first arrived in Punta Cana on a typical allinclusive vacation in 1991. In November of 1995, he returned, this time to work as Director of the Paradisus Punta Cana, part of the Meliá Hotel chain, where for the next seventeen years he supervised over 800 workers.

Castillo, began his career in the hospitality industry in Palma de Mallorca, Spain, working at Hotel Capitol as a bell boy at the age of thirteen. Three years later, he was 10 promoted to work in the Reception area, as the Hotel became part of the IberoStar Hotel, becoming head of reception by the age of twenty. Castillo managed to combine university studies at night, while working during the day, graduating with a degree in Tourism Business Administration. After several years of climbing the ladder in various management positions in the hospitality industry, he had the opportunity to direct Hotel 33, part of Sunwing a Scandinavian hotel chain, where he remained until his arrival in Punta Cana.

This opportunity allowed him to become multi-lingual, speaking Spanish, ‘Mallorquin’ (local dialect), English, French, German, and “some” Swedish- as he modestly admits. In 2012, Castillo was invited to become the General Director of the area’s most popular shopping area, the Palma Real Shopping Village, a commercial property part of the Meliá Hotel, to upgrade its brand image. Over the last years, the shopping center has established itself as a high end mall with major, international brands, such as the Hard Rock Café, Nautica, Tommy Hilffiger, among others. Since arriving in Palma Real Shopping Village the perceived change has been remarkable, not only in Sales and Marketing, but on the management level, which Castillo does with a personal touch. Recently, this commercial hotspot has undergone major expansion renovations to include a luxury Night Club, a large chain supermarket, additional retail space and the famed Outback Stackhouse- coming soon!

Paco Castillo Moreno, de 61 años,

natural de Albacete, España, aunque a los 13 años se mudó junto a su familia a Palma de Mallorca, está casado con la Dra. Patria Ovalles - dominicana-, y es padre de un niño de 7 años llamado Rodrigo. La primera vez que visita Punta Cana fue en el año 1.991 de vacaciones, quedándose enamorado de la isla y de su gente. Tan sólo 4 años más tarde, en Noviembre 1995, regresa a Punta Cana, pero esta vez a trabajar como Director del Paradisus Punta Cana, de la cadena Meliá Hotels, dirigiendo a 800 trabajadores. Pero volvamos a sus orígenes profesionales en Palma de Mallorca, donde con 13 años empieza a trabajar de botones en el Hotel Capitol durante tres años consecutivos, de dicho Hotel pasó a formar parte del Hotel Ibero-Star de Palma de Mallorca ejerciendo de Recepcionista trabajando hasta los 16 años, y de éste Hotel hasta los 20 años comienza a trabajar al Hotel Talayot ejerciendo de Jefe de Recepción. En una segunda etapa, desde los 20 años hasta los 27 años, trabaja en el Hotel Playa Marina, ejerciendo de Jefe de Conserjería, comenzando una tercera e importantísima etapa desde los 27-43 años en Dirección del Hotel 33 -de la cadena de hoteles escandinava Sunwing- dirigiéndolo hasta los 43 años durante 16 años continuados. Destacamos que desde el año 1965 hasta el año 2012, Paco se ha dedicado íntegramente, personal y profesionalmente a trabajar en el Sector de Hotelería, 47 años, toda una vida!

A nivel académico, Paco consiguió compaginar Estudios Universitarios por la noche así como trabajo durante el día, titulándose como Diplomado en Administración de Empresas Turísticas, tres años de carrera universitaria donde se instruyó en los conceptos prácticos, y teóricos necesarios para dirigir Hoteles y empleados eficientemente.

Living in Punta Cana | Viviendo en Punta Cana En cuanto a la formación en idiomas, Paco es multi-lingue, habla español, mallorquín, inglés, francés, alemán, y se defiende con el idioma sueco “un poco” como él dice, gracias su experiencia trabajando en la cadena hotelera sueca Sunwing. Como persona interesada en formación continua, ha asistido a cursos diversos para su aprendizaje personal y profesional, con un Master en Auditoria Medioambiental de la Industria Turística. Actualmente, y desde Noviembre 2012, Paco trabaja como Director General del Centro Comercial, Palma Real Shopping Village, perteneciente al Grupo Hotelero Meliá, donde con energías renovadas ha asumido un nuevo reto de volver a posicionar dicho lugar como el Centro Comercial de referencia para residentes y turistas en Bávaro-Punta Cana. Con la apertura de nuevas tiendas de retail, un Supermercado Plaza Lama y mejoras en su Business Center, este Centro Comercial es el mejor en su sec-

The Children of Villa Caoba Los Niños de Villa Caoba As visitors (or residents)

of one of the Caribbean’s largest tourist destinations, we have a moral obligation to give something back to the people who live in the communities that we visitand live in. It is simply the right thing to do to help people who struggle with basic needs for food, water, housing, health and safety. We live in a community where help is all around us in the forms of charitable organizations. Here are some of the philanthropic activities that one organization has undertaken over the years at both the national and international levels.

Chaired by Anna Maria Pla Pujal, a Spanish citizen, is the non-profit organization called “Fundación Lirio del Valle” (which means ‘Lili of the Valley’ in English) was created in 2009 in the Dominican Republic. The foundation was set up to provide schooling and feeding, and thus contributing to the proper physical and intellectual development of the children in a small village called Villa Caoba, an impoverished community of La Romana, just a 45 minute drive from Punta Cana. The foundation has the support of partners, volunteers and sponsors in the Dominican Republic and Spain, and is associated with “Associació Amics de Villa Caoba” (Friends of Villa Caoba), a non-profit organization registered in 2010 in the Catalonia region of Spain, which

allocates its funds to the children of Villa Caoba for use of sponsorship and schoolingwhile providing technical assistance and coordination of volunteers. All funds are raised by through contributions from sponsors, voluntary donations and food through charitable auctions, concerts and other events, and are used in full (by volunteers) for the schooling and educational activities. Some events include two well-known annual events in Spain such as the sale of Roses in Sant Jordi (the equivalent of a Valentine’s Day in Catalonia) and the Christmas Lottery in Spain, which has one of the biggest jackpots. Famous Celebrities such as Spanish singer, David Bisbal, donated part of the proceeds from his performance at the Athletics Stadium (organized by Festival COSTA POP) in Malaga on June 20th, 2010 to benefit the foundation. Without the volunteers there would be no guarantee that the programs and resources would continue to thrive for the betterment of the children at Villa Caoba, but one particular Volunteer is seen as the backbone of the Foundation by many; Mrs. Aracelis Ávila, without her, much of the work would not be possible. Asides from working a full-time job and being a full-time mother, Aracelis, a local school teacher, volunteers her time every Saturday at the foundations’ meeting center in La Romana, where children gather every weekend to participate in various activities, both educational and recreational, aimed at enhancing their skills.

Como residentes o como turistas, tenemos una obligación moral de ayudar a la comunidad que vivimos o visitamos, especialmente a los más necesitados de la misma, que sufren las necesidades y carencias básicas de comida, agua, vivienda, salud, y educación. Podemos ayudar a Asociaciones y Fundaciones, como por ejemplo la que os presentamos, Amigos de Villa Caoba. Dirigida por Anna Maria Pla Pujal, española, “Fundación Lirio del Valle”, fundada en 2009 en República Dominicana. Creada para alimentar y escolarizar a niños, así como ayudar a su desarrollo físico e intelectual, está situada en el pequeño pueblo de Villa Caoba, en La Romana, a 45 minutos conduciendo desde Punta Cana. La Fundación, cuenta con el apoyo de voluntarios, patrocinadores y padrinos, tanto en República Dominicana como en España, contando en Barcelona con la Asociación de Amigos de Villa Caoba, Asociación sin ánimo de lucro registrada en el año 2010, con la solidaria intención de recaudar fondos para la patrocinación del desarrollo escolar, proveyendo asistencia técnica, y coordinación de los voluntarios.

Todos los fondos donados, provienen de patrocinadores, y voluntarios, a través de actividades de concienciación, conciertos, y eventos, y se utilizan y destinan totalmente para actividades de escolarización y educación, a través de dichos voluntarios en España y Rep. Dominicana. Destacamos que realizan anualmente, algunos eventos en España, como la venta de Rosas en la festividad de San Jordi , y venta de Lotería de Navidad. Entre los patrocinadores, destacamos a famosos como el cantante David Bisbal, quién donó a la Fundación, parte de sus beneficios del concierto que ofreció en el Estadio Atlético de Málaga el día 20 Junio de 2010. Significar que sin todos aquellos voluntarios, y patrocinadores, sería imposible que la Fundación pudiera funcionar en cuanto a programas, y recursos, y destacamos en particular a la Sra. Aracelis Ávila, dominicana, imprescindible en la Fundación. Realiza un trabajo excelente, Aracelis, profesora y madre, está presente todos los Sábados en las reuniones que se celebran en Villa Caoba, donde los niños participan de actividades educacionales y recreacionales, para el mejoramiento y desarrollo de sus habilidades personales.

But for a number of years, women have had an essential role in the intellectual and artistic development of the art world. In the Dominican Republic, we have had great plastic artists such as Celeste Woss and Gil and Clara Ledesma which were pioneers in Dominican paintings. Others, in 40 more recent years, have created works that transcend boundaries and are honored both nationally and internationally. Amaya Salazar has a unique style and works with fabric, paper, bronze, resin, metal, etc. She is an important artist with an international level projection, which not only excels in the art world, but also uses the feminine figure with her muse. New Property Taxes Propiedad Inmobiliaria: Nueva modalidad de pago de Impuesto On February 5,

1988, Law 18-88 was enacted. This law dealt taxes on real estate, luxury dwellings and unimproved urban lots and established the assessment of taxes on these properties. The law also ordered that the proper authorities establish a tax rate scale.

On November 9, 2012, Law 253-12 was enacted. Informally called a fiscal reform law, it creates significant modifications to previously existing legislation by altering the basis of the Real Estate Property Tax (known by its Spanish acronym â&#x20AC;&#x153;IPIâ&#x20AC;?) and establishing, beginning at the time of its enactment, a tax of one percent (1%) on the value of real estate belonging to natural persons and whose total value, including the value of the lots on which their property is built, is greater than six million, five hundred thousand pesos (RD$6,500,000.00). With this change in the tax law, the minimum taxable total value increases from five million pesos (RD$5,000,000.00) to six million, five hundred thousand pesos (RD$6,500,000.00). The new law also establishes that total value be derived from totaling all of the personâ&#x20AC;&#x2122;s real estate. The aforementioned tax (IPI) shall be assessed on the following types of real estate belonging to natural persons: Real estate intended to be used as residences and

belonging to natural persons, unimproved urban lots (those on which there is no construction intended for residences or commercial activities of any type that have formally approved by the proper authorities and whose improvements occupy less than 30% of the area of the aforementioned lot) and those real properties intended for commercial, industrial or professional activities, or the combination of both types of real estate. The taxable amount of the aforementioned tax is adjusted annually for inflation, by the amount equivalent to the rate published by the Central Bank of the Dominican Republic. The cited Real estate Tax has some exemptions. In other words, there are some types of real estate that are not subject to real estate taxation. These include: Residences whose owners are at least 65 years of age and whose residence is the only real estate they own; rural land used for agricultural purposes; and equipment, furniture, machines, electrical and mechanical equipment and other moveable goods that are located on the encumbered real estate. It is extremely important that the tax situation of both the real estate to be acquired and that of the natural person to whom it belongs be verified prior to purchase in order to guarantee the acquisition of the real estate.

En fecha 5 de Febrero del 1988, fue pro-

mulgada la Ley Núm. 18-88, sobre impuesto a la propiedad inmobiliaria, vivienda suntuaria y solares urbanos no edificados, mediante la cual se procedió a gravar impositivamente dichos bienes, según la escala establecida por las autoridades competentes. En fecha 9 de Noviembre del año 2012, fue promulgada la Ley 253-12, llamada comúnmente de reforma Fiscal, la cual introduce modificaciones de importantes consideraciones, al variar el espectro de la base del Impuesto a la Propiedad Inmobiliaria (IPI), al establecer, en lo adelante, un impuesto de un uno por ciento (1%) sobre el patrimonio inmobiliario perteneciente a personas físicas, cuyo valor, en su conjunto, incluyendo el del solar donde estén edificados, sea superior a seis millones quinientos mil pesos (RD$6,500,000.00). Con dicha modificación impositiva se aumenta el valor imponible existente, de la suma de cinco millones de pesos (RD$5,000,000.00), a la suma de seis millones quinientos mil pesos (RD$6,500,000.00), con la novedad, de que dicha suma resulta de la sumatoria de la totalidad del patrimonio inmobiliario de la persona física.

Dicho impuesto (IPI) recae sobre las siguientes propiedades inmobiliarias de personas físicas: Inmuebles destinados a viviendas pertenecientes a personas físicas, solares urbanos no edificados (aquellos en los que no se haya levantado una construcción formal legalizada por los organismos competentes destinados a vivienda o actividades comerciales de todo tipo y aquellos cuyas construcciones ocupen menos de un 30% de la extensión total de dicho solar) y aquellos inmuebles destinados actividades comerciales, industriales y profesionales o la combinación de ambas clases de inmuebles.

Exenciones. El indicado Impuesto a la Propiedad Inmobiliaria tiene algunas exenciones, es decir, inmuebles que no son susceptibles del pago del mismo, tales como: Viviendas cuyo propietario haya cumplido sesenta y cinco (65) años de edad, siempre que constituya el único patrimonio inmobiliario de su pro-

generic rules that govern and discipline human statements formulated under the sign of the formalities of public authenticity. Notarial law can be interpreted in the strictest sense as the part of Law that applies to notaries public in the course of their duties as professionals and in their relationship with their clients, and more broadly as the combined rules of law that notaries public must know and apply. It is part of objective law and subjective law, where the subject brings about the subjective law, and the object causes the objective law, with both aspects falling within contractual law. It is considered public law, recognizing that probative force must be inalterable, due to the official public nature granted the notary public by law. It is positive because it is recognized by law, it is generic because it applies equally to everyone, and it is authenticated by transcribing veracity and public record. It forms part of proof theory as the procedures that can establish the existence of a right or legal claim, as it is a necessity of the utmost importance to provide proof of its existence. As principles regarding proof the following are particularly noteworthy: “The burden of proof lies with the person bringing the claim”, “By objecting the respondent becomes the perpetrator”, and “legal presumption”, which is often found in the duties discharged by the notarial profession.

conduct and actions of the notary public, who play his social role in his relations with other men, and with the State, with authenticity resulting from the application of a formalism, in which the legislator combines the guarantee of regularity and veracity in legal acts – articles 21-32, Law 301 on Notaries Public. The notary public is the public officer authorized to certify contracts and other extrajudicial acts in accordance with the law.
