Short Sale Heaven by Veronica Malolos
Surely you jest! Is there really such a thing? Believe it or not, I recently had an experience with a short sale closing that I would consider being one that was made in heaven. My Seller had a First and a Second mortgage on his property. I rolled my eyes from the get-go thinking to myself “Oh no, not one of these!” I had a cooperative Seller who understood that he and his wife needed to be on the same page with their Short Sale and Foreclosure Resource REALTOR® (me) at all times. It was priced correctly and competitively with other distressed properties that had already saturated this market area. The following day, we found out that the outside A/C unit was stolen! That was definitely another eye-rolling moment right there. Within 13 days on the market, a wonderful REALTOR® brought my Seller a full price cash offer. I could tell that she was experienced and educated. I knew then that we had a good chance at this. The 4 months of short sale processing was grueling. The Lender of the first mortgage needed a higher net payoff. The Title Agent and I put our minds together to make the numbers work. The Selling REALTOR® did a fine job of negotiating for the best interests of her Buyer and I worked on negotiating for the best interests of my Seller in regards to the stolen A/C (by bringing the A/C insurance claim payoff to the table). We got the approval from the “First”. My processor was happy. Now if only we could get the “Second” to go along with the “First”. That didn’t happen until we had just 7 days left on the “First” approval. By this time, the Buyer was getting ready to walk. The Selling REALTOR® and I had a long conversation about how crucial it was that the Buyer stays with the process. She did a fantastic job at helping her Buyer understand the process and the importance of holding on. My processor escalated the file until finally
we got the approval from the “Second”. By this time we only had 5 days left on the original Approval. I prepared the property for inspection quickly. I had to get the Seller to settle the outstanding utility bills of his former tenant and get the utilities turned on for the inspection within 24 hours. The Selling REALTOR® was so efficient in getting the inspections done and we finally got word that the Buyer was moving forward with the purchase. The Title Agent worked on getting the closing package. The Buyer wired her funds and we were closed and disbursed right in the nick of time. This was a wonderful combination of the following: a cooperative Seller and Buyer, a determined short sale Processor, a fantastic Title Agent and 2 REALTORs® who communicated well and worked together for two common goals which are: 1. To work for the benefit of our customers and 2. To CLOSE THE DEAL! Over the years, I have been fortunate to meet so many solid professional REALTORs® through my activities at our association and those relationships really pay off by making complicated transactions run smoothly through trust and respect between fellow REALTORS® and Affiliates. This to me was a short sale made in Heaven! ■

Your leadership has spent a great deal of time engaged in the current real estate industry and public policy environment, as well as, making plans and setting standards for the future of the association. Here are a few highlights from July through September from your Board of Directors’ actions: *Approved a donation of $1 per member to the “Show our Troops We Care” program in response to a request from Wendell Davis, President of Florida REALTORS®. These funds will buy international calling cards to deployed members of the U.S. Armed Services – the item most requested by our men and women serving overseas. *Supported participation by President Veronica Malolos, President Elect Tim Weisheyer and AE Carol Platt at the AG Institute Candidates Forum, sponsored by our Farm Credit of Central Florida affiliate. *Recommended the candidates for public office election to OSCAR members and to Florida REALTORS® Political Action Committee for St. Cloud City Council, Kissimmee Commission, Osceola County Commission, Osceola County School Board and the Florida House of Representatives.
OSCAR Supports National REALTORS® Campaign For Military Families by Wendi Jeannin October 18, 2010 (Kissimmee, Fl): The Osceola County REALTORS® Association (OSCAR) continues its mission to support the troops announcing its partnership with the National Association of REALTORS® (NAR) HouseLogic Operation Home Relief. HouseLogic Operation Home Relief is a Facebook campaign to increase awareness, rally support and raise funds for USA Cares, a nonprofit organization that provides counseling and financial foreclosure assistance to post-9/11 active duty U.S. military service personnel, veterans and their families. The NAR launched HouseLogic a free, comprehensive consumer website about all aspects of homeownership. $1 will be donated to USA Cares every time someone “likes” the Operation Home Relief Cause page on Facebook and will match individual donations made to the cause, up to $20,000.

What’s In A Name? Your URL Means Business! by Kemp Howland, GRI, SFR OSCAR Technology Committee First, a definition: A URL is a name. It identifies something or someone. The initials stand for “uniform resource locator”. This is how we identify ourselves and our businesses on the internet. Our URL is our internet name. By definition, a URL describes a location and means for obtaining a resource. Example: yourbusiness.com. The first part tells who you are. The second part (the top-level domain) gives a clue about the type of work you do. A “.org” is usually a not-for-profit. A “.edu” is usually a school or university. A “.com” is probably a commercial venture. You can tell a lot about someone by looking at their URL. What does a name really mean? Let’s set the way-back machine (our time-traveling capsule) to the 15th century. Back then, if your name was Jack, and you were a blacksmith, you would probably be recorded in the local census as “Jack Smith”. If you were Steve, and you made wheels for wagons, your occupation was known as a wheelwright, so you would be known as Steve Wright. Sometimes, especially if you weren’t a skilled craftsman, you would be identified by where you lived, or spent most of your time. A guy named William who lived in the hills, would be called William Highland (get it? Highland = hill.) My own name, which is Kempton Sherman Howland, says a lot. If we were still back there in the 17th century, and I introduced myself, you would know right away that I was from Kemptoncroft (a sleepy little village in the south of England, with a fence or “croft” around it), and you would know that my family raised sheep (the name Sherman comes from “shear man” – the guy who shears sheep for their wool) and I must have come down from the mountains, because my last name (Howland) is a Teutonic mutation of the word Highland, or, from the hills. Apparently I would have been known as a hillbilly sheep farmer from a tiny fenced or walled village in southern England. That’s a comforting thought. Other cultures’ naming conventions are similar, if a bit less descriptive. If you met a woman from Russia whose name was Anna Simonova, you would know right away that her father’s name was Simon. This would be handy if you wished to marry her, as you would know where to deliver the dowry of three goats and 50 kilos of potatoes. In Scandinavia, you might meet a lawyer named Lars
Andersen. Chances are that, years ago, one of his ancestors was somebody named Anders, and Lars was descended from Anders’ son, or Andersen. (In Scandinavia “son” and “sen” are apparently interchangeable.) Simple, no? And Lars could have named his son Lars Larson. However, it could get complicated very quickly! Your URL is your internet name The point is, names mean something. Names tell others something about who we are and what we do. Naming yourself or your business on the internet is no different. Can you tell what these companies offer by looking at the URL?

If you have an opportunity to be distinctive and descriptive, why not do it? Does it make sense to spend millions of dollars to get users to understand what “BING.COM” does? That’s what Microsoft had to do. Why not just call it “findwhateveryouwant.com”? OK, that might be too simplistic, but you get the idea. When you name yourself for the entire world to see, do you want to be known as Maryanne@aol.com, or Maryanne@ homesforless.com? How about Joe@gmail.com or joe@ nodownpaymenthousing.com? Do you think it might drive more customers to your door if you were known for what you do? New Opportunities Arise Almost Every Day Today we have opportunities to take advantage of a marketing solution that did not even exist twenty years ago. Some of us do a better job than others. Some of understand how it works, while others are still learning. When your association identifies an opportunity for its members, it makes sense to pay attention. In the coming months, there will be fantastic opportunities for us, as Realtors®, to take advantage of URL naming that has not been available until now. Watch your association’s e-Blasts for information on how you may benefit from a new set of top-level domains (like.com, .net, .edu, etc.) that will soon be available. Here’s the real argument for capturing as many URL’s as you can which could be beneficial to your business: If you

don’t grab your URL, someone else can (and probably will!) If you haven’t thought up a creative way to enhance your brand through the use of a URL, get to work on it today. If you have one or more URL’s that you currently own, protect them by extending the subscriptions. And make sure, when you hear that a new top-level domain is available, to get your brand in line with it quickly, before someone else grabs it. You simply must protect your brand. This is good advice for anyone who uses the internet to market their business. Our association must follow its own advice. If a new top-level domain becomes available, it is imperative that OSCAR identify itself through the new domain, if only to supplement the existing URLs. It’s not so much the great benefit we might derive from a URL
such as “osceolarealtors.mls”. It’s the damage which would inevitably occur if some other, less principled organization made it theirs. It’s time we all took a critical look at how we present ourselves to the on-line world. Capture as many URL’s as you can to protect your brand and encourage customers to use your services. Protect your URL, your top-level domain, and your overall branding strategy. And insist that your association does the same. ■ Kemp Howland is a career-long member of OSCAR. The rules were very simple: 1 - Each lumberjacks was allowed only one saw. 2 - All trees to be cut down are marked and these are the only trees that are counted. 3 - The lumberjacks who cuts down the most trees within one hour will be the winner. 4 - The lumberjacks were identified by being named A and B. After the first 15 minutes the score was A-11…B-10 After the next 15 minutes the score was A-19…B-18 After the next 15 minutes the score was A-26…B-27 After the next 15 minutes the score was A-32…B-36 AND THE BIG MONEY WINNER WAS B! Because the winner stopped and “sharpened his saw” after each 15 minutes! Yes, it took B time to sharpen his saw, but at the same time, A’s saw was getting more dull each 15 minutes! A was cutting down fewer and fewer trees while B was sharpening his saw and steadily increased the winning number of trees cut down! This is a very old proverb (example: “A little knowledge is a dangerous thing”) that compares the lumberjacks to a hard working REALTOR®. The reasoning was that we must all STOP and learn how to list and sell real estate and be the WINNER in our contest! ■

Licensure requirement for short sale negotiations Since the passage of 6% ZKLFK LPSOHPHQWV IHGHUDO UHTXLUHPHQWV RI The Secure and Fair Enforcement for Mortgage Licensing Act of 2008, many have asked if a real estate sales associate or broker may negotiate a short sale for a fee without having to be licensed as a mortgage broker through the Office of Financial Regulation under Ch. 494, F.S. Following are general guidelines: May a real estate licensee negotiate a short sale? On July 31, 2009, Gregg Morton, Chief Counsel for the Office of Financial Regulation, issued an opinion regarding whether a real estate licensee who is engaged in short sale transactions must comply with section 494.00296, F.S. Morton assumed the following facts: A real estate licensee is asked by a client to list a house for sale. The licensee ascertains that the fair market value of the house is less than the amount owed. The licensee enters into dialogue with the client’s lender to see if a short sale is acceptable. The only remuneration sought by the licensee is a commission on the sale. No additional fees are sought by the real estate licensee for the negotiation or dialogue with the lender. May a real estate licensee receive an upfront fee for the negotiation of the short sale? Morton stated that he is assuming the licensee is not paid upfront and does not receive an advance fee, and that the commission would not be set higher or be split more favorably with another real estate licensee based on the additional work involved in negotiating with the mortgage holder. Morton added that as long as the only remuneration sought is the commission for the sale of the property and no other fees are collected for the dialogue with the lender, the activity mentioned would not fall under the section 494.00296, F.S. Note this is the opinion of Morton, chief counsel, and not the opinion of the Office of Financial Regulation as a regulatory body. Do I need a mortgage broker’s license to continue to list and sell short sales? No. If you enter into a dialogue with the lender to see if a short sale is acceptable, and if you do not charge an additional or upfront fee or increased commission for such a dialogue, you would not be required to get a mortgage broker license, according to Morton. Read his letter here. I have created a separate company which charges additional fees for the negotiation of short sales. There is so much additional work with these transactions. Why am I unable to charge for it? If you act outside of the parameters described above (i.e., charge an upfront fee, additional fee or additional commission; create a separate company to negotiate short sales; give advice on deficiency or tax liability; or give advice on the best solution for a distressed owner of property) you could be engaging in mortgage brokering services or tax consulting services without having a valid license, or you may be engaging in unauthorized practice of law. Best Practices Good Advice The Dos and Don’ts of Online Advertising The role of trademarks and domain names is an important one and the case discussed here is only one of many which have arisen involving major corporations. The issue is also of importance in the REALTOR® community as the expansion of real estate business onto the Internet continues to accelerate. It will be important for Association’s to monitor not only the use by members of the Association’s membership marks on the Internet but also their own to assure all such uses comply with the rules governing the use of the membership marks. There are no special rules which must be learned for the Internet, but members as licensees authorized to use the membership marks must abide by the rules on the Internet the same way they do in any other media. The Trademark Protection Program treats the Internet as just another of the ways by which members may promote their services and the properties they are offering for sale. As such the rules governing the use of the membership marks on the Internet, including as domain names, are the same ones governing all uses of the membership marks by members. Members must observe these rules in the same way the must abide by the NSI domain name rules (those rules can be found at www.internic.net). The term REALTOR®, whether used on the Internet, as part of a domain name or in some other fashion must refer to a member or a member’s firm, may not used with descriptive words or phrases and should be separated from the member’s name or firm name. Thus uses such as number1realtor.com, firstrealtor.org or realtorproperties.com are all incorrect. Uses such as johndoe-realtor.com or abcrealty-realtors.com on the other hand would be examples of what could be done as a part of domain names. The membership marks, and particularly the REALTOR® block R logo should not be used as hypertext links at a web site as such uses can suggest an endorsement or recommendation of the linked site by your Association. The cost involved in correcting these types of misuses emphasizes the importance of communicating the rules and their application in cyberspace to members at the earliest possible time so that decisions related to domain names and designs for websites can include trademark considerations. As the rules themselves have not changed, members need only be reminded that the Web is not an unregulated wild west where anything goes, and the rules governing use of the membership marks do apply to uses on the Internet. As you know the terms REALTOR, REALTORS, and REALTOR-ASSOCIATE, as well as the REALTOR block “R” logo are federally registered collective membership marks. As

such, these marks may only be used by members of the local Board and the National Association. Any unauthorized use is an infringement of the National Association’s legal right. Use by a nonmember is misleading and may be a violation of the real estate license laws of your state. Membership in the Board of REALTORS is entirely voluntary and while we sincerely hope you will rejoin the Board, we respect your right to choose not to do so at this time. However, at the same time, we must ask you to respect our rights in the marks we use to identify individuals as members. (This is the exact verbiage that came from NAR legal department concerning a former member) When surfing the Web for real estate homepages, it’s quite common to come across sites belonging to REALTORS®. If you are looking to add your own electronic presence on the Internet, it is easy to get caught up in designing your own web page and choosing a domain name which will capture the attention of surfers and make you easily identifiable. REALTORS® often want to use the REALTOR® marks as part of their domain name or address to distinguish themselves, but they must keep in mind that there are rules governing proper use of the REALTOR® marks that must be adhered to at all times regardless of the media used. These rules are found in the National Association’s Membership Marks Manual, a reference manual explaining proper use of the REALTOR® marks including examples of correct and incorrect uses. Here is a brief list of the principle rules affecting use of the REALTOR® marks in domain names: • The term REALTOR®, whether used as part of a domain name or in some other fashion must refer to a member or a member’s firm. • The term REALTOR® may not be used with descriptive words or phrases. For example, Number1realtor.com, numberonerealtor.com, chicagorealtors.org or realtorproperties.com are all incorrect. • For use as a domain name or e-mail address on the Internet the term REALTOR does not need to be separated from the member’s name or firm name with punctuation. For example, both johndoe-realtor.com and johndoerealtor.com would be correct uses of the term as a part of domain names and jdoe®realtors@webnetservices.com and jdoerealtors@ webnetservices.com are both correct uses of the term as part of an e-mail address. • The REALTOR® block R logo should not be used as hypertext links at a web site as such uses can suggest an endorsement or recommendation of the linked site by your Association. The only exception would be to establish a link to the National Association’s web site, Realtor.com. The public has adopted the use of all lower case letters when writing domain names, even those containing trademarks. Therefore, for purposes of domain names and internet addresses only, there is an exception to the rule on capitalization of the term REALTOR and it may appear in lower case letters. Whether you use traditional print media or the Internet, it is essential to use the REALTOR® marks in accordance with the rules and guidelines of the National Association. The REALTOR® marks should only be used to denote membership in the NATIONAL ASSOCIATION OF REALTORS®. ■
Cell Phone Etiquette Are You a Cell Phone Sinner? Mobile Mistakes Could Wreck Your Career In spite of their convenience and necessity, cell phones are now another means whereby we can irritate our fellow man. Theaters, restaurants, trains, even public restrooms, are no longer safe from the possibility of an untimely call. Two weeks ago I even heard someone having a cell conversation in a toilet stall. At that moment I knew that if ever there was a reason for voicemail I had found it. Somehow cell phone ownership seems to affect common sense. And on a more serious note, poor cell phone etiquette can ruin a career. Are you committing any of the following sins? SIN 1: Annoying or Cutesy Rings The cha-cha, the latest pop single, your lover’s voice-I don’t want to hear any of these, and neither does anyone else. Have mercy on the general public when picking a cell phone ring. Your latest Romeo saying, “Ooh, baby, baby” may be funny to your friends, but it’s a credibility wrecker at the office. Believe it or not, that actually happened to a friend of mine. She went to a business meeting and forgot to turn off her ringer. Midway through the meeting, her purse started talking. She had a fancy ring that was a recording of his voice telling her how beautiful she was. Thank goodness he didn’t use her name, so like everyone else, she pretended she didn’t know the source of the mysterious voice. SIN 2: Holding Court “We just landed, and I’m waiting to get off the plane.” I must hear that from at least four or five people every time I take a Flight. In the midst of all the benign information that follows, what these rude cell phone users don’t say is, “There is a short, homicidal looking woman standing next to me. I can tell that she is getting ready to beat me senseless for talking loudly about nothing on my phone.” People, please: if there is nowhere for the rest of us to go, think about whether you really need to have that conversation. SIN 3: We Can Hear You For whatever reason, many people talk at top volume when they are on a cell phone. Microphones are sensitive. The person you are calling can hear you. We don’t need to. Enough said. SIN 4: Your Help Is Ruining My Conversation In the last few months; I have seen signs in fast-food restaurants and retail stores that say something to the effect: “We will gladly help you when you are done with your cell phone call.” It doesn’t surprise me. Many times I have watched people talk on phones while in line (see Sin 2) and then not even address or acknowledge the employees whose assistance they need. Simple courtesy will go a long way toward getting you on your way. SIN 5: Taking a Call When in a Meeting As the old saying goes, just because something can be done doesn’t mean that it should be done. Whether you have called it
yourself or are merely attending at someone’s request, invitation, or order, a scheduled meeting is not the time for cell phone calls. The rings alone are intrusive; answering them is an even worse breach of etiquette. The message received by those at the meeting is that they are less important than the disembodied voice coming through the cell. Unless your intention is to make others feel insignificant (definitely not a cool move if your boss is waiting for you to get off the phone), then don’t answer, turn it off, and get it out of sight. SIN 6: Are You Talking to Me? With the invention of hand-free cell phones came the doubleedged sword of convenience and mistaken identity. Who among us has not been taken aback by the presence of another human trawling the aisles of Wal-Mart while actively engaged in what, on initial inspection, would seem to be an animated discussion with himself or herself? After giving this person, who is clearly having a psychotic episode, a wide berth, we realize there is actually a streamlined headset attached to the person’s skull yet well hidden underneath a hat. At the risk of being mistaken for a pop singer or air traffic controller who has wandered away from work, leave the headset in the car. SIN 7: Too Much Information Discussing anything of a private nature that others within earshot might be able to hear is unwise on a number of counts. Think about it: do you want your coworkers to know the results of your latest lab tests your doctor’s office has just called to share with you? or see your “dark side” when your contractor calls to tell you his work will take two months longer and $2,000 more than he had originally stated? or hear your travel agent has booked you on that cruise to Nassau for the same week you’d requested to have off for surgery you so desperately needed? Unless you want to raise a lot of questions and eyebrows, take calls from those who probably have unpleasant, upsetting, or incriminating information when you have total privacy. On a very serious note, too much information given over a cell phone while others are in your presence could cost you dearly. A friend recently shared with me his experience of standing behind a woman talking on her cell to a repairman who was coming to her home to do some work while she wasn’t going to be there. By the end of the call, my friend had learned the woman’s name, address, neighborhood (complete with directions on how to get there), and the location of the spare key she had left for the repairman to gain entry to her house. Had he been so inclined, he could have reached the woman’s place before the repairman and cleaned her out-or worse. Go forth, and sin no more. My Florida Regional MLS Introduces Scout for SafeMLS A few weeks ago MFRMLS announced plans to implement a security initiative designed to provide optimum protection for valuable MLS and customer data by preventing unauthorized access and account sharing. This ensures valuable data doesn’t end up compromised and assures that everyone using the MLS is participating in the cost of providing the service. This new security initiative will begin on September 8, 2010.
