves in [online] situations,” says fellow panelist Heather Ozur of Keller Williams Realty in LaQuinta, Calif. Posts or comments that attack or threaten other people, language that could be taken as defamation, and statements that reveal information about a transaction are points that should be addressed in a brokerage social media policy. There are also issues related to appropriate use of advertising and intellectual property infringement (for instance, do your agents know how to source photos). Amy Smythe Harris, broker-owner of Urban Provision REALTORS® in The Woodlands, Texas, says she counsels all her agents on how to post on social media, and has conducted webinars for her practitioners on the topic. “A lot of what we’re facing is agents not posting correct content,” she says. Agents are also not guiding their clients on what’s appropriate to post in the midst of a transaction. Harris says she knows of sellers who published a post about a negotiation situation involving multiple offers. A friend of a friend ended up seeing the post and that person happened to be one of the buyer’s agents who submitted an offer. Situations like that can kill deals, Harris says. While a social media policy might help, some things are impossible to monitor on social media, Copeland admits. That’s why this issue also relates to professionalism, he says, and if there are agents putting your real estate business at risk online, the best course of action might be to let them go. “It’s time to say goodbye to your agents who pose a liability,” Copeland says. doc change implementation The August 1st date for new mortgage disclosures will be delayed, says Consumer Financial Protection Bureau (CFPB) Director Richard Cordray. The new proposed start date will be October. 1, 2015. Initially CFPB will publish the proposed amendment to hold off the effective date, allowing the public time to comment. After the public comment period, a final decision will be expected shortly thereafter. As of yet, however, the propsal has not been published. This change creates an “integrated disclosure” which combines requirements of the Truth in Lending Act (TILA) and the Real Estate Settlement Procedures Act (RESPA). This change comes on the heel of changes made on June 4th which stated that the CFPB would offer a grace period to title companies and lenders through part of 2015 at least. This would allow companies who make a “good faith effort” to comply to have more time to perfect their systems. This October postponement will not negate this buffer period. Margy Grant, Vice President and General Council of Florida Realtors stated they are in the process of updating forms to make the language adhere to the new disclosure requirements. Watch Florida Realtors’ website for contracts with highlighted changes to be posted sometime in July. The new documents will be held off until closer to the October 1st date, however.
