Proposed Aqua rate increase reignites tensions between the company and its customers

BOURBONNAIS – As state regulators consider whether to approve a proposed rate increase for the state’s second largest private water utility, its customers are criticizing it for poor service and high prices.
Aqua Illinois, which serves parts of 14 counties mostly in northern Illinois, requested an increase to its rates in January. Under the proposal, customers would see about a $30 increase in monthly bills, according to Citizens Utility Board, a consumer watchdog group involved in the case.
This comes at the same time as the state’s largest utility, Illinois American Water, is requesting a similar rate increase of its own – and facing its own criticisms.
The Illinois Commerce Commission is expected to rule on both cases by the end of the year. Regulators at the ICC can accept, reject or modify the proposals based on evidence presented to them from the companies, ICC staff, advocacy groups and municipalities.
Representatives of Aqua Illinois say the rate increase is necessary to maintain the infrastructure of its water systems, such as pump stations and water treatment plants, as well as to keep up with the cost of inflation. According to Aqua Illinois President David Carter, the cost of chemicals needed for making water safe to drink has more than doubled since the utility’s last rate case over six years ago.
But many Aqua Illinois customers say the company has already failed to adequately maintain its systems and shouldn’t be granted the increase.
Last year, Aqua Illinois entered into a consent order meant to resolve years of legal battles with the state’s attorney general stemming from dangerously high levels of lead in the water system for University Park, a far south suburb of Chicago. The heavy metal can lead to brain and kidney damage and is particularly dangerous for young children.
University Park’s mayor, members of its board of trustees and residents registered their dissatisfaction with the utility at an ICC hearing Thursday in Bourbonnais. Black residents make up the majority of the working class village of about 7,200.
“This is environmental racism and injustice,” University Park Village Manager Elizabeth Scott said during a public comment. “And ICC, I want you to know we have to have you do something. These
people are monsters.”
Others, like former village trustee Sonia Jenkins, criticized the rate increase request itself, particularly after many have spent several years buying bottled water to avoid relying on the tap.
“We have major concern with Aqua water company,” Jenkins said. “There is no trust. Our seniors cannot afford an increase like this.”
In the five years since the Illinois Environmental Protection Agency found lead in University Park’s water, Aqua has spent about $18 million on remediation, according to Carter, none of which is being recovered from ratepayers. The lead contamination came from erosion of older pipes.
“We feel really confident that the erosion control treatment we have in place is working well,” he said in an interview last week, also noting that testing has found lead levels to be acceptable for three years.
Residents of the village can also request lead level testing from the company at no cost.
“We are committed to wanting to begin to build the trust,” Carter said Thursday.
But University Park residents are not alone in their discontent over Aqua’s water quality. At a separate hearing Monday in the far northwest Chicago suburb of Crystal Lake, attendees complained of service interruptions and of discolored water.
“It’s just unfair,” said Frank Pontrelli of Lakemoor. “We’re just getting browbeat here. Money’s getting taken and the water is still orange.”
Stephanie Tesmer, a customer and longtime critic of Aqua Illinois, said in an interview that she and others in her McHenry County community are “angry” and “frustrated” with the company.
“No one uses water from the tap,” she said.
Water in Tesmer’s unincorporated neighborhood of Eastwood Manor is often discolored due to high levels of iron. In the company’s 2023 water quality report for that system, it found the iron concentration to be 2.3 parts per million. While it doesn’t apply to this specific water system, the general threshold for iron set by the Illinois EPA’s threshold of 1.0 parts per million for drinking water.
This leaves people like Tesmer relying on personally owned filtration systems to remove iron in their water, which can be costly.
Carter said despite the discoloration, the water meets state and federal safety regulations. Still, the company is expect-
ed to have a system-wide iron filtration system in place in Eastwood Manor by early next year. The company acquired Eastwood Manor’s water system, which had been plagued by water quality issues for decades, in 2016.
But Tesmer remains skeptical the utility will keep to its timeline.
“I won’t believe anything until I see a proposal at the county level that they’re ready to do the work,” Tesmer said.
Service interruptions and high costs were also common concerns among residents of Lake County who registered public comment.
Last year, Hawthorn Woods and Kildeer experienced a multi-day service interruption, leaving hundreds of households without water. Parts of Lake County, including Hawthorn Woods, earlier this month were put under a boil advisory after a water main break.
“In 31 years of living in Buffalo Grove, I only had one boil order,” Susan Bauer, who moved to Hawthorn Woods four years ago, said during a public comment. “Furthermore, my bills were nothing compared to what I’m paying now. My friends who still live in Buffalo Grove, they pay half of what I pay.”
These situations have, according to Aqua, been resolved and all of its water systems are testing below regulatory limits for other hazardous materials.
But every water utility – public and private – is facing aging infrastructure that will need to be replaced or upgraded in the coming years. The federal EPA in a 2023 report found that Illinois needs more than $22 billion in infrastructure spending over the next two decades, an increase of about 6 percent since its last assessment of infrastructure needs that was released in 2018.
While some infrastructure improvements can be handled with government funding, for Aqua and other private companies, much of it will have to come from customers.
“We are on kind of a collision course, truly, with rates and infrastructure,” Carter said Thursday.

Hurricane Debby makes landfall in Florida as Category 1 storm and threatens catastrophic flooding

TAMPA, Fla. (AP) — Hurricane Debby reached the Big Bend coast of Florida early Monday, bringing with it the potential for catastrophic flooding and life-threatening storm surge as it slowly passes over the northern part of the state. Forecasters warned that, in the coming days, record-setting rain could pummel coastal Georgia and South Carolina as the storm heads east.
The storm made landfall as a Category 1 storm near Steinhatchee, a tiny community in northern Florida of less than 1,000 residents on Florida’s Gulf Coast. It had maximum sustained winds of 75 mph (120 kph) and was moving north-northeast at 10 mph (17 kph), the National Hurricane Center in Miami said. The storm came ashore in one of the least populated areas of Florida, but forecasters warned heavy rain could spawn catastrophic flooding in Florida, South Carolina and Georgia.
Looking out over the Steinhatchee River from the condo above the marina he operates, Chris Williams said he was feeling blessed that the damage wasn’t worse. Williams said his power went out at about 5:30 a.m. Monday as the storm was washing ashore, jamming the dock-studded riverfront with tree debris and barrels.
The small community where Hurricane Debby made landfall is roughly 20 miles (32 kilometers) from where Hurricane Idalia crashed ashore less than a year ago.
“Two in less than a year is pretty bad,” Williams said. “You do everything you can possibly do to prepare. And when you’ve done that, clean up and put it back together and move forward.”
Forecasters said storm surge was expected to be the biggest threat for Florida, with 6 to 10 feet (1.8 to 3 meters) of inundation above ground level predicted in part of the zone near the Big Bend.
“That part of the coast is a very vulnerable spot,” John Cangialosi, a hurricane specialist with the National Hurricane Center, said Monday. Some areas, including Sarasota and Manatee counties, have already received 10 to 12 inches (25 to 30 centimeters) of rain.
In Georgia, the National Weather Service is predicting major flooding
on some rivers: the Canoochee River near Claxton, the Ohoopee River near Reidsville and the Ogeechee River near Eden. All those rivers were below flood stage Monday but could see their water levels more than double by later in the week.
Nearly about 300,000 customers were without power in Florida and Georgia on Monday, according to PowerOutage.com.
Florida Gov. Ron DeSantis said some 17,000 linemen are working to restore electricity. He warned residents in affected areas to sit tight until conditions are safe.
“When the water rises, when you have streets that can be flooded, that’s hazardous,” DeSantis said. “Don’t try to drive through this. We don’t want to see traffic fatalities adding up. Don’t tempt fate, don’t try to go through these flooded streets.”
A truck driver was killed early Monday after he lost control of his tractor trailer along a wet Interstate 75 in the Tampa area. In Union County, some roads were already under water and numerous trees and power lines were down. The Union County Sheriff’s Office said Monday that residents were cleaning up from a tornado that touched down in the county Sunday night, damaging at least one home. No injuries were reported.
Hurricane Debby has followed a track “very similar to Idalia 11 months ago,” DeSantis said. Hurricane Idalia came ashore near Keaton Beach, Florida on Aug. 30, 2023, with maximum sustained winds of 125 mph. Keaton Beach is about 20 miles north of Steinhatchee. He noted there were fewer power outages with Debby.
Images posted on social media by Cedar Key Fire Rescue early Monday showed floodwaters rising along the streets of the city, located south of where the storm made landfall. Water was “coming in at a pretty heavy pace,” the post said.
Debby was expected to move eastward over northern Florida and then stall over the coastal regions of Georgia and South Carolina, thrashing the region with potential record-setting rains totaling up to 30 inches (76 centimeters) beginning Tuesday through Saturday morning. Flooding is expected to be especially severe in low-lying areas near the coast, including Savannah, Georgia;
Hilton Head Island, South Carolina; and Charleston, South Carolina. Georgia Gov. Brian Kemp has called up 2,000 members of the Georgia National Guard.
Officials in Savannah said the area could see a month’s worth of rain in four days if the system stalls over the region.
Debby is the latest storm to wrack the Carolinas
North Carolina and South Carolina have dealt with three catastrophic floods from tropical systems in the past nine years, all causing more than $1 billion in damage.
In 2015, flooding rains fed by moisture as Hurricane Joaquin passed well offshore caused massive flooding that nearly knocked Columbia’s water system offline.
In 2016, flooding from Hurricane Matthew caused 24 deaths in the two states and rivers set record crests that would be broken in 2018 when Hurricane Florence set rainfall records in both Carolinas, flooded many of the same places and was responsible for 42 deaths in North Carolina and nine in South Carolina.
Residents hunker down as storm passes through
“Right now, we are to trying secure everything from floating away,” said Sheryl Horne, whose family owns the Shell Island Fish Camp along the Wakulla River in St. Marks, Florida, where some customers moved their boats inland.
The sparsely populated Big Bend region in the Florida Panhandle also was hit last year by Hurricane Idalia, which made landfall as a Category 3 hurricane.
“I am used to storms and I’m used to cleaning up after storms,” Horne said. Even though the Putnam Lodge in Cross City, Florida, was at the edge of the storm’s eyewall, the almost 100-year-old lodge still had power and appeared to have only a few downed trees Monday morning, said Ed Pivacek, owner of the “Old Florida” property.
The lodge was full of residents who had fled coastal areas and TV news crews capturing the storm.
“The rains have ceded, the grounds are flooded, and we lost a couple of oak trees, but we still have our power,” Pivacek said. “Things seem to be OK here, as long as we keep our power.”
Voices across the globe express concern over increasing arrests in Venezuela after disputed election

CARACAS, Venezuela (AP) — Voices across the globe expressed concern Sunday over the growing number of arrests in Venezuela following last weekend’s disputed elections.
Pope Francis said Venezuela is “living a critical situation” in his traditional Sunday remarks at the Vatican, adding, “I appeal to all parties to seek the truth, to avoid all kinds of violence.”
The remarks came hours after Venezuelan President Nicolás Maduro announced Saturday that the government has arrested 2,000 opponents. At a rally in the Venezuelan capital Caracas, Maduro pledged to detain more people and send them to prison.
U.S. Deputy National Security Adviser Jon Finer told CBS program “Face the Nation” Sunday that the Biden administration is worried the arrests could spark wider unrest.
“We are concerned about the prospect of instability, should there continue to be these detentions,” Finer said.
And in a statement, the leaders of several European countries including France, Spain, Germany and Italy said “the rights of all the Venezuelans, especially the political leaders, should be respected during this process. We strongly condemn any arrests or threats against them.”
Authorities have declared President Nicolás Maduro the victor in last Sunday’s election but have yet to produce voting tallies to prove he won. The opposition claims to have tally sheets showing it won.
An Associated Press analysis Friday of vote tally sheets released by the opposition coalition indicates that their candidate, Edmundo González, won significantly more votes than the government claimed, casting serious doubt on the official declaration that Maduro won.
Both González, a former diplomat, and opposition leader María Corina Machado — who was barred by the government from running — have gone into hiding, saying they fear they will be arrested or killed. Maduro and his cadres have threatened to lock them both up.
The government arrested hundreds of opposition supporters who took to the streets in the days after the disputed poll.
Machado braved the threats to speak at a massive opposition rally Saturday
in Caracas, but was whisked away afterwards on the back of a motorcycle.
“After six days of brutal repression, they thought they were going to silence us, intimidate or paralyze us,” Machado told the rally. “The presence of every one of you here today represents the best of Venezuela.”
A few hours later, Maduro again threatened to arrest González for not showing up at the electoral council meeting he had been summoned to. The council, like most parts of Venezuela’s government, is completely controlled by Maduro.
“You face serious legal consequences for disobeying the Constitution, the courts and the law,” Maduro said of González.
Maduro also vowed to continue to use a heavy hand against his opponents, saying 2,000 of them have been arrested already.
“This time there will be no pardon, this time there will be Tocorón,” he said, referring to a notorious prison.
On Friday, masked assailants ransacked the opposition’s headquarters on Friday, taking documents and vandalizing the space.
In his long, rambling speech, Maduro issued threats but also called for reconciliation and peace, claiming, “There is room in Venezuela for everyone,” and calling it “the blessed land of opportunity.”
Venezuela sits atop the world’s largest proven crude oil reserves and once boasted Latin America’s most advanced economy, but it entered into a free fall marked by 130,000% hyperinflation and widespread shortages after Maduro took the helm in 2013. More than 7.7 million Venezuelans have fled the country since 2014, the largest exodus in Latin America’s recent history.
U.S. oil sanctions have only deepened the misery, and the Biden administration — which had been easing those restrictions — is now likely to ramp them up again unless Maduro agrees to some sort of transition.
Late Friday, Venezuela’s high court, the Supreme Justice Tribunal, ordered the Maduro-controlled National Electoral Council to hand over the precinct vote count sheets in three days. There have been calls from multiple governments, including Maduro’s close regional allies, for Venezuela’s electoral authorities to release the precinct-level tallies, as it
has after previous elections.
The AP processed almost 24,000 images of tally sheets, representing the results from 79% of voting machines.
According to the calculations, the González received 6.89 million votes, nearly half a million more than the government says Maduro won. The tabulations also show Maduro received 3.13 million votes from the tally sheets released.
By comparison, the National Electoral Council said Friday that based on 96.87% of tally sheets, Maduro had
won 6.4 million votes and Gonzalez had 5.3 million. National Electoral Council President Elvis Amoroso attributed the delay in filing complete results to attacks on the “technological infrastructure.” There has been a flurry of diplomatic efforts by Brazil, Colombia and Mexico to convince Maduro to allow an impartial audit of the vote. On Thursday, the governments of the three countries issued a joint statement calling on Venezuela’s electoral authorities “to move forward expeditiously and publicly release” detailed voting data.

Dealing with Japanese Beetles
Last week, I was talking with an apple grower and one of their first questions was about Japanese beetle control due to having them covering one of their varieties. While I’ve seen some small populations on my blackberries, you may be dealing with a larger population like this apple grower. Feeding on over 300 different species of plants with their favorite plants being Japanese maple, roses, grapes, cherries, and others, this insect may become a bigger problem for you this month in the garden.

area is the problem. In fact, the presence of a small number will eventually lead to a large number of Japanese Beetles overtime. When a beetle feeds on a plant, it is leaving behind a feeding pheromone that is attractive to other Japanese Beetles to join. This may mean that some plants are more targeted than others. Feeding usually occurs at the top of the plant as the beetles work their way down. Their damage gives the leaves of a plant a lacelike appearance.
If you are dealing with a smaller population this year, it’s typically correlated with fall weather. In the fall, the Japanese Beetles will lay eggs that overwinter and hatch next year. They need a certain

Recently, Constellation requested that its land holdings in Ogle County surrounding the Byron Nuclear Power plants be rezoned from agriculture to industrial. While in the early stages of the approval process very little information was released as to what the firm has in mind for an industrial project. The uncertainties about the purpose of the rezoning has left the public guessing about what projects the firm has in mind for the land. The firm owns hydro, wind and solar generating facilities and could chose to expand the renewable capacity on the site.
Some ideas expressed by local people include using the steam from the plant for corn ethanol, diesel, hydrogen production, or building additional nuclear power stations on the land. Those pushing for the zoning change will eventually reveal their plans for the site.
Concern was expressed over losing more agricultural land to expand industrial projects was not in the long term public interest. Other concerns about converting agricultural land include creating new housing developments and more recently installing solar farms on
agricultural lands. Such projects are often advocated in terms of their economic benefits and jobs for the community. Their adverse effects are raised as reasons for not approving such projects.
From a societal perspective seeking change is usually driven by those who benefit economically from such projects; those who see their interests violated from the proposed change object to them The Reagan administration’s declaration decades ago that greed is good appears to have opened the floodgates of appeals to economic growth as the end goal of society.
Others embracing long term values other than economic growth and profits point to the overall environmental deterioration including climate change and the social consequences of the massive increase in wealth that has been concentrated in fewer hands in recent years. While those concerns remain unresolved they continue to intensify and contribute to social tensions within society.
From an energy perspective the search for viable alternatives to the dwindling availability of fossil fuels, particularly oil and natural gas remain unresolved. Advocates of oil and gas compete with
amount of water to do this. If the beetles do not get this, then it may mean less of a population the next year. So what can you do? If it’s annual vegetables with low insect damage, you may be able to shake them off foliage in the morning into a bucket of soapy water. This will drown them and should begin to reduce their population. You might also combine this with row cover/cheesecloth/ fine netted material that could keep Japanese Beetles from the crops. I have found success with this on my dwarf peach tree. Keep in mind that a netted material will keep out pollinators too which you may need for your vegetables. We usually do not recommend Japanese
Beetle traps. These traps attract Japanese Beetles from your yard and many other yards nearby. As Japanese Beetles are great flyers, any plants near the trap will most likely sustain damage. You will find the traps need to be emptied regularly too. There are some insecticides that are labeled for Japanese Beetles. These include products like Neem Oil which can provide a 3-4 day deterrence. Read the label and follow directions for any insecticides as some may have negative effects on your pollinators you need for your vegetables. Soil treatments are sometimes used for Japanese Beetle grubs.

Nuclear advocates and critics of nuclear power remain in a war of words over the wisdom or folly of increasing the use of nuclear generated electricity. There is little new information in the debates.
In the UK, the author of The Consciousness of Sheep points to the recent costly and behind schedule effort in building their latest nuclear plant. He contrasted the UK debacle in building its newest nuclear power plant as being 10 billion pounds over budget and unlikely to generate any useful electricity before 2030. In contrast, in China new nuclear plants are built in less time than the global average of six years.
Similar delays and increasing costs have been characteristic of new nukes being built in the United States. M.V. Ramana and Jixiang Wang recently published an article in Counterpunch calling attention to the work of Rafael Grossi, Director General of the International Atomic Energy Agency. He has repeatedly warned of the major risk of a severe nuclear accident if the Zaporizhzhia plant in the Ukraine is struck by a missile. While acknowledging the risks of accidents or military strikes, he has repeatedly called
for building more nuclear reactors. The world’s electrical production from nuclear power has declined over the past 25 years from 17.5 % in 1996 down to 9.2% in 2022. Beyond safety concerns, other issues include that the projects are costly and seldom meet their projected construction timeline. Nearly 90% of all reactors connected to the grid over the years 2020 and 2022 failed to meet their projected completion times. China had the only two plants completed on time. Globally some 92 nuclear projects have been cancelled or suspended and usually involve substantially monetary losses. Even the small modular reactor from NuScale has been cancelled.
Criticisms of nuclear power do not mean that efforts to increase its role in supplying electricity are over but substantial challenges in continuing to pursue efforts to expand its use remain. With the effort to increased use of electricity in the economy, how to meet the demand remains in dispute. But it is clear that energy has been a key factor in developing the modern economy and while it has multiple benefits it also has adverse environmental impacts that need to be addressed.

The twisted story of the murder of George Mack

Mornings started early on the Mack farm, even Sunday mornings. On Sunday, July 14, 1878, Joseph Watsic who was employed by George Mack as a farm hand struggled to get out of bed. He probably thought this morning would be like so many Sundays before. Joseph had no idea how different this day would be.
One of the other hands on the farm, Frank Dickerson, woke Joseph up that day to go to the barn and feed the livestock. Joseph entered the barn still groggy from sleep. But as Joseph’s eyes adjusted to the gloom of the barn, he saw a sight which caused him to shriek and run for the house.
There in one of the stalls lay his employer, George Mack. His body was horribly mutilated in what looked like a horse trampling. But things were not as they seemed that July morning.
Joseph’s shouts alerted Dickerson and both men went back to the barn. They carried George toward the house. George’s wife, Belinda, saw them coming and opened the door. One look at George’s mangled body made it clear that he was already beyond help.
Soon the news of George’s death spread and at first, folks accepted the story that “Old Jen” , one of the family’s work horses, had caused George’s death. But in the hours and days that followed, their opinions would change.
George Mack lived on his family farm near the town of Turtle Township. He lived with his wife, Belinda and three children and the two men who worked the farm, Frank and Joseph. They had a comfortable two-story house and were doing well. George was respected by his community, and it was said he was a good neighbor.
Authorities were called and they soon showed up at the Mack farm. They immediately began the process of determining how George died. Right away there were things that pointed to a story different than was first presented. Just opposite the stable was a muddy patch (called a hog wallow in the papers of the day) that looked like a struggle had taken place there.
George’s body also carried evidence that more than a horse trampling had taken place. His chest was caved in, his face was scratched and “pounded to jelly” according to the newspaper accounts. There was also a gash on the top of his head that seemed to be made with a sharp instrument. He had sustained a shattered
shoulder and broken ribs. George’s hands and clothing were also smeared with mud that wouldn’t have come from the dry barn where Old Jen was kept.
This evidence aroused the suspicions of the coroner as he completed his examination. At the same time the coroner was coming to his conclusion that this was no accident, the other authorities were finding evidence of their own. The terrible news of George’s death had spread, and the townsfolk had begun to gather at the farm. They had also begun to talk.
They told stories of the fights that the couple had over Belinda’s friendliness toward the hired men, especially Frank Dickerson. George had grown so jealous of the time his wife spent with Dickerson that he finally fired the handyman in May. But then George had taken ill, and Belinda had hired Dickerson again to help with the planting. George tried to protest but Belinda ignored him.
It was customary during this time period to hold an inquest right at the scene of any death. It allowed authorities and the coroner to question people while the story was still fresh in their minds.
During the inquest into the farmer’s death, stories of the fights and jealousy between Dickerson and George were revealed. The inquest ended with a determination that George’s death was caused by blows by someone unknown. Authorities quickly took it a step further and decided that they had enough evidence to arrest Frank Dickerson for the murder of George Mack.
Frank Dickerson made a full confession to what had really happened to George on the night of July 13. The authorities had lots of evidence to prove their theory that Dickerson had done the killing. But Dickerson had his own story. According to Frank, he only helped move the body under the hooves of Old Jen. In Frank’s version, it was Belinda who had done the actual killing. He also shared that it was Belinda who had backed up Old Jen and walked the horse over George’s body several times to make it look like the horse had caused the farmer’s death.
After the funeral, Belinda went to stay with friends that lived in Beloit. And it was there that the police arrested her. Once the story broke and the townsfolk of Turtle Township and Beloit had their suspicions confirmed to the actual relationship between Belinda and Dickerson, they were outraged. The police ordered extra guards to protect the two people whose actions had caused George’s death.
As one can imagine, the interest in
this story was immense. So many people showed up to the trial that the maximum limit was quickly reached. Many attendees were left standing in the halls and on the lawn of the courthouse. The papers described the courtroom as “crowded to the point of suffocation.”
Frank Dickerson’s testimony was one of the high points of the trial. He shared all the horrid details of the last hours of George’s life. Dickerson was in his room when he heard Belinda call his name. When Dickerson came down the stairs he saw Belinda strike George over the head with a club from the firewood box. Dickerson stated he headed for the door. According to Dickerson he was going to get help for George. That was Belinda when said that she would tell everyone that it was Dickerson who had struck the farmer with the club.
Belinda then told Dickerson that they needed to make it look like an accident. They carried George’s body to the barn. They laid him in the hog wallow while they chased the pigs out of the yard. Then they opened the barn and placed George’s body in Old Jen’s stall and Belinda backed the horse over the body several times. After the deed was finished, Belinda demanded that Frank get rid of their bloody clothes. He put them down in the privy. The police later recovered the bloody items.
Belinda’s defense had a lot of evidence to overcome. But of course, the main thing was Dickerson’s testimony. They painted him as a jilted lover who had tried to get Belinda to have an affair but that she had rejected his affections. He promised he would get even. Dickerson’s attempt to frame Belinda by murdering her husband and placing the blame on her was merely an act of revenge.
But it seems the jury didn’t believe the defense and on January 10, 1879, they returned with a verdict of guilty. Belinda was sentenced to “hard labor in the State Prison of Wisconsin, for the term of her natural life, and that on the 13th day of each July during such term her imprisonment should be solitary.”
Dickerson went on trial next. It lasted ten days and the outcome was exactly the same. But another twist in this story was about to occur.
Belinda appealed her conviction. The Wisconsin Supreme Court agreed with her claims that she should be granted a new trial because she was not allowed to share her side of the story. She was granted a new trial.
Belinda’s second trial ended with the
jury being unable to agree on a verdict. Six jury members had voted for acquittal, two members had voted for murder and the rest, voted for manslaughter. The judge ordered a new trial. But it seemed that Wisconsin was done with this case. Belinda Mack never had a third trial.
When looking back at the two trials, there was one difference that stood out clearly. In Belinda’s first trial both men that were working for the family testified against her. The younger boy, Joseph, was only seventeen at the time of the murder. He testified about the Mack couple’s fights and that Dickerson and Belinda seemed to have a “close” relationship.
But Joseph never testified during the second trial. In the time between the first and second trial Belinda had married Joseph, even though he was almost half her age. Neighbors spoke of how smart Belinda was to marry young Joseph, the only other person that was at the farm when George was murdered. According to Wisconsin state law, spouses cannot be compelled to testify against their partners.
Belinda and Frank, who had such a passionate love affair, never saw each other again. Frank was released from prison in 1890 but didn’t bother to search for Belinda. It was just as well. If he had, he would have found the widow now living in Minnesota. She was still married to the young man who had discovered George’s body.
Another incident only deepened the mystery of George’s death. George was buried at Oakwood Cemetery in Beloit. A short time after his funeral, one of the caretakers noticed that George’s stone had been vandalized. The caretaker questioned neighbors about visitors to George’s grave. The neighbors mentioned that a young lady visited the grave, but no one knew her identity. The motive for the vandalism was never determined. But when folks found out that the word “Murdered” had been removed from George’s stone it definitely added another layer of mystery to this already twisted story.
