Ministry introduces electronic payment systems to ease revenue collections The Ministry of Land, Housing and Human Settlement development has introduced electronic payment systems in order to easy payment of land fees. In addition to easing the payment, the move also aim at enabling the Ministry improve revenue collections. This was said by the Minister for Land, Housing and Human Settlement development, Mr William Lukuvi, through his ministry budget. Mr Lukuvi said in 2015/2016 financial year the ministry plans to raise Sh70 billion, up from Sh61 billion planned for the previous year. Hon. William Lukuvi
He noted that in order to meet this increased target, the ministry would streamline revenue collection, including introducing systems which would enable people to pay land fees and taxes electronically. “In addition to introducing electronic payment systems, owners of large farms and estates will be required to pay their fees and taxed through banks,” elaborated Minister Lukuvi. He further said that in collaboration with the Ministry of Finance they will make sure that 30 percent of the collected revenue is remitted timely to the councils. He said this move would catalyse and motivate the councils to collect more. He said there will also be public awareness campaigns through media, to sensitise people the importance of paying land fees and taxes timely.

The Ministry will also move to deregister all title deeds owned by people who have not fulfilled the conditions of holding them including non payment of fees and taxes. Elaborating, Mr Lukuvi noted that electronic payment of land dues will enable land owners make payments through their mobile phones. The plan was to start using this system on July 1, this year. “This system will increase revenue collections but it will also reduce time people spend to make the payments through the conventional ways. I would like to appeal to the public to accept and use this system,” he said. In 2014/2015 the Ministry planned to collect Sh61.32 billion but as of last April revenue collections topped Sh47 billion, being 76.6 percent of the target. The amount denoted an increase of Sh3.8 billion compared to 2013/2014 collections of Sh43.2 billion under the same period. Meanwhile, the ministry has set a target of identifying land measuring 200,000 acres across the country which will be included in the national Land Bank. Mr Lukuvi said that the government has set aside Sh5 billion which will be used to compensate people who currently live or work on the targeted land. “This money will be put in the Land Compensation Fund,” he said noting that the government has already annulled a number of title deeds across the country in the previous year including Ufyome farm in Babati in Manyara and Fort Ikoma in Mara Region.

He said some title deeds to 67 surveyed plots have also been annulled. He said the ministry was continuing with verification of large farms which have been abandoned by its owners for long time. “We want to repossess this land and include it in our Land bank,” he said. Mr Lukuvi said further that the ministry has continued to build and improve electronic systems for management of land information and data. He named such systems as including Management of Land Information System or MOLIS and Land Rent Management System or LRMS. He said in 2014/15 the Ministry planned to start creating Integrated Land Management Information System – ILMIS, a wide system which embraces many things compared to the available systems. The works of creating the system started in may this year and it is expected that it will be completed in 2019/2020 financial year. He said in the first phase, the system will be fixed at the ministry headquarters and in offices of four zones. The first phase has been planned to be ready in 2016/2017 financial year.
The second phase will involve fixing of the system in all district council land offices. “After this system in put in place, all services related to planning, surveying and allocation of land and plots will be conducted electronically. Under the system applications will also be lodged electronically and replies will also be given through the similar means,” said Mr Lukuvi. In 2014/2015 the Ministry planned to fix electronic systems in 30 district councils, Mr Lukuvi said noting that the target has been surpassed as by April this year the system was up and running in 70 councils. “We now have 145 land offices in district councils with this electronic system including the Capital development Authority (CDA) in Dodoma,” he said. He noted that the remaining 23 council offices will have the system fixed before last July in order to have the entire country covered.
According to Mr Lukuvi, the Ministry has also improved the Management of Land Information System – MOLIS and now it has capacity to store and process transactions done in Zones and the office of the Title deeds registrar. He also said various land sector stakeholders can access and get information on land sector by downloading an applications in their smart phones called “ardhí tza”. He said information which can be accessed through this application include policies, laws, regulations, directives and various publications. He said the ministry has also developed another system which will enable people to get information on land ownership by sending sms through their mobile phones with message MOL to number 15404.

PIL, TPB & PSPF ink land, housing pact
Honourable Suluhu, who is also the Minister of State charged with Union Affairs, received a standing ovation from the real estate industry stakeholders, bankers and media as she took her place at the high table, ready to usher in a new age of planned settlements to a country that has long suffered shoddy squatter living. The celebrations were to honour the visionary and timely project to increase planned settlement in Tanzania. The project is the brainchild of Property International Ltd (PIL), leaders in land surveys and city planning that operates under the guiding slogan, Jenga kwa mpango epuka makazi holela (plan your building, avoid squatter living). However, PIL understands that after plots have been surveyed, comes the matter of funding to acquire the plot and thereafter to erect a structure. As such, the visionary team sought a tri-part partnership to bridge the financial gap. It brought on board two other key stakeholder, PSPF- Public Service Pension Fund (now open to the private sector and the general public) and the Tanzania Postal Bank (TPB).
Property International Ltd (PIL), the Tanzania postal Bank (TPB) and the Public Sector Pension Fund (PSPF) have inked a pact that serves to ease the acquisition of land and houses in key development regions across the country. The tripartite agreement is an avenue that offers the public the opportunity to own land on surveyed plots and to subsequently secure low interest loans to build houses.

The agreement was made public at a colourful event in mid August at the Hyatt in Dar es Salaam. Arriving at the celebrations, the guest of honour, Vice President Candidate under the ruling party CCM, Honourable Samia Suluhu smiled fondly and waved; a true daughter and mother of Tanzania, she could not resist a stately shoulder shake as she walked past the traditional dancers’ troupe.
The partnership will see PSPF members receive low interest loans from TPB (as early as within only 3 months of making contributions) not only to acquire the surveyed land from P.I.L but to build a house thereafter. Short of this ingenious set up, most Tanzanians are left to go out of pocket to purchase land and build their homes, a fit only a handful of the well off can achieve. “I congratulate this partnership, it comes at the right time and complements government efforts to ensure a decent living for our citizens,” said Honourable Suluhu in her speech.

She said surveyed lands have clear demarcations and records and that way making it easy to resolve any disputes that arise. She took the time to congratulate P.I.L again for its ‘title deed guarantee’ that P.I.L offers its clients.

“In the 70’s and 80s there was a migration into the cities but the land was not surveyed so people settled in unplanned settings,” the minister recalled. She went on to cite the troubles that were created by the unplanned settlements that continue to plague the county to date. She pointed out aspects like delivery of social services; “because of unplanned settlements even the government fails to deliver social services effectively…how are we to lay water pipes and electricity poles when there is no planned settlement?” she queried. She also cited the case of emergencies noting that fire trucks get stranded when they attempt to rescue a burning structure because there are no access roads in unplanned settlements short of demolishing other houses to reach the inferno.
“When an employee is not assured of their living conditions, they are less efficient because they are destructed by concerns over their welfare, this project solves this problem,” she added. Citing that the project may seem ‘small’ at the moment, Honourable Suluhu said; “this is a national project with immense impact on the welfare of the people and the development of our country.” The running mate of Presidential candidate Dr John Magufuli, said planned settlements will also serve to end land conflicts that have claimed numerous lives unnecessarily.
“I have a plot of land in Kigamboni and it’s been 3 years now, I still don’t have a title deed,” she revealed with a touch of humour. “So having P.I.L not only survey the land but also shoulder the burden of seeking the title deed and handing it to me along with my land, stands to revolutionalize the real estate industry in the country,” she said. She went on to pledge government support to see the project successfully expand and roll out to all regions of the country. She also said planned settlements will serve to reduce corruption related to land compensation in the event where persons are moved to pave way for development projects like roads. “At the moment, it is even hard to determine the compensation amount because the land is not surveyed,” she said. “This situation leaves loopholes for corrupt officials to cheat people out of their rightful compensation,” she said.
“With planned settlement, even a 6 year old can find their way home if lost because all they would have to do is tell the name of the street and the number of the house,” she said comically imitating the voice of a toddler much to the amusement of the participants. “This project will also give the nation’s workforce a peace of mind allowing them to be more productive and that way expedited the nation’s development,” said the Candidate for Vice Presidency.

Cover Story She said with the option for low interest loans, then most public servants and in particular teachers, stand to benefit. “With this project our teachers don’t have to wait for the government to build for them they have the opportunity to build their own houses through deferred payment paid back slowly over time so they do not bare the financial burden,” she said. “The government also looses a lot of revenue from un-surveyed land because no property tax is levied on buildings built on un-surveyed land,” she added. Summing up her speech, Honourable Suluhu said PIL efforts are in line with national development initiatives including the Big Results Now (BRN) targeted to ensure expedited results in priority development areas. “Guaranteeing basic needs for all Tanzanians is on top of the government’s agenda and a decent living is paramount to this goal, I again congratulate all three parties in this partnership for the initiative that will improve the welfare of our people,” she said. Earlier, Property International Limited CEO Abdul Halim Zahran reassured Suluhu and the public at large that PIL is committed to expanding the project and ensuring all Tanzanians have the option to own land and housing affordably and timely.
“We were motivated to launch this project by the plight of our brethren in unplanned settlements who fall victims to floods every rain season,” he said referring to Dar es Salaam squatters.
On his part, PSPF’s Gabriel Silayo reminded the general public that the fund now accepts voluntary membership and so all Tanzanians are now eligible for the land and home loans by joining the fund.
“But we also sought to address the question of funding, so we partnered with PSPF whose members are now entitled to low interest loans for the purchase of land,” he added.
“Our members are entitled to the loans after only 6 months of contribution,” he detailed.
The PIL CEO went on to detail that, after land acquisition comes the dilemma of constructing a house; “to beat this challenge, we joined hands with TPB to provide housing loans,” he said. He noted that at the moment, PIL, which has the capacity to survey up to 600 plots of land every day, has already sold out five projects in various parts of the country including Kibaha, Kigamboni, Mlandizi, Horohoro. He also revealed that PIL is already in talks with Zanzibar authorities to roll out the project in the Isles where there is a lot of encroachment of fertile land meant for agriculture. “So we have requested a stretch of land that is not good for agriculture and we will transform it into planned settlements complete with all social services and amenities,” he pledged.
He also reassured Minister Honourable Suluhu that teachers stand to benefit from the project because of the 350 000 and growing members of PSPF, most are teachers; “...and under this project, the teachers now have the opportunity to own land and build houses without any financial pressure,” he said. Tanzania Postal bank, TPB’s Chief Executive Officer, Sabasaba Moshingi said with 53 branches spread out across the country, the public is assured of accessing the land housing loans from anywhere in the country. He cited that 90 per cent of the country has not been surveyed and this is the case even for major commercial cities like the booming port city of Dar es Salaam where only 30 per cent of the land is surveyed. He highlighted several key initiatives that the bank has undertaken including support to small groups and sports clubs. “This part of our commitment to providing services that address the reality on the ground…many of these groups were marginalized and had no financial backing until now,” he said. Along with the dance troupe, the function was coloured by the Mjomba band who performed various songs including a rendition made specifically for the project. Backed by drums for rhythm, the band coined commendations for the project describing it as “the saviour of the poor man” “a chance for all to own land and housing” and also appropriately described the partnership as “a marriage that will prevail.”

NEWSBRI STAKEHOLDERS PROPOSE HAUL OF TANZANIA’S EDUCATION SYSTEM
Tanzania’s education system should be reviewed so as to incorporate work ethics and entrepreneurial skills to enable graduates fit in the labour market, stakeholders have suggested. They made the suggestion in Dar es Salaam yesterday at a three-day workshop on national co-creation skills development. Addressing the workshop, Chief Secretary Ombeni Sefue, emphasised that the country’s education system has to be reviewed. He said it should put emphasis on work ethics, skills and entrepreneurial in line with competitiveness to leverage a middle income economy.
ARUSHA SET ASIDE LAND FOR ENTREPRENEURS Arusha Region has set aside 25 hectares in five districts of the region for medium and small-scale traders to conduct their businesses, regional administrative secretary Adoh Mapunda has said. Mr Mpunda said this when officiating at an entrepreneurs workshop organised by the Eastern Southern African University Research Programme (ESAURP) and financed by Financial Sector Deepening Trust (FSDT). Incorporated in Tanzania on July 1, 2004, overarching goal of the FSDT is to develop a deeper financial system that can provided greater access to

finance to more Tanzanians. It is determined to generate sustainable improvement in the livelihood of poor households through reduced vulnerability to shocks, increased incomes, and employment achieved through the provision of greater access to financial services for enterprises. Only Zambia and Tanzania have a positive food balance sheet in the region, the Southern African Development Community (SADC) Heads of State have heard. President Edgar Lungu’s Special Assistant for Press and Public Relations Amos Chanda told journalists recently after the Heads of State closed door meeting, that only Zambia and Tanzania had a surplus reserve of cereals in the SADC region. Chanda said the summit urged all countries that were in danger of starving due to cereal deficit as a result of poor rainfall pattern during the 2014/2015 farming season, to get the required interventions in terms of relief maize and cereal supplies. TANZANIA LAUNCHES AGRICULTURE BANK TO BOOST AGRO-SECTOR Tanzanian has launched the state-run Tanzania Agriculture Development Bank (TADB) in an official event in Dar es Salaam on August 7th, 2015, to boost the agricultural sector in the country with better financing options.
The Government which also engaged to raise a total of Sh800 billion ($380 million) for capital requirement in a lapse of eight years, will do it at a rate of Sh100 million per year to support the bank’s yearly operations. During the launch event President Kikwete has asked for the bank’s management support to look for proper financing packages to boost the agricultural sector, since a lack of these resources in the last years has not left the industry to grow at an effective rate. TASAF LAUNCHES PROJECT TO HELP POOR FAMILIES
The Tanzania Social Action Fund (TASAF) has planned to spend more than Sh577 million in its third phase to support poor families in Muleba District, Kagera Region. Speaking during the launch at Magata Kalutanga ward in Muleba District on Tuesday, TASAF official Thelesphory Balusha said the third phase project would be implemented in three years from 2015 to 2018. He said more than 15, 063 households will benefit from the project. “The project we have launched shall finance poor families in the months of July to October. The 577,148,886.36/- will be used to pay the residents for two months only,” he said adding that more funds will be released for the exercise in the remaining months. He said apart from supporting poor families, the project is also geared to help energetic
family members to get jobs under temporarily employment schemes. He said the jobs would be provided during natural disasters. TTCL LAMENTS OVER VANDALS OF NATIONAL FIBRE OPTIC CABLE
Tanzania Telecommunications Company Limited (TTCL) has complained over unscrupulous people vandalising the national fibre optic cable network to extract copper which was actually not available in the cable. “Some members of the pastoralist community also dig out the cable and use it for grazing cattle,” TTCL acting manager for Arusha and Manyara regions Emmanuel Buchard said yesterday. Mr Buchard said the mostly affected area of the cable network was between Arusha and Namanga township bordering Tanzania and Kenya, asking residents of the area to reveal criminals involved in vandalizing it, as the government had heavily invested in it. He cited two latest incidents in Arusha and Babati where road construction contractors had destroyed the cable, saying measures had already been taken against them. EABC, GERMAN FIRM INK $1 MILLION PACT The East African Business Council (EABC) has entered into a $1 million worth of Memorandum of Understanding (MoU) with the Federation of German Industries to strengthen the

Mr Denniss Karera, the EABC chairman, signed the MoU on behalf of the council while the BDI managing director, Mr Matthias Wachter, penned the document on behalf of the Federation of the German Industries. TRADERS WARNED TO STAY AWAY FROM BRT ROAD OR FACE PENALTY Dar es salaam based petty traders have been ordered to clear away from all Bus Rapid Transit (BRT) trunk lanes or face legal action. With the trials conducted on Monday and full operations due in October the directors of the UDA-Rapid Transit (UDART) Company, Sabri Mabruk warned that if the traders are left to continue operating on the lanes then traffic congestion will continue. “The lanes were designed to improve the transport system in the city and not conducting businesses,” he said while speaking to press yesterday in the city. “People should vacate these areas as soon as possible,” Mabruk urged. “As part of preparations for the October full launch, the

Last year a survey revealed that the country had lost more than half of its elephant population, with number declining from 110,000 in 2009 to fewer than 44,000. While the poachers are profiting from these beloved species, tourism could suffer, Meru said. TANZANIA INAUGURATES DAR ES SALAAMSOMANGA ROAD Tanzanian President Jakaya Kikwete has recently inaugurated the Dar es Salaam-Somanga corridor in the country’s southern coastal region which aims to meet the increasing demand on transport of goods and passengers between both cities. The project’s total costs of $46.49 million was totally funded by the Kuwait Fund for Arab Economic Development (KFAED) in two stages in the years 1995 and 2000, and it included the improvement of 230 km of road, completion of the Rufiji Bridge, river bank and slope protection, and consultancy services. The new corridor is meant to contribute to the economic and social development of the Tanzania’s south eastern
regions by linking them with the commercial capital Dar es Salaam with reduction on road fees and maintenance costs. SMES CHALLENGED TO STEP UP PERFORMANCE Small and Medium Enterprises (SMEs) have been challenged to step up their potentials and tap into the East African Community (EAC) where majority of products are imported from overseas. The East African Community market has an assured boasts of 159 million people and a Gross Domestic Product (GDP) of over 100bn/-, Felix Mosha, former East African Business Council Chairman said over the weekend in Dar es Salaam. He was speaking during an award winning ceremony of the 2015/16 Top 100 midsized companies sponsored by Bank M Tanzania. The event saw Softnet Technologies Ltd announced victorious in this year’s statewide survey. According to Mosha, the country has small and medium industries but they mostly focus on the domestic market. “SMEs need to develop strategies on how to target where there is hot demand for the products,” he urged.

1. What are the basic requirements of land ownership in Tanzania?
In Tanzania, all land is public land, owned by the government where the President acts as a Trustee (Art. 4, The Land Act 1999). Citizens may only apply for a lease from the office of Land Registry and receive a certificate to show the boundaries they own. Land can be occupied through customary right of occupancy (CRO) and granted right of occupancy (GRO). Land is leased from the government for a maximum of 99 years, however, in some parts of the country where land is not so heavily regulated, the local government office can give you land provided you register as a member of the village, work on the land and pay a small fee; that land can then eventually be registered.
2. Who can own land?
One must be a citizen of Tanzania if he/ she is to own land, unless the land is used for investment purposes. However, it is possible for a foreigner to be granted a “derivative right” for land to be used for investment through Tanzania Investment

Centre. Foreigners that require the land for personal use would not be allowed to purchase the land; instead they can enter into lease agreements with land owners.
3. What categories of land are there in Tanzania?
• General land is surveyed land usually located in urban centers. • Village land is usually land in villages and within villages in rural Tanzania. Some village land has been surveyed but the majority of the land is un-surveyed. Village land cannot be used for investment until it is transferred into general land. However, in some villages, the local authorities grant permission to members of the village to own land. • Reserved land includes that reserved for forestry, national parks, public recreation grounds etc.
4. What is the procedure of registering land?
Below is the standard procedure where there is no dispute over land.
• Obtain an official search at the land registry. • Submit an application to obtain evaluation at the Ministry of Lands. • Obtain rent clearance from the Ministry of Lands to prove that all land rents for the past 10 years have been paid. • Land is inspected and valued by a government valuer. • A lawyer applies for certificate of title. • Obtain approval from the Commissioner of Lands for the disposition of property. • The Land Officer records the transfer deed under the buyer’s name at the Registry of Lands. • Obtain certificate of title from Registry of Lands.
5. What rights does one have as a land owner?
• Right to develop (with permit from relevant authority) • Right to prevent trespassers from entering • Right to enjoyment of natural resources attached to one’s land.

A land dispute is when two or more parties disagree over boundaries and/or ownership/allocation of land. In Tanzania, disputes over land are resolved with either informal dispute resolution i.e. Alternative Dispute Resolution (ADR) or formal actions whereby one takes the matter to court.
7. What are the benefits of land registration?
Prior going to court one has to commence with the Village Land Councils, then to the Ward Tribunal, the District Land and Housing Tribunals then to the High Court and finally to the Court of Appeal. Informal methods are less costly and it is important to consider what method is

• It can provide better information on land ownership and rights for physical planning as well as facilitate the development of other planning tools such as information banks covering land use, land values, population etc. Moreover, it can provide a tool to restrict certain land uses with a negative environmental impact.
6. How can one settle a land dispute?
• Efficient land transfers as all the information has been previously documented and checked thus making transfers easier, less expensive and more secure.
• Security of ownership as it reduces the number of land disputes and stimulates development.
