My Contract is Going South. Now What?
People who enter into real estate contracts want those contracts to close, but that doesn’t always happen. Sometimes the buyer can’t obtain financing, the property appraises for less than the sale price, or an inspection reveals a heretofore unseen problem with the property that is a deal-breaker. The standard real estate sale contract anticipates these potential problems and contains contingency provisions to deal with them. Bigger problems arise when one party wants out of the contract for a different reason or for no good reason at all.
The standard contract contains provisions that give the parties options in the event of a default. The non-defaulting parties has the following options against the defaulting party:
1) specific performance
By - Diana Brazealeto deposit earnest money with a designated escrow agent to give the seller assurance that the buyer is ready, willing, and able to buy the property. If the buyer defaults, the seller has the option to retain the earnest money as liquidated damages. If the seller defaults, the buyer is entitled to the return of his earnest money and liquidated damages consisting of his actual costs (e.g. inspection fees, appraisal fees, loan fees, etc.).
2) termination of the contract with liquidated damages
3) any other remedies available at law or equity
Specific Performance
Specific performance means that the non-defaulting party can take the defaulting party to court and seek a judgment that compels the defaulting party to perform. This remedy is rarely used but can be effective in the event of a seller default. In this case, if the buyer can demonstrate that he is ready, willing and able to close the sale, the court can order the seller to accept the sale price and deed the property to the buyer. A seller attempting to compel a buyer to perform has a more difficult task. The seller can seek the court order directing the buyer to pay and accept a deed to the property, but this may not be feasible if the buyer is unable to come up with the funds.
Liquidated Damages
The most common remedy in the event of a default is to terminated the contract and seek liquidated damages. Liquidated damages means that it would be difficult or impossible to put a dollar amount on the non-defaulting party’s actual damages, so that party’s damages are liquidated (i.e. agreed upon in advance) at the amount of the earnest money or some other amount set forth in the contract. Most real estate contracts provide for the buyer
Any Other Remedies Available at Law or Equity
If specific performance is impractical and liquidated damages are unsatisfying, a nondefaulting party may pursue any other remedies available at law or equity. This means filing suit for breach of contract or for any other cause of action (e.g. fraud) that may fit the particular fact pattern. In these cases, the facts are rarely one-sided, so both sides usually hire counsel, the defendant files a counterclaim accusing the plaintiff of default, and they fight it out in court. Litigation gets very expensive very quickly, and a responsible attorney should be asking the client at the beginning if a broken contract is worth the expense of litigation.

As Mortgage Rates Rise, Fresh Real Estate Listings Hit a Near
3-Year High

The average rate for a 30-year fixed home loan inched up from 6.74% to 6.87% for the week ending March 21, according to Freddie Mac.
“After decreasing for a couple of weeks, mortgage rates are once again on the upswing,” Sam Khater, Freddie Mac’s chief economist, said in a statement. “Despite elevated rates, homebuilders are displaying renewed confidence in the housing market, focusing on the fact that there is a good amount of pent-up demand, an ongoing supply shortage, and expectations that the Federal Reserve will cut rates later in the year.”
The mortgage rate question
Although the Fed is expected to cut rates three times this year, this relief might not come as early as many might like, given recent inflation data came in higher than expected, according to Speianu. (Although the Fed’s rates and mortgage rates are different, they tend to move in the same general direction.)
Although mortgage rates are down from their multidecade peak of 7.79% from last October, rates might not be low enough for many budget-minded home shoppers, who might take what Speianu calls a “wait and see” approach to home buying. This means some buyers might choose to keep an eye on rates and pounce only when—or if—they fall.
The official arrival of spring has also ushered in a pop of positive news for housing: A whopping 17.8% more sellers listed their homes in the week ending March 16 compared with last year.
“This is the highest year-over-year growth rate in new listings seen since May of 2021,” says Realtor.com® economic data manager Sabrina Speianu in her most recent analysis. “This increase in newly listed homes means more fresh options for buyers heading into the spring home buying season.”
Will this flush of brand-new listings jump-start a housing market that’s been stuck in neutral as of late, or will high mortgage rates keep buyers and sellers on the sidelines? We’ll break down how the latest real estate market data will come into play as the new buying and selling season revs up in this installment of “How’s the Housing Market This Week?”
“If mortgage rates continue to remain steady, it is likely that buyers may wait to lock in lower rates later this year,” says Speianu.
Those buyers watching rates may want to keep a close eye on the economy as well.
“Falling mortgage rates hinge on falling inflation, but recent data still puts inflation well above the Fed’s 2% target,” Realtor.com senior economic research analyst Hannah Jones adds. “The latest projections show that interest rates are likely to be higher for slightly longer than expected in the previous update, but the trajectory will remain dependent on incoming inflation and employment data.”

As buyers mull their bottom line, some sellers are lowering asking prices to lure them in.
“Sellers who have already listed their homes are adjusting to make their listings more competitive, and the share of available listings that have had a price reduction continues to increase,” explains Speianu.
The inventory share of price-reduced homes rose in February by 1.4% compared with the previous year.
“This pace of increasing price reductions has continued into the first few weeks of March,” Speianu points out.
Home inventory continues to grow
Spring home-buyers headed into the housing market will find it’s not just fresh listings that are up but also overall active inventory, which jumped a whopping 23.8% above year-ago levels for the week ending March 16.
“This past week, sellers continued to list homes at a pace much higher than last year,” says Speianu. “For the 19th straight week, active listings registered above the prior year’s level, which means that today’s home shoppers can consider more options.”
Yet this good news doesn’t seem so great when you pull back and view the big picture: Total housing inventory is down nearly 40% compared with typical pre-pandemic levels from 2017 to 2019.
“However, new home supply is looking promising as homebuilders cranked up activity in February,” says Jones. “Housing starts climbed 5.9% year over year and home completions were nearly 10% higher annually in February, signaling potentially more home options in coming months.”
What to expect as the spring market kicks in
Yet home shoppers solely focused on where mortgage rates are headed might be wise to shift their focus to what else is happening in the housing market as spring progresses.
For instance, Speianu points out that buyers will be “facing a trade-off as home listing prices typically also peak in the summer months.”
Some home buyers are already wasting no time to close the deal, with the typical home spending two days less on the market for the week ending March 16 compared with the same period last year. (Homes spent an average of 61 days on the market in February.)
“More home options mean more buyers are finding what they are looking for amid scarce inventory,” says Speianu. “So homes continue to move relatively quickly.”
“As the spring season approaches, many buyers and sellers are getting warmed up to enter the housing market. Some existing homeowners are likely to be hesitant to list their home for sale in today’s high-rate environment,” adds Jones.
“Both progress in inflation and a boost in home supply would help the housing market return to more balance and affordability,” she continues. “Inflation moving toward 2% would allow for easing mortgage rates, and more home supply would relieve upward price pressure. When these two levers start to move in the right direction, many buyers will see a more favorable housing market.”

Buying or selling a home? How the real estate fee structure impacts you

Big changes are coming to the way people buy and sell houses in the United States. The National Association of Realtors settled a lawsuit last week that could up-end the way real estate agents are paid, doing away with the traditional agent’s commission of 5-6%. That’s prompting a reckoning for buyers, sellers and real estate agents. Here are six things to know.
What if you already sold a house? As part of the settlement, the National Association of Realtors agreed to pay $418 million over the next four years. That’s in addition to $210 million that various brokerage firms had already agreed to pay. Lawyers will get a chunk of that money, but the rest will go to people who sold their homes in recent years and paid what critics argue were inflated real estate commissions. Eligibility depends on where you live, but in some parts of the country, the settlement covers people who sold homes as much as a decade ago.
“We don’t know the exact number, but we estimate it to be in the neighborhood of 40 or 50 million” people, says Benjamin Brown, cochair of the anti-trust practice at Cohen Milstein, one of the law firms involved in the class-action case.
What increased negotiations mean for buyers and sellers?
There’s going to be more opportunity to shop around, and likely a wider array of services, from deluxe agents who charge a premium price to discount agents with more limited services — similar to what exists in other markets like stock brokers and travel agents.
Sellers may be able to negotiate a flat fee to market their house, not connected to the selling price. Buyers may be able to purchase a la carte services — paying less if they do their own house-hunting on the Internet and more if they want to be chauffeured around to open houses.

How will this change real estate commissions? For decades, the norm in this country has been for the person selling a home to pay both her own agent and the buyer’s agent. What’s more, the buyer’s share of that commission had to be spelled out in order to advertise the home on the big regional listing sites. Realtors insist they never fixed those commissions, but as a practical matter, the public notice worked to set a standard — often in the neighborhood of 5 or 6%, split between the seller’s agent and the buyer’s agent.
For a home priced at $400,000 — which is close to the national average — that works out to $20,000 to $24,000 in commissions — much higher than people in other countries typically pay. In Germany, commissions average 4.5%. In the UK, they’re under 2%.
Starting in July, sellers will no longer have to spell out a commission for the buyer’s agent. Advocates say that should lead to more negotiation, more competition and ultimately lower costs.
Many sellers may decide not to pay the buyer’s agent, leaving buyers to shoulder that cost on their own, or go without an agent altogether.
Overall expenses are expected to be significantly lower, however. Economists at the Federal Reserve Bank of Richmond estimate the changes could save home buyers $30 billion a year, with most of those savings coming out of the pockets of real estate agents.
What does this mean for agents?
Agents are still sorting out what this might mean for their business. When fees are more negotiable, agents will have to make the case for what they’re worth. But the best agents feel like they do that already.
“Do I think that Realtors have to learn to do business in a different way? Absolutely,” says Kevin Wilson, president of the Greater Nashville Realtors. “But I also think this is a wrinkle in the landscape. Not a landmine.”
A drop in commissions might drive some agents into other lines of work, but that’s not necessarily a bad thing. The U.S. has 2.5 to 3 million real estate agents — which is far more than any other country, relative to the size of its housing market. For example, the U.S. has about six times more home sales each year than the U.K. does, but 26 times more agents.
“Do we see agents that work with buyers start to phase out of the business because they’re just not getting as many clients?”
asks Jovani Ortiz, an agent on Long Island. “These are sort of the unknowns that most agents are looking at right now.”
While the commission pie is likely to shrink, it may be cut into fewer slices, so the remaining agents might end up making the same amount of money.
With home prices and mortgage rates already high, how will home buyers pay for their own agents? While sellers have traditionally paid buyers’ agents in the U.S. (and built that expense into the sales price of their home), many sellers may opt not to pay buyers’ agents in the future. In that case, buyers will have to pay their own agent out of pocket, on top of a down payment and other closing costs. Finding thousands of dollars to pay an agent could be a challenge, especially for first-time buyers, who typically have limited funds and also the greatest need for an agent’s guidance. First-time buyers accounted for just 26% of existing home sales in February — tying a record low.
“Many first time buyers are already at the absolute max of what they’re able to borrow,” says Vanessa Perry, a professor at George Washington University School of Business and a fellow at the Urban Institute’s Housing Policy Finance Center. “They’re not going to be able to come up with any additional cash to pay their own agent.”

to do so. Eventually, buyers may be able to fold the cost of their agent’s commission into their mortgage, stretching the payments out over the life of the loan. But that will require a change in mortgage underwriting rules. Over time, lower real estate commissions should lead to somewhat lower housing prices.
What should people who are thinking of buying or selling in the next six months do?
The settlement’s changes in commission rules take effect in July, just as many people will be shopping for homes ahead of a new school year. But it’s not clear how quickly the landscape will change. Buyers and sellers may want to talk with their agent about the costs and benefits of moving before the deadline or waiting until the new rules are in place. Remember, commissions account for $20,000 to $24,000 on a typical home.
