Padma Lakshmi Named 2016 Ellis Island Honoree By a Staff Writer adma Lakshmi, host of popular reality show ‘Top Chef’, added a new feather to her cap last week when the author and model was named a recipient of 2016 Ellis Island Medal of Honor. According to the latest list of honorees for this year, announced by the National Coalition of Ethnic Organizations April 28, Padma Lakshmi is among six South AsianAmericans who have been selected for the 2016 Ellis Island honor to be awarded to a total of 88 distinguished immigrants to the United States at a colorful ceremony on Ellis Island May 7. Besides the 88 national honorees, there will be three international honorees as well.

The award pays homage to the immigrant experience and the contribution made to America by immigrants and their children. The medals are awarded to native-born and naturalized U.S. citizens.

Kavery Kaul On Mission To Explore ‘Shifting Sands Of Culture’ – NEW YORK avery Kaul is addressing the engagement between people of different cultures and faiths via her film “Streetcar to Kolkata”. The filmmaker, who is a name to reckon with in the world of documentary-making, says she likes to pan the camera to mirror the “shifting sands of culture, race, class and belonging”. Kaul shared that her journey from India to a different culture of the U.S. turned out to be an inspiration for her to explore the filmmaking business. “Every family has its own treasure chest of stories. I grew up with stories about India’s fight for independence from the British and the partition that followed. And then, there were stories of life at the sometimes-challenging, sometimes-comic, always-memorable intersection of the India my family came from and the America we came to. For all of us, the stories we’ve heard shape our beliefs, our practices and our perspective of the world,” span.state.gov quoted Kaul as saying. A graduate of Harvard University, Kaul has been awarded a Fulbright Fellowship, a New York Foundation for the Arts Artist’s Fellowship, multiple New York State Council on the Arts grants and two National Endowment for the Arts awards. amiya Fagun, a Bangladeshi student at Newtown High School in Elmhurst, Queens, has been crowned the winner of the fourth annual Congressional District Art Contest, known locally as Meng art contest after U.S. Rep. Grace Meng (DQueens). Meng announced April 25 that this year’s contest marked the first time that a student of Bangladeshi descent has won the competition. The contest, which consisted of entries from Queens high school students, is part of “An Artistic Discovery”, the national art contest sponsored each year by the House of Representatives that showcases the artwork of all Congressional district art contest winners from across the nation. Beginning this June, Fagun’s winning artwork – along with the winning pieces from art contests in Congressional districts throughout the United States – will be displayed for one year in the historic Cannon Tunnel, a heavily-traveled corridor of the United States Capitol. Fagun, along with one of her parents, will also be awarded round-trip airplane tickets to Washington, D.C. – courtesy of Southwest Airlines – to join Meng at the opening ceremonies of the national art competition. The ceremony scheduled for June takes place on Capitol Hill and will recognize Fagun’s exceptional artistic talents as well as those of all the other

A resident of Elmhurst, Fagun won the competition for her watercolor drawing entitled “Moments of Life.” She emigrated to the U.S. from Dhaka three years ago. She plans to attend City College of New York in the fall and may pursue a major in art. Meng announced Fagun as the winner during a reception she hosted for students and their families, art teachers, principals and school administrators. It was held at the Queens Museum in Flushing Meadows Corona Park where all of the

Wearing Heart On Their Sleeves At Gujarat Day Celebration By a Staff Writer housands of miles away from their home state, Gujaratis in the Tristate area celebrated Gujarat Day at the Indian Consulate May 2, reminiscing the birth of the state that was officially created May 1, 1960. In keeping with the spirit of the occasion, a patriotic fervor tinged with a bit of nostalgia seemed to be infectious among the 100-odd people, who had gathered for the celebration in the spacious ballroom of the consulate. The guests greeted each other with “Jai Jai Garvi Gujarat”, meaning hail to Gujarat, as they readied for the beginning of the event which started with ceremonial lighting of lamps by Consul General Riva Ganguly Das. Several community elders spoke about how the state has prospered over the decades and how its economic development was spurred by Narendra Modi when he was the state’s chief minister. They also talked about the business enterprise of Gujaratis, who have settled in many parts of the world, including in the United States, and have made a mark for themselves. “There are more than 60 million Gujaratis in India, America, and in all the seven continents, except perhaps on the moon and the mars, but someday that too could be a reality,” Sudhir Parikh,

New Yorkers have turned Holi into an international celebration where different ethnicities and nationalities celebrate the Indian festival of colors, Ela Dutt reports

housands of men, women and children, crowded into Dag Hammarskjold Plaza in mid-town Manhattan April 30, to enjoy the festival of colors in what organizers see as a trend toward globalization of the ancient Hindu festival celebrating the onset of Spring. A week before, thousands came to celebrate Holi in Brooklyn that featured a local talent in a music and art festival. The April 30 Holi was held at 47th Street between 1st and 2nd Ave. near the United Nations, and attracted a multicultural, international crowd that enjoyed throwing colors and dancing to Indian and fusion music played by live bands, as well as watch groups of dancers perform. Organized by NYC Bhangra Dance Company & School, the event attracted more than 10,000 people, whose numbers were tracked by the wristbands issued, organizers told Desi Talk. It was the largest of the seven “Holi Hai” events held so far by NYC Bhangra, Megha Kalia, founder of the school said. “The concept of Holi is catching up all over the world. But it’s also about how you package it,” Kalia said. This was a free, familyfriendly, no-alcohol event, the only one of its kind in the city, she said. The event was completely funded by NYC Bhangra, and cost more than $60,000 in total costs, with permits, insurance, etc. making up 30 percent, besides execution, production and cleaning, Kalia said. Finding a place for any event in high-priced real estate like Manhattan, was exorbitant, let alone one that required a lot of cleaning when over. Dag Hammarskjold Plaza was ideal because the ground could be washed and cleaned of the colors, a labor of love carried out by the 130 volunteers well after the event which went from 11 am to 6 pm. “It was also an event where everyone looked after everyone else. A few people lost their wallets but found them. Two children were “lost” but parents found them. That’s what makes it extraordinary,” Kalia said. “We include everybody. Children come and enjoy as well,” said Kalia. Chua Yun Chun, a Bhangra dancer originally from Singapore, and a teacher at Bhangra NYC, was effusive in her praise of the event. “This was the second one I helped with and while last year’s was phenomenal, this year’s was crazy!” she exclaimed. A more selective group of artists than last year meant their music and dance could be better showcased. And New York’s diversity was evident. “There were people from all walks of life, there was great energy. You really saw the magic unfold before you,” she said describing her experience of merging with the crowds in her

A week earlier on April 23rd weekend, Brooklynites celebrated Holi with a music and art festival, on an empty lot on Johnson Avenue.

Religion did not play a part in the festival of colors which is observed by Hindus, Sikhs, Jains and other religions. “We stay away from religion when its “Holi Hai,” because if you limit it to religion, it would restrict the attendance to the diaspora,” Kalia said. “Even the NYPD Social Affairs Department officer Jeffrey Arlotta was very surprised and commented at how much diversity there was even though it was an Indian festival,” Kalia said. The music groups that performed at the event included the Latin Fusion Dance Project which

Brooklyn Holi A somewhat different Holi celebration, more international and with lesser Indian ethnic content, capturing the spirit of the festival, was held April 23rd weekend in Brooklyn on a Johnson Avenue lot. Tickets had to be purchased and alcohol was sold. According to news reports, more than 2,000 people attended and local bands rocked the crowd at the 5th annual event. Described by organizers as the “Festival of Colors: Holi NYC” it was billed as a “Spring arts and music festival,”

according to the website, which also describes the Indian religious roots of the festival. “ There are no words to describe how we feel right now. You all made the day so amazing and we love you to pieces!!!” organizers said after the festival on Facebook. The Village Voice carried a picture spread and

noted, “Thousands of people came together to praise the coming of spring, harvests, unity, joy...and to douse each other in colorful powder.” One of the attendees, Yaitza Cruz, said, “We had such a great time. can’t wait for the next one.” Mia Carla, who has attended past Brooklyn Holi celebrations

ven 15 years after 9/11, Sikhs in the US feel they are more likely to face profiling, bigotry and backlash than the average American because of the two symbols of their distinct identity - beard and turban. To dispel this misperception and spread better awareness about the religion, a new Sikh art exhibit will be held in New York later this year to showcase the pride taken by the community in their religious and cultural practices. UK-based photographers Amit and Naroop will click portraits of Sikh Americans under “The Sikh Project” mounted by The Sikh Coalition. These protraits will be unveiled around the 15th anniversary of 9/11. The Coalition is the largest Sikh American advocacy and community development organisation in the US and works towards the realization of civil and human rights for all people, particularly Sikhs. After their critically acclaimed exhibit in the UK, the two photographers, who are proud of their Sikh heritage, said they are “very excited” about their upcoming exhibition. “We are very excited! In the US, it will serve as an educational piece as well as an art project

as the awareness of the Sikh identity is still misunderstood; so we are hoping it will have a wider impact,” the two photographers told this correspondent in an email interview from New York. The photography exhibit, which explores the beauty, style and symbolism of the Sikh articles of faith, will include both turbaned men and women and feature a combination of iconic Sikh Americans and a few selected winners. Speaking about how the idea of ‘Sikh Project’ came to them, the two photographers said it was in 2013 that it struck them when they “noticed men of different backgrounds and ages growing beards for fashion, as part of their identity.” “Being Sikh photographers, we wanted to show that in our culture, the beard has been a part of the Sikh identity for hundreds of years,” they said in the joint interview. They said their UK exhibition got “overwhelming response” and was “appreciated” and “respected” for the message it was giving and the way it was executed. “The content and context resonated with people from different backgrounds as it is not just about Sikh’s, it’s about pride for your identity”. The two, who have worked in

the US earlier also, want their latest project to “stand up to the UK Singh Project and if anything even better than it.” “In the UK, we have witnessed how powerful art can be in positively educating the broader public about the Sikh community. We can’t wait to begin photographing the Sikh American experience and sharing those stories with the world as well.” Amit and Naroop, in partnership with the Sikh Coalition, are currently casting for additional photography candidates and are asking turbaned Sikh Americans of all ages and genders to take part in this groundbreaking project. The deadline for the entry is May 1. According to Coalition’s Executive Director, Sapreet Kaur, “The goal with bringing this project to the United States is the opportunity to combat bigotry by sharing a positive narrative of Sikhs in America through portraits and the incredible stories behind them.” The Coalition was founded by volunteers on the night of September 11, 2001, in response to a torrent of violent attacks against Sikh Americans throughout the US. Talking about the response of the people, the two photographers said it has been “fantastic”. “The subjects involved have seen the success we have had, so

they are excited to be involved. It’s the complete opposite of the UK Singh project as nobody wanted to be involved at first and it took a while for it to build momentum.” They strongly feel that such exhibition will help in showing the Sikh community in the US in a positive light and help fight bigotry they face in their daily lives. “Each one of the subjects has a story to tell, which will sit alongside the portrait. Some are positive, some are more dramatic, but through the stories, visitors of the exhibition will get to learn what it means to be an American Sikh, both in identity and also in spirit.” “Yes I believe so,” he said when asked whether the exhibition will help in highlighting the importance of the beard and turban, an important article of faith of the Sikh community. “An accompanying video interview of each subject will allow visitors of the exhibition to learn more about the way Sikhs are treated, both positively and negatively, and the courage it takes for the subjects to continue to wear their articles of faith,” they said in their interview to IANS. The project, they said, is a fusion of their Sikh heritage and British upbringing.

Sordillo, who is a Warren Township Committeeperson, was also elected to the Somerset County State Committee with Governor Christie in 2009. An engineer by training, Sordillo is a graduate of Tufts University, and serves on many boards and professional and other societies. Indian-Americans for Trump 2016 is a registered PAC with the Federal Election Commission, formed in January 2016, to encourage IndianAmericans and others to support Republican presidential candidate Donald J. Trump. Sordillo is expected to advise the board on all activities related to Trump’s election.

Consul General In N.Y. Moots Idea Of U.S. Judges’ Visit To India By a Staff Writer he possibility of inviting a delegation of American judges to visit India was discussed by Riva Ganguly Das, Consul General of India in New York, with some New York State Supreme court judges and community leaders on the sidelines of a reception for the ambassador in Long Island last week. Several judges of the New York State Supreme Court and public officials from Long Island joined a community reception for Ganguly Das April 24 which was hosted by the Indian American Voters Forum in Albertson, Long Island. In attendance were Supreme Court Justice Steven Bucaria, Justice Bruce Cozzens, Justice Ruth Balkins, Justice Denise Sher, District Court Judge Anthony Paradiso, New York Assemblyman Thomas McKevitt and former Nassau County Executive Tom Suozzi. About 80 prominent members of the community were present, including Dr. Sudhir Parikh, publisher of News India Times and Padma Shri award winner, Dr. Dattatreyudu Nori, a noted radiation oncologist, and other prominent physicians, community activists, business leaders and heads of organizations. Indian-American Voters Forum was represented by its Chairman Varinder Bhalla and members of the organizing committee – Dr. Ajay Lodha, Dr. Vaijinath Chakote, Dr. Yashpal Arya, Dr. Sunil Mehra and Animesh Goenka. Ganguly Das discussed the possibility of inviting a delegation of American judges to visit India and some of the judges positively responded to the idea. “I am very welcoming of the idea of an exchange program of the judiciary and I hope that soon one day it will come true”, Justice Bucaria was quoted as saying in a press release issued by the by the voters forum. Bhalla apprised the Consul General of the organization’s recent initiative to recruit members of the U.S. Congress into the Congressional Caucus on India and Indian-Americans and its recent success in having Congresswoman Kathleen Rice join the Caucus. Dr. Parikh, a key player in promoting the idea of forming the Caucus in 1993, also spoke about its role in “furthering the relationship between our two democracies, our nations’ shared interests from global security to trade and international prosperity.” Suozzi,a candidate for election to U.S. Congress, stressed his longstanding association with the Indian- American community in Long Island, and promised, that

non-profit founded two years ago by Sharwani Kota, currently a high school junior, raised more than $10,000 for poor children in India diagnosed with autism at a fundraiser April 22 in J.P. Stevens High School in Edison, New Jersey. The event by the non-profit Hope4Spandana was attended by about 800 people, including dignitaries such as Senator Peter Barnes, Congressman Frank Pallone, former deputy speaker of New Jersey State Assembly Upendra Chivukula, former Edison Mayor Jun Choi,

International Mission of Mercy Chairman Satish Mehtani and Morris county Democratic Party president Vin Gopal. Also at hand at the fundraiser were Edison City Council members Sapana Shah, Ajay Patil, and community leader Peter Kothari. The event lasting for three-and-half hours included music and dance programs performed by professionals. Sharwani gave a presentation about the organization and the schools adopted by them in India. When the organization was formed two years ago, Kota recruited 45 other children from various school districts in New Jersey and all of them have been working to spread aware-

ness about autism and raise funds in New Jersey and New York through flash mob dances for research and care. As part of the event, Hope4Spandana honored Mehtani with "Outstanding Humanitarian Award" for his unparalleled service in helping Nepal earthquake victims. Kota said that members of the group, including Esha Khandelwal, Sneha Pachanady, Shreya Devarakonda, Sraavya Mallela, Anjali Modgula, Alekhya Vuntla, Arya Massand, Arnav Patel, Divi Patil and others, have been working for the cause over two years. Hope4Spandana adopted two schools in India where they have over 70 kids in each school diagnosed with various spectrum of autism disorders. Kota said that the mission of the organization is to raise $50,000 for this cause by July this year to better serve the children in India. So far, Kota said, around $40,000 has been raised, including the funds raised at the April 22 event.

young man of IndoCaribbean origin was attacked by several youth in Astoria, Queens, N.Y., last week, shouting “ISIS, ISIS” and punching and beating him. Police are describing it as a bias crime, according to news reports. Though the 19-year old victim’s name was not revealed by police, Gothamist newspaper reported his father’s name as Ray Bisram, who told media his son was “traumatized” by the attack. The youth who attacked him were carrying a metal pipe which they threatened to use on him, and a baseball bat. Bisram told Univision TV, “Right now, he’s kind of traumatized, because, you know, a guy punching him and another guy running with a bat and a iron pipe scream out, you know, racist words and stuff toward him, he’s pretty traumatized

because he’s thinking what if they would have hit me with that pipe.” A little after 1 pm, in broad daylight on April 27, the victim was walking on 10th Street in Astoria, when he noticed three tens aged 17-19, following him. One of them shouted to him calling him an “Arab” and punched him in the fact twice when he turned around. They brandished the metal pipe and baseball bat at him. Luckily, the victim was able to sidestep the metal pipe swung at him. A neighbor, Ron Garcia was on the street when he saw the attack taking place. “They pushed him up there and that’s when they went to take the swing on the pipe with him,” Garcia is quoted saying in the report “He averted it, like he moved out away and midway to me, and when he made his way to me, that’s when they ran up the block.” The NYPD has put out a description of the attackers –

one male, aged 17-19 years-old, short black close cut hair, approximately 5’6” tall, 160 lbs, last seen wearing a dark colored two tone sweater with vertical lines, black pants and black sneakers. The third suspect is around 18-years-old, approximately 5’9” tall, black hair and a beard, last seen wearing a black hooded sweat jacket with white horizontal stripes, black jeans, grey t-shirt and grey sneakers. Last week, 32-year-old Singh, who followed the woman to New York where she came in 2007 to attend school, and then moved to Texas where she worked, was sentenced to 17 years in prison after being convicted by a jury in Collin County, Texas, on charges of burglary of a habitation and fraudulent use of information, ending the woman’s decade-long stalking nightmare by Singh. The Dallas Morning News which reported the conviction and sentence April 30 in the stalking case of the woman, whose name was not revealed, said Singh of Los Angeles had been stalking the woman for nearly a decade, threatening her as she moved from India to several cities in the United States. The report said quoting prosecutors that when the woman moved to New York in 2007 to attend school, he followed her all the way from Delhi and tried to enroll in the same university the woman was attending in New York, but was denied admission. The university obtained a criminal trespass order prohibiting him from the campus. Later on, the woman took an internship in California, and Singh followed her to find out

where she lived. The report said that Singh went to her home, demanding to see her. When she refused, he told her, according to prosecutors, that she won’t be able to hide from him and that he will always find her. The harassment continued even after she returned to New York to finish school. In 2011, when the woman moved to Plano, Texas, to work for an information technology company, Singh continued to harass her through phone calls and other electronic means, the report said quoting prosecutors. Singh even created a false credit monitoring service account in her name to learn where she lived in Plano and then broke into her apartment by persuading a locksmith to open the door and took away her passport, social security card and other documents as well as several pieces of jewelry. Singh was arrested by Plano police from the parking lot of her apartment complex with her stolen personal belongings when a suspicious neighbor called 911. The report said that prior to his conviction in the U.S., Singh was convicted in India on charges related to the harassment, threats and assault. After his sentencing last month, Defense attorney Joe Padian said, they would appeal the sentence. “While we respect the jury’s service, we were disappointed with the sentence, and we do intend to appeal,” Padian was quoted as saying.

We must stop importing extremism through senseless immigration policies.” – Donald Trump, foreign policy address, April 27 his claim reminded us of rhetoric surrounding resettled refugees facing terrorism charges, in the wake of last year’s Paris attacks. We had found a Democratic lawmaker’s claim misleading when he said that not one of the refugees who resettled in America after 9/11 has been arrested on domestic terrorism charges. Now, Trump says “scores of recent migrants” -- which would include refugees -- in the United States have been charged with terrorism, and that there are “dozens and dozens” more per public case. Is that correct? The Trump campaign, as usual, did not return our request for additional details. It’s unclear where Trump is getting this information. We could not find the source, even after checking with the Department of Justice, Department of Homeland Security, FBI, groups that oppose and support immigration, and experts who keep track of domestic or international terrorism cases in the United States. The claim may be a bungled reference to a list from the office of Sen. Jeff Sessions, R-Ala., of 30 foreign-born individuals who were arrested on charges relating to terrorism in recent years. This list is quoted in several articles, and described as a “partial inventory of recently implicated terrorist migrants.” Sessions is also a

The majority of the 30 cases involved naturalized U.S. citizens – people who came to the U.S. as children or had arrived before 2011. We reviewed similar lists of cases from 2014 and 2015, involving 76 people charged with activities relating to foreign terrorist organizations. Of them, 57 were U.S. citizens, seven were lawful permanent residents and two were refugees. The rest were visa overstays or unknown. There were both naturalized and natural-born U.S. citizens (including those of Caucasian, African American or Hispanic descent), and many of the naturalized citizens had arrived in the country as children. In general, individuals

must live in America at least five years with a green card to qualify for U.S. citizenship. The actual citizenship process can take up to a year or more. So even if Trump is counting naturalized citizens as “migrants,” the ones listed in these cases would not qualify as “recent.” “I have seen no evidence that there are ‘scores’ of recent migrants charged with terrorism,” said Seth Jones, director of the International Security and Defense Policy Center at the Rand Corp. “Most of the FBI arrests for ISIS-related charges have been American citizens or permanent residents.” The number of people accused of actually plotting attacks in the United States on behalf of the Islamic State terror group is smaller. Of the 64 people arrested on international terrorism charges between March 2014 and July 2015, 20 were “domestic plot-

After that case, the FBI’s director of Terrorist Explosive Device Analytical Center told ABC News that there were dozens of terrorism investigations into resettled refugees. But according to former

and current U.S. law enforcement officials, the scope of that investigation has been narrowed down to about two dozen people. The Tsarnaev brothers in the Boston Marathon bombing were initially described as refugees in news reports, but it was later revealed that the brothers ended up in the United States as minors because their father applied for asylum. Again, Trump’s description of “recent migrants” would not apply. Are there “dozens and dozens more” cases out there for every case made public? William Banks, founding director of the Institute for National Security and Counterterrorism at Syracuse University, said he doesn’t buy it. “One implication of his statement is that we’re keeping secrets about terrorism prosecution, and that’s false,” Banks said. “In extraordinary circumstances, indictments might be sealed when there’s a concern about the security of the evidence or safety, of a potential witness, or something like that. But I can’t think of an instance involving terrorism in the United States that might be true.” Trump gave a prepared speech for once, with even a teleprompter. So one would presume that someone would have looked this stuff up before writing it into his speech. Alas, there is no evidence that “scores” of “recent migrants” are charged with terrorism, and that for every case made public, there are “dozens and dozens more.” If we ever get a call or email back from the Trump organization, we would impart this piece of novel advice: use Google. – The Washington Post

Record crowd visits Rutgers as New Jersey’s oldest university celebrates Annual Day record crowd of more than 100,000 people visited Rutgers University’s three locations during the eighth annual Rutgers Day April 30, learning firsthand about the New Jersey’s oldest public university which is gearing up for its 250th anniversary celebrations November 10 this year.

Rutgers day, the popular spring event that began at Rutgers University­New Brunswick in 2009, was held this year for the first time at Rutgers University­Newark, and Rutgers University­Camden as well. Rutgers Day activities in Camden started with a World Tai Chi Day demonstration led by Rutgers­Camden Chancellor Phoebe Haddon and Camden Mayor Dana Redd. The 2,900 visitors of all ages walked the 40­acre campus near the historic Camden waterfront to

NJPAC’s Jazz for Teens also played and musicians affiliated with Rutgers’ Institute of Jazz Studies gave Rutgers Day visitors lessons to play a short tune.

Qatar Investigates Death At World Cup Site As Labour Rights Under Scrutiny By Tom Finn

he organisers of Qatar’s 2022 World Cup said on Sunday they were investigating the death of an Indian labourer at one of its sites but denied it was caused by working conditions which the wealthy Gulf country is under pressure to improve. Along with accusations of corruption during its World Cup bid, Qatar has long been under fire from rights groups for labour abuses. Last week, world soccer body FIFA urged Qatar to hasten improvements for builders on World Cup sites and said it would monitor conditions. Qatar, an energy exporter which has the highest income per capita in the world, is also under pressure from the United Nations to address workers’ rights before World Cup construction peaks in 2017. Labourer Jaleshwar Prasad, 48, fell unconscious on Wednesday while performing steel work at Al Bayt stadium in Al Khor, 50 km (31 miles) north of Doha, a witness told Reuters. Organisers said the death was not caused by working conditions. “Al Khor Hospital reported the cause of death as cardiac

arrest,” the Qatar’s Supreme Committee for Delivery and Legacy of the 2022 World Cup said in a statement. “The family of Mr Prasad were informed of the tragedy immediately. A full investigation is underway.” Qatar’s efforts to become the competition’s first Arab host have been dampened by accusations including that workers were forced to live in squalor and to work without proper access to water and shelter in the blazing sun. About 5,100 construction workers from Nepal, India and Bangladesh are building stadiums in the country. Unions and labour protests are banned and authorities penalise dissent with jail terms or immediate deportation. Prasad is the third Indian employed on a World Cup site to die of a heart attack in the last six months, according to a February report by the Supreme Committee. Qatar’s Supreme Committee says there have been no workrelated fatalities on World Cup sites, but law firm DLA Piper, in a review for the government in 2013, found evidence of dozens of work-related deaths across Qatar among migrant labourers from South Asia. denied claims there are higher instances of heart attacks among construction workers and does not publish independently-verified statistics on worker-related injuries and fatalities. Autopsies and postmortems on people who die sudden and unexpected deaths are forbidden by Qatari law unless a crime is suspected. “Workers dying suddenly from heart attacks is something we hear about often, the causes are not always clear. But we’re moving now into the hottest time of the year when the risk of fatality increases,” said Amnesty Gulf researcher Mustafa Qadri. “When a worker dies, Qatar needs to get to the bottom of what happened. People’s lives are in danger”. Amnesty reported on abuses at a World Cup stadium in a wide-ranging report three weeks ago based on the accounts of 132 workers. DLA Piper recommended that Qatar launch an independent study into cardiac deaths among migrant workers. But the practice among Indian Dawoodi Bohras hit the headlines in November when a court in Australia found two members of the diaspora community guilty of cutting two girls. A Bohra religious leader was convicted of being an accessory. Since then, more than a dozen Bohra communities in Europe and the United States have passed resolutions against the practice. “Why should girls in some parts of the world be spared from circumcision, while girls in other countries continue to be cut?” the non-profit group Sahiyo, which aims to end FGM in India, posted on its website on Friday. “The strongest form of opposition to khatna is now coming from within the community.” Campaigners will now focus on petitioning the government while still working with the community, said Ranalvi. “There is hypocrisy in the clergy’s stance, so the government is the most important route open to us now,” she said. “We need them to step in to protect our girls.” – Reuters

Around the world in 20 days: Follow two reporters on a 21,623-mile journey By Andrea Sachs and Jabin Botsford

f only we had 80 days. Unfortunately, we don’t have Verne’s generous vacation allotment, but we do have nearly three weeks — more than enough time to take a short lap around the world. For our circumnavigation, we will touch down in five countries, one island city-state and a former British colony administered by China. The boots-on-ground segments will last from a brief 24 hours (Reykjavik, Iceland) to a more languorous three days (Seychelles). For each destination, we will embark on a mini-scavenger hunt: we must visit a landmark, eat a local dish and snap up a souvenir. Over 20 days, we will cover thousands of miles and several time zones on four continents. And on the 21st day, we shall rest. We had only 24 hours in Reykjavik; we could sleep on the morning flight to Stockholm. On the island, Jabin and I moved like the Icelandic wind that could seemingly push the Nordic country closer to Greenland. About an hour after arriving on the redeye, we were bouncing along toward the Golden Circle, the nearly 200-mile loop that bubbles, spews and sprays with geologic features. The route provides layover lubbers like us with an alternative to the 830-mile Ring Road, which demands at least a week of your devotion. With foggy heads and clear skies, we hiked down to the first attraction on the route, Kerio, a volcanic crater lake that is a mere baby at 3,000 years old. The gravely path down to the caldera felt like shifting coffee grinds underfoot. I fell more on that short walk than I had over the past two winters. Fortunately, the landing was soft and silly. I also wasn’t the only tumbler in the crowd. A mom created a human chain with her young son, who eventually lost to gravity. Thankfully, the sliding stopped just shy of the shore; one false step into the icy water and you’re an instant Popsicle At Gullfoss, or Golden Waterfall, the water thundered down the Hvitá River

gorge, releasing frothy white plumes high into the air. In the distance, the mountains wore snowy stoles around their shoulders. The wind started to kick up, and I had to resist invisible hands pushing against me. The force grew even stronger at Geysir Hot Springs, a site gurgling with geothermal activity. On the short stroll to Strokkur, which puffs steam every four to eight minutes, my headscarf blew around like a kite and my mitten flew into a rivulet near a boiling hot pot. I knew that I had to take immediate action; I couldn’t wait till the shops in the capital. I disappeared inside the store across the street and, a few minutes later, returned to the field in my new armor, an Icelandic wool hat. You see, sometimes a souvenir is more than a keepsake; it’s a tool of survival. We completed the Circle by mid-afternoon and scooted into Reykjavik for a one-two punch of diversions. We rode the elevator to the observation deck of the 244-foot-tall Hallgrímskirkja Church and stood on stools to peer at the colorful buildings cascading toward the sea and keeping a polite distance from the steely mountains. Afterward, by the harbor, Jabin stood in line at the food stand, Bæjarins Beztu Pylsur, whose name translates to “the best hot dog in town.” When his turn arrived, Jabin, who had trained for this moment, ordered a hot dog with everything (onions, sweet mustard, remoulade sauce) and a Coke. An employee dressed his dog and placed it in a narrow wooden holder on the counter for pickup. On our 12th hour in Iceland, we finally arrived at one of the country’s most popular attractions, the Blue Lagoon. (For proof, count the buses and American accents.) Guests of the geothermal spa follow a ritual that includes a pre-soak shower and the slathering of conditioner on one’s hair, to protect locks from drying out. NOW THAT THE CAP IS REACHED . . . DO I STILL HAVE A CHANCE OF GETTING AN H-1B VISA?

O

n April 7, 2016, U.S. Citizenship and Immigration Services (USCIS) announced that it has reached the congressionally mandated H­1B cap for fiscal year (FY) 2017. USCIS also received more than the limit of 20,000 H­1B petitions filed under the U.S. advanced degree exemption. Because of the surge of petitions that were filed, USCIS conducted a lottery to determine which petitions received during the five­ day submission period will actually be considered. USCIS has already started sending receipt notices for the petitions selected in the random selection process. As expected, it is a very stressful time for thousands of potential H­1B workers. Until the prospective H­1B employers or their legal representatives start receiving receipt notices, and the dark clouds of uncertainty over prospective H­1B visa holders move past, the question worth asking and exploring is: “Do I still have a chance of getting an H­1B visa even if my H­1B petition does not make it to the H­ 1B cap?”

Unfortunately, the regular (bachelor’s) H­1B cap remains at 58,2001 and the master’s cap cannot accommodate more than 20,000 specialty occupation work­ ers. However, there are certain categories of cap­exempt H­1B visas. One such cate­ gory is for beneficiaries of employment offers at: (1) institutions of higher educa­ tion or related or affiliated nonprofit en­ tities; or (2) nonprofit research organizations or governmental research organizations. Thus, to get a cap­exempt H­1B visa using this category the funda­ mental question to ask is: whether the offer of employment is from an institu­ tion of higher education, or related or af­ filiated nonprofit entities, or from nonprofit research organization or gov­ ernmental research organization. For the purposes of H­1B cap exemption, the H­1B regulations have adopted the definition of institution of higher educa­ tion set forth in section 101(a) of the Higher Education Act of 1965. To be clas­ sified as an institution of higher educa­ tion, the educational institution must satisfy five (5) requirements. First, the educational institute must be a public or other nonprofit institution. Second, the master’s degree issuing institution must be accredited by a nationally recognized accrediting agency or association. Moreover, the educational institution must satisfy all of the following three re­ quirements: (1) admits as regular student only persons having a certificate of grad­ uation from a school providing second­ ary education, or the recognized equivalent of such a certificate; (2) is

legally authorized within such state to provide a program of education beyond secondary education; and (3) provides an educational program for which the insti­ tution awards a bachelor’s degree or pro­ vides not less than a 2­year program that is acceptable for full credit toward such a degree. The previous article in this series discussed in detail which educational in­ stitutions may or may not qualify as an institution of higher education. Assuming that the academic institution will qualify as an institution of higher education, the next two questions that have perplexed immigration practition­ ers and potential H­1B employers are: (1) what is the difference between employed “by” and employed “at”; and (2) how does one determine if the nonprofit insti­ tution is “related to or affiliated with” an institution of higher education.

The 2006 Aytes memo clarified the differ­ ence between employed “at” and em­ ployed “by’, and the purpose2 behind it. This memo explained that commonly, qualifying institutions petition on behalf of current or prospective H­1B employ­ ees and claim this exemption. In certain instances, petitioners that are not them­ selves a qualifying institution also claim this exemption because the prospective H­1B beneficiary will perform all or a portion of the job duties “at” a qualifying institution. Such petitioners are referred to as “third party petitioners.” Thus, USCIS allows an exemption in situations where the employee is employed by a “third party petitioner” but the prospec­ tive H­1B employee will perform job du­ ties at a qualifying institution that directly and predominately furthers the normal, primary, or essential purpose, mission, objectives or function of the qualifying institution, namely, higher ed­ ucation, or nonprofit research organiza­ tion, or governmental research organization. Thus, if the petitioner is not itself a qualifying institution, the bur­ den is on the petitioner to establish that there is a “logical nexus” between the work performed predominately by the beneficiary and the normal, primary, or essential work performed by the qualify­ ing institution. In this context, the issue that has been source of frequent litigation is: “How to determine whether the nonprofit institu­ tion is “related to or affiliated with” the institution of higher education?” The Ad­ ministrative Appeals Office (“AAO”) has always deferred to the USCIS approach as to whether the nonprofit institution is related to or affiliated with the institu­ tion of higher education.

The 33-year-old actress, who found global recognition with her character Alex Parrish in the American TV series “Quantico”, looked ravishing in a deep-cut, striped black gown at the dinner held on April 30 night. abbir Khan’s third film could have been easily called the Tiger Shroff showreel. Every second scene of “Baaghi” is a chance for Shroff to show off his rippling muscles and an incredibly flexible body that he manages to contort into all sorts of positions while fighting the bad guys. Everyone else in this twoand-a-half-hour film is incidental, as is any semblance of a story or plot. Shroff plays Ronnie, an orphan who lands up at a kalaripayattu school to learn the ancient martial art in the southern state of Kerala. The tutor (played by real-life martial art expert and the film’s action director Shifuji Shaurya Bhardwaj) takes him under his wing and trains him in the art of breaking a man’s bones with the mere flick of a finger. Ronnie also meets Sia (Shraddha Kapoor), a giggly, air-headed girl who falls for him because it rains every time they meet and she is convinced it is a karmic sign of some sort. Sia’s shrill manner and her perpetually wide-eyed demeanor make you wonder why Ronnie is so smitten. But the romance is handled so fleetingly by the

The villain is a menacing looking Raghav (Sudheer Babu), who is the son of Ronnie’s mentor and runs an illegal fight club in Bangkok. Raghav is equally smitten by Sia (another of this film’s mysteries) and kidnaps her, imprisoning her at his headquarters. This sets the stage for even more conflict, plenty of broken bones and some well-executed scenes in which Shroff proves he is an action hero in the making. Borrowing heavily from films such as “The RaidRedemption” and “Fight Club”, Sabbir Khan puts in enough exciting action in the 139minute film for lovers of this genre to be satisfied. The film is tailor-made for Shroff and he doesn’t disappoint – he executes a kick with the same fluidity and grace as a dancer and makes the toughest of sequences looks scarily easy. The easiest of romantic scenes requiring a bit of emoting – that is a whole other story. But if you can forgive the lack of logic and acting chops, then “The Tiger Shroff Showreel” might be worth your time. – Reuters
