Considering Purchasing a Property on a Shared Well? Ask these Ten Questions First.
Many properties in rural Missouri are not connected to a municipal water supply and rely on wells instead. This is often a good thing, as southwest Missouri has an ample supply of clean, potable groundwater, and the water from a properly drilled well is often better than city water. However, some properties, often those in neighborhoods outside city limits are connected to shared wells, and are subject to shared well agreements. If you are looking at a property on a shared well, do some research before you buy.
1. Is there a recorded agreement governing the shared well? The deed to property will often reference the well agreement, and you can obtain a copy of it at the recorder’s office. Read it closely, and consult an attorney if you need clarification.
2. On whose property does the well sit? The well may be located on a dedicated parcel of land or it may sit on the property of one your potential neighbors. If it’s the latter, consult that person regarding the operation of the well.
3. What is the average cost per month for water from the shared well? One advantage of shared wells is that their water supply can be very economical.

8. If the well or the pump needs maintenance, how is that need determined and how does the “keeper” of the well collect the funds to pay? Again, a welldrafted well agreement should provide guidance for this situation.
9. What if one or more of the homes on the shared well does not pay for its share of the water or maintenance? The well agreement may or may not have a provision governing this issue, but often the solution is, unfortunately, to sue the defaulting party for payment. Shutting off the water to that home is NOT recommended, as that can to serious legal liability and expense.
10. What if one or more of the homes on the shared well is using far more water than the well can provide? For example, I once dealt with a situation where one of the homeowners on a shared well started a nursery business from his home. He used so much water that the other homes did not have enough.
4. How may homes are connected to the shared well? Inquire as to whether the water supply and the pump are sufficient to supply them.
5. Is the well regulated by the Missouri Department of Natural Resources (“DNR”)? If there are more than three homes on the well, it should be, and you should consult the DNR for further information (e.g. water test results) regarding the well.
6. Does the well have one electric meter, or does each home have its own meter to gauge its usage of the well? This is important to determine how much each home should pay for its respective water supply.
7. If there’s only one meter, how is each home’s water bill determined, and who collects it? A well-drafted well
If you are a potential buyer of a property on a shared well, you should ask all of these questions, and not sign a purchase contract until you are satisfied with the answers. If you are not satisfied with the state of the shared well, consider having the property inspected to determine the feasibility of drilling a new, dedicated well and obtaining an estimate of the cost to do so. Having an adequate water supply to your home is absolutely essential, and having an inadequate water supply will cause you many headaches.

What do you like most about the Ozarks? While Table Rock Lake is definitely my favorite, the natural beauty of the Ozarks is also something I truly appreciate.
At what point in your life did you feel the draw to get into Real Estate? I started leaning toward real estate around the beginning of high school. Growing up watching my dad run his own businesses inspired me to want to be my own boss.

If pay wasn’t a factor, I’d choose a job that lets me travel the world with friends and family—scuba diving exotic dive sites and skiing mountains in different countries. Being able to combine adventure, travel, and time spent with loved ones would make for the perfect job.

Real Estate agents work hard to get listings, market properties for sale, and bring sales to fruition. They often do so with no money up front, but with the expectation that their reward will come at closing with the payment of their commissions. If the closing does not happen, an agent who has fronted money for marketing expenses may suffer financially.

An established agent may consider this situation a cost of doing business, take the loss, and move on to other sales. Sometimes, however, an agent will go to great lengths to market a unique property, and end up liable for considerable expense when the owner decides not to sell after all.

The standard form listing contract for Missouri agents provides that if an agent procures a “ready, willing, and able buyer,” for the listed property, the agent is entitled to the agreed upon fee in the contract. That sounds good, but it is rarely so simple. The term “ready, willing, and able buyer” can be construed many different ways by many different courts and attorneys, and it may not be worthwhile for an agent to sue an owner who decides not to sell. Lawsuits are never a sure thing, legal fees are not cheap, and an agent may not want to have a reputation as someone who sues. There is also the practical consideration of collecting the fee when there is no closing. So what is an agent to do? Consider asking for money up front or for reimbursement for expenses exceeding a
certain amount. The standard listing contract has no provision for this, but agents can write their own language in the “Special Agreements” section of the contract. For example, “Owner agrees to reimburse Agent for marketing expenses exceeding $___,” or “Owner agrees to deposit $____ with Agent’s Broker for marketing expenses.”

Some owners may balk at the prospect of paying expenses up front or at the suggestion that they might decide to take a property off the market, and look for another agent. At that point, the agent needs to make a decision. Is this owner worth the risk? If the answer is yes, understand that you may take a loss. If the answer is no, let the owner go elsewhere.
