HE mother of an eight year old girl who was allegedly raped and sodomised at the age of six by Xolile Tose (33) of Motherwell is pleading with South Africans to help her innocent child face life again.
Tose is currently on trial in the Port Elizabeth High Court. His bail application had been denied. He has pleaded not guilty. The unemployed woman (30), who cannot be identified to protect the identity of the child, is struggling to survive since the ordeal on 16 December 2011. She is currently renting a shack in Motherwell. The told PE Express Indaba, that she needs assistance to help her child live life to the full,
like any other child. The girl suffered severe physical injury to her private parts and has to wear a colostomy bag as a result of the horrific rape. Her mother said the girl was also asked to leave the school she was attending owing to the smell of the colostomy bag. “This is an allegation the Department of Education refutes. But the child is not at school. The records show that she last attended school in March 2013,” said Children’s rights advocate Petros Majola. “We, the caring members of society need to do something to restore this child’s childhood. We need to find ways to get her a home, with sanitation, water, safety and most of all love,” said the Justice Department’s Intermediary, who spoke to PE Express as a mother, and a caring South African resident.
Tose allegedly raped the child at knifepoint. Despite the presence of the intermediary, the child was not able to testify in court yesterday. “The child has not developed intellectually and psychologically since the ordeal. She is eight but has the intelligence of a 5-year-old,” said clinical psychologist Karen Joyce Andrews on why the little rape victim could not testify. “We’re here to support the child. Harsh sentences must be imposed on those who brutally attack our children and they must rot in jail. Whatever happens to the accused, we’ll make sure all the prescripts of the law are followed in order to protect the child, said Director of Khula Community Development Project Majola. He added, “But we’ll also make sure that she is not failed by the state in terms of enjoying life to the fullest after this experience,”
According to Majola, the child deserves to be treated with dignity and respect as enshrined in Section 10 of the Constitution of the RSA Act 108 of 1996 as amended. Congress of the People (COPE) members have been at the court since Monday to show their support to the victim and her mother. “We hope the justice department would ensure that the accused is heavily punished for ruining the poor child’s life, said Cope Cllr Nobenguni Magwaca. “We know God said thou shall not kill. But our government should hang people who do things like these. They don’t deserve to be among people in our communities,” said IDAMASA President Bishop Sandile Jika, adding that as the church they had been praying ceaselessly for the child. The case is continuing this week.
