JACK ELBON
PUBLISHES BOOK ON LIFE EXPERIENCES OSCAR member, Jack Elbon has added another credential to his already long and distinguished resume …that of Author. Jack has recently completed and published a book based on his own personal life experiences. The book, titled “My Journey; West Virginia to Korea to WVU”, chronicles his experiences growing up in the poverty of the Great Depression and carries through to the mid-50s in which he served bravely in the Korean War. Jack’s recounting of the characters in this book (the real people he met) have had, he said, a profound effect on his life, and he
shares them with the reader in hopes that they too can benefit from what they’ve had to say. OSCAR is home to a diverse group of people, and it’s always a thrill to see such creative talent within our ranks. Over the years, Jack has filled many roles - among them Fire Chief, Swim Wear Designer, REALTOR®, and now author. It takes a great deal of perseverance to commit one’s story to paper and we congratulate him on seeing this creative endeavor through. Much like his other career ventures, we are sure this one will be met with a well-deserved success.

APPOINTED TO CODE ENFORCEMENT BOARD OSCAR member, John Goldsborough has another achievement to add to his list, having just been appointed to the Osceola County Commissioner’s Code Enforcement Board. He was very recently appointed to the Resort and Second Home Forum Steering Committee as well. As a member of the Code Enforcement Board, John will participate in the conducting of hearings in regards to
code and ordinance violations and enforcement. “John Goldsborough is an avid participant in the community, bringing his real estate expertise to the table in his various committee endeavors. With John on their side, Osceola County’s Code Enforcement Board will be ably backed by a knowledgeable and highly skilled community leader”, said OSCAR Association Executive, Carol Platt.

APPOINTED CHAIR TO OSCEOLA COUNTY SCHOOL BOARD
Big congratulations to Tim Weisheyer who was appointed Chairman of the Osceola County School Board. Tim was selected from other board members to lead and set agendas. Tim has a long record of community involvement and leadership, having been an active member on OSCAR’s own board, even serving as 2011 President. Tim has also made this Association proud with his appointment to the Impact Homelessness Task Force in Osceola County. We know the school board is in good hands. And further congratulations are due to Tim for receiving the Small Business of the Year award by the Kissimmee/Osceola Chamber of Commerce’s Osceola Business Awards.

10 tips for

Tax representation is becoming like the condiments aisle at your local grocery store. There are too many choices and no way to tell what’s best. Here are 10 do’s and don’ts to follow before hiring someone to represent you before the IRS: 1. Do ask for a free consultation – You should not be required to pay anything to a Tax Lawyer or CPA just to find out whether you need to hire him or not. The purpose of the first consultation is not only for you to determine whether or not you wish to engage the services of this particular tax professional, but also to allow the tax professional to determine whether or not he wants to take your case. In short, the initial consultation benefits the lawyer as much as it does the potential client. 2. Don’t hire anyone who tries to scare you into “acting now” - We have heard of many cases where the would-be tax representative told a potential client that he or she could go to jail if they didn’t hire them immediately. This is immoral. A good tax representative will make you feel less, not more, anxiety about your stressful IRS problems. He does this by telling you the truth: There is light at the end of the tunnel and if you are truly committed to getting back on track with your taxes and accounting you can do so and the IRS will be appreciative of it. Remember, it is extremely rare for the IRS to pursue criminal charges against everyday taxpayers who for one reason or another find themselves behind in their taxes. 3. Don’t hire anyone who uses sales gimmicks to try to get you to hire him - Remember, you aren’t buying a used car or cheap furniture and you shouldn’t be treated as if you were. You want to hire a serious professional to handle this critically important matter for you, not “Dan’s Discount House of Holy Worship.” 4. Do hire a Lawyer - Many CPAs and IRS Enrolled Agents are experienced and competent in the area of IRS disputes, but only statements you make to a lawyer are protected from disclosure under the attorney-client privilege. Non-lawyers can be forced to disclose in a hearing or trial everything you tell them. 5. Don’t hire someone who’s advertisements or promotional materials offer “pennies on the dollar” IRS settlements.–This is a scam. These unscrupulous con men are telling you they can do something that they know you wish they could do. In other words, these individuals are trying to manipulate you by telling you what you want to hear, not what you need to hear. It is preposterous that any honest tax professional would or could tell you what she could do for you without first analyzing your case. 6. Don’t hire anyone who sends you an unsolicited letter in the mail after you’ve been served with an IRS lien.– These people scour the

newspapers and public records looking for anyone who has had a tax lien filed against them. Then they send mass mailings to them offering - you guessed it - “pennies on the dollar” settlements. A good and reputable IRS representative doesn’t need to do cold calls to get clients. 7. Do contact the local bar association to find out if the representative has been sanctioned for misconduct- This is another reason to hire a lawyer/CPA. Non-lawyers and non-CPAs are not regulated and, therefore, it is impossible for you to find out their disciplinary history. Given a choice, isn’t it just common sense to hire a tax professional who actually belongs to a profession that closely monitors his or her ethical behavior and competence? 8. Do ask detailed questions about the representative’s background and experience – You have a right to know everything about a potential tax advisor before you give them any money (see number 1, above).
Ask the representative the following questions: a. Have you ever tried a case in United States Tax Court? – If the answer is no, it tells you that if your tax dispute doesn’t get resolved at the administrative level you will have to hire another representative to take the matter to Court. b. Can the IRS or the Courts make you disclose what I say to you? Only a tax lawyer can say “no” to this question. (See number 4, above) c. Have you ever been reprimanded or sanctioned by any state bar association or department of professional regulation? - You can check this out yourself, but it’s a good idea to ask the potential representative to gauge his reaction. If he gets defensive, you’ve got your answer. 9. Do ask to meet with the person who will be working on your case. The person you have the initial consultation with may be an attorney, but the person he or she delegates the work to might not be. There is nothing wrong with a lawyer who has non-lawyers assist him or her in handling case files, but you have the right to meet the person who will be doing either all or part of the work in your case. 10. Don’t hire the first person you speak with unless you are certain it is the right person for you. Tax matters are simply too important for you to hire the first person you speak with merely because it’s more work to speak with several candidates. It’s always a good idea to get a second opinion.

...And you’d better know them before you try to deal with the IRS because it is highly likely that the IRS official you will be dealing with either, a) doesn’t know them; or b) isn’t particularly enthusiastic about your exercise of them. There have been three Taxpayer Rights bills passed by Congress in the last twenty years. Here are some of the more critical provisions of each bill:
Taxpayer Bill of Rights I • • • •
Taxpayers have the right to legal representation similar to that of a criminal defendant Taxpayers have the right to have the IRS processes explained to them Taxpayers have the right to sue the government for damages caused by IRS officials The IRS cannot evaluate collection employees based on their collection results
Taxpayer Bill of Rights II • • • • • •
Established the position of Taxpayer Advocate with higher level of independence and authority to assist taxpayers Required IRS to give taxpayers 30 days written notice before altering, modifying or terminating an Installment Agreement Expands IRS authority to abate interest accruals on delinquent tax liabilities Granted Tax Court jurisdiction to review for abuse of discretion the IRS’s denial of interest abatement Shifted the Burden of Proof to the IRS to show substantial justification for its position against a taxpayer Allowed taxpayers to recover a civil penalty up to $500,000 for IRS misconduct

013 Content creation and syndication, in a nutshell, sums up what I’m sharing with you here, and it’s immensely powerful. You create content, in the form of short articles, and syndicate that content so that it is freely re-published and publishable by others. For example, in article directories (where the articles can be accessed for further republication), by ezine publishers, and on other websites like blogs. You can advertise this resource to your newsletter subscribers or blast it out on social media via paid ads to really get some traction. People love free content but make sure you clearly state they have to link to your site in order to use it. This is good for SEO. This is also often referred to as article marketing. But I go beyond the traditional meaning of that term to make content creation and syndication even more powerful. So What Exactly Is Article Marketing? In its most basic form, it’s about creating a win-win situation between yourself (as the content creator) and publishers of that content. What Is Syndication and How Is It Done? Syndication is sending your content out to drive traffic to your website. People don’t know who you are until you go out to where they are to tell them. This can be done in an automated fashion or manually. Later we will discuss how to accomplish this. Some examples of going to where the people are is setting up opt-in pages and creating an offer for people to trade their emails in exchange for a gift, whitepaper, etc. Once you’ve collected emails proceed to a monthly newsletter. Another way to do this is posting your content to your social media outlets. Another option might be Podcasting on a regular basis. This is quite a commitment that shouldn’t be taken lightly and you need to be consistent. Make sure you enjoy this and have a long term plan for the future.
Syndication can be done in 2 ways and you may be asking yourself, “Which is more effective?”. Both would be the correct answer and let me spell them out for you. When you post an article to your blog in WordPress or whatever the platform it can be automated. I stress When you the word CAN because I post an article in know for a fact that WordPress WordPress can be set to auto or whatever the publish your articles to your platform it can be favorite social media outlets automated which is super convenient. As for the other web platforms it’s a toss up, some offer that functionality and some don’t. The other way is to manually share via your favorite social media tool [i.e. Bufferapp, Hootsuite, etc.]. I prefer Bufferapp but it does have some limitations. Until just recently Bufferapp wouldn’t post to Google+. Now that it does I really am enjoying it. I prefer this app because it is less confusing to use than Hootsuite and more intuitive. Sometimes less is more and in this case it is for me. Both Bufferapp and Hootsuite offer free accounts but I will leave this decision up to you to fit your needs and organization’s goals. The free account limit the number of social media outlets you can post to in both tools by the way. To learn more go here: Bufferapp.com or Hootsuite.com Another way is heading over to a blog that is extremely active in your niche or business vein and ask the site admin to let you guest post to their blog. There is a right and wrong way to approach this. Your articles need to be informative and not “salesy”. Think of those reading the articles not about selling them something. If you add tremendous value then the sales will come in time. You could also go the route of least resistance which isn’t as good as what I just mentioned but it works and is less time/effort on your part. Oh, did I mention it’s cheap?! Think of this service as a personal assistant to building your value online. It’s called SubmitYourArticle.com and they charge $2 per article submission.

The Association has recently received several phone calls regarding questionable and/or unauthorized access to listed or managed properties. The Code of Ethics and Arbitration Manual, “Pathways to Professionalism” states in part, that you should: “Never allow buyers to enter listed property unaccompanied.” “Never allow unaccompanied access to property without permission.” “Enter property only with permission even if you have a lockbox key or combination.” The Code of Ethics addresses access to listed and/or managed property as follows:

Standard of Practice 3-9 REALTORS® shall not provide access to listed property on terms other than those established by the owner or the listing broker. (Adopted 1/10) Violation of the Code of Ethics can result in fines of up to $5,000, suspension of membership and/or additional sanctions. Also, Supra Rules prohibit the sharing of any electronic SupraKey product with anyone, subject to a maximum fine of $5,000 and/or suspension of Supra services.

Our Global Alliance Committee hosted this special evening event celebrating global real estate in our multicultural association this fall. The event brought together people from all over the world to talk about their culture’s traditions and ways of doing business - valuable information for anyone interested in doing international business which is so prevalent in Central Florida. The event was quite a success, but the Global Alliance is always seeking new membership to grow its ranks and effectiveness. By the way, the Global Alliance recently earned the Gold Ctouncil award from NAR, a high achievement considering only 27 associations out of over 6,000 nationwide, received any recognition for these efforts. We’ve all heard this before, but the saying always holds true. You need to buy the right house, in the right town, on the right street, that meets your needs and goals. Central Florida is the all-time favorite area for the British Canadians and many other international buyers, namely Orlando and Kissimmee. This area draws in big crowds and is a ‘go-to’ destination for families due to the number of attractions, including Disney World, Universal Studios, Busch Gardens and Sea World. Central Florida also is a hub for avid golfers boasting the best courses in the state. Orlando alone is home to over 110 golf courses, all within a 45 minute radius. Let us not forget the shopping! There is abundance of shopping malls and outlet stores within the region, offering everything from high street fashions to high-end designer brands. Most people buy a property located in a community zoned for STR’s (short term rentals) due to flexibility reasons. Owning a home in this type of community offers a number of options to homeowners, such as:

Living in the property full time Using the property as a year-round, short term rental property for vacationers Leasing the property to long-term rental tenants Renting the property during the times you are not using it
On the flip side of the coin you cannot rent short term (less than 7 months) in an area that does not carry the required zoning. Central Florida’s climate is warm all year round, and there is less rain than in coastal areas. Central Florida’s popularity has resulted in an ever booming healthy short term rental market, which makes this part of Florida a great choice for investors and second home owners. Although Orlando is central to the state and has no beaches, its location offers easy access to 6 beautiful beaches all within a 90 minute drive or less. Driving to the beach offers spectacular views of this beautiful state. For those interested in seeing the Gulf Coast beaches, there are 7 beaches that can be reached with a 2 ½ hour drive from Orlando.

For a long time, photography and video have been looked at as a piece of art or perhaps just a form of entertainment. However, now that we live in a world where the internet is our eyes to everything, photos and videos play a bigger and bigger part of marketing online. Companies who use social media effectively with photography and video see dramatic online following and loyalty. So as a real estate agent, you’re probably thinking: How does this help me? The answer is simple; Pictures are YOUR gateway to getting the attention of other agents and individuals searching through properties. In this article we will outline some of the considerations to make when purchasing a camera. When people look at digital cameras, the very first thing they usually compare is the available megapixels. Perhaps though, this is not the first thing you should be looking at. Let’s face it, even our phones these days take HUGE photos. If you look at what a megapixel is, it has nothing to do with the clarity, it has everything to do with the size of the photo. Let me also point out that you will be uploading these photos *online* which will most likely compress your large photos to a smaller one anyhow. Here are some additional things to think about when buying a camera: Lenses/Zoom - Cameras with detachable lenses will be more flexible, but not necessarily better for you. DSLR cameras generally come with one lens, but around the holidays at the big box stores, you can find packages including more than one lens. This can really make taking the leap into a DSLR more affordable. If you plan on going with a Point and Shoot you can look at the digital zoom. These come pretty standard since you don’t have a manual lens to adjust. In addition, look for “Image Stabilizing” abilities in either your DSLR lens or your Point and Shoot. This will help. FPS - This acronym stands for Frames Per Second. The stripped down version and application of this feature mainly applies when shooting objects moving at high speeds, for instance, your son’s soccer game. Point and Shoots will not be able to keep up with shooting crisp clear pictures at a high rate. Some DSLRs can shoot close to 12 FPS but more commonly it’s around 5. LCD Screen - If you plan to take a look at the pictures you took while on your camera to detect lighting conditions and verify exposure, you should certainly factor in the size of the screen. 2.7”-3” is going to be a

pretty standard size. Keep in mind that the larger the screen the more battery you will drain. Speaking of battery...… Battery - People often overlook battery life. In addition to the duration of the charge, also keep in mind that if the camera does not take AA batteries but rather uses proprietary rechargeable batteries, you may want to buy extra batteries online. These can sometimes come in package deals as well. Let’s wrap this all up: After coming out of the holiday season, lots of cameras will be for sale at your local electronics store. With this knowledge you have now, you should be able to judge for yourself what you are looking for. Keep in mind what you are shooting: If you are just shooting pictures of houses, a point and shoot is fine. Are you shooting high speed sports and want more control over the images? If so, then you may want to make the leap to a DSLR camera.
