But in the view of at least one Captain America, the presumptive nominee for president is making America hate again. “Donald Trump has certainly been a candidate whose words have been alarming for someone like me, who happens to be at the front lines of bigotry in post-9/11 America,” said Vishavjit Singh, a Washington-born Sikh artistactivist in his mid-40s. By day, Singh is a political cartoonist. But on occasion, he transforms into Sikh Captain America, a costumed soldier with a traditional head wrap who fights bigotry and champions cultural understanding through public appearances and talks. And ahead of Friday’s opening of the film “Captain America: Civil War,” Singh draws a stark contrast between Trump and Cap’s alter ego, Steve Rogers — two iconic New York characters born in the ’40s. “Captain America as a character would stand in complete opposition to Donald Trump and his candidacy,” said Singh, who now lives in New York himself. “Today, besides ISIS, the festering of extreme right-wing and supremacist forces at home will be targets for Captain America’s wrath.” The artist also creates cartoon campaigns, such as the Send Sikh Note To Trump postcard campaign, in which he and some of his fans send Trump a postcard every day “with a message focused on processing our anger inspired by his jingoistic madness into small kernels of humor and compassion. He might be full of himself, overstuffed with his achievements with a towering skyscraper of an ego, but even deep inside him resides seeds of benevolence,” Singh said. “I wish him well; I wish him compassion; I wish him to realize the violence of his words; I wish him a landslide loss in the elections for his own good.” Captain America was born in New York during World War II, from the minds of Jewish creators and

He created posters showing an illustration of Captain America in a turban and beard for his exhibitor booth. One fan was Fiona Aboud, a New Yorkbased Brazilian American photographer who was working on her

art project “Sikhs: An American Portrait.” She said he should come back next year dressed as Captain America. He said no — until about 10 months later, when a gunman entered a Sikh temple in Milwaukee and killed six worshipers. “I decided to get out of my own way and engage my vulnerability — body-image issues, being skinny all my life, and getting stereotyped all my life,” he said. “So in June 2013, I stepped out as Captain America with anxiety, sweaty palms and not knowing how people will respond. It turned out to be one of the most amazing days of my life.” It was the mid-’70s, and Singh was nearly kindergarten age, when his family left the Maryland suburb of Hyattsville to move to India. Young Vishavjit went to school in New Delhi, where he showed a talent for art but was told to drop that interest by seventh grade. “Family and culture decided there are only two professions in my future: medicine and engineering,” Singh said. Some superheroes don glasses to shield their identity, but a young Singh had to begin wearing glasses while in grade school — which for him, he said, was “aesthetic suicide.” “I got subtle digs from family and friends, which never stopped. Having a handsome brother to be compared to did not help. By the time I was in high school, I was finally convinced of my ugliness. This would inform everything I did or not,” said Singh, who compensated by “studying my rear off.” In 1984, after

He’ll appear at, say, the University of Kansas one week and L.A.’s Japanese American National Museum the next. This summer, he’ll also be part of Marvel Comics’ gallery of 75 Captain America cosplayers from across the nation, to celebrate the 75th anniversary of Captain America’s creation. Singh also donned the costume for a comedy segment on “Totally Biased With W. Kamau Bell” and appeared in SikhLens Productions’ 2014 short film, “Red, White and Beard.” Plus he gets “love letters from strangers, messages from armed services members, a responder for 9/11 from Arizona police force,” he said. Whenever he steps into his Cap uniform, he said, “suddenly, I am like the ultimate patriot for fellow Americans — someone to be embraced, saluted, captured in pictures. Someone who represents America; someone who is one of ‘us.’ “In costume, I only had two young men attending a Puerto Rican parade who called me a terrorist,” Singh recounts. “I asked them: Are [you] really calling Captain America a terrorist? They apologized profusely.” That negative reaction, he says, was uncommon, yet only fuels his sense of costumed mission. “Near unanimously,” he says of public response, “it has been love across the board.” – The Washington Post

Clinton Promises To Recruit More Asian-Americans In Her Administration By Ela Dutt t was a love-fest between the sitting president, a potential Democratic incoming president, and the Asian-American community at the star-studded Asian Pacific American Institute for Congressional Studies’ awards gala, May 4 in Washington, D.C. President Obama owned the community as his own and praised its achievements, and Democratic presidential candidate Hillary Clinton promised to hire members of the community in her administration were she to win the White House Nov. 8. “I want to let you know that I will make sure that you are well represented in my administration if I am fortunate enough to be your president,” Clinton said, according to news reports. In a video snippet of her speech on the Web, the presidential hopeful urged the enthusiastic audience which shouted her name repeatedly, that they needed to join her campaign, adding, “I want you to be involved not just in my campaign, but more importantly, really governing our country in a way that keeps alive the promise of America,” President Obama, who made it

Sekhar Narasimhan, founder of the super-PAC AAPI Victory Fund, told News India Times, the takeaway for him from the President’s message was that Asian Americans needed to get moving, get to the polling booths, to make a difference. “Only 56 percent of Asian-Americans are registered to vote, and IndianAmericans probably even less,” said Narasimhan who is also cochair of the Democratic National Committee’s Indo-American Council. “Indian-Americans are very apathetic, even in the simple act of voting. Our data shows that in the 6 swing states, Nevada,

Colorado, Ohio, Virginia, North Carolina, and Florida, we are the margin of victory.” Comedian and author Aziz Ansari was presented with the Vision Award at the gala, along with actor Alan Yang who was the co-star in his latest feature documentary “Master of None. “We need more minority creators,” Ansari said in his acceptance speech, NBC News reported. “Don’t wait for white people to open the door for you,” he added. The event was emceed by two Indian-Americans, actor Parvesh Cheena and economist and entrepreneur Sonal Shah. Cheena best known for his role on NBC’s sitcom Outsourced and as the voice of the Transformer Blades on Discovery Family Channel’s “Transformers: Rescue Bots.” Shah is currently executive director of the Beeck Center for Social Impact & Innovation and previously was the director of the White House office of Social Innovation and Civic Participation. The 22nd annual gala was attended by more than 1,000 guests including members of Congress, among them Rep. Ami Bera, D-California, political activists, community leaders, and celebrities as well as White House Champions of Change.

Judge Orders Questioning Of Clinton Aides About Emails – WASHINGTON federal judge has ordered questioning of Democrat front-runner Hillary Clinton’s top aides about her secret email server. Top Clinton aides Huma Abedin and Cheryl D. Clinton herself could also have to answer questions in the open records case brought by conservative foundation, Judicial Watch, according to Judge Emmet G. New York City Launches Multilingual Campaign To Help Uninsured Immigrants By a Staff Writer

ew York City Mayor Bill de Blasio’s Office of Immigrant Affairs, with the support of the New York State Health Foundation, launched a campaign May 5, to reach uninsured immigrant New Yorkers eligible for DACA (Deferred Action For Childhood Arrivals). The launch was held at the City University of New York Graduate School of Journalism’s Center for Community and Ethnic Media. The campaign aims to reach more than 300,000 immigrants through targeted advertising, public education materials, and centralized resources in English, Bangla, Urdu, Spanish, Chinese, Korean, Russian, Haitian-Creole, and Polish. “DACA recipients are often unaware that they are eligible for Medicaid and other benefits, leaving countless immigrant New Yorkers uninsured,” Mayor de Blasio said, adding that MOIA’s campaign efforts would ensure that DACA recipients are aware that these benefits are accessible and obtainable. “This will not only help decrease the number of uninsured immigrant New Yorkers, but it also will encourage others to come out the shadows and apply for DACA and it’s numerous benefits,” the Mayor

said. According to officials, this campaign is the largest effort across the country to highlight DACA recipients’ potential Medicaid eligibility and other benefits. Despite the Affordable Care Act helping many New Yorkers, some groups still lag far behind, especially immigrants, they said. According to the City’s estimates, about 85,000 New Yorkers

are eligible for Deferred Action for Childhood Arrivals (DACA) program. However, less than half of eligible New Yorkers have applied for these benefits. The two-month campaign will include transit ads, ads in ethnic and community newspapers, social media, and info-cards displays in local businesses, in order to reach immigrant New Yorkers in the communities in which they live and in the languages that

they speak. The campaign’s visuals reflect the diversity of DACAeligible individuals across communities, in order to better connect to individuals who are parents, workers, and/or college students. That equals more than 38,000 arrivals who are largely unaware they may have access to health coverage for the first time in their lives, not including the root benefits of the program, according to State Senator Martin Malavé Dilan. In 2013 approximately 63.9 percent or 345,000, of the City’s undocumented individuals were uninsured. The uninsured rate for undocumented immigrants is more than three times that of other noncitizens in New York City (20%) and more than six times greater than the uninsured rate for the rest of the City (10%). Meanwhile, enrollment in ‘ActionHealthNYC’ for uninsured immigrant New Yorkers has begun May 2, and will end June 30. Connecticut Teenager Tops Wells Fargo National Essay Contest By a Staff Writer 13-year-old girl from Connecticut was named the 2016 grand prize winner of ‘Succeeding Together’ national essay contest that has been created by Wells Fargo to celebrate the huge impact The First Tee, a youth development organization through golf, has on students across the country. The written contest was held ahead of the 2016 Wells Fargo Golf Championship held last week in Charlotte, North Carolina, to which the grand prize winner, Meghna Mazumdar, won a trip. The competition was specifically created for the 30,000+ teenage participants of The First Tee that introduces young people to golf and its inherent values at approximately 170 chapters across the U.S. The ‘Succeeding Together’ written contest asked participants to write about the importance of having and being a part of a “Go-To Team,” a core life skill of The First Tee that fosters partnership and teamwork in all areas of life. ACF Holds Two-day Cricket Coaching Clinic In Queens By a Staff Writer

A

two-day cricket coaching clinic was held for more than a dozen trainers from New York area at the Idlewild Cricket Facilities of Queens United Sports Club in Queens April 30-May 1. The clinic was conducted by American Cricket Federation’s director of coaching Jatin Patel at the level 1 and level 2 stages for more than a dozen coaches. Most of the participants in the two clinics have played cricket at the first-class level, which made communication of game strategies, awareness, and basic bowling and batting techniques somewhat easier. As part of the clinic, an under-15 boys cricket match featuring the Queens United Cricket Academy and Cricmax, based in New Jersey, was held as well. The match gave the participants an opportunity to observe the coaching styles of the teams’ coaches as well as to address issues such as scoring, game analysis and team strategies on the field. New Jersey Man Sentenced For Distributing Child Pornography From News Dispatches

n Indian-American man from New Jersey was sentenced May 6, to four years in prison for distributing child pornography on the Internet. Nil Choudhury, 27, a resident of Margate, N.J., was arrested in 2013. He pleaded guilty this March. On May 6, Atlantic County Superior Court Judge Bernard E. DeLury, sentenced Choudhury to four years in state prison. He must also register as a sex offender under Megan's Law, the

In his guilty plea, Choudhury admitted he had distributed child pornography and that he used file sharing software to make it available to multiple users who could download it from a "shared folder" on his computer. He was caught when a detective from the New Jersey State Police Digital Technology Investigations Unit downloaded some of these files while monitoring a network popular with sex offenders. They traced it to Choudhury's home where they found many images and videos of child pornography

on his computer. “Anyone who views and distributes child pornography takes part through their actions in the sexual exploitation of children,”

Pranav Patel of Tamarac, Florida, participated along with eight others in the multi-state scam “through a dizzying round of unauthorized trades” to pump up the share price of a company with no business operations, Robert L. Capers, the federal prosecutor in Brooklyn said. The 35-year-old Patel was scheduled to appear later Wednesday in a federal court in Fort Lauderdale, Florida, for legal proceedings to bring him to Brooklyn for trial. The case involved the NASDAQtraded stocks of ForceField Energy Inc., which claimed to be a world-wide distributor LED lighting products. The nine from four states

South Brunswick Man Charged With Criminal Mischief From News Dispatches

jinka Kelkar, a 20-yearold resident of South Brunswick who allegedly sought to take a revenge on a man who was dating his ex-girl friend, accidentally targeted the wrong house and caused $10,000 in damage to vehicles parked in the driveway. Police said that Kelkar damaged five vehicles parked outside a house on Friendship Road in South Brunswick. He was arrested within a few hours after the incident May 8 and arrested Kelkar who was seen damaging the vehicles on home surveillance camera. He was charged with trespassing, vandalism and third-degree criminal mischief. He posted $10,000 bail and was released, police said. If convicted, Kelkar faces

up to five years in prison. According to Tapintonet.com, the family members of the house targeted head some hissing air noise around midnight outside, and came out to check. They found that tires of some of the cars, including guests at home, were slahed and one car had obscenities scratched in to its door and fender and called police. Officers and family members reviewed the home surveillance tape and found that the suspect moments earlier damaging the vehicle in their driveway. Police recognized the image in the videotape at Kelkar. The report said that police went to Kelkar’s residence but were told by his parents he was not home. Later, officers on surveillance outside his home found that Kelkar was inside his home at 6:30am and took him into custody.

ohsin Raza, 51, and his wife, Humaira Iqbal, 40, of Woodbridge, Virginia, were sentenced April 29, to 24 months and 15 months in prison, respectively, for conspiracy and wire fraud affecting a financial institution. They along with two others, four defendants were convicted by a federal jury on Feb. 3. According to court documents and evidence presented at trial, in 2005 Raza was hired by SunTrust Mortgage (STM) as a vicepresident tasked with opening an office in Annandale, Virginia. Raza hired his wife and her brothers, Farukh Iqbal, 41, and Mohammad Ali Haider, 33, both of Chantilly, Virginia, to work as loan officers at

SunTrust Mortgage. From 2006 until 2007, when the defendants left SunTrust Mortgage, they falsified loan applications for borrowers and purchased fake tax documents to support the false loan applications, according to a press release from the Justice Department. SunTrust Mortgage underwriters in Richmond approved the loans totaling several million dollars based in large part upon the fake documents in the files, and ultimately borrowers were given loans to buy homes that they could not afford. Raza and Humaira Iqbal were also ordered to forfeit two properties and $40,000 and pay restitution to victims in the amount of $1.9 million. The brothers Iqbal and Haider were each sentenced to one year and one day in prison.

Philadelphia woman who participated in one of the largest credit card fraud schemes ever was sentenced May 6, to 40 months in prison, U.S. Attorney for New Jersey Paul J. Fishman announced. Vernina Adams, 34, previously pleaded guilty before Judge Anne E. Thompson to an information charging her with one count of conspiracy to commit bank fraud. Judge Thompson imposed her sentence in Trenton federal court. In addition to the prison term, the judge sentenced Adams to five years of supervised release. Adams was originally charged in February 2013 as part of a conspiracy, led by Tahir Lodhi, Babar Qureshi, Ijaz Butt, and others, to fabricate more than 7,000 false

identities and obtain tens of thousands of credit cards. Since then, 19 people, including Adams, have pleaded guilty in connection with the scheme. The scheme involved a threestep process in which the accused would make up a false identity by creating fraud identification documents and a phony credit profile with the major credit bureaus; pump up the credit of the false identity by providing bogus information about that identity’s creditworthiness; then borrowed or spent as much as they could without repaying the debts – causing more than $200 million in confirmed losses to businesses and financial institutions. The network included maintaining more than 1,800 “drop addresses,” including houses, apartments and post office boxes, across the country, which the

defendants used as the mailing addresses of the false identities. Adams and her conspirators also used sophisticated methods – including a network of blackmarket businesses called “tradelines” providers – to commit fraud. Tradelines are lines of credit in a credit history. During her plea proceeding, Adams admitted advertising on Craigslist for individuals willing to add someone onto their credit cards. She also admitted selling other members of the conspiracy fraudulent tradelines, including by working with Acapulco Jewelry, a complicit business in California. Adams would extend a fictitious line of credit to a false identity, backdate the line of credit so it appeared to have existed for a longer period of time, then falsely report the line of credit had been paid.

Nehru Who? Indian Textbooks Delete Nelson Mandela, English Poets And Country’s First Prime Minister

By Annie Gowen n independent education panel in Rajasthan caused a firestorm by almost completely erasing the legacy of the country’s first prime minister, Jawaharlal Nehru, from a draft school textbook, the Indian Express reported. In an omission akin to deleting George Washington or Thomas Jefferson from American history books, a new secondary school textbook posted online contains a few scant references to Nehru but no discussion of his role securing India’s independence from Great Britain or overseeing the country’s tumultuous early years as a new democracy, the report noted May 8. The secondary education board in the state -- led by India’s governing conservative Bharatiya Janata Party -- earlier removed the work of Western poets like John Keats and T.S. Eliot and excised a chapter on Nelson Mandela from its textbooks -calling it “meaningless.” The Mandela chapter was replaced with writing on India’s tribal communities, according to the Times of India. Leaders said that they wanted to bring the work of Indian authors closer to students. “It is strange and unfortunate Rajasthan students have been reading chapters on Africa and poems by foreign authors while they are ignorant about our own tribals and poets. These textbooks giving undue importance to foreign authors and chapters are meaningless,” a senior committee member told the Times of India. The move comes as the country’s central government is set to unveil a new national education

policy which some historians and educators fear could bring similar changes. India’s education minister, Smriti Irani, came under fire in recent days for a plan for India’s ancient Sanskrit to be taught in its prized engineering and technical universities, whose alumni include Google’s Sundar Pachai, among others. She later

said it would be taught as an elective. Changing or rewriting Indian history has long been a source of controversy and political debate. A similar effort occurred during the last Hindu nationalist-led government of 1999-2004, where educational texts were rewritten to celebrate the lives of Hindu Kings over the Mughal emperors. Hindu nationalists have long argued that much of Indian history has been written from a Eurocentric, colonial perspective and needs to be adapted.

Back then -- and now in Rajasthan -- the assassination of Mohandas K. Gandhi, regarded as the father of the nation, was glaringly omitted from textbooks. Gandhi was assassinated by a member of the Hindu right wing in 1948 by a man who believed his policies had appeased Muslims. The man, Nathuram Godse, had briefly been a part of the Rashtriya Swayamsevak Sangh, the Hindu nationalist group closely associated with the B.J.P.,

the party of Prime Minister Narendra Modi. Not surprisingly, India’s Congress Party leaders -- led by the descendants of Nehru, including vice president Rahul Gandhi, his great-grandson -were not pleased by the move. Congress party leader Sachin Pilot said in a tweet that deleting Nehru from textbooks was a demonstration of the party’s “petty thinking.” – The Washington Post

rime Minister Narendra Modi’s party May 9 made public his university degree certificates in a bid to disprove allegations by a political opponent that he had fabricated his qualifications. Since winning an election last year, Arvind Kejriwal, the ambitious chief minister of the Delhi regional government, has stepped up his attacks on Modi. Kejriwal has not said why Modi would want to claim a fake degree but the allegations, which set off frenzied speculation on social media, struck a nerve in the prime minister’s Hindu nationalist party, upset about the risk to his reputation. Modi has often cited the journey from his humble begin-

nings as a tea vendor’s son to national leader to win support from the country’s poor. Having a degree fits the narrative of a man with the grit and determination to succeed. Senior leaders of the Bharatiya Janata Party (BJP) held aloft what they said were Modi’s degrees, a Bachelor of Arts from Delhi University and

a Master of Arts in Political Science from Gujarat University. “It is very unfortunate that we have to clarify the prime minister’s educational qualification,” party president Amit Shah told a news conference in New Delhi at which he was flanked by Finance Minister Arun Jaitley. Spokesmen for the two universities declined to comment on whether Modi’s degree certificates were genuine. Kejriwal says he has evidence Modi misappropriated the degrees of someone with the same name. A spokesman for Kejriwal’s party stood by the accusations, saying there were inconsistencies in the dates and names on Modi’s degrees. “We are happy to have an illiterate prime minister,” said

the spokesman, Vikas Yogi. “But not a prime minister who lies about his degrees.” Modi’s party distributed photocopies of the certificates to journalists, with its officials saying Kejriwal should apologize to the country for doubting Modi’s credentials. “The degrees are in the public domain, but such allegations debase our political discourse,” said party president Shah. Kejriwal, a self-styled antigraft crusader, has been at loggerheads with the BJP since last year. In December he accused Jaitley of allowing fraud at the Delhi cricket association that he ran for a decade from 2003. Armed Guards Protect Last Water In Drought-parched Tikamgarh City By Shuriah Niazi

uthorities in this droughtparched city in Madhya Pradesh have deployed round-the-clock armed guards at a river-fed community reservoir to prevent farmers from siphoning the remaining water for irrigation. With rainfall in Tikamgarh district this year 52 percent below average – the second dry year for the area – water is now available to city residents only sporadically, with fears even that may run out during the peak heat months of May and June, authorities say. Forty-seven-year-old Suryakant Tiwari, one city resident, said his family and many others now have drinking and household water supplied only once every five days.

“I have not seen such a condition in my lifetime. Almost every water source in the area has dried up. We don’t know how we will survive,” Tiwari he said. Farmers have been prohibited from drawing water from reservoirs to irrigate their crops. But Tikamgarh Municipal Corporation officials fear farmers from adjoining Uttar Pradesh whose farms border the Bari Ghat dam, fed by the Jumuniya River are poaching water to try to keep their crops alive. “If crops continue to be irrigated using the river water, it is not going to last long and there will be severe crisis during the summer season,” warned Laxmi Giri, the Tikamgahr municipal corporation president. “Our priority is to supply drinking water to the people.” The Jamuniya River is the only

source of drinking water for over 100,000 people in Tikamgarh, she said. But “farmers of the neighboring state try to open the gates of the dam and draw water illegally using pipelines. We’re therefore compelled to deploy guards,” Giri said. Tikamgarh is hardly alone. The drought-ravaged Bundelkhand, a region in central India spread over the states of Madhya Pradesh and Uttar Pradesh, is suffering some of the worst drought in memory. Crops in the area have been badly hit, cattle are dying of thirst and lack of grazing, and there are growing fears that even drinking water could run dry before the monsoon is expected to begin in June. “All the ponds, reservoirs and water bodies which earlier supplied water in areas of Tikamgarh

have dried up. With no water available for irrigation, farmers have abandoned their crops and are migrating to nearby urban areas in search of livelihood and for sustenance. Life is really hard for them,” said Rajendra Adhvrayu, a local journalist who writes on water issues in the region. “The situation has never been so bad,” he added. “This is for the first time that the tussle over water has degenerated into a battle of sorts. We fear the situation will be grave during the coming months.” The Jamuniya River separates Madhya Pradesh and Uttar Pradesh states along some of its length. A 1974 water sharing pact gives Madhya Pradesh 17 percent of the water stored in the Jamuniya Dam in Uttar Pradesh. Madhya Pradesh stores its share in five dams, including the

Bari Ghat. But this year, water is available only in Bari Ghat dam. Water in the four other dams – Harpura, Charpuva, Madiya and Sudan – has run out. Giri said authorities in Tikamgarh had shut off the electrical supply to farmers in Uttar Pradesh to try to prevent pumping of water from the dam for irrigation. Farmers have instead turned to using diesel pumps to pull water from the reservoir, he said. “The administration has failed to convince them not to draw water illegally from the dam,” she said. n April 7, 2016, U.S. Citizenship and Immigration Services (USCIS) announced that it has reached the congressionally mandated H­1B cap for fiscal year (FY) 2017. USCIS also received more than the limit of 20,000 H­1B petitions filed under the U.S. advanced degree exemption. Because of the surge of petitions that were filed, USCIS conducted a lottery to determine which petitions received during the five­ day submission period will actually be considered. USCIS has already started sending receipt notices for the petitions selected in the random selection process. As expected, it is a very stressful time for thousands of potential H­1B workers. Until the prospective H­1B employers or their legal representatives start receiving receipt notices, and the dark clouds of uncertainty over prospective H­1B visa holders move past, the question worth asking and exploring is: “Do I still have a chance of getting an H­1B visa even if my H­1B petition does not make it to the H­ 1B cap?”

Unfortunately, the regular (bachelor’s) H­1B cap remains at 58,2001 and the master’s cap cannot accommodate more than 20,000 specialty occupation work­ ers. However, there are certain categories of cap­exempt H­1B visas. One such cate­ gory is for beneficiaries of employment offers at: (1) institutions of higher educa­ tion or related or affiliated nonprofit en­ tities; or (2) nonprofit research organizations or governmental research organizations. Thus, to get a cap­exempt H­1B visa using this category the funda­ mental question to ask is: whether the offer of employment is from an institu­ tion of higher education, or related or af­ filiated nonprofit entities, or from nonprofit research organization or gov­ ernmental research organization. For the purposes of H­1B cap exemption, the H­1B regulations have adopted the definition of institution of higher educa­ tion set forth in section 101(a) of the Higher Education Act of 1965. To be clas­ sified as an institution of higher educa­ tion, the educational institution must satisfy five (5) requirements. First, the educational institute must be a public or other nonprofit institution. Second, the master’s degree issuing institution must be accredited by a nationally recognized accrediting agency or association. Moreover, the educational institution must satisfy all of the following three re­ quirements: (1) admits as regular student only persons having a certificate of grad­ uation from a school providing second­ ary education, or the recognized equivalent of such a certificate; (2) is

legally authorized within such state to provide a program of education beyond secondary education; and (3) provides an educational program for which the insti­ tution awards a bachelor’s degree or pro­ vides not less than a 2­year program that is acceptable for full credit toward such a degree. Assuming that the academic institution will qualify as an institution of higher education, the next two questions that have perplexed immigration practition­ ers and potential H­1B employers are: (1) what is the difference between employed “by” and employed “at”; and (2) how does one determine if the nonprofit insti­ tution is “related to or affiliated with” an institution of higher education. The 2006 Aytes memo clarified the differ­ ence between employed “at” and em­ ployed “by’, and the purpose2 behind it. This memo explained that commonly, qualifying institutions petition on behalf of current or prospective H­1B employ­ ees and claim this exemption. In certain instances, petitioners that are not them­ selves a qualifying institution also claim this exemption because the prospective H­1B beneficiary will perform all or a portion of the job duties “at” a qualifying institution. Such petitioners are referred to as “third party petitioners.” Thus, USCIS allows an exemption in situations where the employee is employed by a “third party petitioner” but the prospec­ tive H­1B employee will perform job du­ ties at a qualifying institution that directly and predominately furthers the normal, primary, or essential purpose, mission, objectives or function of the qualifying institution, namely, higher ed­ ucation, or nonprofit research organiza­ tion, or governmental research organization. Thus, if the petitioner is not itself a qualifying institution, the bur­ den is on the petitioner to establish that there is a “logical nexus” between the work performed predominately by the beneficiary and the normal, primary, or essential work performed by the qualify­ ing institution. In this context, the issue that has been source of frequent litigation is: “How to determine whether the nonprofit institu­ tion is “related to or affiliated with” the institution of higher education?” The Ad­ ministrative Appeals Office (“AAO”) has always deferred to the USCIS approach as to whether the nonprofit institution is related to or affiliated with the institu­ tion of higher education. to be continued...

The sounds of certain mantras create vibrations which are helpful to seekers on the path. What is needed is that the seeker must repeat the mantra with faith, love and devotion.

A: Science is the study of the laws of the external world. Spirituality is also a science, but it studies the inner world. Now the time has come where both of them are drawing close to each other. Physics for instance studied the atom, but after quantum physics the atom is asking about who is the one who studied me? So they are coming closer. But one is concerned with the outer sphere while the other is concerned with the inner sphere. Q: Why was evil created in the first place? Why can’t we all have clean hearts and souls from the very beginning? A: Evil was not created. In the beginning, there was only good. But the absence of good is evil. Evil in itself has no existence of its own. Dark­ ness has no existence of its own. Darkness is ab­ sence of light. A room may have been in the dark for 100 years. You go and light a match, a single match, will remove the darkness. The darkness will not tell you ­ I have lived here for 100 years. How can you drive me out immediately? No, darkness has no existence at all. Darkness is only absence of light. Likewise, evil is only absence of good. Q: I have forgiven my friend for cheating me, but I cannot forget his cheating me. What should I do? A: It is said that forgiveness is healing the wound and forgetting is taking off the scar. If you want the scar to remain with you, you can keep on remembering it. But, if you want to do away with the scar also, you must try and forget. Q: What is one simple exercise I can do to ele­ vate myself? A: Clasp God to your heart and let your hands be busy doing as much good as you can, to as many as you can, in as many ways as you can. Indian Film Festival Features Film World’s Elite And Newbies

By Ela Dutt – NEW YORK he 16th annual New York Indian Film Festival (NYIFF) held its inaugural gala May 7, at the Skirball Center for Performing Arts. Billed as the oldest, most prestigious Indian film festival in the U.S., this year’s smorgasbord of independent, art house, alternate, and diaspora films, screened over the period May 7-14, includes 40 screenings (35 narrative, 5 documentary), all seen for the first time in New York City. In addition, the festival also features five programs of short films. Numerous film-makers with their cast appeared on the red carpet speaking about their films. Celebrities spotted at the gala included author Salman Rushdie, filmmaker Mira Nair, author and actress Madhur Jaffrey, India’s Consul General in New York Riva Ganguly Das, and author Suketu Mehta. The dance troupe, Manhattan Andaaz performed. The master of ceremonies was Sree Srinivasan, chief digital officer of the Metropolitan Museum of Art. Aroon Shivdasani, executive and artistic director of the IndoAmerican Arts Council, which puts the show together, welcomed the guests. Nair, who is “Face of the Festival” according to Shivdasani, spoke about the growing influence of the festival and dwelt on her new film about Uganda, her second home.

Panels where representatives of each of the language films discussed their experiences; an LGBT panel, a new directors panel, among others. The festival also features the National Film Development

Ghosh, the lead character in the Konkani film, upon request, sang a few songs impromptu at the gala, bringing people to their feet to dance. “It was a very exciting night,” Shivdasani told Desi Talk. “We never actually had a language film for opening night. This was a complete departure and what that means is we are getting bolder,” she laughed. The Konkani feature film is a tribute to Goan music and musicians of the 1960s and 1970s, narrated through the emotional rollercoaster of a love story, telling the nostalgic tale of musicians who lived and died unrecognized, unappreciated and unsung. Multiple award winner and fresh from the international film festival circuit, Parched, is about four ordinary women in rural Gujarat who talk unapologetically about men, sex and life as they struggle with their individual boundaries. The highlight is the world premiere of Kagaz Ki Kashti (Paperboat), which tracks the life of a down-to-earth, small-town boy, who made it big in the Ghazal world breaking through the norms and mixing western instrumentation. to make this classical genre simple and hummable.

‘The Man Who Knew Infinity’: Life Of A Mathematical Genius Is Snuffed Out Young By Michael O’Sullivan he life of the imagination is difficult to capture, let alone to contain, onscreen. For that reason, movies about such original thinkers as famous writers and artists - or, as in “The Man Who Knew Infinity,” the pioneering mathematician Srinivasa Ramanujan - suffer from an inherent difficulty. How do you show, in ways that are at least vaguely cinematic, the stroke of genius? Dev Patel plays Ramanujan, a self-taught mathematical prodigy from India who died tragically at age 32 after doing groundbreaking work at Cambridge University in the early years of the 20th century. For simplicity’s sake, the film focuses on only one aspect of Ramanujan’s work: his pioneering exploration of number theory, particularly as related to parti-

tions. The number 4, for instance, can be expressed as the sum of

five - and only five - “partitions” of whole numbers: 1+1+1+1; 1+1+2; 1+3; 2+2; and 4. As a num-

ber grows larger, approaching infinity, could there be a formula, Ramanujan wondered, that would calculate the number of its partitions? He thought he had found one. All he had to do was prove it to a skeptical, Anglo-centric academic community. This is math at its purest math for math’s sake - and it’s heady, if hardly cinematic, stuff. We watch Ramanujan shuffle back and forth between his digs at Cambridge and the office of his mentor, professor G.H. Hardy (Jeremy Irons), who suspects his protege is right but unrigorous. Hardy pushes him to be more diligent in his proofs. Ramanujan, meanwhile, equates his grasp of number theory to a religious experience - to a glimpse of God, in short - as something that comes to him intuitively rather than through cold, hard calculation. “Every single positive integer is one of his friends,” Hardy’s col-

league Littlewood (Toby Jones) aptly observes after Ramanujan notices that the number of his taxi, 1729, happens to be “the smallest number expressible as the sum of two cubes in two different ways.” (Such anomalies have today come to be called “taxicab numbers,” after Ramanujan.) Of course, our hero is also quite ill with tuberculosis through all of this, so the movie benefits from the poignancy of a brilliant life about to be extinguished. Other sad sub-themes - antiIndian racism, Ramanujan’s pining for his wife back in Madras add little to the film except cliched sentimentality. Based on Robert Kanigel’s well-received 1991 biography of Ramanujan, “The Man Who Knew Infinity” tells a great story. It’s just that it’s a little too by-the-book to make anything other than a so-so movie. – The Washington Post

Amitabh, Kangana Win Top Honors At 63rd National Film Awards – NEW DELHI he 63rd National Film Awards ceremony here on April 3 got a dash of glitz and glamour of Bollywood with Amitabh Bachchan and Kangana Ranaut getting Best Actor and Best Actress honors. President Pranab Mukherjee presented the awards at the ceremony at Vigyan Bhavan, which got talent from all the regional cinematic worlds across India under one roof. A total of 21 awards were given by the President in the NonFeature Film category while the number of awards in Feature Film category were 51. And to add to it, three awards were given to Best Writing on Cinema. While Amitabh, dressed up in a black suit, picked up the award for his act as a Bengali father in “Piku”, which also starred Deepika Padukone, Kangana looking radiant in off-shoulder gown got the honor for her superlative dual act in “Tanu Weds Manu Returns”. She has previously won National Awards twice for her roles in “Fashion” and “Queen”. In the Feature Film category, the award for the Best Feature Film was given to filmmaker S.S. Rajamouli’s southern magnum opus “Baahubali: The Beginning”, produced by Shobu Yarlagadda and Arka Mediaworks Pvt Ltd. The talent of the Hindi film industry was lauded along with regional film industries like Bengali, Marathi, Punjabi, Tamil, Telugu and Assamese. The President said that the “Indian films truly reflected the Indian character of unity and diversity”. Mukherjee complimented the award winners who
