Gov’s office revises revenue estimates, calls on lawmakers to ‘defray’ noncitizen health care costs

Current-year estimates revised downward while next year’s projections increase

SPRINGFIELD – Gov. JB Pritzker said this week that the state remains “on a great trajectory from a fiscal perspective,” even as his office decreased its current-year revenue estimates in light of falling tax revenues.

The Governor’s Office of Management and Budget this week shaved $616 million off its estimate for current-year revenues, marking a downward revision of about 1.1 percent. The move corresponded with a $532 million, or roughly 1 percent, increased revenue estimate for the upcoming fiscal year.

The governor’s office now projects the current year will end with $50.7 billion in revenues collected. In his February budget proposal, he had proposed about $790 million in supplemental spending for the current year that would have brought total spending to $51.2 billion – an amount exceeding the new revenue estimate.

The proposed supplemental spending included $490 million in increased appropriations for state agencies, a $200 million added pension payment and $100 million for additional capital improvements at early childhood centers across the state.

Pritzker suggested at an unrelated news conference Thursday that spending for the current year could be brought in line with revenues by slowing the pace of agency spending.

“We’re talking about approximately 1 percent of the entire budget,” he said. “So knowing that this might be coming, we’ve ramped down some of the spending here and there within all of our agencies to make sure that we could cover that 1 percent difference.”

The downward revision to the current Fiscal Year 2023 estimate was due to revenues for the month of April coming in $849 million below what GOMB had projected, an indicator that pandemic-era state revenue spikes are beginning to

slow.

“We understand that the broader economy is slowing down a bit,” Pritzker said at a Wednesday news conference. “And we also understood that the benefit to the economy of some of the stimulus that was put into it in prior years will also wane.”

As for the upcoming Fiscal Year 2024 that begins July 1, GOMB’s revenue estimate rose to nearly $50.5 billion. The governor’s office now projects to have $840 million more in revenues than the $49.6 billion spending amount he proposed for FY 2024.

That increase was partially driven by an expected influx of income tax revenue tied to an annual reconciliation process for prior-year business taxes. Recent changes to state and federal tax codes have led to a greater-than-normal amount of money being subject to the statutory reallocation process, according to the Illinois Department of Revenue, although GOMB warns some the revenue bump will be “one-time in nature.”

Still, that upward revision for the upcoming year would not be enough to cover a shortfall created by a cost overrun related to a state expansion of health care to noncitizens who would otherwise be ineligible for Medicaid benefits.

Those programs, which provide health care benefits similar to Medicaid to noncitizens aged 42 and older, are now expected to cost about $1.1 billion next year – a 400 percent increase from the original estimate of $220 million included in Pritzker’s February budget proposal.

The program was an initiative of Illinois’ Legislative Latino Caucus, passed in 2020 during the early months of the COVID-19 pandemic when Latinos were getting sick at a higher rate than white Illinoisans. It officially launched in 2021 for those age 65 and older but exceeded its anticipated cost within one month.

It has since been expanded twice to cover noncitizens age 42 and older, and the Democratically controlled legislature is considering expanding the program to noncitizens between the ages of 19 and 42. Under the state’s pre-existing AllKids program, noncitizens age 18 and under are already eligible for Medicaid benefits.

The Illinois Department of Healthcare

and Family Services noted recently that the agency expects the federal government to cover about $100 to $120 million in health care costs in FY 2024 for noncitizens who are seeking asylum in the U.S.

Pritzker said Wednesday that he is hopeful lawmakers will come up with a solution for defraying some of the rest of that projected cost. On Thursday, he gave suggestions for solutions that he said were made possible by the flexibility the state has since the program is not subject to the same regulation as Medicaid, which is a joint program administered by the state and federal governments.

“It is possible, for example, that there could be – for some people at certain income levels – copays that would defray the costs of the program,” he said.

Another example, he said, would be to reexamine reimbursement rates.

“These are all things that I think are reasonable to consider to make sure that we’re reining in the cost but also serving the people who most need this health care,” Pritzker said.

The recent upward revisions to estimated program costs have prompted sharp criticism from Republicans. But in a news conference earlier in the week, state Rep. Lilian Jimenez, D-Chicago, pushed back against calls to end the program.

“Many immigrants in the state of Illinois do contribute to taxes. They pay their taxes when they work, they file their taxes with an ITIN number,” she said. “They are taxpaying members of this state and should be treated as such. And they’re also human beings, most of all, and we have to remember that when we talk about cutting this or cutting that.”

Repelled by high car prices, Americans are holding on to their vehicles longer than ever

ANN ARBOR, Mich. (AP) — With new and used cars still painfully expensive, Ryan Holdsworth says he plans to keep his 9-year-old Chevy Cruze for at least four more years. Limiting his car payments and his overall debt is a bigger priority for him than having a new vehicle.

A 35-year-old grocery store worker from Grand Rapids, Michigan, Holdsworth would probably be in the market for a vehicle within a few years — if not for the high cost. For now, it’s out of the question.

“You’re not going to get one for a price you can afford,” he said.

Holdsworth has plenty of company. Americans are keeping their cars longer than ever. The average age of a passenger vehicle on the road hit a record 12.5 years this year, according to data gathered by S&P Global Mobility. Sedans like Holdsworth’s are even older, on average — 13.6 years.

Blame it mainly on the pandemic, which in 2020 triggered a global shortage of automotive computer chips, the vital component that runs everything from radios to gas pedals to transmissions. The shortage drastically slowed global assembly lines, making new vehicles scarce on dealer lots just when consumers were increasingly eager to buy.

Prices reached record highs. And though they’ve eased somewhat, the cost of a vehicle still feels punishingly expensive to many Americans, especially when coupled with now much-higher loan rates.

Since the pandemic struck three years ago, the average new vehicle has rocketed 24% to nearly $48,000 as of April, according to Edmunds.com. Typical loan rates on new-car purchases have ballooned to 7%, a consequence of the Federal Reserve’s aggressive streak of interest rate hikes to fight inflation.

It’s all pushed the national average monthly auto loan payment to $729 — prohibitively high for many. Experts say a family earning the median U.S. household income can no longer afford the average new car payment and still cover such necessities as housing, food and utilities.

Used vehicle prices, on average, have surged even more since the pandemic hit — up 40%, to nearly $29,000. With an average loan rate having reached 11%, the

typical monthly used-vehicle payment is now $563.

Faced with deciding between making a jumbo payment and keeping their existing vehicles, more owners are choosing to stick with what they have, even if it means spending more on repairs and maintenance.

Auto mechanics have been struck by the rising ages and mileages of vehicles that now arrive at the shop in numbers they’d never seen before.

“You see cars all the time in here with 250,000, 300,000 miles,” said Jay Nuber, owner of Japanese Auto Professional Service, a repair garage near downtown Ann Arbor, Michigan. “They haven’t been really having major work or anything. They’ve just been doing the (routine) service.”

It doesn’t mean that most owners of older vehicles are necessarily stuck with constant repair bills. One reason people can hold their vehicles for increasingly long periods is that auto manufacturing has improved over time. Engines run longer. Bodies don’t rust as quickly. Components last longer.

Yet the cost of buying either a new or used vehicle is leaving more people with essentially no choice but to keep the one they have.

“The repair-versus-buy equation changed,” said Todd Campau, an associate director with S&P. Even with rising repair costs, Campau said, it’s still typically more cost-effective to fix an older vehicle than to spring for a purchase.

The average vehicle age, which has been edging up since 2019, accelerated this year by a substantial three months. And while 12.5 years is the average, Campau noted, more vehicles are staying on the road for 20 years or more, sometimes with three or four successive owners.

In such cases, the third or fourth owner is getting a much older car than they would have in the past. Nearly 122 million vehicles on the road are more than a dozen years old, Campau said. S&P predicts that the number of older vehicles will keep growing until at least 2028.

Even with more durable vehicles able to last longer, all of this has created a boom time for auto shops. Through most of last year, Nuber’s Japanese Auto was overwhelmed with customers. It took up to three weeks to get an appointment,

whether for repairs or the routine maintenance that older vehicles, in particular, require.

“The phone just kept ringing, and the cars just kept coming,” Nuber said.

It’s now at the point where some vehicle owners must decide whether to pay for a repair that costs more than their vehicle is worth. That’s where many of them draw the line, said Dave Weber, manager at Japanese Auto.

On Friday, Weber said, one customer needed rear brakes, wheel bearings and exhaust system repairs. The customer decided to do only half the repairs and wait until later to decide whether to sink more money into the aging vehicle.

“They patch them up and drive them for however long, until the next major repair,” Weber said.

S&P predicts that U.S. new vehicle sales will reach 14.5 million this year, from about 13.9 million last year. A big reason is that the supply at dealerships is finally growing. Automakers have also begun to restore some discounts that had long helped keep a lid on prices. The result is that many people who can afford to buy can now do so. It’s a trend that could slow the advancing age of the U.S. fleet and boost overall sales.

Still, no one is predicting a return to pre-pandemic annual sales of around 17 million anytime soon. Even with discounts, new-vehicle prices are likely to stay much higher than pre-pandemic levels for years to come.

As for Holdsworth, the Chevy Cruze owner, he plans to keep up with the scheduled maintenance on his car, especially routine oil changes. Even if he encountered a major repair, he thinks he’d probably pay for it.

Having bought his vehicle two years ago, Holdsworth has about two years of payments left. So his Cruze, too, may reach the 12.5-year-old national average.

“I’ll finish paying it off,” he said, “and drive it for a couple more years.”

Dining with Dogs

More dogs could show up in outdoor dining spaces. Not everyone is happy about it

Just in time for the summer dining season, the U.S. government has given its blessing to restaurants that want to allow pet dogs in their outdoor spaces.

But even though nearly half of states already allow canine dining outdoors, the issue is far from settled, with many diners and restaurants pushing back against the increasing presence of pooches.

“I’d like to be able to enjoy my meal without having to worry about fleas, pet hair, barking and entitled dogs and their owners,” said Tracy Chiu Parisi, a food blogger in New York, who was once startled by a dog that stuck its head in her lap while she was reading a menu.

Restaurants have been required to allow service dogs for decades. But it wasn’t until the mid-2000’s that a handful of states — including Florida and Illinois — began passing laws allowing dogs in outdoor dining spaces, according to the Animal Legal and Historical Center at Michigan State University. Twenty-three states now have such laws or regulations.

But the legal landscape is confusing. Michigan law doesn’t allow dogs in outdoor dining spaces, for example, but lets restaurants apply for a variance from their county health department.

So in 2020, the Conference for Food Protection — a group of food industry and health experts that advises the government — asked the U.S. Food and Drug Administration to issue guidance for states. It cited a 2012 risk assessment in Australia and New Zealand that found that the health risk to human diners from dogs was very low.

The FDA’s updated food code, issued late last year, says restaurants can have dogs in outdoor areas if they get approval from a local regulator. Restaurants should have signs saying dogs are welcome and should develop plans to handle dogs and their waste. They should ensure dogs remain properly restrained and provide separate food bowls so dogs don’t use plates or utensils meant for humans.

The new guidance comes as U.S. pet ownership is rising. Nearly 87 million U.S. households now have a pet, up from 85 million in 2019, according to the American Pet Products Association.

And experts say more people are looking for dining options that will accom-

modate their dogs. Yelp searches for businesses using the “dogs allowed” filter jumped 58% between the year ending May 1, 2021, and the year ending May 1, 2023. A total of 47,415 businesses now describe themselves as “dog friendly” on Yelp, the company says.

“Younger pet owners, Millennials and Generation Z, have incredibly strong bonds with their pets and they are willing to act upon that,” said Steven Feldman, president of the Human Animal Bond Research Institute. “They are more likely to frequent — and express a preference for — pet-friendly businesses.”

Monty Hobbs, the managing director of a digital marketing agency in Washington, can often be found at local restaurant patios with Mattox, his 5-year-old terrier and miniature schnauzer mix. Some waiters even bring Mattox bits of bacon.

Hobbs stresses that he doesn’t take Mattox everywhere. “He’s my dog. He’s not my child,” he said.

But Mattox is well-behaved, he said, so it’s nice to know they can drop in at a neighborhood bar if they’re out taking a walk.

At Zazie, a San Francisco bistro, diners get $10 off a bottle of wine on Mondays if they bring their dogs, who get treats donated by the pet store across the street.

“It’s great for business. People really enjoy bringing their dog out with them,” said Megan Cornelius, Zazie’s co-owner.

But other restaurants are saying no to Fido.

The Salty Dog Café in Hilton Head, South Carolina, allowed dogs on its patio when it first opened in 1987. But two years later, it banned them. Too many dogs were barking through meals, fighting, lying in walkways and stealing hot dogs from kids’ plates, says Tim Stearns, the Salty Dog’s chief operating officer.

If diners object, the Salty Dog points them to a separate dog-friendly deck where they can eat takeout food from the restaurant. But most diners seem to appreciate the policy.

“We are all dog lovers at Salty Dog, but we remain a restaurant for humans,” Stearns said.

The Blond Giraffe Key Lime Pie Factory in Key West, Florida, banned dogs because it didn’t want to be held responsible if a dog ate iguana droppings — which can

make them violently ill — or tripped a child or an elderly diner. In at least one case, an unleashed dog at the restaurant killed a neighborhood cat.

Julie Denzin, who has worked as a restaurant server in Milwaukee for more than a decade, has watched dogs drool, fight, growl and relieve themselves on restaurant patios. Dogs have bitten her and knocked her over, causing her to spill scalding hot coffee. She has also encountered diners who are allergic to dogs or afraid of them.

Denzin doesn’t think dogs should be banned, but says restaurants should consider designating dog-friendly areas or specific hours when dogs are allowed.

“It’s not a matter of liking or disliking dogs,” she said. “The point is, regardless of what the owner might say — no matter

how perfect and obedient they insist their dog is — there’s no way to ensure the safety and comfort of other guests.”

Maddie Speirs, a dog trainer with Pawsitive Futures Dog Training in St. Petersburg, Florida, said many people hire her with the goal of training their dogs to eat out at restaurants. Not every dog is cut out for that, she said; they need to be comfortable with noise and unsolicited interactions and able to be able to sit near food for long periods.

She urges owners to think about who benefits from restaurant visits: them or their dogs.

“If you think it’s for your dog, what exactly are they getting out of it?” she said. “It’s not as fun of a social interaction for dogs as it is for us.”

Illinois Supreme Court considers whether a fetus can be a ‘victim’ of murder

High court will also consider limits of police power to ‘stop and frisk’ pedestrians

CHICAGO — In 2007, Reginald Lane shot and killed Jwonda Thurston, his pregnant girlfriend. For the murder, he was sentenced to life in prison, following state statute for someone who is found guilty of killing “more than one victim.”

On Thursday, the Illinois Supreme Court heard arguments in Lane’s case, specifically around whether Lane was given the appropriate sentence. Lane’s appeal hinges, in part, on whether Thurston’s unborn child can be considered a “victim” of the murder and, more broadly, whether it can be considered an “individual” under the law.

“As it stands now, the unified code of corrections defines a victim as any natural person who su�ered direct harm,” Talon Nouri, an attorney representing Lane, told the justices. “And again, the statute on statutes notes that whenever the word ‘person’ or ‘individual’ is used, that person must have fi rst been born alive.”

Nouri also cited the state’s Reproductive Health Act, a 2019 law that, among other things, stipulates fetuses do not have independent rights in the state of Illinois.

In addition to the question of what constitutes a “victim” under state law, Nouri also argued Lane’s sentence was inappropriately applied because the lower courts had sentenced Lane in alignment with the sentence for a double murder.

murder and killing an unborn child – also called feticide – which are two distinct crimes.

“While the penalty section of the ‘intentional homicide of an unborn child’ statute states that the sentence shall be the same as for fi rst degree murder, the relevant statutes and definitions unambiguously exclude intentional homicide of an unborn child from this double murder sentencing statute,” Nouri told the court.

Assistant Attorney General Josh Schneider, who argued the case on behalf of the state, relied on the statute’s language identifying the sentence for feticide as being the same as murder.

“When a person is convicted of intentional homicide of an unborn child, the sentence they receive for that o�ense is the same sentence they would receive if they had been convicted of fi rst-degree murder under those same circumstances,” Schneider said.

Several justices interrogated that line of reasoning.

“So we really don’t even need to go to these definitions in the other statutes because the legislature has directed us to apply the same sentence as in murder?” Justice Lisa Holder White asked of Schneider.

“That’s exactly right,” Schneider replied.

The justices took the matter under consideration with a ruling to come at a later, unspecified date.

Stop and frisk

The justices on Thursday also considered the case of Francisco Lozano.

In 2018, Lozano was the subject of a “Terry stop,” sometimes also known as a “stop and frisk” or “field inter-

view” in Chicago’s East Garfield Park neighborhood.

From their unmarked police car, two o�cers noticed Lozano running on a rainy afternoon with his hands in his pockets. After turning their car around, o�cers saw him run up the stairs of an abandoned apartment building before stopping him and finding that he had a car radio, two screwdrivers and a wallet.

As a result of this stop, Lozano was eventually found guilty of burglary to a vehicle and possession of burglary tools.

Lozano’s lawyer, Pamela Rubeo, argued the police violated Lozano’s 4th Amendment right against unlawful search and seizure by stopping him for “running in the rain.”

“The parties agree the o�cers needed reasonable suspicion of criminal activity at the inception of this stop,” Rubeo told the court. “Here, no such reasonable suspicion existed.”

Assistant Attorney General Jalan Jaskot, who argued on behalf of the state, told the justices that police had reasonable suspicion by the time they stopped Lozano, citing the behavior that police observed as they approached Lozano for the stop.

This received some pushback from Chief Justice Mary Jane Theis, who referenced the lower court’s opinion on the case.

“According to the o�cer’s own testimony, the reason why he stopped him was to conduct a field interview and ask him why he was running,” Theis noted during oral arguments. “Why shouldn’t we just accept that was the basis of the stop – as the o�cer himself described – and evaluate whether that was an appropriate Terry stop?”

Jaskot responded that the o�cers saw Lozano “flee” to the abandoned building when they turned their car around and that while they were approaching, they saw a “bulge” in Lozano’s front sweatshirt pocket, giving them reasonable suspicion for a Terry stop.

“If the facts of this case were simply that the defendant was running in the rain, o�cers would not have the reasonable suspicion to conduct that Terry stop,” Jaskot said after further questioning on the subject from the justices. “However that is not all that we have. Very importantly, we also have the defendant’s evasive behavior where he did change that direction and run towards this building that appeared abandoned.”

Rubeo also argued that some evidence in Lozano’s trial was inappropriately

introduced, as it was taken from statements Lozano gave during his arrest, without being given a “Miranda warning,” a set of notifications police are required to give people they arrest. These notifications include the right to remain silent, the right to an attorney and the warning that anything a defendant says can be used against them in court, among other things.

In their court fi ling, the attorney general’s office argued that Lozano forfeited the chance to suppress the statements he made before being given a Miranda warning because his lawyers failed to bring it up in his trial.

The case will also be considered by the justices, although there is not a set timeline for how long they will take to deliver a final opinion.

‘Riding the circuit’

The justices did not hear arguments for these cases at their typical venue at the Supreme Court’s building in Springfield. Rather, the court was “riding the circuit” and heard arguments on the campus of Chicago State University on Chicago’s South Side.

The court uses a version of the historical practice of judges traveling to district courts to “raise public awareness and confidence in the judicial branch,” according to Theis.

It’s a practice that had been temporarily stalled in recent years amid the COVID19 pandemic. The court held a virtual “riding the circuit” program in 2021 in conjunction with schools from the state’s Second Judicial District in northern Illinois. The court’s previous in-person road trip took place in Sept. 2019 when arguments were heard at Lewis & Clark Community College in Godfrey.

“It is the first time in our history of this court and our state that we have come to the First District here in Chicago,” Theis told attendees of the arguments on Thursday.

Around 300 students from schools around the region attended the event. Following the oral arguments, students participated in a question-and-answer session with representatives of the Cook County Bar Association.

Growing rhubarb, continued

Rhubarb is one of the earliest spring vegetables in the Rockford area each year. This perennial plant produces annual stalks which you harvest and cook. Because of its tart flavor, rhubarb tends to be cooked with sugar or another fruit. While rhubarb can grow well in most years, you may find that the vigor of your plant has started to decline and you need to address its growing needs.

For the fi rst 3 years of a rhubarb plant’s life, it is focused on building a strong root system. During this time, it is important

to not harvest any stalks as you would be taking energy away from the plant. This is especially important in it’s first season. In the 2nd year, you might be able to harvest 1-2 weeks. Yet again, year 2 is focused on building this perennial plant root system for strong harvest for years to come. The third year you could potentially harvest much longer with 5-6 weeks of harvest. What this means though is that if you plant rhubarb in 2023, your full harvest will not begin until 2025-2026. During these years, try to add compost/aged manure each season. You might also consider a yearly balanced fertilizer of 10-10-10. The

rhubarb plants are massive and remove a lot of nutrients from the soil each season. So, it’s important to be adding products that can allow for the plant to thrive.

If you have a rhubarb plant that is over 5-6 years, it may be time to split-divide the plant. By doing this, it can reinvigorate your plant. This action occurs in early spring when the soil is beginning to warm with initial stalk emergence. To divide the plant, use a shovel to cut the underground plant in half or in quarters. Remove all the parts except for one. You can give these parts out to friends or plant in other parts of your property. After a

When we were asked to form the Illinois Renewable Energy Association in 2001 we agreed to accept a leadership role in it. The board included installers of small solar and wind systems who had attended the Energy Fair at Amherst, Wisconsin, in a rural setting. Similar but smaller events were occurring in rural settings in Iowa and Michigan.

When we organized our first Renewable Energy Fair in Ogle County, most of the vendors and speakers had done the same at other events. Many were focused on living energy e�cient lives and many were outdoor enthusiasts who enjoyed the rural setting.

The primary interests of Fair attendees was reducing their own energy bills, eliminating reliance on fossil fuels and finding opportunities to use solar and wind energy. Home owners liked the idea of being able to reduce their energy bills and still enjoy the benefits of adequate energy supplies. At a recent prairie event one member thanked us for the fact his electric bill decreased to $13/month after having a solar system installed.

Beyond the interests of small busi-

nesses and those seeking energy independence were advocates of large scale utility solar and wind installations. These would necessitate upgrading the electrical grid to accommodate a major transition to increased reliance on what became known as green energy. A participating couple established one of the fi rst utility scale wind farms in Illinois. It surrounded the farm home of an Illinois natural areas specialist who later accepted a similar position with an international organization to escape living within a wind farm.

Relatives from Germany came to the Fair and brought news of Feldheim, Germany, whose 130 residents eventually left the national grid and powered their community locally with wind and solar. Later they added a biogas plant based on pig and cow manure for energy to process corn and grains. In order to leave the national grid the community raised money to create their own local electric grid.

Initially, renewable energy was supported by environmental interests but as these installations continue to expand, some environmental interests increased their concerns regarding overall environmental impacts.

In the eyes of some critics the clean energy transition from fossil fuels and its adverse environmental impacts to adverse environmental impacts from mining, processing, consumption and subsequent disposal of minerals used for renewable installations in a more intensely electrified economy was not advantageous.

The environmental interests expressing such concerns claim they are not opposed to solar and wind installations but are raising doubts that they will solve our environmental problems unless there is a major commitment to changing the consumption patterns of the majority of citizens in highly developed economies.

Recently President Macron of France issued a warning to citizens about the end of abundance and pushed the retirement age up two years leading to widespread protests. England’s Hugh Pill warned of reduced prosperity as well for their country. Tim Morgan of Surplus Energy Economics considers the economy as an energy system rather than a financial one and describes how growth in prosperity is trending downward as the cost of securing more energy trends upward. Since the 1990s each dollar of economic growth was based on $3 of net new debt. The level of

Rhubarb plants will produce a seed stalk. Remove the seed stalk and continue your harvest. When a seed stalk appears, it is sending energy away from the plant. You may have many seed stalks develop throughout the season.

Around the fi rst fall frost, the rhubarb stalks and leaves will die back. Leave this debris in place as it will provide winter protection.

Despite the questions being raised regarding the transition to cleaner energy sources the process continues as revealed in data provided by existing organizations. It is early in the transition from a fossil fuel based society built on excessive energy consumption and products designed to be short lived and disposed of in landfi lls. A less energy intensive society is possible and would have economic, environmental and social benefits. Renewable energy sources would be a part of this society but critics consider it unlikely that renewables themselves will provide the massive amount of energy currently powering the global economy. If a far less energy intensive lifestyle is what lies ahead it is possible to pursue it now. A good place to start is by reconsidering what individuals consider essential uses of energy and cut back on discretionary use. At the societal level a similar process is possible but has far broader social and economic implications regarding what constitutes essential services.
