Third Quarter Presidents Message: We attended the NAR mid-year meetings in Washington DC in May and had some very productive meetings and committee assignments on the national level. I personally served as a Director and member of the Business Issues Policy Committee. We have multiple members involved with different committees, as well, and I wanted to give a shout out to Wanda Linscott, Tim Weisheyer, and Veronica Malolos for their involvement and efforts. In addition, thank you to Joyce Malone and Carol Platt for their committee involvement, efforts, and participation in making this an effective trip. Carol was part of the Smart Growth Advisory Group and Local and State Issues Mobilization Committee. Member, Cheryl Grieb also took part in the Smart Growth Advisory Group with Carol. Veronica Malolos held a spot on the Commercial Real Estate Research and Advisory Board and the Housing Opportunity Committee, while Tim is a member of the Strategic Thinking Advisory Committee. Also, Danny Hernandez serves on the Multicultural Real Estate Leadership Advisory Group.

Some of the items that came out of the meeting are noted below and are talking points from the NAR Board of Directors meeting and the action items we heard and passed.

On the local level, there are some great educational classes coming up that I would encourage you to attend. Also, congratulations to our association Relay for Life team, who did a tremendous job in raising funds in the fight against cancer.

Consumer Advertising Campaign - The board continued for three years the annual $35 special assessment to fund the consumer advertising campaign. Results of a member survey conducted in April 2016 show that 87% of REALTORS® favor NAR’s advertising program and 88% of REALTORS® would like to see more NAR advertising that promotes real estate activity and advances the REALTOR® profession.

Student loan debt - In response to growing concerns over the impact of student debt on the ability to buy a home, the board adopted a policy that seeks to allow student borrowers to refinance their loans and streamline income-based repayment programs. Additionally, NAR supports proposals that promote student loan simplification, clarity, and education. And NAR will take steps to ensure that mortgage underwriting guidelines related to student loan debt are standardized and do not impair home ownership.

Homelessness - In response to homelessness and rising housing insecurity, the board adopted a policy urging state and local REALTOR® associations to work with their communities’ stakeholders to develop innovative and proactive strategies to aid citizens experiencing homelessness or facing problems paying for housing.

In closing, I would like to remind members of the importance of contributing to our REALTOR® Political Action Committee. Your $20 fair share contribution funds are needed for advocacy on many issues that affect not only our industry but private property rights. It is a critical component in The REALTOR® brand remaining The Voice for Real Estate! But, if you are looking for a more social way to contribute to this important cause, our annual RPAC Auction will be taking place at the Osceola Council on Aging on August 6th. This is one of our most well-attended networking functions, with food and drinks provided. All money raised goes directly to our PAC which in turn works hard for us to ensure our success as REALTORS®. Watch your emails for further details. I look forward to seeing you there.

Technology is evolving rapidly and so is our nation’s vulnerability. Many purchases, transactions, and exchanges are taking place in the virtual world. Our economy, utilities, businesses, and databases all depend on the internet. It is predicted the next World War will take place in the cyber world. Should someone with detriment reasons decide to cause a security breach, many lives could be compromised and our nation would be devastated.

The funds given to me would help me educate myself so I could help prevent or fight such threats. I want to help keep potential detriments at bay and have cyber-criminals prosecuted to the full extent of the law. The cyber-security field is expanding and in great demand. Unfortunately, many females and minorities are no on board. I would like to be among the few who have decided to do what it takes to serve the people.

My finances are working as a barrier against me when it comes to gaining an education. My family receives different types of government help, and even then it isn’t enough to get by.

My mother is disabled and is the only parent in my home. None of us are currently working, but want to break this cycle. The funds would help me break the barrier and move forward. I would be the first in my immediate family to receive a college degree.

The National Association of REALTORS® Legislative Meetings in Washington, DC ushered in a number of changes in our associations, but our 2017 NAR dues rate was not one of them. 2017 Dues will remain at $120 a year! Learn how you can use these nuggets from successful brokers and tech entrepreneurs to strike a more cultivated tone online.

At the Emerging Business Issues & Technology Forum during the REALTORS® Legislative Meetings & Trade Expo this month, we learned about some low-cost tech tools worth trying. But the panelists also shared how they promote their businesses on social media without turning off followers or running afoul of social algorithms. Take advantage of their knowledge of how these sharing platforms work to elevate your web presence to the next level.

Marry Your Schedule With the Right Content You may have heard the common advice to post at certain times of the day when more people are using social media. But the best way to engage your followers

is giving them what they want at the right time. Axay Parekh, operating partner at RE/MAX Life in Tulsa, Okla., told attendees that what they post matters just as much as when they post.

“In your morning post, talk about something upbeat,” he said. “In the midday check-up, post what you’re doing or shout out about something going on in the evening.”

At night — which Parekh called “wine time,” when people are likely to be relaxing in front of their screens — post with more personal interaction in mind. “Talk about what happened during the day,” he said. “You want to post things that people can relate to. You want to post something genuine.”

Game the Facebook Algorithm

“Ask yourself: If another agent or another person were posting this, would I want to watch it?”

Most social media platforms are secretive about how and when they decide to surface posts in users’ news feeds, but there are a few things you can do to game the system. Amy Smythe-Harris, co-broker–owner of Urban Provision, REALTORS®, in Houston, said Facebook may recognize your posts as being fresher if you react to the engagement they have garnered. As soon as you notice a comment on one of your posts, you can “bump the post by liking their comment,” she added.

Also, Riedmann cautions that a Facebook Live chat may take a while to attract viewers, so users should be comfortable in front of a camera for a significant amount of time. “You don’t want to close it too quickly because you need to give people a chance to join in,” Riedmann said. “Don’t think just because you only have one or two followers you should quit. That’s like deleting your Instagram post because it didn’t get enough likes.”

Smythe-Harris also said you can help other real estate professionals by communicating with them publicly on Facebook, rather than via e-mail. For example, if you

Who in your area would you recommend for this situation?” They’ll appreciate the fact that you reminded their followers of their real estate work in an indirect way in your post, and hopefully they’ll thank you by returning the favor. “You can do that with each other and nobody will tell,” Smythe-Harris said with a smile.

Parekh’s tactic requires thinking ahead. Before he makes an important Facebook announcement that he wants his whole sphere to see, he posts something silly he knows people will like, which boosts his engagement numbers. He told attendees it’s usually OK to be goofy, as long as you’re being genuine. “I take chances.

There have been one or two times it hasn’t paid off, but usually it does.”

Go Live Another way to make Facebook happy is to use the new features the platform is promoting. Jacy Riedmann, vice president of real estate photo and video company Amoura Productions in Omaha, Neb., focuses much of her live social media efforts on Facebook Live due to the prominent placement the social media platform provides for those who use the new tool.

“It’s like any kind of new media; you can be a little sloppy on it, but people are going to want you to tighten the reins,” Riedmann told the audience, adding that it’s important to consider the subject matter carefully, with community events and live chats being good options.

Get Objective Smythe-Harris suggested attendees find a sort of token they can use over and over again to represent their businesses online. “Come up with a social object that works for you,” she said. Her business had custom wine glasses made with their logo on them. She and her colleagues bring the glasses to events and post photos of them on social media as a fun yet subtle way to remind followers of what she does for a living: “I’m what you would call a subliminal marketer.”

Hash It Out While hashtags on Twitter whittle down your available character count, and too many Facebook hashtags may make your post look like spam, Instagram is a hashhappy place for Riedmann. “I break the rules. I use a lot of hashtags,” she told the audience.

She noted that hashtags can help people who don’t know you, but are interested in the area in which you work, find and follow you. “Somebody who wants to learn more about a neighborhood will find you, and then you’re the expert,” she said, adding that this is a gentler way of letting people know you sell real estate. “You don’t have to say it if you show it.”

Parekh noted using certain hashtags consistently can cause your followers to associate those tags with you. Not only does he incorporate his community’s identity in his profile names (axtulsa), but he also often adds the #TulsaRealEstate hashtag to his posts. “You want to brand yourself,” he told the audience. “People will start seeing it over and over again.”

A serious question in the recent past with social or online marketing is where is the ROI [Return on Investment]?

Another question might be, “What is ROI in marketing?

Does online marketing even have an ROI?” This question mystifies those in traditional marketing circles. Heck, even within social media marketing there is a lot of confusion here. Some social and online marketers have tried to spin ROI’s meaning to things like “Return on Influence”. This is completely absurd if you are investing money into these areas. You need dollars and cents to make sense of this.

So what is the answer to ROI in Marketing?

This is easy to measure with PPC or pay per click because there is a definitive dollar amount associated with your ads. Google can definitely answer this question succinctly with AdWords. Recently I wrote about Facebook’s paid ad platform that I’ve been experimenting with, and have been pleased so far.

Determining ROI in marketing is actually easier than you think. You just have to change how you implement your marketing strategies online. Google provides you a free

tool in your Google Analytics account that will help you set goals for this.

First you have to identify what a conversion looks like for your business. How does a transaction take place on your website. If you aren’t selling retail products online you may be wondering how to do this. You may need to track offline with your sales team or you may need to create a “call to action” on your site. Something that provides a trigger to notify you who the buyers are.

Once you’ve done this with an eBook or something like that then you can create a subdomain to track who is filling out a form or downloading a free offer. After the new friend has filled out the form or clicked download you will need a thank you page or message after the action has been performed.

Enter that URL in your Google analytics goal tool then you can track it. Like I said, if you don’t sell your product online or if it’s a service you may have to match up your results with your sales team monthly. There are so many solutions that could be customized to your business and most are free. Just get creative! Did this trigger any ideas that I missed? If so what?

Increasingly the world is moving towards globalization… blame it on the internet, Facebook, air travel, etc. Mankind is on a sustained path towards integration and instead of a world defined by Nation States and geographical boundaries we are trending more and more to be defined by the ways we are inter-connected.

To stay ahead of the curve we need to keep abreast of the innovative ways things are changing to address issues that will have major impact our lives and on real estate. Things such as, trade issues, climate change, the “New Silk Roads” being developed by the Asian Infrastructure Investment bank and other organizations across Euroasia, etc.

Today approximately 52% of the world’s population are under 30 years old, that’s roughly 3.5 Billion or 3,500,000,000 people. They will undoubtedly have greater challenges and these challenges will require fundamental rethinking of some of the major issues as we know them today.

I came across a book recently and I thought it made for great reading. It provided me with a new and different outlook as to how the world is evolving. It’s called “Connectography” written by Parag Khanna, a global Strategist. I recommend it and if you don’t want to buy the book at least google “Six maps that will make you rethink the world”

I cannot envision the extent these changes will have on real estate as we know it but my guess is that thing will evolve rapidly. We have seen in the past decade how buyers and sellers are using the internet and other social media tools and the impact they are having on the way we conduct business.

Remember we as now more interconnected than ever before so it may just worth our while to find out how the world is changing and not just be contented with where we stand.

When you think of the Americans with Disabilities Act (ADA), you might envision ramps to make it easier for people who use wheelchairs to physically access buildings.

But today, with so much commerce being conducted online, some courts are finding that websites must also be accessible to people with visual and other impairments. That could mean big changes to how your professional, brokerage, and association websites work in the future.

The ADA is silent on the issue of online accommodation because the Act predates the widespread use of the Internet. Without clear guidance, consumers and businesses have had to turn to courts around the country to resolve the question of whether the ADA’s accessibility obligations extend to a business’s online presence. Courts are split on the question of if and when a business is obligated to create an accessible website. However, an accumulation of case law now asserts that a business’s accessibility obligations do indeed extend to its website, so it’s a smart risk management decision to evaluate your own websites now.

To further underscore the timeliness of undertaking this evaluation, activity at the Department of Justice, the federal agency responsible for enforcing the Act, demonstrates that it is likely only a matter

of time before a clear mandate of web accessibility under the ADA is issued. The DOJ has long taken the broad position that the ADA’s obligations extend to all websites under Title III, the section of the ADA that applies to businesses. Back in September 2010, the DOJ issued an Advance Notice of Proposed Rulemaking regarding the accessibility of web information and services, which sought to add web accessibility requirements to Title III. Meanwhile, DOJ enforcement actions, demand letters, and complaints filed by private litigants are adding up. While a final rule isn’t expected until sometime in 2018, the DOJ’s position— and the significant amount of enforcement activity it’s conducted to underscore that position—means it’s time for professionals to start thinking about making changes.

At this point you may be asking yourself, “What exactly does an accessible website look like?” In practice, it doesn’t necessarily look all that different to people without disabilities.

An accessible website allows adaptive software and specialized browsers used by persons with disabilities to augment content and make it easier to consume. For example, these programs might add text descriptions to complex graphics, voice-overs that read text aloud, or transcripts of videos. Accessible websites allow the specialized programs and browsers to easily interact with a website

in order to improve and help maximize a person’s experience on the site, obtaining the site’s information in a format that takes their disability into account.

So what can you, as a business owner, do to get ahead of this issue? As a first step, contact your website provider to inquire about the current accessibility of your site, and ask what it’s currently doing to create or improve accessibility. If you operate your own website and do not have the technical expertise in-house, consult one of the many technical experts who specialize in creating and maintaining accessible websites. A technical expert can help identify where your site might fail to comply with the “Web Content Accessibility Guidelines 2.0,” a technical standard created by the World Wide Web Consortium to help developers and site managers make the web more accessible.

And adding contact information for someone at your business who can respond to a particular user’s inability to access the site, or a portion of it, is a proactive step your business can take to address site accessibility issues up front in order to avoid running into legal problems later.

With more and more business being conducted over the Internet, and the likely changes to the regulatory landscape, getting out in front of the online accessibility issue is a smart business decision. Not only can it help you avoid legal risks down the road, it also establishes your business as accessible to all and may enhance your reputation and even your bottom line.

Once you understand what accessibility improvements to your website are needed, changes can be implemented incrementally. In their settlement orders, the DOJ has generally allowed businesses up to 18 months to implement necessary accessibility changes to their sites. And remember, even after your website is updated, you should ensure ongoing compliance with the Web Content Accessibility Guidelines 2.0 when you add new content or website features.

Educate and train relevant personnel to ensure they are knowledgeable about and focused on your business’s online accessibility.

Technical experts are also available to monitor your website and alert you when a change or remediation is necessary.

You might also consider making it easier for users of your site who may be disabled to get in touch. A simple feedback form can help them inform you about what accessibility features may need to be improved or added.

Help buyers avoid falling victim to a growing real estate scam that dupes them into giving their purchase money to hackers.

When NAR General Counsel Katie Johnson asked a group of real estate professionals whether they or someone they knew had clients that were victims of wire fraud, more than one-third of the audience at the Idea Exchange Council for Brokers raised their hands.

Johnson laid out the top legal friction points currently facing practitioners during the REALTORS® Legislative Meetings & Trade Expo in Washington, D.C. last week. Wire fraud topped the list as a sophisticated scam causing consumers to lose millions of dollars each year.

Hackers are gaining access to e-mail accounts through captured passwords, and they’ll search inboxes for messages related to real estate transactions, Johnson said. Once they find a victim who’s in the process of buying a home, they’ll send a spoof e-mail that looks like it’s from their agent, title representative, or attorney, and it will say there are “new” wiring instructions, which includes a fraudulent account. The home buyer will then unwittingly wire funds directly into the hacker’s account, Johnson said.

“Once they send it, the money is gone,” she added.

“Millions of dollars are lost on this.”

Jessica Edgerton, NAR associate counsel, presented suggestions during the Professional Standards Forum & Committee Meeting to help clients avoid falling victim to wire fraud. “The more we raise awareness of these scams, the more red flags consumers will recognize,” Edgerton says.

Here are six tips for keeping the transaction secure: 1. Build a standard warning about wire scams into your e-mail signature or include a disclaimer at

the bottom of your e-mails that says you will not discuss personal financial information over e-mail.

2. At the beginning of every transaction, tell clients what your communication practices are.

3. If you or your agents do engage in a wire transfer with a client, call them on the phone immediately prior to the transfer of funds so they know they’re sending money to the legitimate source.

4. You and your clients should avoid free Wi-Fi with no firewall to protect against hackers capturing an e-mail password or other sensitive information.

5. Always use strong passwords and change them regularly; advise your clients to do the same. It also wouldn’t hurt for your client to change their password before wire instructions are sent.

6. Brokers should consider employing a staff person who’s responsible for monitoring, updating, and implementing information security systems and procedures at your company.

“We can implement every technical safeguard we can think of, but if our people [agents and staff] aren’t following protocol, it’s like leaving the door to the citadel wide open,” Edgerton says.
