PRESIDENT’S MESSAGE Realtors® Legislative Meetings and Trade Expo We recently spent a week in Washington, DC attending the NAR 2019 REALTORS® Legislative Meetings & Trade Expo. Our delegation consisted of Jeff Perry, Tim Weisheyer, Sue Vasquez, Maria Flores, Norkis Valdez, Joe Johnson, Cheryl Grieb, Veronica Malolos, Twis Lizasuain, and myself. We proudly represented OSCAR and several of our committees (Diversity Committee, MLS Committee, and Global Alliance Committee) during this event. We were also honored to witness the induction of Past President Tim Weisheyer into the National Association of Realtors® RPAC Hall of Fame. As our Association grows, it is exciting to see more and more of our membership participate and attend these conventions. If you have not attended a convention, I urge you to do so! You will be amazed to find out how insightful they can be. These types of events not only make our Association stronger, but they also help you individually. The knowledge gained from these opportunities can help you become a better leader and can be used to improve your business. Growing in popularity, teams are sprouting up all over real estate. Maybe you have a team that works in your brokerage or you’ve co-brokered a transaction with a team. But what exactly does it mean to work on a team, or start a team? What are the benefits, what are the disadvantages? Together we are going to answer those questions. We will take a deeper look inside teams, from all perspectives. During this class the new regulations for 2019 will be discussed. Team Advertising Rule The FREC team advertising rule (10.026) went into effect in June 2018. Licensees have until July 1, 2019, to comply with the requirements. The team advertising rule states that “Advertisements containing the team or group name, the team or group name shall not be larger print than the name of the registered brokerage. All advertising must be in a manner in which reasonable persons would know they are dealing with a team or group.” Individual Advertising Rule After much discussion, FREC decided not to change the individual advertising rule. Currently, the individual advertising rule states that “the licensed name of the brokerage must appear on all advertisements.” In addition, “no advertisement placed or caused to be placed by a licensee shall be fraudulent, false, deceptive or misleading.”


REALTORS® Care Committee It is hard to believe how quickly the month of May came and went! In last month’s issue I mentioned that our committee saw a video from Give Kids the World. This month we were able to take a tour of their amazing facility. They have over 1800 volunteers who come in weekly to help put a smile on the children’s faces. If you have ever wanted to volunteer this would be a great place to start! The food drive for the Osceola Council on Aging was a huge success. Thank you to all of the members that donated. The Council will use the food we collected to provide food bags to seniors, disabled adults, and disadvantaged families. We have also adopted a route for the Osceola Council on Aging’s “Meals on Wheels” program. Every Monday morning starting at 9:45, our committee members will help the council hand deliver nutritious meals to home bound seniors. We currently have shift openings. If you are interested in volunteering, please contact me at sue@suevasquez.com.

KELVIS MELO Global Alliance Committee Chair The Global Alliance Committee recently embarked on our first outbound trade mission to Toronto, Canada. Thanks to the the cultural awareness training we received prior to our trip, we were able to create world wide contacts. Our Association prides itself on providing our members with the education and tools necessary to propel them into the next level of their careers. This year the Global Alliance Committee has synchronized education, training, and networking events with other departments within OSCAR to provide a clear, logical and consistent path in the formation of global practitioners. From June 24 through June 28, we will be hosting a full 5-day, 35 CE credit, Certified International Property Specialist Institute (CIPS). Participants of this institute will gain the knowledge needed to do business abroad. I highly recommend that global practitioners become familiar with various cultural differences. Simple gestures

may be insignificant to Americans, but may offend a foreign buyer and destroy your chances of conducting business with them and their circle of influence. Another educational course we will be offering is a Global Alliance Committee sponsored class on July 10, 2019. The “How to Build a Global Outbound Referral Network” class is intended to provide the novice and seasoned global practitioners with everyday tools they can utilize to build their global referral network. I have publicly stated on prior occasions, my belief that we are fortunate to live and work in a region where the environment is ripe with global real estate opportunities. We must educate and equip ourselves with the knowledge to grow and globalize our businesses.

Florida Legislative Update

Governor DeSantis Signs SB 7068 and AOB Reform Into Law SEAN WHYARD GOVERNMENT AFFAIRS COORDINATOR

SB 7068 (Transportation) is a law that creates multi-use corridors (toll roads). “The program is designed to advance construction of regional corridors that will accommodate multiple modes of transportation and multiple types of infrastructure. The specific purpose of the program is to revitalize rural communities, encourage job creation in those communities, and provide regional connectivity while leveraging technology and enhancing quality of life and public safety” (The Florida Senate). •

Annual funding is expected to reach about $140 million in coming years for the plan, which seeks to extend the Suncoast Parkway from the Tampa Bay area to the Georgia border; extend the Florida Turnpike west to connect with the Suncoast Parkway; and create a new transportation corridor, including a toll road, from Polk to Collier counties.

During the initial development phases, FDOT will appoint task force members for each corridor comprised of representatives from state agencies, environmental entities and other stakeholders to evaluate and coordinate corridor analysis, environmental/land use impacts, and other pertinent impacts.  The results of these analyses will be summarized in a report that is to be submitted to the Governor and the Legislature in October 2020. HB 7065 (AOB) reforms one-way attorney fees, which is a primary incentive behind AOB abuse. Under the new law, attorney fees are governed by a formula that looks at the difference between a pre-trial settlement offer and final judgment. Depending on the difference between these two figures, the insurer, the assignee or neither could be entitled to recover attorney fees. All bill provisions become effective on July 1, 2019, except for provisions relating to attorney fees, which became effective when the bill was signed into law.

Osceola County Legislative Update On May 20, the Osceola County Board of County Commissioners voted to adopt an ordinance that will amend the Land Development Code. The ordinance made its way through a first reading in April and was approved by the Osceola County Planning Commission. Below are the proposed changes: •

The Osceola County Planning division has introduced changes to Ch. 3 of the Land Development Code. The most significant change is in the Future Land Use Designation (FLUD) and Zoning Correlation table (3.3).

The FLUD ‘Medium Density and Residential’ will change to ‘Medium Density and Intensity’ with an addition of Community Commercial Office (CO) to the zoning correlation. The FLUD ‘Office’ will be eliminated. The FLUD ‘Conservation’ will be changed to ‘Conservation, Natural Resources, and Utilization’ (3.3).

Within the Residential Uses section of Ch. 3 (3.6.1) there will be a change to section H. (Multifamily Homes Within Low Density Residential Districts). The change states, “Neighborhood-scaled structure that has the appearance of a medium to large single-family home and is appropriately scaled to fit sparingly within single family neighborhoods. Parking for such structures shall adhere to single family residential standards, occur to the side or rear of the property, and be screened from neighboring properties. The maximum lot size shall not exceed one-half (0.5) acre.”
