Court weighing school COVID mitigations Lawsuit seeks to block mask mandates, exclusion rules By Peter Hancock

SPRINGFIELD – A Sangamon County judge is considering a motion to block Illinois schools from requiring people to wear face masks in classes and excluding students and staff from school buildings if they’ve had close contact with someone who has tested positive for COVID-19. Circuit Judge Raylene Grischow heard oral arguments last week in a class action lawsuit against 145 school districts that was filed last year by Greenville attorney Thomas DeVore, who has unsuccessfully challenged the state’s COVID-19 mitigation measures in several other lawsuits. In September, DeVore filed a motion for a temporary restraining order to permit students to continue in-person learning in school. Attorney General Kwame Raoul’s office is defending the districts and the Illinois Education Association, along with the Illinois Federation of Teachers, has entered the case as intervenors on behalf of the teachers they represent. The cases were originally filed individually in several Illinois counties but were later consolidated into Sangamon County Circuit Court. At issue is whether school districts are violating state law by implementing

orders from Gov. JB Pritzker and guidelines from the Illinois Department of Public Health and Illinois State Board of Education to impose certain mitigation measures in order to hold in-person instruction. Those measures include requirements that all students, staff and visitors wear face coverings in school buildings, that students and staff be excluded from buildings if they test positive for COVID19 or have been in close contact with someone else who has, and that school personnel be vaccinated or submit to weekly testing. In the suit, DeVore argues that exclusions amount to a kind of “quarantine” and that under the Department of Public Health Act, schools cannot exclude students for public health concerns without their parents’ consent or a quarantine order from a public health department. He also argues that schools have no legal authority to require vaccinations or the wearing of masks unless a public health department has issued a quarantine order. “The plaintiffs have a right to insist the students not be excluded from school, and denied their right to an in-person education, except as provided by law,” the lawsuit states. “Quite simply, the defendants are infringing upon the lawful right of the students, and of their parents or guardians, to be free to choose for themselves

whether mask wearing as a treatment, or type of modified quarantine, for the purpose of limiting the spread of an infectious disease, is, absent a court order, appropriate,” the lawsuit states DeVore has been the attorney in numerous lawsuits representing businesses and individuals challenging Pritzker’s executive orders during the pandemic. In one, he represented state Sen. Darren Bailey, R-Xenia, a Republican candidate for governor. Judge Grischow, however, threw out that case in December 2020, finding that the governor has the authority to issue multiple, successive disaster proclamations stemming from one ongoing disaster. In a motion to dismiss the case, the Illinois Education Association argued that masking and exclusions are not “quarantines” and therefore are not preempted by the Public Health Act. It also argues that the joint guidance issued by IDPH and ISBE gives school districts lawful authority to impose mask and exclusion mandates. In a separate filing, the Illinois Federation of Teachers argued that the public health interest involved in preventing the spread of COVID-19 outweighs any individual right of the students and parents who are challenging the mandates. “Those parents, students, teachers and staff who are not before the court have a compelling interest in the enforcement of mitigation measures that reflect the best judgments of policymakers facing rapidly changing circumstances,” attorneys for the IFT wrote. The case against the school districts has generated significant public interest. During a hearing on Jan. 5, Grischow noted in a journal entry, “the court and the court’s receptionist began receiving emails from outside sources setting forth their position on the issues being argued in the case.” “The court did not review the emails and turned them over to the U.S. Marshals office to review for security reasons,” Grischow wrote. “The emails will not be kept or reviewed by the court. SPRINGFIELD – Gov. JB Pritzker on Monday vetoed a bill that would have provided paid administrative leave for public school and university employees who miss work due to COVID-19-related issues and instead negotiated “compromise” legislation that would provide such leave to only those who are fully vaccinated. “Vaccines are a vital tool in preventing the deadly effects of COVID-19, and those who take the steps to be fully vaccinated against this virus are doing their part to keep everyone safe,” Pritzker said in his veto message. “They deserve to be able to take the time they need to respond to the ongoing devastating impacts the COVID-19 pandemic continues to have on them and their families.” House Bill 2778 passed the General Assembly during the fall veto session with wide bipartisan majorities, 53-1 in the Senate and 92-23 in the House. It would have provided paid leave for any employee, including support staff and contractors, who missed work because they or someone in their household contracted COVID-19, if they or a family member was forced to stay home because they’d been in close contact with someone who had tested positive, or if they could not work because the school building was closed due to COVID-19. To be eligible, however, the bill provided that the employee must either have been vaccinated or participated in the COVID-19 testing program provided by the district. In September, Pritzker issued an executive order requiring school personnel to be vaccinated or undergo weekly testing. But his veto action Monday means that those who choose not to be vaccinated will not be eligible for paid administrative leave. Since that bill passed, however, Pritzker said he has been negotiating with teachers unions and other groups to negotiate a different package with a stronger vaccine requirement. “Numerous organizations are impacted

by this legislation, and my administration has listened closely to all of them, including lawmakers and our partners at the Illinois Education Association and the Illinois Federation of Teachers, parents, school districts, community colleges and universities,” he said in his veto message. “Through a collaborative, cooperative process, we have negotiated an initiative that will provide paid administrative leave for teachers who, despite doing all they can to keep themselves and their communities safe, continue to have their lives and livelihoods disrupted by COVID-19.” Under that initiative, which still needs legislative approval, public school and university employees would receive paid administrative leave if they are fully vaccinated and they or their child is required to be excluded from school because of a positive COVID-19 test or have been in close contact with someone who has a confirmed case of COVID-19. It also maintains the wage protections in HB2778 for all hourly school employees – including custodians, bus drivers, food service workers, classroom assistants and administrative staff – who miss work because the school building they’re assigned to is closed due to a COVID-19 outbreak. That protection would be retroactive for the entire 2021-2022 academic year. “Keeping schools open and those inside them – and their families – safe has been our number one priority from the start of the pandemic,” IEA President Kathi Griffin said in a news release. “We want people to stay home when they’re sick, to be able to care for their children when their children need them the most, and to be paid when the circumstances that close their buildings are completely beyond their control.” “The pandemic has been physically, emotionally, and economically challenging for us all, and certainly no less so for educators, school staff, and their families,” said IFT President Dan Montgomery. “This legislation provides important relief and ensures that education personnel can afford to take time off if they or they families become ill with COVID.”

What are US options for sanctions against Putin? By Ellen Knickmeyer Associated Press

WASHINGTON (AP) — The financial options being considered to punish President Vladimir Putin if Russia invades Ukraine range from the sweeping to the acutely personal — from cutting Russia off from U.S. dollars and international banking to slapping sanctions on a former Olympic gymnast reported to be Putin’s girlfriend. Publicly, the United States and European allies have promised to hit Russia financially like never before if Putin does roll his military into Ukraine. Leaders have given few hard details to the public, however, arguing it’s best to keep Putin guessing. And weeks into the negotiations, it’s far from clear that Americans have succeeded in achieving U.S. and European consensus on what sanctions will be imposed and what would trigger them. A look at some of the financial actions under consideration:

SWIFT RETALIATION

For the U.S. and its European allies, cutting Russia out of the SWIFT financial system, which shuffles money from bank to bank around the globe, would be one of the toughest financial steps they could take, damaging Russia’s economy immediately and in the long term. The move could cut Russia off from most international financial transactions, including international profits from oil and gas production, which in all accounts for more than 40% of the country’s revenue. Allies on both sides of the Atlantic also considered the SWIFT option in 2014, when Russia invaded and annexed Ukraine’s Crimea and backed separatist forces in eastern Ukraine. Russia declared then that kicking it out of SWIFT would be equivalent to a declaration of war. The allies — criticized ever after for responding too weakly to Russia’s 2014 aggression — shelved the idea. Russia since then has tried to develop its own financial transfer system, with limited success. The U.S. has succeeded before in persuading the SWIFT system to kick out a country — Iran, over its nuclear program. But kicking Russia out of SWIFT would also hurt other economies, including those of the U.S. and key ally Germany. U.S. lawmakers said last week the Biden administration is still analyzing how bad that impact would be. Annalena Baerbock, the foreign minister for Germany, asked by reporters about the proposed Russian SWIFT ban, seemed to express doubts. “The toughest stick won’t always ulti-

mately be the most intelligent sword,” Baerbock said.

DOLLAR CLEARING

The United States already holds one of the most powerful financial weapons to wield against Putin if he invades Ukraine — blocking Russia from access to the U.S. dollar. Dollars still dominate in financial transactions around the world, with trillions of dollars in play daily. Transactions in U.S. dollars ultimately are cleared through the Federal Reserve or through U.S. financial institutions. Crucially for Putin, that means foreign banks have to be able to access the U.S. financial system to settle dollar transactions. The ability to block that access gives the United States the ability to inflict financial pain well beyond its borders. Previously, the U.S. has suspended financial institutions from dollar clearing for allegedly violating sanctions against Iran, Sudan and other countries. Biden indicated to reporters that cutting off Russia’s and Russians’ ability to deal in dollars was one of the options the U.S. was studying. Unlike the SWIFT option and the other financial measures, it’s one the U.S. could do on its own. Many Russians and Russian companies would be stymied in carrying out even the most routine transactions, like making payroll or buying things, because they would have no access to the U.S. banking system.

EXPORT CONTROLS

White House press secretary Jen Psaki has confirmed that the U.S. is considering imposing export controls — potentially cutting off Russia from the high tech that helps warplanes and passenger jets fly and makes smartphones smart, along with the other software and advanced electronic gear that make the modern world run. That could include adding Russia to the most restrictive group of countries for export control purposes, together with Cuba, Iran, North Korea and Syria, officials said. That would mean that Russia’s ability to obtain integrated circuits, and products containing integrated circuits, would be severely restricted, because of the global dominance of U.S. software, technology and equipment. The impact could extend to aircraft avionics, machine tools, smartphones, game consoles, tablets and televisions. Such sanctions could also target critical Russian industry, including its defense

and civil aviation sectors, which would hit Russia’s high-tech ambitions, whether in artificial intelligence or quantum computing. Like some of the other penalties under consideration, U.S. export restrictions would risk motivating businesses to look for alternatives in other countries, including China.

BOND MARKETS

The Biden administration limited Russia’s ability to borrow money by banning U.S. financial institutions from buying Russian government bonds directly from state institutions last year. But the sanctions didn’t target the secondary market, leaving this as a possible next step.

NORD STREAM 2 NATURAL GAS PIPELINE

Republicans and Democrats in the Congress fought Russia’s new Nord Stream 2 natural gas pipeline to Germany for years, arguing it would help Russia use its control of the gas supply as leverage to achieve its policy aims in Europe. Rival bills in Congress would sanction the pipeline’s operators — Republicans want to impose the sanctions right away, but Democrats only if Russia invades Ukraine. The Biden administration previously has held off from that level of sanctions, to avoid getting crossways with ally Germany. German officials say blocking operation of the pipeline if Russia moves in to Ukraine would be “on the table” if there’s an invasion — but that’s as far as they’ve gone publicly.

GOING AFTER THE OLIGARCHS ... AND A REPORTED GIRLFRIEND

One of the most-used sanctions tactics by the U.S. is sanctioning the immediate circles of leaders, their families, and military and civilian circles. Putin and his friends and family could face that as well, along with Russia’s powerful business oligarchs, and its banks. Sweeping legislation by Indiana Republican Rep. Jim Banks, co-sponsored by nearly 40 other House Republicans, would pile on sanctions even before any further Russian invasion of Ukraine, from the SWIFT cutoff to the Nord Stream penalties. They also would urge consideration of targeting many in Russia’s upper echelon with sanctions. That includes Putin’s family and a woman reported to be Putin’s romantic interest, Alina Kabaeva, who won Olympic gold in 2004 in rhythmic gymnastics.

Ukraine leaders urge calm, saying invasion is not imminent By Yuras Karmanau Associated Press

KYIV, Ukraine (AP) — Ukraine’s leaders sought Tuesday to reassure the nation that an invasion from neighboring Russia was not imminent, even as they acknowledged the threat is real and received a shipment of U.S. military equipment to shore up their defenses. Moscow has denied it is planning an assault, but it has massed an estimated 100,000 troops near Ukraine in recent weeks and is holding military drills at multiple locations in Russia. That has led the United States and its NATO allies to rush to prepare for a possible war. Several rounds of high stakes diplomacy have failed to yield any breakthroughs, and tensions escalated further this week. NATO said it was bolstering its deterrence in the Baltic Sea region, and the U.S. ordered 8,500 troops on higher alert for potential deployment to Europe as part of an alliance “response force” if necessary. British Prime Minister Boris Johnson also said he is prepared to send troops to protect NATO allies in Europe. The U.S. and its allies have vowed to hit Russia with sanctions like never before if Moscow sends its military into Ukraine but they have provided few details, saying it’s best to keep President Vladimir Putin guessing. The U.S. State Department has ordered the families of all American personnel at the U.S. Embassy in Kyiv to leave the country, and it said that nonessential embassy staff could leave. Britain said it, too, was withdrawing some diplomats and dependents from its embassy, and families of Canadian diplomatic staff also have been told to leave. In Ukraine, however, authorities have sought to project calm in order not to desta-

bilize the situation and avoid panic — and many citizens have expressed skepticism that there will be an invasion soon. In parliament, Defense Minister Oleksii Reznikov said that “as of today, there are no grounds to believe” that Russia is preparing to invade imminently, noting that its troops have not formed what he called a battle group that could force its way through the border. “Don’t worry, sleep well,” he said. “No need to have your bags packed.” Reznikov’s remarks follow multiple reassurances from President Volodymyr Zelenskyy and other officials. On Monday, Zelenskyy told the nation that the situation was “under control.” In an interview aired late Monday, however, the defense minister acknowledged that “there are risky scenarios” that “are possible and probable in the future.” Russia has said Western accusations it is planning an attack are merely a cover for NATO’s own planned provocations. Kremlin spokesman Dmitry Peskov on Tuesday once again accused the U.S. of “fomenting tensions” around Ukraine, a former Soviet state that has been locked in a conflict with Russia for almost eight years. In 2014, following the ouster of a Kremlinfriendly president in Kyiv, Moscow annexed Ukraine’s Crimean Peninsula and threw its weight behind a separatist insurgency in the country’s industrial heartland in the east. The fighting between Ukrainian forces and Russia-backed rebels has killed over 14,000 people, and efforts to reach a peaceful settlement have stalled. In the latest standoff, Russia wants guarantees from the West that NATO will never admit Ukraine as a member and that the alliance would curtail other actions, such as stationing troops in former Soviet bloc countries. Some of these, like the membership

pledge, are nonstarters for NATO, creating a seemingly intractable stalemate that many fear can only end in a war. Moscow has accused Ukraine of massing troops near rebel-controlled regions in the east, aiming to retake them by force — accusations Kyiv has rejected. Analysts say Ukraine’s leaders are caught between trying to calm the nation and ensuring it gets sufficient assistance from the West in case of an invasion. “Ukrainian authorities are trying to prevent destabilization and panic inside the country, hence the calming statements saying there is no threat of an imminent Russian invasion,” political analyst Volodymyr Fesenko said. “The Kremlin’s plans include undermining the situation inside Ukraine, fomenting hysteria and fear among Ukrainians, and the authorities in Kyiv find it increasingly difficult to contain this snowball,” he added. A Kyiv International Institute of Sociology poll found about 48% of Ukrainians believe an invasion in the coming months to be a real threat. But with many aware of the possibility that recent moves could also be part of information warfare, 39% said they don’t see it happening. The nationwide poll of 1,205 people from Jan. 21-22 had a margin of error that did not exceed 3.2 percentage points. The crisis didn’t stop a large group of people from rallying in front of the parliament in Kyiv, demanding changes to the country’s tax regulations and even clashing with police at one point. Other Ukrainians watched warily. “Of course we fear Russia’s aggression and a war, which will lead to the further impoverishment of Ukrainians. But we will be forced to fight and defend ourselves,” said Dmytro Ugol, a 46-year-old construc-

tion worker in Kyiv. “I am prepared to fight, but my entire family doesn’t want it and lives in tension. Every day, the news scares us more and more.” Putting U.S.-based troops on heightened alert for Europe on Monday suggested diminishing hope in the West that Putin will back away from what U.S. President Joe Biden himself has said looks like a threat to invade Ukraine. As part of a new $200 million in security assistance directed to Ukraine from the United States, a shipment including equipment and munitions arrived Tuesday in Ukraine, according to Deputy Defense Minister Hanna Maliar. The U.S. moves are being done in tandem with actions by other NATO members to bolster a defensive presence in Eastern Europe. Denmark is sending a frigate and F-16 warplanes to Lithuania; Spain is sending four fighter jets to Bulgaria and three ships to the Black Sea to join NATO naval forces, and France stands ready to send troops to Romania. Biden’s national security team has been working with several European nations, the European Commission, and suppliers around the globe to develop contingency plans if Russia were to cut off energy supplies, according to two senior administration officials who briefed reporters about efforts to mitigate spillover effects from a potential military action. The officials spoke on the condition of anonymity to discuss the deliberations. If needed, Europe would look to natural gas supplies in North Africa, the Middle East, Asia and the United States. The effort would require “rather smaller volumes from a multitude of sources” to make up for a Russian cutoff, according to one official.

ST. PAUL, Minn. (AP) — Prosecutors played video from a police body camera Tuesday as witness testimony resumed at the federal civil rights trial of three former Minneapolis police officers accused of violating George Floyd’s civil rights as fellow Officer Derek Chauvin killed him. Former officers J. Alexander Kueng, Thomas Lane and Tou Thao are broadly charged with depriving Floyd of his civil rights while acting under government authority. Floyd died on May 25, 2020, after Chauvin knelt on his neck for 9 1/2

minutes as the 46-year-old Black man was facedown, handcuffed and gasping for air. Kueng knelt on Floyd’s back, Lane held his legs and Thao kept bystanders from intervening in the videotaped killing that triggered worldwide protests and a reexamination of racism and policing. Prosecutors told U.S. District Judge Paul Magnuson that they did not plan to play all of the video evidence in court, but want it available to the jury when they deliberate. Prosecutor Samantha Trepel, who works for the Justice Department’s civil rights division, said during opening statements Monday that the videos will show the three

officers stood by as Chauvin “slowly killed George Floyd right in front of them” and told jurors that they “will ask you to hold these men accountable.” But it was Chauvin, the senior officer at the scene, who called “all of the shots,” one defense attorney told jurors, adding that the Minneapolis Police Department did too little to train officers to intervene when a colleague should be stopped. Another officer’s attorney focused on Floyd’s struggle with police before they restrained him. And an attorney for the third officer said his client raised concerns about the restraint of Floyd, but was

rebuffed. Chauvin was convicted of murder and manslaughter last year in state court. He also pleaded guilty to a federal count of violating Floyd’s civil rights. Kueng, who is Black; Lane, who is white; and Thao, who is Hmong American, are all charged for failing to provide Floyd with medical care. Thao and Kueng face an additional count for failing to stop Chauvin, who is white. Both counts allege the officers’ actions resulted in Floyd’s death. Attorneys for both Kueng and Thao noted that prosecutors must prove the officers willfully violated Floyd’s constitutional rights — a high legal standard that essentially requires prosecutors to prove the officers knew what they were doing was wrong, but did it anyway. Tom Plunkett, Kueng’s attorney, highlighted the rookie status of his client and Lane, who were responding to a 911 call accusing Floyd of using a counterfeit $20 bill to buy a pack of cigarettes at a corner market. Thao and Chauvin responded as backup. “You’ll see and hear officer Chauvin call all of the shots,” Plunkett said. Lane’s attorney, Earl Gray, said Lane was at Floyd’s legs and could not see Chauvin’s knee on Floyd’s neck. Lane at one point suggested that they use a restraint called the hobble on Floyd, which would have meant Floyd would have been on his side “and no doubt he’d be alive today,” Gray said. But he said Chauvin said no. Lane also suggested twice that they roll Floyd over, but was rebuffed, Gray said. Gray also said Lane called an ambulance because of a cut on Floyd’s lip and later had another officer increase the urgency of the ambulance code. Gray noted that Lane got into the ambulance and helped perform chest compressions on Floyd. Thao’s attorney, Robert Paule, said Floyd’s death was a tragedy, “however, a tragedy is not a crime.” He also said a widely watched bystander video of the arrest does not show everything, including Floyd struggling with officers who were trying to put him in a police vehicle. Gray said Lane will testify, but it’s not known if Thao or Kueng will. It’s also not clear whether Chauvin will testify, though many experts who spoke to The Associated Press believe he won’t. Magnuson has said the trial could last four weeks. Lane, Kueng and Thao also face a separate state trial in June on charges they aided and abetted both murder and manslaughter.

Growing Small Fruits: Strawberry BY GRANT MCCARTY CONTRIBUTOR

One of the small fruits we receive questions about at the University of Illinois Extension each year are strawberries. These small fruits do not take up too much space in your garden, can produce in a single season, and do not require the extensive pruning and trellising like other small fruits. However, strawberry plants are not without their own issues with decisions that you make that can help you have an easier strawberry experience. The main decision you need to make is whether you’ll grow strawberries as an annual or perennial. Strawberry plants can be grown as an annual crop

in which you are planting them the end of April, harvest weekly starting the end of July for 10-12 weeks, and then remove them in October. You’d be planting new strawberry plants ever spring. The traditional way of growing strawberries is as a perennial plant where you’d overwinter your strawberry plants each year with straw, harvest for 2-3 weeks in the summer, renovate the strawberry patch, and overwinter again. In this perennial system, you would not harvest strawberries in 2022 and plants would live 3-5 years before replacing. The decision on whether you grow strawberries as annual or perennial will depend on what your goals are. If you want to try out small fruits and get yields

this season, an annual strawberry plant may be great. You though would have to commit to managing and harvesting them on a weekly basis until the end of October. You’d buy new plants every year. For a one time investment and a short harvest season, the perennial strawberry plants will be the type you want. The primary concerns on perennial strawberry plants are sometimes an inability to survive winters and disease problems. You also need to renovate the patch each summer. To grow annual strawberries, you want to grow the “Day-Neutral” type. These are specifically bred to not overwinter. All runners, the vine like growths from the strawberry plant, are removed. Annuals

work great in containers. Strawberries will produce for you only in summer of 2022. I grew Day-Neutrals last summer and was pleased with them. If you’d like to grow perennial strawberries, look for “June-Bearing”. After planting this spring, you will select four runners from your plant and remove all other runners and any flowers that develop. The goal being to develop a good root system. In the summer of 2023, this will be your first harvest and you’ll renovate the bed to overwinter the plants in the fall. In our early writings on energy, we cited James Kunstler and his description of the economic impact of dwindling energy supplies on our economy. His outlook was described in the book The Long Emergency. We heard his presentation on the topic at the Land Institute in Kansas. Seated next to us was Mark Udall, a leading national political figure at the time. We exchanged views regarding Kunstler’s presentation and Udall acknowledged that his views had merit but he felt they were too extreme. Kunstler anticipated the unfolding of a long term social crisis based on the decline in abundant low cost global oil supplies. He described the world’s oil reserves as dwindling and becoming more costly to produce on the current scale. As a result society would be forced to change dramatically. Other aspects of the crisis include climate change, water scarcity, epidemic diseases, famine, mass migrations and international terrorism. He recent perspective on likely events occurring in 2022 included comments on the current energy situation. His expected global decline in oil and gas supplies was delayed by the rapid growth in production from the U.S. shale industry; our lives continued as usual until they were disrupted by the Covid crisis. Oil produced by the shale oil industry

lacks the heavy distillates for diesel and heating oil important to society. Since the shale industry has not been profitable he thinks it will be di�cult to secure new investments needed to operate. Yields are in decline as the most productive sites have already been drilled. He expects U.S. oil production this year to drop below 9 million barrels per day as our consumption falls to 15 million barrels per day. Our need for imports leaves us vulnerable to global supply disruptions and price volatility. He doubts that renewable energy sources can power the complex industrial society now in existence. The topic of peak oil is regaining visibility. The peak in conventional oil supplies occurred in 2005 with falling production in the large, easy to find oil fields. By 2018 oil production peaked in more costly unconventional supplies. Kunstler does not expect society will run out of oil but indicates that what remains requires greater expenditures of energy and money to secure, leaving less energy to power the overall economy. Currently much of Europe, particularly England, is faced with an energy crisis. The new natural gas pipeline across the Baltic Sea from Russia has not shipped gas to Germany as their government has not agreed to accept it. If the political di�erences are resolved peacefully the needed gas could arrive shortly after. Having installed a substantial amount

of intermittent wind producing electricity, England requires costly backup supplies for natural gas generators. Importing liquified natural gas from the U.S. could provide some relief but it is costly. Shipping more liquified natural gas out of our country has contributed to rising prices here. England and much of Europe depend on natural gas to heat homes, businesses and industries. England cut funding for upgrading home insulation levels and redirected it to fund e�cient electric heat pumps to meet heating needs. If a prolonged cold spell hits during a period of little wind electricity could be distributed on a rotating basis. Similar rotation schemes were in place during and following WWII in parts of Europe. Citizens heated meals and wrapped them in blankets to finish cooking. Before electricity was widely available in our country, partially cooked foods were put in insulated hay boxes to retain heat already in the food to continue cooking. The situation in Europe warrants watching as it might illustrate how the long emergency could unfold and how governments respond to it. Kunstler noted that China has very little natural gas and oil within its borders and remains highly dependent on its dwindling coal supplies. A dispute with Australia has reduced coal imports from there. China continues to import sizable amounts of oil from other countries and remains vulner-

able to supply disruptions as it is shipped through the narrow Straits of Hormuz and Malacca. Given the complex international situation uncertainties in energy supplies and costs persist. Increased costs are adding to the economic stress the past two years from the virus lockdowns and supply disruptions. Kunstler continues to believe the long emergency will force major changes in the way we live and the structure of society. His follow-up book Living in the Long Emergency provides examples of how some people are adjusting their lives in response to the declining availability of low cost fossil fuels. Concerns over depleting energy supplies are often ignored until a crisis hits. Short term responses can get us through the initial hit. But a long emergency would require rebuilding our economy while addressing the substantial environmental damage from our reliance on fossil fuels. The push for renewable energy is cast as a response to climate change but it is also a response to dwindling energy supplies. For now we hope you can stay warm and comfortable. But climate change and dwindling energy supplies indicate we need to reduce our long term energy consumption. What are you, your friends and community doing in response to the long term emergency?

China less worried about global criticism these Olympics By Stephen Wade Associated Press

When Beijing was awarded the 2008 Summer Olympics, the International Olympic Committee predicted the Games could improve human rights, and Chinese politicians hinted at the same. Such talk is all but absent this time as the 2022 Beijing Winter Olympics open in just over a week. The Games are a reminder of both China’s rise and its disregard for civil liberties, which has prompted a diplomatic boycott led by the U.S. Rights groups have documented forced labor, mass detentions and torture, and the U.S. has called China’s internment of at least 1 million Uyghurs genocide. China has also come under criticism over the near-disappearance from public view of tennis star Peng Shuai after she accused a former senior member of the ruling Communist Party of sexually assaulting her.

But with more political, economic and military clout than it had 13 1/2 years ago, China appears to be worrying less about global scrutiny this time. And the COVID-19 pandemic has given it even more control over the Olympics, particularly with the isolation of visiting journalists, separated in a “bubble” from the Chinese population. “There’s nothing to ‘prove’ at this point; 2008 was a ‘coming out’ party and all this one does is confirm what we’ve known for the last decade,” Amanda Shuman, a China researcher at the University of Freiburg, wrote in an email to The Associated Press. “If anything, there’s a lot less pressure than 2008,” she said. “The Chinese government knows full well that its global economic upper hand allows it to do whatever it wishes.” The IOC had few options when it awarded China the Games for the second time. Six possible European candidates, led by Norway and Sweden, bowed out for political or cost reasons. Voters in two other coun-

IOC members eventually picked Beijing — an authoritarian state that doesn’t need voter approval to proceed — over Almaty, Kazakhstan, in a close vote, 44-40. The IOC has allowed China to avoid human rights oversight. Beginning with the 2024 Paris Olympics, host cities must adhere to the U.N. Guiding Principles on Business and Human Rights. But China was not subject to those rules when it was picked in 2015. “When China hosts the Olympics again, it is no longer the China back in 2008,” dissident Chinese artist Ai Weiwei said in an email to The AP. Ai helped design the famous Bird’s Nest stadium that was used in the 2008 Games — hoping it would signify a new openness — and then regretted doing so, calling it and the Olympics China’s “fake smile.” Ai was jailed in 2011 in China on unspecified charges and now lives in exile in Portugal. The Bird’s Nest will again host the opening ceremony on Feb. 4. “China today has deviated further away from democracy, freedom of press and human rights, and the reality has become even harsher,” Ai added. China’s tone has toughened since the last time it hosted the Games. In 2008, Beijing put some curbs on broadcasting from Tiananmen Square but allowed it; agreed to “protest zones,” though they were never used, with access repeatedly denied; and dropped some reporting restrictions more than a year ahead of the Games. It also unblocked its censored internet for journalists. In 2022, there is less accommodation. The pandemic will limit journalists to a tightly sealed “bubble,” though there will be internet access. Chinese organizers have warned foreign athletes that any statement that goes against Chinese law could be punished. And a smartphone app widely used by athletes and reporters has glaring security vulnerabilities, according to an internet watchdog. Some national Olympic committees have advised teams and staff not to take personal phones or laptops to Beijing. The IOC, which generates billions from sponsorships and broadcast rights, seldom pushes back in public against Chinese organizers who are, in reality, the Chinese government. Some of the changes that affect 2022 began a month after the 2008 Olympics ended, when the global financial crisis hit. China fared better than most countries,

which increased its confidence. China has since seen the rise of Xi Jinping, who headed the 2008 Olympics and was named general secretary of the Communist Party in 2012. “Although Xi was in charge of 2008 Olympic Games, the Winter Games is truly Xi’s Games,” said Xu Guoqi, who teaches history at the University of Hong Kong. He is the author of “Olympic Dreams: China and Sports, 1895-2008.” Mary Gallagher, director of the Center for Chinese Studies at the University of Michigan, said the state of U.S. democracy and its “poor pandemic response” have further emboldened China. “Right now the multiple U.S. failures create momentum for renewed nationalism and confidence in China,” Gallagher said by email. “This is made all the more effective by the Communist Party’s strict control over information, which can rain ‘positive energy’ down on what’s happening in China while only publicizing negative accounts of other countries, especially the U.S.” China complained in 2008 that human rights protests around Tibet politicized the Olympics. The Olympic Torch Relay, taken on a world tour, faced violent protests in London and elsewhere. The IOC has not tried such a relay since. China, which has called the allegations of human rights abuses the “lie of the century,” says mixing sports and politics goes against the Olympic Charter. IOC President Thomas Bach has likewise used that principle as a shield against critics. But others see hypocrisy on China’s part. “Sports and politics do mix,” Laura Luehrmann, a China specialist at Wright State University, said in an email. “Politics is about the distribution and use of limited resources – most notably power and decision-making, but also finances as well. Sports is all about power and money – even if framed as glorifying athletic achievement.” Victor Cha, who served in the White House under President George W. Bush and is the author of “Beyond the Final Score — The Politics of Sport in Asia,” said China’s moaning about others politicizing sports is “the pot calling the kettle black.” “There is no country that has ignored the Olympic Charter’s mandate to keep politics out of sports more than China,” Cha, who teaches at Georgetown University, wrote in an essay last week for the Center for Strategic & International Studies. “Much as the world would like the Olympics to be devoid of politics, as George Orwell once wrote: ‘Sport is war minus the shooting.’”
