Jury convicts politically connected businessman for bribing pair of lawmakers

James Weiss found guilty on all seven counts of bribery, lying to FBI

CHICAGO – It wasn’t quite “where’s the beef?” but when he stepped outside a suburban Wendy’s with a fellow lawmaker on a hot August morning in 2019, thenstate Sen. Terry Link asked a question to the same effect as the fast-food giant’s former slogan.

“What’s in it for me, though?” Link asked then-state Rep. Luis Arroyo, who had been pitching him – once again –on sponsoring legislation to regulate so-called sweepstakes machines, a legally murky form of gambling.

The answer to that question became central to the federal government’s case against politically connected businessman James Weiss, which ended Thursday with a jury convicting Weiss on seven counts, including bribery and lying to the FBI.

Federal sentencing guidelines dictate a maximum of 20 years in prison for the most serious of the charges, though those convicted of public corruption have faced wildly different sentences.

Weiss is married to former state Rep. Toni Berrios, D-Chicago, making him the son-in-law of longtime former Cook County Democratic Party boss Joe Berrios. Neither attended any of the seven-day trial.

Wearing a stony expression and a black suit, Weiss took occasional sips of water from a red plastic cup while Judge Steven Seeger read the guilty verdicts on Thursday afternoon. The jury deliberated for about four hours after hearing the last bit of closing arguments in the morning, following roughly four days of testimony from 13 witnesses – including Link.

Before dismissing the parties, Seeger scheduled Weiss’ sentencing for Oct. 11.

‘A scheme already underway’

In September 2018, Weiss founded a sweepstakes machine company called Collage LLC and promptly set to work on changing state laws to fully legalize the devices, which operate in a legal gray area in Illinois.

ing on Arroyo to “consult” with him for $2,500 per month. While the defense said it was a legitimate business arrangement, the government called it a bribe – and the jury agreed.

“He can call it whatever he wants,” Assistant U.S. Attorney Sean Franzblau told the jury during his closing arguments Wednesday. “He can call himself his consultant, his lobbyist, his dentist, his therapist – it doesn’t matter. If you pay a public official money in exchange for an official act, it is a bribe.”

Ten months into Arroyo’s arrangement with Weiss, the two met Link for a meeting in a Highland Park Wendy’s. It was there that Link asked Arroyo to step outside, and then asked the critical question. Though Link had assured his fellow Democrat that their conversation was “you and I talking,” the 24-year veteran of Springfield had been wearing an FBI wire as part of a deal he’d cut a couple years earlier after being caught evading his taxes.

Arroyo answered Link’s question in the Wendy’s parking lot with an offer of “a monthly check, a monthly stipend” for Link or someone else of his choosing. And a few weeks later, Weiss cut the first of two $2,500 checks for a “friend” of Link’s named “Katherine Hunter.”

But no such person ever existed; it was a name the FBI provided to Link an hour before his second meeting with Arroyo. Weiss drove Arroyo to a diner in Skokie, then stayed in the car while Arroyo went inside and handed Link a folder containing Weiss’ business card, draft legislation to regulate sweepstakes machines, and a $2,500 check from Collage LLC that Weiss had signed with the payee line left blank.

Arroyo is now 10 months into a 57-month prison sentence after he pleaded guilty to bribing Link. But Weiss has maintained his innocence.

Weiss’ attorney, Ilia Usharovich, emphasized Weiss’ absence from both key meetings between Link and Arroyo in which the bribe was arranged.

“They both hid it from Mr. Weiss,” Usharovich said. “If they wanted Mr. Weiss to know about it, they would’ve had him at the table.”

Usharovich also said the fact that Weiss paid the $2,500 monthly consulting fees in checks is reason enough to doubt he was bribing Arroyo and Link.

“If Jimmy wanted to bribe these people, why wouldn’t he just give them cash?” he asked the jury in his closing arguments. “Bribes come in cash because you don’t want a record. You don’t want to be sitting in federal court explaining.”

The government attorneys, however, refuted that claim.

“Common sense dictates that when you send someone to meet an elected official at (the Skokie) restaurant with a blank check and legislation…you are paying a bribe,” Franzblau told the jury. “It’s not an accident...It’s a continuation of a scheme already underway.”

Speaking to reporters after the verdict, juror Abriana Sutherland-Scienski said the jury didn’t buy Usharovich’s attempt to separate Weiss from Arroyo’s actions.

“It’s pretty clear that Mr. Weiss was involved in every step of this process,” she said. “There were some arguments that the defense made that I personally found insulting to our intelligence and to the court at large.”

Sweepstakes machines

After partnering with Weiss, Arroyo promptly began pushing for pro-sweepstakes machine legislation in Springfield, according to testimony from Link and two lawmakers who’d been involved in gambling legislation around that time. State Rep. Bob Rita, D-Blue Island, characterized Arroyo’s advocacy as “extreme,” and said he’d even started avoiding Arroyo.

After Link blew up at Arroyo as the clock was winding down on lawmakers’ spring session in May of that year, the feds saw an opportunity to further Link’s role as a cooperating witness. In mid-July, Link called Arroyo, apologized for telling him on the Senate floor to “get the f--- out of here” and suggested meeting to talk about sweepstakes legislation.

The meeting at the Highland Park Wendy’s took place a couple weeks later, where Weiss made his case to Link for the legalization of sweepstakes machines – a close cousin of the heavily regulated video gaming terminals that have proliferated in Illinois in the last decade.

Blinken and Xi pledge to stabilize deteriorated US-China ties

BEIJING (AP) — U.S. Secretary of State Antony Blinken met on Monday with Chinese President Xi Jinping and said they agreed to “stabilize” badly deteriorated U.S.-China ties, but America’s top diplomat left Beijing with his biggest ask rebuffed: better communications between their militaries.

After meeting Xi, Blinken said China is not ready to resume military-to-military contacts, something the U.S. considers crucial to avoid miscalculation and conflict, particularly over Taiwan.

Still, China’s main diplomat for the Western Hemisphere, Yang Tao, said he thought Blinken’s visit to China “marks a new beginning.”

“The U.S. side is surely aware of why there is difficulty in military-to-military exchanges,” he said, blaming the issue squarely on U.S. sanctions, which Blinken said revolved entirely around threats to American security.

Yet Blinken and Xi pronounced themselves satisfied with progress made during the two days of talks, without pointing to specific areas of agreement beyond a mutual decision to return to a broad agenda for cooperation and competition endorsed last year year by Xi and President Joe Biden at a summit in Bali.

And, it remained unclear if those understandings can resolve their most important disagreements, many of which have international implications. Still, both men said they were pleased with the outcome of the highest-level U.S. visit to China in five years.

The two sides expressed a willingness to hold more talks, but there was little indication that either is prepared to bend from positions on issues including trade, Taiwan, human rights conditions in China and Hong Kong, Chinese military assertiveness in the South China Sea, and Russia’s war in Ukraine.

Blinken said later that the U.S. set limited objectives for the trip and achieved them. He told reporters before leaving for a Ukraine reconstruction conference in London that he had raised the issue of military to military communications “repeatedly.”

“It is absolutely vital that we have these kinds of communications,” he said. “This is something we’re going to keep working on.”

The U.S. has said that, since 2021, China has declined or failed to respond to over a dozen requests from the Department of Defense for top-level dialogues.

According to a transcript of the meeting with Blinken, Xi said he was pleased with

the outcome of Blinken’s earlier meetings with top Chinese diplomats and said restarting the Bali agenda were of great importance.

“The Chinese side has made our position clear, and the two sides have agreed to follow through the common understandings President Biden and I had reached in Bali,” Xi said.

That agenda had been thrown into jeopardy in recent months, notably after the U.S. shot down a Chinese surveillance balloon over its airspace in February, and amid escalated military activity in the Taiwan Strait and the South China Sea. Combined with other disputes over human rights, trade and opiate production, the list of problem areas is daunting.

But also Xi suggested the worst could be over.

“The two sides have also made progress and reached agreement on some specific issues,” Xi said without elaborating, according to a transcript of the remarks released by the State Department. “This is very good.”

In his remarks to Xi during the 35-minute session at the Great Hall of the People, a meeting that was expected but not announced until an hour before it started, Blinken said “the United States and China have an obligation and responsibility to manage our relationship.”

“The United States is committed to doing that,” Blinken said. “It’s in the interest of the United States, in the interests of China, and in the interest of the world.”

Blinken described his earlier discussions with senior Chinese officials as “candid and constructive.”

Despite the symbolism of his presence in China, Blinken and other U.S. officials had played down the prospects for any significant breakthroughs on the most vexing issues facing the planet’s two largest economies.

Instead, these officials have emphasized the importance of the two countries establishing and maintaining better lines of communication.

Thus, China’s refusal to resume the military-to-military contacts was a hitch.

“Progress is hard,” Blinken told reporters. “It takes time, it takes more than one visit.”

Blinken’s trip is expected to herald a new round of visits by senior U.S. and Chinese officials to each other’s countries, possibly including a meeting between Xi and Biden in India or the U.S in the coming months.

Before meeting with Xi, Blinken met earlier Monday with China’s top diplomat Wang Yi for about three hours, an encounter that produced a harsh assessment of the talks.

China’s foreign ministry said “it is necessary to make a choice between

dialogue or confrontation, cooperation or conflict.” It blamed the “U.S. side’s erroneous perception of China, leading to incorrect policies towards China” for the current “low point” in relations.

And, it said the U.S. bore responsibility for halting “the spiraling decline of ChinaU.S. relations to push it back to a healthy and stable track.” It added that Wang had “demanded that the U.S. stop hyping up the ‘China threat theory,’ lift illegal unilateral sanctions against China, abandon suppression of China’s technological development, and refrain from arbitrary interference in China’s internal affairs.”

In it’s readout of the meeting, the State Department said Blinken “underscored the importance of responsibly managing the competition between the United States and the PRC through open channels of communication to ensure competition does not veer into conflict,” using the acronym for the People’s Republic of China.

In the first round of talks on Sunday, Blinken met for nearly six hours with Chinese Foreign Minister Qin Gang, after which both countries said they had agreed to continue high-level discussions.

Both the U.S. and China said Qin had accepted an invitation from Blinken to visit Washington but Beijing made clear that “the China-U.S. relationship is at the lowest point since its establishment.” That sentiment is widely shared by U.S. officials.

Blinken’s visit came after his initial plans to travel to China were postponed in February after the shootdown of a Chinese surveillance balloon over the U.S.

In his meetings, Blinken also pressed the Chinese to release detained American citizens and to take steps to curb the production and export of fentanyl precursors that are fueling the opioid crisis in the United States.

Since the cancellation of Blinken’s trip in February, there have been some high-level engagements. CIA chief William Burns traveled to China in May, while China’s commerce minister traveled to the U.S. And Biden’s national security adviser Jake Sullivan met with senior Chinese foreign policy adviser Wang Yi in Vienna in May.

But those have been punctuated by bursts of angry rhetoric from both countries over the Taiwan Strait, their broader intentions in the Indo-Pacific, China’s refusal to condemn Russia for its war against Ukraine, and U.S. allegations from Washington that Beijing is attempting to boost its worldwide surveillance capabilities, including in Cuba.

And, earlier this month, China’s defense minister rebuffed a request from U.S. Defense Secretary Lloyd Austin for a meeting on the sidelines of a security symposium in Singapore, a sign of continuing discontent.

But unlike video gaming terminals, which require thousands of dollars in annual fees for licensing, sweepstakes machine operators only pay a $30 annual fee to the Illinois Department of Revenue for a sticker. Sweepstakes machines proponents claim the devices fall under Illinois’ Prizes and Gifts Act and shouldn’t be treated as a type of gambling.

Due to the much lower barrier to entry, both Weiss and Arroyo told Link that sweepstakes machines help small businesses that either don’t have liquor licenses or can’t a�ord the license fees required to host state-regulated video gaming terminals.

Usharovich had tried to make the case that lawmakers like Link, Rita and former state Sen. Tony Munoz, who also testified in the case, were in the pocket of big video gaming companies and casinos, both of which want to ban sweepstakes machines outright. As a result, Usharovich claimed, it was in their best interest to block legislation to legalize sweepstakes machines.

But juror Sutherland-Scienski told reporters that the jury didn’t find that argument compelling either.

When interviewed by FBI agents two months after Link and Arroyo’s second meeting, Weiss claimed that Link had wanted Weiss to hire “Katherine Hunter” to lobby on behalf of Collage in Springfield. Weiss even said he’d once had a brief phone conversation with her.

“I knew Katherine Hunter. I had talked to her, or I thought it was her,” Weiss told the agents while in the back of an FBI vehicle during a surprise interview in late October 2019. “I told you guys that I talked to her for two minutes.”

According to Weiss, Arroyo had handed him his phone once while they were together at Tavern on Rush, a restaurant in downtown Chicago, and indicated it was Hunter wanting to talk to him about their consulting arrangement.

Weiss’ attorney asked the jury to keep an open mind about coincidences.

“There’s no proof to show that Mr. Weiss did not speak to what he believed to be a woman named Katherine,” Usharovich said in his closing arguments.

Weiss would later have his assistant send a lobbying contract to Hunter, along with a second $2,500 check. The items

were sent to Link’s P.O. box, which he’d long used to accept mail related to his political action committee. But Weiss claimed he didn’t know it was Link’s P.O. box, as it was the only address provided to him by Arroyo.

Both the contract and the check were made out to “Catherine Hunter” – spelled with a C instead of a K – a fact Usharovich used to sow doubt about Weiss’ involvement in the alleged scheme. Earlier in trial, jurors heard a September 2019 wiretapped call in which Link reminded Arroyo that Katherine was spelled “with a K, not a C.”

“That means Mr. Arroyo wasn’t communicating with Mr. Weiss because the second check and the contract was made out to Catherine with a C,” Usharovich said.

He claimed Weiss didn’t know that Katherine Hunter was just a “passthrough” entity for Link to get paid, and cited Weiss’ exclusion from the second meeting between Link and Arroyo.

“They both hid it from Mr. Weiss,” Usharovich said. “If they wanted Mr. Weiss to know about it, they would’ve had him at the table.”

Usharovich also built on the theme the defense introduced in their opening

statement last week, insisting that it was actually the government that “created” the bribe by creating the fictitious “Katherine Hunter” and having Link solicit a bribe from Arroyo on her behalf.

The government’s attorneys, however, pushed back on the notion that Link solicited a bribe; Link himself said he’d asked the question the feds suggested “in his own words,” and that it was meant to be open-ended.

Franzblau told the jury that Arroyo could’ve o�ered Link anything – like support for one of his bills – or nothing. But instead, “Arroyo fl ipped into corruption mode,” he said.

“Ladies and gentlemen, the government did not create the bribe,” Franzblau said. “The FBI simply walked up to a corrupt scheme already in place, gave a little nudge, and another bribe came tumbling out.”.

Paradise Guitar store owner and Skynyrd fanatic Thor Davis talks shop

Paradise Guitars began in November, 1986 with co-owners Mike Johnston and Gary Phillips in a tiny two-story house on Shirland ave. in Beloit Wis.

The building’s previous home was to The Peg Nelson Guitar Center, which served Beloit for three decades. The store eventually out grew its walls and moved to 921 E Inman Pkwy, in September of 1988. Since then, Paradise Guitars has a new owner and new location.

Today we catch up with new owner Thor Davis.

RRI: When Mike Johnston (former owner Paradise Guitars) retired the store moved to a new location. First off tell us how you got into the picture in the first place and why the move?

Thor Davis: Well I grew up at Paradise Guitars, my dad worked there for most of my life as a guitar teacher and tech/ Luthier with Gary in back. I went to school at Turner just down the road so I walked down every day after school. I’ve known Mike Johnston (former owner) ever since I can remember.

RRI: Do you remember what first got you into music and guitars early on?

TD: My father 100%, I’ve had a guitar

since the day I was born and I was always exposed to good music because of him.

RRI: You are currently building a name for yourself as one of the best guitar repair techs in the area. Have you always had a passion for type of thing? (building, electronics, etc.)

TD: Thank you! I’m trying! But yes, I’ve always got the most satisfaction working with my hands, as a kid I was always tinkering on my bicycles or skateboards. I’ve always had good attention to detail too which in my opinion is very important in this business.

RRI: In a previous conversation you told me that you started collecting vintage guitars and gear over a decade ago. What is your favorite guitar or piece of gear? Something that you would never consider selling?

TD: I LOVE vintage gear, especially vintage Fender! I have two favorite pieces; I have a 1968 Telecaster that is a Frankenstein but a killer player. My favorite collectable one is my 1954 Martin 000-18, i got that one at Carter Vintage in Nashville and don’t ever plan on selling it.

RRI: Are you into vinyl records at all?

TD: Absolutely, there is a certain quality to vinyl you just can’t get with digital. I don’t have a huge collection but I try to

buy vinyl whenever I come across it.

RRI: You guys sell new and used equipment at your store. What is the most common thing that people ask for while visiting Paradise guitars?

TD: The most common request I get in the store is usually for entry level guitars for people just getting into it. They may not be the most “high dollar” sales but I’d say the most fun. I love seeing people’s excitement for it as they’re getting into it all!

RRI: If you could go back in time and grab two items from the past and bring them home to current time, what would you bring with you? Doesn’t have to be music related.

TD: I have to say a 1953 Fender Telecaster (that’s my dream guitar) and a 1970 Chevy Nova. Old stuff rules.

RRI: Does your store offer lessons?

TD: Yes, we do! Lessons are $25 per half hour and times are available all during the week!

RRI: Scenario - A group of kids walk into the store. One kid grabs a guitar and plugs in. What does he start playing?

TD: Haha depends on the kid; I hear a lot of EVH licks being attempted. The ‘80s are making a comeback. Most often, It’s usually a lot of clunking around but

sometimes I’m pleasantly surprised by some of the younger players around here.

RRI: Led Zeppelin =

TD: RULES! Jimmy Page is one of my favorites.

RRI: Favorite Pub in Beloit to have some chicken wings and a beer with friends =

TD: That’s a tough one! Suds was my favorite when it was still around. Nowadays I’d have to say Grand Ave Pub but 5 Bar should get an honorable mention too. It’s a cool vibe and cool people!

RRI: Favorite music group of all time = TD: Lynyrd Skynyrd before the plane crash. They were awful after Ronnie died.

RRI: Best concert you have ever seen = TD: Primus was pretty damn cool! That was probably the most entertaining show I’ve seen.

RRI: What’s next for Thor Davis?

TD: I’m going to ride this thing out until the wheels fall off! Keep trying to build a name for myself and just see where the music business takes me! Nashville has always been a goal of mine. Hopefully I’ll end up there one day!

When MTV first brought seven strangers together to live in a New York City loft in The Real World back in 1992, it was billed as a social experiment. Reality TV’s latest social experiment is Freevee’s Jury Duty (Freevee is Amazon’s free, ad-supported streaming service.)

Jury Duty wanted to see how an average person would react to serving on a sequestered jury. Everything about the trial was fake, except for that one average guy – Ronald Gladden – who thought he was taking part in a PBS documentary about the United State’s jury system. Adding even more realism, there was another actor playing someone else

PBS was supposedly following but who wouldn’t make it onto a jury. (That part didn’t even make it into the show.)

Roughly three weeks of real time play out over the Jury Duty’s eight 30-minute episodes. During that period, Gladden and a handful of other “jurors” were together nearly 24 hours a day, while other jurors were supposedly sequestered at a different hotel, so the actors were able to go home each might.

One of the funniest bits happened early on. Actor James Marsden (Enchanted, X-Men, Westworld) – playing a heightened version of himself – sat down near Gladden in the waiting room, but Gladden didn’t recognize him. Cast had to switch to their plan B, and another actor came

up to ask for a photo with Marsden.

Producers had multiple contingency plans in place so the cast could adapt to however Gladden reacted to the craziness happening around him.

While each episode is entertaining, the real payoff comes in the final episode, “The Verdict,” after the judge – played by real-life Chicago attorney Alan Barinholtz (father of actors Ike and Jon Brinholtz) – reveals the big secret, and Gladden learns the lengths cast and crew went to create as realistic as an experience as possible, while adding bizarre scenarios that still needed to ring true. Producers said Gladden kept them on their toes the entire time.

One of the show’s cardinal rules was

to never make Gladden the butt of a joke. They pushed and tested him, but he never broke. Instead of brushing off someone you or I might find annoying, he was kind and caring. When forced or cajoled into awkward situations, he maintained his composure and rolled with whatever punches they threw his way. And when deliberating, he did his best to be fair without pushing his opinions on other jurors.

If you decide to watch Jury Duty, make a point to later watch the episodes with commentary from Gladden, Marsden, and others. That’s when you’ll really understand what, and who, really made this show so special.

Energy and Technology

We recently attended Timber Lake Playhouse near Mt. Carroll with friends. Since they drove, we were passengers so had a chance to scan the skies in the open countryside. It was clear just how widely smoke from the Canadian forest fires stretched across the sky. Later the East coast of the US was inundated by the smoke.

As an environmental expert we know says: If we just look around and pay attention to things, there is all the evidence we need as proof of climate change. Unfortunately different eyes interpret events according to other perspectives leading some to claim it is a normal cyclic event and nothing to worry about.

However as the environmental community and more members of the public take notice of the haze surrounding them, public pressure for solutions to our environmental problems may increase. With global temperatures already high for this time of the year, continued release of heat trapping gases and the anticipated return of El Nino, we could face heat waves, droughts, wildfires and hurricanes driven by heat energy in the oceans. A remaining question is whether megafires will be a routine part of life on the planet.

One long offered solution to climate change and other environmental problems has been to dramatically cut back on energy consumption. Far more emphasis needs to be placed on energy efficiency. We have long followed the work of Amory Lovins and interacted with him at energy hearings and meetings. We visited his highly insulated home in Snowmass, Colorado, which was designed to maintain the heat collected from the sun. It is comfortable without a furnace; he grows bananas in the house.

Existing homes and buildings can be retrofitted to radically reduce energy consumption as well. If a program were initiated to design whole factories, equipment, buildings, and vehicles, substantial energy savings beyond that thought possible today would accrue. If a nation became truly energy efficient, Lovins and the RMI calculate that 2/3 to 3/4 of all fossil fuel energy could be saved in industrialized countries. He essentially calls for technological solutions based on good design which would enable to people to live the good life with little focus on changing their behavior.

Whether technological innovation alone will meet the challenges we face is disputed by other experts. Their main premise is that since our unquestioned faith in technology is what led to deteriorating environmental and social conditions we should be evaluating the environmental

impacts of new technologies before they are widely implemented.

Formerly, the Office of Technological Assessment at the Federal level assessed the pros and cons of proposed projects seeking federal support. The assessment process halted a proposed controversial project to build a commercial plane to travel at speeds which broke the sound barrier, saving time for passengers. Top scientists in the fields related to the project rejected it out of concerns over sonic booms and damage to the ozone layer. Later the British built the Concorde based on a similar concept, used it in commercial aviation for a short time and later, based on structural and operational problems, scuttled the project. The office was subsequently abolished leaving Congress no source of independent advice on projects proposed for funding. There are renewed calls to reestablish the assessment office Questions are being raised regarding whether renewable sources can supply the essential energy needed to power the modern economy. One skeptic suggested we begin by converting an island to renewable energy to demonstrate its potential and assess its impacts.

Such demonstrations are already occurring; one is on the Greek island of Astypalea featuring a transition to electrification. Nearly 100% of their new car sales are electric. Roughly 1/4 of the residents use electric ridesharing services that enable them to rent electric cars, scooters and bikes. By 2024, 100% of the electricity for electric vehicles will come from a new solar power plant with battery storage. Additional solar capacity will be added in subsequent years. According to an article in Clean, the transition to solar electricity is supported by the Volkswagen Group and the Hellenic Republic. Supporters expect to create similar projects in other areas of Europe.

Other projects underway that provide small scale efforts to cut energy consumption can be emulated in other communities as well. In the Bryant neighborhood in Ann Arbor, the Community Action Network partnered with the city to make the homes more energy efficient while transitioning to electricity. The homes will eliminate fossil fuel combustion and depend on electrically powered HVAC systems. Plans include installing solar systems on all the homes. The project was described in a radio story available from the Yale Climate Connections

Considering global energy uncertainties, existing federal and state incentives available for energy efficiency and renewable energy provide opportunities for individuals and communities to achieve a measure of energy security.
