Bill aims to limit excessive school district cash reserves

Some districts could operate for years on money they’ve stashed away

SPRINGFIELD – The overall financial health of Illinois school districts has been improving in recent years, according to a recent state report, but a bill moving through the General Assembly seeks to rein in the amount of money some districts are saving.

Senate Bill 1994, which passed unanimously out of the Senate last week and now awaits action in the House, would put a cap on how much money school districts could hold in reserves. Districts that exceed it would be required to fi le a report with the state.

“They’re kind of like a nonprofit where, you know, money comes in and resources

come in, and then it needs to be spent,” the bill’s sponsor Sen. Meg Loughran Cappel, D-Shorewood, said during an interview. “Like, yes, you need to have savings. Yes, those are good practices. But you can’t just be sitting on all this cash and then not doing anything with it.”

The Illinois State Board of Education publishes a report each year measuring the financial health of all 852 school districts in the state. The report looks at several factors such as their expenditure-to-revenue ratio, short-term and long-term debt, and how many days’ worth of cash on hand they keep.

ISBE uses those factors to generate an overall “financial profi le” score for each district. Over the last seven years, the latest report noted, the statewide average score has risen steadily.

To receive ISBE’s highest rating, districts must keep the equivalent of 180 days of operating expenditures on hand. The agency also notes that bond under-

writers and financial advisers typically recommend 144 to 180 days of operating expenditures.

According to the most recent report, which includes data from the fiscal year that ended June 30, 2021, 70 percent of districts had cash reserves of between 100 and 359 days of expenses. But 197 districts, or 23 percent, had reserves of 360 to 720 days, and 10 districts had reserves greater than 720 days.

The report does not identify which districts have those large reserves.

SB 1994 would require districts to calculate their three-year average operating expenses each year and report their cash on hand. If their cash reserves ever exceed 2.5 times their annual average, they would have to submit a plan to ISBE for how they intend to spend those reserves.

Districts would not be required to spend excess reserves, but only to submit the plan detailing how they intend to do so over the next three years.

Cappel said that limit was negotiated with superintendents and other o�cials involved in school district budgeting who had pushed back against the original version of the bill, which would have required districts to immediately spend down any reserves beyond 250 days of operating expenses.

She noted that there are many reasons why a district might build up large reserves. Some, she said, might save up so they can pay cash for capital expenses like a new security system or to build a new elementary school. Others might be bracing themselves for the possibility that their heating or air conditioning system might go out.

“I don’t want to stop any district, if they’ve got plans to build something that’s appropriate, you know, a kindergarten building or whatever,” she said. “Of course, we want you to be able to use that. So that’s kind of where this came from.”

China military ‘ready to fight’ after drills near Taiwan

TAIPEI, Taiwan (AP) — China’s military declared Monday it is “ready to fight” after completing three days of largescale combat exercises around Taiwan that simulated sealing off the island in response to the Taiwanese president’s trip to the U.S. last week.

The “combat readiness patrols” named Joint Sword were meant as a warning to self-governing Taiwan, which China claims as its own, China’s military said earlier.

“The theater’s troops are ready to fight at all times and can fight at any time to resolutely smash any form of ‘Taiwan independence’ and foreign interference attempts,” it said Monday.

The exercises were similar to ones conducted by China last August, when it launched missile strikes on targets in the seas around Taiwan in retaliation for then-Speaker Nancy Pelosi’s visit to Taiwan, but have been smaller and less disruptive.

Military experts say the exercises serve both as intimidation and as an opportunity for Chinese troops to practice sealing off Taiwan by blocking sea and air traffic, an important strategic option the Chinese military might pursue in the event it uses military force to take Taiwan.

The Chinese actions follow President Tsai Ing-wen’s delicate mission to shore up Taiwan’s dwindling diplomatic alliances in Central America and boost its U.S. support, a trip capped with a sensitive meeting with U.S. House Speaker Kevin McCarthy in California. A U.S. congressional delegation also met with Tsai over the weekend in Taiwan after she returned.

China responded immediately to the McCarthy meeting by imposing a travel ban and financial sanctions against those associated with Tsai’s U.S. trip and with increased military activity through the weekend.

“China wants to use any increase of diplomatic interactions between the U.S. and Taiwan as an excuse to train its military,” said Kuo Yu-jen, a defense studies expert and director of the Institute for National Policy Research in Taiwan.

Beijing says contact between foreign officials and the island’s democratic government encourages Taiwanese who want formal independence, a step China’s ruling Communist Party says would lead to war. The sides split in 1949 after a civil war, and the Communist Party says the island is obliged to rejoin the mainland,

by force if necessary.

After Pelosi visited Taiwan, China conducted missiles strikes on targets in the seas around Taiwan, while also sending warships and war planes over the median line of the Taiwan Strait. It also fired missiles over the island itself which landed in Japan’s exclusive economic zone, in a significant escalation.

The live-fire exercises disrupted flights and shipping in one of the busiest shipping lanes for global trade. This time, shipping and maritime traffic have largely continued as normal, Kuo said.

The exercises this time have focused more on air strength, with Taiwan reporting more than 200 flights by Chinese warplanes in the past three days. Chinese state broadcaster CCTV, citing the People’s Liberation Army, said the exercises are “simulating the joint sealing off” of Taiwan as well as “waves of simulated strikes” at important targets on the island.

On Monday, the PLA said its Shandong aircraft carrier was taking part in the exercises encircling Taiwan for the first time. It showed a video of a fighter jet taking off the deck of the ship in a post on Weibo, the social media platform.

The appearance of the Shandong aircraft carrier in the Pacific Ocean suggests that it could be used to prevent foreign militaries from coming to help Taiwan, said Han Gan-ming, a research fellow at the government-backed Institute for National Defense and Security Research.

“In the future if there’s a similar military maneuver, then Taiwan will have to face it alone,” Han said.

Between 6 a.m. Sunday and 6 a.m. Monday, a total of 70 planes were detected and half crossed the median of the Taiwan Strait, an unofficial boundary once tacitly accepted by both sides, according to Taiwan’s Ministry of National Defense. Among the planes that crossed the median were eight J-16 fighter jets, four J-1 fighters, eight Su-30 fighters and reconnaissance planes. Taiwan also tracked J-15 fighter jets, which are paired with the Shandong aircraft carrier.

By Monday evening, Taiwan’s defense ministry reported another 91 flights by bombers, as well as multiple fighter jets, early warning aircraft and military transport planes.

That followed a full day between Friday and Saturday in which eight warships and 71 planes were detected near Taiwan, according to the island’s Defense

Ministry. It said in a statement that it was approaching the situation from the perspective of “not escalating conflict, and not causing disputes.”

Taiwan said it monitored the Chinese moves through its land-based missile systems, as well as from its own navy vessels.

China’s military harassment of Taiwan has intensified in recent years with planes or ships sent toward the island on a near-daily basis, with the numbers rising in reaction to sensitive activities. The military activity has increased a notch since Pelosi’s visit, with Chinese PLA fighter jets regularly flying over the middle boundary line. Experts say PLA navy vessels regularly navigate the waters off Taiwan’s northeastern coast.

Meanwhile, to the south in the South China Sea, the U.S. 7th Fleet said its missile destroyer USS Milius sailed by Mischief Reef in a freedom of navigation operation. China has built an artificial island on the sea feature to stake its claim to the disputed territory.

China said the U.S. “illegally trespassed” into waters near the reef without the permission of the Chinese government, according to a statement from the Chinese military’s southern command.

Outside of the military maneuvers, Kuo said he was worried about the announcements from Fujian’s Maritime Safety Administration from last week, when it said it would conduct “on-site inspections” of cargo ships and working vessels in the Taiwan Strait as part of a patrol exercise.

“First they’ll target ships traveling between the Strait, then they will target any international ship,” he said. “Gradually this will become the de facto new status quo.”

One of the U.S. representatives who attended the meeting with Tsai last week said Saturday the U.S. must take seriously the threat China poses to Taiwan. Republican Mike Gallagher, chairman of the U.S. House Select Committee on China, told The Associated Press that he plans to lead his committee in working to shore up the island government’s defenses, encouraging Congress to expedite military aid to Taiwan.

Next abortion battles may be among states with clashing laws

Abortion is banned in Idaho at all stages of pregnancy, but the governor on Wednesday signed another law making it illegal to provide help within the state’s boundaries to minors seeking an abortion without parental consent.

The new law is obviously aimed at abortions obtained in other states, but it’s written to criminalize in-state behavior leading to the out-of-state procedure – a clear nod to the uncertainty surrounding e�orts by lawmakers in at least half a dozen states to extend their influence outside their borders when it comes to abortion law.

At the same time, Democrat-controlled states are advancing and adopting laws and executive orders intended to shield their residents against civil lawsuits and criminal investigations related to providing abortions for women from states where there are bans.

But there is no legal precedent giving good guidance about whether states can influence their residents getting abortions outside their borders.

“If red states pass laws saying, ‘We can go after people for X, Y and Z,’ and blue states say, ‘You can’t,’ we’re in uncharted territory,” said Mary Ziegler, a legal historian at the University of California, Davis School of Law.

Arguments about the laws could be rooted in key clauses of the U.S. Constitution that could contradict each other in this case. One clause requires states to respect the laws of other states while another recognizes the right to travel among states and a third restricts the ability of states to impair interstate commerce.

Legal experts say that no prior cases are exactly comparable, though state laws have confl icted in weighty ways in the past.

In the 1840s and 1850s, it was with questions over whether fugitive enslaved people in free states remained the property of slaveholders. In the 1857 Dred Scott decision, frequently cited as the worst ruling in U.S. history, the U.S. Supreme Court ruled that they did.

More recently, before the nation’s top court recognized a right to same-sex marriage in 2015, state marriage laws were a patchwork. Some states did not recognize marriages that were legal elsewhere, and all the protections that go with them, including hospital visitation rights and even the ability to divorce.

The federal ruling largely resolved those legal confl icts.

The effort to restrict abortion in far-reaching ways is an outgrowth of last year’s U.S. Supreme Court decision that overturned Roe v. Wade and ended a nationwide right to abortion.

Each state now makes its own rules. Abortion is banned in all stages of pregnancy in 13 states. Another five have similar bans on the books but are not being enforced under judge’s orders as legal challenges to them are sorted out.

Texas took a step toward state-border restrictions even before Roe was overturned with a 2021 law that allows civil lawsuits against a person who “aids or abets the performance or inducement of abortion.” It does not specify whether the aid would have to happen within Texas. Oklahoma has a similar law.

But using them to block out-of-state abortions has not been tried yet — or tested in court.

Other states are pursuing di�erent approaches.

Idaho’s measure bans transporting a minor for an abortion without parental consent — but bars only the part of the journey that takes place in Idaho.

Tennessee’s GOP-dominated legislature last week approved a measure that would prohibit cities and counties from using their funds to help someone obtain an abortion outside the state — including banning coverage of out-of-state abortions under government employee health insurance plans.

In his concurring opinion in last year’s ruling overturning Roe, Supreme Court Justice Brett Kavanaugh contemplated whether states could restrict their residents from getting abortions in other states: “In my view, the answer is no based on the constitutional right to interstate travel,” he wrote.

Andrea Miller, president of the National Institute for Reproductive Health, which supports abortion rights, said the validity of interstate laws is unclear.

“The hope would be this would be seen as an extreme overreach,” she said, “but one would have thought that overturning Roe v. Wade would have been an extreme overreach too.”

Elisabeth Smith, state policy director for the Center for Reproductive Rights, said the measures have impacts even if they don’t hold up in court.

“Will anti-abortion activists continue to try to use these techniques and use these avenues?” he asked. “Absolutely.

Their goal in doing so is to try to chill activity and make those of us who support abortion rights too frightened to help people.”

One possible test of the out-of-state applicability of abortion laws is just getting started in Texas.

The former husband of a Galvestonarea woman who terminated a pregnancy last year with medication sued three women who helped her obtain pills, claiming wrongful death. The lawsuit says the woman terminated the pregnancy in July 2022 and the couple divorced in February.

A lawyer representing the ex-husband is Jonathan Mitchell, a former Texas solicitor general who is the architect of the law that uses civil penalties to enforce an abortion ban. As part of the suit, Mitchell sent a letter to the National Latina Institute for Reproductive Justice in New York City, demanding that it

preserve documents. The letter said one of the women helping the ex-wife obtain abortion pills worked for the group and the organization would face questions about whether she was acting as part of her job.

“If anyone out-of-state helps one of their employees break Texas laws, then you better believe that there can be action taken against that, against that company or organization,” said Mark Lee Dickson, a Texas anti-abortion activist who has pushed successfully for local governments to bar abortion clinics. “If an individual assists Texans in breaking the laws of Texas, then that’s a problem, too.”

Michael Lerner, ‘Barton Fink’ Oscar nominee, dies at 81

Michael Lerner, the Brooklyn-born character actor who played a myriad of imposing figures in his 60 years in the business, including monologuing movie mogul Jack Lipnick in “Barton Fink,” the crooked club owner Bugsy Calhoun in “Harlem Nights” and an angry publishing executive in “Elf” has died. He was 81. His nephew, actor Sam Lerner, announced his death in an Instagram post Sunday. Sam Lerner wrote that his uncle died Saturday but did not provide further details. Neither his nor Michael Lerner’s representatives immediately responded to requests for further comment.

“He was the coolest, most confident, talented guy,” Sam Lerner wrote. “Everyone that knows him knows how insane he was — in the best way...we’re all lucky we can continue to watch his work for the rest of time. RIP Michael, enjoy your unlimited Cuban cigars, comfy

chairs, and endless movie marathon.”

Born in 1941 to Romanian-Jewish parents and raised in Brooklyn’s Red Hook neighborhood, Michael Lerner began acting locally as a teen and into his days at Brooklyn College, where he got the chance to play Willie Loman in “Death of a Salesman.” His ambitions to pursue acting professionally crystalized when he received a Fulbright Scholarship and chose to study theater at the London Academy of Music and Dramatic Arts, where he lived in an apartment with Yoko Ono for a time, appearing in her short film “Smile.” His brother, Ken Lerner, also became an actor.

Lerner moved to Los Angeles in 1969, at the urging of an agent who saw his work at the American Conservatory Theatre in San Francisco. He started getting cast in television shows, including “M(asterisk) A(asterisk)S(asterisk)H,” “The Brady Bunch” and “The Rockford Files,” making his film debut in Paul Mazursky’s “Alex

In 1981, he was cast in Bob Rafelson’s remake of “The Postman Always Rings Twice,” alongside Jack Nicholson, who he called one of the most generous actors he’d ever worked with, and Jessica Lange. A longtime cigar aficionado, Lerner felt out of his depths when he was asked to smoke a cigarette in a scene with Nicholson in a jail. Lerner said he held the cigarette with both hands.

He felt more comfortable playing cigar-smoking journalist and politician Pierre Salinger in “Missiles of October,” for which Jackie Kennedy once told him that he’d “out Pierre’d Pierre.”

Lerner also loved working with John Sayles on “Eight Men Out,” in which he played Arnold Rothstein, the crime boss who conspired to fix the 1919 World Series.

“Most of the time I don’t rehearse, but I do a lot of preparation. Especially for a biographical character or one of the studio heads,” he said in 2016. “I did a lot of research for Barton Fink and looked into Louis B. Mayer and all the moguls in Hollywood.”

Joel and Ethan Coen’s “Barton Fink,” released in 1991, is the film Lerner is most remembered for.

“I had auditioned for Joel and Ethan before, for Miller’s Crossing. So I walked into the room, as the character, and I don’t say hello to anybody. And I sit down behind my desk and do this big speech: ‘Bart! Bart! So great to see you,’” Lerner said in 2016. “I did the monologue the way I wanted to do it and I just walked out of

the room and that was it. And Joel and Ethan were just sitting in a corner just laughing and laughing and that was it.”

Lerner, who drew inspiration from Preston Sturges movies, said the Coens didn’t give him much acting direction and “were a little nervous that I was talking so fast” but that they let him do what he wanted.

The role got him his first and only Oscar nomination, but in 1992, the Academy Award for supporting actor went to Jack Palance for “City Slickers.”

The Coens called him years later to do a cameo in “A Serious Man.”

Lerner also said he was frequently recognized for his turns in Eddie Murphy’s “Harlem Nights” and “Elf,” as Fulton Greenway. He also played Cher’s father in the television spinoff of “Clueless.”

In the late 90s, he was excited to get a chance to work with Woody Allen on the film “Celebrity,” but it turned into a terrible experience, he said in a 2016 interview.

“He is a schmuck,” Lerner said. “And the movie’s a piece of s—-.”

Lerner also appeared in several bigger blockbusters over the years, including “Godzilla” as Mayor Ebert, “X-Men: Days of Future Past,” as Senator Brickman, and “Mirror Mirror” as Baron.

“Those are good parts but not great acting roles,” Lerner said.

And he never felt cheated by being known as a “character actor” rather than a leading man. In 1999, in an interview with Cigar Aficionado, he said, simply, “Every role is a character role.”

As discussed in the last two weeks, vegetable seed starting can be done easily indoors if you have the right space and equipment. Your basic equipment of containers, light source, and growing media tend to be all you need along with your seeds. However, there is an additional tool that could help get you on the right path.

A germination heat mat can potentially solve the problem of cold growing media. It goes under your containers and provides additional warmth (10-20 F degrees) for your soil in order for your seeds to germinate quickly. Without it,

it may take a much longer time for your seeds to germinate and push back your planting date. This additional warmth can lead to better transplants.

Soil temperature is connected to seed germination. If the soil is too cold, the seeds may be delayed significantly from germinating or never germinate. In general, it should take 6-10 days from planting for seeds to emerge if the soil temperatures are 65-85 F. Following germination, the soil temperature needs to be around 10 F less.

Each vegetable seed can be di�erent when it comes to germination. For instance, tomato seeds will germinate in an optimum soil temperature of 65-85 F.

When the soil temperature averages 68 F, it would take 8 days to emerge. At nearly 77 F, it would take 6 days. The temperatures can also be too hot where they will not germinate above 100 F. There are many great guides that explain the germination temperatures. Do not utilize a heat mat that is not designed for seed starting. Many of the heat mats that you might find to keep you warm on cold nights are too warm for seed starting. Though you do not need to use it after germination, you may find that the room you are starting your seeds in is too cold and that keeping the seedling heat mat running can be beneficial for very warm loving crops like eggplant

and peppers.

With the warm soil, you need to further consider the room temperature and humidity. For germination and continued growth, an indoor range of 60-70F is preferred. Night temperatures should stay at 60-65 F. Humidity needs to be in the 35-50% range. To adjust these, you may need to add a humidifier, place the seedlings in an area of the home that stays warmer, and even placing plants closer together.

Revisiting the hydrogen economy

An early vision for a cleaner energy future featured using hydrogen as the fuel to power the global economy. In the e�ort to reduce carbon emissions the use of hydrogen was portrayed as clean since its only emission was water vapor.

Burning fossil fuels and their use as chemicals has dramatically improved the living conditions of humanity, lifting populations out of poverty and slavery. But its consumption is widely recognized as a major contributor to climate change and other adverse environmental impacts so reducing its use has become a global mission. Finding new sources of energy is also needed as fossil fuels are becoming depleted and the cost of securing them continues to rise.

We were early advocates of using less energy and transitioning to cleaner energy sources. Before starting Energy Fairs we made presentations based on a small teaching tool which generated electricity from sunlight, using its output to demonstrate splitting water into

hydrogen and oxygen. A firm in Michigan made and sold solar panels, presenting visions of a solar future. They also had a demonstration unit that produced electricity using a hydrogen powered fuel cell.

At an Energy Fair a presentation was made regarding the arrival of a hydrogen powered fuel cell car built by Honda. A push toward a hydrogen economy continues but questions are being raised regarding how much of a role hydrogen should have as a fuel source to power the economy.

Dr. Thornstein Sigfusson made a keynote presentation at an early Energy Fair on Iceland’s e�ort to become the world’s first hydrogen powered economy. Their e�ort was focused on using hydrogen to power their transportation fleets of buses, trucks, cars and fishing boats as fossil fuels were costly to import and a leading source of pollution. Their extensive use of geothermal and hydro power sources, low population levels and existing low cost energy supplies made it feasible to target hydrogen as an energy option for transportation. While their progress toward that goal was slowed,

global interest in hydrogen as a fuel source continues to grow. E�orts toward this end have accelerated in the EU as a result of the energy shortages arising from the sanctions on Russian energy.

Nate Hagens interviewed Paul Martin on the role of hydrogen in our energy future. Martin has experience working with hydrogen and syngas as an industrial consultant and reminds us that hydrogen has two basic uses: as a fuel and a commodity chemical.

Other than potential use for ocean shipping and airplanes Martin believes using hydrogen as a fuel is not appropriate because its current production contributes to climate change in two major ways. Since 96% of it is produced from fossil fuels it releases substantial levels of carbon dioxide. Its combustion as a fuel also releases nitrous oxides adding to climate change.

Martin believes hydrogen’s major use should be as a chemical, not a fuel or form of energy storage. One of the most important uses of hydrogen is producing ammonia, essential in nitrogen fertilizers. Fertilizers and the chemical

industry feed half of the world’s existing population and animals used as food. Hydrogen is also used in processing heavy oils, plastics and iron.

Currently hydrogen is primarily produced from fossil fuels without capturing carbon released from the process. While increasing the release of hydrogen from water via electrolysis is a relatively clean process, fossil fuels still are used to secure the resources and manufacture the components essential in the process.

While Paul Martin does not recommend using hydrogen as a fuel, the EU, US and China are all investing heavily in its production and use and continue to increase funding it. Small demonstration projects supply hydrogen for household appliances, heating and cooking. Natural gas companies are experimenting with blending hydrogen into natural gas. BP is planning an electrolysis hub to provide hydrogen fuel for trucks and other forms of heavy transport. The intent of the research and demonstrations is to bring down the cost of producing hydrogen to increase its use in society.
